Daniel Anderl Judicial Security and Privacy Act of 2020 This bill addresses the security of active and retired federal judges and their immediate families, including by limiting the release of these protected individuals' personally identifiable information. Specifically, federal agencies may not publicly post a protected individual's personally identifiable information. Furthermore, upon receiving a written request from a protected individual, an agency must within 72 hours remove any such information relating to the individual that has already been posted. The Department of Justice must award grants to state and local governments to help prevent the release of protected individuals' personally identifiable information. Additionally, data brokers may not sell the personally identifiable information of a protected individual. Upon receiving a written request from a protected individual, a private party (1) shall not publicly disclose personally identifiable information relating to the individual, and (2) must remove any such information already posted on the internet. A protected individual may sue to enforce the bill's provisions. The bill also authorizes additional security for protected individuals, including by providing home intrusion detection systems and expanding the availability of U.S. Marshals Service protection.

Informed Consent Act This bill establishes a new criminal offense for knowingly performing an abortion or sterilization procedure without obtaining informed consent, unless the procedure is necessary to save an individual's life or otherwise prevent substantial impairment of a major bodily function. An individual who performs these procedures absent informed consent is subject to criminal penalties—a fine, a prison term of up to 10 years, or both.

This bill establishes funding for, expands, and provides additional economic assistance to small businesses in response to COVID-19 (i.e., coronavirus disease 2019). Specifically, the Small Business Administration is authorized to provide second draw loans of up to $2 million under the Paycheck Protection Program. A recipient shall be eligible for forgiveness of a second draw loan in the same manner as an initial paycheck protection loan. Further the bill modifies the Paycheck Protection Program by, among other things, (1) expanding forgivable expenses, (2) allowing borrowers to select an eight-week period through December 31, 2020, to use their paycheck protection loan, (3) simplifying the forgiveness application for smaller loans, (4) expanding eligibility to certain chambers of commerce and destination marketing organizations, and (5) establishing a specific loan calculation for farmers and ranchers.

This resolution supports the announcements of (1) the establishment of full diplomatic relations between Israel and the United Arab Emirates and between Israel and Bahrain, and (2) the suspension of Israeli actions to apply sovereignty in parts of the West Bank. Further, it calls on each of these countries to encourage greater people-to-people normalization, and it calls on other Arab and Muslim countries to establish full relations with Israel. It also reaffirms the House of Representatives' support for a negotiated, two-state solution to the Israeli-Palestinian conflict.

Criminal Judicial Administration Act of 2020 This bill expands the authority of a judge to provide transportation and related expenses to a defendant to travel to a federal criminal court proceeding and also authorizes a magistrate judge to rule on post-judgment motions in certain criminal cases. (A magistrate judge assists a district court judge and exercises certain authority delegated by the district court judge to the magistrate judge, such as conducting trials in certain misdemeanor cases if the defendant consents.)

Help Independent Tracks Succeed Act or the HITS Act This bill permits taxpayers to treat as currently deductible expenses the cost of qualified sound recording productions not exceeding $150,000 in a taxable year. The bill defines qualified sound recording production as certain sound recordings produced and recorded in the United States.

Flexible Financing for Rural America Act of 2020 This bill allows rural utility service providers to submit to the Department of Agriculture (USDA) a request to adjust the interest rate or modify the terms of certain loans. The request shall include a report summarizing how the adjustment or modification will assist the borrower in providing critical utility services to a rural community. Specifically, on receipt of a request, USDA must adjust the interest rate on the loan to match certain interest rates in effect when the bill is enacted for obligations of comparable maturity to the term remaining on the loan (or a higher rate requested by the borrower), and make modifications to the loan terms as necessary to address changes in the financial position of the borrower due to the COVID-19 (i.e., coronavirus disease 2019) public health emergency and to promote the financial sustainability of the borrower. In carrying out the adjustments or modifications, USDA shall not impose or collect any fee from, or impose any penalty on, a borrower. The bill also provides funding to implement the adjustments and modifications.

Just and Unifying Solutions To Invigorate Communities Everywhere Act of 2020 or the JUSTICE Act This bill addresses policies and issues regarding policing practices and law enforcement accountability. The bill funds state and local grants, incentivizes state and local reporting on the use of certain policing practices, creates new federal offenses for certain misconduct, establishes a commission to study the conditions affecting Black men and boys, and establishes best practices and training requirements.

Patents for Humanity Program Improvement Act This bill authorizes the holder of an acceleration certificate awarded under the Patents for Humanity program to transfer the certificate to another party. (The Patents for Humanity program recognizes patent owners, applicants, and licensees that use their inventions to meet humanitarian challenges. The winners each receive a certificate which can be used to accelerate certain U.S. Patent and Trademark Office proceedings, such as a patent application.)

Promoting Alzheimer's Awareness to Prevent Elder Abuse Act This bill requires the Department of Justice (DOJ) to review and update, if necessary, certain best practices, replication guides, and other training materials for law enforcement, judicial officials, and others whose work may bring them in contact with elder abuse. Specifically, DOJ must address victims and witnesses who have Alzheimer's disease and related dementias in these materials. Additionally, in creating or compiling these materials, DOJ must consult with the Department of Health and Human Services and, as appropriate, other entities with relevant expertise in elder abuse.

Trademark Modernization Act of 2020 or the TM Act of 2020 This bill makes several changes to trademark law, such as by providing new mechanisms for opposing and canceling trademark registrations at the Patent and Trademark Office (PTO) and by making it easier to secure an injunction. The bill authorizes a third party to submit evidence to the PTO to oppose an application for a federal trademark registration. The bill establishes a procedure for any party to petition the PTO to expunge a registration for a trademark that has not been used in commerce. The bill also establishes a procedure for any party to petition the PTO to reexamine any trademark registration on such nonuse grounds. The PTO may also initiate such an expungement or reexamination proceeding. If a plaintiff has prevailed in court in asserting certain trademark rights, that plaintiff shall be entitled to a presumption that the plaintiff will suffer irreparable harm for purposes of determining whether the plaintiff is entitled to a permanent injunction. If a trademark plaintiff is seeking a preliminary injunction, that plaintiff is entitled to this presumption upon a court finding that the plaintiff is likely to succeed on the merits of the case. Under current law, a plaintiff must establish irreparable harm to secure an injunction. The Government Accountability Office shall report to Congress on PTO efforts to address false and inaccurate claims in trademark registrations and applications.

Stopping Harmful Offers on Platforms by Screening Against Fakes in E-commerce Act of 2020 or SHOP SAFE Act of 2020 This bill establishes that an electronic commerce platform shall be liable for trademark infringement by a third-party seller of goods that implicate health and safety unless the platform takes certain actions. Specifically, the platform may be contributorily liable if the seller uses a counterfeit mark in connection with selling, offering, or advertising such goods on the platform. The platform may avoid such liability by taking certain actions, including (1) requiring the seller to be available for service of process in the United States, (2) verifying the seller's identity and contact information, (3) requiring the seller to agree to not use counterfeit marks with goods sold on the platform, (4) implementing technical measures to prescreen listings on the platform and remove listings for goods being sold with a counterfeit mark, and (5) implementing policies to remove and ban repeat offenders.

Alabama Black Belt National Heritage Area Act This bill establishes the Alabama Black Belt National Heritage Area in Alabama, consisting of land in Bibb, Bullock, Butler, Choctaw, Clarke, Conecuh, Dallas, Greene, Hale, Lowndes, Macon, Marengo, Monroe, Montgomery, Perry, Pickens, Sumter, Washington, and Wilcox Counties. The Center for the Study of the Black Belt at the University of West Alabama shall prepare and submit a management plan for the heritage area.

Judicial Branch Senior Executive Leave Efficiency and Modernization Act of 2020 This bill allows certain senior level employees within the judicial branch to accumulate up to 90 days of unused annual leave for use in succeeding years. Under current law, such employees may accumulate only up to 30 days.

Working Families Flexibility Act of 2020 This bill revises requirements for the receipt of compensatory time off for private sector employees. Specifically, the bill authorizes private employers to provide compensatory time off to their employees at a rate of one and one-half hours for each hour of employment for which overtime compensation otherwise is required; employees may accrue a maximum of 160 hours of compensatory time. Employers are prohibited from interfering with an employee's right to or not request compensatory time off in lieu of payment of overtime compensation or from requiring an employee to use such compensatory time, and must give their employees 30-days notice before discontinuing a compensatory time policy. Employers are liable to employees for damages from violations of these requirements.

Lower Costs, More Cures Act of 2019 This bill establishes and modifies several requirements to address prescription drug prices under Medicare, Medicaid, and other programs. The bill generally limits payment amounts for drugs and biologics under Medicare medical services, reduces cost-sharing under the Medicare prescription drug benefit, modifies certain authorities and requirements under the Medicaid Drug Rebate Program, revises provisions relating to regulatory approval and commercial availability of generics and biosimilars, and establishes several reporting requirements for drug manufacturers with respect to drug prices.

Artistic Recognition for Talented Students Act or the ARTS Act This bill directs the Copyright Office to waive various copyright registration-related fees for works that win certain competitions sponsored by the Congressional Institute or established by Congress. To qualify for the fee waiver, the copyright registration application must be filed within a specified time frame, but the Copyright Office may waive fees for a qualifying work even if the application is filed outside the time frame.

Dignity for Aborted Children Act This bill requires abortion providers to offer patients specified options concerning the human fetal tissue from an abortion. Specifically, patients must be given an informed consent form specifying the options to (1) take possession of the tissue for transfer to an entity that provides interment or cremations services, or (2) in cases where the tissue is expelled on the provider’s premises, release the tissue to the provider. If the tissue is released to the abortion provider, the provider must ensure the tissue is interred or cremated within seven days of the procedure in a manner consistent with state law regarding the disposal of human remains. Abortion providers must report annually about the aggregate number of abortions performed and other specified information. The bill provides civil or criminal penalties for violations of disposal, informed consent, and reporting requirements.
