Cattle Fever Tick Eradication Program Enhancement Act This bill requires the Department of Agriculture (USDA) to enter into a contract to evaluate the Cattle Fever Tick Eradication Program. (Under the program, the Animal and Plant Health Inspection Service works in coordination with the Texas Animal Health Commission to combat the spread of cattle fever ticks, which can spread a serious cattle disease called bovine babesiosis or cattle fever.) Specifically, USDA must enter into a contract to review and report on the Cattle Fever Tick Eradication Program with a (1) land-grant college or university, or (2) non-land-grant college of agriculture. The review must include an evaluation of the program's effectiveness with respect to preventing and reducing the spread of tick-borne illnesses in cattle; the program's benefits, and the burdens of compliance, to cattle producers; the treatment protocols developed and implemented under the program; and the federal and state funds allocated to support the program for the most recent fiscal year.

Women's Rights and Protection Act of 2023 This bill prohibits expending federal funds to provide assistance to any country that has enacted laws that criminalize or discriminate on the basis of gender, including laws that limit or prohibit women from attending school or that authorize female genital mutilation.

Strengthening Supply Chains Through Truck Driver Incentives Act of 2023 This bill allows certain licensed commercial truck drivers a $7,500 tax credit in a taxable year. The adjusted gross income of such drivers may not exceed $90,000 ($135,000 in the case of a joint tax return and $112,500 for heads of household). Such drivers must have driven a truck in a trade or business for a specified number of hours in a taxable year. The credit expires after December 31, 2024.

Accelerate Long-term Investment Growth Now Act or the ALIGN Act This bill makes permanent the expensing of certain new business equipment. Expensing allows the deduction of the full amount of an expense item in the same taxable year.

Ensuring Lawful Collection of Hidden Assets to Provide Order Act or the EL CHAPO Act This bill requires the forfeited profits of Joaquin Archivaldo Guzman Loera (El Chapo) from his illicit drug trafficking enterprise to be reserved for border security measures between the United States and Mexico, including the completion of a wall. Additionally, it requires the forfeited funds from the felony conviction of a member of a drug cartel to be reserved for border security measures between the United States and Mexico, including the completion of a wall.

Let Experienced Pilots Fly Act of 2023 This bill raises the mandatory retirement age for pilots engaged in commercial aviation operations from 65 to 67 years of age, unless the operation takes place in (1) the territorial airspace of a foreign county where such operations are prohibited by the foreign country, or (2) international airspace where such operations are not in compliance with the Annexes to the Convention on International Civil Aviation. The Federal Aviation Administration must also submit a report to Congress on further increasing the age limitation for pilots engaged in commercial aviation operations.

Equality and Fiscal Accountability Protection Act of 2023 This bill prohibits expending federal funds to provide assistance to any country that has enacted laws that criminalize or discriminate on the basis of sexual orientation, including laws that criminalize homosexuality or same-sex marriage.

Strengthening Enforcement and Criminalizing Unlawful Records Enabling Flights Act or the SECURE Flights Act This bill prohibits the use of certain warrants and other documents issued by U.S. Immigration and Customs Enforcement (ICE), the Department of Homeland Security (DHS), and U.S. Customs and Border Protection (CBP) as proof of identification at airport security checkpoints. If an individual uses a prohibited document as proof of identification, the Transportation Security Administration (TSA) must inform ICE, CBP, and local law enforcement to determine whether the individual is in violation of any term of release from custody of the agency. An individual who is in violation may not be permitted to enter a sterile area (e.g., the boarding area) unless the individual (1) is being removed or deported from the United States, or (2) presents a covered valid and unexpired identification document. Examples of covered identification documents include a U.S. passport, a biometrically secure card issued by a DHS trusted or registered traveler program, a state-issued enhanced driver's license, and an employment authorization document issued by U.S. Citizenship and Immigration Services. Further, prior to authorizing entry into a sterile area, the TSA must collect biometric information from an individual who (1) does not present a covered identification document, and (2) the TSA cannot verify is a U.S. national. The TSA must submit the information to the national Automated Biometric Identification System (IDENT).

Railway Safety Act of 2023 This bill addresses safety requirements for rail carriers and trains transporting hazardous materials. Specifically, the Department of Transportation (DOT) must issue safety regulations for trains carrying hazardous materials to require that rail carriers or shippers (1) provide state emergency response commissioners with advanced notice and information about the hazardous materials; (2) reduce blocked rail crossings; and (3) comply with certain requirements regarding train length and weight specifications, track standards, speed restrictions, and response plans. DOT must also establish requirements for wayside defect detectors. These are used by railway systems alongside the tracks to detect defects and failures (e.g., wheel bearing failures). Current federal regulations do not require their use, but federal guidance does address their placement and use. Under the bill, DOT must issue regulations establishing requirements for the installation, repair, testing, maintenance, and operation of wayside defect detectors for each rail carrier operating a train carrying hazardous materials. The bill also increases the maximum fines DOT may impose on rail carriers for violating safety regulations, requires DOT to update rail car inspection regulations and audit the federal inspection program, requires a minimum two-person crew for certain freight trains, phases out certain railroad tank cars by May 1, 2025 (four years sooner than required under current law), expands training for local first responders, imposes a new fee on certain rail carriers, and authorizes grants to improve railway safety.

This joint resolution nullifies the rule issued by the Bureau of Alcohol, Tobacco, Firearms and Explosives titled Factoring Criteria for Firearms With Attached "Stabilizing Braces" and published on January 31, 2023. The rule establishes criteria for determining whether a firearm equipped with an attached stabilizing brace that facilitates shoulder fire is a rifle subject to regulation (e.g., registration) under the National Firearms Act.

Puppy Protection Act of 2023 This bill requires the Department of Agriculture to expand standards that govern the humane handling, care, treatment, and transportation of animals to include new requirements for commercial dog dealers. Specifically, the standards must require dog dealers to provide to dogs adequate housing, exercise, and veterinary care; appropriate and nutritious food; continuous access to potable water; and meaningful socialization with humans and compatible dogs for at least 30 minutes each day. The standards must also include requirements for breeders to use safe breeding practices and make all reasonable efforts to find humane placement for retired breeding dogs.

Drug Price Transparency in Medicaid Act of 2023 This bill requires pass-through pricing models, and prohibits spread-pricing, for payment arrangements with pharmacy benefit managers under Medicaid. The bill also extends funding for retail pharmacy surveys and requires additional information with respect to price concessions and survey participation to be made publicly available.

Mayorkas Must Fly Coach Until We Secure the Border Act This bill prohibits any officer or official of the Office of the Secretary of the Department of Homeland Security (DHS), including the Secretary of DHS, from using any federal executive aircraft until certain conditions relating to the border have been met. Specifically, the prohibition shall apply until the number of encounters and apprehensions of non-U.S. nationals ( aliens under federal law) who have unlawfully crossed the border have been reduced to FY2020 numbers; DHS reports to Congress a plan to place 90% of deployed U.S. Border Patrol agents in duties in the field; and DHS reports to Congress a plan to offer resources, including financial support, to local communities and governments.

Executive Mental Competency Protection Act of 2023 This bill requires the physician to the President to conduct a comprehensive cognitive evaluation of the President by January 1st of each fiscal year and make the results available on the White House public website. If a President fails to complete such evaluation by that date, during the remainder of the fiscal year no federal funds may be obligated or expended for presidential travel.

Drug Cartel Terrorist Designation Act This bill directs the Department of State to designate four specified drug cartels as foreign terrorist organizations. (Among other things, such a designation allows the Department of the Treasury to require financial institutions to block transactions involving the organization.) The four specified cartels in the bill are the Gulf Cartel, the Cartel Del Noreste, the Cartel de Sinaloa, and the Cartel de Jalisco Nueva Generacion. The bill also requires the State Department to submit a detailed report on those four cartels and any other cartels it may identify. Based on this report, the State Department must designate as a foreign terrorist organization any such identified cartel (or faction thereof) that meets certain criteria for designation as a foreign terrorist organization. The bill specifies that it may not be construed to expand eligibility for asylum.

Eradicating Narcotic Drugs and Formulating Effective New Tools to Address National Yearly Losses of life Act or the END FENTANYL Act This bill requires U.S. Customs and Border Protection to review and update, as necessary, manuals and policies related to inspections at ports of entry to ensure the uniformity of inspection practices to effectively detect illegal activity along the border, such as the smuggling of drugs and humans.

Protect Children's Innocence Act This bill places restrictions on the provision of gender affirming care. Gender affirming care includes performing surgery, administering medication, or performing other procedures for the purpose of changing the body of an individual to correspond to a sex that differs from the individual's biological sex. Specifically, the bill makes it a felony to perform any gender affirming care on a minor and it permits a minor on whom such care is performed to bring a civil action against each individual who provided the care. Additionally, the bill prohibits the use of federal funds for gender affirming care or for health insurance that covers such care. Such care may not be provided in a federal health care facility or by a federal employee. The bill also prohibits qualified health plans from including coverage for gender affirming care. Further, plans that include coverage for such care are not eligible for federal subsidies. Finally, the bill prohibits institutions of higher education from offering instruction in gender affirming care. It also makes any non-U.S. national ( alien under federal law) who performs gender affirming care on a minor deportable and inadmissible to the United States. The restrictions under this bill do not apply to the provision of care under certain circumstances such as when an individual does not have normal sex chromosome structure, sex steroid hormone production, or sex steroid hormone action.

Sultana Steamboat Disaster Commemorative Coin Act of 2023 This bill directs the Department of the Treasury to mint and issue not more than 100,000 $5 gold coins, 500,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the Sultana steamboat explosion that occured on April 27, 1865, on the Mississippi River. All surcharges received by Treasury from the sale of such coins must be paid to the Sultana Historical Preservation Society for the purpose of establishing, operating, and maintaining a museum.

Major Richard Star Act This bill provides that combat-disabled uniformed services retirees with fewer than 20 years of creditable service may concurrently receive, without reduction, veterans' disability compensation and retired pay or combat-related special compensation.

Parents Bill of Rights Act This bill establishes various rights of parents and guardians regarding the elementary or secondary school education of their children. Local educational agencies (LEAs) and schools must comply with the requirements of the bill in order to receive federal education funds. Specifically, the bill requires schools to notify parents and guardians of their rights regarding the education of their children. These rights include the right to review the curriculum of their child's school; know if the state alters its challenging academic standards; meet with each teacher of their child at least twice each school year; review the budget, including all revenues and expenditures, of their child's school; review a list of the books and other reading materials in the library of their child's school; address the school board of the LEA; receive information about violent activity in their child's school; and receive information about any plans to eliminate gifted and talented programs in the child's school. Additionally, the bill directs each LEA to post on a publicly accessible website (or otherwise widely disseminate to the public) the curriculum for each elementary and secondary school grade level. The LEA must also include in its annual report card the overall budget of the LEA and the budget for each elementary and secondary school. The bill also provides for additional family educational and privacy rights, including by prohibiting schools from selling student information for commercial or financial gain.

Combating Racist Training in the Military Act of 2023 This bill prohibits the Armed Forces and academic institutions of the Department of Defense from promoting specified anti-American and racist theories (e.g., that any race is inherently superior or inferior to any other race). Specifically, the bill prohibits including anti-American and racist theories or materials in curricula, reading lists, seminars, workshops, trainings, or other educational or professional settings in a manner that could appear as sponsorship, approval, or endorsement; contracting with, hiring, or otherwise engaging speakers, consultants, diversity trainers, and other persons for the purpose of advocating anti-American and racist theories; compelling members of the Armed Forces to affirm or profess belief in anti-American and racist theories; and segregating members of the Armed Forces by race in any setting, including educational and training sessions.

Protecting Taxpayers and Victims of Unemployment Fraud Act This bill addresses fraud and overpayments of pandemic unemployment insurance (UI) benefits, including by providing incentives for states to investigate and recover overpayments of these benefits. Specifically, the bill allows states to retain 25% of any recovered fraudulent overpayments. These retained funds may be used for modernizing unemployment compensation systems and information technology, reimbursing administrative costs, hiring fraud investigators and prosecutors, and for other program integrity activities. Additionally, the bill allows states to retain 5% of any overpayments of regular and extended UI benefits. A state must, in order to retain these overpayments, certify that it has met certain conditions for data matching. Next, the bill extends from 3 to 10 years the time during which states can recover overpayments of pandemic UI benefits. Further, the bill extends flexibilities for states to hire temporary staff on a noncompetitive basis to identify, pursue, and recover fraudulent overpayments. The bill also extends from 5 to 10 years the statute of limitations for federal criminal charges or civil enforcement actions related to UI fraud. Finally, the bill repeals a section of the Coronavirus Aid, Relief, and Economic Security Act (as amended by the American Rescue Plan of 2021) that provided funding for UI program integrity activities.

Stop CCP Fentanyl Act This bill imposes sanctions on various Chinese government officials and entities. It also establishes a cause of action against China’s government or Chinese government officials for certain harms stemming a fentanyl-related overdose. Specifically, the bill requires the President to impose visa- and property-blocking sanctions on (1) the president of China, (2) the chairman of the Chinese Communist Party (CCP), (3) China’s State Council, and (4) China’s Politburo Standing Committee. The President may waive the sanctions upon certifying that (1) China’s government and the CCP have taken all reasonable measures to prevent the flow of fentanyl produced in China into the United States, and (2) the intelligence community has determined that amount of fentanyl from China and the deaths resulting from overdoses of such fentanyl has dropped 98%. This bill also authorizes a U.S. national or lawful permanent resident to sue certain Chinese government officials or the Chinese government for the death of an immediate family member caused by an overdose by fentanyl (or fentanyl analogue) manufactured using fentanyl precursors from China. Property blocked pursuant to sanctions under this bill may be used to satisfy a judgment from such a lawsuit.

Debbie Smith Act of 2023 This bill reauthorizes through FY2029 the Debbie Smith DNA Backlog Grant Program. The program provides grants to state and local governments to improve and expand the collection and analysis of DNA evidence, including evidence in sexual assault kits.

250th Anniversary of the United States Marine Corps Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the 250th anniversary of the United States Marine Corps. All surcharges received by Treasury from the sale of such coins must be paid to the Marine Corps Heritage Foundation and shall only be used for the purposes of supporting the mission of the Marine Corps Heritage Center.

UNRWA Accountability and Transparency Act This bill makes changes to U.S. foreign policy in matters concerning the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA). For purposes of this policy, the bill defines Palestinian refugee as a person who (1) resided from June 1946 to May 1948 in Mandatory Palestine (a region controlled by Britain until 1948), (2) was personally displaced as a result of the 1948 Arab-Israeli conflict, and (3) has not accepted citizenship or other permanent adjustment in status in another country. Furthermore, under U.S. policy, derivative refugee status may only extend to the spouse or minor child of such a Palestinian refugee. The bill withholds U.S. funding for the UNRWA unless the Department of State makes certifications concerning the UNRWA's staff, partners, and funding. Specifically, the State Department must certify that neither UNRWA staff and partners nor its funding and facilities are affiliated with terrorism or disseminating certain rhetoric, such as calling for the destruction of Israel or describing Israelis as occupiers or settlers . Additionally, the State Department must certify that the UNRWA is (1) subject to comprehensive independent financial audits, and (2) not affiliated with any financial institutions complicit in money laundering or terror financing. The State Department must also implement a plan to encourage other countries to align their UNRWA-related activities with U.S. policy objectives, including the phaseout of the UNRWA by resettling Palestinian refugees outside of Israel.

Build the Wall Now Act This bill resumes the construction of, and modifies the requirements for, a physical barrier along the U.S.-Mexico border. Specifically, the Department of Homeland Security (DHS) must, within one day of the bill's enactment, resume any project related to the construction of such barriers (and any related infrastructure), and DHS may not cancel any contracts related to such construction that were entered into on or before January 20, 2021. Additionally, funds already appropriated for such construction must remain available until expended. The bill also modifies the requirements for the physical barriers along the southern border and requires DHS to consult with the labor organization representing border patrol agents about the safety and effectiveness of the agents deployed in the vicinity of the barriers. Finally, the bill exempts these construction projects from certain legal requirements, including requirements stemming from the Administrative Procedure Act, the Clean Air Act, the Clean Water Act, and the federal laws regarding public contracts.

Cardiac Arrest Survival Act of 2023 This bill expands immunity from civil liability related to emergency use of automated external defibrillator devices (AEDs). In particular, the bill specifies that immunity applies regardless of whether the person who used the AED complied with signage, received training, or was assisted or supervised by another person, such as a licensed physician. Additionally, the bill limits the liability of the person who owns or acquires an AED for harm resulting from its use unless that person fails to appropriately maintain the AED.

Oral Health Literacy and Awareness Act of 2023 This bill requires the Health Resources and Services Administration (HRSA) to conduct a public education campaign to increase oral health literacy and awareness. HRSA must design the campaign to focus on children, pregnant women, parents, older adults, people with disabilities, and racial and ethnic minorities.

COVID-19 Vaccination Non-Discrimination Act This bill prohibits making federal funds available to any facility that refuses to treat an individual based on the individual's COVID-19 vaccination status, including any funding under Medicare, Medicaid, or the Children's Health Insurance Program (CHIP).

Preventing Malign CCP Influence on Academic Institutions Act This bill requires institutions of higher education (IHEs) to disclose information regarding gifts from and contracts with organizations affiliated with China's government, the Chinese Communist Party (CCP), or the People's Liberation Army (PLA) , including certain educational institutes or programs, think tanks, and business entities. Under current law, an IHE must disclose to the Department of Education (ED) a gift or contract from a foreign source that is valued at $250,000 or more, considered alone or in combination with all other gifts from or contracts with that foreign source. This bill establishes a special disclosure rule relating to organizations affiliated with China's government, the CCP, or the PLA. Specifically, the bill requires an IHE to disclose a gift from or contract with such an organization that is valued at $5,000 or more, considered alone or in combination with all other gifts from or contracts with that organization. Additionally, the bill requires an IHE that receives federal grants to annually file a report with ED that identifies any activities conducted pursuant to a contract or other agreement between the IHE and such an organization, including any joint research or academic exchanges. Such contracts or agreements must be publicly available on the IHE's website.

Felony Murder for Deadly Fentanyl Distribution Act of 2023 This bill makes the distribution of fentanyl resulting in death a first degree murder. An individual who is guilty of first degree murder by distributing fentanyl is subject to death or life in prison.

This bill establishes new criminal offenses related to furnishing sexually explicit material (i.e., books, magazines, newspapers, or other printed material and digital or electronic books) to elementary or secondary schools or state or local educational agencies. It also prohibits federal funds for schools that obtain or educational agencies that distribute such material. Specifically, the bill makes it a crime for a president, director, manager, or officer of a publishing house to knowingly authorize the furnishing of published material containing a sexually explicit visual depiction to schools or educational agencies. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. The bill imposes a fine on a publishing house that knowingly furnishes such published material to schools or educational agencies. The bill also prohibits federal funds from being provided to (1) schools that knowingly obtain such published material, and (2) educational agencies that knowingly distribute such material to schools. The bill includes exceptions for material with serious literary, artistic, political, or scientific value.

Dismemberment Abortion Ban Act of 2023 This bill restricts the performance of dismemberment abortions. It defines the term dismemberment abortion . Specifically, the bill prohibits a physician from knowingly performing a dismemberment abortion. It provides an exception for a dismemberment abortion that is necessary to save the life of a mother whose life is endangered by a physical disorder, illness, or condition. The bill establishes criminal penalties—a fine, a prison term of up to two years, or both—for a physician who performs a prohibited dismemberment abortion. It also authorizes civil remedies for a woman or parent of a minor who undergoes a dismemberment abortion. A woman who undergoes a dismemberment abortion may not be prosecuted or held civilly liable.

No Social Security for Illegal Aliens Act of 2023 This bill prohibits an individual from collecting Social Security benefits based on wages and income earned for services illegally performed in the United States while the individual was an alien.
