Amendment· HAMDTHAMDT 123 (102nd)passed

Amendment originally sought to delete sec. 1205 which authorizes funds for the United Nations Population Fund; and sec. 1206 which authorizes the use of funds for nongovernmental organization family planning assistance activities; and would have inserted language which denies funds to any organization or program which, as determined by the President, supports or participates in the management of a program of coercive abortion or involuntary sterilization. It would have prohibited funds to any foreign nongovernmental organization that performs or actively promotes abortion as a method of family planning. \ As amended by the Kostmayer amendment (A003), the funding for the U.N. Population Fund was restored with certain restrictions including a limitation on assistance to the People's Republic of China. \ As amended by the Berman amendment (A004), language was added which specifies that U.S. government funds provided to nongovernmental organizations for family planning activities may not be used to perform or promote abortion as a method of family planning.

Amendment· HAMDTHAMDT 405 (103rd)failed

An amendment in the nature of a substitute to specify that actions prohibited under the measure must occur near the clinic, or near the home of the individual affected to constitute "crime". The substitute specifies that people lawfully engaging in activities protected by the First Amendment are exempt from the penalties of the bill, and exempts parents or legal guardians when their activities are directed at their minor child from such penalties. Under the substitute, physical obstruction would be a crime only if it is accompanied by force or threats of force. The substitute provides that people harmed could not sue for punitive damages as under the bill, but only for actual damages. The amendment sets standards that must be met before a court can issue an injunction. Finally, the amendment does not allow state attorneys general to bring suits under the measure, only the affected party or the Justice Department.
