Energy Innovation and Carbon Dividend Act of 2018

Energy Innovation and Carbon Dividend Act of 2018 This bill amends the Internal Revenue Code to impose a fee on the carbon content of fuels, including crude oil, natural gas, coal, or any other product derived from those fuels that will be used so as to emit greenhouse gases into the atmosphere. The fee is imposed on the producers or importers of the fuels and is equal to the greenhouse gas content of the fuel multiplied by the carbon fee rate. The rate begins at $15 in 2019, increases by $10 each year, and is subject to further adjustments based on the progress in meeting specified emissions reduction targets. The bill also imposes a specified fee on fluorinated greenhouse gases. The bill includes: exemptions for fuels used for agricultural or nonemitting purposes, rebates for facilities that capture and sequester carbon dioxide, and border adjustment provisions that require certain fees or refunds for carbon-intensive products that are exported or imported. The fees must be deposited into a Carbon Dividend Trust Fund and used for administrative expenses and dividend payments to U.S. citizens or lawful residents. The fees must be decommissioned when emissions levels and monthly dividend payments fall below specified levels. The bill also amends the Clean Air Act to suspend certain regulations that limit greenhouse gas emissions. The suspensions expire if the emissions targets established by this bill are not reached after a specified time period.

Strategy To Oppose Predatory Organ Trafficking Act or the STOP Organ Trafficking Act This bill states that it shall be U.S. policy to combat trafficking in human organs and promote the establishment of voluntary organ donation systems. The bill authorizes the Department of State to refuse to issue a passport to, or revoke a previously issued passport from, a person convicted of trafficking in human organs who used a passport or otherwise crossed an international border in committing such offense. The Trafficking Victims Protection Act of 2000 is amended to: (1) include trafficking of persons for the removal of their organs in the definition of severe forms of trafficking in persons, and (2) direct the Interagency Task Force to Monitor and Combat Trafficking to collect and organize data from human rights officers at U.S. embassies on host country laws against trafficking in human organs.

Family Reunification Act This bill directs the Department of Homeland Security (DHS) to ensure that each unaccompanied alien child removed by a federal official or employee from the custody of a parent or legal guardian at or near a port of entry or within 100 miles of the border be reunited with the parent or legal guardian at the earliest possible date unless: a state court terminates the rights of a parent or legal guardian, determines that it is in the child's best interests to be removed from the parent or legal guardian, or makes any similar determination that is authorized under state law; a state or county child welfare official determines that it is in the child's best interests to be removed from his or her parent or legal guardian because the child is in danger of abuse or neglect from the parent or legal guardian; or DHS requires continued separation because the child is a trafficking victim or is at significant risk of becoming a trafficking victim, there is a strong likelihood that the adult is not the child's parent or legal guardian, or the child is in danger of abuse or neglect from the parent or legal guardian.

Protecting Rational Incentives in Newsprint Trade Act of 2018 or the PRINT Act This bill directs the Department of Commerce to conduct a study of, and to report to Congress regarding, the economic well-being, health, and vitality of the newsprint industry and the local newspaper publishing industry in the United States, including an assessment of: the trends in demand for newsprint and traditional printed newspapers, in demand for digital or online consumption of news, and in the U.S. pulp and paper industry and the effect of declining demand for newsprint on the health of such industry; measures undertaken by printers and newspaper publishers to reduce costs in response to increased costs for newsprint in the United States, and whether such measures have harmed local news coverage or reduced employment in the newspaper and publishing industries; whether measures undertaken by publishers and printers to reduce costs have harmed local businesses that advertise in local newspapers; and the global production capacity for newsprint in light of the declining demand for newsprint. Commerce and the U.S. International Trade Commission may not give effect to an affirmative determination in an antidumping or countervailing duty investigation relating to imports of uncoated groundwood paper until the President certifies that he has received the report and has concluded that giving effect to the determination is in the economic interest of the United States. Until such time as the President issues the certification, the administering authority shall order a rate of zero for deposits posted in such an investigation.

Advancing Innovation and Reinvigorating Widespread Access to Viable Electromagnetic Spectrum Act or the AIRWAVES Act This bill requires the Federal Communications Commission (FCC) to complete auctions by December 31, 2020, that will grant priority access broadcast licenses for specified frequency spectrum bands. The FCC and the National Telecommunications and Information Administration are directed to identify frequencies in specified spectrum bands that may be utilized for non-federal unlicensed use and commercial licensed use. The FCC must allocate 10% of proceeds from each of the spectrum band auctions specified in the bill to expand wireless infrastructure in rural areas that are underserved or unserved. The FCC shall conduct a study on how unlicensed frequency spectrum bands can be utilized for: (1) the provision of healthcare in rural areas, (2) distance learning, and (3) facilitating innovations in agriculture.

Uniting and Securing America Act of 2018 or the USA Act of 2018 This bill provides conditional permanent resident status for an alien meeting specified requirements, including having entered the United States when younger than 18 years old and residing in the United States since December 31, 2013. An individual may apply to have such conditional basis removed after meeting specified eligibility requirements. The Department of Homeland Security (DHS) shall cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent residence on a conditional basis, an individual who was granted Deferred Action for Childhood Arrivals (DACA) status, unless such individual has engaged in disqualifying conduct. The bill repeals provisions that deny an unlawful alien eligibility for higher education benefits on the basis of residence within a state unless a U.S. citizen or national is eligible for such benefits without regard to whether such citizen or national is such a resident. DHS shall: (1) deploy the most practical and effective technology available in order to achieve situational awareness and operational control along the U.S. border; (2) submit to Congress a comprehensive southern border strategy to achieve border control; and (3) begin eradicating the carrizo cane plant and salt cedar along the Rio Grande River. DHS may construct new ports of entry along the northern and southern borders. The bill establishes Operation Stonegarden in DHS to provide border security grants to law enforcement agencies in border or maritime border states that are involved in U.S. Customs and Border Protection operations DHS shall establish a two-year grant program to improve emergency communications in the southern border region for individuals who are at risk of violence and lack cellular and LTE network service. The number of immigration judges is increased. The President shall designate a senior official to coordinate federal and international efforts to strengthen citizen security, the rule of law, and economic prosperity in Central America.

Receiving Electronic Statements To Improve Retiree Earnings Act This bill amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Internal Revenue Code to authorize the electronic delivery of pension plan documents required to be furnished to a plan participant, beneficiary, or other individual. The system for furnishing such a document must: (1) be designed to result in effective access to the document, (2) permit the recipient to select the electronic means through which the document is received or request paper documents, and (3) protect the confidentiality of personal information. An annual paper notice must be provided describing: the selection of electronic means for furnishing documents, the right to modify the selection or to elect to receive paper versions of the documents at no additional direct cost and how to make the election, and any election that has been made to receive paper documents. An electronically furnished document must be prepared and furnished in a manner that is consistent with the style, format, and content requirements for the document. It must also include a notice that apprises the individual of the significance of the document when it is not otherwise reasonably evident as transmitted.

Requires each new Member, Delegate, Resident Commissioner, officer, and employee to certify completion of such program within 60 days after beginning service. Considers failure to meet such requirement a violation of Rule XXIII. Expresses the sense of the House that the Office of Compliance should: update, as specified, its program of sexual harassment prevention and response training in employment; and consult with the Workplaces Respond to Domestic and Sexual Violence: A National Resource Center in updating and implementing such program.

Closing the Bump-Stock Loophole Act This bill amends the Internal Revenue Code to allow the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to regulate a reciprocating stock, or any other device which is designed to accelerate substantially the rate of fire of a semiautomatic weapon (i.e., bump stocks) in the same manner as a machine gun. Any person possessing such a device when this bill is enacted must register the device with the ATF within one year of the enactment of this bill, and the registration must be included in the National Firearms Registration and Transfer Record. The bill defines a "semiautomatic weapon" as any repeating weapon that: (1) utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round, and (2) requires a separate function of the trigger to fire each cartridge.

Dialysis Patient Access to Integrated-care, Empowerment, Nephrologists, Treatment, and Services Demonstration Act of 2017 or the Dialysis PATIENTS Demonstration Act of 2017 This bill establishes a demonstration program for the provision of integrated care to Medicare beneficiaries with end-stage renal disease (ESRD). Under the voluntary program, eligible participating providers may form organizations to offer ESRD integrated care models and serve as medical homes for program-eligible beneficiaries. Such a model: (1) shall cover medical and hospital services, other than hospice care, under Medicare; (2) must include benefits for transition into transplantation, palliative care, or hospice; and (3) may cover prescription drug benefits. An organization must offer at least one open network model but may also offer one or more preferred network models. An organization shall return savings achieved under the models to program-eligible beneficiaries. A beneficiary shall have the opportunity to: (1) opt out of the program, (2) make an assignment change into an open network model offered by a different organization, or (3) elect a preferred network model. The bill establishes requirements regarding: (1) benefits for program-eligible beneficiaries who are also eligible for Medicaid benefits, (2) program quality and reporting, (2) ESRD integrated care strategy, (3) program operation and scope, (4) beneficiary notification, and (5) payment. The Medicare Payment Advisory Commission must, before 2025, submit to Congress an interim report on the program.

"Pyramid promotional scheme" means any plan or operation in which individuals pay consideration for the right to receive compensation that is based upon recruiting other individuals into the plan or operation rather than primarily related to the sale of products or services to ultimate users. Furthermore, any person who establishes, operates, or promotes any plan or operation which sells or solicits the sale of consumer products or services in the home or otherwise outside of a permanent retail establishment, and which sells products or services to independent salespeople, shall have a bona fide inventory repurchase agreement. A violation of the bill shall be treated under the Act as an unfair or deceptive act or practice in, or affecting, commerce.

Financial Stability Oversight Council Insurance Member Continuity Act This bill amends the Financial Stability Act of 2010 to modify the term of the independent member with insurance expertise of the Financial Stability Oversight Council to allow the current member to continue to serve in the event of a delay in the naming of a successor by the end of the member's six-year term. In such a case, the independent member may continue to serve until 18 months after the end of the term or until a successor is confirmed, whichever is earlier.

Securing Experienced Returning Veterans Employment Act of 2017 or the SERVE Act This bill directs that in order to improve the accuracy and completeness of a certification or verification of job skills and experience acquired while on active duty, the Department of Defense (DOD) (and the Department of Homeland Security with respect to the Coast Guard when it is not operating as a service in the Navy) shall: (1) establish a database to record all training performed by members of the armed forces that may have application to civilian sector employment, (2) make such information that is unclassified available to states and other employers so that they may allow military training to satisfy licensing or certification requirements for civilian professions, and (3) ensure that certifications and verifications of job skills and experience can be confirmed by states and other employers. A state may use a certification or verification provided to a member of the armed forces and request DOD or the Coast Guard to confirm its accuracy and authenticity. Such information shall be confirmed or denied within five business days. A certification or verification provided to a member of the armed forces and accepted by a state to satisfy licensing or certification requirements shall be valid in all states once used in the accepting states. Pre-separation counseling concerning licensing and certification requirements shall include state-submitted and approved lists of military training and skills that satisfy occupational certifications and licenses.

BRAVE Act

Bolstering Returning American Veterans Education Act or the BRAVE Act This bill directs the Department of Veterans Affairs (VA) to provide a standard training curriculum for school certifying officials regarding administrative responsibilities relating to VA educational assistance programs. Such curriculum shall be provided through an Internet website or taught at a VA-sponsored conference. The VA shall require as a condition of course approval that the school certifying official of the educational institution offering the course must: (1) complete the training curriculum within 30 days of after first being designated as a school certifying official, and (2) receive a minimum 75% score on a test of the official's knowledge of the covered subjects. A school certifying official is an educational institution official designated to: (1) sign or report enrollment certifications, or (2) sign the school portion of the application and enrollment certification for individualized tutorial assistance.

Veterans' Entry to Apprenticeship Act

Veterans' Entry to Apprenticeship Act This bill requires the Department of Veterans Affairs to treat a pre-apprenticeship program as a program of apprenticeship, for purposes of providing educational assistance: (1) if such pre-apprenticeship program is recognized under or compliant with relevant state standards for a postsecondary pre-apprenticeship program, or (2) in the case of a program for which a state does not require any such standards, if the curriculum of the pre-apprenticeship program is approved by a sponsor who certifies that the program will prepare an individual with skills and competencies needed to enroll in a registered apprenticeship program and the pre-apprenticeship program maintains conduct and attendance policies in accordance with such sponsor. A covered individual enrolled in a pre-apprenticeship program must receive the same amount and kind of educational assistance the individual would receive if the individual were enrolled in a program of apprenticeship, with an exception of specified housing assistance if the individual is not paid as part of such pre-apprenticeship program.

The President may not issue a separate designation of Pakistan as a major non-NATO ally until the President certifies that Pakistan: is continuing to conduct military operations that are contributing to significantly disrupting the safe haven and freedom of movement of the Haqqani Network, has taken steps to demonstrate its commitment in preventing the Haqqani Network from using any Pakistani territory as a safe haven, is actively coordinating with Afghanistan to restrict the movement of militants along the Afghanistan-Pakistan border, and has shown progress in the arrest and prosecution of Haqqani Network senior leaders and mid-level operatives.

No Regulation Without Representation Act of 201 7 This bill prohibits a state from taxing or regulating a person's activity in interstate commerce unless the person is physically present in the state during the period in which the tax or regulation is imposed. A person is physically present if the person's business activities in the state include: maintaining a commercial or legal domicile in the state; owning, holding, leasing, or maintaining certain property in the state; having one or more employees, agents, or independent contractors in the state who provide on-site design, installation, or repair services on behalf of the remote seller; having one or more employees, exclusive agents or exclusive independent contractors present in the state who engage in activities that substantially assist the person to establish or maintain a market in the state; or regularly employing three or more employees in the state. The bill specifies certain activities and agreements that indicate a de minimis physical presence that is excluded from the definition of "physical presence." The bill also specifies that U.S. district courts have original jurisdiction over civil actions to enforce this bill.

Gigabit Opportunity Act

Gigabit Opportunity Act This bill amends the Internal Revenue Code to authorize the designation of qualified gigabit opportunity zones in low-income communities and to provide tax incentives for investments in the zones. Governors may submit nominations for a limited number of qualified gigabit opportunity zones in low-income communities to the Department of the Treasury for certification and designation. Governors must give particular consideration to areas that: are facing obstacles to economic development due to a lack of geographic broadband coverage or speed; are the focus of mutually reinforcing state, local, or private economic development initiatives; are poised for economic growth that requires access to high speed broadband for commercial purposes; and represent the areas of a state where such service would result in the highest return on investment. For eligible taxpayers that sell certain broadband services, the bill allows: (1) deferrals, reductions, or exemptions from taxes on capital gains invested in certain property used to provide broadband services in a zone (depending on how long the property is held), and (2) immediate expensing of the costs of the property. The bill also allows tax-exempt private activity bonds to be used for certain broadband projects in the zones. Within one year of enactment of this bill, the Federal Communications Commission must publish a Uniform Model Broadband Deployment Act containing laws for the state regulation of the deployment of broadband services. Qualified zones must adopt either the Act or laws comparable to the Act.
