Constitutional Amendment - Provides that, on or before the fifteenth day after the beginning of each regular session of the Congress, the President shall transmit to the Congress a budget which shall set forth separately: (1) his estimate of the receipts of the Government, other than trust funds, during the ensuing fiscal year under the laws then existing; (2) his recommendations with respect to outlays to be made from funds other than trust funds during such ensuing fiscal year; and (3) if such recommendations exceed such estimate, a surtax rate which the President determines to be necessary to be applied with respect to the income tax of taxpayers to those portions of taxable years of taxpayers occurring during such fiscal year, so that such receipts will equal such outlays. Directs the Speaker of the House of Representatives during the first quarter of each fiscal year, and during the third quarter of each fiscal year to: (1) estimate the receipts of the Government, other than trust funds, during such fiscal year; (2) estimate outlays to be made from funds other than trust funds during such fiscal year; and (3) (A) if such estimate of outlays exceeds such estimate of receipts, determine a surtax rate which the Speaker considers necessary to be applied, with respect to the income tax of taxpayers, to those portions of taxable years of taxpayers remaining in such fiscal year, so that such receipts will equal such outlays; or (B) if such estimate of outlays equals such estimate of receipts, determine that no surtax rate is necessary to be applied. Directs the President during the last month of each fiscal year to review whether the receipts of the Government, other than trust funds, for such year will be less than the outlays other than trust funds for that fiscal year. Provides that if he finds that such receipts are going to be less than such outlays, he shall determine a surtax rate which he considers necessary to be applied with respect to the income tax of taxpayers, so that taxes received by the Government from such surtax, when added to other receipts of the Government, will equal such outlays. Authorizes the suspension of the provisions of this Article in the case of a grave national emergency declared by Congress (including a state of war formally declared by Congress) by a concurrent resolution, agreed to by a rollcall vote of three-fourths of all the Members of each House of Congress, with each such resolution providing the period of time (not exceeding one year) during which those provisions are to be suspended.

Prohibits a petroleum refiner or distributor from cancelling, failing to renew, or otherwise terminating a franchise unless he furnishes notification in writing to each affected distributor or retailer by certified mail not less than ninety days prior to the date on which such franchise will be canceled, together with a statement of the reasons of such cancellation and of the remedies available. Provides that a petroleum refiner or distributor shall not cancel, fail to renew, or otherwise terminate a franchise unless the retailer or distributor whose franchise is terminated failed to comply substantially with any essential and reasonable requirement of such franchise or failed to act in good faith in carrying out the terms of such franchise. States that if a refiner or distributor engages in conduct prohibited under this Act, a retailer or distributor may maintain a suit against such refiner or distributor.

Health Care Insurance Act

Health Care Insurance Act - Provides, under the Social Security Act, for medical, dental, and hospital care through a system of voluntary health insurance financed in whole for low-income groups through issuance of certificates, and in part for all other persons through allowance of tax credits. Adds to the Social Security Act a new title entitled Federal Financing of Voluntary Health Insurance. Provides that, for the purpose of providing assistance on behalf of the individuals and their dependents whose income and resources are insufficient to meet the costs of necessary medical, dental, and hospital services, there is established a program of hospital, dental, and medical benefits for any eligible beneficiary and his dependents through the issuance of health insurance certificates, in full payment of allowable premium on a qualified health care insurance policy of his choice. Assets that health insurance certificates of entitlement will be redeemable by the carrier by payment from the Federal Health Insurance Redemption Fund. Includes as eligible beneficiaries under this title any husband and wife both under age 65 and living together and any unmarried person under age 65 who is not a dependent beneficiary. Defines a dependent beneficiary as any child of an eligible beneficiary receiving more than 50 percent of his support from the eligible beneficiary, which child is under 21, or if a student, under age 23. Provides that every individual who is an eligible beneficiary whose income results in no individual income tax liability during his base year, whose dependent beneficiaries have no such liability for their taxable years which end during his base year, and who is not eligible to receive military medical care, shall be eligible to receive a health insurance certificate of entitlement. Asserts that such certificates shall be applicable in full payment of allowable premiums for a qualified health care insurance policy or plan. Requires that such policy or plan shall provide protection for the eligible beneficiary and his dependent beneficiaries for a 12-month period beginning during his benefit year against the expenses of health care, including catastrophic expenses of illness. Allows tax credits for health care insurance. Asserts that every individual who is an eligible beneficiary who has not elected, where eligible, to receive benefits under the provisions for fully-paid health care insurance for the low-income group and who is not eligible to receive military medical care, shall be allowed at his election a credit against his income tax liabliity for his taxable year which ends during his base year; or a health insurance certificate of entitlement acceptable by a qualified carrier in payment toward a premium, under a qualified health care insurance policy. Specifies the amount of the tax credit or the value to be assigned to the health insurance certificate on the basis of allowable premiums. Provides that a health insurance certificate of entitlement means a certificate issued by the Secretary of Health, Education and Welfare upon application to him by an eligible beneficiary to apply toward payment of premium on a qualified health care insurance policy or plan. Specifies that a qualified health care insurance policy or plan shall be a contractual agreement specifying benefits under a program offered by a qualified carrier which has been registered by a State Agency and which provides basic institutional and medical coverage and catastrophic expense coverage. Declares that each such qualified health care insurance policy or plan shall be noncancellable and guaranteed renewable so long as the carrier continues to offer to the public one or more qualified health care insurance policies or plans, shall provide protection against the expense of health care without regard to any pre-existing conditions, and shall provide for payment under this title of usual and customary charges for services covered under the policy or plan. Stipulates what cost shall be included under basic coverage and under catastrophic expense coverage. Establishes deductibles for each of the two types of coverage. Creates a Health Insurance Advisory Board which shall consist of eleven persons including the Secretary of Health, Education, and Welfare and the Commissioner of the Internal Revenue Service. Directs that the remaining members, not otherwise in the employ of the Government, shall be appointed by the President, with the advice and consent of the Senate, without regard to the provisions of title 5, United States Code, governing appointment in the competitive service. Asserts that the Secretary of HEW shall serve as Chairman. Provides that the members shall be selected from the persons who are specifically qualified to serve on such Board by virtue of their education, training, or experience. Provides that the Health Insurance Advisory Board shall perform such functions as: (1) prescribe such regulations as may be necessary to carry out the purposes and provisions of this Act; (2) establish minimum Federal standards for the use of State insurance departments in determining whether an insurance company and plan are qualified under this Act; (3) in consultation with carriers, providers of services, and consumers, plan and develop programs whose purposes are to provide for maintaining the quality of medical care; and (4) review the effectiveness of the tax credit program and file an annual report. Grants the States the power to decide which carriers are qualified. Forbids any Federal officer or employee to exercise any supervision or control over the practice of mediciene or dentistry or the manner in which medical or dental services are provided, or over the selection, tenure, or compensation of any officer or employee or any institution, agency, or person providing health services; or to exercise any supervision or control over the administration or operation of any such institution, agency, or person. Creates in the Treasury a trust fund to be known as the Federal Health Insurance Redemption Fund to consist in part of an amount equal to the aggregate amount of premiums paid under this title through the redemption of health insurance certificates.

Establishes the National Commission on the Prevention of Raw Material Shortages within the legislative branch of Government. States that the duties of the Commission shall be to investigate and report to the Congress on the raw materials which the United States presently imports at the rate of 10 percent or more of annual consumption, those raw materials which are likely to be imported at such rate by 1985, and any other raw materials which in the judgment of the Commission may become in short supply sufficiently by 1985 to seriously affect realization of national economic goals of the United States. Requires such report to include an analysis of: (1) the possiblity of the supply of such raw materials being disrupted by shortage in supply or the actions of countries or companies engaged in the production or transportation of such raw materials; (2) the probable economic impact of shortages in such raw materials; (3) the availability of substitute materials for such raw materials, the economic impact of such substitution, and the research in progress which could result in the increased availability of substitute materials; (4) actions and policies of companies involved in the supply and distribution of such raw materials to determine if these actions and policies will increase the available supply of such raw materials; and (5) the policies, laws, and actions of the United States Government to determine whether they are consitent with the national policy of anticipating and avoiding shortages in such raw materials. States that such report shall make recommendations for changes in laws which affect scientific research, foreign trade, taxation, raw material exploration, government procurement, national economic policy, national environmental policy, and any other domestic or foreign policy of the United States Government affecting supply of such raw materials. Requires such report to be made to the Congress of the United States within two years of the establishment of the Commission. Specifies the composition of the Commission and the powers of its members and agents. Gives the Commission the power to hold hearings and to issue subpoenas compelling the attendance and testimony of witnesses and the production of any evidence that relates to any matter under investigation by the Commission. Allows the Commission to obtain official data from any department or agency of the United States to carry out the provisions and purposes of this Act, to accept gifts, and to use the mails in the same manner and upon the same conditions as other Federal agencies. Authorizes to be appropriated the sums necessary to carry out the provisions of this Act.

Oil Shale Mining and Energy Corporation Act

Oil Shale Mining and Energy Corporation Act - Creates the "Oil Shale Mining and Energy Corporation" to establish and administer on Federal land a national program of oil shale exploration and development. Provides that the Corporation shall have a Board of Directors appointed by the President with Senate approval, such board to direct the exercise of all the powers of the Corporation. Provides that the Corporation: (1) may make contracts to carry out its functions under this Act: (2) may purchase, lease, or dispose of such property as it deems necessary; (3) shall have the power to exercise the right of eminent domain; (4) shall have such power as may be necessary for the exercise of the powers specifically conferred in this Act; (5) shall have the power to acquire or dispose of real property except for oil or gas exploration and development; (6) shall have the power to explore for oil shale on Federal lands, to develop and sell oil and gas and other oil shale products produced on Federal lands, and to build and operate all those facilities necessary for the development or sales of such resources, as authorized by this Act; (7) shall have the power to explore, develop, acquire or sell oil and gas and other oil shale products alone or on a joint or cooperative basis with any private or public entity; (8) shall have the power to engage in research directed toward the development and utilization of oil shale deposits on Federal lands, and may build, own, and operate research testing, or demonstration facilities, alone or on a joint or cooperative basis with any private or other public entity; (9) shall have the power to obtain and operate facilities necessary for the production, sale, transportation, or delivery of oil, gas, or other shale products; and (10) shall have the power to sell commercially valuable minerals which may be obtained incidental to the production of oil shale products on Federal lands. Authorizes the President of the United States to transfer to the Corporation the use, possession, and control of such other Federal land or personal property of the United States as he may from time to time deem necessary. Specifies, with respect to the Corporation, procedures for maintaining accounts, entering into contracts, and providing annual financial statements and reports. Provides for audit, by the Comptroller General, of the transactions of the Corporation. Authorizes the Corporation to lease, purchase, or construct transmission pipelines within transmission distance from the place where oil and gas products from oil shale on Federal lands are produced and to interconnect with other systems. Authorizes and directs the Board of Directors of the Corporation,, in order to render financial assistance to States and local governments within whose jurisdiction the Corporation has acquired properties previously subject to State and local taxation, to pay to such State and local governments percentages of the gross proceeds derived from the operation of the Corporation. Provides that such payments are in lieu of taxation and that the Corporation, its property, franchises, and income are expressly exempted from taxation in any manner by any State or local government. Authorizes the Corporation to issue and sell bonds, notes, and other evidences of indebtedness in order to assist in financing its oil shale resources exploration and development program and to fund such bonds. Provides criteria for setting of rates for sale of oil shale products by the Corporation. Provides that all net proceeds (over expenses) of the Corporation for each fiscal year shall be deposited in the American Indian Fund, such Fund to be created in the Treasury of the United States. Provides for the allocation of such Fund to eligible Indian tribes by the Secretary of Interior under the State and Local Fiscal Assistance Act. Directs that, prior to the initiation of any program of exploration or the construction of any major facility under this Act, the Corporation shall prepare an environmental impact statement pursuant to the National Environmental Policy Act, such statement to be made public. Provides that hearings be held to allow interested persons to submit comments on the statement. Prohibits the Corporation from using surface mining techniques for the exploration or development of oil shale resources. Authorizes the appropriation to the Corporation for each fiscal year of all sums necessary to carry out this Act.
