Dream Act of 2017

Dream Act of 2017 This bill directs the Department of Homeland Security (DHS) to cancel removal and grant lawful permanent resident status on a conditional basis to an alien who is inadmissible or deportable or is in temporary protected status who: (1) has been continuously physically present in the United States for four years preceding this bill's enactment; (2) was younger than 18 years of age on the initial date of U.S. entry; (3) is not inadmissible on criminal, security, terrorism, or other grounds; (4) has not participated in persecution; (5) has not been convicted of specified federal or state offenses; and (6) has fulfilled specified educational requirements. DHS shall cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent residence on a conditional basis, an alien who was granted Deferred Action for Childhood Arrivals (DACA) status unless the alien has engaged in conduct that would make the alien ineligible for DACA. DHS may not: (1) grant conditional permanent resident status without the submission of biometric and background data, and completion of background and medical checks; and (2) disclose or use information provided in applications filed under this bill or in DACA requests for immigration enforcement purposes. The bill prescribes the conditions under which DHS: (1) may terminate a person's conditional permanent resident status, and (2) shall adjust a person's conditional status to permanent resident status. The bill: (1) sets forth documentation requirements for establishing DACA eligibility, and (2) repeals the denial of an unlawful alien's eligibility for higher education benefits based on state residence.

Stop Corporate Inversions Act of 201 7 This bill amends the Internal Revenue Code to revise rules for the taxation of inverted corporations (i.e., U.S. corporations that acquire foreign companies to reincorporate in a foreign jurisdiction with income tax rates lower than the United States). The bill provides that a foreign corporation that acquires the properties of a U.S. corporation or partnership after May 8, 2014, shall be treated as an inverted corporation and thus subject to U.S. taxation if, after such acquisition: (1) it holds more than 50% of the stock of the new entity (expanded affiliated group), or (2) the management or control of the new entity occurs primarily within the United States and the new entity has significant domestic business activities.

American Business for American Companies Act of 2017

American Business for American Companies Act of 2017 This bill prohibits an executive agency from awarding a contract for the procurement of property or services (including a defense contract) to: (1) any foreign incorporated entity determined to be an inverted domestic corporation or any subsidiary of such entity, or (2) any joint venture more than 10% of which is held by such an entity or subsidiary. Each agency must include in each such contract awarded with a value in excess of $10 million, other than a contract for exclusively commercial items, a clause that prohibits the prime contractor from: (1) awarding a first-tier subcontract with a value greater than 10% of the total prime contract to such an entity or joint venture, or (2) structuring subcontract tiers enabling such entity or joint venture to perform more than 10% of the total value of the prime contract. An agency may waive such requirements for a contract in the interest of national security. The bill provides for termination of a contract or suspension or debarment of a contractor in violation of this bill. A foreign incorporated entity must be treated as an inverted domestic corporation if: (1) the entity acquires, on or after May 8, 2014, substantially all of the properties held by a domestic corporation or substantially all of the assets of, or substantially all of the properties constituting a trade or business of, a domestic partnership; and (2) after the acquisition, either more than 50% of the stock of the entity is held by former shareholders of the domestic corporation or former partners of the domestic partnership, or the management and control of the expanded affiliated group which includes the entity occurs primarily within the United States and such expanded affiliated group has significant domestic business activities. The bill: (1) sets forth an exception for an entity within an expanded affiliated group with substantial business activities in the foreign country in which the entity is created, and (2) requires the Department of the Treasury to prescribe regulations for determining cases in which the management and control of an expanded affiliated group is to be treated as occurring primarily within the United States.

New Collar Jobs Act of 2017 This bill amends the Internal Revenue Code to establish an employee cybersecurity education tax credit, not to exceed $5,000 a year per employee, for an employer who incurs costs for an employee who earns a certificate or degree at the undergraduate or graduate level or an industry-recognized certification listed in the National Initiative for Cybersecurity Education's Cybersecurity Workforce Framework. The Federal Acquisition Regulation is amended to provide a business that utilizes the employee cybersecurity education tax credit and submits a bid for a competitive federal contract valued at more than $5 million a 5% increase in the business's bid score. The bill amends the Higher Education Act of 1965 to authorize the Department of Education to cancel eligible Federal Direct Loans for borrowers who have: (1) made 36 consecutive monthly payments, and (2) held a cybersecurity job in an economically distressed area during at least 12 months of payments. The program will cancel up to $25,000 in loans. The Cybersecurity Enhancement Act of 2014 is amended to include teaching cybersecurity as an acceptable employment option to satisfy post-award obligations for recipients of a CyberCorps Scholarship-for-Service award.

Promoting Transparency in Trade Act This bill amends the Bipartisan Congressional Trade Priorities and Accountability Act of 2015 to require the President to publish on a publicly available website the proposed U.S. text for a trade agreement regarding trade barriers before the start of a negotiating round and the considered text for such an agreement at the conclusion of each negotiating round. Congress may disapprove of trade authorities procedures (fast track) if the President has not published required negotiation texts for a proposed trade agreement. The bill amends the Trade Act of 1974 to direct the U.S. Trade Representative (USTR) to ensure that the Chief Transparency Officer of the Office of the USTR does not have, or appear to have, any conflict of interest in ensuring the transparency of the activities of the Office, including trade negotiations.

100 by '50 Act This bill calls for the United States to aggressively reduce carbon pollution as rapidly as practicable and achieve 100% clean and renewable energy by 2050. It provides financial support (e.g., grant programs and loans) for clean and renewable energy, including support for affordable zero-emission vehicle-based public transportation, solar energy, and energy efficiency retrofits in homes. The bill provides job training, unemployment compensation, health benefits, and pension and other benefits and services to adversely affected workers employed in the fossil fuel energy sector. The bill amends the Public Utility Regulatory Policies Act of 1978 to create annual caps on fossil fuel electricity beginning in 2022 and ending in 2050 when it is phased out. The Department of Energy (DOE) must establish a grant program for energy storage and dispatchable energy technologies. The bill provides financial incentives (e.g., tax credits and grants) for clean and renewable energy, energy efficiency improvements, and energy storage. The bill amends the Clean Air Act to establish a zero-emission vehicle standard. In addition, it establishes: (1) a carbon fee to transition the commercial aviation, maritime transportation, and rail sectors away from fossil fuel usage; (2) grant programs for zero-emission vehicles; (3) a national highway decarbonization grant program; and (4) tax credits for electric vehicles, hybrid trucks, biofuels, and alternative fuels. DOE must also establish a zero-emission residential and commercial heating grant program. The bill: (1) terminates specified fossil fuel subsidies, and (2) creates a climate duty for carbon-intensive products imported from other countries. The Department of the Treasury must issue climate bonds. The proceeds of the bonds must be deposited in the Climate Fund, which may be used to carry out the bill.

Code Like a Girl Act This bill directs the National Science Foundation (NSF) to award competitive grants to institutions of higher education, local educational agencies, or nonprofit organizations to accelerate research efforts to increase understanding of the factors that contribute to the willingness or unwillingness of girls under the age of 11 to participate in STEM (science, technology, engineering, and mathematics, including computer science) activities. The NSF shall also award competitive grants to such institutions and organizations to enter into partnerships with local educational agencies to develop and evaluate interventions in pre-K and elementary school classrooms that seek to increase participation by such girls in computer science activities. The NSF must: (1) ensure that the materials developed under a program that are demonstrated as being effective in achieving grant goals are made available free of charge to the public on an Internet website, (2) convene an annual meeting of participating partnerships to foster greater national collaboration, and (3) furnish such partnerships with technical assistance in meeting grant program requirements.

Pre-1972 recordings will fall within the existing compulsory license system for digital transmissions, which currently only cover post-1972 recordings. The bill preempts claims under state and common law for digital transmission of pre-1972 recordings.

LGBT Data Inclusion Act This bill requires federal agencies that collect information through a survey that includes demographic data (where subjects self-report information or a proxy provides information about the subject or responds for all persons in a household) to establish data standards that require: a determination of which existing data sets exclude information about sexual orientation and gender identity; an identification, and a use, of appropriate methods to include questions on sexual orientation and gender identity in surveys that facilitate categorization and voluntary participation and that preserve privacy and confidentiality; and a routine assessment of needed changes in survey methods related to asking such questions. Agencies that publish reports relying on survey demographic data must include information on sexual orientation and gender identity. Individuals shall not be: (1) required by this bill to disclose their sexual orientation or gender identity to an agency; or (2) subjected to fines or penalties for refusing to answer, or providing a false answer to, any survey question regarding gender identity or sexual orientation. Nothing in this bill shall be construed to permit the use of such collected information in a manner that would adversely affect an individual.

Water Advanced Technologies for Efficient Resource Use Act of 2017 This bill codifies the Environmental Protection Agency's (EPA) WaterSense program, which identifies, labels, and promotes water efficient products, buildings, landscapes, and services. This bill also establishes a program to provide financial incentives for consumers to purchase and install residential water efficient products and services labeled under the WaterSense program. In order to meet procurement requirements for a water consuming product or service, federal agencies must purchase a WaterSense product or service, or a Federal Energy Management Program designated product. Agencies do not have to procure those products or services if they are not cost-effective, or not reasonably available. The bill amends the Internal Revenue Code to exclude from the gross income of individual taxpayers any amount received under an incentive program for the purchase and installation of residential water efficient products and services.

Harry W. Colmery Veterans Educational Assistance Act of 2017 This bill revises education and related benefits provided to veterans, service members, dependents, and survivors. The bill amends the Post-9/11 veterans' educational assistance program to: remove certain time restrictions on program use; increase assistance for reservists, guardsmen, dependents, and surviving spouses and dependents; provide full eligibility for Post-9/11 Purple Heart recipients and certain reservists and guardsmen; provide an extra academic years' worth of benefits for STEM (science, technology, engineering, or mathematics) degree candidates; establish a five-year pilot program for high technology courses; restore eligibility for service members whose school closes in the middle of a semester; authorize funding to improve claims processing; permit assistance to be used at certain institutions that are not institutions of higher education; and pro-rate the housing stipend for reservists called to active duty. The bill authorizes the Edith Nurse Rogers STEM Scholarship to help veterans complete STEM degrees. The Yellow Ribbon program is extended to Fry Scholarship recipients (surviving dependents of service members who died on active duty) and certain Purple Heart recipients. (The Yellow Ribbon program helps veterans pay for higher education tuition and fee costs not covered by the Post-9/11 program.) The bill: (1) extends the Advisory Committee on Education, (2) increases survivors' and dependents' educational assistance, and (3) extends funding for state educational program approving agencies.

Do No Harm Act This bill makes the Religious Freedom Restoration Act of 1993 (RFRA) inapplicable to federal laws (or implementations of laws) that: protect against discrimination or the promotion of equal opportunity, including the Civil Rights Act of 1964, the Americans with Disabilities Act, the Family Medical Leave Act, Executive Order 11246 (concerning equal employment opportunity), the Violence Against Women Act, and the Department of Housing and Urban Development's (HUD's) rules entitled "Equal Access to Housing in HUD Programs Regardless of Sexual Orientation or Gender Identity"; require employers to provide wages, other compensation, or benefits, including leave; protect collective activity in the workplace; protect against child labor, abuse, or exploitation; or provide for access to, information about, referrals for, provision of, or coverage for, any health care item or service. Under current law, RFRA prohibits the government from substantially burdening a person's exercise of religion even if the burden results from a rule of general applicability, except in furtherance of a compelling governmental interest when using the least restrictive means. The bill makes RFRA inapplicable to: (1) terms requiring goods, services, functions, or activities to be performed or provided to beneficiaries of government contracts, grants, cooperative agreements, or awards; or (2) denials of a person's full and equal enjoyment of a government-provided good, service, benefit, facility, privilege, advantage, or accommodation. To assert a RFRA claim or defense in a judicial proceeding, the government must be a party to the proceeding.

America's Call To Improve Opportunities Now for National Service Act or the ACTION for National Service Act This bill amends the National and Community Service Act of 1990 and the Domestic Volunteer Service Act of 1973 to reestablish the Corporation for National and Community Service as an independent executive agency called the National and Community Service Administration. An individual who successfully completes a term of full-time national service shall be entitled to a national service educational award equal to twice the amount of tuition for the institution of higher education where the individual is enrolled, not to exceed twice the average in-state tuition. Current law limits the award's value to the maximum amount of a Federal Pell Grant that an individual is eligible to receive in the aggregate. Within the administration, the bill establishes an interagency working group to evaluate specified issues related to: (1) eligibility for tuition and student loan repayment assistance with regard to participation in certain national or volunteer service programs, (2) the advisability of granting federal hiring preference to certain volunteer program participants, and (3) methods for increasing the participation of seniors in national service programs. The National Service Foundation, a nonprofit corporation established by the bill, shall accept and administer gifts made in connection with the administration. The bill expresses support for the authorization of appropriations sufficient to provide, within 10 years, volunteer service opportunities for at least 1 million volunteers in full-time national service annually. The bill amends the Internal Revenue Code to exclude AmeriCorps educational awards from gross income.

Saving America's Pollinators Act of 2017 This bill requires the Environmental Protection Agency (EPA) to suspend the registration of members of the nitro group of neonicotinoid insecticides that are registered under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) for use in seed treatment, soil application, or foliar treatment on bee-attractive plants, trees, and cereals until the EPA determines that the insecticides will not cause unreasonable adverse effects on pollinators. The determination must be based on: an evaluation of the published and peer-reviewed scientific evidence on whether the use or uses of those neonicotinoids cause unreasonable adverse effects on pollinators, including native bees, honeybees, birds, bats, and other species of beneficial insects; and a completed field study that meets the criteria required by the EPA and evaluates residues, chronic low-dose exposure, and cumulative effects of multiple chemical exposures. The EPA may not issue new registrations of the neonicotinoid pesticides for any seed treatment, soil application, and foliar treatment on bee-attractive plants, trees, and cereals under FIFRA until it has made the determination with respect to the insecticide. For purposes of protecting and ensuring the long-term viability of native bees and other pollinators, the Department of the Interior must: (1) regularly monitor the health and population status of native bees, (2) identify the scope and likely causes of unusual native bee mortality, and (3) submit to Congress and make public an annual report on the health and population status of native bees.

Voter Empowerment Act of 2017 Voter Registration Modernization Act of 2017 This bill amends the National Voter Registration Act of 1993 to require states to make available online voter registration. The federal criminal code is amended to prohibit hindering, interfering with, or preventing voter registration. The Help America Vote Act of 2002 is amended to require states to promote access to voter registration and voting for individuals with disabilities. The Election Assistance Commission (EAC) must support pilot programs enabling individuals with disabilities to register and vote at their residences. The bill reauthorizes support for state and local governments to ensure voting access for individuals with disabilities. States must notify individuals convicted of a criminal offense under state law, upon release or upon sentence to probation, of their right to vote in federal elections. Voter Confidence and Increased Accessibility Act of 2017 This bill revises auditing requirements for voting systems. Voting systems must use individual, durable, voter-verified paper ballots. The National Science Foundation must support the study and development of accessible ballot voting and best practices to enhance the accessibility of voting for certain individuals. With exceptions, states must audit federal election results. The Servicemembers Civil Relief Act is amended to extend the guarantee of voting residency to family members of absent military personnel. The EAC must support poll-worker recruitment and training and develop materials for a model program. The Federal Election Campaign Act of 1971 is amended to prohibit a chief state election administration official, unless the official or a family member is a candidate, from taking part in political management or in a political campaign for federal office over which the official has supervisory authority. The EAC is reauthorized and its exemption from certain contracting requirements is repealed.

Voting Rights Advancement Act of 2017 This bill amends the Voting Rights Act of 1965 to allow a representative official of an Indian tribe, with authorization from the governing body of the tribe, to request one or more polling places to be located on tribal lands. The state or political subdivision shall provide each requested polling place at no expense to the Indian tribe if certain criteria are met. A federal court shall retain jurisdiction to enforce constitutional voting guarantees, but also certain violations of the Act as well as of any federal prohibition against discrimination on the basis of race, color, or membership in a language minority group, for an appropriate period to prevent commencement of new devices to deny or abridge the right to vote. Any state (and all of its political subdivisions) shall be subject to certain requirements for a 10-year period if: 15 or more voting rights violations occurred there during the previous 25 years; or 10 or more violations occurred during the previous 25 years, at least one of which was committed by the state itself (as opposed to a political subdivision within it). A state or political subdivision that obtains a declaratory judgment that it has not used a device to deny or abridge the right to vote shall be exempt from such requirements unlessas specified. This bill prescribes transparency requirements regarding any changes to specified matters. Department of Justice authority to assign observers receives new extensions. Courts shall grant preliminary injunctive relief if a complainant raises a serious question whether the challenged covered practice violates the Act or the Constitution and, on balance, the hardship imposed upon the defendant by the relief will be less than the hardship on the plaintiff if the relief were not granted.

Schedules That Work Act This bill grants an employee the right to request that the employee's employer change the terms and conditions of employment relating to: the number of hours or times the employee is required to work or be on call; the location; the amount of notification the employee receives of work schedule assignments; and minimizing fluctuations in the number of hours the employee is scheduled to work on a daily, weekly, or monthly basis. The employer, if the request is made, shall engage in a timely, good faith interactive process with the employee that includes a discussion of potential schedule changes that would meet the employee's needs. The bill outlines the process for either granting or denying a change. The employer shall grant a request, unless there is a bona fide business reason for denying it, if the request is made because of the employee's serious health condition, the employee's responsibilities as a caregiver, or enrollment in a career-related educational or training program, or if a part-time employee requests such a change for a reason related to a second job. An employer, if an employee requests a change for any other reason, may deny it for any reason that is not unlawful. The employer shall give the employee the reason for the denial, including whether it was a bona fide business reason. The bill outlines employer requirements for paying reporting time and split shift pay and for giving advance notice of work schedules to retail, food service, or cleaning employees, or the Department of Labor's designated employees, except for those in bona fide executive, administrative, or professional capacities. The bill makes it unlawful for any employer or other person to: (1) interfere with, restrain, or deny the exercise or the attempt to exercise any right of an employee specified in this bill; (2) retaliate against an employee for exercising the rights granted employees by this bill; or (3) interfere with proceedings or inquiries with respect to violation of an individual's rights under this bill. The bill sets forth administrative enforcement procedures and civil remedies for violation of these prohibitions. Labor must give information and technical assistance to employers, labor organizations, and the general public concerning compliance with this bill. The Bureau of Labor Statistics and the Bureau of the Census shall: (1) include in the Current Population Survey questions on, among other things, the amount of fluctuation in the number of hours the employee is scheduled to work on a daily, weekly, or monthly basis; and (2) conduct at regular intervals the Contingent Worker Supplement, the Work Schedules and Work at Home Supplement, and other relevant supplements to the Current Population Survey. This bill is inapplicable to any employee covered by a bona fide collective bargaining agreement if its terms govern work scheduling practices.

Foreign Investment and Economic Security Act of 2017 This bill amends the Defense Production Act of 1950 to provide for: (1) national security reviews of transactions involving the construction of a new facility in the United States by any foreign person (currently, national security reviews are conducted only for certain mergers, acquisitions, or takeovers by or with a foreign person); and (2) net U.S. benefit reviews of new construction, mergers, acquisitions, or takeovers by or with a foreign person. The bill makes net benefit reviews mandatory for transactions that meet specified Clayton Act requirements. The Committee on Foreign Investment in the United States (CFIUS) shall consider a transaction's effect on: (1) employment, resource processing, utilization of parts and services produced in or imported into the United States, and exports; (2) industrial efficiency, technological development, technology transfers, and product innovation; (3) domestic or foreign competition; (4) compatibility with national industrial and economic policies; and (5) public health, safety, and the environment. In the case of a net benefit determination concerning a foreign government-influenced transaction, the CFIUS must consider: the governance and commercial orientation of the foreign person engaging in such transaction; the extent to which the foreign person is owned, controlled, or influenced by the foreign government; and adherence to U.S. law and corporate governance standards, engagement of the foreign country with the Securities and Exchange Commission and the Public Company Accounting Oversight Board, and the likelihood of commercial operation. The bill prohibits transactions that the President determines are not of net U.S. benefit and bars judicial review of such determinations. The bill also revises the composition of the CFIUS for the purpose of carrying out net benefit determinations. The term "foreign government-controlled transaction" is revised to include a person with access to below-market loans or other financing from a foreign government.

Mental Health in Schools Act of 2017 This bill amends the Public Health Service Act to revise a community children and violence program to assist local communities and schools in applying a public health approach to mental health services, including by: (1) revising eligibility requirements for a grant, contract, or cooperative agreement; and (2) providing for comprehensive school mental health programs that are culturally and linguistically appropriate, trauma-informed, and age appropriate. A comprehensive school mental health program funded under this bill must assist children in dealing with trauma and violence. The bill makes only certain partnerships that include a state educational agency and one or more educational agencies, with a local agency serving as lead partner, eligible for funding. They include public or private entities that use evidence-based intervention. The Substance Abuse and Mental Health Services Administration shall develop a fiscally appropriate process for evaluating grant program activities, including the development of: (1) guidelines for the submission of program data by recipients; and (2) outcome measures to be applied by recipients in evaluating programs, including student and family measures and local educational measures.

IDEA Full Funding Act This bill amends the Individuals with Disabilities Education Act to reauthorize and make appropriations for the grant program to assist states and outlying areas in providing special education and related services to children with disabilities. The bill sets the amount to be appropriated for each fiscal year from FY2018-FY2026 as the greater of: (1) a specified amount, or (2) a specified percentage of an amount determined pursuant to a formula that multiplies the number of children receiving special education services by the average per-pupil expenditure in public elementary and secondary schools. The bill appropriates funds for FY2027 and each subsequent fiscal year equal to the greater of a specified amount or 40% of the amount determined using such formula. Amounts appropriated shall be expended consistent with pay-as-you-go requirements.
