Pancreatic Cancer Research and Education Act

Pancreatic Cancer Research and Education Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services to establish and implement a Pancreatic Cancer Initiative to assist in coordinating activities to address the high mortality rate associated with pancreatic cancer. Requires the Secretary to establish the Interdisciplinary Pancreatic Cancer Coordinating Committee to: (1) provide advice on overall research objectives and benchmarks for pancreatic cancer research; (2) develop and annually update a strategic plan for pancreatic cancer research awareness; and (3) conduct evaluations and make recommendations to the Secretary, the Director of the National Institutes of Health (NIH), and the Director of the National Cancer Institute regarding the prioritization and award of NIH research grants relating to pancreatic cancer. Requires the Secretary to develop a primary care provider education program on pancreatic cancer. Requires the Director of NIH and the Director of the Centers for Disease Control and Prevention (CDC) to develop a communication tool kit for patients and their families that focuses on specific pancreatic cancer issues relating to patient choices and patient care. Allows the Secretary to award grants to research institutions for use in developing innovative compounds or technologies for the prevention, early detection, or treatment of those cancers with five-year survival rates of less than 50%. Requires the Secretary to focus on pancreatic cancer during the initial five fiscal years of awarding such grants. Allows the Secretary to designate two additional Specialized Programs of Research Excellence focusing solely on pancreatic cancer research.

Hardrock Mining and Reclamation Act of 2009 - Applies this Act to any mining claim, millsite claim, or tunnel site claim located under the general mining laws or used for beneficiation or mineral processing activities, regardless of whether legal and beneficial title to the mineral is held by the United States. Conditions federal issuance of a patent for any such mining or millsite claim upon specified determinations by the Secretary of the Interior. Subjects production of locatable minerals to a royalty of 8% of the gross income from mining. Imposes a 4% royalty upon federal lands subject to an existing permit, and specified royalties on certain federal land added to an existing operations permit. Prescribes a hardrock mining claim maintenance fee for each unpatented mining claim, mill, or tunnel site on federally owned lands. Designates certain wilderness study areas, areas of critical environmental concern, and related areas as not open to location of mining claims. Permits a state or local government or Indian tribe to petition the Secretary of the Interior for withdrawal of specific federal land from operation of the general mining laws in order to protect specific values. Instructs the Secretary to ensure that mineral activities on federal land subject to a claim are carefully controlled to prevent undue degradation of public lands and resources. Prescribes requirements for the exploration permit process and for operations permits, including financial assurances. Requires restoration of lands to a condition capable of supporting prior uses or other beneficial uses. Establishes the Locatable Minerals Fund composed of: (1) penalties, fees, and royalties; (2) the Hardrock Reclamation Account, and (3) the Hardrock Community Impact Assistance Account. Amends the National Materials and Minerals Policy, Research and Development Act of 1980 to direct the Secretary of Agriculture to initiate prompt actions to improve the availability and analysis of mineral data in public land use decision-making with respect to National Forest System lands. Amends the Energy Policy Act of 1992 to subject certain oil shale claims to the reclamation requirements of this Act. Repeals the Building Stone Act and the Saline Placer Act.

Home Front to Heroes Postal Benefits Act - Directs the Secretary of Defense to provide for a program under which postal benefit vouchers are provided during FY2010 for members of the Armed Forces who are serving in overseas operations or who are hospitalized due to a disease or injury incurred as a result of such service. Permits the vouchers to be transferred to another person to allow that person to mail correspondence and small parcels to the member. Limits vouchers to one per month. Allows a voucher earned during FY2010 to be used after the end of that fiscal year. Directs the Secretary to transfer to the Postal Service an amount representing the amount of the vouchers used.

Requires coverage for assisted reproductive technology only if certain conditions are met. Prohibits a group health plan from taking specified actions to avoid the requirements of this Act. Applies such requirements to health insurance coverage offered in the individual market and coverage offered through Federal Employees Health Benefit (FEHB) plans.

Stop Trading on Congressional Knowledge Act - Amends the Securities Exchange Act of 1934 and the Commodities Exchange Act to direct both the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) to prohibit purchase or sale of either securities or commodities for future delivery by a person in possession of material nonpublic information regarding pending or prospective legislative action if the information was obtained: (1) knowingly from a Member or employee of Congress; (2) by reason of being a Member or employee of Congress; and (3) other federal employees. Amends the Code of Official Conduct of the Rules of the House of Representatives to prohibit designated House personnel from disclosing material nonpublic information relating to any pending or prospective legislative action relating to either securities of a publicly-traded company or a commodity if such personnel has reason to believe that the information will be used to buy or sell the securities or commodity based on such information. Amends the Ethics in Government Act of 1978 to require formal disclosure of certain securities and commodities futures transactions to either the Clerk of the House of Representatives or the Secretary of the Senate. Amends the Lobbying Disclosure Act of 1995 to subject to its registration, reporting, and disclosure requirements, as well as requirements for identification of clients and covered legislative and executive officials, all political intelligence activities, contacts, firms, and consultants. Requires the Comptroller General to include political intelligence activities, contacts, firms, and consultants in its annual compliance audits and reports.

Credit CARD Act of 2009

Credit Cardholders' Bill of Rights Act of 2009 - Amends the Truth in Lending Act to prohibit a creditor from increasing any annual percentage rate of interest (APR) applicable to the existing balance on an open end consumer credit card account unless specified conditions are met. Allows a creditor to increase an APR on the existing credit card balance only if the increase is due solely to one of three specified circumstances. Requires a 45-day advance notice of credit card account rate increases. Prohibits imposition of a finance charge, with certain exceptions, upon a credit card account balance that is based on balances for days in billing cycles preceding the most recent billing cycle (double cycle billing). Prohibits the imposition of a fee on an outstanding credit card balance, at the end of a billing period, that is attributable only to interest accrued during the preceding billing period on an outstanding balance fully repaid during that preceding billing period. Requires each periodic statement of account to provide the telephone number, Internet address, and website at which the payoff balance may be requested. Grants a consumer the right to reject a new credit card before the creditor notifies a consumer reporting agency of its corresponding account. Sets forth special rules for accounts with promotional rate balances or deferred interest balances. Prohibits a creditor from denying a cardholder a specified payment grace period if the cardholder takes advantage of a promotional rate balance or deferred interest rate balance. Requires creditors to send a periodic credit card statement of account to the consumer at least 25 calendar days before the due date for the next payment on the outstanding balance. Authorizes a consumer to opt-out of creditor authorization of over-the-limit transactions if fees are imposed. Prohibits imposition of any over-the-limit fee if the credit limit was exceeded due to a credit hold, unless the actual amount of the transaction for which the hold was placed would have resulted in the consumer's exceeding such credit limit. Prescribes the contents of credit card price and availability information which the Board of Governors of the Federal Reserve System (Board) must collect and make public semiannually. Prescribes a standard for the initial issuance of subprime or "fee harvester" cards (accounts requiring first-year fee payments in excess of 25% of the total amount of credit authorized). Prohibits extensions of credit to consumers under age 18, unless they are emancipated under state law.

Emergency Contraception Education Act of 2009 - Directs the Secretary of Health and Human Services to develop and disseminate information on emergency contraception to the public and to health care providers. Compassionate Assistance for Rape Emergencies Act of 2009 - Requires hospitals, as a condition of receiving federal funds, to offer and to provide, upon request, emergency contraception to victims of sexual assault. At-Risk Communities Teenage Pregnancy Prevention Act of 2009 - Authorizes the Secretary to award grants for teenage pregnancy prevention programs. Requires the Secretary to award grants for teenage pregnancy prevention research. Truth in Contraception Act of 2009 - Requires that any information concerning the use of a contraceptive provided through specified federally funded education programs be medically accurate and include health benefits and failure rates. Unintended Pregnancy Reduction Act of 2009 - Amends title XIX (Medicaid) of the Social Security Act to expand Medicaid's coverage of family planning services. Responsible Education About Life Act of 2009 - Authorizes the Secretary to make grants to states to conduct sex education programs, including programs that provide education on abstinence and contraception for the prevention of teenage pregnancy and sexually transmitted diseases.

Children's Health Insurance Program Reauthorization Act of 2009

Children's Health Insurance Program Reauthorization Act of 2009 - Amends title XXI (State Children's Health Insurance Program) (SCHIP) of the Social Security Act (SSA) to reauthorize the program (referred to in this Act as CHIP) through FY2013 at increased levels. Revises requirements for: (1) CHIP allotments; (2) optional coverage of low-income pregnant women; (3) outreach and enrollment activities; (4) verification of U.S. citizenship or nationality for CHIP and Medicaid (SSA title XIX); (5) state option for providing premium assistance, including coordination with private coverage; (6) child health quality improvement activities; (7) access to dental and mental health benefits; and (8) program integrity and data collection, including the payment error rate measurement (PERM). Establishes in the Treasury the Child Enrollment Contingency Fund. Requires phase-out of CHIP coverage for nonpregnant childless adults. Limits the matching rate for states that propose to cover children with effective family income that exceeds 300% of the poverty line. Denies federal funding for illegal aliens. Prohibits initiation of new health opportunity account demonstration programs. Establishes a task force to conduct a nationwide campaign of education and outreach for small business concerns regarding the availability of coverage for children through private insurance options, the Medicaid program, and CHIP. Expresses the sense of the Senate affirming its intent to enact legislation this year that improves access to affordable and meaningful health insurance coverage for employees of small businesses and individuals. Prohibits any increase in physician ownership or investment in hospitals or any expansion of the physical capacity of such hospitals. Prescribes requirements for hospitals to qualify for the rural provider and hospital exception to such prohibition. Amends the Internal Revenue Code to increase the excise tax on tobacco products but allow a specified credit against tobacco floor stocks taxes. Directs the Secretary of the Treasury to study and make recommendations to Congress about the magnitude of tobacco smuggling in the United States. Amends the Tax Increase Prevention and Reconciliation Act of 2005 to increase the amount of any required installment of corporate estimated tax which is otherwise due in July, August, or September 2013.

Reestablishes the National Oceanic and Atmospheric Administration (NOAA) and its leadership. (NOAA was created by the Reorganization Plan No. 4 of 1970.) Includes in NOAA the National Weather Service and the Science Advisory Board. Establishes a National Ocean Advisor in the Executive Office of the President. Reestablishes in the Executive Office of the President the Committee on Ocean Policy, which was originally established by executive order. Establishes a Council of Advisors on Ocean Policy to advise the President. Designates nine ocean regions to promote coordinated regional efforts to implement the national ocean policy. Requires the NOAA Administrator to establish or designate a Regional Ocean Partnership for each region and requires each Partnership to prepare a Regional Ocean Strategic Plan. Establishes the Ocean and Great Lakes Conservation Trust Fund. Requires payments to coastal states for Regional Ocean Strategic Plan activities. Requires the United States Postal Service (USPS) to print a special postage stamp to enable the public to help protect, maintain, and restore marine ecosystems.

Lilly Ledbetter Fair Pay Act of 2009 - Amends the Civil Rights Act of 1964 to declare that an unlawful employment practice occurs when: (1) a discriminatory compensation decision or other practice is adopted; (2) an individual becomes subject to the decision or practice; or (3) an individual is affected by application of the decision or practice, including each time wages, benefits, or other compensation is paid. Allows liability to accrue, and allows an aggrieved person to obtain relief, including recovery of back pay, for up to two years preceding the filing of the charge, where the unlawful employment practices that have occurred during the charge filing period are similar or related to practices that occurred outside the time for filing a charge. Applies the preceding provisions to claims of compensation discrimination under the Americans with Disabilities Act of 1990 and the Rehabilitation Act of 1973. Amends the Age Discrimination in Employment Act of 1967 to declare that an unlawful practice occurs when a discriminatory compensation decision or other practice is adopted, when a person becomes subject to the decision or other practice, or when a person is affected by the decision or practice, including each time wages, benefits, or other compensation is paid.

Paycheck Fairness Act - Amends the portion of the Fair Labor Standards Act of 1938 (FLSA) known as the Equal Pay Act to revise remedies for, enforcement of, and exceptions to prohibitions against sex discrimination in the payment of wages. Revises the exception to the prohibition for a wage rate differential based on any other factor other than sex. Limits such factors to bona fide factors, such as education, training, or experience. States that the bona fide factor defense shall apply only if the employer demonstrates that such factor: (1) is not based upon or derived from a sex-based differential in compensation; (2) is job-related with respect to the position in question; and (3) is consistent with business necessity. Avers that such defense shall not apply where the employee demonstrates that: (1) an alternative employment practice exists that would serve the same business purpose without producing such differential; and (2) the employer has refused to adopt such alternative practice. Revises the prohibition against employer retaliation for employee complaints. Prohibits retaliation for inquiring about, discussing, or disclosing the wages of the employee or another employee in response to a complaint or charge, or in furtherance of a sex discrimination investigation, proceeding, hearing, or action, or an investigation conducted by the employer. Makes employers who violate sex discrimination prohibitions liable in a civil action for either compensatory or (except for the federal government) punitive damages. States that any action brought to enforce the prohibition against sex discrimination may be maintained as a class action in which individuals may be joined as party plaintiffs without their written consent. Authorizes the Secretary of Labor (Secretary) to seek additional compensatory or punitive damages in a sex discrimination action. Requires the Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs to train EEOC employees and affected individuals and entities on matters involving wage discrimination. Authorizes the Secretary to make grants to eligible entities for negotiation skills training programs for girls and women. Directs the Secretary and the Secretary of Education to issue regulations or policy guidance to integrate such training into certain programs under their Departments. Directs the Secretary to conduct studies and provide information to employers, labor organizations, and the general public regarding the means available to eliminate pay disparities between men and women. Establishes the Secretary of Labor's National Award for Pay Equity in the Workplace for an employer has made substantial effort to eliminate pay disparities between men and women. Amends the Civil Rights Act of 1964 to require the EEOC to collect from employers pay information data regarding the sex, race, and national origin of employees for use in the enforcement of federal laws prohibiting pay discrimination. Directs: (1) the Commissioner of Labor Statistics to continue to collect data on woman workers in the Current Employment Statistics survey; (2) the Office of Federal Contract Compliance Programs to use specified types of methods in investigating compensation discrimination and in enforcing pay equity; and (3) the Secretary to make accurate information on compensation discrimination readily available to the public. Directs the Secretary and the Commissioner of the EEOC jointly to develop technical assistance material to assist small businesses to comply with the requirements of this Act.

Requires the Secretary to establish the Healthy America Advisory Committee to provide annual recommendations concerning modifications to the benefits, items, and services required. Provides for premium subsidies based on income. Authorizes states to establish a State Choices for Long-Term Care Program to provide long-term care coverage to individuals. Requires the Secretary to establish Chronic Care Education Centers. Requires states to establish or designate a state Health Help Agency to carry out the administration of HAPI plans and to promote prevention and wellness for residents. Amends the Internal Revenue Code to require employers and individuals to each make shared responsibility payments for HAPI plan premiums. Sets forth requirements for health insurance issuers offering a HAPI plan. Establishes the Healthy Americans Public Health Trust Fund for the payment of premium subsidies. Terminates federal health benefits coverage, including coverage provided under the Federal Employees Health Benefits (FEHB) program, state Medicaid coverage, and the State Children's Health Insurance program (SCHIP). Enhanced Health Care Value for All Act of 2007 ( sic )- Provides for a Comparative Effectiveness Advisory Board and a Health Care Comparative Effectiveness Research Trust Fund.

Climate Market, Auction, Trust & Trade Emissions Reduction System Act of 2008, or the Climate MATTERS Act of 2008 - Declares the purpose of this Act to establish a federal program to reduce US greenhouse gas (GHG) emissions substantially enough by 2050 to avert the catastrophic impacts of global climate change. Directs the Secretary of the Treasury to establish an international reserve GHG emission allowance program, whose allowance sales proceeds shall be used to mitigate the negative impacts of global climate change on disadvantaged communities in World Trade Organization (WTO) participant countries. Establishes the International Climate Change Commission to determine annually whether a WTO participant country has taken certain action to limit its GHG emissions. Amends the Internal Revenue Code to: (1) establish a system for issuing, auctioning, recording, and tracking GHG emission allowances; and (2) impose an excess emissions penalty on owners or operators of covered facilities that fail to submit one or more emission allowances to the Secretary for any year. Establishes a Carbon Market Efficiency Board to: (1) analyze information on the GHG emission allowance market; and (2) authorize the Secretary to carry out cost relief measures if the market poses a substantial harm to the U.S. economy. Provides for the distribution of emission allowances to owners and operators of fossil fuel-fired electric power generating facilities and of energy intensive manufacturing facilities. Establishes: (1) the Deficit Reduction Trust Fund; and (2) the Citizen Protection Trust Fund (CPTF). Directs the Secretary to administer a Climate Change Rebate Program. Provides for a healthy families fund. Sets forth allocations of specified CPTF account funds for: (1) investment in natural resource adaptation to impacts of climate change and ocean acidification; (2) owners and operators of covered facilities who take actions that result in verified GHG emission reductions; (3) states that comply with certain federal building energy standards; (4) states with GHG emission reduction programs exceeding federal GHG emission reduction targets; (5) reductions in GHG emissions from the agriculture and forestry sectors, including those from deforestation activities in foreign countries; and (6) states and load-serving entities that implement energy-efficiency programs. Requires distribution of certain funds for grants for fixed guideway transit and other specified alternative transportation projects. Requires the Administrator of the Environmental Protection Agency (EPA) to: (1) develop a federal greenhouse gas registry; (2) make certain GHG emission determinations for covered facilities; and (3) promulgate regulations that require that U.S. GHG emissions in uncovered sectors do not grow.
