Pension Security Act of 2002

Pension Security Act of 2002 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to require individual account plans, including those with cash or deferred arrangements under IRC section 401(k), to furnish quarterly pension benefit statements to plan participants and beneficiaries with rights to direct investments. Requires individual account plan administrators to give 30 days notice (except in specified circumstances) to plan participants and beneficiaries before a period (lockdown, blackout) in which their ability to divest or diversify assets control over their account assets will be limited. Provides that, during such lockdown periods, employers are not exempt from liability for failing in fiduciary duty with respect to individual account plan investments; but states that this loss of exemption from liability is not triggered by any limitations or restrictions on employee ability to divest or diversify assets, if such limitations or restrictions are disclosed to participants and beneficiaries through summary plan description or materials describing specific investment alternatives under the plan. Amends ERISA and IRC to prohibit individual account plans from acquiring or holding employer securities with respect to which there is any restriction on divestment by a participant or beneficiary after the participant has completed three years of plan participation. Exempts employee stock ownership plans (ESOPS) from this prohibition. Allows ERISA prohibited transaction exemptions under specified conditions to: (1) a fiduciary adviser's providing certain investment advice to an employee benefit plan or to a participant or beneficiary of such plan; (2) sale, acquisition, or holding of securities or other property (including any lending of money or other extension of credit associated with these) pursuant to such advice; and (3) direct or indirect receipt of fees or other compensation by the fiduciary adviser or an affiliate in connection with providing such advice. Amends the Securities Exchange Act of 1934 to prohibit certain insider trading during pension plan transaction suspension periods.

Amends SSA title XIX to provide for expanded coverage of low-income Medicare beneficiaries under Medicaid. Amends SSA title XVIII to provide for: (1) coverage of low-income Medicare beneficiaries in Medicare+Choice; and (2) low-income Medicare beneficiaries to elect to suspend Medicare supplemental (Medigap) insurance.

National Aviation Capacity Expansion Act - Directs the Administrator of the Federal Aviation Administration to implement the redesign and reconstruction of Chicago O'Hare International Airport in Cook and DuPage Counties, Illinois, in accordance with a specified runway redesign plan, and the development of a south suburban airport in the Chicago metropolitan region, by facilitating approval, funding, construction, and implementation of such plan and suburban airport. Requires all environmental reviews, analyses, and opinions related to issuance of permits, licenses, or approvals relating to such plan or airport to be conducted on an expedited basis. States that approval by the Administrator of an airport layout plan submitted by Chicago that includes the runway redesign plan shall: (1) provide that any runway located more than 2500 feet south of existing runway 9R-27L shall not begin construction before January 2011; and (2) be subject to the condition that noise impact of aircraft operations at O'Hare after the year in which the first new runway is first used will be less than that in 2000. Prohibits the consideration of such a plan unless it includes public roadway access through the western boundary of O'Hare to passenger terminal and parking facilities. Directs the Administrator to give priority consideration to a letter of intent application submitted by the State of Illinois (or a political subdivision thereof) for construction of the suburban airport. Sets forth requirements regarding the construction of the runway redesign plan as a Federal project on or after July 1, 2004. Requires the withholding of all airport grant funds for O'Hare (other than grants involving national security and safety) until January 1, 2026, unless specified conditions with respect to operations at Merrill C. Meigs Field have been met.

Includes within: (1) "required primary health services" appropriate cancer screening (currently, screening for breast and cervical cancer), specialty referral when medically indicated, and specified housing-related services; and (2) "additional health services" behavioral and mental health substance abuse services. Permits grants to health centers for the planning and development of management networks. Rewrites PHSA provisions regarding rural health. Provide grants for expanded delivery of health care services in rural areas, for the planning and implementation of integrated health care networks in rural areas, and for the planning and implementation of small health care provider quality improvement activities. Telehealth Grant Consolidation Act of 2001 - Provides for the establishment: (1) of telehealth network and telehealth resource centers grant programs; and (2) an Office for the Advancement of Telehealth. Provides for grants to eligible entities to enable such entities to provide for improved emergency medical services in rural areas. Reauthorizes and rewrites PHSA provisions regarding the National Health Service Corps program. Prohibits an entity to which a Corps member is assigned from denying requested health services and discriminating in the provision of services because an individual is unable to pay. Provides for a community access demonstration program to improve the effectiveness, efficiency, and coordination of services for uninsured and underinsured individuals. Expands the availability of dental health services.

Directs the Secretary to: (1) maintain the Paul Coverdell National Acute Stroke Registry and Clearinghouse, including conducting and/or making available research concerning best practices for prevention, treatment, and rehabilitation; (2) make grants to States to establish statewide stroke prevention, treatment, and rehabilitation systems; and (3) develop a model curriculum for training emergency medical services personnel. Sets forth requirements for the State grant program, including matching funds, standards for care and facilities, central data reporting and analysis, special consideration for geographic areas with high rates of disability from stroke or significant need, and technical assistance. Authorizes the Secretary to make grants to develop and implement education programs for appropriate medical personnel with regard to newly developed diagnostics, technologies, and therapies for stroke prevention and treatment.

General Aviation Industry Reparations Act of 2001 - Directs the President to take certain actions to compensate general aviation entities for losses incurred by them as a result of the terrorist attacks on the United States on September 11, 2001, including to: (1) issue Federal credit instruments (including subsidy amounts for such instruments) to such entities; and (2) compensate them for direct losses incurred as a result of any Federal ground stop order issued by the Government and any incremental losses incurred as a direct result of such attacks. Authorizes the Air Transportation Stabilization Board to enter into agreements with one or more obligors to issue such instruments. Sets forth certain instrument and compensation requirements. Authorizes the Secretary of Transportation to provide insurance or reinsurance, or reimbursement of insurance costs increases, to a general aviation entity against loss or damage arising from the operation of nonmilitary aircraft while in the United States. Defines "general aviation entity" to mean any person (other than an air carrier) that operates nonmilitary aircraft or provides aviation services directly related to nonmilitary aircraft or nonmilitary airport operations or relies on direct or indirect access to U.S. airspace to conduct its primary business as determined by the Secretary. Includes fixed based operators, flight schools, manufacturers of general aviation products, and persons engaged in nonscheduled commercial aviation enterprises.

Directs the Medicare Payment Advisory Commission (MEDPAC) to study and report to Congress on replacing or modifying the use of the sustainable growth rate as a factor in determining the update for such payments such that the factor used more fully accounts for changes in the unit costs of providing physicians' services.

Combatting Illegal Gambling Reform and Modernization Act - Amends the Federal criminal code to revise provisions regarding interstate gambling. Increases the term of imprisonment for violations. Prohibits (with exceptions) any person engaged in a gambling business from knowingly using a communication facility for the transmission: (1) of bets or wagers, or betting information, in interstate or foreign commerce, within the special maritime and territorial jurisdiction of the United States, or to or from any place outside the jurisdiction of any nation regarding any transmission to or from the United States,; or (2) of a communication in such interstate or foreign commerce which entitles the recipient to receive money or credit as a result of bets or for information assisting in the placing of bets. Prohibits (with exceptions) any person engaged in a gambling business from knowingly accepting credit, an electronic fund transfer, a check, or the proceeds of certain other forms of financial transaction as the Secretary may prescribe in connection with the transmission of such a communication of information assisting the placing of bets. Lists exceptions, including certain: (1) transmissions of information assisting in the placing of bets (such as for use in news reporting); and (2) uses of communication facilities for the transmission of bets (e.g., where a State or Tribe has explicitly authorized such bets). Sets forth remedies for violations. Bars imposition of damages, penalties, or forfeiture against any person or entity for an act done in compliance with notice received from a law enforcement agency.

Requires the Under Secretary to assume responsibility for the screening of passengers and property on passenger aircraft in air transportation that originates in the United States or intrastate air transportation. Sets forth provisions requiring: (1) airport operators to establish air transportation security programs that also provide for a military presence at each airport, including at locations where passengers are screened; (2) the application of certain employment standards and training requirements to airport security personnel, including screeners of passengers and property; (3) the deployment of Federal air marshals on selected passenger flights; (4) specified enhanced aviation-related security measures, including allowing pilots to carry firearms in the cockpit of an aircraft; and (5) submission of passenger manifests from air carriers and foreign air carriers in foreign transportation. Establishes the Transportation Security Oversight Board to review and approve regulations issued by the Under Secretary with respect to transportation security matters. Authorizes airport operators to conduct threat assessments with regard to passenger vehicles parked within 300 feet of an airport terminal.

Air Piracy Reprisal and Capture Act of 2001 - Amends the Federal criminal code to expand provisions regarding: (1) piracy on the high seas to cover piracy in the skies and on land and, if death results, to authorize imposition of the death sentence; (2) arming or serving on privateers to increase penalties; (3) assault on a commander (as piracy) to cover assault on any airplane officer; (4) conversion or surrender of a vessel to cover aircraft and aircraft officers or service members and, if death results, to provide for the death sentence; and (5) corruption of seamen and confederating with pirates to cover aircraft and to increase penalties. Amends the Revised Statutes of the United States to expand the application of piracy laws to acts committed upon land or in the air. Modifies a provision regarding the commissioning of private vessels for seizure of piratical vessels to authorize the President to instruct the leader of any suitable entity operating under the authority of any letters of marque and reprisal granted by Congress, whether on the high seas, in the skies, or on land, to subdue, seize, and take persons and property, using force as necessary to defend the lives, liberties, and property of U.S. citizens. Deems: (1) property identified as subject to seizure under such a letter subject to confiscation and forfeiture; and (2) any person so identified as subject to seizure subject to court-martial jurisdiction and to transfer into U.S. custody.

Requires authorized outfitters to defend and indemnify the United States for costs or expenses associated with injury, death, or damage to any person or property caused by negligence or wanton disregard for persons or property arising out of an outfitter's activities. Requires outfitter permits to include a principal allocation of outfitter use and authorizes temporary permits to include such allocation. Authorizes the Secretary to adjust an allocation of use. Permits temporary allocations of use for up to two years and the renewal, transfer, or extension of such allocations. Requires the Secretary to: (1) develop a process for annual evaluation of the performance of authorized outfitters; and (2) renew an authorization at the outfitter's request, under appropriate conditions. Makes outfitter permits transferable to qualified transferees under specified conditions. Sets forth recordkeeping requirements for authorized outfitters. Requires the Secretary to: (1) grant authorized outfitters full access to administrative remedies; and (2) establish an expedited procedure for consideration of appeals. Entitles outfitters that hold existing permits, contracts, or other authorizations to issuance of permits under this Act if their recent performance was determined good, satisfactory, or acceptable, or the equivalent.

Requires the Secretary to accept a separate amount from: (1) the Savage Irrigation District equal to the current value of the remaining water supply payment obligation under certain contracts as full payment of such District's share of the construction of the Savage Unit; and (2) the Pick-Sloan Missouri Basin Program power beneficiaries equal to the current value of the aid-to-irrigation payment obligation as full payment of aid-to-irrigation associated with the Unit's construction. Provides related requirements regarding recreation management and Pick-Sloan pumping power service. Requires the Secretary to: (1) provide fish protection devices to prevent fish from entering the main canal of the Lower Yellowstone Irrigation Project and allow bottom dwelling fish species to migrate above the intake diversion dam on the Yellowstone River; and (2) conduct a monitoring plan to measure the effectiveness of such devices for a minimum of two years.

Rural Health Care Improvement Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act to provide for: (1) revision in the Medicare disproportionate share hospital (DSH) payment adjustment for rural hospitals equalizing DSH payment amounts; (2) a single, standardized amount under the Medicare inpatient hospital prospective payment system (PPS); (3) treatment of certain physician pathology services; (4) elimination of the 15 percent reduction in payment rates under the Medicare PPS for home health services; (5) a permanent increase in the Medicare payment amount for home health services furnished in a rural area; and (6) exclusion of certain rural health clinic services and federally qualified health center services from the PPS for covered skilled nursing facility services. Amends the Public Health Service Act (PHSA) to establish: (1) a capital infrastructure revolving loan program under which the Secretary of Health and Human Services may make described loans to any rural entity for projects for capital improvements from the loan and loan guarantee fund under PHSA; (2) a high technology acquisition grant and loan program under which the Secretary may award grants and make loans to any eligible entity for any costs incurred by the eligible entity in acquiring eligible equipment and services for improving the quality of health care in rural areas; and (3) a program of grants to eligible entities under which the Secretary shall award such grants to public or nonprofit private entities to establish telehealth resource centers for the health care needs of individuals in rural areas. Amends the Internal Revenue Code to exclude from gross income for income tax purposes any payments received under the National Health Service Corps Loan Repayment Program.

National Monument Fairness Act of 2001 - Revises Federal law with respect to a presidential proclamation that, during one calendar year, either creates a national monument that is more than 50,000 acres or that adds more than 50,000 acres to an existing national monument. Prohibits the issuance of such a proclamation until 30 days after the President has transmitted the proposed proclamation to the Governor of the State or States in which such acreage is located, soliciting written comment. Makes any such proclamation ineffective two years after its issuance unless Congress has approved it by law. Requires the President: (1) to solicit public participation and comment in the development of a monument proclamation; (2) to consult with the Governor and entire congressional delegation of the State or territory in which such lands are located at least 60 days before any national monument proclamation; and (3) before issuing it, to consider any information, including public comments, made available in the development of existing plans and programs for the management of the lands under consideration. Requires any management plan for a national monument developed subsequent to a proclamation made under this Act to comply with the procedural requirements of the National Environmental Policy Act of 1969.
