Strengthening America's Satellite Industry Act

Strengthening America's Satellite Industry Act - Expresses the sense of Congress that the President should increase U.S. diplomatic efforts to strengthen arms export controls to ensure that such controls are supportive of U.S. arms export controls, particularly with respect to countries of concern to the United States. Requires the President to report annually to Congress for five years regarding such diplomatic activities. Amends the Foreign Assistance Act of 1961 to require that information regarding certain defense items exported without a license under the Arms Control and Export Act be included in the annual military assistance report. Amends the Arms Export Control Act to direct the President to report to Congress, by country and by international organization, regarding the total dollar value of major defense equipment and defense articles exported pursuant to licenses for the previous fiscal year. Authorizes the President to remove satellites and related components from the United States Munitions List, except for any satellite or related component that may be transferred to, or launched into outer space by, the People's Republic of China (PRC). Directs the Inspector General of the Department of State to: (1) review Department investigations of possible misuse of U.S.-origin defense items, and (2) and report to Congress. Directs the Secretary of State to report to Congress regarding placing the export licensing functions of the Department's Directorate of Defense Trade Controls on a self-financing basis.

Safe Schools Improvement Act of 2011 - Amends the Elementary and Secondary Education Act of 1965 to require states, on an ongoing basis, to: (1) collect and report certain information on bullying and harassment by youth in their elementary and secondary schools and communities; (2) conduct, and report the results of, a needs assessment for bullying and harassment prevention programs; and (3) provide technical assistance to local educational agencies (LEAs) and schools in their efforts to thwart bullying and harassment. Requires LEAs to: (1) include clear prohibitions against bullying and harassment within their discipline policies; (2) establish and monitor performance indicators for incidents of bullying and harassment; and (3) establish grievance procedures students, parents, and educators can use to redress such conduct. Directs LEAs to notify parents, students, and educators annually on: (1) the bullying and harassment prohibited by their discipline policies, (2) the numbers and nature of bullying and harassment incidents for each of their schools, and (3) grievance procedures for redressing such conduct. Requires: (1) the Secretary of Education to conduct, and report on, an independent biennial evaluation of programs to combat bullying and harassment in elementary and secondary schools; and (2) the Commissioner for Education Statistics to collect data, that are subject to independent review, to determine the incidence and prevalence of bullying and harassment in elementary and secondary schools in this country.

Paycheck Fairness Act

Paycheck Fairness Act - Amends the portion of the Fair Labor Standards Act of 1938 (FLSA) known as the Equal Pay Act to revise remedies for, enforcement of, and exceptions to prohibitions against sex discrimination in the payment of wages. Revises the exception to the prohibition for a wage rate differential based on any other factor other than sex. Limits such factors to bona fide factors, such as education, training, or experience. States that the bona fide factor defense shall apply only if the employer demonstrates that such factor: (1) is not based upon or derived from a sex-based differential in compensation, (2) is job-related with respect to the position in question, and (3) is consistent with business necessity. Makes such defense inapplicable where the employee demonstrates that: (1) an alternative employment practice exists that would serve the same business purpose without producing such differential, and (2) the employer has refused to adopt such alternative practice. Revises the prohibition against employer retaliation for employee complaints. Prohibits retaliation for inquiring about, discussing, or disclosing the wages of the employee or another employee in response to a complaint or charge, or in furtherance of a sex discrimination investigation, proceeding, hearing, or action, or an investigation conducted by the employer. Makes employers who violate sex discrimination prohibitions liable in a civil action for either compensatory or (except for the federal government) punitive damages. States that any action brought to enforce the prohibition against sex discrimination may be maintained as a class action in which individuals may be joined as party plaintiffs without their written consent. Authorizes the Secretary of Labor (Secretary) to seek additional compensatory or punitive damages in a sex discrimination action. Requires the Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs to train EEOC employees and affected individuals and entities on matters involving wage discrimination. Authorizes the Secretary to make grants to eligible entities for negotiation skills training programs for girls and women. Directs the Secretary and the Secretary of Education to issue regulations or policy guidance to integrate such training into certain programs under their Departments. Directs the Secretary to conduct studies and provide information to employers, labor organizations, and the general public regarding the means available to eliminate pay disparities between men and women. Establishes the Secretary of Labor's National Award for Pay Equity in the Workplace for an employer who has made a substantial effort to eliminate pay disparities between men and women. Amends the Civil Rights Act of 1964 to require the EEOC to collect from employers pay information data regarding the sex, race, and national origin of employees for use in the enforcement of federal laws prohibiting pay discrimination. Directs: (1) the Commissioner of Labor Statistics to continue to collect data on woman workers in the Current Employment Statistics survey, (2) the Office of Federal Contract Compliance Programs to use specified types of methods in investigating compensation discrimination and in enforcing pay equity, and (3) the Secretary to make accurate information on compensation discrimination readily available to the public. Directs the Secretary and the Commissioner [ sic ] of the EEOC jointly to develop technical assistance material to assist small businesses to comply with the requirements of this Act.

Great Ape Protection and Cost Savings Act of 2011 - Prohibits: (1) conducting invasive research on great apes; (2) possessing, maintaining, or housing a great ape for the purpose of conducting invasive research; (3) using federal funds to conduct such research on a great ape or to support an entity conducting or facilitating invasive research on a great ape either within or outside of the United States; (4) knowingly breeding a great ape for the purpose of conducting or facilitating such research; (5) transporting, moving, delivering receiving, leasing, renting, donating, purchasing, selling, or borrowing a great ape in interstate or foreign commerce for conducting or facilitating such research; and (6) transferring federal ownership of a great ape to a non-federal entity unless the entity is a suitable sanctuary. Defines "great ape" as any chimpanzee, bonobo, gorilla, orangutan, or gibbon. Defines "invasive research" as research that may cause death, injury, pain, distress, fear, or trauma to great apes, including drug testing or exposure to a substance or isolation, social deprivation, or other experimental manipulations that may be detrimental to the ape's health or psychological well-being. Requires the Secretary of Health and Human Services (HHS) to effectuate the permanent retirement of all great apes that are owned by the federal government and that are being maintained in any facility for the purpose of breeding for, holding for, or conducting invasive research. Sets forth civil penalties for violations of this Act. Establishes in the Treasury the Great Ape Sanctuary System Fund to be administered by the Secretary for construction, renovation, and operation of  the sanctuary system for surplus chimpanzees.

SDHV Energy Efficiency Standards for America Act of 2011 - Amends the Energy Policy and Conservation Act (EPCA) to revise energy conservation standards for central air conditioners and central air conditioning heat pumps by requiring: (1) the seasonal energy efficiency ratio of small-duct, high-velocity systems to be no less than 11.00 for products manufactured on or after January 23, 2006; and (2) the heating seasonal performance factor of such systems to be 6.8 for products manufactured on or after such date. Defines "small-duct, high-velocity systems" to mean a heating and cooling product that contains a blower and indoor coil combination that: (1) is designed for, and produces, at least 1.2 inches of external static pressure when operated at the certified air volume rate of 220-350 cubic feet per minute per rated ton of cooling; and (2) when applied in the field, uses high velocity room outlets generally greater than 1,000 feet per minute that have less than 6.0 square inches of free area. Authorizes the Secretary of Energy (DOE) to amend by rule the standards established for such systems. Prohibits amended standards from taking effect less than five years after the final rule making the amendment is published. Requires the Secretary to determine whether standards for such systems should be amended no later than June 30, 2012.

Lung Cancer Mortality Reduction Act of 2011 - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS) to implement a comprehensive program to achieve a 50% reduction in the mortality rate of lung cancer by 2020. Requires the program to include initiatives throughout HHS, including: (1) a strategic review and prioritization by the National Cancer Institute of research grants; (2) the establishment by the Food and Drug Administration (FDA) of quality standards and guidelines for facilities that conduct computed tomography screening for lung cancer; and (3) the provision of funds to the Centers for Disease Control and Prevention (CDC) to establish a Lung Cancer Early Detection Program that provides low-income, uninsured, and underserved populations that are at high risk for lung cancer access to early detection services. Requires the Secretary of Defense (DOD) and the Secretary of Veterans Affairs (VA) to coordinate with the Secretary of HHS in implementing this Act and implementing coordinated care programs for military personnel and veterans diagnosed with lung cancer. Requires the Secretary of HHS to establish: (1) the Lung Cancer Computed Tomography Screening and Treatment Demonstration Project; and (2) the Lung Cancer Advisory Board to monitor the programs established under this Act.

Fair Elections Now Act - Amends the Federal Election Campaign Act of 1971 (FECA) with respect to: (1) candidate benefits of fair elections financing of House of Representatives election campaigns; (2) allocations to candidates from the Fair Elections Fund established by this Act; (3) 500% matching payments to candidates for certain small dollar contributions; (4) Fund allocation eligibility requirements; (5) certification of a federal election candidate as a participating candidate; (6) contribution, expenditure, and fundraising requirements; (7) a public debate requirement; (8) remission to the Fair Elections Fund of unspent funds after an election; (9) establishment of the Fair Elections Fund and of a Fair Elections Oversight Board; (10) civil penalties for violation of contribution and expenditure requirements; and (11) transfer of a portion of collected civil money penalties into the Fair Elections Fund. Prohibits: (1) use of contributions by a participating candidate for any purposes other than an election campaign, and (2) establishment of joint fundraising committees with any political committee other than a candidate's authorized committee. Prescribes a limitation on coordinated expenditures by political party committees with participating candidates. Amends FECA to empower the Federal Election Commission (FEC) to petition the U.S. Supreme Court for a writ of certiorari to appeal a civil action. Requires all designations, statements, and reports required to be filed under FECA to be filed: (1) directly with the FEC, and (2) in electronic form accessible by computers. Reduces from 48 hours to 24 hours after their receipt the deadline for the FEC to make designations, statements, reports, or notifications available to the public in the FEC office and on the Internet.

Requires the Office of Personnel Management (OPM): (1) within six months after enactment of this Act, to determine (or, if applicable, redetermine) the amount of such surplus or liability as of the close of the most recently ending fiscal year using the methodology required under this Act; and (2) if the result is a surplus, to transfer the surplus amount to the Postal Service Retiree Health Benefits Fund within 15 days after the determination of a surplus. Provides for an alternate determination of an USPS surplus or supplemental liability for FY2016-FY2020. Requires transfer of certain surplus postal retirement contributions in FY2011 to the Postal Service Retiree Health Benefits Fund or the Employees' Compensation Fund under the Federal Employees' Compensation Act (FECA). Expresses the intent of Congress that this Act shall apply to allocations of past, present, and future benefit liabilities between the USPS and the Treasury.

Repeals also the windfall elimination requirement with respect to computation of an individual's primary insurance amount under which OASDI retirement or disability benefits are reduced if the individual receives a federal, state, or local government pension, did not pay Social Security taxes during the years of government service, and so did not earn entitlement to Social Security benefits for those years.

Stop Trading on Congressional Knowledge Act - Amends the Securities Exchange Act of 1934 and the Commodity Exchange Act to direct both the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) to prohibit purchase or sale of either securities, security-based swaps, or commodities for future delivery or swap by a person in possession of material nonpublic information regarding pending or prospective legislative action if the information was obtained: (1) knowingly from a Member or employee of Congress, (2) by reason of being a Member or employee of Congress, or (3) from other federal employees and derived from their federal employment. Amends the Code of Official Conduct of the Rules of the House of Representatives to prohibit any Member, officer, or employee of the House from disclosing material nonpublic information relating to any pending or prospective legislative action relating to any publicly-traded company or to any commodity if such person has reason to believe that the information will be used to buy or sell the securities of that publicly traded company or that commodity for future delivery based on such information. Directs both the Committee on Agriculture and the Committee on Financial Services of the House of Representatives to hold hearings on the implementation by the CFTC and the SEC of such financial transaction prohibitions. Amends the Ethics in Government Act of 1978 to require formal disclosure of certain securities and commodities futures transactions to either the Clerk of the House of Representatives or the Secretary of the Senate. Amends the Lobbying Disclosure Act of 1995 to subject to its registration, reporting, and disclosure requirements, as well as requirements for identification of clients and covered legislative and executive officials, all political intelligence activities, contacts, firms, and consultants. Requires the Comptroller General to include political intelligence activities, contacts, firms, and consultants in its annual compliance audits and reports.

Makes this Act applicable to any action pending on or commenced after January 1, 2002. Directs the Secretary of State to report to Congress on the extent to which the public has access to records, including archived information, with respect to the deportation of such persons to Nazi concentration camps on such trains.

Requires the Director of the National Office for Cyberspace to: (1) oversee information security policies and practices, (2) establish a national program to instruct students in cybersecurity education and computer literacy; (3) review federal agency budgets relating to the protection of information infrastructures, and (4) ensure the operation of a central federal information security incident center. Requires each federal agency to perform an annual independent audit of its information security programs and practices and submit the results of such audit to the Director. Requires the Secretary of Commerce, on the basis of proposed standards developed by the National Institute of Standards and Technology (NIST), to promulgate information security standards pertaining to federal information systems. Prohibits any agency from entering into a contract, an order under a contract, or an interagency agreement for information technology without including requirements for effective information security that supports the operations and assets of that agency. Requires the Director of the Office of Management and Budget (OMB) to require each agency to conduct an initial vulnerability assessment for any major information system. Establishes in the Executive Office of the President the Office of the Federal Chief Technology Officer. Includes among the duties of such Officer: (1) advising the President and agency officials on information technology infrastructures, strategy, and use; (2) leading an interagency effort to ensure the use of best-in-class technologies; (3) promoting technological innovation in the federal government; (4) establishing public-private sector partnership initiatives; and (5) gathering information on significant developments and trends in information technology. Grants the Secretary of Homeland Security primary authority for the protection of the critical information infrastructure, as defined by this Act.

Sets a deadline for the Board to make revisions to any proposed or final rule regarding such EDTs if at least two of the agencies contributing to such report determine that any one of the following is true: (1) either such requirements or the Board's proposed rule entitled "Debit Card Interchange Fees and Routing" does not encompass all costs and investments associated with debit card transactions; (2) consumers will be adversely affected by either the requirements or the proposed rule; or (3) the current exemption of small financial institutions (with less than $10 billion in assets) from such requirements, or as carried out by the proposed rule, is not effective in practice.

Requires the Secretary, acting through the Director of the Agency for Healthcare Research and Quality and the Assistant Secretary for Preparedness and Response, to develop guidelines or best practices for the evacuation of intensive care units during a national health emergency, including a pandemic or natural disaster, that ensure the safe and effective evacuation of all individuals regardless of age, disability, or life expectancy. Requires the Secretary to establish the Panel on Emergency Preparedness Databases to: (1) assess the adequacy of existing national preparedness databases in facilitating effective and coordinated medical responses during a national health emergency; (2) identify gaps in existing information networks; and  (3) recommend specific ways to improve awareness of the availability of resources before, during, and after an incident. Prohibits the Secretary from using any finding or recommendation developed under this Act in making coverage, reimbursement, or incentive determinations under any program in a a manner that precludes or discourages an individual from choosing a health care treatment based on how the individual values the tradeoff between extending the length of life and the risk of disability.

(Defines "covered policy" as any life, dowry, education, property, or other insurance policy that: (1) was in effect at any time between January 30, 1933, and December 31, 1945; and (2) was issued to a policyholder domiciled in any area occupied or controlled by Nazi Germany). Permits nationwide service of process in order to bring such civil action. Directs the court to award certain remedies to the prevailing beneficiary in such action. Prohibits any executive agreement between the United States and any foreign country from invalidating or preempting any state law creating a cause of action against an insurer or related company based upon a claim arising out of, or related to, a covered insurance policy by reason of either any specified executive foreign policy or specified executive agreement. Deems effective upon its enactment any state law enacted on or after March 1, 1998, which requires an insurer doing business in that state to disclose information regarding such covered policies. Prohibits any federal department or agency from expending funds for the purpose of issuing a statement of interest seeking to encourage a federal court to dismiss any claim or action brought to recover compensation arising out of or related to a covered policy. Prohibits a court from dismissing a claim or action brought under this Act within 10 years after its enactment on the ground that the claim or action is barred under any statute of limitations or the doctrine of laches.

Considers such a breeder of dogs to be a dealer. Requires dealers to include on licensing applications and annual renewals the total number of dogs exempted from exercise on the premises of the dealer in the preceding year by a licensed veterinarian. Requires the Secretary of Agriculture (USDA) to promulgate requirements for the exercise of dogs at facilities owned or operated by a dealer, including requiring daily access to exercise that: (1) allows the dogs to move sufficiently in a way that is not forced, repetitive, or restrictive; and (2) is in an area that is spacious, cleaned at least once a day, free of infestation by pests or vermin, and designed to prevent the dogs from escaping. Allows an exemption if: (1) a licensed veterinarian determines that a dog should not exercise because of the health, condition, or well-being of the dog; and (2) such determination is reviewed and updated at least once every 30 days by the veterinarian, unless the basis for the determination is a permanent condition. Subjects such a determination to review and approval by the Secretary.

Requires the Secretary to develop a primary care provider education program on pancreatic cancer. Requires the Director of NCI and the Director of the Centers for Disease Control and Prevention (CDC) to develop a communication tool kit for patients and their families that focuses on specific pancreatic cancer issues relating to patient choices and patient care. Allows the Secretary to award grants to research institutions for use in developing innovative compounds or technologies for the prevention, early detection, or treatment of those cancers with five-year survival rates of less than 50%. Requires the Secretary to focus on pancreatic cancer during the initial five fiscal years of awarding such grants. Allows the Secretary to designate two additional Specialized Programs of Research Excellence focusing solely on pancreatic cancer research.
