Nurse Training and Retention Act of 2009 - Directs the Secretary of Labor to establish a partnership grant program to award matching grants to eligible entities to carry out comprehensive programs to provide education to nurses and create a pipeline to nursing for incumbent ancillary health care workers who wish to advance their careers.

Credit Card Fair Fee Act of 2009 - Sets forth a limited antitrust immunity to providers of covered electronic payment systems and merchants for negotiation of access rates and terms. Authorizes providers of a single covered electronic payment system (e.g. credit cards and/or debit cards) and merchants to jointly negotiate and agree upon rates and terms for access to such system. Provides immunity exceptions. Requires the rates and terms of a voluntarily negotiated access agreement to be the same for all merchants and participating providers, regardless of their respective category or volume of transactions. Requires issuers, acquirers, owners, and merchants to make specified disclosures regarding itemized costs and access agreements. Requires the negotiating parties to file jointly with the Attorney General any voluntarily negotiated access agreement that affects any market in the United States or elsewhere.

IDEA Fairness Restoration Act - Amends the Individuals with Disabilities Education Act to include expert witness fees, including the reasonable costs of any test or evaluation necessary for the preparation of the parent or guardian's case in the action or proceeding, within the definition of "attorneys' fees" that may be awarded to the prevailing party in a civil action brought under such Act.

Enhancing Science, Technology, Engineering, and Mathematics Education Act of 2009 - Requires the President to establish, in the Office of Science and Technology Policy, a Committee on Science, Technology, Engineering, and Mathematics Education (STEM education) within the National Science and Technology Council. Establishes an Office of Science, Technology, Engineering, and Mathematics Education in the Department of Education, to be administered by an Assistant Secretary. Requires the Assistant Secretary to conduct at least every five years an evaluation of the STEM education programs administered by the department. Requires the Secretary of Education to award a grant to establish a voluntary State Consortium on STEM Education and a grant to the National Science Digital Library to establish the STEM Education Resource Alliance.

Student-to-School Nurse Ratio Improvement Act of 2009 - Amends the Public Health Service Act to allow the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC), to make demonstration grants to states in which the student-to-school nurse ratio in public secondary schools, elementary schools, and kindergarten is 1,000 or more students to every school nurse to reduce such ratio.

Recognizes that: (1) the current payment mechanisms for Federally-Qualified Health Centers in Medicaid, the Children's Health Insurance Program (CHIP, formerly known as SCHIP), and Medicare are essential to assuring access to quality, affordable, primary, and preventive care servies; and (2) any expansion of private insurance must include mechanisms to ensure the full participation of, and appropriate reimbursement to, such Centers to ensure adequate access to care for the medically underserved and disenfranchised. Expresses the sense of Congress that: (1) everyone should have the choice of a community health center as their health care home and every center should be appropriately reimbursed for the care it provides; and (2) health care reform should include measures to expand community health centers.

Federal Oil Spill Research Program Act - Amends the Oil Pollution Act of 1990 to direct the President to establish the Federal Oil Spill Research Committee as an interagency committee to coordinate a comprehensive federal oil spill research program, complete a research assessment on the status of oil spill prevention and response capabilities, and develop a federal oil spill research plan. Directs the Committee to: (1) establish a program for conducting oil pollution research, development, and demonstration; (2) submit to Congress an assessment of the status of oil spill prevention and response capabilities; and (3) establish the priorities for federal oil spill research and development. Requires the Administrator of the National Oceanic and Atmospheric Administration (NOAA) to: (1) award competitive grants to higher education and other research institutions to advance research and development and to demonstrate technologies for preventing, detecting, or mitigating oil discharges; and (2) contract with the National Academy of Sciences to assess, evaluate, and report on the status of federal oil spill research and development.

Directs the Secretary of the Interior, through the Director of the National Park Service (NPS), to conduct a study of the National D-Day Memorial in Bedford, Virginia, to evaluate its national significance and the suitability and feasibility of designating it as a unit of the National Park System. Requires the identification of alternatives for the management, administration, and protection of the Memorial.

Healthy Transition Act of 2009 - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS) to award grants or cooperative agreements to states: (1) to develop plans for the statewide coordination of services to assist adolescents and young adults with a serious mental health disorder in acquiring the skills, knowledge, and resources necessary to ensure their healthy transition to successful adult roles and responsibilities; and (2) for the coordination of such services. Requires the Secretary to designate a federal entity, or establish a Committee of Federal Partners, to coordinate programs providing such services. Directs such entity or committee to: (1) review how federal programs and efforts that address issues related to the transition of adolescents and young adults with serious mental health disorders may be coordinated to ensure the maximum benefit for the individuals being served; and (2) provide technical assistance to the states that are planning or implementing programs under this Act.

School Meal Enhancement Act of 2009 - Directs the Secretary of Agriculture to implement a school-wide paperless free school meal program which allows local educational agencies (LEAs) to select certain schools to provide free meals to all their students without the use of paper applications to determine their eligibility for free or reduced price breakfasts or lunches under the Child Nutrition Act of 1966 or the Richard B. Russell National School Lunch Act. Prohibits the participation of schools that do not have a student enrollment of which at least: (1) 65% are estimated to be eligible for free meals under the Richard B. Russell National School Lunch Act and the Child Nutrition Act of 1966; or (2) 75% are estimated to be eligible for free or reduced price meals under the Richard B. Russell National School Lunch Act. Requires the Secretary to issue guidance that establishes an alternate, paperless method of determining such estimated eligibility rates. Reimburses the school food service authority of each participating LEA pursuant to a formula that factors in such estimated eligibility rates.

Federal Youth Coordination Act of 2009 - Amends the Tom Osborne Federal Youth Coordination Act to establish in the Executive Office of the President the White House Office of National Youth Policy, headed by a Director, to: (1) develop, coordinate, promulgate, oversee the implementation of, and evaluate the National Youth Strategy to maximize the efficiency and effectiveness of youth services; (2) review and make recommendations with respect to the budgets for federal youth services to ensure the adequacy of those budgets; (3) coordinate the youth services provided by federal departments and agencies and coordinate federal interagency youth services; (4) consult, coordinate with, facilitate joint efforts among, and support state, local, and tribal governments, nongovernmental entities, and youth, particularly disadvantaged youth, with respect to improving youth services; and (5) make grants and provide training and technical assistance to states to support state Youth Services Coordinating Entities and state Youth Advisory Boards. Requires the Director to submit to the President and Congress, and make available to the public, a National Youth Strategy that shall set forth a comprehensive plan for that year to improve outcomes for youth in the United States, particularly disadvantaged youth. Requires coordination of federal departments and agencies with the White House Office. Places the existing National Youth Development Council within the White House Office to assist the Director by coordinating: (1) the youth services provided by federal departments and agencies; and (2) federal interagency youth services. Requires the Council also to assist in the development, coordination, implementation, evaluation, and promulgation of the Strategy. Establishes within the White House Office the National Youth Advisory Board.

Clean Energy Promotion Act - Requires the United States to annually deposit into the BLM Wind Energy and Solar Energy Permit Processing Improvement Fund up to $5 million received as annual wind energy and solar energy right-of-way authorization fees under the Federal Land Policy and Management Act of 1976. Makes the amounts deposited available for salaries and expenses related to the Bureau of Land Management (BLM) offices dedicated to the coordination and processing of wind energy and solar energy permit applications. Authorizes the expenditure or transfer of such amounts as are necessary to: (1) the U.S. Fish and Wildlife Service; (2) the Environmental Protection Agency (EPA); and (3) state agencies involved in the processing of wind and solar permits on federal lands under the jurisdiction of the BLM.

Encourages each institution of higher education (IHE) in the country to seek membership in the Servicemembers Opportunity Colleges (SOC) Consortium, which helps coordinate postsecondary educational opportunities for members of the Armed Forces, their families, and veterans. Supports the goals and ideals of High-Performance Building Week. Recognizes and reaffirms the nation's commitment to High-performance Buildings by promoting awareness about their benefits and new education programs, supporting research, and expanding access to information. Recognizes the unique role that the Department of Energy (DOE) plays through the Office of Energy Efficiency and Renewable Energy's Building Technologies Program, which works closely with the building industry and manufacturers to conduct research and development on technologies and practices for building energy efficiency. Recognizes the important role that the National Institute of Standards and Technology (NIST) plays in developing the measurement science needed to develop, test, integrate, and demonstrate the new building technologies. Encourages further research and development of high-performance building standards, research, and development.

Positive Behavior for Safe and Effective Schools Act - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to allow states to allocate school improvement funds under title I of the ESEA for coordinated, early intervention services for all students. Includes among such services, schoolwide positive behavior supports, defined as a systematic approach to embed proven practices for early intervention services in order to achieve important social outcomes and increase student learning, while preventing problem behaviors. Requires improvements in schoolwide learning climates, including schoolwide positive behavior supports, to be a target of: (1) technical assistance provided by states to local educational agencies (LEAs) and schools, and by LEAs to schools identified as needing improvement; (2) schoolwide programs that allow LEAs to consolidate educational funds to upgrade the entire educational program of schools that serve a high proportion of low-income families; (3) professional development funding; (4) funding under the Safe and Drug-Free Schools and Communities program; and (5) elementary and secondary school counseling programs. Amends the Department of Education Organization Act to establish, within the Department of Education, an Office of Specialized Instructional Support Services to oversee, implement, and ensure adequate evaluation of, the provision of specialized instructional support services in schools by school counselors, social workers, psychologists, and other qualified professionals.

Prosthetic and Custom Orthotic Parity Act of 2009 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to require a group health plan that provides medical and surgical benefits as well as benefits for prosthetic devices and components and orthotic devices to offer such prosthetic and orthotic coverage in the same manner as applicable to medical and surgical benefits. Prohibits separate financial requirements or more restrictive treatment limitations. Limits required benefits for prosthetic devices and custom orthotic devices and related services to the most appropriate model that adequately meets the medical requirements of the patient. Requires benefits to include repairs and replacements as determined appropriate by the treating physician. Prohibits any annual or lifetime dollar limitation on benefits for prosthetic devices and custom orthotic devices and related services unless such limitation applies in the aggregate to all benefits.

Help Student Soldiers Act - Amends title IV (Student Assistance) of the Higher Education Act of 1965 to waive the application of the requirement that students return title IV funds which were unearned due to their withdrawal from school to students whose withdrawal is necessitated by service in the Armed Forces. Provides loan forgiveness under the Federal Family Education Loan, Direct Loan, and Perkins Loan programs to students for that portion of loan assistance which is unearned due to their withdrawal from school for service in the Armed Forces and which is not returned to such programs by their schools.

Pathways to College Act - Authorizes the Secretary of Education to award competitive five-year grants to local educational agencies that serve mostly high-need high schools for programs to increase the number of students from low-income families who attend college. Defines "high-need high schools" as those where at least one-half of the students are from low-income families. Requires grantees to use such funds to: (1) train teachers and counselors to provide students with advice concerning postsecondary education; (2) implement a comprehensive college guidance program for all students which exposes them to postsecondary information and planning assistance before the end of their first semester of high school; (3) ensure that their schools develop comprehensive, school-wide plans of action to strengthen their college-going culture; (4) create or maintain a postsecondary access center in each school that provides information on colleges and universities, career opportunities, and financial aid options; and (5) provide a setting in which professionals working in college access programs can meet with students. Directs the Secretary to provide technical assistance to grantees in calculating and analyzing their college-going rates and adopting best practices for elevating such rates. Requires grantees periodically to evaluate the success of their grant activities and use the evaluations to refine such activities and their performance measures. Directs the Secretary to conduct an independent evaluation of the grant program which includes an assessment of the program's affect on high school graduation and college-going rates.

Securing American Families by Educating and Training Youth (SAFETY) Through Nonviolence Act of 2009 - Authorizes the Attorney General to award grants to state or local governments, educational institutions, nonprofit organizations, and faith-based entities to prevent or alleviate the effects of community violence by educating, mentoring, and counseling youth regarding the principles and application of nonviolence in conflict resolution. Gives grant priority to applicants that agree to use the funds in communities experiencing an increase in violence, but lacking the resources to address violence prevention.

National Fish Habitat Conservation Act - Establishes a National Fish Habitat Board to: (1) promote, oversee, and coordinate the implementation of this Act and the existing National Fish Habitat Action Plan; (2) establish aquatic habitat conservation goals and priorities; and (3) review and recommend fish habitat conservation projects. Authorizes the Board to designate Fish Habitat Partnerships to: (1) coordinate Plan implementation at a regional level; (2) identify strategic priorities; (3) recommend habitat projects; and (4) develop and carry out fish habitat conservation projects. Establishes Partnership approval criteria, including that a Partnership: (1) include representatives of a diverse group of public and private partners focused on conservation of aquatic habitats to achieve results across jurisdictional boundaries and public and private land; and (2) is able to address issues and priorities on a nationally significant scale. Directs the Secretary of the Interior to fund, from amounts appropriated under this Act, up to 50% of the cost of approved fish habitat conservation projects on nonfederal and 100% of projects on federal land or water. Requires the Director of the U.S. Fish and Wildlife Service to: (1) establish the National Fish Habitat Conservation Partnership Office within the Service; and (2) develop the Office's interagency operational plan. Requires the Director, the Assistant Administrator of the National Oceanic and Atmospheric Administration (NOAA), and the Director of the United States Geological Survey (USGS) to provide technical and scientific assistance to the Partnerships, the project participants, and the Board.

Charles August "CAL" Long Undiagnosed Diseases Registry Act of 2009 - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC), to establish and maintain an undiagnosed diseases registry to facilitate the early recognition, prevention, treatment, cure, and control of such diseases. Authorizes the Secretary to make the information in the registry publicly available, except for: (1) individually identifiable information; or (2) trade secrets or commercial or financial information. Requires such database to be operational one year after enactment of this Act.

Tax Equity for Health Plan Beneficiaries Act of 2009 - Amends the Internal Revenue Code to: (1) exclude from an employee's gross income employer-provided accident and health plan benefits extended to a domestic partner or non-dependent, non-spouse beneficiary eligible to receive such benefits under an employer plan (i.e., "eligible beneficiary"); (2) exempt such benefits paid to eligible beneficiaries from applicable employment and unemployment taxes; (3) allow self-employed individuals a tax deduction for the health insurance costs of their eligible beneficiaries; (4) allow tax-exempt volutary employees' beneficiary associations to provide sick and accident benefits to the domestic partners and non-dependent, non-spouse beneficiaries of their members; and (5) allow reimbursement of the medical expenses of an eligible beneficiary from a health savings account (HSA). Directs the Secretary of the Treasury to provide guidance relating to reimbursements from a flexible spending arrangement and a health reimbursement arrangement attributable to an eligible beneficiary as defined by this Act.

Authorizes the award of a single Congressional Gold Medal to collectively honor the American soldiers who were prisoners of war at Bataan/Corregidor/Luzon during World War II, in recognition of their personal sacrifice and service to their country. Provides for the Medal's display at the Smithsonian Institution. Expresses the sense of Congress that the Medal should be made available for display elsewhere, particularly at locations associated with those who fought in defense of Bataan/Corregidor/Luzon and the prisoners of war.

Blue Star/Gold Star Flag Act of 2009 - States that a condominium association, cooperative association, or residential real estate management association may not adopt or enforce any policy, or enter into any agreement, that would restrict or prevent an association member from displaying a Service Flag on residential property within the association with respect to which such member has a separate ownership interest or a right to exclusive possession or use. (A Service Flag, also known as a "blue star banner," is an official banner authorized by the Department of Defense [DOD] for display by families who have members serving in the Armed Forces during any period of war or hostilities the United States may be engaged in for the duration of such hostilities.) States that nothing in this Act shall be considered to permit any display or use inconsistent with: (1) any DOD regulations regarding rules or customs pertaining to the proper display or use of the Service Flag; or (2) any reasonable restriction pertaining to the time, place, or manner of displaying the flag necessary to protect a substantial interest of the condominium, cooperative, or residential real estate management association.

Domestic Partnership Benefits and Obligations Act of 2009 - Provides that a federal employee and his or her domestic partner shall be entitled to benefits available to, and shall be subject to obligations imposed upon, a married federal employee and his or her spouse. Defines "domestic partner" to mean an adult unmarried person living with another adult unmarried person of the same sex in a committed, intimate relationship. Defines "benefits" to include federal health insurance and enhanced dental and vision benefits, retirement and disability benefits, family, medical, and emergency leave, group life insurance, long-term care insurance, compensation for work injuries, and benefits for disability, death, or captivity. Excludes members of the uniformed services from the definition of "employee." Sets forth requirements for filing: (1) an affidavit of eligibility as such a domestic partner, which shall include a certification that the employee and the domestic partner are each other's sole domestic partners and intend to remain so indefinitely; and (2) a statement upon dissolution of such a domestic partnership.

Domestic Violence Leave Act - Amends the Family and Medical Leave Act of 1993 to entitle an eligible employee, his or her same-sex spouse, or domestic partner to up to 12 workweeks of leave during any 12-month period: (1) to care for such individual's family member, if the family member is addressing domestic violence, sexual assault, or stalking and their effects; or (2) because such individual is addressing such matters, he or she is unable to perform any of the functions of his or her position. Authorizes such individual to substitute any of his or her accrued paid vacation leave, personal leave, family leave, or medical or sick leave for any of the 12-week period of such leave. Authorizes an employer to require an employee to certify with documentation the basis of the leave request. Declares that nothing in this Act shall require an employer to provide paid sick leave or paid medical leave in any situation in which such employer would not normally provide any such paid leave. Amends federal civil service law to entitle civilian federal employees, their same-sex spouses, or domestic partners to the same leave allowance. Provides for the substitution of accrued paid annual or sick leave for any part of the 12-week period. Authorizes the employing agency to require an employee to certify with documentation the basis of the leave request.

Mental Health in Schools Act of 2009 - Amends the Public Health Service Act to revise a community children and violence program to assist local communities and schools in applying a public health approach to mental health services, including by: (1) revising eligibility requirements for a grant, contract, or cooperative agreement; and (2) providing for comprehensive school mental health programs that are culturally and linguistically appropriate and age appropriate. Makes only a partnership between a local educational agency and at least one community program or agency that is involved in mental health eligible for such funding. Sets forth assurances required for eligibility, including that: (1) the local education agency will enter into a memorandum of understanding with relevant community-based entities that clearly states the responsibilities of each partner; (2) the program will include training of all school personnel, family members of children with mental health disorders, and concerned members of the community; and (3) the program will demonstrate the measures to be taken to sustain the program after funding terminates. Requires the Administrator of the Substance Abuse and Mental Health Services Administration to develop a process for evaluating grant program activities, including: (1) the development of guidelines for the submission of program data by recipients; and (2) the development of measures of outcomes to be applied by recipients in evaluating programs, to include student and family measures and local educational measures.

Absentee Ballot Track, Receive, and Confirm Act - Amends the Help America Vote Act of 2002 to direct the Election Assistance Commission (EAC) to make a payment to reimburse a state for the costs incurred in establishing, if the state so chooses, an absentee ballot tracking program for federal elections.

Truth in Fur Labeling Act of 2009 - Amends the Fur Products Labeling Act to: (1) eliminate the exemption to fur labeling requirements for products containing relatively small amounts of fur; and (2) permit states to enforce more restrictive labeling requirements. Directs the the Federal Trade Commission (FTC), in the Fur Products Name Guide, to replace the term "Raccoon, Asiatic" with "Dog, Raccoon."

Comparative Effectiveness Research Act of 2009 - Amends title XI (General Provisions, Peer Review, and Administrative Simplification) of the Social Security Act to provide for a program of comparative effectiveness research for health care. Defines "comparative effectiveness research" as research evaluating and comparing the implications and outcomes of two or more health care strategies to address a particular medical condition. Establishes the Health Care Comparative Effectiveness Research Institute as a nonprofit, nongovernmental corporation to conduct research on the effectiveness of health care treatments, including pharmaceuticals, medical devices and procedures, and other therapies. Requires the Institute to: (1) identify national priorities for comparative clinical effectiveness research; (2) establish and update a research project agenda and provide for peer review of research; (3) establish a standing methodology committee for developing the science of comparative effectiveness research; and (4) disseminate research findings. Amends the Internal Revenue Code to establish in the Treasury the Comparative Effectiveness Research Trust Fund. Provides revenues for the Trust Fund by: (1) transferring amounts from certain appropriations for comparative effectiveness research, from the General Fund, and from the Medicare Federal Hospital Insurance and Federal Supplementary Medical Insurance Trust Funds; and (2) imposing a fee on certain accident or health insurance policies and self-insured health plans. Requires the Comptroller General to review financial audits of the Institute and assess the adequacy and use of funding. Terminates all funding for the Trust Fund after FY2020.

Lord's Resistance Army Disarmament and Northern Uganda Recovery Act of 2009 - Directs the President to submit to the appropriate congressional committees a regional strategy to guide U.S. support for multilateral efforts to eliminate the threat to civilians and regional stability posed by the Lord's Resistance Army (LRA) and to enforce the rule of law and ensure full humanitarian access in LRA-affected areas. Authorizes the President to provide assistance to respond to the humanitarian needs of populations in northeastern Congo, southern Sudan, and Central African Republic affected by LRA activity. Expresses the sense of Congress that the Secretary of State and Administrator of the United States Agency for International Development (USAID) should work with the appropriate congressional committees to increase future assistance to Uganda if the government of Uganda demonstrates a commitment to reconstruction in war-affected areas of northern and eastern Uganda. Expresses the sense of Congress that the President should support efforts by the people of northern Uganda and the government of Uganda to: (1) promote local and national reconciliation including mechanisms outlined in the Annexure to the Agreement on Accountability and Reconciliation between the government of Uganda and the LRA; and (2) assist internally displaced people, establish mechanisms for the demobilization and reintegration of former combatants, and enhance the competency of local institutions including the police.

Healthy Families Act - Requires certain employers, who employ 15 or more employees for each working day during 20 or more workweeks a year, to permit each employee to earn at least one hour of paid sick time for every 30 hours worked. Declares that an employer shall not be required to permit an employee to earn more than 56 hours of paid sick time in a calendar year, unless the employer chooses to set a higher limit. Allows employees to use such time to: (1) meet their own medical needs; (2) care for the medical needs of certain family members; or (3) seek medical attention, assist a related person, take legal action, or engage in other specified activities relating to domestic violence, sexual assault, or stalking. Prohibits an employer from interfering with an employee's exercise of such rights. Directs the Secretary of Labor to exercise certain investigative and enforcement authority for employees covered by the Family and Medical Leave Act of 1993 or the Government Employee Rights Act of 1991. Grants the same authority, for employees under their jurisdiction, to the Librarian of Congress, the Comptroller General, the Board of Directors of the congressional Office of Compliance, and the Merit Systems Protection Board. Authorizes civil actions by employees, individuals, or their representatives for damages or equitable relief against employers who violate this Act. Waives a state's sovereign immunity with respect to a suit brought by an employee of a federally-assisted state program or activity for relief authorized under this Act. Requires the Commissioner of Labor Statistics annually to compile information annually on paid sick time, and the Comptroller General to study related matters. Declares that nothing in this Act shall be construed to discourage employers from adopting or retaining more generous leave policies.
