Community College Agriculture Advancement Act of 2023

Community College Agriculture Advancement Act of 2023 This bill authorizes the Department of Agriculture (USDA) to make competitive grants to assist eligible entities in maintaining and expanding their capacity to conduct workforce training, education, research, and outreach activities related to agriculture and similar disciplines. An eligible entity includes a junior or community college, or a consortium or alliance of two-year public colleges, supporting agriculture advancement. In awarding grants, USDA must give priority to entities coordinating with a local agriculture industry operator to provide experiential training and other opportunities for students. Grant funds may be used to expand and maintain the capacity of the eligible entity, including through the purchase or other acquisition of equipment and other infrastructure, the professional growth and development of faculty, and the development of apprenticeships and other work-based learning opportunities. An eligible entity may submit to USDA an application for designation and funding as a Center of Excellence for Agriculture Advancement. Funding received as a result of such a designation must be used to demonstrate agriculture best practices and to provide leadership in capacity building at a regional or national level.

AM Radio for Every Vehicle Act of 2023

AM Radio for Every Vehicle Act of 2023 This bill requires the Department of Transportation (DOT) to issue a rule that requires all new motor vehicles to have devices that can access AM broadcast stations installed as standard equipment. (AM broadcast stations are often used to deliver emergency alerts and news and entertainment programming; some newer vehicles do not include AM equipment.) Specifically, this bill applies to motor vehicles manufactured in the United States, imported into the United States, or shipped in interstate commerce after the rule's effective date. The DOT rule must require all such vehicles to have devices that can receive signals and play content transmitted by AM broadcast stations or digital audio AM broadcast stations installed as standard equipment. Prior to the effective date of the rule, manufacturers that do not include devices that can access AM broadcast stations as standard equipment must inform purchasers of this fact through clear and conspicuous labeling. DOT may assess civil penalties against any manufacturer that fails to comply with the mandate. The Department of Justice may also bring a civil action to enjoin a violation. Further, the Government Accountability Office must study and report on whether a reliable alternative communication system exists for delivering emergency alerts and consider the (1) cost to drivers and passengers of receiving communications through an alternative system, and (2) cost and time required to develop and implement an alternative.

Credit Access and Inclusion Act of 2023

Credit Access and Inclusion Act of 2023 This bill allows for the reporting of certain positive consumer-credit information to consumer reporting agencies. Specifically, a person or the Department of Housing and Urban Development may report information related to a consumer's performance in making payments either under a lease agreement for a dwelling or pursuant to a contract for a utility or telecommunications service. However, information about a consumer's usage of any utility or telecommunications service may be reported only to the extent that the information relates to payment by the consumer for such service or other terms of the provision of that service. Furthermore, an energy-utility firm may not report a consumer's outstanding balance as late if the firm and the consumer have entered into a payment plan and the consumer is meeting the obligations of that plan. Specified provisions that establish civil liability with respect to furnishers of information to consumer reporting agencies shall not apply to any violation of the bill. The Government Accountability Office must report on the consumer impact of such reporting.

Responsible Borrowing Act of 2023

Responsible Borrowing Act of 2023 This bill authorizes institutions of higher education (IHEs) to prorate or limit the amount of a Federal Direct Loan that an enrolled student may borrow for an academic year or in the aggregate. The bill specifies the factors that an IHE may use to limit these loans. These factors include the average or median starting salary for typical occupations pursued by graduates of the program (or the median earnings of students who complete such program), the enrollment status of the student (i.e., full- or part-time enrollment), the credential level of the program (e.g., degree or certificate), and the year of the program for which the student is seeking the loan. Upon request of a student whose loan has been prorated or limited, an IHE may increase the amount of the loan within otherwise applicable limits at the discretion of the IHE's financial aid administrator.

Fentanyl Trafficker Elimination Act

Fentanyl Trafficker Elimination Act This bill increases the term of imprisonment for drug trafficking offenses involving large quantities of fentanyl or fentanyl analogues. Specifically, the bill requires life imprisonment for illegally importing or exporting, or illegally manufacturing, distributing, dispensing, or possessing with intent to manufacture, distribute, or dispense, 400 grams or more of fentanyl or 100 grams or more of a fentanyl analogue, regardless of prior offenses or if death or serious bodily injury occurs. (Currently, such offenses carry a minimum sentence of 10 years imprisonment and a maximum sentence of life imprisonment for a first offense; penalties increase with subsequent offenses or if death or serious bodily injury occurs.)

This joint resolution nullifies the final rule submitted by the Department of Labor titled Rescission of Implementing Legal Requirements Regarding the Equal Opportunity Clause's Religious Exemption Rule . This rule, which became effective March 31, 2023, rescinded a rule that became effective January 8, 2021. The rule that became effective in 2021 expanded the religious exemption to the prohibition on federal contractors and subcontractors discriminating in employment decisions based on race, religion, sexual orientation, or other factors.

Veterans Health Care Freedom Act

Veterans Health Care Freedom Act This bill requires the Center for Innovation for Care and Payment within the Department of Veterans Affairs (VA) to implement a three-year pilot program to improve the ability of veterans who are enrolled in the VA health care system to access hospital care, medical services, and extended care services through the covered care system by providing such veterans with the ability to choose health care providers. Under the bill, the covered care system includes VA medical facilities, health care providers participating in the Veterans Community Care Program (VCCP), and eligible entities or providers that have entered into a Veterans Care Agreement. A veteran participating in the program may elect to receive care at any provider in the covered care system. The pilot program removes certain requirements (e.g., location of the veteran) to access care at VA and non-VA facilities. After four years, the bill permanently phases out the requirements for accessing care under the VCCP and Veterans Care Agreements and requires the VA to provide such care under the same conditions of the pilot program. Additionally, after four years, veterans may receive care at a VA medical facility regardless of whether the facility is in the same Veterans Integrated Service Network as the veteran.

Fight CRIME Act

Fight and Combat Rampant Iranian Missile Exports Act or the Fight CRIME Act This bill imposes sanctions pertaining to Iran's missile program. The President must impose visa- and property-blocking sanctions on foreign persons (i.e., foreign individuals, entities, and states) that are knowingly involved with Iran or Iran-aligned entities in certain missile-related activities, such as (1) acquiring, possessing, developing, transporting, transferring, or deploying missiles or related items and technology that are covered by the Missile Technology Control Regime (MTCR), or (2) developing missile or drone technologies. (The MTCR is an informal political understanding among states that seek to limit missile proliferation.) The President must also impose sanctions on (1) certain adult family members of those who are subject to the sanctions discussed above, and (2) foreign persons who knowingly provide significant support to or engage in a significant transaction with those subject to the sanctions discussed above. The bill also requires the Department of State to report to Congress on various topics, including (1) a diplomatic strategy to renew international restrictions on certain missile-related activities set forth in Annex B of U.N. Security Council Resolution 2231, which concerns restrictions on arms transfers to and from Iran; (2) the identities of foreign persons engaging in restricted activity under Annex B; and (3) an analysis of the foreign and domestic supply chains that facilitate Iran's missile or drone programs.

Promoting Free and Fair Elections Act

Promoting Free and Fair Elections Act This bill prohibits federal agencies from using funds made available for salaries and expenses to solicit or enter into agreements with nongovernmental organizations to conduct voter registration or voter mobilization activities on the agency's property or website. The bill also requires federal agencies to delay carrying out certain activities pursuant to Executive Order 14019 (which established requirements for expanding access to voter registration and election information) until various conditions are met, such as the agency submitting reports to Congress. The bill also prohibits institutions of higher education that operate federal work-study programs from registering or mobilizing voters on or off campus.

Save Our Sequoias Act

Save Our Sequoias Act This bill provides for the conservation of giant sequoia trees ( Sequoiadendron giganteum ) in California. Specifically, it provides statutory authority for the Giant Sequoia Lands Coalition and outlines the coalition's duties. The coalition must submit a Giant Sequoia Health and Resiliency Assessment and annually update it. The information from the assessment must be made available so the information can be integrated into certain other plans. The coalition must also create and maintain a website that contains the assessment, educational materials, searchable information about individual giant sequoia groves, and a searchable database to track the status and costs of reforestation and rehabilitation activities. In addition, the bill declares an emergency on certain public lands and allows officials to carry out protection plans during the emergency to respond to the threat of wildfires, insects, and drought. The emergency expires after seven years. The Department of the Interior must develop and implement a Giant Sequoia Reforestation and Rehabilitation Strategy. Finally, the bill establishes a variety of programs and funds to support the conservation of giant sequoias.

PRIME Act

Processing Revival and Intrastate Meat Exemption Act or the PRIME Act This bill exempts from federal inspection requirements animals and meats that are slaughtered and prepared at custom animal slaughter facilities for distribution within the state. Under current law, a custom slaughter exemption applies if the meat is slaughtered exclusively for personal, household, guest, or employee uses. Specifically, the bill expands the federal inspection exemption to include the slaughter of animals or the preparation of carcasses, meat, and meat food products that are slaughtered and prepared at a custom slaughter facility in accordance with the laws of the state where the facility is located; and prepared exclusively for distribution to household consumers in the state or restaurants, hotels, boarding houses, grocery stores, or other establishments in the state that either prepare meals served directly to consumers or offer meat and food products for sale directly to consumers in the state. The bill does not preempt any state law concerning (1) the slaughter of animals or the preparation of carcasses, meat, and meat food products at a custom slaughter facility; or (2) the sale of meat or meat food products.

To provide for the closure of the Consulate General of the People's Republic of China and the Hong Kong Economic and Trade Office located in New York City, and for other purposes.

Fair Access to Banking Act

Fair Access to Banking Act This bill places restrictions on certain banks, credit unions, and payment card networks if they refuse to do business with a person who complies with the law. Restrictions include prohibiting the use of electronic funds transfer systems and lending programs, termination of an institution's depository insurance, and specified civil penalties. Banks and other specified financial institutions are allowed to deny financial services to a person only if the denial is justified by a documented failure of that person to meet quantitative, impartial, risk-based standards established in advance by the institution. This justification may not be based upon reputational risks to the institution. Banks may also deny services to a person who engaged in rude or harassing conduct toward an employee of the bank. The bill establishes the right for a person to bring a civil action for a violation of this bill.

Employee Rights Act

Employee Rights Act This bill generally addresses employer obligations related to unionized workplaces. This bill provides that an employer may be considered a joint employer in relation to an employee under federal labor law only if such employer directly, actually, and immediately (and not in a limited and routine manner) exercises significant control over the essential terms and conditions of employment. Such control may by demonstrated by hiring and discharging employees, determining individual employee rates of pay and benefits, day-to-day supervision of employees, assigning individual work schedules, positions, and tasks, and administering employee discipline. The bill also requires a workplace election to approve or reject a union to be conducted by secret ballot. Further, the bill requires an employer to provide limited employee information to union representatives to facilitate a workplace election. An employer that mishandles or fails to provide such information according to the bill's requirements may be liable for an unfair labor practice (i.e., labor law violation). Additionally, the bill requires an employee to authorize in writing any use of the employee's labor organization dues or other contribution for a purpose other than collective bargaining or contract administration. Such authorization must be made upon 35 days' notice and expires after one year. Finally, the bill exempts Indian Tribes, including Indian Tribe enterprises and institutions, from the collective bargaining rights and related provisions of federal labor law.

Safe Routes Act of 2023 This bill directs the Department of Transportation to waive vehicle weight limits for covered logging vehicles. The term covered logging vehicle means a vehicle that (1) is transporting raw or unfinished forest products, including logs, pulpwood, biomass, or wood chips; (2) is traveling a distance not greater than 150 air miles from origin to a storage or processing facility; and (3) meets state legal weight tolerances and vehicle configurations for transporting raw or unfinished forest products within the state boundaries in which the vehicle is operating.

Defund China’s Allies Act

Defund China's Allies Act This bill prohibits providing U.S. foreign assistance, including humanitarian assistance and security assistance, to certain countries that do not have full diplomatic relations with Taiwan. The countries barred from foreign assistance by the bill are Honduras, Nicaragua, Dominica, Antigua and Barbuda, Grenada, Cuba, Bahamas, Barbados, Jamaica, Trinidad and Tobago, Panama, Costa Rica, Dominican Republic, El Salvador, Bolivia, Uruguay, Guyana, Suriname, Venezuela, Solomon Islands, and Kiribati. The prohibition shall be lifted the earlier of (1) 30 days after the President certifies to Congress that the country has resumed or established full diplomatic relations with Taiwan, or (2) 10 years after the date of the bill's enactment.

Campus Free Speech Restoration Act

Campus Free Speech Restoration Act This bill addresses expressive activities (e.g., peacefully assembling, distributing literature, or carrying signs) on college campuses. First, the bill generally prohibits a public institution of higher education (IHE) that participates in federal student-aid programs from restricting noncommercial expressive activities on campus. Further, the bill prohibits a public IHE from receiving federal funds if the Department of Education determines that the public IHE (1) maintains a policy that infringes upon the expressive rights of students; or (2) maintains or enforces time, place, or manner restrictions on expressive activities, except in limited circumstances. In addition, the bill prohibits retaliation against an individual because the individual reported or complained about restrictions on expressive activities or participated in an investigation or hearing. The bill also requires a private IHE that receives federal funds to provide students with its policies related to expressive rights. The bill also establishes a framework for investigating complaints and for IHEs to regain eligibility for federal funds.

OMAR Act

Oversight for Members And Relatives Act or the OMAR Act This bill prohibits the use of campaign funds to compensate the spouse of a candidate or an individual holding federal office. It also requires disclosure of payments made to spouses or immediate family members. Specifically, the bill prohibits an authorized committee of a candidate or any other political committee that is established, maintained, or controlled by a candidate or an individual holding federal office from directly or indirectly compensating the spouse of the candidate or individual for services provided to or on behalf of the committee. The prohibition does not apply to a political committee of a political party. Next, the bill requires a political committee to report on disbursements to the spouse or an immediate family member of the candidate or the individual holding federal office. Finally, the bill requires any penalty for a violation of the bill to be imposed on the candidate or the individual holding federal office if the candidate or individual involved knew of the violation. Further, it prohibits the committee involved from reimbursing the candidate or individual for the penalty.

Immigration Parole Reform Act of 202 3 This bill limits the authority of the Department of Homeland Security (DHS) to grant immigration parole (i.e., give official permission for an individual to enter and temporarily remain in the United States). Specifically, the bill (1) limits what qualifies as an urgent humanitarian reason or a significant public benefit that would justify granting parole, and (2) prohibits granting parole based on an individual's membership in a defined class of individuals. An urgent humanitarian reason is limited to specified medical emergencies and a significant public benefit is limited to assisting the U.S. government in a law enforcement matter. Individuals granted parole on the basis of an urgent humanitarian reason or a significant public benefit are not permitted to work while in the United States. Additionally, the bill provides statutory authority for DHS to grant parole to (1) certain Cuban nationals, (2) certain family members of active-duty Armed Forces members, and (3) certain removed individuals for the purpose of attending their immigration hearing.

Under the bill, natural cheese is defined as cheese (ripened or unripened soft, semi-soft, or hard) that is produced from animal milk or certain dairy ingredients and is produced in accordance with established cheese-making standards. The definition excludes pasteurized process cheeses, cheese foods, and cheese spreads. A food is deemed misbranded and may not be sold if it does not meet this definition and its label includes the term natural cheese as a factual descriptor of a category of cheese.

Kids in Classes Act

Kids in Classes Act This bill prohibits a state educational agency from receiving specified federal education funds unless funds are provided directly to a parent or guardian of an eligible child for certain qualified educational expenses (e.g., educational materials, tutoring, or private school tuition). Eligible child refers to a child who attends a public elementary or secondary school and such school (1) receives specified federal education funds; and (2) does not provide, for more than three days during a school year and for reasons related to a public health emergency or collective bargaining action, in-person instruction for all students who wish to attend.

Expressing the sense of Congress that tax-exempt fraternal benefit societies have historically provided and continue to provide critical benefits to the people and communities of the United States.

This concurrent resolution expresses the sense of Congress that tax-exempt fraternal benefit societies provide critical benefits to the people and communities of the United States and their work should continue to be promoted.

Securing Maritime Data from Communist China Act

Securing Maritime Data from Communist China Act This bill imposes restrictions on the use of LOGINK, China's state-sponsored and state-supported logistics platform. Specifically, the bill prohibits the Department of Defense from entering into or renewing contracts with entities that use (1) LOGINK, (2) any logistics platform associated with the Chinese government, or (3) any logistics platform that shares data with LOGINK or logistics platforms associated with the Chinese government. The bill requires the President to enter into negotiations with allies and partners (such as Japan, Australia, and NATO members) to prohibit entities in their jurisdictions from using any of these platforms. Additionally, the bill requires the President to prohibit entities that own or operate a port (or any other critical infrastructure designated by the President) in the United States from using or sharing data with LOGINK or logistics platforms associated with the Chinese government.

SECURE Flights Act

Strengthening Enforcement and Criminalizing Unlawful Records Enabling Flights Act or the SECURE Flights Act This bill prohibits the use of certain warrants and other documents issued by U.S. Immigration and Customs Enforcement (ICE), the Department of Homeland Security (DHS), and U.S. Customs and Border Protection (CBP) as proof of identification at airport security checkpoints. If an individual uses a prohibited document as proof of identification, the Transportation Security Administration (TSA) must inform ICE, CBP, and local law enforcement to determine whether the individual is in violation of any term of release from custody of the agency. An individual who is in violation may not be permitted to enter a sterile area (e.g., the boarding area) unless the individual (1) is being removed or deported from the United States, or (2) presents a covered valid and unexpired identification document. Examples of covered identification documents include a U.S. passport, a biometrically secure card issued by a DHS trusted or registered traveler program, a state-issued enhanced driver's license, and an employment authorization document issued by U.S. Citizenship and Immigration Services. Further, prior to authorizing entry into a sterile area, the TSA must collect biometric information from an individual who (1) does not present a covered identification document, and (2) the TSA cannot verify is a U.S. national. The TSA must submit the information to the national Automated Biometric Identification System (IDENT).

End Zuckerbucks Act

ATF Transparency Act

ATF Transparency Act This bill modifies procedural requirements related to the transfer or making of firearms that are subject to regulation under the National Firearms Act (e.g., machine guns, short-barreled shotguns, and silencers). The bill permits the transfer of a firearm if 90 days have elapsed since the application to transfer the firearm was filed, and the application has not been denied. Additionally, the bill establishes an administrative relief process with respect to an application to transfer that is denied. The bill permits the making of a firearm if 90 days have elapsed since the application to make the firearm was filed, and the application has not been denied. Finally, the bill requires reports on firearms-related background check inquiries that remain unresolved after 90 days and the percentage of firearms-related background check inquiries related to the transfer of a firearm that were administered by the Federal Bureau of Investigation.

Save Our Gas Stoves Act

Save Our Gas Stoves Act This bill places limits on energy conservation standards for kitchen ranges or ovens under the Energy Policy and Conservation Act. The Department of the Energy (DOE) may not prescribe or amend energy conservation standards for kitchen ranges or ovens if they would result in the unavailability of a product on account of the type of fuel the range or oven uses. In addition, DOE may not finalize, implement, or enforce the proposed rule titled Energy Conservation Program: Energy Conservation Standards for Consumer Conventional Cooking Products issued on February 1, 2023, or any substantially similar rule. The proposed rule prescribes energy conservation standards for consumer conventional cooking tops, including electric cooking tops, gas cooking tops, electrical ovens, and gas ovens.
