States' Right To Innovate in Health Care Act of 2009 - Amends the Social Security Act to add a new title XXII (State Comprehensive Health Care and Cost Containment Demonstration Projects). Directs the Secretary of Health and Human Services to establish a state-based Universal Health Care Coverage Commission to participate in the review of state applications for planning and demonstration grants for the development of a cost-effective delivery system of universal, comprehensive health care with simplified administration. Authorizes such grants. Requires a state plan to provide: (1) coverage of all eligible state residents, without regard to employment status, income, health status or preexisting condition, or location of residency within the state; and (2) health benefits that are at least actuarially equivalent to the standard Blue Cross/Blue Shield preferred provider option service benefit plan under the Federal Employees Health Benefit Program. Allows one or more contiguous states in a geographic region to file a joint application for such grants. Authorizes Interstate Compacts of states to conduct joint health care programs under a grant.

Automobile Dealer Economic Rights Restoration Act of 2009 - Prohibits an automobile manufacturer (manufacturer) in which the federal government has an ownership interest, or which receives loans from the federal government, from depriving an automobile dealer (dealer) of its economic rights. Requires the manufacturer to honor those rights as they existed for Chrysler LLC and General Motors Corporation dealers prior to the commencement of the bankruptcy cases of each corporation, including dealer rights to recourse under state law. Requires the appropriate manufacturer to restore the franchise agreement between the dealers and Chrysler LLC or General Motors that was in effect prior to the commencement of their respective bankruptcy cases, and to take assignment of such agreements. States that nothing in this Act is intended to make null and void the transfer of substantially all the assets of such corporations.

CLEAN-UP Act

Correction of Long-Standing Errors in Agencies' Unsustainable Procurements Act of 2009 or the CLEAN-UP Act - Requires executive agencies to ensure that: (1) inherently governmental functions, functions closely related to such functions, and mission-essential functions are performed by federal employees; (2) other functions are performed by the more efficient form of personnel, whether federal employees, contractors, or military personnel; and (3) consideration is given to using federal employees to perform new functions on a regular basis. Requires each agency head to submit to the Director of the Office of Management and Budget (OMB): (1) an annual report on service contracts for new work; (2) a Functions At Risk Report that describes those functions required to be performed by federal employees that are actually performed by contractors (requires agencies to reduce the total number of contractor employees described in that Report by 70% within six years); and (3) a strategic human capital plan to ensure the capability of the agency's federal employee workforce to perform agency functions. Prohibits an agency from conducting a public-private competition for any function that such plan identifies as experiencing a gap in its federal employee workforce. Requires agencies subject to the Federal Activities Inventory Reform Act of 1998 (other than the Department of Defense [DOD]) to: (1) submit an annual inventory of activities performed pursuant to contracts for services; (2) review those contracts and identify activities that should be considered for conversion to performance by civilian employees; and (3) develop a plan for such conversion by June 30 of the following year. Authorizes agency heads to expedite the hiring of certain professionals in shortage category positions. Requires the Director to: (1) develop guidelines for the establishment of business process re-engineering projects; and (2) conduct annual performance reviews of such projects that are ongoing. Sets forth revisions, requirements, and restrictions applicable to studies and public-private competitions for the conversion of agency functions to contractor performance pursuant to OMB Circular A-76.

Domestic Partnership Benefits and Obligations Act of 2009 - Provides that a federal employee and his or her domestic partner shall be entitled to benefits available to, and shall be subject to obligations imposed upon, a married federal employee and his or her spouse. Defines "domestic partner" to mean an adult unmarried person living with another adult unmarried person of the same sex in a committed, intimate relationship. Defines "benefits" to include federal health insurance and enhanced dental and vision benefits, retirement and disability benefits, family, medical, and emergency leave, group life insurance, long-term care insurance, compensation for work injuries, and benefits for disability, death, or captivity. Excludes members of the uniformed services from the definition of "employee." Sets forth requirements for filing: (1) an affidavit of eligibility as such a domestic partner, which shall include a certification that the employee and the domestic partner are each other's sole domestic partners and intend to remain so indefinitely; and (2) a statement upon dissolution of such a domestic partnership.

National Infrastructure Development Bank Act of 2009 - Establishes the National Infrastructure Development Bank as a wholly owned government corporation. Makes the Bank's Board of Directors responsible for monitoring and overseeing energy, environmental, telecommunications, and transportation infrastructure projects. Authorizes the Board to: (1) issue public benefit bonds and provide direct subsidies to infrastructure projects; (2) borrow on the global capital market and lend to entities and commercial banks for funding infrastructure projects; and (3) purchase, pool, and sell infrastructure-related loans and securities on such market. Requires the Board to establish criteria for determining project eligibility for financial assistance under this Act. Sets forth the duties of the Bank's executive committee and audit committee. Requires the Bank to establish a risk management committee, which shall: (1) create financial, credit, and operational risk management guidelines for the Bank; (2) set standards to ensure diversification of lending activities by both region and infrastructure project type; and (3) create conforming standards for infrastructure finance securities. Exempts all notes, debentures, bonds or other such obligations issued by the Bank, and the interest on or credits with respect to such bonds or other obligations, from state or local government taxation. Terminates the Bank after 15 years.

Puerto Rico Democracy Act of 2009 - Authorizes the government of Puerto Rico: (1) to conduct a plebiscite giving voters the option to vote to continue Puerto Rico's present political status or to have a different political status; (2) if a majority of ballots favor continuing the present status, to conduct additional such plebiscites every eight years; and (3) if a majority of ballots favor having a different status, to conduct a plebiscite on the options of becoming fully independent from the United States, forming with the United States a political association between sovereign nations that will not be subject to the Territorial Clause of the Constitution, or being admitted as a state of the Union. Prescribes the eligibility requirements for voting in the plebiscite. Requires the Puerto Rico State Elections Commission to certify plebiscite results to the President and Congress.

Lord's Resistance Army Disarmament and Northern Uganda Recovery Act of 2009 - Directs the President to submit to the appropriate congressional committees a regional strategy to guide U.S. support for multilateral efforts to eliminate the threat to civilians and regional stability posed by the Lord's Resistance Army (LRA) and to enforce the rule of law and ensure full humanitarian access in LRA-affected areas. Authorizes the President to provide assistance to respond to the humanitarian needs of populations in northeastern Congo, southern Sudan, and Central African Republic affected by LRA activity. Expresses the sense of Congress that the Secretary of State and Administrator of the United States Agency for International Development (USAID) should work with the appropriate congressional committees to increase future assistance to Uganda if the government of Uganda demonstrates a commitment to reconstruction in war-affected areas of northern and eastern Uganda. Expresses the sense of Congress that the President should support efforts by the people of northern Uganda and the government of Uganda to: (1) promote local and national reconciliation including mechanisms outlined in the Annexure to the Agreement on Accountability and Reconciliation between the government of Uganda and the LRA; and (2) assist internally displaced people, establish mechanisms for the demobilization and reintegration of former combatants, and enhance the competency of local institutions including the police.

Amends the Whale Conservation and Protection Study Act to rename it as the International Whale Conservation and Protection Act of 2009. Requires the Secretary of Commerce (Secretary), in cooperation with the Secretary of State, to: (1) restate strong U.S. opposition to commercial whaling and to refuse to engage in any negotiation or reinterpretation of the International Convention for the Regulation of Whaling that would weaken the moratorium on commercial whaling, create new categories of whaling, condone lethal scientific whaling, or weaken whale conservation and protection; and (2) support subsistence whaling and the development of the Aboriginal Whaling Management Scheme. Sets forth provisions concerning the International Whaling Commission. Requires the Secretary, in cooperation with the United States Coast Guard, to: (1) pursue the establishment of guidelines for minimizing the introduction of incidental noise from commercial shipping operations into marine environments to reduce the potential adverse affects on whales and other marine life; and (2) promote the use of areas to be avoided by commercial vessels and other navigational measures to minimize the threat of injury to whales. Requires the Secretary, in cooperation with the Secretary of the Interior, to encourage nations that hold any reservations under the Convention on International Trade in Endangered Species of Wild Fauna and Flora to the great whales listed in Appendix I to withdraw such reservations and terminate commercial trade in whale meat and products. Provides for international cooperation and compliance with regulations governing trade in or takings of whales. Requires the Secretary to: (1) negotiate with the government of Canada with the goal of concluding a North Atlantic Whale Conservation Agreement within 18 months; (2) develop international action plans to reduce threats to whales and other cetaceans through the establishment of new International Marine Protected Areas (IMAs) and IMA networks; and (3) establish whale research initiatives to enhance whale conservation efforts. Requires the Secretary and the Secretary of State to support efforts to study and reduce the adverse effects of anthropogenic noise on whales and other marine life.

Healthy Families Act

Healthy Families Act - Requires certain employers, who employ 15 or more employees for each working day during 20 or more workweeks a year, to permit each employee to earn at least one hour of paid sick time for every 30 hours worked. Declares that an employer shall not be required to permit an employee to earn more than 56 hours of paid sick time in a calendar year, unless the employer chooses to set a higher limit. Allows employees to use such time to: (1) meet their own medical needs; (2) care for the medical needs of certain family members; or (3) seek medical attention, assist a related person, take legal action, or engage in other specified activities relating to domestic violence, sexual assault, or stalking. Prohibits an employer from interfering with an employee's exercise of such rights. Directs the Secretary of Labor to exercise certain investigative and enforcement authority for employees covered by the Family and Medical Leave Act of 1993 or the Government Employee Rights Act of 1991. Grants the same authority, for employees under their jurisdiction, to the Librarian of Congress, the Comptroller General, the Board of Directors of the congressional Office of Compliance, and the Merit Systems Protection Board. Authorizes civil actions by employees, individuals, or their representatives for damages or equitable relief against employers who violate this Act. Waives a state's sovereign immunity with respect to a suit brought by an employee of a federally-assisted state program or activity for relief authorized under this Act. Requires the Commissioner of Labor Statistics annually to compile information annually on paid sick time, and the Comptroller General to study related matters. Declares that nothing in this Act shall be construed to discourage employers from adopting or retaining more generous leave policies.

Autism Treatment Acceleration Act of 2009 - Amends the Public Health Service Act to require the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration, to implement an Autism Care Center Program to provide grants and other assistance to improve the effectiveness and efficiency in providing comprehensive care to individuals diagnosed with autism spectrum disorders and their families. Directs the Secretary to award grants for: (1) services to enable adults with autism spectrum disorders to be as independent as possible; and (2) multimedia campaigns to increase public education and awareness and reduce stigma concerning such disorders. Establishes the Interdepartmental Autism Coordinating Committee to coordinate all federal efforts concerning autism spectrum disorders. Repeals provisions establishing the Interagency Autism Coordinating Committee to coordinate all efforts within the Department of Health and Human Services (HHS) concerning autism spectrum disorders. Requires the Secretary to establish: (1) the National Network for Autism Spectrum Disorders Research and Services to provide resources for, and facilitate communication between, autism spectrum disorder researchers and service providers; and (2) a National Data Repository for Autism Spectrum Disorders Research and Services to facilitate the development and rapid dissemination of research into best practices that improve care. Requires the Secretary to award national training initiative supplemental grants to address the unmet needs of individuals with autism spectrum disorders and their families. Amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Public Health Service Act to require group health plans to provide coverage for the diagnosis and treatment of autism spectrum disorders. Applies such requirement to coverage offered in the individual market, under the Federal Employees Health Benefits Program, and under Department of Defense (DOD) health benefit plans.

Nurse and Health Care Worker Protection Act of 2009 - Requires the Secretary of Labor to propose a standard on safe patient handling and injury prevention to prevent musculoskeletal disorders for direct-care registered nurses and all other health care workers that requires the use of engineering controls to lift patients and the elimination of manual lifting of patients through the use of mechanical devices, except where patient care may be compromised. Requires health care employers to: (1) develop and implement a safe patient handling and injury prevention plan; (2) provide their workers with training on safe patient handling and injury prevention; and (3) post a uniform notice that explains the standard and the procedures to report patient handling-related injuries. Requires the Secretary to conduct unscheduled inspections to ensure compliance with safety standards. Allows health care workers to: (1) refuse to accept an assignment in a health care facility that violates safety standards or for which such worker has not received required training; and (2) file complaints against employers who violate this Act. Prohibits employers from taking adverse actions against any health care worker who in good faith reports a violation, participates in an investigation or proceeding, or discusses violations. Authorizes health care workers who have been discharged, discriminated, or retaliated against in violation of this Act to bring legal action for reinstatement, reimbursement of lost compensation, attorneys' fees, court costs, and other damages. Requires the Secretary of Health and Human Services (HHS) to establish a grant program for purchasing safe patient handling and injury prevention equipment for health care facilities.

Credit Card Interchange Fees Act of 2009 - Amends the Truth in Lending Act to prohibit specified electronic payment system network practices, including the imposition of: (1) additional charges on merchants and consumers for premium payment cards; (2) certain restrictions on merchants, including chargebacks for transactions on point of sale terminals that exceed the allowable amount on such devices; (3) restrictions upon network routing; (4) any requirement to meet a minimum number of transactions in any period; or (5) fees or a related adverse action for failure of the merchant to meet such a minimum transactions requirement. Requires an electronic payment system network to disclose its contract terms to the merchant, including its complete operating rules, without restricting the merchant's use of such information. Directs the Federal Trade Commission (FTC) to prescribe regulations to: (1) ensure that the rules, terms, and conditions to which a merchant or consumer is subject under an agreement with an electronic payment system network are neither unfair nor deceptive to consumers and merchants, nor anticompetitive; (2) prohibit any unfair or deceptive act or practice or anticompetitive act or practice that may result from such rule, term, or condition; and (3) regularly review such rules, terms, and conditions. Directs the Board of Governors of the Federal Reserve System to collect and disseminate to the public: (1) complete information on fees charged by each electronic payment system network in connection with consumer-initiated transactions; and (2) the rules, terms, and conditions to which a merchant or a consumer is subject under an agreement with an electronic payment system network for transactions using payment cards.

Amends titles II (Old Age, Survivors and Disability Insurance) (OASDI) and XVIII (Medicare) to use such new CPIEC in the computation of cost-of-living increases for Social Security and Medicare benefits, replacing the CPI for All Urban Consumers (U.S. city average).

Gun Show Loophole Closing Act of 2009 - Amends the federal criminal code to make it unlawful for any person to operate a gun show unless such person: (1) has attained 21 years of age; (2) is not prohibited from transporting, shipping, or receiving firearms and has not violated any federal firearms requirements; (3) has registered with the Attorney General as a gun show operator and has provided a photograph and fingerprints; (4) has not concealed material information nor made false statements in connection with a gun show operator registration; and (5) notifies the Attorney General of the date, time, and duration of a gun show not later than 30 days before the commencement of such show and verifies the identity of each vendor at the gun show. Imposes recordkeeping requirements on gun show operators and criminal penalties for failure to register as a gun show operator and maintain required records. Grants the Attorney General authority to enter the business premises of any gun show operator, without a showing of reasonable cause or a warrant, to examine records and inventory to determine compliance with this Act. Increases criminal penalties for serious recordkeeping violations and violations of criminal background check requirements. Authorizes the Director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) to hire additional investigators to carry out inspections of gun shows.

Requires the Director of the National Institutes of Health (NIH) to include information on IBD research in the biennial reports of NIH to Congress. Expresses the sense of Congress that the Directors of NIH and the National Institute of Diabetes and Digestive and Kidney Diseases should support specified research and training goals for inflammatory bowel disease.

Allocates grant funds among states on the basis of the relative portion of school improvement funds provided to local educational agencies (LEAs) in each state under the Elementary and Secondary Education Act of 1965. Reserves 1% of the grant funds for assistance to outlying areas and Indian schools. Requires states to reallocate such grant funds to LEAs on the basis of each LEA's share of school improvement funds received by LEAs in the state for the previous fiscal year. Directs the Secretary to make grants to LEAs in Louisiana, Mississippi, and Alabama for the construction, modernization, renovation, or repair of public schools, including early learning facilities and charter schools, to make them safe, healthy, high-performing, and technologically up-to-date. Allocates grant funds among such LEAs on the basis of each LEA's share of infrastructure damage inflicted on public school facilities in such states by Hurricane Katrina or Hurricane Rita in 2005. Requires the iron and steel used in projects funded under this Act to have been produced in this country, subject to specified exceptions.

Federal Price Gouging Prevention Act

Federal Price Gouging Prevention Act - Makes it unlawful, during a period proclaimed by the President as an energy emergency, to sell gasoline or any other petroleum distillate at a price that: (1) is unconscionably excessive; or (2) indicates the seller is taking unfair advantage of the circumstances of an emergency to increase prices unreasonably. Authorizes the President to issue an energy emergency proclamation of up to 30 days, with renewals allowed, and to cite the geographic area, gasoline or other petroleum distillate, and time period covered. Authorizes a proclamation to include a period of up to one week preceding a reasonably foreseeable emergency. Exempts from this Act a sale of gasoline or other petroleum distillate transaction on a futures market. Empowers the Federal Trade Commission (FTC) and state attorneys general to enforce this Act. Prescribes civil and criminal penalties for violations, but limits the criminal penalty to criminal actions brought by the Department of Justice (DOJ). Allows a state to bring a civil action to enforce this Act or to impose civil penalties. Requires deposit of fines and penalties collected under this Act in a separate Consumer Relief Trust Fund in the Treasury to provide assistance under the Low Income Home Energy Assistance (LIHEAP) Program. Declares that nothing in this Act preempts state law.

Lung Cancer Mortality Reduction Act of 2009 - Amends the Public Health Service Act to require the Secretary of Health and Human Services (the HHS Secretary) to implement the Lung Cancer Mortality Reduction Program to achieve a reduction of at least 25% in the mortality rate of lung cancer by 2015. Includes within such program: (1) a strategic review and prioritization of research grants; (2) an expansion of research programs, such as on predispositions to lung cancer; and (3) the expedited development of computer assisted diagnostic, surgical, treatment, and drug testing innovations. Amends the Federal Food, Drug, and Cosmetic Act to apply provisions related to drugs for rare diseases or conditions to: (1) chemoprevention drugs for precancerous conditions of the lungs; (2) drugs for targeted therapeutic treatment of lung cancer; and (3) drugs to curtail or prevent nicotine addiction. Requires the HHS Secretary to establish an early disease research and management program targeted at the high incidence and mortality rates of lung cancer among minority and low income populations. Requires the Secretary of Defense (DOD) and the Secretary of Veterans Affairs (VA) to coordinate with the HHS Secretary in: (1) the development of the Lung Cancer Mortality Reduction Program; (2) the implementation of an early detection and disease management research program for military personnel and veterans whose smoking history and exposure to carcinogens during active duty service has increased their risk for lung cancer; and (3) the implementation of coordinated care programs for military personnel and veterans diagnosed with lung cancer. Requires the HHS Secretary to convene a Lung Cancer Advisory Board to monitor the programs established under this Act.

Star-Spangled Banner Commemorative Coin Act

Limits the period for coin issuance to calendar year 2012. Imposes a surcharge of $35 per coin for the $5 coins and $10 per coin for the $1 coins, which shall be distributed to the Maryland War of 1812 Bicentennial Commission for the purpose of supporting bicentennial activities, educational outreach activities, and preservation and improvement activities pertaining to the sites and structures relating to the War of 1812.

Authorizes the Secretary to award competitive matching grants to partnerships that include an LEA and, permissibly, IHEs, other educational entities, federal, state, regional, or local natural resource or environmental agencies, or park and recreation departments, for activities to improve and support environmental education that include: (1) advancing content and achievement standards; (2) developing or disseminating innovations or model programs; and (3) research.

Amends the Internal Revenue Code to provide a tax credit for voluntary donations to the House Clean Elections Fund. Establishes the Clean Elections Review Commission. Amends the Communications Act of 1934 to entitle clean money candidates to receive specified free broadcast time and reduced broadcast rates in certain circumstances. Amends federal postal law to prohibit franked mass mailings by Members of Congress (except public meeting notices) during the 90 days before primary and general election periods, unless they are not candidates for re-election to any other federal office. Amends FECA to: (1) empower the Federal Election Commission (FEC) to petition the U.S. Supreme Court for a proceeding on certiorari; and (2) reduce from 48 to 24 hours the deadline for electronic filing with the FEC of reports by each political committee of contributions received within 90 days before an election.

Authorizes the Secretary of Homeland Security to cancel the removal of, and adjust to conditional permanent resident status, an alien who: (1) entered the United States before his or her 16th birthday and has been present in the United States for at least five years immediately preceding enactment of this Act; (2) is a person of good moral character; (3) is not inadmissible or deportable under specified grounds of the Immigration and Nationality Act; and (4) at the time of application, has been admitted to an institution of higher education or has earned a high school or equivalent diploma. Sets forth the conditions for conditional permanent resident status. Authorizes an alien who has satisfied the appropriate requirements prior to enactment of this Act to petition the Secretary for conditional permanent resident status. Sets forth requirements respecting: (1) exclusive jurisdiction; (2) confidentiality; (3) fee prohibitions; (4) higher education assistance; and (5) a Government Accountability Office (GAO) report respecting the number of aliens adjusted under this Act.

Breast Cancer Education and Awareness Requires Learning Young Act of 2009 or EARLY Act - Amends the Public Health Service Act to direct the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC), to conduct a national evidence-based education campaign: (1) to increase public awareness regarding the threats posed by breast cancer to young women, including the particular risks faced by certain ethnic and cultural groups; and (2) focusing on awareness of risk factors and achieving early detection through community-centered informational forums, public service advertisements, and media campaigns. Directs the Secretary to award grants to entities to establish national multimedia campaigns that: (1) will encourage young women to be aware of their personal risk factors, strategies for increasing early detection and self awareness, evidence based preventative lifestyle changes, and other appropriate breast cancer early detection and risk reduction strategies; (2) will encourage young women of specific higher-risk populations to talk to their medical practitioners about those risks and methods for appropriate screening and surveillance; and (3) may include advertising through specified media. Requires the Secretary, acting through the Director, to: (1) establish an advisory committee to assist in creating and conducting the public education campaign; (2) conduct an education campaign to increase awareness among health care professionals; and (3) conduct prevention research. Directs the Secretary to award grants to organizations and institutions to provide to young women diagnosed with breast cancer substantive assistance and health information from credible sources on: (1) education and counseling regarding fertility preservation; (2) social, emotional, psychosocial, financial, lifestyle, and caregiver support; (3) familial risk factors; and (4) risk reduction strategies to reduce recurrence or metastasis.

Breast Cancer Patient Protect Act of 2009 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to require a group health plan that provides medical and surgical benefits to ensure that inpatient (and in the case of a lumpectomy, outpatient) coverage and radiation therapy are provided for breast cancer treatment. Prohibits such a plan from: (1) restricting benefits for any hospital length of stay to less than 48 hours in connection with a mastectomy or breast conserving surgery or 24 hours in connection with a lymph node dissection, insofar as the attending physician, in consultation with the patient, determines such stay to be medically necessary; or (2) requiring that a provider obtain authorization from the plan or issuer for prescribing any such length of stay. Requires such a plan or issuer to: (1) provide notice to each participant and beneficiary regarding the coverage required under this Act; and (2) ensure that coverage is provided for secondary consultations. Prohibits a group health plan from taking specified actions to avoid the requirements of this Act. Applies such requirements to health insurance issuers offering coverage in the individual market. Allows a health insurance issuer that provides individual health insurance coverage to nonrenew or discontinue an individual's coverage based on the intentional concealment of material facts regarding a health condition related to the condition for which coverage is being claimed.
