National Trauma Center Stabilization Act of 2009 - Amends the Public Health Service Act to revise provisions governing grants to trauma centers. Directs the Secretary of Health and Human Services to establish four programs to award grants to public or nonprofit trauma centers to: (1) assist in defraying substantial uncompensated care costs; (2) further a center's core mission; (3) provide emergency relief to ensure continued and future availability of trauma service; and (4) support the development and maintenance of innovative information technology systems. Sets forth: (1) minimum qualifications of eligible centers, including requirements for levels of uncompensated care provided; and (2) preferences for awarding grants among level I, II, III, and IV trauma centers and among centers based on the changing availability of or demand for trauma care in the area served and financial need. Requires grantees to submit a long-term plan for providing trauma care. Requires the Secretary to: (1) annually determine and notify centers of their eligibility to receive a grant; and (2) periodically report on the status of such grants, the financial stability of the centers, the populations using the centers, and the effectiveness and efficiency of center activities. Authorizes appropriations for such grants for FY2010-FY2015 and specifies percentages to be reserved for the different types of grants.

Prohibits requiring repayment of certain amounts previously paid to SBP recipients in the form of a retired pay refund. Repeals the optional authority of (and instead requires) the Secretary of the military department concerned to pay an annuity to a member's dependent children when there is no eligible surviving spouse. Directs the Secretary concerned to restore annuity eligibility to a surviving spouse who earlier agreed to transfer such eligibility to a surviving child or children of a member.

Hardrock Mining and Reclamation Act of 2009 - Applies this Act to any mining claim, millsite claim, or tunnel site claim located under the general mining laws or used for beneficiation or mineral processing activities, regardless of whether legal and beneficial title to the mineral is held by the United States. Conditions federal issuance of a patent for any such mining or millsite claim upon specified determinations by the Secretary of the Interior. Subjects production of locatable minerals to a royalty of 8% of the gross income from mining. Imposes a 4% royalty upon federal lands subject to an existing permit, and specified royalties on certain federal land added to an existing operations permit. Prescribes a hardrock mining claim maintenance fee for each unpatented mining claim, mill, or tunnel site on federally owned lands. Designates certain wilderness study areas, areas of critical environmental concern, and related areas as not open to location of mining claims. Permits a state or local government or Indian tribe to petition the Secretary of the Interior for withdrawal of specific federal land from operation of the general mining laws in order to protect specific values. Instructs the Secretary to ensure that mineral activities on federal land subject to a claim are carefully controlled to prevent undue degradation of public lands and resources. Prescribes requirements for the exploration permit process and for operations permits, including financial assurances. Requires restoration of lands to a condition capable of supporting prior uses or other beneficial uses. Establishes the Locatable Minerals Fund composed of: (1) penalties, fees, and royalties; (2) the Hardrock Reclamation Account, and (3) the Hardrock Community Impact Assistance Account. Amends the National Materials and Minerals Policy, Research and Development Act of 1980 to direct the Secretary of Agriculture to initiate prompt actions to improve the availability and analysis of mineral data in public land use decision-making with respect to National Forest System lands. Amends the Energy Policy Act of 1992 to subject certain oil shale claims to the reclamation requirements of this Act. Repeals the Building Stone Act and the Saline Placer Act.

Access to Postal Services Act - Modifies the procedures the U.S. Postal Service must follow in connection with the closing or consolidation of any postal facility, including: (1) requiring an assessment of the need for the closure or consolidation; (2) eliminating a requirement to consider the resulting Postal Service economic savings; (3) requiring a posting in each affected postal facility at least 90 days before the final decision is made; and (4) requiring (under current law, allowing) suspension of the determination pending an appeal to the Postal Regulatory Commission. Exempts emergency suspensions (as defined under Postal Service regulations) or lease termination or cancellation by a party other than the Postal Service. Defines "postal facility," for the provisions amended by this Act, to include an office, branch, station, or other facility operated by the Postal Service.

Authorizes the Secretary of Health and Human Services to exempt pharmacies and pharmacists from such standards if licensing, accreditation, or other mandatory quality requirements apply to them with respect to the furnishing of items and services.

340B Program Improvement and Integrity Act of 2009 - Amends the Public Health Service Act to expand the drug discount program to allow participation as a covered entity by certain: (1) children's hospitals; (2) critical access hospitals; (3) entities providing maternal and child health services, community mental health services, or treatment services for substance abuse; (4) Medicare-dependent, small rural hospitals; (5) sole community hospitals; and (6) rural referral centers. Prohibits enrolled hospitals from obtaining covered outpatient drugs through a group purchasing arrangement. Requires the Secretary of Health and Human Services to establish reasonable exceptions to such requirements, including for drugs unavailable through the program and to facilitate generic substitution when a generic covered drug is available at a lower price. Expands the program to include a drug used in connection with an inpatient or outpatient service by enrolled hospitals. (Currently, only outpatient drugs are covered under the program.) Requires hospitals enrolled in the 340B drug discount program to provide to each state a credit on the estimated annual costs to such hospital of single source and innovator multiple source drugs and noninnovator multiple source drugs provided to Medicaid recipients for inpatient use. Sets forth a formula for calculating the credit. Allows a hospital to avoid paying such credits under certain circumstances. Requires the Secretary to: (1) carry out activities to improve compliance by manufacturers and covered entities with the requirements of the drug discount program; and (2) establish an administrative process for resolving claims by covered entities and manufacturers of violations of such requirements. Requires manufacturers to offer each covered entity covered drugs for purchase at or below the applicable ceiling price if such a drug is made available to any other purchaser at any price.

Veterans' Heritage Firearms Act of 2009

Veterans' Heritage Firearms Act of 2009 - Provides a 90-day amnesty period during which veterans and their family members can register in the National Firearms Registration and Transfer Record any firearm acquired before October 31, 1968, by a veteran while a member of the Armed Forces stationed outside the continental United States. Grants such an individual limited immunity under the federal criminal code and the Internal Revenue Code with respect to the acquisition, possession, transportation, or alteration of such firearm before or concurrent with such registration. Extends such immunity to a veteran who attempts to register a qualifying firearm outside of the amnesty period if the veteran surrenders the firearm within 30 days after being notified of potential criminal liability for continued possession. Requires the Attorney General to: (1) transfer each firearm qualifying as a curio or relic which has been forfeited to the United States to the first qualified museum that requests it; and (2) publish information identifying each such firearm which is available to be transferred to a museum. Prohibits the Attorney General from destroying any such firearm which has been forfeited until five years after the forfeiture. Requires that any firearm transferred to a qualified museum be registered to the transferee. Makes a prohibition against transfer or possession of a machine-gun inapplicable to a transfer to or by, or possession by, a museum which is open to the public and incorporated as a not-for-profit corporation under applicable state law.

Rural Hospital Assistance Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act with respect to the additional inpatient hospital service payment (payment adjustment) for low-volume hospitals (usually meaning a "subsection (d) hospital" located more than 25 road miles from another subsection (d) hospital and having less than 800 discharges during the fiscal year.) (Generally, a subsection (d) hospital is an acute care hospital, particularly one that receives payments under Medicare's inpatient prospective payment system (IPPS) when providing covered inpatient services to eligible beneficiaries.) Redefines low-volume hospital, for discharges occurring during FY2009 only, as a subsection (d) hospital located more than 15 (instead of 25) road miles from another subsection (d) hospital and having less than 1,500 (instead of 800) discharges of individuals entitled to, or enrolled for, Medicare part A (Hospital Insurance) benefits ("tweeners,'' or hospitals too large to be critical access hospitals, but too small to be financially viable under the Medicare hospital prospective payment system (PPS)). Revises, for FY2010 only, the temporary applicable percentage in the formula for determining the payment adjustment for such hospitals. Requires the use of the non-wage adjusted prospective payment rate (PPS) rate during FY2010 under the Medicare-dependent hospital (MDH) program. Prescribes requirements for hospitals to qualify for a Medicare hospital exception to the prohibition on certain physician referrals to hospitals in which such physicians have an ownership or investment interest in the entity. (Eliminates the Medicare hospital exception for physician-owned hospitals, but provides a limited exception for existing facilities.)

Designates certain lands in Mesa, Montrose, and Delta Counties as wilderness and as a component of the National Wilderness Preservation System, to be known as the Dominguez Canyon Wilderness Area.

Requires any rates charged for water for municipal, domestic, or industrial use or for the use of facilities for the storage or delivery of water to be adjusted to reflect the estimated revenue derived from contracts for the use of Fryingpan-Arkansas project excess capacity or exchange contracts using project facilities. Authorizes appropriations for the construction of the Conduit. Prohibits such sums from being used for its operation or maintenance.

Department of Veterans Affairs Energy Sustainability Act of 2008 - Directs the Secretary of Veterans Affairs to: (1) implement in the Department of Veterans Affairs (VA) an energy sustainability program to minimize energy consumption and encourage the use of alternative energy sources; (2) establish and maintain a database to track and report on VA energy and water expenditures; (3) complete an audit of VA energy usage during FY2009; (4) ensure VA compliance with an Executive Order and VA Directive concerning energy efficiency goals and objectives; (5) install alternative fueling stations on at least 35 VA medical facility campuses; (6) submit to Congress a plan for increasing the use of energy-efficient and renewable energy technologies in VA facilities and operations; (7) provide for the installation of individual electric sub-metering equipment at VA facilities; (8) ensure that energy-efficient products meeting VA requirements are purchased whenever the VA purchases items that consume electricity; and (9) conduct a study on water and fuel consumption by the National Cemetery Administration and ways to reduce such consumption. Establishes in the VA: (1) an Office of Energy Management; and (2) the Advisory Committee on Energy Management and Sustainability. Authorizes an increase in the dollar limit of VA grants for: (1) adaptive housing to encourage the use of high-efficiency systems and products or other energy-use reduction items; and (2) adaptive vehicles to encourage the purchase of alternative use vehicles. Directs the Secretary and the Secretary of Energy to enter into a memorandum of understanding to improve and facilitate the use of expertise of the national laboratories to evaluate energy- and water-efficient technologies for use by the VA. Authorizes the Secretary to carry out a pilot program to sell economic incentives that reduce the emission of air pollutants attributable to a VA facility.

Requires the Secretary to prioritize improvements based on: (1) recommendations of the Southern Ute Indian Tribe; (2) cost-benefit analyses; (3) the ability of the Project's users to irrigate agricultural land using the Project's irrigation infrastructure; (4) the effect on water conservation; (5) the cultural benefits that the improvements would have on the Tribe; and (6) the opportunity to address water supply or environmental conflicts. Authorizes the Secretary to provide grants to, and enter into cooperative agreements with, the Tribe in order to repair, rehabilitate, reconstruct, or replace the Project's irrigation infrastructure. Prohibits such a grant or agreement from being used for the repair, rehabilitation, or reconstruction of any major impoundment structure or for on-farm improvements. Requires the Secretary, in carrying out a grant or cooperative agreement, to: (1) consult with the Tribe and the Director of the Bureau of Indian Affairs (BIA) and obtain the Tribe's approval; and (2) coordinate the project with any work being conducted under the BIA's irrigation operations and maintenance program. Authorizes the Secretary to require the Tribe to provide nonfederal funds to match not less than 25% of the total amount of a grant or agreement.

Second Amendment Enforcement Act - Amends specified law prohibiting the killing of wild birds and wild animals in the District of Columbia to declare that nothing in it or any other provision of law shall authorize or be construed to permit the Council, the Mayor, or any governmental or regulatory authority of the District to prohibit, constructively prohibit, or unduly burden the ability of persons otherwise not prohibited from possessing firearms under federal law from acquiring, possessing in their homes or businesses, or using for sporting, self-protection or other lawful purposes, any firearm neither prohibited by federal law nor subject to the National Firearms Act. Denies the District any authority to enact laws or regulations that discourage or eliminate the private ownership or use of firearms. Amends the Firearms Control Regulations Act of 1975 (FCRA) to repeal the definition of a machine gun as any firearm which shoots, is designed to shoot, or can be readily converted or restored to shoot semiautomatically, more than 12 shots without manual reloading. (Thus repeals the ban on semiautomatic weapons.) Redefines "machine gun" as any firearm which shoots, is designed to shoot, or is readily restored to shoot automatically, more than one shot without manual reloading by a single function of the trigger. Includes the frame or receiver of any such weapon, any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a weapon into a machine gun, and any combination of parts from which a machine gun can be assembled if such parts are in the possession or under the control of a person. Repeals the District's: (1) registration requirement for possession of firearms; (2) requirement that licensed firearms dealers keep records of ammunition received into inventory and ammunition sold or transferred; and (3) requirement that, under certain conditions, firearms in the possession of certain individuals must be kept unloaded, disassembled, or with the trigger locked. Maintains the current ban on the possession and control of a sawed-off shotgun, machine gun, or short-barreled rifle. Amends FCRA to allow an individual to possess ammunition in the District if the individual owns (currently, holds the valid registration certificate for) a firearm of the same guage or caliber as such ammunition. Eliminates criminal penalties for possessing an unregistered firearm. Amends federal law to eliminate criminal penalties for carrying a pistol whether loaded or unloaded in one's dwelling house, place of business, or on land possessed by such person. Amends the federal criminal code to make it lawful for any licensed importer, licensed manufacturer, licensed dealer, or licensed collector to sell or deliver a handgun to a District resident if such individual is licensed in Maryland or Virginia to do so.

Commodity Markets Transparency and Accountability Act of 2008 - Amends the Commodity Exchange Act to define "energy commodity." Prohibits the Commodity Futures Trading Commission (CFTC) from permitting a foreign board of trade to provide its U.S-located members with access to the CFTC electronic trading system and order matching system for energy or agricultural commodities unless such board meets requirements similar to those imposed upon U.S. exchanges. Subjects swap transactions, transactions for agricultural and energy commodities, and large traders in over-the-counter contracts to reporting and recordkeeping requirements. Directs the Commission to: (1) set position limits for any one person with respect to designated contract markets, derivative transaction execution facilities, and electronic trading facilities; (2) convene a Position Limit Agricultural Advisory Group and a Position Limit Energy Group; (3) appoint at least 100 new full-time employees; (4) review prior actions to ensure compliance with this Act; and (5) review over-the-counter markets. Revises the core principles applicable to position limits for contracts in agricultural and energy commodities to require position limits for speculators. Directs the Government Accountability Office (GAO) to conduct a study of: (1) the international regime for regulating the trading of energy commodity futures and derivatives; and (2) speculators' effects on agriculture and energy futures markets and prices. Directs the Commission to: (1) require regular reporting of fungible over-the-counter agricultural and energy transactions; and (2) determine if such transactions have the potential to disrupt market liquidity or cause market or price disturbances, and if so, to use its discretion to impose position limits. Authorizes the Commission to use expedited procedures to carry out this Act.

Provides for the issuance of ski area permits for the use and occupancy of suitable lands within the National Forest System for skiing and other snow-sports and such other seasonal or year-round recreational activities associated with mountain resorts as the Secretary of Agriculture may authorize pursuant to this Act. Allows the Secretary to authorize the holder of a ski area permit issued pursuant to the Act to also provide on lands subject to such permit such other seasonal or year-round outdoor and natural-resource based developed recreation activities and associated facilities, in addition to skiing and other snow-sports, as determined appropriate. Prohibits any activity or facility from being authorized under this Act if its authorization would result in the primary recreational purpose of lands subject to a ski area permit not being skiing or other snow-sports.
