Nancy Gardner Sewell Medicare Multi-Cancer Early Detection Screening Coverage Act This bill allows for Medicare coverage and payment for multi-cancer early detection screening tests that are approved by the Food and Drug Administration and that are used to screen for cancer across many cancer types, if the Centers for Medicare & Medicaid Services determines such coverage is appropriate.

This joint resolution nullifies the final rule issued by the National Marine Fisheries Service titled Endangered and Threatened Wildlife and Plants; Regulations for Listing Endangered and Threatened Species and Designating Critical Habitat and published on June 24, 2022. The 2022 rule rescinds an earlier rule which limited the ability of the service to designate an area a critical habitat . Areas designated as critical habitat are subject to certain statutory restrictions.

This joint resolution nullifies the final rule issued by the U.S. Fish and Wildlife Service titled Endangered and Threatened Wildlife and Plants; Endangered Species Status for Northern Long-Eared Bat and published on November 30, 2022. This rule reclassifies the northern long-eared bat ( Myotis septentrionalis ) from a threatened species to an endangered species under the Endangered Species Act. The rule also removes the northern long-eared bat's species-specific rule, which applied only when the bat was listed as a threatened species.

Farm Credit Administration Independent Authority Act This bill specifies that the Farm Credit Administration (FCA) is the sole regulator of the Farm Credit System (FCS) and establishes reporting requirements for FCS institutions. Specifically, the bill states that the FCA is the sole and independent regulator of the FCS and exempts entities that are supervised by the FCA from the Equal Credit Opportunity Act (ECOA). (The bill addresses a proposed rule by the Consumer Financial Protection Bureau [CFPB] that would implement provisions of the ECOA by requiring covered financial institutions, including FCS lenders, to collect and report to the CFPB data on credit applications for small businesses, including the principal owner's race, sex, and ethnicity.) The bill also requires FCS institutions to (1) request that loan applicants and borrowers that are small farmers disclose information identifying their race, sex, and ethnicity; and (2) annually report the collected information to the FCA. If an FCS institution customer does not voluntarily report the requested information, the FCA may not require the institution to use other means to deduce the information.

Truck Parking Safety Improvement Act This bill directs the Department of Transportation (DOT) to provide competitive grants for projects that provide public parking for commercial motor vehicles and improve the safety of commercial motor vehicle drivers. States, metropolitan planning organizations, tribal governments, and local governments are eligible for these grants. The grants must be used for projects on federal-aid highways or a facility with reasonable access to such a highway or a freight facility. In providing grants, DOT must determine that there is a shortage of commercial motor vehicle parking capacity in the corridor in which the project is located; the eligible entity has consulted with motor carriers, commercial motor vehicle drivers, public safety officials, and private providers of commercial motor vehicle parking regarding the project; the project will likely increase the availability or utilization of commercial motor vehicle parking, facilitate the efficient movement of freight or improve highway safety, traffic congestion, and air quality; and the eligible entity has demonstrated the ability to provide for the maintenance and operation of the facility. To the maximum extent practicable, DOT must select grant projects that maximize the geographic dispersion of new commercial motor vehicle parking capacity across the United States.

Aviation Workforce Development Act This bill expands the qualified tuition program (commonly referred to as 529 plans) to allow distributions to pay education-related expenses required for participation in certain aviation maintenance and commercial pilot courses.

Historic Tax Credit Growth and Opportunity Act of 2023 This bill increases the rehabilitation tax credit and modifies certain requirements for the credit. The bill increases the rate of the credit for qualified rehabilitation expenditures in taxable years beginning after December 31, 2020, and before January 1, 2028, after which the rate reverts to 20%. The bill increases the rate of the credit to 30% for certain small projects whose qualified rehabilitation expenditures do not exceed $2.5 million. The bill also expands the types of buildings eligible for rehabilitation by decreasing the rehabilitation threshold from 100% to 50% of project expenses. It also eliminates the basis adjustment requirement for the credit and modifies rules relating to tax-exempt use property eligible for the credit.

Carnivals are Real Entertainment Act This bill makes certain workers with a traveling carnival or circus eligible for P visas (nonimmigrant visas for athletes, artists, and entertainers). Such visas shall be available for workers who perform functions that are integral and essential to the carnival or circus, such as transporting and assembling relevant structures and equipment. Such visas shall only be available for a position if (1) there are not sufficient U.S. workers available, and (2) employing a non-U.S. national ( alien under federal law) will not affect the wages and working conditions of similarly employed U.S. workers.

Equitable Community Access to Pharmacist Services Act This bill expands Medicare coverage to permanently include services provided by a pharmacist, including incidental services and supplies, related to testing, vaccines, and treatment for COVID-19, influenza, and certain other illnesses. Specifically, the bill provides for continued coverage of pharmacist services relating to evaluation and management of patients for testing and treatment for COVID-19, influenza, respiratory syncytial virus (RSV), or streptococcal pharyngitis (strep throat), as well as vaccines for pneumococcal disease, COVID-19, influenza, or hepatitis B. It also generally provides for coverage of pharmacist services during a public health emergency.

This bill establishes bonding requirements for the recipient of a water infrastructure construction loan under the Water Infrastructure Finance and Innovation Act. A borrower must secure the financed project with payment and performance bonds in minimum amounts set out in the bill.

Let Experienced Pilots Fly Act of 2023 This bill raises the mandatory retirement age for pilots engaged in commercial aviation operations from 65 to 67 years of age, unless the operation takes place in (1) the territorial airspace of a foreign county where such operations are prohibited by the foreign country, or (2) international airspace where such operations are not in compliance with the Annexes to the Convention on International Civil Aviation. The Federal Aviation Administration must also submit a report to Congress on further increasing the age limitation for pilots engaged in commercial aviation operations.

Transparency in College Foreign Payments Act This bill revises certain disclosure requirements for institutions of higher education (IHEs). Specifically, the bill requires an IHE to disclose to the Department of Education (ED) any gift from or contract with a foreign source, regardless of the amount of the gift or contract. Under current law, an IHE must disclose to ED a gift or contract from a foreign source that is valued at $250,000 or more, considered alone or in combination with all other gifts from or contracts with that foreign source within a calendar year. An IHE must also report the identity of each foreign source and the name of each foreign government. Further, an IHE must report additional information when it receives a restricted or conditional gift or contract from a foreign source. Such additional information includes (1) the identity of the foreign source; (2) the identity of the specific department, college, project, or other division of the IHE that is the recipient of the gift or contract, if applicable; and (3) the intended purpose of the gift or contract.

Honoring Our Fallen Heroes Act of 2023 This bill extends death and disability benefits under the Public Safety Officers' Benefits Program (PSOB) to certain public safety officers who suffer from exposure-related cancer while on duty and their survivors. The PSOB program provides death, disability, and education benefits to public safety officers who are killed or injured in the line of duty and their survivors. The bill specifies that exposure-related cancer shall be presumed to constitute a personal injury in the line of duty if the public safety officer was exposed to or in contact with heat, radiation, or a carcinogen that is linked to an exposure-related cancer; the officer began serving as an officer not later than 5 years before the date of the diagnosis of an exposure-related cancer and the diagnosis occurred not later than 15 years after the last date of active service; and the exposure-related cancer directly and proximately resulted in the death or permanent and total disability of the officer. The Department of Justice's Bureau of Justice Assistance (BJA) must periodically review the definition of exposure-related cance r. It directs the BJA to add additional cancers to the definition under certain circumstances (e.g., a petition process).

Strengthening Enforcement and Criminalizing Unlawful Records Enabling Flights Act or the SECURE Flights Act This bill prohibits the use of certain warrants and other documents issued by U.S. Immigration and Customs Enforcement (ICE), the Department of Homeland Security (DHS), and U.S. Customs and Border Protection (CBP) as proof of identification at airport security checkpoints. If an individual uses a prohibited document as proof of identification, the Transportation Security Administration (TSA) must inform ICE, CBP, and local law enforcement to determine whether the individual is in violation of any term of release from custody of the agency. An individual who is in violation may not be permitted to enter a sterile area (e.g., the boarding area) unless the individual (1) is being removed or deported from the United States, or (2) presents a covered valid and unexpired identification document. Examples of covered identification documents include a U.S. passport, a biometrically secure card issued by a DHS trusted or registered traveler program, a state-issued enhanced driver's license, and an employment authorization document issued by U.S. Citizenship and Immigration Services. Further, prior to authorizing entry into a sterile area, the TSA must collect biometric information from an individual who (1) does not present a covered identification document, and (2) the TSA cannot verify is a U.S. national. The TSA must submit the information to the national Automated Biometric Identification System (IDENT).

Protecting Access to Ground Ambulance Medical Services Act of 2023 This bill extends the specialized rate increase for Medicare payment of ground ambulance services in rural areas for an additional three years (until January 1, 2028).

Lake Winnibigoshish Land Exchange Act of 2023 This bill directs the Forest Service to exchange specified land in the Chippewa National Forest in Minnesota for specified land owned by Big Winnie Land and Timber, LLC, (BWLT), if BWLT offers to make the exchange. The exchange shall be for equal value or the values shall be equalized by a cash payment, subject to an exception. The land acquired by the Forest Service shall be added to and managed as part of Chippewa National Forest.

This joint resolution nullifies the rule issued by the Bureau of Alcohol, Tobacco, Firearms and Explosives titled Factoring Criteria for Firearms With Attached "Stabilizing Braces" and published on January 31, 2023. The rule establishes criteria for determining whether a firearm equipped with an attached stabilizing brace that facilitates shoulder fire is a rifle subject to regulation (e.g., registration) under the National Firearms Act.

Save Our Gas Stoves Act This bill places limits on energy conservation standards for kitchen ranges or ovens under the Energy Policy and Conservation Act. The Department of the Energy (DOE) may not prescribe or amend energy conservation standards for kitchen ranges or ovens if they would result in the unavailability of a product on account of the type of fuel the range or oven uses. In addition, DOE may not finalize, implement, or enforce the proposed rule titled Energy Conservation Program: Energy Conservation Standards for Consumer Conventional Cooking Products issued on February 1, 2023, or any substantially similar rule. The proposed rule prescribes energy conservation standards for consumer conventional cooking tops, including electric cooking tops, gas cooking tops, electrical ovens, and gas ovens.

Law Enforcement Officer and Firefighter Recreation Pass Act This bill directs the Department of Agriculture and the Department of the Interior to make the National Parks and Federal Recreational Lands Pass available, at no cost, to a law enforcement officer or firefighter who provides adequate proof of eligibility.

This bill excludes certain propane storage facilities from requirements under chemical facility anti-terrorism standards. Specifically, such exclusion applies to a facility that stores propane for sale to or use by a dwelling, sale to or use in agricultural production, or sale to or use by small business concerns that are located in rural areas. If the Department of Homeland Security determines that a propane storage facility does not satisfy the requirements of an excluded facility, it must report to Congress and notify the owner or operator of the facility.

Chiropractic Medicare Coverage Modernization Act of 2023 This bill expands Medicare coverage of chiropractic services to include all services provided by chiropractors, rather than only subluxation corrections through manual manipulation of the spine.

Forest Protection and Wildland Firefighter Safety Act of 2023 This bill authorizes the Department of the Interior and the Department of Agriculture to discharge a fire retardant, a chemical, or water for fire suppression, control, or prevention activities. No National Pollutant Discharge Elimination System permit shall be required for such activities or for similar activities conducted by the Forest Service, the National Park Service, the Bureau of Land Management, the U.S. Fish and Wildlife Service, the Bureau of Indian Affairs, the Federal Emergency Management Agency (FEMA), a state or political subdivision thereof, or a tribal government.

Hello Girls Congressional Gold Medal Act of 2023 This bill provides for the award of a single Congressional Gold Medal in honor of the female telephone operators of the Army Signal Corps, commonly known as the Hello Girls , in recognition of their military service, devotion to duty, and 60-year struggle for veterans' benefits and recognition as soldiers.

This joint resolution nullifies the Comprehensive Policing and Justice Reform Amendment Act of 2022, enacted by the Council of the District of Columbia. The act sets forth a variety of measures that focus on policing, including measures prohibiting the use of certain neck restraints by law enforcement officers, requiring additional procedures related to body-worn cameras, and expanding access to police disciplinary records.

Pipeline Sabotage and Accident Prevention Act This bill establishes criminal penalties for causing a defect in or disrupting the operation of pipeline infrastructure. Specifically, the bill prohibits a person from knowingly and willfully causing or threatening to cause a defect in a pipe, pump, or valve intended to be used in any pipeline facility that would affect the integrity or safe operation of the facility; or disrupting the operation of a pipeline facility. Violators are subject to a fine, a prison term of up to 10 years, or both.

Foster Youth and Driving Act This bill expands state foster care and adoption assistance programs to provide driving preparation assistance to foster youth and related training for foster parents. The bill further directs assistance to states and tribal organizations for age-appropriate foster youth to, among other things, obtain automobile insurance, complete driver's education, obtain a driver's license, and purchase a vehicle.

Preserving Choice in Vehicle Purchases Act This bill modifies the waiver process under the Clean Air Act related to state emission control standards for new motor vehicles (or new motor vehicle engines). Under current law, states are preempted from adopting or enforcing emission control standards for new motor vehicles (or new motor vehicle engines) unless the Environmental Protection Agency (EPA) provides a waiver authorizing a state to adopt such standards if certain requirements are met. The bill provides that state standards that directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines are not eligible for waivers. The bill also prohibits the EPA from determining that any state standards amended after the bill's enactment are within the scope of an existing waiver. Additionally, the bill requires the EPA to revoke waivers granted between January 1, 2022, and the date of enactment of this bill if the standards directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines.

Treating Tribes and Counties as Good Neighbors Act This bill revises the Good Neighbor Authority program to modify the treatment of revenue from timber sale contracts under good neighbor agreements with the Department of Agriculture (USDA) and the Department of the Interior. (The Good Neighbor Authority permits USDA and Interior to enter into cooperative agreements or contracts with states, counties, and Indian tribes to perform forest, rangeland, and watershed restoration services on federal land managed by the Forest Service or the Bureau of Land Management.) Specifically, the bill (1) requires Indian tribes and counties to retain revenue generated from timber sales under a good neighbor agreement; and (2) allows states, counties, and Indian tribes to use such revenue for authorized restoration projects on nonfederal lands under a good neighbor agreement. (Under current law, only a state is permitted to retain the revenues, and the revenues must be used for restoration projects on federal land.)

Violet's Law This bill requires federal research facilities to facilitate the adoption or nonlaboratory placement of dogs, cats, nonhuman primates, guinea pigs, hamsters, and rabbits with animal rescue organizations, animal sanctuaries, animal shelters, or individuals. In order to be adopted or placed, the animals must no longer be needed for research and be suitable for release. To be suitable for release, the animal must be free of any infectious disease or physical abnormality that would endanger the animal, other animals, or public health.

Comprehensive Grizzly Bear Management Act of 2023 This bill directs the Department of the Interior to issue a final rule relating to removing the Northern Continental Divide Ecosystem population of grizzly bears from the federal list of endangered and threatened wildlife, without regard to any other provision of law that applies to issuance of such rule. Such issuance shall not be subject to judicial review.

No WHO Pandemic Preparedness Treaty Without Senate Approval Act This bill establishes that any convention or agreement on pandemic-related issues reached by the World Health Assembly (WHA) pursuant to a specified negotiating body shall be deemed to be a treaty requiring the advice and consent of the Senate. Specifically, this bill applies to any international instrument negotiated by the intergovernmental negotiating body established by the WHA in December 2021 to strengthen pandemic prevention, preparedness, and response.

Transparency, Accountability, Permitting, and Production of American Resources Act or the TAPP American Resources Act This bill provides for the exploration and development of energy resources (e.g., oil, gas, and minerals), including by (1) requiring additional federal oil and gas leasing, (2) expediting energy projects, (3) eliminating or reducing certain fees related to the development of federal energy resources, and (4) requiring certain revenue from energy development to be shared with states. The Department of the Interior must conduct sales for the leasing of oil and gas resources on federal lands and waters as specified by the bill. For example, Interior must immediately resume quarterly sales of leases of onshore federal land for oil and gas development, conduct a minimum of four oil and gas lease sales in each state with land available for oil and gas leasing under mineral leasing law, issue a five-year oil and gas leasing program under the Outer Continental Shelf Lands Act for 2023-2028, and approve each subsequent five-year oil and gas offshore leasing program no later than 180 days before the expiration of the previous program. Additionally, the bill expedites the development of energy resources, including by (1) limiting the scope of review of major federal actions under the National Environmental Policy Act of 1969; and (2) expediting the environmental review of mineral exploration and production activities, such as coal mining. The bill also reduces royalties for oil and gas development on federal land. Finally, the bill increases the amount of revenue from energy development that is shared with coastal states.

Major Richard Star Act This bill provides that combat-disabled uniformed services retirees with fewer than 20 years of creditable service may concurrently receive, without reduction, veterans' disability compensation and retired pay or combat-related special compensation.

This bill specifies that funds provided under the Farm Storage Facility Loan Program may be used to construct or upgrade storage facilities for propane that is primarily used for agricultural production. This Department of Agriculture loan program provides low-interest financing for agricultural producers to build or upgrade commodity storage facilities. Some agricultural producers use propane to power agricultural operations (e.g., grain dryers, irrigation engines, and barn heating).

LEO Fair Retirement Act of 2023 This bill makes a series of changes to certain retirement and premium pay calculations for federal law enforcement officers (LEOs). Specifically, the bill provides that for purposes of computing the annuity of an LEO under the Civil Service Retirement System and the Federal Employees Retirement System, any premium pay earned by such LEO in excess of limitations imposed on such pay shall be included in the LEO's average pay, contingent on the payment of a specified lump sum by the LEO to the Office of Personnel Management. The bill allows for a nonrefundable tax credit with respect to such lump-sum payments. The bill also makes postal inspectors, federal air marshals, and other specified personnel eligible for availability pay (i.e., premium pay paid to LEOs who are criminal investigators).

Law Enforcement Officers Equity Act This bill expands the definition of law enforcement officer under provisions of the Federal Employees Retirement System (FERS) and the Civil Service Retirement System (CSRS). Specifically, the bill expands the definition to include (1) federal employees whose duties encompass the investigation or apprehension of suspected or convicted criminals and who are authorized to carry a firearm; (2) Internal Revenue Service employees whose duties are primarily the collection of delinquent taxes and the securing of delinquent returns; (3) U.S. Postal Inspection Service employees; (4) Department of Veterans Affairs police officers; and (5) certain U.S. Customs and Border Protection employees who are seized-property specialists with duties relating to custody, management, and disposition of seized and forfeited property. The bill deems service performed by an incumbent law enforcement officer on or after the enactment date of this bill to be service performed as a law enforcement officer for retirement purposes. The past service of such incumbents shall be treated as service performed by a law enforcement officer for retirement purposes only if a written election is submitted to the Office of Personnel Management within five years after the enactment of this bill or before separation from government service, whichever is earlier. An incumbent who makes an election before the enactment of this bill may pay a deposit into the Civil Service Retirement and Disability Fund to cover prior service. A law enforcement officer shall not be subject to mandatory separation during the three-year period beginning on the enactment of this bill.

Parents Bill of Rights Act This bill establishes various rights of parents and guardians regarding the elementary or secondary school education of their children. Local educational agencies (LEAs) and schools must comply with the requirements of the bill in order to receive federal education funds. Specifically, the bill requires schools to notify parents and guardians of their rights regarding the education of their children. These rights include the right to review the curriculum of their child's school; know if the state alters its challenging academic standards; meet with each teacher of their child at least twice each school year; review the budget, including all revenues and expenditures, of their child's school; review a list of the books and other reading materials in the library of their child's school; address the school board of the LEA; receive information about violent activity in their child's school; and receive information about any plans to eliminate gifted and talented programs in the child's school. Additionally, the bill directs each LEA to post on a publicly accessible website (or otherwise widely disseminate to the public) the curriculum for each elementary and secondary school grade level. The LEA must also include in its annual report card the overall budget of the LEA and the budget for each elementary and secondary school. The bill also provides for additional family educational and privacy rights, including by prohibiting schools from selling student information for commercial or financial gain.

Protecting American Energy Production Act This bill prohibits the President from declaring a moratorium on the use of hydraulic fracturing unless Congress authorizes the moratorium. The bill also expresses the sense of Congress that states should maintain primacy for the regulation of hydraulic fracturing for oil and natural gas production on state and private lands. Hydraulic fracturing, or fracking, is a process to extract underground resources such as oil or gas from a geologic formation by injecting water, a propping agent (e.g., sand), and chemical additives into a well under enough pressure to fracture the formation.

Whole Milk for Healthy Kids Act of 2023 This bill revises requirements for milk provided by the National School Lunch Program of the Department of Agriculture (USDA). Currently, schools participating in the program must provide milk that is consistent with the most recent Dietary Guidelines for Americans; USDA regulations require milk to be fat-free or low-fat and allow milk to be flavored or unflavored. The bill modifies these restrictions and instead permits schools to offer students whole, reduced-fat, low-fat, and fat-free flavored and unflavored milk. In addition, schools currently participating in the program must provide meals that meet certain nutrition requirements; USDA regulations require that the average saturated fat content of the meals offered must be less than 10% of the total calories. Under the bill, USDA must revise these requirements to increase the allowable average saturated fat content of a meal to account for milk fat included in whole milk.

Governing Unaccredited Representatives Defrauding VA Benefits Act or the GUARD VA Benefits Act This bill imposes fines on individuals for soliciting, contracting for, charging, or receiving any unauthorized fee or compensation with respect to the preparation, presentation, or prosecution of any claim for Department of Veterans Affairs benefits. The attempted commission of such offenses is also punishable by fine.

Natural Gas Tax Repeal Act This bill eliminates a program administered by the Environmental Protection Agency (EPA) that provides incentives for petroleum and natural gas systems to reduce their emissions of methane and other greenhouse gases. It also repeals a charge on methane emissions from specific types of facilities that are required to report their greenhouse gas emissions to the EPA's Greenhouse Gas Emissions Reporting Program.

Stop Taxpayer Funding of Traffickers Act This bill prohibits an individual who is indicted for or charged with a covered trafficking offense from receiving federal benefits. Covered trafficking offense refers to a human trafficking offense or a drug trafficking offense occurring at an international border, or within the territorial waters, of the United States. Federal benefit refers to (1) the issuance of any grant, contract, loan, professional license, or commercial license provided by a U.S. agency or by appropriated U.S. funds; and (2) any retirement, welfare, Social Security, health, disability, veterans, public housing, or other similar benefit. The bill requires the federal government to provide retroactive benefits payments for an individual who has the charge dismissed or is found not guilty of the covered trafficking offense.
