Tax Parity for Health Plan Beneficiaries Act of 2013 - Amends the Internal Revenue Code to: (1) exclude from an employee's gross income employer-provided accident and health plan benefits extended to a domestic partner or non-dependent, non-spouse beneficiary eligible to receive such benefits under an employer plan (i.e., "eligible beneficiary"); (2) exempt such benefits paid to eligible beneficiaries from otherwise applicable employment and unemployment taxes; (3) allow self-employed individuals a tax deduction for the health insurance costs of their eligible beneficiaries; (4) allow tax-exempt voluntary employees' beneficiary associations to provide sick and accident benefits to the domestic partners and non-dependent, non-spouse beneficiaries of their members; (5) allow reimbursement of the medical expenses of an eligible beneficiary from a health savings account (HSA); and (6) extend tax-exempt medical benefits to the eligible beneficiaries of retired employees Directs the Secretary of the Treasury to provide guidance relating to reimbursements from a flexible spending arrangement and a health reimbursement arrangement attributable to an eligible beneficiary as defined by this Act.

Open Fuel Standard Act of 2013 - Requires each fleet of a manufacturer of passenger automobiles (including light-duty motor vehicles) to comprise at least: (1) 30% qualified vehicles in model year 2016, and (2) 50% qualified vehicles in model year 2017 and each subsequent year. Defines "qualified vehicle" as: (1) a vehicle that operates on natural gas, hydrogen, or biodiesel; (2) a flexible fuel vehicle capable of operating on gasoline, E85, and M85; (3) a plug-in electric drive vehicle; or (4) a vehicle propelled solely by fuel cell or by something other than an internal combustion engine. Authorizes a manufacturer to request an exemption from such requirement from the Secretary of Transportation (DOT).

Treat and Reduce Obesity Act of 2013 - Amends title XVIII (Medicare) of the Social Security Act to include information on the coverage of intensive behavioral therapy for obesity in the "Medicare and You Handbook." Authorizes the Secretary of Health and Human Services (HHS) to allow other physicians, registered dietitians, certified diabetes educators, and instructors trained and certified by the National Diabetes Prevention Lifestyle Coach Training program of the Centers for Disease Control and Prevention (CDC) to provide, and be independently reimbursed for, intensive behavioral therapy for obesity furnished outside of the primary care setting, so long as any such nonphysician provider or instructor furnishing the therapy must communicate any recommendation or treatment plan for an individual to the individual's primary care physicians or practitioner. Authorizes the Secretary to cover under Medicare part D (Voluntary Prescription Drug Benefit Program) medication for treatment of obesity or for weight loss management for an overweight individual with one or more comorbidities.

Wireless Tax Fairness Act of 2013 - Prohibits states or local governments from imposing any new discriminatory tax on mobile services, mobile service providers, or mobile service property (i.e., cell phones) for five years after the enactment of this Act. Defines "new discriminatory tax" as a tax imposed on mobile services, providers, or property that is not generally imposed on other types of services or property, or that is generally imposed at a lower rate, unless such tax was imposed and actually enforced prior to the date of enactment of this Act. Amends the federal judicial code to grant jurisdiction to federal district courts to grant injunctive and other appropriate relief to prevent, restrain, or terminate any acts in violation of this Act. Requires the Comptroller General (GAO) to conduct a study of the impact of state and local taxes on mobile services, providers, or property on the costs consumers pay for mobile services.

PRIME Act of 2013

Preventing and Reducing Improper Medicare and Medicaid Expenditures Act of 2013 or PRIME Act of 2013 - Amends part D (Prescription Drug Benefits) of title XVIII (Medicare) of the Social Security Act (SSA) to direct the Secretary of Health and Human Services (HHS) to prohibit sponsors of prescription drug plans (PDPs) from paying claims for prescription drugs that do not include the valid National Provider Identifier for the drug's prescriber. Requires the Secretary's annual report to Congress on the use of recovery audit contractors under the Medicare Integrity Program to: (1) describe the types and financial cost of improper payment vulnerabilities identified by recovery audit contractors and how the Secretary is addressing them, and (2) assess the effectiveness of changes made to Medicare payment policies and procedures in order to address those vulnerabilities. Requires the Secretary to address improper payment vulnerabilities in a timely manner, prioritized based on the risk to the Medicare program. Authorizes the Secretary, under recovery audit contracts under both Medicare and Medicaid (SSA title XIX), to retain a certain portion of the recovered amounts for a program management account for activities addressing problems that contribute to improper payments and fraud. Requires the Secretary, under such contracts, to retain an additional 5% of the recovered amounts to be made available to the HHS Inspector General to investigate improper payments or audit internal controls associated with Medicare or Medicaid payments. Directs the Secretary to develop a plan to revise the incentive program under the Health Insurance Portability and Accountability Act of 1996 for the reporting of fraud and abuse to encourage greater participation by individuals reporting Medicare fraud and abuse. Requires the plan to include certain recommendations for: (1) ways to enhance rewards for individuals reporting, and (2) extention of the incentive program to the Medicaid program. Amends SSA title XIX to cover the costs of equipment, salaries and benefits, and travel and training in appropriations for the Medicaid Integrity Program. Allows the Secretary to increase Centers for Medicare and Medicaid Services (CMS) staff whose duties consist solely of protecting the integrity of the Medicare program by a number determined necessary to carry out the Program (currently, by 100). Directs the Secretary to provide incentives for Medicare administrative contractors to reduce the improper payment error rates in their jurisdictions. Requires imprisonment for up to 10 years or a fine of up to $500,000 ($1 million in the case of a corporation), or both, for knowingly, intentionally, and with the intent to defraud purchasing, selling, distributing, or arranging for the purchase, sale, or distribution of a Medicare, Medicaid, or CHIP beneficiary identification number or billing privileges under SSA titles XVIII, title XIX, or title XXI (Children's Health Insurance Program). Amends SSA title IV part D (Child Support and Establishment of Paternity) with respect to the Federal Parent Locator Service to give the CMS Administrator access to information in the National Directory of New Hires to determine the eligibility of an applicant for, or enrollee in, the Medicare program or an applicable state health subsidy program under the Patient Protection and Affordable Care Act (PPACA). Requires the Secretary to disclose to the HHS Inspector General information on individuals and their employers in the National Directory of New Hires if the HHS Inspector General gives the Secretary their names and Social Security account numbers. Restricts the use of such information to: (1) determining the eligibility of an applicant for, or enrollee in, the Medicare program or an applicable state health subsidy program; or (2) evaluating the integrity of such programs. Sets forth rules for the use and disclosure of such information by state agencies. Directs the Secretary to establish a plan to encourage and facilitate the participation of states in the Medicare-Medicaid Data Match Program (Medi-Medi Program). Revises Medi-Medi Data Match Program purposes. Amends SSA title XIX, as amended by PPACA, and XXI with respect to claims processing and detection of fraud within the Medicaid and CHIP programs.

Pet Safety and Protection Act of 2013 - Amends the Animal Welfare Act to list permissible sources of dogs and cats used by research facilities to include dogs and cats obtained: (1) from a licensed dealer, (2) from a publicly owned and operated pound or shelter that meets specified requirements, (3) by donation from a person who bred and raised the dog or cat or owned it for not less than one year, or (4) from a research facility licensed by the Secretary of Agriculture. Sets forth additional monetary penalties for related violations. Prohibits federal facilities from purchasing or otherwise acquiring dogs or cats for exhibition purposes (currently, for research, experimentation, or exhibition purposes) except from: (1) the operator of an auction that comports with legal requirements, or (2) a person holding a valid dealer or exhibitor license. Prohibits dealers from selling or otherwise providing any research facility (currently, any individual or entity) with random source dogs or cats unless specified certification requirements are met.

FIT Kids Act

Fitness Integrated with Teaching Kids Act or FIT Kids Act - Requires the Secretary of Education to award grants to states to implement comprehensive programs to promote physical activity, education, and fitness and nutrition that are based on scientifically valid research, and an analysis of need that considers, at a minimum, physical education indicators. Limits a grant award to a maximum of five years. Prescribes certain activities under a grant, including that states must: (1) develop and implement a physical education indicators measurement system; (2) collect and publish information on physical activity, education, and fitness and nutrition at the school level; (3) use indicators to identify and address student needs; (4) encourage local education agencies to integrate physical activity, education, and fitness into a range of subjects throughout the school day and locations within schools; and (5) award sub-grants based on identified needs. Requires the Secretary, acting through the Director of the Institute of Education Sciences, to establish program performance metrics to measure the effectiveness of the grant program's activities. Amends the Elementary and Secondary Education Act of 1965 to require the compact with parents under the school-level parental involvement policy to include a description of the school's responsibility to support their children in leading a healthy and active life, such as by providing health meals and snacks, encouraging participation in physical education, and sharing in physical activity outside the school day to support successful academic achievement. Amends the Rehabilitation Act of 1973 to require the Secretary to promote equal opportunities for students with disabilities to be included and participate in physical education and extracurricular athletics implemented in, or in conjunction with, elementary schools, secondary schools, and institutions of higher education, by ensuring the provision of appropriate technical assistance and guidance for schools and institutions and their personnel.

Federal Response to Eliminate Eating Disorders Act of 2013 - Amends the Public Health Service Act (PHSA) to require the Director of the National Institutes of Health (NIH) to take certain actions regarding eating disorder research, including to: (1) implement a scientifically justified budget for research on eating disorders, (2) coordinate and evaluate NIH research activities and programs, (3) expand NIH research on eating disorders, (4) establish a task force on eating disorder research, and (5) provide for centers of excellence for research on eating disorders. Requires the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC), to: (1) provide for the collection, analysis, and reporting of epidemiological data on eating disorders; (2) establish a Center of Eating Disorders Epidemiology to collect and analyze information on eating disorders; and (3) establish a CDC clearinghouse for the collection and storage of data generated under this Act. Sets forth requirements for providing education and training on eating disorders, including: (1) developing and implementing a training program for health professionals on eating disorders; (2) establishing the Task Force on Eating Disorders Prevention in Educational Institutions to develop and provide training on eating disorders identification and prevention for students, faculty, coaches, and staff in schools; and (3) conducting public service announcements. Amends the PHSA, the Employee Retirement Income Security Act of 1974 (ERISA), and the Internal Revenue Code to require a health plan that provides medical and surgical benefits to also provide coverage for eating disorders. Applies such requirement to coverage offered under the Federal Employees Health Benefit Program. Amends title XIX (Medicaid) of the Social Security Act to expand coverage for eating disorders. Requires the Secretary, acting through the Director of the Agency for Healthcare Research and Quality, to award grants for patient advocacy to help individuals with eating disorders obtain adequate health care services and insurance coverage.

Responding to Urgent Needs of Survivors of the Holocaust Act or RUSH Act - Amends the Older Americans Act of 1965 to include specifically within its purview older Americans who are Holocaust survivors. Authorizes the Administrator for Community Living to designate, within the Administration for Community Living of the Department of Health and Human Services (HHS), a person with specialized training, background, or experience with issues of Holocaust survivors to implement services for them. Requires a state nutrition project to: (1) ensure that project meals meet the dietary needs of program participants based on religious, cultural, or ethnic requirements; and (2) encourage individuals who distribute nutrition services to engage in conversation with homebound older individuals and to be aware of the warning signs of medical emergencies, injury, or abuse in order to reduce isolation and promote wellbeing. Amends the Older Americans Act Amendments of 2006 to require the study of nutrition projects to analyze the abilities of service providers to obtain viable contracts for special foods necessary to meet a religious requirement, required dietary need, or ethnic consideration. Authorizes the HHS Assistant Secretary for Aging to make grants to or contract with states, public agencies, private nonprofit agencies, institutions of higher education, and organizations, including tribal organizations, to support programs that provide transportation services and resources to older individuals with the greatest economic or social need.

Requires the Department of Defense (DOD) and the National Guard to inform military personnel who are discharged or released from active duty of the work opportunity tax credit and provide them with documentation relating to eligibility for and use of such credit. Requires the Secretaries of Labor, Veterans Affairs, and Defense to enter into an agreement to govern the coordination of veteran job training services. Requires the Secretaries of Labor and Veterans Affairs to prepare reports on the veteran job training programs of their respective departments. Amends the DOD pilot program for assessing the feasibility and advisability of permitting enlisted personnel to obtain civilian credentialing or licensing for skills required for military occupational specialties to require the designation as military occupational specialties of the MOS 31B Military Police, MOS 15Q AC-Air Traffic Controller, and the MOS 12M Fire Protection, in addition to not fewer than three and not more than five additional military occupational specialties. Amends the Small Business Act to direct the head of each executive department to submit an annual report to the Administrator of the Small Business Administration (SBA) containing the percentage of the total value of all prime contracts awarded by the executive department during the preceding one-year period to small business concerns owned and controlled by service-disabled veterans.

Horseracing Integrity and Safety Act of 2013 - Requires: (1) there to be an independent anti-doping organization with responsibility for ensuring the integrity and safety of horse races that are the subject of interstate off-track wagers, and (2) the independent anti-doping organization designated pursuant to the Office of National Drug Control Policy Reauthorization Act of 2006 to serve as such organization. Sets forth as the duties of such organization: (1) developing, publishing, and maintaining rules regarding substances, methods, and treatments that may and may not be administered to a horse participating in such a race; (2) implementing programing relating to anti-doping education, research, testing, and adjudication to prevent any horse participating in such a race from racing under the effect of any prohibited substance, method, or treatment; and (3) excluding from participation in any such race any person who is determined to have violated such a rule or who is subject to a suspension from horse racing activities by any state racing commission. Prescribes conditions under which such organization may: (1) suspend the period a person is excluded from participation; and (2) permit the use of furosemide by a horse participating in such a race during the two-year period following enactment of this Act. Permits a host racing association to conduct a horse race that is the subject of an interstate off-track wager, and permits an interstate off-track wager to be accepted by an off-track betting system, only if consent is obtained from such organization. Requires such organization to ensure that all costs incurred in carrying out its duties are defrayed pursuant to agreements for such consent.

Includes among exemptions to such prohibition the breeding transportation, or possession of such species by authorized persons. Defines "breeding" as facilitating the propagation or reproduction (whether intentionally or negligently), or failing to prevent the propagation or reproduction, of a prohibited wildlife species or other animal. Removes from the list of persons authorized to import, export, transport, sell, receive, acquire, purchase, breed, or possess such species a person that is licensed or registered, and inspected, by the Animal and Plant Health Inspection Service (APHIS) or any other federal agency with respect to such species. Includes in such list: an institution accredited by the Association of Zoos and Aquariums (AZA) or certified related facilities that coordinate with an AZA Species Survival Plan for breeding of species listed as threatened or endangered under the Endangered Species Act of 1973; a wildlife sanctuary that cares for such species, is a tax exempt corporation, does not commercially trade in or propagate such species, does not allow direct contact between the public and animals, and does not allow the transportation and display of such species off-site; a person that is in possession of animals of such species that were born before the date of this Act's enactment and that are registered with APHIS within 180 days after such regulations are promulgated; and a traveling circus that regularly travels in interstate commerce to conduct performances featuring live prohibited wildlife species and multiple trained human entertainers, that does not allow members of the public to be in direct contact with or unsafe proximity to a prohibited wildlife species of any age, and that, during the three years preceding this Act's enactment, has not been determined by the Secretary of Agriculture to have violated the Animal Welfare Act by reason of jeopardizing the health and well-being of a prohibited wildlife species. Establishes civil and criminal penalties and forfeiture requirements for violations of this Act.

Requires such campaign to include dissemination of the following information: (1) breast reconstruction is possible at the time of breast cancer surgery or at a later time; (2) prostheses or breast forms may be available; (3) federal law mandates that both public and private health plans include coverage of breast reconstruction and prostheses; (4) the patient has a right to choose the provider of reconstructive care, including the potential transfer of care to a surgeon that provides breast reconstructive care; and (5) the patient may opt to undergo breast reconstruction at a time after surgery for personal or medical reasons during treatment or after completion of all other breast cancer treatments. Requires the information required to be disseminated by this Act to be be posted on the Internet websites of relevant federal agencies, including the Office of Women's Health, the Office of Minority Health, and the Office of Rural Health Policy. Prohibits such campaign from specifying, or being designed to serve as a tool to limit, the health care providers available to patients. Requires biennial reports to Congress describing and evaluating the activities carried out under this Act.

Directs the Equal Employment Opportunity Commission (EEOC) to issue regulations to carry out this Act, including the identification of reasonable accommodations addressing known limitations related to pregnancy, childbirth, or related medical conditions.

Requires the Secretary of Health and Human Services (HHS) to develop a national acuity tool to establish nurse staffing requirements above minimum ratios. Directs the Secretary to adjust Medicare payments to hospitals to cover additional costs incurred in providing services to Medicare beneficiaries that are attributable to compliance with such ratios. Authorizes a nurse to object to, or refuse to participate in, any activity, policy, practice, assignment or task if in good faith it would violate minimum ratios under this Act or if the nurse is not prepared by education, training, or experience to fulfill the assignment without compromising the safety of any patient or jeopardizing the license of the nurse. Prohibits a hospital from: (1) taking specified actions against a nurse based on the nurse's refusal to accept an assignment for such a reason; or (2) discriminating against any patient, employee, or any other individual for good faith complaints or grievances relating to the care, services, or conditions of the hospital or of any affiliated or related facilities. Prohibits actions by hospitals to restrain such rights. Sets forth enforcement provisions. Applies provisions of this Act through federal health programs, including Medicare, Medicaid, and Department of Veterans Affairs (VA) health benefits programs. Includes stipends in the nurse workforce loan repayment and scholarship program. Expands the nurse retention grant program to authorize programs to implement nurse preceptorship and mentorship projects.

Requires a person conducting hydraulic fracturing operations, when a medical emergency exists and the proprietary chemical formula of a chemical used in such operations is necessary for medical treatment, to disclose such formula or the specific chemical identity of a trade secret chemical to the state, the Administrator, or the treating physician or nurse upon request, regardless of whether a written statement of need or a confidentiality agreement has been provided. Authorizes such person to require a written statement of need and a confidentiality agreement as soon thereafter as circumstances permit.

Better Enforcement for Sexual Assault Free Environments Act of 2013 or BE SAFE Act - Amends the Uniform Code of Military Justice (UCMJ) to repeal the authority of a convening authority (the person taking action on the findings of a court-martial) to use discretion to either set aside a finding of guilty or change such finding to a finding of guilty to a lesser included offense (except with respect to a minor offense). Requires a convening authority, when changing a charge with respect to a minor offense, to prepare a written explanation of such action, which shall be made part of the record. Prohibits a convening authority from reducing a sentence to less than the mandatory minimum sentence, unless to reflect the substantial assistance by the accused in the investigation or prosecution of another person who has committed an offense. Requires a convening authority who disapproves, commutes, or suspends a sentence, in whole or in part, to prepare a detailed written explanation therefor, which shall be made part of the record. Requires mandatory dismissal or dishonorable discharge of a person found guilty under the UCMJ of rape, sexual assault, forcible sodomy, or an attempt thereof. Eliminates any statute of limitations with respect to UCMJ actions for sexual assault of a child. Authorizes the Secretary of the military department concerned to provide guidance for commanders regarding their authority to make determinations, and to take action, regarding whether a member of the Armed Forces (member) serving on active duty who is alleged to have committed a sexual assault or other sex-related offense should be temporarily reassigned or removed from a position of authority or assignment in order to maintain order and discipline within the member's unit. Directs the Secretary concerned to designate legal counsel (knows as a Victims' Counsel) to provide legal assistance to a member or dependent who is the victim of a sex-related offense, whether the allegation is restricted (confidential) or unrestricted. Requires enhanced training for all military and civilian attorneys providing such assistance. Requires the Secretary of Defense (DOD) to report to the congressional defense committees on: (1) sentencing guidelines and mandatory minimum sentencing provisions under the UCMJ, and (2) the roles of commanders in the administration of military justice and the investigation, prosecution, and adjudication of UCMJ offenses.

Email Privacy Act - Amends the Electronic Communications Privacy Act of 1986 to prohibit a provider of remote computing service or electronic communication service to the public from knowingly divulging to any governmental entity the contents of any communication that is in electronic storage or otherwise maintained by the provider. Revises provisions under which the government may require, pursuant to a warrant, the disclosure by such a provider of the contents of such communications. Eliminates the different requirements applicable under current law depending on whether such communications were stored for fewer than, or more than, 180 days. Requires a law enforcement agency, within 10 days after receiving the contents of a customer's communication, or a governmental entity, within 3 days, to provide the customer a copy of the warrant and a notice that such information was requested by, and supplied to, the government entity. Provides that nothing in this Act shall be construed to limit the authority of a governmental entity to use an administrative or civil discovery subpoena to: (1) require an originator or recipient of an electronic communication to disclose the contents of such communication to the governmental entity; or (2) require an entity that provides electronic communication services to employees or agents of the entity to disclose the contents of an electronic communication to or from such employee or agent to a governmental entity if the communication is held, stored, or maintained on an electronic communications system owned or operated by the entity. Authorizes a governmental entity that is: (1) seeking a warrant for the contents of communications to include in the application a request for an order delaying the notification required for up to 180 days, in the case of a law enforcement agency, or up to 90 days, in the case of any other governmental entity; and (2) obtaining the contents of a communication, or information or records, to apply to a court for an order directing a provider of electronic communication service or remote computing service to which a warrant, order, subpoena, or other directive is directed not to notify any other person of the existence of the directive for up to 180 days, in the case of of a law enforcement agency, or up to 90 days, in the case of any other governmental entity. Provides for extensions. Requires service providers, after such extension, to provide the government three business days' notice of their intent to inform a customer or subscriber that the provider has disclosed the individual's electronic communications information to the government. Directs the Comptroller General to report to Congress by September 30, 2015, regarding the disclosure by electronic communication service providers of customer communications and records, including an analysis and evaluation of such disclosure under provisions: (1) as in effect before the enactment of this Act, and (2) as amended by this Act.
