Ending the Medicare Disability Waiting Period Act of 2009 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act (SSA) to: (1) phase out the waiting period for disabled individuals to become eligible for benefits under SSA title XVIII (Medicare); and (2) eliminate the waiting period for individuals with life-threatening conditions to become eligible for such benefits. Directs the Secretary of Health and Human Services to request the Institute of Medicine of the National Academy of Sciences to study the range of disability conditions that can be delayed or prevented if individuals receive access to health care services and coverage before a condition reaches disability levels.

Breast Cancer Patient Protect Act of 2009 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to require a group health plan that provides medical and surgical benefits to ensure that inpatient (and in the case of a lumpectomy, outpatient) coverage and radiation therapy are provided for breast cancer treatment. Prohibits such a plan from: (1) restricting benefits for any hospital length of stay to less than 48 hours in connection with a mastectomy or breast conserving surgery or 24 hours in connection with a lymph node dissection, insofar as the attending physician, in consultation with the patient, determines such stay to be medically necessary; or (2) requiring that a provider obtain authorization from the plan or issuer for prescribing any such length of stay. Requires such a plan or issuer to: (1) provide notice to each participant and beneficiary regarding the coverage required under this Act; and (2) ensure that coverage is provided for secondary consultations. Prohibits a group health plan from taking specified actions to avoid the requirements of this Act. Applies such requirements to health insurance issuers offering coverage in the individual market. Allows a health insurance issuer that provides individual health insurance coverage to nonrenew or discontinue an individual's coverage based on the intentional concealment of material facts regarding a health condition related to the condition for which coverage is being claimed.

Mail Network Protection Act of 2009 - Requires the U.S. Postal Service to bargain with unions representing career Postal Service employees before entering into a contract for mail processing, mail handling, or surface transportation of mail if the contract, in a 12 month period, would involve work that would otherwise be performed, in whole or in part, by those employees and either: (1) involve more than a specified amount of work time; or (2) cost over $5 million.

Community Choice Act of 2009 - Amends title XIX (Medicaid) of the Social Security Act (SSA) to require state Medicaid plan coverage of community-based attendant services and supports for certain Medicaid-eligible individuals. Outlines requirements for: (1) an enhanced federal medical assistance percentage (FMAP) for ongoing activities of early coverage states that enhance and promote the use of community-based attendant services and supports; and (2) increased federal financial participation for certain expenditures incurred by the state for the provision of such services and supports. Directs the Secretary of Health and Human Services to: (1) award grants to eligible states which have established a Consumer Task Force to assist the state in its development of real choice systems change initiatives; and (2) conduct a demonstration project for the purpose of evaluating service coordination and cost-sharing approaches with respect to the provision of community-based services and supports to dually eligible individuals.

Public Lands Service Corps Act of 2009 - Amends the Public Lands Corps Act of 1993 to rename the Public Lands Corps as the Public Lands Service Corps. Permits Corps participants to work in the National Marine Sanctuary System, coral reefs, and other coastal, estuarine, and marine habitats, and other lands and facilities administered by the National Oceanic and Atmospheric Administration (NOAA). Requires the: (1) establishment of offices within the Department of the Interior, Forest Service, and NOAA for the coordination of Corps activities; and (2) designation of a Corps coordinator for each agency within the Departments of the Interior, Agriculture, and Commerce that administers eligible service lands. Requires the Corps to consist of individuals between the ages of 16 and 25 who are enrolled as participants for a period of not more than two years. (Current law does not specify any time period for enrollment.) Requires a recruitment program and training program for Corps members. Describes the types of natural and cultural resources conservation projects that may be carried out by the Corps or any qualified youth or conservation corps on eligible service lands. Sets forth requirements regarding the use of Corps members to provide certain visitor and interpretation services. Authorizes the Secretaries to: (1) establish residential conservation centers; (2) provide temporary housing for the Corps and residential conservation centers; (3) as an appropriate natural and cultural resources conservation project, direct Corps participants to aid in the construction of residential conservation center facilities, including housing; (4) seek the assistance of the Secretary of Energy in identifying and using green building technologies and modular housing designs that may be adapted for such facilities; and (5) recruit mentors for Corps participants. Authorizes individual placements of consulting interns with federal land, coastal, and ocean management agencies to carry out management analysis. Requires the issuance of management guidelines for programs of the Corps.

Fitness Integrated with Teaching Kids Act or the FIT Kids Act - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to require annual state and local educational agency report cards to include specified information on school health and physical education programs. Includes the promotion of healthy, active lifestyles by students within ESEA grant programs that support school counseling, smaller learning communities, community learning centers, and parental involvement in their childrens' education. Revises the professional development program for teachers and principals to include training for physical and health education teachers, and training on improving students' health habits and participation in physical activities. Directs the Secretary of Education to contract with the National Academy of Sciences (NAS) for a study that: (1) assesses the effect health and physical education have on students' ability to learn; and (2) makes recommendations for improving, and measuring improvements to, their health and physical education in schools.

Flexibility in Rebuilding American Fisheries Act of 2009 - Amends the Magnuson-Stevens Fishery Conservation and Management Act to require fishery management plans, amendments, or regulations for overfished fisheries to specify a time period for ending overfishing and rebuilding the fishery that is as short as practicable (currently, as short as possible). Modifies the exceptions to the requirement that such period not exceed ten years. Requires consideration, in evaluating progress to end overfishing and rebuild overfished stocks, of factors other than commercial and recreational fishing. Requires, when the Secretary of Commerce extends the period under specified provisions, that the maximum rebuilding time not exceed the sum of the initial ten-year period, the expected time to rebuild the stock absent any fishing mortality and under prevailing environmental conditions, and the mean generation time of the stock.

Preservation of Antibiotics for Medical Treatment Act of 2009 - Amends the Federal Food, Drug, and Cosmetic Act to require the Secretary of Health and Human Services to deny an application for a new animal drug that is a critical antimicrobial animal drug unless the applicant demonstrates that there is a reasonably certainty of no harm to human health due to the development of antimicrobial resistance attributable to the nontherapeutic use of the drug. Defines "critical antimicrobial animal drug" as a drug intended for use in food-producing animals that contains specified antibiotics or other drugs used in humans to treat or prevent disease or infection caused by microorganisms. Requires the Secretary to withdraw approval of a nontherapeutic use of such drugs in food-producing animals two years after the date of enactment of this Act unless certain safety requirements are met. Directs specified congressional committees to hold hearings on the implementation of such a withdrawal of approval.

Preexisting Condition Patient Protection Act of 2009 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to prohibit a group health plan from: (1) imposing any preexisting condition exclusion; or (2) providing for an affiliation period for coverage offered by a health maintenance organization (HMO). Defines an "affiliation period" as a period of time before health insurance coverage becomes effective. Requires each health insurance issuer offering coverage in the group market in a state to accept every employer in the state that applies for such coverage. Prohibits preexisting condition exclusions for individual health insurance coverage. Requires the Secretary of Health and Human Services to report to Congress on the impact of this Act on health benefits coverage. Authorizes the Secretary to request claims data, enrollee data, and other appropriate information from group health plans and health insurance issuers. Directs the Comptroller General to report to Congress on the impact of this Act and other relevant federal laws on the reduction in the number of uninsured and underinsured individuals and on the affordability of coverage.

Securing America's Future Economy Commission Act or SAFE Commission Act - Establishes the Securing America's Future Economy (SAFE) Commission to develop legislation designed to address: (1) the unsustainable imbalance between long-term federal spending commitments and projected revenues; (2) increases in net national savings to provide for domestic investment and economic growth; (3) the implications of foreign ownership of federally issued debt instruments; and (4) revision of the budget process to place greater emphasis on long-term fiscal issues. Requires the Commission to: (1) develop one or two methods for estimating the cost of legislation as an alternative to the current Congressional Budget Office (CBO) method; and (2) hold at least one town-hall style public hearing within each federal reserve district. Requires the Commission to submit a legislative proposal to Congress and the President. Authorizes the President to submit to Congress an alternative proposal. Authorizes the Committee on the Budget of either chamber to publish its own alternative proposal in the Congressional Record. Sets forth procedures for consideration of such legislation. Requires CBO to prepare a long-term cost estimate and have it published in the Congressional Record as expeditiously as possible whenever requested to do so by the Commission, the President, or the chairman or ranking minority member of the Committee on the Budget of either chamber.

Ban Poisonous Additives Act of 2009 - Treats any food container that is composed, in whole or in part, of bisphenol A or that can release bisphenol A into food as a container that is composed of a poisonous or deleterious substance for purposes of the Federal Food, Drug, and Cosmetic Act. Bans the use of such containers. Allows the Secretary of Health and Human Services to grant a waiver of such ban for one year (renewable for an additional year) under specified circumstances. Requires any product for which the Secretary grants a waiver to display a prominent warning on its label of the potential health effects associated with bisphenol A. Directs the Commissioner of Food and Drugs to periodically review substances listed in federal regulations and generally recognized as safe. Requires any such substances that are shown by new scientific evidence to cause reproductive or developmental toxicity in humans or animals to be banned or otherwise restricted. Amends the Federal Food, Drug, and Cosmetic Act to require (currently, permits) a manufacturer or supplier of a food contact substance to notify the Secretary of the identity, intended use, and safety of any such substance and of determinations as to the health effects of such substance.

United States Cadet Nurse Corps Equity Act - Deems service of a person as a member of the United States Cadet Nurse Corps between July 1, 1943, and December 15, 1945 (qualified service), to be active military service for purposes of all laws administered by the Department of Veterans Affairs. Requires: (1) the Secretary of Defense to issue an honorable discharge to each person whose qualified service warrants one; and (2) the discharge to be issued before the end of the one-year period beginning on the enactment of this Act. Prohibits benefits from being paid to persons as a result of such enactment for any period before the enactment date.

Prescribe A Book Act - Creates a Pediatric Early Literacy program under which the Secretary of Education awards matching grants to nonprofit organizations for the implementation of three-part models through which: (1) health care providers encourage parents to read aloud to their children and offer them recommendations and strategies for doing so; (2) health care providers give each visiting child between the ages of six months and five-years a new, developmentally appropriate children's book to take home and keep; and (3) volunteers reading to children in health care facility waiting areas show parents the techniques and pleasures of reading aloud to children. Requires that the books provided to children under the program be obtained at a discount.

Multinational Species Conservation Funds Semipostal Stamp Act of 2009 - Requires the United States Postal Service to issue and sell, at a premium, a Multinational Species Conservation Funds Semipostal Stamp. Requires proceeds from the sale of such stamp to be: (1) transferred to the United States Fish and Wildlife Service (USFWS) to help fund the operations supported by the Multinational Species Conservation Funds; and (2) divided equally among the African Elephant Conservation Fund, the Asian Elephant Conservation Fund, the Great Ape Conservation Fund, the Marine Turtle Conservation Fund, and the Rhinoceros and Tiger Conservation Fund. Prohibits such proceeds from being taken into account in any decision relating to the level of appropriations or other federal funding to be furnished to the USFWS or such Funds. Requires the stamp to: (1) be made available to the public for at least five years; and (2) depict images of flagship multinational species.

Birth Parent Assistance Act of 2009 - Authorizes the Secretary of Health and Human Services to provide certain services for birth parents who have placed a child for adoption, either directly or by grant to or contract with state or local governmental entities or public or private agencies or organizations, including licensed child welfare or adoption agencies or adoptive family groups and faith-based organizations. Specifies such services for birth parents as: (1) post-legal adoption services; (2) individual, group, and family counseling; and (3) training of mental health professionals, social workers, and staff at hospitals and other appropriate birth care facilities relating to their interaction with birth parents and adoptive families.

Teri Zenner Social Worker Safety Act - Authorizes the Secretary of Health and Human Services, through the Substance Abuse and Mental Health Services Administration, to award grants to states to provide safety measures to social workers and other professionals working with violent, drug-using, or other at-risk populations. Authorizes such grants to be used to provide or support: (1) the procurement and installation of safety equipment, including communications systems to assist agencies in locating staff, and technical assistance and training for safety communications; (2) training exercises for self-defense and crisis management; (3) facility safety improvements; (4) provision of pepper spray for self-defense; (5) training in cultural competency and on strategies for de-escalating a situation that could turn volatile; (6) training to help workers who work with mentally ill communities and who need help coping; and (7) educational resources and materials to train staff on safety and awareness measures. Directs the Secretary to establish guidelines for assuring the cost-effectiveness and quality of the safety measures funded.

Adds Parkinson's disease (manifested to a degree of disability of 10% or more) to the list of diseases presumed to have been incurred in or aggravated by military service in Vietnam (and therefore compensable under veterans' disability compensation), notwithstanding that there is no evidence of the disease during the period of service, provided a veteran served between specified dates and was exposed to a herbicide used in military operations during that period.

Employee Free Choice Act of 2009 - Amends the National Labor Relations Act to require the National Labor Relations Board (NLRB) to certify a bargaining representative without directing an election if a majority of the bargaining unit employees have authorized designation of the representative (card-check) and there is no other individual or labor organization currently certified or recognized as the exclusive representative of any of the employees in the unit. Sets forth special procedural requirements for reaching an initial collective bargaining agreement following certification or recognition. Revises enforcement requirements with respect to unfair labor practices during union organizing drives, particularly a preliminary investigation of an alleged unfair labor practice (ULP) which may lead to proceedings for injunctive relief. Requires that priority be given to a preliminary investigation of any charge that, while employees were seeking representation by a labor organization, or during the period after a labor organization was recognized as a representative until the first collective bargaining contract is entered into, an employer: (1) discharged or otherwise discriminated against an employee to encourage or discourage membership in the labor organization; (2) threatened to discharge or to otherwise discriminate against an employee in order to interfere with, restrain, or coerce employees in the exercise of guaranteed self-organization or collective bardaining rights; or (3) engaged in any other related ULP that significantly interferes with, restrains, or coerces employees in the exercise of such guaranteed rights. Adds to remedies for such violations: (1) back pay plus liquidated damages; and (2) additional civil penalties.

Newborn, Child, and Mother Survival Act of 2009 - Amends the Foreign Assistance Act of 1961 to authorize the President to furnish assistance to improve the health of newborns, children, and mothers in developing countries. Directs the President to develop a comprehensive U.S. government strategy to reduce mortality and improve the health of newborns, children, and mothers in developing countries. Establishes the Interagency Task Force on Child Survival and Maternal Health in Developing Countries.

Generations Invigorating Volunteerism and Education Act or the GIVE Act - Amends the National and Community Service Act of 1990 (NCSA) and the Domestic Volunteer Service Act of 1973 (DVSA) to revise the programs under such Acts and reauthorize appropriations for such programs through FY2014. Revises under NCSA: (1) the School-Based and Community-Based Service-Learning programs and Higher Education Innovative Programs for Community Service (Learn and Serve programs); (2) National Service Trust programs (AmeriCorps); (3) the National Civilian Community Corps (NCCC); and (4) the Investment for Quality and Innovation program. Eliminates the current Community-Based Learn and Serve programs. Establishes two new Learn and Serve programs: (1) Campuses of Service, which provides funds to institutions of higher education to develop or disseminate exemplary service-learning programs that assist their students' pursuit of public service careers; and (2) Innovative Service-Learning Programs and Research, which funds community service-learning opportunities for elementary and secondary, college, and graduate students as well as research into service-learning. Includes among eligible AmeriCorps programs: (1) an Education Corps to address unmet educational needs; (2) a Healthy Futures Corps to address unmet health needs; (3) a Clean Energy Corps to address unmet environmental needs; and (4) a Veterans Corps to address the unmet needs of veterans and their families. Creates AmeriCorps Opportunity Corps programs that include certain existing programs and new programs to: (1) increase community access to technology; (2) engage citizens in public safety, health, and emergency preparedness services; (3) mentor youth; (4) reduce recidivism by re-engaging court-involved youth; and (5) support the needs of veterans or active duty service members and their families. Establishes an Education Awards Only program authorizing the Corporation for National and Community Service (Corporation) to provide fixed-amount grants to programs that have approved national service positions, but no AmeriCorps funding. Sets the National Service educational awards for full-time AmeriCorps, NCCC, and Volunteers in Service to America (VISTA) participants at a level equal to the maximum available Pell Grant available to students under the Higher Education Act of 1965. Includes among needs to be met under the NCCC program, disaster relief, infrastructure improvement, environmental and energy conservation, and urban and rural development. Requires states to develop comprehensive plans for volunteer and paid service by Baby Boomers and older adults. Directs the Corporation to plan pilot programs to: (1) better target and serve displaced workers; and (2) establish a centralized electronic citizenship verification system which would allow the Corporation to share employment eligibility information with the Department of Education. Authorizes the Corporation to treat September 11th annually as a National Day of Service and Remembrance. Establishes within the Investment for Quality and Innovation program: (1) a ServeAmerica Fellowships program providing fellowships to individuals chosen by states to participate in service projects addressing certain areas of national need; (2) a Silver Scholarship Grant Program providing scholarships to individuals age 55 or older who complete at least 500 hours of service in a year in an area of national need; and (3) an Encore Fellowships program providing one-year fellowships to individuals age 55 or older who serve in areas of national need and receive training to transition to public service employment. Makes ServeAmerica fellows eligible for national service educational awards. Authorizes the Corporation to provide grants to innovative and model service programs, including those for disadvantaged youth, youth under age 17, and potential recidivists. Eliminates federal funding for the Points of Light Foundation. Revises under DVSA: (1) the VISTA program; and (2) the Senior Corps, including the Retired and Senior Volunteer program (RSVP), the Foster Grandparent program, and the Senior Companion program. Gives priority in VISTA participant selection to disadvantaged youth and retired adults of any profession. Authorizes new VISTA grant programs of national significance that provide poor and rural communities with: (1) services reintegrating formerly incarcerated individuals into society; (2) financial literacy and planning; (3) before-school and after-school services; (4) community economic development initiatives; (5) assistance to veterans and their families; and (6) health and wellness services. Eliminates the VISTA Literacy Corps, University Year for VISTA, and Literacy Challenge Grant programs. Raises the minimum and maximum stipend provided to VISTA participants. Prioritizes RSVP projects in specified areas. Makes anyone 55 years of age or older eligible as Senior Corps volunteers. Provides, under the Senior Corps demonstration program, incentive matching grants to Senior Corps programs that exceed specified performance measures, enroll most of their volunteers in outcome-based service programs, and increase their enrollment of Baby Boomer volunteers. Expresses the sense of the Congress that the number of AmeriCorps, VISTA, and NCCC participants should reach 250,000 by 2014. Congressional Commission on Civic Service Act - Establishes a Congressional Commission on Civic Service to provide recommendations to Congress on improving opportunities for individuals to volunteer or perform national service.

Food Allergy and Anaphylaxis Management Act of 2009 - Requires the Secretary of Health and Human Services to develop and make available to local educational agencies, schools, early childhood education programs, and other interested entities voluntary guidelines to develop plans for individuals to manage the risk of food allergy and anaphylaxis in schools and early childhood education programs. Directs that such guidelines address: (1) parental obligation to provide the documentation of their child's allergies; (2) the creation of an individual food allergy management plan for each such child; (3) communication between schools or programs and emergency medical services; (4) reduction of exposure to anaphylactic causative agents; (5) food allergy management training; and (6) administration of epinephrine. Allows the Secretary to award matching grants to assist local educational agencies in implementing such food allergy and anaphylaxis management guidelines.

Josh Miller Helping Everyone Access Responsive Treatment in Schools Act of 2009 or the Josh Miller HEARTS Act - Amends the Elementary and Secondary Education Act of 1965 to direct the Secretary of Education to award matching grants to local educational agencies (LEAs) to: (1) purchase automated external defibrillators (AEDs) for use in their schools; and/or (2) provide training to meet the grant requirement that at least five adult employees or volunteers at each school where an AED is to be used successfully complete training in its use and in cardiopulmonary resuscitation (CPR). Requires LEA grant applicants also to demonstrate that: (1) the AEDs are integrated into the schools' emergency response procedures; and (2) emergency services personnel are notified of their locations. Gives grant priority to schools that: (1) lack an AED; (2) typically have a significant number of students, staff, and visitors present during the day; (3) generally have a longer wait for emergency medical services than other public facilities in the community; and (4) have not received funds under the Rural Access to Emergency Devices Act.

Increased Student Achievement Through Increased Student Support Act - Directs the Secretary of Education to award competitive, renewable, five-year grants to partnerships between low-income local educational agencies (LEAs) and schools offering graduate programs in school counseling, social work, or psychology to increase the number of program graduates employed by low-income LEAs. Defines "low-income LEAs" as those that: (1) serve students at least 20% of which are from low-income families; (2) have ratios of school counselors, social workers, and psychologists to students that fall at least 10% below specified target ratios; and (3) have been identified as needing improvement or corrective action or include at least one school identified as needing improvement, corrective action, or restructuring under the Elementary and Secondary Education Act of 1965. Allows the use of grant funds to: (1) provide program graduate students with field training at partnership LEA schools; (2) contribute to program graduates' salaries at such schools for up to three years after they graduate; (3) increase the number of school counselors, social workers, and psychologists per student, and from underrepresented backgrounds, in such schools; (4) enhance the capacity of partnership graduate schools to train such professionals; (5) develop course work designed to facilitate such graduates' service to low-income LEAs and at-risk students; and (6) provide tuition credits to such graduate students and student loan forgiveness to program graduates employed as school counselors, social workers, or psychologists by low-income LEAs for at least five consecutive years. Directs the Secretary to establish a program providing student loan forgiveness to non-participants in this Act's grant program who have been employed for at least five consecutive years as school counselors, social workers, or psychologists by low-income LEAs. Requires the Secretary to identify a formula for future use in designating regions as eligible for benefit programs because of having a shortage of such school personnel.

Child Nutrition Promotion and School Lunch Protection Act of 2009 - Amends the Child Nutrition Act of 1966 to require the Secretary of Agriculture to establish science-based nutrition standards for foods served in schools other than foods served under the school lunch or breakfast programs. Applies such standards to all food sold outside such programs anywhere on school campuses during the extended school day, with the possible limited exemption of food sold at school fundraisers. Requires the Secretary to: (1) consider the recommendations of authoritative scientific organizations and evidence concerning the relationship between diet and health when establishing the standards; and (2) review the standards as soon as practicable after the Department of Agriculture and the Department of Health and Human Services publish a new edition of the Dietary Guidelines for Americans.

Great Ape Protection Act of 2009 - Prohibits: (1) conducting invasive research on great apes; (2) knowingly breeding, possessing, renting, loaning, donating, purchasing, selling, housing, maintaining, leasing, borrowing, transporting, moving, delivering, or receiving a great ape for the purpose of conducting such research; or (3) using federal funds to conduct such research. Defines "invasive research" as research that may cause death, bodily injury, pain, distress, fear, injury, or trauma to great apes, including drug testing or exposure to a substance that may be detrimental to the ape's health or psychological well-being. Requires the Secretary of Health and Human Services (HHS) and other appropriate federal authorities to provide for the permanent retirement of all great apes that are owned or under the control of the federal government and that are being maintained in any facility for the purpose of breeding for, holding for, or conducting invasive research. Sets forth civil penalties for violations of this Act.

Contractor Accountability Act - Requires the head of each federal agency to report to Congress annually on each covered contract or order awarded or issued by the agency during the year. Requires the report to contain: (1) a certification that the agency has exercised oversight over each contract or order sufficient to ensure that each contractor is fulfilling the obligations specified; and (2) a list of the names of each contractor found to not be fulfilling its obligations. Requires each report to be publicly available on the agency's website. Requires the Comptroller General to report to Congress on agency compliance.

Emergency Retiree Health Benefits Protection Act of 2009 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to add a program for emergency retiree health benefit protections. Prohibits group health plans from reducing retiree health benefits after the retirement of a plan beneficiary. Requires such plans to adopt provisions barring post-retirement reductions in retiree health benefits. Requires group health plan sponsors to grant retired plan participants the option of benefit restoration. Authorizes the Secretary of Labor to waive or vary requirements for benefit restoration if compliance with such requirements would: (1) be adverse to the interests of plan participants in the aggregate; (2) not be administratively feasible; and (3) cause substantial business hardship to plan sponsors. Establishes the Emergency Retiree Health Loan Guarantee Program. Authorizes the Program to guarantee loans provided by private financial institutions to assist plan sponsors in meeting benefit restoration obligations under this Act. Terminates loan guarantee authority after 2015. Authorizes the Secretary to assess civil penalties for violations of this Act.

Pharmaceutical Market Access and Drug Safety Act of 2009 - Amends the Federal Food, Drug, and Cosmetic Act (FFDCA) to revise provisions governing the importation of prescription drugs. Waives the limitation on importation of prescription drugs that have been exported from the United States. Prohibits the importation of a qualifying drug unless such drug is imported by: (1) a registered importer; or (2) an individual for personal use. Establishes registration conditions for importers and exporters. Requires the Secretary of Health and Human Services to inspect places of business, verify chains of custody, inspect facilities, and determine compliance with registration conditions. Sets forth provisions governing the importation of qualifying drugs that are different from U.S. label drugs, including standards for judging such differences. Prohibits manufacturers from: (1) discriminating against registered exporters or importers; (2) causing there to be a difference in a prescription drug distributed in the United States and one distributed in a permitted country; (3) engaging in actions to restrict, prohibit, or delay the importation of a qualifying drug; or (4) engaging in any action that the Federal Trade Commission (FTC) determines discriminates against a person that engages or attempts to engage in the importation of a qualifying drug. States that the resale in the United States of prescription drugs that were properly sold abroad is not patent infringement. Requires the Secretary to educate consumers regarding prescription drug importation. Sets forth provisions governing the sale of prescription drugs through an Internet site. Includes the dispensing or selling of a prescription drug in violation of this Act as a prohibited act under FFDCA. Prohibits the introduction of restricted transactions with unregistered foreign pharmacies into a payment system or the completion of such transactions using a payment system.

Clean Water Protection Act - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to define "fill material" to mean any pollutant that replaces portions of waters of the United States with dry land or that changes the bottom elevation of a water body for any purpose and to exclude any pollutant discharged into the water primarily to dispose of waste.

Access for All America Act - Amends the Public Health Service Act to: (1) increase and extend the authorization of appropriations for community health centers and for the National Health Service Corps scholarship and loan repayment program for FY2010-FY2015, and provide for increased funding for such programs in FY2016 and each subsequent fiscal year; and (2) revise and expand provisions allowing a community health center to provide services at different locations, adjust its operating plan and budget, enter into arrangements with other centers to purchase supplies and services at reduced cost, and correct material failures in grant compliance.

Military Readiness Enhancement Act of 2009 - Repeals current Department of Defense (DOD) policy concerning homosexuality in the Armed Forces. Prohibits the Secretary of Defense, and the Secretary of Homeland Security with respect to the Coast Guard when it is not operating as a service in the Navy, from discriminating on the basis of sexual orientation against any member of the Armed Forces or any person seeking to become a member. Authorizes the re-accession into the Armed Forces of otherwise qualified individuals previously separated for homosexuality, bisexuality, or homosexual conduct. Requires such Secretaries to ensure that regulations governing the personal conduct of members of the Armed Forces are written and enforced without regard to sexual orientation.

Shirley Chisholm Congressional Gold Medal Act - Authorizes the posthumous award of a congressional gold medal in commemoration of Shirley Chisholm, in recognition of her activism, independence, and ground-breaking achievements in politics, her election as the first African-American woman in Congress, and her campaign to be the first African-American to gain the nomination of a major political party for President of the United States.

Family Smoking Prevention and Tobacco Control Act - Amends the Federal Food, Drug, and Cosmetic Act to provide for the regulation of tobacco products by the Secretary of Health and Human Services through the Food and Drug Administration (FDA), including through disclosure, annual registration, inspection, recordkeeping, and user fee requirements. Directs the Secretary to establish the Center for Tobacco Products to implement this Act. Sets forth criteria by which tobacco products are deemed adulterated or misbranded. Allows the Secretary to require prior approval of all label statements. Authorizes the Secretary to restrict the sale or distribution of tobacco products, including advertising and promotion, if appropriate for the protection of the public health. Sets forth limits on such regulations, including prohibiting establishment of a minimum age greater than 18 for product purchases. Prohibits: (1) cigarettes from containing any artificial or natural flavor (other than tobacco or menthol) or an herb or spice, including strawberry, cinnamon, or coffee; or (2) a tobacco product manufacturer from using tobacco that contains a greater level of pesticide chemical residue than is specified by any tolerance applicable to domestically grown tobacco. Requires the Secretary to establish tobacco product standards to protect the public health. Prohibits the Secretary from: (1) banning all cigarettes, all smokeless tobacco products, all little cigars, all other cigars, all pipe tobacco, or all roll-your-own tobacco products; or (2) requiring the reduction of the nicotine yields of a tobacco product to zero. Requires premarket approval of all new tobacco products. Sets forth standards for the sale of modified risk tobacco products. Requires the Secretary to establish a Tobacco Products Scientific Advisory Committee. Revises tobacco product warning labels and advertising requirements. Thrift Savings Plan Enhancement Act of 2009 - Amends provisions related to the Thrift Savings Plan (TSP), including to provide for: (1) automatic enrollment of new employees; and (2) a Roth contribution program.

Arthritis Prevention, Control, and Cure Act of 2009 - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services to develop and implement a National Arthritis Action Program that may include: (1) research, investigations, demonstrations, training, and studies relating to the control, prevention, and surveillance of arthritis and other rheumatic diseases; (2) additional grant support to encourage the expansion of research related to the prevention and management of arthritis at the Centers for Disease Control and Prevention (CDC); (3) national education and outreach activities for arthritis and other rheumatic diseases; (4) emphasis on prevention, early diagnosis, and appropriate management of arthritis and opportunities for effective patient self-management; and (5) grants to states or Indian tribes for comprehensive arthritis control and prevention programs and public health surveillance, prevention, and control activities related to arthritis and other rheumatic diseases. Authorizes the Secretary to expand and intensify programs of the National Institutes of Health (NIH) with respect to research and related activities concerning various forms of juvenile arthritis and related conditions. Authorizes the Secretary, acting through the Director of CDC, to: (1) provide for the collection, analysis, and reporting of data on juvenile arthritis; and (2) support the development of a national juvenile arthritis population-based database. Requires the Secretary to support activities that provide for: (1) an increase in institutional training grants to support pediatric rheumatology training; and (2) an expansion of public-private partnerships to promote education training and fellowship opportunities for pediatric rheumatologists. Directs the Secretary to establish and carry out a pediatric rheumatology loan repayment program, as needed.

Medal of Honor Commemorative Coin Act of 2009 - Directs the Secretary of the Treasury to mint and issue $5 gold coins and $1 silver coins emblematic of the design selected by the Secretary, after consultation with the Boards of the Congressional Medal of Honor Society and the Congressional Medal of Honor Foundation, in honor of the distinguished service of the American military men and women who have been Medal of Honor recipients. Limits the period for coin issuance to calendar year 2011. Imposes a surcharge of $35 per coin for the $5 coin and $10 per coin for the $1 coin, to be distributed to the Congressional Medal of Honor Foundation to help finance educational, scholarship, and outreach programs of the Foundation.

Federal Reserve Transparency Act of 2009 - Repeals the authority of the Comptroller General to carry out an onsite examination of an open insured bank or bank holding company only if the appropriate federal regulatory agency has consented in writing. (Retains the authority of the Comptroller General to audit a federal agency.) Directs the Comptroller General to complete, before the end of 2010, an audit of the Board of Governors of the Federal Reserve System and of the federal reserve banks, followed by a detailed report to Congress.

Encourages the President to: (1) reaffirm his commitment to pursue policies to protect the health and rights of women and girls; and (2) issue a proclamation calling upon the people of the United States to observe International Women's Day.

5-Star Generals Commemorative Coin Act - Requires the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half-dollar clad coins in recognition of five United States Army Five-Star Generals: George Marshall, Douglas MacArthur, Dwight Eisenhower, Henry "Hap" Arnold, and Omar Bradley, alumni of the United States Army Command and General Staff College, Fort Leavenworth, Kansas. Requires the design of the coins to include portraits of the generals. Restricts the issuance of such coins to calendar 2013. Requires specified surcharges in the sale of such coins, which shall be paid promptly to the Command and General Staff College Foundation to help finance its support of the College.
