Local Partnership Act of 1992

Local Partnership Act of 1992 - Establishes a revenue sharing program of payments to local governments. Sets forth the general framework for the use and timing of payments and for adjustments. Establishes in the Treasury a Local Government Fiscal Assistance Trust Fund (trust fund), with the Secretary of the Treasury as the personal trustee, and authorizes appropriations to finance it. Describes qualifying criteria for and conditions to be met by local governments seeking payments under the program. Requires payments withheld in cases of noncompliance. Requires the Secretary, in accordance with specified formulae, to determine the amount from the trust fund to be allocated to each State for further allocation to county, municipal, and township local governments as well as to Indian tribes and Alaskan native villages. Sets forth special rules governing allocations to territorial governments. Permits State variation of certain local government allocations. Sets forth special rules governing adjustments in local government allocations, including a limit on allocations to local government units based on a specified formula. Specifies the information to be used in making allocations under the program. Requires public hearings on proposed uses of program payments in relation to the local government's budget. Requires public disclosure of information on proposed payment uses and proposed budgets of local governments both prior to the hearing and after adoption of the budget. Prohibits discrimination under a local government program or activity on the basis of race, color, national origin, or sex if such program or activity is paid for with funds provided under this Act. Lists additional prohibitions applicable to such programs or activities. Prescribes procedures for: (1) instituting administrative proceedings for violations of such prohibitions; (2) suspending and terminating payments; and (3) judicial review of such sanctions. Sets forth provisions providing for: (1) enforcement by the Attorney General of such prohibitions; (2) civil actions by persons adversely affected by prohibited practices; (3) independent audits of local government finances; (4) investigations by the Secretary of possible violations of this Act; (5) reviews by the Comptroller General of activities of the Secretary, State governments, and local government units to determine compliance with this Act; (6) annual reports by the Secretary to the Congress on both the trust fund and the administration of the payment program; and (7) annual reports by local govermental units to the Secretary on program payments.

Directs the fund to plan, design, and oversee the construction of the Memorial. Establishes the World War II Memorial Advisory Board to: (1) promote and encourage the donation of private funds for the construction of the Memorial; and (2) recommend the site for and assist in the selection of the design of the Memorial. Terminates the Board within 30 days after completion of the Memorial or on the lapse of the authority provided by this Act. Authorizes the Fund to solicit and accept private contributions for construction of the Memorial. States that the requirements and authority of this Act shall lapse if: (1) construction of the Memorial is not commenced within seven years of its enactment; or (2) before such construction, the Secretary of the Interior certifies that funds are not available in an amount sufficient to ensure its completion.

Excludes from U.S. entry certain Haitians who directly or indirectly assisted the overthrow of President Aristide or who participated in terrorist acts against the Haitian people.

National Triad Program Act

National Triad Program Act - Requires the Director of the National Institute of Justice to conduct a national assessment of: (1) the nature and extent of crimes against the elderly; (2) the needs of law enforcement, health, and social service organziations, in working to prevent, identify, investigate, and provide assistance to victims of such crimes; and (3) promising strategies to respond effectively to those challenges. Specifies that such assessment shall address: (1) the analysis and synthesis of data from a range of sources; (2) the problems of elderly who are living alone or in high crime areas and who are abused and neglected, and the fear of victimization; (3) the identification of strategies and techniques tht have been shown to be effective or which show promise; (4) the analysis of the factors that enhance or inhibit development of a coordinated response by law enforcement, health care, and social service providers; and (5) the research agenda needed to develop a comprehensive understanding of the problems of crimes against the elderly. Requires the Director to disseminate the results of such assessment. Authorizes the Director to make awards to coalitions of local law enforcement agencies, victim service providers, and organizations representing the elderly for pilot programs and field tests of promising strategies and models for forging partnerships for crime prevention and service provision. Specifies that pilot programs funded under this Act may include existing general service coalitions of law enforcement, victim service, and elder advocate organizations that wish to use additional funds to work at a particular problem in their community or to target a particular geographic area in need of intensive services. Authorizes the Director to make awards to: (1) coalitions of national law enforcement, victim service, and elder advocate organizations for training and technical assistance in implementing pilot programs; (2) research organizations to investigate the types of elder victimization shown by the assessment to present particularly critical problems or to be emerging crimes about which little is known, to evaluate the effectiveness of selected pilot programs, and to conduct research and development identified as being critical; and (3) public service advertising coalitions to increase public awareness of, and promote ideas or programs to prevent, crimes against the elderly. Authorizes appropriations.

Veterans In Transition Act

Veterans In Transition Act - Directs the Secretary of Defense to provide post-service training vouchers to eligible members of the armed forces who apply in order to finance employment retraining provided through programs established under the Job Training Partnership Act. Requires such vouchers to be provided to such members within 60 days of their separation from active duty. Defines as eligible those members serving on active duty or full-time National Guard duty on September 30, 1990, who were either involuntarily separated or separated under one of the military separation incentive programs, and who were not entitled to retired or retainer pay incident to such separation. Requires such a member to certify to the Secretary that the member is unemployed and does not have a firm commitment for employment upon separation. Directs the Secretary to provide such vouchers to certain unemployed members who did not receive such vouchers due to lack of the required certification. Authorizes the Secretary to provide such vouchers to other members discharged or released from active duty if they would benefit from the training provided. Directs the Secretary to provide appropriate notification to members eligible for such vouchers. Provides for the determination of voucher amounts, requiring such amounts to be generally equal to the cost of providing the training required to achieve the employment objective chosen by the member. Directs the Secretary of Labor to assist the Secretary in determining voucher amounts. Authorizes any member receiving such a voucher to exchange it for employment and training services provided under the Job Training Partnership Act (JTPA) to the same extent as other individuals eligible to receive such services. Requires such vouchers to be used within a two-year period after discharge, release, or separation. Directs the Secretary, after receiving a voucher, to reimburse the training provider for the actual cost of providing such training, not to exceed the face value of the voucher. Prohibits more than ten percent of the funds provided under this Act from being used for administrative costs. Prohibits the training providers, in accepting vouchers in exchange for employment and training services under the JTPA, from: (1) reducing the number of individuals who receive such services in the absence of the voucher program; or (2) denying such services to veterans who are eligible for such services but do not have a voucher. Directs the Secretary to notify the State agency administering the JTPA in which the member intends to reside and take up training. Amends the JTPA to include such separated members in the defense conversion adjustment program provided under such Act. Requires preseparation counseling of members about to be discharged or released from active duty to occur as soon as possible, but not later than 90 days before the date of discharge (currently, upon discharge). Includes as part of such counseling the creation of a transition plan for the member and spouse to achieve educational, training, and employment objectives. Directs the Secretary to consult with the Secretaries of Labor, Education, and Veterans Affairs and the Economic Adjustment Committee to improve the coordination of, and eliminate duplication between, specified job training and placement programs available to members who are discharged or released from active duty. Directs the Secretary to use ten percent of the amount authorized to be appropriated under this Act for the financing of specified coordination efforts. Directs the Secretary, as part of the preseparation counseling provided to discharged or released members, to insure that information is provided to interested members with respect to the establishment and operation of small businesses. Authorizes the Secretary to make a grant to a member eligible for a training voucher to assist such member in establishing a small business after such discharge or release. Authorizes the Secretary to make a grant to a business owned or operated by a veteran to assist the business to employ members eligible for training vouchers. Authorizes the Secretary to enter into an agreement with the head of a Federal agency under which the agency makes grants to States and local governments and nonprofit organizations to establish internships or other training programs for members eligible for training vouchers. Provides that all such grants will be made in lieu of providing the member with a training voucher. Authorizes the Secretary, in order to assist discharged or released members and their spouses in locating civilian employment, to conduct marketing and employer outreach activities to promote the creation of employment opportunities for such members and spouses. Authorizes appropriations.

Residential Mortgage Credit Fairness Act of 1992 - Amends the Truth in Lending Act to prohibit a creditor from: (1) imposing terms and conditions for a residential mortgage transaction which are less favorable to the consumer than the terms and conditions which were originally disclosed to the consumer; or (2) limiting the availability or effectiveness of such terms and conditions to a specified period. Allows an exception to such requirements if: (1) the disclosure contains a clear and conspicuous statement that such terms and conditions are subject to change; or (2) any delay in consummating the transaction is due to an unreasonable delay caused by the consumer. Requires that any disclosure made in connection with a residential mortgage shall: (1) be mailed or delivered before the earlier of the date on which the credit is extended or three days after the creditor receives the consumer's application; and (2) include a statement of the rights and duties of the creditor and the consumer and any form to be used by the consumer to exercise the right to withdraw the application. Allows a consumer to withdraw a mortgage application without incurring any obligation to the creditor (other than certain reasonable fees) if the consumer provides the creditor written notice within three days after receiving the required disclosure statement from the creditor. Specifies that, for purposes of such required disclosure statements, the term "finance change" shall include any fee imposed by the creditor for any such extension of credit. Increases the civil penalty for failure to make a required disclosure for a residential mortgage from a minimum of $100 and a maximum of $1,000 to a minimum of $1,000 and a maximum of $10,000.

Displaced Federal Employees Assistance Act of 1992 - Establishes notification requirements for reductions in force (RIFs) affecting Federal employees. Requires: (1) at least 60 days' written notice to the employee and any such employee's exclusive representative for collective-bargaining purposes before such employee is so released; and (2) 60 days' notice, if the RIF would involve the separation of a significant number of employees, to the appropriate State dislocated worker units and the chief elected official of such units of local government as appropriate. Specifies that, with respect to certain RIFs involving the separation of a significant number of employees of the Department of Defense (DOD), the notice period shall be 120 days. Requires: (1) the Office of Personnel Management to establish and keep current a Government-wide list of vacant (or soon to be vacant) positions; and (2) specified executive agencies, in filling vacant positions for which qualified RIFed employees have applied, to give full consideration to the applications of such employees before selecting any candidate from outside the agency for the position, subject to specified limitations. Requires the Secretary to establish a program under which separation pay (equal to six months basic pay) may be offered to encourage eligible employees to take immediate or early retirement, subject to specified requirements. Allows RIFed employees to keep their Government health insurance for 18 months while paying only the employee share of the premium, with the cost paid out of DOD's salaries and expenses account.

Youth Employability Services 2000 Act of 1992 - Amends the Job Training Partnership Act (JTPA) to authorize appropriations to establish five additional Job Corps centers during each of the ten fiscal years beginning with FY 1993. Directs the Secretary of Labor (the Secretary) to evaluate the educational curricula offered by the Job Corps as to whether participants are being adequately prepared with skills to meet the technological demands of the marketplace. Requires a report to the Congress and dissemination of evaluation results. Revises the age limits for participation in the Job Corps to allow not more than 20 percent of the enrollees to be from age 22 through 24. Declares that JTPA allows participants to participate concurrently or sequentially in both the Job Corps and training services for the disadvantaged. Increases from ten to 20 percent the allowable number of nonresidential participants enrolled in the Job Corps in any year. Requires that, in enrolling nonresidential participants, priority be given to those eligible individuals who are single parents with dependent children. Prohibits the Secretary from reducing the number of residential participants in Job Corps programs during any program year below the number during 1991 in order to increase the number of nonresidential participants. Prohibits use of Department of Labor funds to contract with a nongovernmental agency to administer or manage a Civilian Conservation Center of the Job Corps on public land. Directs the Secretary, as practicable, to provide child care at or near Job Corps centers for individuals who require such care for their children in order to participate in the Job Corps. Requires each Job Corps center to provide alcohol and drug abuse counseling and referral to participants who need such services. Directs the Secretary to provide all nonprofit Job Corps contractors with an equitable and negotiated management fee of not less than one percent of the contract amount.

Authorizes the Corporation to make grants to existing or emerging community services empowerment corporations (corporations) for revolving funds that will provide assistance for business and employment opportunities in low-income urban and rural areas. Obligates at least ten percent of existing corporation annual appropriations for loans and capital investments to locally-owned small enterprises in high unemployment areas. Sets forth provisions regarding: (1) eligibility requirements; (2) aggregate grant limits; (3) limitations on capital investment, administrative costs, technical assistance, and training; and (4) limitations on loan repayments and capital investment proceeds. Authorizes the Corporation to make grants for: (1) emerging corporation enhancement, technical assistance, and training; and (2) research and development. Sets forth audit and reporting provisions. Authorizes appropriations.
