Military Spouses Achieving College Education for Survivors Act of 2015 or ACES Act of 2015 This bill amends the Veterans Access, Choice, and Accountability Act of 2014 to deem any member of the Armed Forces who died between September 11, 2001, and December 31, 2005, to have died on January 1, 2006, in order to make that member's surviving spouse eligible for the Marine Gunnery Sergeant John David Fry scholarship. (Surviving spouses of service members who die in the line of duty after September 11, 2001, are eligible for such assistance until the earlier of the date they remarry or the date that is 15 years after the military spouse's death.) A surviving spouse of a member of the Armed Forces who died between September 11, 2001, and December 31, 2005, who elected before enactment of this Act to receive educational benefits under the Survivors and Dependents Educational Assistance program or the Marine Gunnery Sergeant John David Frye program may revoke such choice. (Such an election is currently irrevocable.)

Friendly Airports for Mothers Act of 2015 This bill authorizes the Secretary of Transportation to approve a grant application for an airport development project only if the Secretary receives written assurances that the owner or operator of a large or medium hub airport will maintain a lactation area at each passenger terminal building of the airport behind the airport security screening area. The bill defines "lactation area" to mean a room or other location in a commercial service airport for members of the public to express breast milk that: is shielded from view and free from intrusion from the public; has a door that can be locked; includes a place to sit, a table or other flat surface, and an electrical outlet; is readily accessible to and usable by individuals with disabilities; and is not located in a restroom. The Secretary may approve a terminal development project for the construction or installation of a lactation area at a commercial service airport.

This bill directs the Department of Veterans Affairs (VA) to enter into an agreement or a contract with each state home to pay for adult day health care for a veteran eligible for, but not receiving, nursing home care. The veteran must need such care either specifically for a service-connected disability, or, if not specifically for one, the veteran must have a service-connected disability rated 70% or more. Payment under each agreement or contract between the VA and a state home must equal 65% of the payment that the VA would otherwise pay to the state home if the veteran were receiving nursing home care.

21st Century Cures Act

21st Century Cures Act This bill amends the Public Health Service Act to reauthorize the National Institutes of Health (NIH) through FY2018. The NIH Innovation Fund is established to fund a strategic plan, early stage investigators, and high-risk, high-reward research. The NIH may require scientific data to be shared if the research is fully funded by the NIH. The NIH and the Food and Drug Administration (FDA) must implement a system that allows further research on clinical trial data. The Centers for Disease Control and Prevention must expand surveillance of neurological diseases. The Council for 21st Century Cures is established to accelerate the discovery, development, and delivery of innovative cures, treatments, and preventive measures. The Department of Health and Human Services must monitor the use of antibacterial and antifungal drugs and resistance to these drugs. Requirements are established for interoperability and certification of health information technology. Practices that discourage the exchange of electronic health information are prohibited. This bill amends the Federal Food, Drug, and Cosmetic Act to revise the drug approval process, including by: (1) allowing patient experience data to be considered in the risk-benefit assessment of a new drug, (2) requiring the FDA to qualify drug development tools, (3) allowing the FDA to rely upon data previously submitted for a different purpose to expedite the development of certain drugs, and (4) establishing a streamlined data review program for approval of a drug for an additional indication. Manufacturers and distributors of investigational drugs for serious conditions must publish their policies on compassionate use requests. The marketing exclusivity period is extended by six months for a drug approved for a new indication that is a rare disease or condition. The priority review voucher program for rare pediatric diseases is revised and extended. The FDA must: (1) establish a program for priority review of breakthrough medical devices, (2) identify types of devices that do not require a report preceding introduction, and (3) rely on a third-party to determine the safety and effectiveness of changes to medical devices. Regarding medical devices, this bill defines “valid scientific evidence” and makes changes to classification panels and the humanitarian device exemption. “Health software” is defined and, with certain exceptions, exempted from FDA regulations. This bill amends title XVIII (Medicare) of the Social Security Act to require the Centers for Medicare & Medicaid Services (CMS) to: (1) increase certain payments for new antimicrobial drugs, (2) establish a payment methodology for certain medical devices, and (3) publish online estimated payments for certain outpatient items and services. A pharmaceutical and technology ombudsman within the CMS must respond to complaints from manufacturers of medical products. Medicare prescription drug plan sponsors may limit the access of certain beneficiaries to frequently abused drugs. This bill amends the Controlled Substances Import and Export Act to allow exported controlled substances to be re-exported within the European Economic Area.

Treat and Reduce Obesity Act of 2015 Amends title XVIII (Medicare) of the Social Security Act to authorize the Department of Health and Human Services (HHS), in addition to qualified primary care physicians and other primary care practitioners, to cover intensive behavioral therapy for obesity furnished by: (1) a physician who is not a qualified primary care physician; (2) an evidence-based, community-based HHS-approved lifestyle counseling program; or (3) any other appropriate health care provider (including a physician assistant, nurse practitioner, clinical nurse specialist, a clinical psychologist, and a registered dietitian or nutrition professional). Allows coverage of intensive behavioral therapy for obesity furnished by another appropriate health care provider or program only if it is furnished: (1) upon referral from, and in coordination with, a physician or primary care practitioner in a primary care or other HHS-specified setting; and (2) in an office setting, a hospital outpatient department, a community-based site that complies with the federal regulations concerning the privacy of individually identifiable health information, or another HHS-specified setting. Authorizes HHS to cover under Medicare part D (Voluntary Prescription Drug Benefit Program) medication for treatment of obesity or for weight loss management for an overweight individual with one or more related comorbidities.

Gun Show Loophole Closing Act of 2015 Amends the federal criminal code to make it unlawful for any person to operate a gun show unless such person: (1) has attained 21 years of age; (2) is not prohibited from transporting, shipping, or receiving firearms and has not violated any federal firearms requirements; (3) has registered with the Attorney General as a gun show operator and has provided a photograph and fingerprints; (4) has not concealed material information nor made false statements in connection with a gun show operator registration; and (5) notifies the Attorney General of the date, time, and duration of a gun show not later than 30 days before the commencement of such show and verifies the identity of each vendor at the gun show. Imposes recordkeeping requirements on gun show operators and criminal penalties for failure to register as a gun show operator and maintain required records. Grants the Attorney General authority to enter the business premises of any gun show operator, without a showing of reasonable cause or a warrant, to examine records and inventory to determine compliance with this Act. Increases criminal penalties for serious recordkeeping violations and violations of criminal background check requirements. Authorizes the Bureau of Alcohol, Tobacco, Firearms, and Explosives to hire additional investigators to carry out inspections of gun shows.

Job Creation through Energy Efficient Manufacturing Act This bill requires the Department of Energy (DOE) to establish a Financing Energy Efficient Manufacturing Program to provide grants to establish or expand programs to finance energy efficiency retrofit, onsite clean and renewable energy, smart grid systems, and alternative vehicle fleet projects for industrial businesses. DOE must establish a process to identify financing opportunities for manufacturing and industrial business with asset portfolios across multiple states. Grant recipients must give a higher priority to those programs that: (1) leverage private and nonfederal sources of funding, and (2) aim to expand the use of energy efficiency project financing using private sources of funding. Grant recipients must also collect, share, and report on data resulting from programs carried out under this bill. DOE must incorporate the data into appropriate DOE databases, with provisions for the protection of confidential business data.

Marine and Hydrokinetic Renewable Energy Act of 2015 This bill amends the Energy Independence and Security Act of 2007 to revise and reauthorize through FY2019 the program of research, development, demonstration, and commercial application to expand marine and hydrokinetic renewable energy production. The program must give priority to fostering accelerated research, development, and commercialization of technology. The meaning of "marine and hydrokinetic renewable energy" is expanded to include all forms of energy, not just electricity, from: (1) waves, tides, and currents in oceans, estuaries, and tidal areas; (2) free flowing water in rivers, lakes, and streams; (3) free flowing water in man-made channels; and (4) differentials in ocean temperature (ocean thermal energy conversion). National Marine Renewable Energy Research, Development, and Demonstration Centers must support in-water testing and demonstration of marine and hydrokinetic renewable energy technologies, including facilities capable of testing: (1) marine and hydrokinetic renewable energy systems of various technology readiness levels and scales, (2) a variety of technologies in multiple test berths at a single location, and (3) arrays of technology devices.

Protecting Domestic Violence and Stalking Victims Act Amends federal firearms provisions to expand the definition of: (1) "intimate partner" to include a dating partner or former dating partner; and (2) "misdemeanor crime of domestic violence" to include a misdemeanor offense that has, as an element, the use or attempted use of force, or the threatened use of a deadly weapon by a dating partner or former dating partner against the victim. Prohibits the sale or other disposition of a firearm or ammunition to, or the possession or receipt of a firearm by, a person who: (1) is subject to a court order, or an ex parte order, that restrains such person from harassing, stalking, threatening, or engaging in other conduct that would put an individual in reasonable fear of bodily injury, including an order issued at the request of an employer on behalf of its employee or at the request of an institution of higher education on behalf of its student, or from intimidating or dissuading a witness from testifying in court; or (2) has been convicted in any court of a misdemeanor crime of stalking under federal, state, territorial, or tribal law or of a crime that involves conduct that would be proscribed by prohibitions against stalking if committed within the special maritime and territorial jurisdiction of the United States.

Public Lands Service Corps Act of 2015

Public Lands Service Corps Act of 2015 Amends the Public Lands Corps Act of 1993 to rename: (1) the Public Lands Corps Act of 1993 as the Public Lands Service Corps Act of 1993, and (2) the Public Lands Corps as the Public Lands Service Corps (the Corps). Establishes the Corps in the Department of Commerce (as well as in the Department of Agriculture and the Department of the Interior, as under current law). Requires: (1) establishment of a department-level office within the Department of the Interior, Forest Service, and the National Oceanic and Atmospheric Administration for the coordination of Corps activities; and (2) designation of a Corps coordinator for each agency within the Departments of the Interior, of Agriculture, and of Commerce that administers such activities. Establishes an Indian Youth Service Corps liaison. Permits the enrollment of resource assistants and consulting interns. Sets a maximum enrollment term of two years. Requires a recruitment program for the Corps. Instructs the Department concerned, for purposes of training, to take into account training already received by Corps participants enrolled from qualified youth or conservation corps. Describes the types of natural and cultural resources conservation projects that may be carried out by the Corps. Authorizes the Corps to provide certain visitor and interpretation services. Authorizes each Department to make: (1) arrangements for temporary housing for Corps participants in conservation centers, and (2) individual placements of consulting interns to perform management analysis activities for agencies under the Department's jurisdiction carrying out appropriate natural and cultural resources conservation projects. Authorizes cooperative agreements and competitive grants for Indian tribes and qualified youth or conservation corps to establish Indian Youth Service Corps programs. Requires the Secretary to issue management guidelines for programs of the Corps. Revises requirements for: (1) participant living allowances to include certain travel costs; (2) noncompetitive hiring status to cover Indian Youth Service Corps particpants, resource assistants, and consulting interns. Removes resource assistants from eligibility for national service educational awards.

PRO Students Act

Protections and Regulation for Our Students Act or the PRO Students Act This bill amends title IV (Student Assistance) of the Higher Education Act of 1965 to require proprietary institutions of higher education (IHEs) to derive at least 15% of their revenue from non-federal sources or risk becoming ineligible for title IV funding. The legislation establishes a Proprietary Education Oversight Coordination Committee. IHEs and other postsecondary educational institutions must meet certain requirements regarding entrance counseling for first-time borrowers, disclosure of clinical training agreement terms, disclosure of a mandatory program review, and preparation of students upon successful program completion. IHEs and other post-secondary educational institutions must not use revenues derived from federal educational assistance funds for recruiting or marketing activities. It amends title IV program participation requirements to broaden the incentive compensation ban, to prohibit predispute arbitration agreements in student contracts, to establish certain institutional requirements related to student default risk, and to prohibit retaliation against whistleblowers who disclose institutional violations. The Department of Education (ED) must establish a complaint tracking system, conduct mandatory program reviews of institutions that pose a significant risk of failing to comply with title IV requirements, and recalculate the cohort default rate and redetermine title IV eligibility for institutions that engage in default manipulation. The legislation permits a federal student loan borrower or ED, on behalf of multiple borrowers, to assert an IHE's unlawful acts or omissions as an affirmative claim or defense against student loan repayment. It also permits ED to impose civil penalties on IHEs that engage in substantial misrepresentation or other serious violations. Accrediting agencies or associations must not require institutions to enter predispute arbitration agreements with students.

Raise the Wage Act

Raise the Wage Act This bill amends the Fair Labor Standards Act of 1938 (FLSA) to increase the federal minimum wage for employees to: (1) $8.00 an hour on January 1, 2016, or, if later, on the first day of the third month after enactment of this Act; (2) $9.00 an hour after one year; (3) $10.00 an hour after two years; (4) $11.00 an hour after three years; (5) $12.00 an hour after four years; and (6) the amount the Department of Labor determines (based on increases in the median hourly wage of all employees) after five years, and annually thereafter. The federal minimum wage for tipped employees shall increase to $3.15 an hour for one year on January 1, 2016, or the first day of the third month after enactment of this Act, whichever is later. Subsequent annual adjustments of the wage increase, according to a specified formula, shall ensure that it remains equal to the wage in effect under FLSA for other employees. Employers must notify their employees of the right to retain any received tips. The separate minimum wage requirements for tipped employees shall end, effective one day after the hourly wage established for them under this Act takes effect. The Department must publish any increase in the minimum wage in the Federal Register and on the Department's website 60 days before it takes effect.

Resident Physician Shortage Reduction Act of 2015

Resident Physician Shortage Reduction Act of 2015 Amends title XVIII (Medicare) of the Social Security Act with respect to distribution of additional resident positions as they affect calculation of payments for direct graduate medical education costs. Directs the Secretary of Health and Human Services, for each of FY2017-FY2021 (and each succeeding fiscal year if additional residency positions are available to distribute), to increase the otherwise applicable resident limit for each qualifying hospital. Directs the Secretary to determine the total number of additional residency positions available for distribution, in accordance with guidelines for allocating 33% to hospitals already operating over the resident limit, and generally setting the aggregate number of increases in the resident limit to 3,000 in each year. Specifies the process for distributing positions. Declares that, for discharges occurring on or after July 1, 2017, the indirect teaching adjustment factor, with respect to additional payments for subsection (d) hospitals with indirect costs of medical education, insofar as those additional payments are attributable to resident positions distributed to a hospital according to such process, shall be computed in a specified manner with respect to those resident positions. (Generally, a subsection [d] hospital is an acute care hospital, particularly one that receives payments under Medicare's inpatient prospective payment system when providing covered inpatient services to eligible beneficiaries.) Directs the National Health Care Workforce Commission established under the Patient Protection and Affordable Care Act to study the physician workforce. Directs the Comptroller General to study strategies for increasing the diversity of the health profession workforce.

Medicare Diabetes Prevention Act of 2015 Amends title XVIII (Medicare) of the Social Security Act (SSAct) to provide coverage of diabetes prevention program services to an eligible diabetes prevention program individual. Directs the Secretary of Health and Human Services to establish the criteria for a diabetes prevention program in accordance with the standards under the National Diabetes Prevention Program established by the Centers for Disease Control and Prevention. Excludes items and services under a diabetes prevention program from the skilled nursing facility prospective payment system. Includes: (1) items and services under a diabetes prevention programs among federally qualified health center services, (2) rates of referrals of eligible individuals to diabetes prevention programs among the quality measures for covered professional services in the Medicare physician quality reporting system, and (3) an individual's diabetes risk assessment in the individual's Medicare personalized prevention plan. Expresses the sense of the House of Representatives that the National Diabetes Prevention Program presents an opportunity for states to reduce the incidence of diabetes among individuals enrolled in their Medicaid programs under SSAct title XIX.

Registered Nurse Safe Staffing Act of 2015

Registered Nurse Safe Staffing Act of 2015 Amends title XVIII (Medicare) of the Social Security Act to require each Medicare participating hospital to implement a hospital-wide staffing plan for nursing services furnished in the hospital. Requires the plan to require that an appropriate number of registered nurses provide direct patient care in each unit and on each shift of the hospital to ensure staffing levels that: (1) address the unique characteristics of the patients and hospital units; and (2) result in the delivery of safe, quality patient care consistent with specified requirements. Requires each participating hospital to establish a hospital nurse staffing committee which shall implement such plan. Specifies civil monetary and other penalties for violation of the requirements of this Act. Sets forth whistleblower protections against discrimination and retaliation involving patients or employees of the hospital for their grievances, complaints, or involvement in investigations relating to such plan.

Cold War Service Medal Act of 2015 Authorizes the military department concerned to issue the Cold War Service Medal to members of the Armed Forces who: (1) served on active duty for at least 24 consecutive months during the Cold War (September 2, 1945, through December 26, 1991); (2) were deployed outside the continental United States for at least 30 days during such period; (3) were members of a reserve component of the Armed Forces and were called or ordered to active duty to participate in exercises or operations directly related to the Cold War; or (4) performed other Cold War service as DOD may prescribe. Disqualifies any such person who was not discharged or released from the Armed Forces under under honorable conditions. Expresses the sense of Congress that DOD should expedite the design and issuance of the Medal.

Marijuana Businesses Access to Banking Act of 2015 This bill provides a safe harbor for depository institutions providing financial services to a marijuana-related legitimate business insofar as it prohibits a federal banking regulator from: (1) terminating or limiting the deposit or share insurance of a depository institution solely because it provides financial services to a marijuana-related legitimate business; or (2) prohibiting, penalizing, or otherwise discouraging a depository institution from offering such services. A federal banking regulator may neither recommend, motivate, provide incentives, nor encourage a depository institution to refuse to offer financial services to an individual, nor downgrade or cancel financial services offered to an individual, solely because the individual: (1) is a manufacturer, producer, owner or operator of a marijuana-related legitimate business; or (2) the depository institution was not aware that the individual is the owner or operator of a marijuana-related legitimate business. A federal banking regulator may not take any adverse or corrective supervisory action, solely because of the business involved, on a loan made to an owner or operator of: (1) a marijuana-related legitimate business, or (2) real estate or equipment that is leased to a marijuana-related legitimate business. Immunity from federal criminal prosecution or investigation is granted, subject to certain conditions, to a depository institution that provides financial services to a marijuana-related legitimate business in a state or one of its political subdivisions that allows the cultivation, production, manufacture, sale, transportation, display, dispensing, distribution, or purchase of marijuana. Neither the depository institution nor its officers, directors, nor employees may be held liable under federal law or regulation solely for providing such financial services or further investing income derived from those services. The Department of the Treasury must require any suspicious activity report filed by a financial institution regarding a marijuana-based business to comply with specified guidance of the Financial Crimes Enforcement Network.

National Park and Wilderness Waters Protection Forever Act

National Park and Wilderness Waters Protection Forever Act Withdraws federal lands within the Rainy River Drainage Basin in Minnesota from all forms of: (1) entry, appropriation, or disposal under the public land laws; (2) location, entry, and patent under the mining laws; and (3) operation under the mineral leasing and mineral material laws. Deems the approval of any lease or permit for activities relating to mining on federal lands in the Basin to be a major federal action significantly affecting the quality of the human environment. Requires an environmental impact statement conducted for such an action to include consideration of any potential impacts to units of the National Park System (NPS) or land in the National Wilderness Preservation System (NWPS) located in the Basin. Conditions the issuance or renewal of any such lease or permit on a requirement that the permittee or lessee seasonally monitor water quality on such lands throughout the Basin. Requires all mining activities to be suspended if any mining related contamination is detected in any NPS unit or NWPS land in the Basin until all contamination has been remediated. Bars a federal agency from approving any mining related activities on federal lands in the Basin until the entity holding a lease or permit for that activity has submitted: (1) an acceptable contamination remediation plan, and (2) a full reclamation and performance bond sufficient to return the affected area to its original condition and treat any potential contamination for 50 years following the conclusion of any mining activities. Exempts sand, gravel, and granite operations that exist on the date of enactment of this Act.

21st Century Civilian Conservation Corps Act Authorizes the President, in order to relieve widespread unemployment, restore depleted natural resources in the United States, and advance public works programs, to establish a Civilian Conservation Corps to employ unemployed or underemployed U.S. citizens in the construction, maintenance, and carrying on of works of a public nature, such as forestation of U.S. and state lands, prevention of forest fires, floods, and soil erosion, and construction and repair of National Park System paths and trails. Authorizes the President to extend Corps activities to state- and private-owned lands to prevent and control forest fires and floods and attacks of forest tree pests and diseases. Requires the President, based on certain criteria, to give preference to the employment of additional persons in the Corps in the following order: (1) unemployed Armed Forces veterans (including Reserve members); (2) unemployed U.S. citizens who have exhausted their unemployment compensation; (3) unemployed U.S. citizens who are eligible for unemployment compensation immediately before employment in the Corps, including any additional compensation or extended compensation; and (4) other unemployed or underemployed U.S. citizens. Authorizes the President to provide housing and transportation for Corps employees. Prohibits discrimination in the hiring of Corps employees.

The National Oceanic and Atmospheric Administration (NOAA) must establish a Climate Change Education Program to: broaden the understanding of human-induced climate change, possible consequences, and potential solutions; apply the latest scientific and technological discoveries to provide learning opportunities to people of all ages; conduct a national information campaign to help people understand and promote implementation of new technologies, programs, and incentives related to energy conservation, renewable energy, and greenhouse gas reduction; and inform the public of impacts to human health and safety as a result of climate change. NOAA must establish a grant program for climate change education. This grant program must be included in the Program.

College Options for DREAMers Act This bill amends title IV (Student Assistance) of the Higher Education Act of 1965 to allow Dreamer students to receive federal financial aid for higher education. A "Dreamer student" is an individual who was under age 16 upon entering this country, has provided a list of secondary schools the individual attended in this country, and, in this country: has earned a high school diploma or the equivalent, is scheduled to complete the requirements for a high school diploma or equivalent before the next academic year begins, has acquired a degree from an institution of higher education, has successfully completed at least two years of a program for a baccalaureate or higher degree, is a beneficiary of the Deferred Action for Childhood Arrivals program, or has served honorably in the uniformed services for at least four years. The Department of Education must provide for a hardship exception to the age and secondary school list requirements. States are allowed to offer unlawful aliens postsecondary benefits on the basis of their residence in the state (e.g., in-state tuition).

Climate Solutions Act of 2015

Climate Solutions Act of 2015 This bill amends the Public Utility Regulatory Policies Act of 1978 by directing the Department of Energy (DOE) to promulgate regulations that require the percentage of electric energy generated from renewable sources that is sold at the retail level to increase each year beginning in 2020 so that in 2050 and each subsequent year, the percentage is at least 80%. DOE must also promulgate regulations that set cumulative energy savings targets for retail electric energy and natural gas suppliers that require each supplier to secure annual savings that are achieved through end-use efficiency improvements at customer facilities. For electric energy suppliers, the targets must increase from .25% of sales in 2018 to 1.5% of sales in 2023 and each year thereafter through 2028. For natural gas suppliers, the target must increase from .25% of sales in 2018 to .5% of sales in 2023 and each year thereafter through 2028. DOE must allow suppliers to achieve the targets through a market-based trading system. The Environmental Protection Agency (EPA) must promulgate annual emission reduction targets for each of 2030 through 2050 to ensure that U.S. greenhouse gas emissions: (1) in 2035 are at least 40% below those in 1990, and (2) in 2050 are at least 80% below those in 1990. The EPA must promulgate final regulations to implement those targets within 7 years and review them at least every 5 years thereafter.

FLEET Act of 2015

Federal Leadership in Energy Efficient Transportation Act of 2015 or the FLEET Act of 2015   Amends the National Energy Conservation Policy Act to expand the definition of "energy or water conservation measure" under such Act to include, in the case of a contract in which the U.S. Postal Service (USPS) is a party: (1) the purchase or lease of low emission and fuel efficient vehicles; (2) the upgrade of USPS vehicles to increase average fuel economy and reduce carbon dioxide emissions; or (3) the construction or maintenance of infrastructure to support such vehicles, including electric vehicle charging stations. Expands the program of agency incentives for conserving energy to include in utility incentive programs measures to support the use of low emission and fuel efficient USPS vehicles. Prohibits USPS from awarding a contract for a vehicle, or purchasing or leasing a vehicle for use by USPS, including a passenger car, light truck, or medium or heavy-duty vehicle, unless the vehicle meets certain minimum carbon dioxide emissions standards and average fuel economy standards. Prohibits USPS from meeting the requirements of this Act by: (1) reducing the frequency of mail delivery, (2) closing post offices or postal distribution facilities, (3) taking any action to restrict or diminish a collective bargaining agreement or eliminate or reduce employee benefits, or (4) entering into a contact with a private company to perform duties that are currently performed by postal employees who are bargaining unit employees.
