Constitution Restoration Act of 2004 - Amends the Federal judicial code to prohibit the U.S. Supreme Court and the Federal district courts from exercising jurisdiction over any matter in which relief is sought against an element of Federal, State, or local government or officer of such government by reason of that element's or officer's acknowledgment of God as the sovereign source of law, liberty, or government. Prohibits a court of the United States from relying upon any law, policy, or other action of a foreign state or international organization in interpreting and applying the Constitution, other than the constitutional law and English common law. Provides that any Federal court decision relating to an issue removed from Federal jurisdiction by this Act is not binding precedent on State courts. Provides that any Supreme Court justice or Federal court judge who exceeds the jurisdictional limitations of this Act shall be deemed to have committed an offense for which the justice or judge may be removed, and to have violated the standard of good behavior required of Article III judges by the Constitution.

First Amendment Restoration Act - Amends the Federal Election Campaign Act of 1971 to repeal: (1) a requirement that persons making disbursements for electioneering communications file reports on such disbursements with the Federal Election Commission; (2) a prohibition against the making of disbursements for electioneering communications by corporations and labor organizations; and (3) a provision treating coordinated communications as contributions.

Amends the Elementary and Secondary Education Act of 1965 to revise impact aid program provisions for distribution of school construction payments, and of school facility emergency and modernization grants, to local educational agencies impacted by military dependent children or by children residing on Indian lands.

Broadcast Decency Enforcement Act of 2004 - Amends the Communications Act of 1934 to provide that, if the violator of the terms and conditions of any Federal Communications Commission (FCC) license, permit, or certificate is either a broadcast station licensee or permittee or an applicant for a broadcast license, permit, or certificate, and such violator is determined by the FCC to have broadcast obscene, indecent, or profane language, the amount of forfeiture penalty shall not exceed $275,000 for each violation or day of such violation, to a maximum of $3 million for any single act or failure to act.

Resolves that: (1) the House of Representatives (House) does not support the lowering of standards or the weakening of the rules of the Federal Communications Commission (FCC) prohibiting obscene and indecent broadcasts to allow network or other communications to use language that is indecent or vulgar; (2) the FCC has a responsibility to utilize its enforcement authority to maintain those rules; and (3) the House will not allow the FCC to permit intrusion upon the family's ability to raise their children in an environment that is not inundated with indecent or profane language on our public airwaves.

Stock Option Accounting Reform Act - Amends the Securities Exchange Act of 1934 to require an issuer of registered securities to show as an expense in its mandatory annual report the fair value of all stock purchase options granted to certain of its senior executive officers after December 31, 2004. Exempts small business issuers from such requirement. Amends the Securities Act of 1933 to require reporting of: (1) stock option expenses as a reduction of the total expense in the fiscal year in which they expire or are forfeited; and (2) as income any excess by which such reduction exceeds total option expenses for any fiscal year. Requires any accounting principle recognized as "generally accepted" by the Securities and Exchange Commission (SEC) regarding the expensing of stock purchase options to comply with this Act. Denies recognition to any such accounting principle until the Secretaries of Commerce and of Labor complete a joint study on the economic impact of mandatory expensing of all employee stock options.

Deplores the development by Iran of a nuclear weapons program and the failure of the Government of Iran to report material, facilities, and activities to the International Atomic Energy Agency (IAEA) in contravention of its obligations under the safeguards convention it signed in connection with the Nuclear Non-Proliferation Treaty (Treaty). Concurs with the conclusion of the Department of State that Iran is pursuing a program to develop nuclear weapons. Calls on the President to use all appropriate means to prevent Iran from acquiring nuclear weapons, with particular attention to the needs of the IAEA for information and access, including information concerning gas centrifuges and the conduct of uranium conversion experiments. Calls on Russia to suspend all nuclear cooperation with Iran until Iran fully complies with a specified IAEA resolution, with particular attention to spent fuel. Calls on the IAEA to declare Iran in violation of the Treaty. Calls on the United Nations Security Council to consider immediately the passage of a Security Council resolution or the taking of other actions that may be necessary to impose diplomatic and economic sanctions against Iran if it fails to meet its obligations to the IAEA. Calls on the Government of Iran to cease all efforts to acquire nuclear fuel cycle capabilities and to end the enrichment and processing of uranium until it is able to provide specific, verifiable assurances that it is not engaged in a clandestine nuclear weapons program.

Amends the National Trails System Act to provide that, in the case of any donation, transfer, lease, sale, or other conveyance for interim use, such use shall not begin until the right to interim use has been acquired from each of the owners of the land underlying the right-of-way (and payment or deposit of compensation to those owners has been made): (1) in accordance with specified law, including the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970; and (2) consistent with any order of a court of competent jurisdiction in a condemnation proceeding.

Chiropractic Health Parity for Military Retirees and Dependents Act - Directs the Secretary of Defense, no later than July 31, 2004, to complete development of a plan to provide chiropractic health care services and benefits, as a permanent part of the TRICARE program (a Department of Defense managed health care program), for covered beneficiaries. Requires plan implementation by December 31, 2004.

RU-486 Suspension and Review Act of 2003 - Deems the approved application for the drug mifepristone (marketed as Mifeprex, commonly known as RU-486, and used for the chemically induced termination of intrauterine pregnancy) to have been suspended. Directs the Comptroller General to review and report on the process by which the Food and Drug Administration (FDA) approved mifepristone. Provides for the contingent reinstatement of such drug if the report determines the approval to have been in accordance with the Federal Food, Drug, and Cosmetic Act.

State Assistance Accountability Act - Amends title VI (Temporary State Fiscal Relief) of the Social Security Act to revise the provision concerning the limitation on temporary State fiscal relief, to permit the use of such funds only for types of expenditure authorized under: (1) the budget of the State for the fiscal year for which the funds are to be expended that, as of May 28, 2003, was most recently approved by the State legislature; or (2) in the absence of such a budget, the budget of the State for the fiscal year for which the funds are to be expended that, as of May 28, 2003, was at the furthest stage of development by the State legislature. Requires the Secretary to: (1) audit a State's use of such funds; and (2) require remittance of all inappropriately expended funds, plus a penalty and interest. Defines an "essential government service" as reduction in the amount of debt held or planned to be held by a State, and not any activity that was not funded by a State in its previous fiscal year.

Cold War Victory Medal Act - Directs the Secretary of the military department concerned, upon application, to issue Cold War Victory service medals to military personnel who served honorably during the Cold War era (September 2, 1945, through December 26, 1991).

Repudiates the anti-Semitic rhetoric of the outgoing prime minister of Malaysia, Dr. Mahathir Mohamad. Calls upon other governments and international bodies, notably the European Union, to condemn these remarks as dangerous incitement. Deplores the tacit acquiescence of those in attendance at the October 2003 Organization of the Islamic Conference.

Urges the Government of the Lao People's Democratic Republic, the United Nations, the European Union, and the Association of South East Asian Nations to work for: (1) unrestricted access to Laos by international election monitors and international human rights organizations; (2) the rights of opposition political parties and their candidates to run for public office and for all adult citizens of Laos to vote; (3) the right of the citizens to assemble, protest, and to organize; (4) the cessation of all acts of violence against the Hmong population; and (5) the release of those jailed in connection with the 1999 pro-democracy demonstrations.

Marine Corps 230th Anniversary Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue not more than 500,000 one dollar coins which shall be emblematic of the warrior ethos of the United States Marine Corps. Requires all surcharges from the sale of the coins to be paid to the Marine Corps Heritage Foundation for construction of the Marine Corps Heritage Center.

Keeping Families Together Act - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to award competitive grants to States to establish systems of individualized mental health treatment and family support services for children who are in custody or in danger of entering the custody of the state for the purpose of receiving mental health services. Requires eligible States to: (1) have laws or policies in effect that ensure that children receive appropriate mental health services so that parents do not have to relinquish legal custody of such children; (2) provide matching funds; (3) establish infrastructure for interagency cooperation and cross system financing; and (4) expand public health insurance programs to cover these services after the grant expires. Establishes a Federal interagency task force to examine mental health issues in the child welfare and juvenile justice systems and the role of their agencies in promoting access by children and youth to mental health services. Amends the Social Security Act to permit the use of the Medicaid home and community-based services waiver to provide mental health services to children and youths as an alternative to care in inpatient psychiatric hospitals.

Mobile Machinery Tax Fairness Act - Amends the Internal Revenue Code to prohibit the treatment of certain mobile machinery as a highway vehicle, thereby exempting such machinery from federal highway excise taxes.

Commission on the Accountability and Review of Federal Agencies Act - Establishes the Commission on the Accountability and Review of Federal Agencies to: (1) evaluate executive agencies and their programs; and (2) submit to Congress a plan recommending agencies and programs that should be realigned or eliminated and proposing implementing legislation. Directs the President to: (1) establish a systematic method for assessing the effectiveness and accountability of agency programs; and (2) submit to the Commission assessments of not less than half of the programs that use such method. Prohibits the implementation of such method until it has been reviewed and accepted by the Commission. Requires the Commission to consider submitted assessments in evaluating programs. Requires the President to identify common performance measures for programs having similar functions and provide the Commission with data on such measures.

Tax Reform Action Commission Act of 2003 - Establishes in the legislative branch a Tax Reform Action Commission to make specific recommendations to Congress for the reform of the internal revenue laws in a manner that produces a system that is: (1) simple, transparent, and efficient; (2) fair and equitable to all Americans; and (3) neutral between different activities and between current consumption and future consumption.

Benjamin Franklin Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue one dollar coins emblematic of the life and legacy of Benjamin Franklin (not more than 250,000 bearing his image as a young statesman and not more than 250,000 with his image as an older numismatist). Directs that all sales include a $10 per coin surcharge, which shall be paid by the Secretary to the Benjamin Franklin Tercentenary Commission, to be used to educate people about Franklin's legacy.

Directs the Secretary of Defense, in the case of a member of the armed forces serving outside the United States in Operations Iraqi Freedom or Enduring Freedom who is granted rest and recuperative leave and provided authorized travel and transportation allowances, to pay the member for transportation, or provide transportation for the member, not only between the overseas duty location and the currently authorized locations (a vacation site or a location in the United States), but, at the request of the member, between the currently authorized locations and the member's permanent duty station or home. Makes such allowance retroactive from September 20, 2003.

District of Columbia Personal Protection Act - Amends the District of Columbia Code to provide that the D.C. Council's regulatory authority regarding firearms, explosives, and weapons in the District shall not be construed to permit the Council, the Mayor, or any governmental or regulatory authority of the District to prohibit, constructively prohibit, or unduly burden the ability of persons otherwise permitted to possess firearms under Federal law from acquiring, possessing in their homes or businesses, or using for sporting, self-protection or other lawful purposes, any firearm neither prohibited by Federal law nor regulated by the National Firearms Act. Denies the District any authority to enact laws or regulations that discourage or eliminate the private ownership or use of firearms. Amends the Firearms Control Regulations Act of 1975 to repeal the definition of a machine gun as any firearm which shoots, is designed to shoot, or can be readily converted or restored to shoot semiautomatically, more than 12 shots without manual reloading. (Thus repeals the ban on semiautomatic weapons.) Repeals the District's: (1) registration requirement for possession of firearms; (2) prohibition on registration of pistols (handguns); (3) prohibition on possession of handgun ammunition; (4) requirement that, under certain conditions, firearms in the possession of certain individuals must be kept unloaded, disassembled, or with the trigger locked; (5) related firearm registration requirements such as applicant qualifications and filing deadline. Maintains the current ban on the possession and control of a sawed-off shotgun, machine gun, or short-barreled rifle. Eliminates criminal penalties for possessing an unregistered firearm. Amends Federal law to eliminate criminal penalties for carrying a pistol whether loaded or unloaded in one's dwelling house, place of business, or on land possessed by such person.

Safeguarding Our Religious Liberties Act - Declares that among those powers reserved to the States and their political subdivisions are the powers to display the Ten Commandments, to recite the Pledge of Allegiance, and to recite the national motto on or within property owned or administered by them. Declares that: (1) the Pledge of Allegiance shall be, "I pledge allegiance to the Flag of the United States of America, and to the Republic for which it stands, one Nation under God, indivisible, with Liberty and justice for all."; and (2) the national motto shall be, "In God we trust." Excepts from the jurisdiction of Federal courts inferior to the Supreme Court the display of the Ten Commandments and the use of the word "God" in the Pledge of Allegiance.

Renewable Fuels and Transportation Infrastructure Enhancement Act of 2003 - Amends the Internal Revenue Code to establish, for a limited period of time: (1) as a credit against the gasoline and diesel fuel excise tax, a credit equal to the sum of the alcohol fuel mixture credit plus the biodiesel mixture credit; and (2) a biodiesel fuels credit business credit.

Hearing Aid Assistance Tax Credit Act - Amends the Internal Revenue Code to allow a nonrefundable income tax credit of up to $500 for the purchase of a qualified hearing aid for an individual who is either: (1) age 55 or older; or (2) is claimed as a dependent of the taxpayer.

Right to Life Act - States that Congress declares that the right to life guaranteed by the Constitution is vested in each human being. Defines "human person" and "human being" as including each and every member of the species homo sapiens at all stages of life, including, but not limited to, the moment of fertilization, cloning, or other moment at which an individual member of the human species comes into being.

Increases from $6,000 to $12,000 the death gratuity paid upon the active-duty death of a member of the armed forces. Amends the Internal Revenue Code to exclude any such death gratuity from gross income.

Authorizes the superintendent of a military service academy to have in effect a policy of offering a voluntary, nondenominational prayer at an authorized academy activity, subject to such limitations as the President may prescribe.

Exempts from the requirement to pay subsistence charges while hospitalized in a military facility an officer or former officer, or an enlisted member or former enlisted member not entitled to retired or retainer pay or equivalent pay, who is hospitalized in a military facility because of an injury incurred: (1) as a direct result of armed conflict; (2) while engaged in hazardous service; (3) in the performance of duty under conditions simulating war; or (4) through an instrumentality of war.

Terrorist Penalties Enhancement Act of 2003 - Amends the Federal criminal code to require any person who, in the course of committing a terrorist offense, engages in conduct that results in the death of a person, to be punished by death or imprisoned for any term of years or life. Includes "terrorist offenses resulting in death" among the aggravating factors for homicide which are used in determining whether a death sentence is justified. Denies Federal benefits to any individual who is convicted of a Federal crime of terrorism, for any term of years or for life.

Amends title XVIII (Medicare) of the Social Security Act to provide for Medicare recognition of the services of respiratory therapists that are furnished as part-time or intermittent nursing care or physical therapy services under a plan of care for home health services. Directs the Secretary of Health and Human Services to study and report to Congress on the impact of paying for the services of respiratory therapists as a separate benefit under part B (Supplementary Medical Insurance) of Medicare, and as an explicit component of the several benefits under part A (Hospital Insurance) of Medicare.

Cord Blood Stem Cell Act of 2003 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration, to enter into contracts with qualified cord blood stem cell banks to assist in the establishment, provision, and maintenance of a National Network of Cord Blood Stem Cell Banks. Lists the purposes of qualifying donor banks and requirements qualifying donor banks must meet. Directs the Secretary, acting through the Administrator, to establish as part of the Network a National Cord Blood Stem Cell Registry. Sets forth the functions of the Registry, which shall include: (1) operating a system for identifying, acquiring, and distributing donated units or cord blood; and (2) maintaining a database with certain information, including the clinical outcomes of all transplantations related to the Network.

Home School Non-Discrimination Act of 2003 - Expresses the sense of the Congress that parents who choose private home education should be encouraged within the framework provided by the Constitution. Amends the Higher Education Act of 1965 (HEA) with respect to: (1) student aid eligibility of home-schooled students who have satisfied certain secondary education standards; and (2) institutional aid eligibility of the higher education institutions that such students attend. Amends the Individuals with Disabilities Education Act (IDEA) to provide, if a parent does not consent to an initial evaluation or special education or related services for a child with a disability, the local educational agency shall not be required to convene an individualized education program (IEP) meeting or develop an IEP for such child. Amends the Internal Revenue Code with respect to qualified elementary and secondary education expenses (the Coverdell Education Savings Account) to include home schools if they are treated as a home school or private school under State law. Amends the part of the General Education Provisions Act known as the Family Educational Rights and Privacy Act of 1974 to prohibit release of certain information on and educational records of students in non-public education, including any student educated at home or in a private school in accordance with State law, without written parental consent. Amends HEA to include students at home schools, whether treated as a home school or a private school under State law, among those prospective secondary school graduates eligible to apply for the Robert C. Byrd Honors Scholarship Program for higher education. Amends the Fair Labor Standards Act of 1938 to direct the Secretary of Labor to extend the hours and periods of permissible employment of employees between the ages of 14 and 16 years who are privately educated at a home school, whether the home school is treated as a home school or a private school under State Law, beyond those hours and periods applicable to employees of such ages who are educated in traditional public schools. (Thus allows home-school students to be employed during the traditional school day.)

Terminates a provision that requires the Secretary of Transportation to ensure that all laborers and mechanics employed by contractors or subcontractors on the construction work performed on Federal-aid highway projects are paid prevailing rate wages. Permits a State to enact a law to provide for continued enforcement of the requirements of such provision in that State.
