Federal Asthma Assessment and State Tracking Act of 2002 - Amends the Head Start Act to authorize early Head Start and Head Start programs to carry out asthma screening programs. Amends the Public Health Service Act to direct the Secretary of Health and Human Services to award grants to local educational agencies for asthma screening programs for public school children. Amends the Social Security Act to state that nothing under such Act or other law shall be construed as prohibiting or restricting Medicaid or school-based assistance for children receiving asthma screening tests. Requires the Secretary to develop, in conjunction with State medicaid programs under the Social Security Act, a demonstration program for model asthma treatment centers. Directs that the centers be based on the treatment models developed by the Inner City Asthma Program sponsored by the National Institutes of Health. Directs the Secretary to give priority in developing the program to communities where the prevalence of uncontrolled asthma is high.

Trade Enhancement Act of 2002 - Amends the Trade Act of 1974 to make an act, policy, or practice unjustifiable if it constitutes fostering by a foreign government of systematic anticompetitive activities by persons or among persons in one or more foreign countries that have the effect of restricting, on a basis inconsistent with commercial considerations, access of U.S. goods or services to a foreign market or diverting foreign goods or services toward the U.S. market. Makes it an unreasonable act, policy, and practice for a foreign government to tolerate such systematic anticompetitive activities. Requires the United States Trade Representative (USTR), in addition to determining what action to take with respect to any act, policy, or practice found unjustifiable or unreasonable, to: (1) further determine whether there is reason to believe that the conduct of the foreign country concerned involves anticompetitive conduct engaged in by any natural or corporate person or persons; and (2) if so, refer the matter to the Attorney General for investigation into whether such conduct violates the Sherman Act. Amends the Sherman Act to require the Attorney General to: (1) conduct such an investigation if the USTR refers such a matter; and (2) commence an action in a U.S. district court seeking injunctive and other relief if an investigation results in an affirmative determination. Amends the Trade Act of 1974 to authorize the USTR to use, if it has a reasonable basis, an inference adverse to the interests of any foreign government which has failed to cooperate by not acting to the best of its ability to: (1) comply with a reasonable request for information; or (2) require a party within its jurisdiction to comply with a reasonable request for information.

Stealth Lobbyist Disclosure Act of 2002 - Amends the Lobbying Disclosure Act of 1995 to redefine the term "client" with respect to coalitions and associations on whose behalf a lobbyist must file a registration. Provides that, in the case of a coalition or association that employs or retains other persons to conduct lobbying activities, each of the individual members of the coalition or association, and not the coalition or association itself as under current law, is the client for whom a registration must be filed. Makes an exception for certain tax-exempt associations and for certain members of a coalition or association if the amount reasonably expected to be contributed by such member toward specific legislation-influencing activities of the coalition or association is less than $1,000 per any semiannual period.

Emergency Unemployment Compensation Act of 2002 - Amends the Temporary Extended Unemployment Compensation Act of 2002 (TEUCA, which is title II of the Job Creation and Worker Assistance Act of 2002, PL107-147) to extend the TEUCA program through weeks of unemployment ending before July 1, 2003 (currently January 1, 2003). Entitles eligible individuals in all States to a total of 26 weeks of TEUCA compensation (13 weeks beyond the current 13 weeks). Provides an additional seven weeks of TEUCA benefits for workers in high unemployment States (entitling them to a total of 33, which is 20 weeks beyond the current 13). Applies a revised adjusted insured unemployment rate State trigger. Sets an additional TEUCA benefit period State trigger based on total unemployment rate.

Military Survivor Benefits Improvement Act of 2002 - Adjusts the basic Survivor Benefit Plan (SBP) annuity amount for surviving spouses, age 62 or over, of former military personnel to: (1) 35 percent of the retired pay of the decedent (current law), for months beginning on or before the enactment of this Act; (2) 40 percent of such pay, for months beginning after enactment of this Act until October 2005; (3) 45 percent of such pay for months beginning after September 2005 and before October 2012; and (4) 55 percent of such pay for months after September 2012. Adjusts similarly the percentage amounts of SBP supplemental annuity authorized to be provided for such surviving spouses. Directs the Secretary of Defense to ensure appropriate adjustments in the computation of retired pay reductions for such supplemental annuities.

National AMBER Alert Network Act of 2002 - Requires the Attorney General to assign an AMBER Alert Coordinator of the Department of Justice to act as the national coordinator of the AMBER Alert communications network regarding abducted children. Requires the coordinator to: (1) seek to eliminate gaps in the network; (2) work with States to encourage the development of additional network elements and to ensure regional coordination; and (3) act as the nationwide point of contact for network development and for regional coordination of alerts on abducted children through the network. Directs the Coordinator to: (1) notify and consult with the Federal Bureau of Investigation concerning each child abduction for which an AMBER Alert is issued; and (2) establish minimum standards for the issuance of alerts and for the extent of their dissemination (limited to the geographic areas most likely to facilitate the recovery of the abducted child). Requires the Secretary of Transportation to provide grants to States for the development or enhancement of notification or communications systems along highways for alerts and other information for the recovery of abducted children. Includes among permissible activities the development or enhancement of electronic message boards, and the placement of additional signage, along highways. Directs the Attorney General to provide grants to States for the development or enhancement of programs and activities for the support of AMBER Alert communications plans.

Prescription Drug Fair Competition Act of 2002 - Amends the Federal Food, Drug, and Cosmetic Act to revise provisions concerning the timing of generic drug availability. Requires applicants (pharmaceutical companies) to register their patents with the Food and Drug Administration (FDA) within 30 days of approval (or issuance for subsequently issued patents). Makes failure to timely register a bar to civil actions for patent infringement. Requires applications for new drugs (NDA) or abbreviated new drug applications (ANDA) which rely upon investigations not conducted by or for the applicant and which concern a patent that claims both the drug and a method of use or more than one method of use to include a certification on a claim-by-claim basis that the patent is invalid or will not be infringed (known as a Paragraph IV filing/certification) by the new drug's (generic) manufacture and a statement regarding the method(s) of use claim. Prohibits (for subsequently issued patents) an extension of the 30 month stay of FDA approval for any new drug where an ANDA or NDA contains a Paragraph IV filing/certification and the patent holder indicates an intention to bring a patent infringement suit against the new (generic) drug's manufacturer. Makes failure to timely file a civil action for infringement a bar to later action. Requires the first generic applicant with a Paragraph IV filing to forfeit the 180 day marketing exclusivity period to a subsequent generic applicant if the first generic applicant engages in certain behaviors which delay or prevent the marketing of the generic drug. Revises notice requirements for Paragraph IV filings to include and protect certain proposed formulation, composition, or method of use information. Excludes an applicants's ability to pay damages from a court's consideration of whether or not to provide injunctive relief before the expiration of the 30 month stay of approval period.

Social Security Preservation Act of 2002

Social Security Preservation Act of 2002 - Repudiates the statements of: (1) the Secretary of the Treasury, Paul O'Neill, that the social security program (title II (Old Age, Survivors and Disability Insurance) of the Social Security Act) is a "pyramid game" and that the social security trust funds (Federal Old-Age and Survivors Insurance Trust Fund and Federal Disability Insurance Trust Fund) have "no assets;" and (2) the statements of congressional leaders that the social security trust funds are "empty," a "total fraud," "a mere accounting device", and consist of "worthless IOUs." Prohibits the use by the Treasury of amounts borrowed from the social security trust funds to pay for other Government expenditures in a fiscal year, unless, during the nine month period immediately preceding the year, the Congress has enacted legislation explicitly affirming that the Treasury will repay these funds. Amends Federal law to require the President to include in each budget: (1) the total amount the Treasury has borrowed from the social security trust funds; and (2) explanations of repayment plans and the impact any legislation enacted in the preceding year will have on them. Requires the Secretary to affirm annually that the Treasury will honor the securities in such trust funds. Allows any individual credited with wages or self-employment income under Medicare to bring an action in an appropriate Federal district court to enjoin any act or practice: (1) by which the Secretary contests an obligation issued for purchase by either social security trust fund; or (2) which constitutes a failure to provide for redemption of the obligation in accordance with its terms or to otherwise honor the full faith and credit of the United States supporting such obligation.

Oral Health Promotion Act of 2002 - Amends title XXI (State Children's Health Insurance) (SCHIP) of the Social Security Act (SSA) to add dental services to coverage provided. Allows States the option of using Federal SCHIP funds to cover dental expenses for a child who is eligible for Medicaid under targeted low-income child Medicaid guidelines when the child has medical coverage that does not include dental services. Allows States the option of covering dental services of adults receiving assistance under SCHIP. Alters the Medicaid matching rate for adult full coverage dental benefits. Establishes in the Treasury the Community Oral Health Expansion Fund to expand the availability of oral health services through community-based centers. Authorizes the use of funds for demonstration projects and demonstration partnerships with Head Start programs for identifying children at risk of dental disease and providing prevention measures. Requires States to contribute, directly or indirectly, up to ten percent of demonstration project costs. Requires the Secretary of Health and Human Services to give grant: (1) priority to States covering a Medicaid level of dental benefits under SCHIP; and (2) preference to States with market-based payment rates for dental services under both Medicaid and SCHIP.

Requires fees collected to be used for administration of this Act and grants for: (1) collecting or processing used computers, monitors, or other devices for recycling; (2) reusing or reselling such articles; and (3) extracting and using, or selling for reuse, raw materials from such articles. Requires reports to Congress on the status of computer recycling, which shall include descriptions of fee collection and use.

Living Well with Fatal Chronic Illness Act - Amends title XVIII (Medicare) of the Social Security Act (SSA) to add a new part D (Purchase of Medicare Benefits by Certain Caregivers Age 55-to-65 Years of Age). Makes eligible for both part A and part B Medicare benefits during a specified period certain individuals 55 or older who are caring on a full-time basis for family members who are Medicare beneficiaries requiring substantial supervision due to severe cognitive impairment or are unable to perform at least two activities of daily living. Directs the Secretary of Health and Human Services to determine and to provide for payment and collection of a monthly premium. Creates in the Treasury the Medicare Caregiver Trust Fund to hold collected premiums. Amends the Internal Revenue Code to provide an annual long-term care credit of $3000 per applicable person for whom a taxpayer is an eligible caregiver. Requires the Secretary, acting through the Administrator of the Health Resources and Services Administration, to carry out research, demonstration, and education programs toward improving the delivery of appropriate health and support services for patients with fatal chronic illnesses. Requires the Director for the Centers for Disease Control and Prevention and the Director of the National Institutes of Health to expand activities with respect to fatal chronic illness. Requires the Secretary to develop pilot programs for the treatment for fatal chronic illness. Directs the Secretary of Veterans Affairs to improve the delivery of appropriate treatment services to patients with fatal chronic illness under health care programs of the Department of Veterans Services.

Revises the formula for determining the amount in an eligible individual's TEUC account. Sets such amount at the lesser of: (1) the total (currently half of the total) amount of regular compensation, including dependents' allowances, payable to the individual during the individual's benefit year; or (2) 26 (currently 13) times the individual's average weekly benefit amount for the benefit year. Augments an individual's account by half (currently all) of the amount originally established in that account if it is exhausted at the time a State is in an extended benefit period.

Veterans Right-To-Know Act of 2002 - Requires the Secretary of Defense to identify each developmental or operational test of the Department of Defense (DOD) involving chemical or biological weapons, or defense against such weapons, in which military personnel or civilians were or may have been exposed to actual or simulated hazardous agents, with or without their knowledge or consent. Requires the Comptroller General to establish within the General Accounting Office an Oversight Working Group on Biological and Chemical Testing to: (1) review DOD chemical and biological test activities that involved exposure to military personnel or civilians; (2) report to Congress information concerning Project SHAD (DOD tests to evaluate the effectiveness of shipboard detection and protective procedures against chemical and biological warfare agents) and Project 112 (DOD tests in and around Alaska using chemical and biological agents); (3) continue to review DOD investigations of any other cases of DOD chemical or biological testing; and (4) identify veterans and veterans organizations with significant information involving such test projects and seek to have that information made available to the Secretaries of Defense and Veterans Affairs. Directs the Secretary of Veterans Affairs to: (1) notify any veterans who may have been exposed, with instructions on how to receive a health care evaluation; and (2) review declassified material to determine any lasting health effects that may have been incurred by exposed veterans.

Medicare Modernization and Prescription Drug Act of 2002 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to add a new part D (Voluntary Prescription Drug Benefit Program) under which each individual who is entitled to benefits under Medicare part A (Hospital Insurance) or eligible to enroll under Medicare part B (Supplemental Medical Insurance) is entitled to obtain qualified prescription drug coverage. Outlines standard coverage benefit packages for FY 2005. Includes for the standard package a monthly premium of $25, an annual deductible of $100, a coinsurance of 20 percent and an annual out-of-pocket spending limit of $2,000. Directs the Secretary to negotiate fair prices with pharmaceutical manufacturers. Provides for accelerated generic drug competition. Amends SSA title XVIII part C (Medicare+Choice) with respect to: (1) inclusion of the costs of certain military services to Medicare-eligible beneficiaries in the calculation of Medicare+Choice payment rates; (2) specialized Medicare+Choice plans for special needs beneficiaries; and (3) continuous open enrollment and disenrollment at any time. Revises requirements for Medicare: (1) part A concerning rural health care, inpatient hospital services, skilled nursing facility services, and hospices; (2) part B concerning physicians services and other services; and (3) part A and B concerning home health services and direct graduate medical education. Amends SSA title XIX (Medicaid) with respect to certain Medicaid disproportionate share hospital (DSH) allotment adjustments and the Q-I1 program. Amends the Federal Food, Drug, and Cosmetic Act to add requirements for interstate Internet sellers of prescription drugs. Establishes within the Office of the Director of the National Institutes of Health the Office of Rare Diseases. Amends the Public Health Services Act with respect to promotion of the pharmacist profession.

Establishes within the Federal Emergency Management Agency (FEMA) the Drought Assistance Fund, which shall be used to: (1) assist State, local, tribal, and critical service entities with drought-related activities; and (2) expand the technology transfer of drought and water conservation strategies. Requires: (1) the Director to publish guidelines for administering a national technical and financial drought assistance program; and (2) the Director, the Secretaries of Agriculture, the Interior, and the Army, and other appropriate Federal agency heads to implement integrated drought preparedness plans. Authorizes States, Indian tribes, local governments, and regional, water providers to develop and implement drought preparedness plans. Amends the Robert T. Stafford Disaster Relief and Emergency Assistance Act to authorize the Director of FEMA to reimburse States for qualifying costs incurred in prepositioning wildfire suppression resources.

Arsenic-Treated Lumber Prohibition and Disposal Act - Amends the Federal Insecticide, Fungicide, and Rodenticide Act to require the Administrator of the Environmental Protection Agency to promulgate regulations prohibiting the use of lumber treated with a pesticide that is a chromated copper arsenical (CCA lumber) in the manufacture, production, or use of any product that may be used for or by children and for any residential purpose. Amends the Solid Waste Disposal Act to: (1) list CCA lumber as a hazardous waste; (2) require disposal of discarded CCA lumber, notwithstanding regulations exempting certain solid wastes from the definition of hazardous waste, in a lined landfill with a leachate system and groundwater monitoring system; (3) require the Administrator to conduct an assessment of the risks of CCA lumber production and use; and (4) direct the Administrator to promulgate regulations for the gradual cessation and prohibition of production of such lumber. Requires the Administrator to: (1) develop and conduct an educational program to assist consumers, municipalities, and school systems in testing arsenic levels and making decisions concerning CCA lumber containment and removal; and (2) establish a pilot program of grants and technical assistance to assist school systems in removal of playground and other equipment containing CCA lumber and remediation activities.

Requires the program to: (1) compile scientifically valid information, with an emphasis on the effect of low doses during critical life stages and the extent of human and wildlife exposure; (2) research the mechanisms by which such chemicals interact with biological systems as well as their screening and tracking; and (3) include the participation of the U.S. Geological Survey. Directs the Secretary of Health and Human Services to establish the Hormone Disruption Research Interagency Commission. Establishes a Hormone Disruption Research Panel within the Institute.
