Improving Seniors' Timely Access to Care Act of 2019 This bill establishes several prohibitions, requirements, and standards relating to prior authorization processes under Medicare Advantage (MA) plans. Specifically, the bill prohibits MA plans from instituting additional prior authorization requirements for surgeries (including related items) that are furnished to a patient during other surgeries for which prior authorization was not required or was already received. Additionally, MA plans must (1) establish an electronic prior authorization program that meets specified standards, including the ability to provide real-time decisions in response to requests for items and services that are routinely approved; (2) annually publish specified prior authorization information, including the percentage of requests approved and the average response time; and (3) meet other standards, as set by the Centers for Medicare & Medicaid Services, relating to the quality and timeliness of prior authorization determinations.

Expanding Access to Retirement Savings for Caregivers Act This bill allows an individual to make annual catch up contributions to a retirement account before reaching age 50 if the individual leaves the workforce to provide dependent cares services. Specifically, the individual must have been unemployed, and have had no earned income, as a result of providing care to (1) a dependent under the age of 13, or (2) a spouse physically or mentally incapable of self-care.

Affordable Housing Credit Improvement Act of 2019 This bill revises provisions of the low-income housing tax credit and renames it as the affordable housing credit . The bill increases the per capita dollar amount of the credit and its minimum ceiling amount beginning in 2019 and extends the inflation adjustment for such amounts. The bill modifies tenant income eligibility requirements and the average income formula for determining such income. It also revises rules for student occupancy of rental units and tenant voucher payments and prohibits any refusal to rent to victims of domestic abuse. The bill further modifies the credit to establish a 4% minimum credit rate for certain housing projects, repeal the qualified census tract population cap, prohibit local approval and contribution requirements, increase the credit for certain projects designated to serve extremely low-income households, increase the credit for certain bond-financed projects designated by state agencies, eliminate the basis reduction for properties that receive certain energy-related tax benefits, and increase the population cap for difficult development areas (i.e., areas with high construction, land, and utility costs relative to area median gross income). The bill also includes Indian and rural areas as difficult development areas and modifies other requirements relating to casualty losses, acquisition credits, and foreclosures.

Ticks: Identify, Control, and Knockout Act or the TICK Act This bill establishes the Office of Oversight and Coordination for Vector-Borne Diseases within the Department of Health and Human Services (HHS). The office must develop a national strategy to address, and coordinate the federal response to, Lyme disease and other tick- and vector-borne diseases. The office must support research initiatives, tick- and disease-surveillance programs, and diagnostic-testing development, among other activities. HHS must also award grants to support the establishment of Regional Centers of Excellence in Tick and Vector-Borne Diseases. Additionally, the Centers for Disease Control and Prevention must form cooperative agreements with state, local, and tribal health departments to address such diseases.

Patient Access to Higher Quality Health Care Act of 2019 This bill repeals specified limitations, for purposes of Medicare participation, on self-referrals by newly constructed or expanded physician-owned hospitals.

Animal Freedom from Testing, Experiments, and Research Act of 2019 or the AFTER Act of 2019 This bill requires federal research facilities to facilitate the adoption or nonlaboratory placement of certain warm-blooded animals (e.g., dogs, cats, monkeys, guinea pigs, hamsters, and rabbits) with animal rescue organizations, animal sanctuaries, animal shelters, or individuals. In order to be adopted or placed, the animals must (1) no longer be needed for research; (2) be suitable for release; (3) not be birds, rats, or mice.

This bill requires the Department of Veterans Affairs (VA) to designate one week per year as Buddy Check Week for the purposes of organizing outreach events and educating veterans on how to conduct peer wellness checks. The VA shall ensure that the Veterans Crisis Line has a plan for handling the potential increase in calls that may occur during such week.

This resolution recognizes the efforts of the late Representative Walter B. Jones to promote military working dogs as unsung heroes on the battlefield and in helping wounded warriors recover from physical and mental injuries. It recognizes the service of, and honors the sacrifices made by, these dogs and soldier handlers from the tactical explosive detection dog program.

Vaccine Awareness Campaign to Champion Immunization Nationally and Enhance Safety Act of 2019 or the VACCINES Act of 2019 This bill requires the Centers for Disease Control and Prevention (CDC) to take a series of actions relating to vaccination rates and awareness. Specifically, the CDC must (1) develop a national surveillance system to monitor vaccination rates, and (2) conduct a national campaign to increase awareness of the importance of vaccines. Additionally, the National Vaccine Advisory Committee must assess national confidence in vaccines and update a specified 2015 report accordingly.

Homecare for Seniors Act This bill allows tax-exempt distributions from health savings accounts (HSAs) to be used for qualified home care. Qualified home care includes a contract to provide three or more of the following services in the residence of the service recipient assistance with eating, assistance with toileting, assistance with transferring, assistance with bathing, assistance with dressing, assistance with continence, and medication adherence. The Department of Health and Human Services must carry out a campaign to increase public awareness of the in-home service expenses that are eligible for tax-free distribution from HSAs.

Historic Tax Credit Growth and Opportunity Act of 2019 This bill increases the rehabilitation tax credit and modifies certain requirements for the credit. The bill increases the rate of the credit to 30% for smaller projects (rehabilitation expenditures not exceeding $3.75 million) and caps the credit for such projects at $750,000 for all taxable years. The bill also allows taxpayers to transfer all or a portion of the credits that are allowable for smaller projects. The bill expands the types of buildings eligible for rehabilitation by decreasing the rehabilitation threshold from 100% to 50% of project expenses. It also eliminates the basis adjustment requirement for the credit and modifies rules relating to the eligibility of tax-exempt use property for the credit.

Physical Therapist Workforce and Patient Access Act of 2019 This bill makes the provision of physical therapy services a profession eligible for the National Health Service Corps (NHSC) Loan Repayment Program. The NHSC Loan Repayment Program assists specified health care professionals to repay eligible student loans in exchange for providing services in areas with limited access to health care.

Tax Fairness for Tribal Youth Act of 2019 This bill treats certain payments made by Indian tribal governments to children as earned income of the child for the purposes of the kiddie tax (the tax on the unearned income of children). This has the effect of exempting the payments from the tax. The bill applies to taxable years beginning after December 31, 2017.

Employee Flexibility Act of 2019 This bill increases the hours of service required for an employee to be classified as a full-time employee for purposes of the employer mandate under the Patient Protection and Affordable Care Act to provide minimum essential health care coverage to full-time employees. The bill increases the hours of service threshold from an average of at least 30 hours of service a week to an average of at least 40 hours of service a week.

Protecting Access to Lifesaving Screenings Act of 2019 or the PALS Act This bill makes a series of changes relating to health insurance coverage of screening mammography. Specifically, the bill requires that any provision of law referring to current recommendations of the U.S. Preventive Services Task Force (USPSTF) with respect to breast cancer screening mammography be administered as if (1) the provision referred to USPSTF recommendations last issued before 2009; and (2) those recommendations applied to any screening mammography modality, including any digital modality of such a procedure. This requirement shall also apply to the Veterans Health Administration's policy on mammography screening for veterans. In addition, the bill preserves Medicare coverage for screening mammography, without a requirement for coinsurance, and expands the definition of screening mammography to include any digital modality of such a procedure. Further, the Centers for Medicare & Medicaid Services may not decrease the frequency with which screening mammography may be paid by Medicare for a woman over 39 years of age. In 2009, the USPSTF updated its guidelines to recommend against routine screening mammography for women between 40 to 49 years of age and to recommend biennial, instead of annual, screening mammography for most women between 50 to 74 years of age. In 2015, through the appropriations process, a three-year moratorium was placed on implementing the guidelines; the moratorium was subsequently renewed until January 1, 2020.

Protecting Home Oxygen and Medical Equipment Act of 2019 or the Protecting HOME Act of 2019 This bill requires the Centers for Medicare & Medicaid Services to apply specified payment adjustments for durable medical equipment under Medicare. The bill also excludes the creation of separate payment classes and monthly payment rates for oxygen items under Medicare from certain budget neutrality requirements.

Senior Citizens' Freedom to Work Act of 2019 This bill eliminates provisions that reduce Social Security benefits for certain beneficiaries who have outside income. Currently, benefits are reduced for Social Security beneficiaries who are younger than full retirement age if they earn more than $17,640 in outside income in a year.

Newborn Care Improvement Act of 2019 This bill increases from 7 to 14 the number of days that the Department of Veterans Affairs (VA) may furnish health care services, including post-delivery care, to the newborn child of a woman veteran who delivered the child in a VA facility or another facility pursuant to a VA contract for such services.

Rural Access to Hospice Act of 2019 This bill allows federally qualified health centers (FQHCs) and rural health centers (RHCs) to receive payment under Medicare for hospice services. Currently, attending physicians who work for FQHCs and RHCs may provide hospice services only outside of FQHC or RHC work hours and must bill Medicare under their own provider numbers; FQHCs and RHCs may not receive payment under Medicare for such services.

Home Health Payment Innovation Act of 2019 This bill makes a series of changes relating to payment and coverage of home health services under Medicare and Medicare Advantage (MA). Specifically, the bill allows the home-confinement requirement (also known as the homebound requirement) for home health services to be waived under Medicare and MA. Currently, as a condition of eligibility for such services, a physician must certify that an individual has difficulty leaving home without assistance (e.g., a wheelchair, special transportation, or help from another person) due to an illness or injury. The bill also alters the payment methodology under the Medicare prospective payment system for home health services, including by eliminating the requirement that such methodology include certain behavioral assumptions regarding the implementation of specified changes to units of payment and case-mix adjustment factors.

This bill requires the Department of the Treasury to collect data and report to Congress on investments held by qualified opportunity funds. Treasury must also make certain information regarding the investments publicly available. Qualified opportunity funds are investment vehicles that are organized as either a partnership or a corporation and receive tax benefits for investing in certain low-income communities that have been designated as opportunity zones.

This resolution strongly condemns the government of Cameroon's abuses in the country's Anglophone regions, including the use of violence and violations of press freedoms. It urges the government to initiate dialogues with separatist groups and civil society, follow through on initiatives developed to address various grievances, and comply with international human rights standards. The resolution also urges separatist groups to immediately stop committing human rights abuses and end their incitement of violence and hate speech.

Beneficiary Enrollment Notification and Eligibility Simplification Act of 2019 or the BENES Act of 2019 This bill makes a series of changes to, and requires additional notifications regarding, the Medicare enrollment process. Specifically, the bill changes the Medicare general enrollment period to October 15-December 31, and requires coverage to begin on the first day of the month following enrollment. (Currently, the general enrollment period is January 1-March 31, and coverage begins July 1.) The bill also generally requires coverage to begin on the first day of the month following enrollment for individuals who enroll in the latter months of their initial enrollment period. (Currently, the longer an individual waits to enroll, the more delayed the effective date of coverage.) The bill also requires Social Security account statements for individuals ages 60 to 64 to include information about Medicare eligibility, late enrollment penalties, coordination of benefits, and special enrollment populations (e.g., veterans).

Wounded Warrior Workforce Enhancement Act This bill requires the Department of Veterans Affairs (VA) to award grants to eligible institutions to (1) establish a master's degree program in orthotics and prosthetics, or (2) expand upon an existing master's degree program in such area. The VA shall give grant priority to institutions that have entered into a partnership with a medical center administered by the VA or a facility administered by the Department of Defense. An eligible institution is an educational institution that is either accredited by the National Commission on Orthotic and Prosthetic Education or that demonstrates an ability to meet such accreditation requirements if it receives a grant. The bill also requires the VA to award a grant to an institution with orthotic and prosthetic research and education experience to (1) establish the Center of Excellence in Orthotic and Prosthetic Education; and (2) improve orthotic and prosthetic outcomes for veterans, members of the Armed Forces, and civilians by conducting orthotic and prosthetic research.

Patient Access to Cellular Transplant Act or the PACT Act This bill specifies that payment under Medicare to a hospital for the acquisition costs of an allogeneic hematopoietic stem cell transplant (e.g., bone marrow transplant from a donor) must be made on a reasonable cost basis (similar to the current payment methodology for solid organ acquisitions). The Centers for Medicare & Medicaid Services must determine included items through regulations.

Tribal Tax and Investment Reform Act of 2019 This bill treats Indian tribal governments as states for purposes of the annual allocation of the tax-exempt bond volume cap. It also repeals provisions that limit an Indian tribal government's eligibility to issue tax-exempt bonds or to be exempt from specified excise taxes to transactions involving the exercise of an essential government function customarily performed by state and local governments. The bill (1) treats employee benefit or pension plans maintained by Indian tribes and domestic relations orders issued pursuant to tribal law in the same manner as plans maintained by states and domestic relations orders issued pursuant to state law; and (2) treats tribal charities and foundations in the same manner as charities and foundations funded and controlled by other governmental entities for purposes of the tax-exempt status of, and deduction for contributions to, such organizations. The bill gives Indian tribes or tribal organizations access to the Federal Parent Locator Service if they are eligible for a grant to operate a child support enforcement program. It makes those tribes and tribal organizations eligible to participate in the program that collects past-due support from individual tax refunds. An Indian tribal government may determine whether a child has special needs for the purpose of the tax credit for the adoption of a child with special needs.

Gold Star Family Tax Relief Act This bill treats certain military survivor benefits that are received by children as earned income of the child for the purposes of the kiddie tax (the tax on the unearned income of children). This has the effect of exempting the benefits from such tax.

Modernizing Agricultural Transportation Act This bill directs the Department of Transportation to establish a working group to (1) identify obstacles to safe, humane, and market-efficient transport of livestock, insects, and agricultural commodities; and (2) develop guidelines and recommended regulatory or legislative actions to improve the safe, humane, and efficient transport of livestock, insects, and agricultural commodities.

Women's Suffrage Centennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 400,000 $1 silver coins that are emblematic of the women who played a vital role in rallying support for the 19th Amendment to the U.S. Constitution. Such coins may be issued during the period beginning on January 1, 2020, and ending on December 31, 2020. All surcharges received from the sales of such coins shall be paid to the American Women's History Initiative of the Smithsonian Institution.

Prenatal Nondiscrimination Act of 2019 or the PRENDA Act of 2019 This bill creates new federal crimes related to the performance of sex-selection abortions (i.e., abortions based on the sex or gender of an unborn child). It subjects a violator to criminal penalties—a fine, a prison term of up to five years, or both. It also authorizes civil remedies, including damages and injunctive relief. A woman who undergoes a sex-selection abortion may not be prosecuted or held civilly liable.

This bill requires the Department of Veterans Affairs to ensure that, if it creates a presumption of service-connection between the occurrence of a disease and exposure to an herbicide agent while serving in the Armed Forces during the Vietnam era at a military base in Thailand, such presumption must also apply to exposure at any military base in Thailand, regardless of where on the base the veteran was located or what military job specialty the veteran performed.

Keeping Our Promises Act This bill expands the list of diseases that are provided a presumption of service-connection for veterans who served in the Republic of Vietnam between January 9, 1962, and May 7, 1975. The bill extends through September 30, 2030, the requirement for the Department of Veterans Affairs (VA) to make determinations and submissions related to the connection between herbicide exposure and occurrence of disease. Additionally, the VA is prohibited from taking the costs of compensation into account when determining the association between exposure to an herbicide agent and occurrence of a disease. The bill requires the VA to determine within 120 days (currently 60) whether a presumption of service-connection is warranted for diseases covered by a National Academy of Sciences report.

Helping Ensure Life- and Limb-Saving Access to Podiatric Physicians Act or the HELLPP Act This bill adds podiatrists as covered physicians under the Medicaid program. Additionally, the bill revises certain documentation requirements related to Medicare coverage of therapeutic shoes for individuals with diabetes. Finally, the bill subjects payments made to a Medicaid provider or supplier to a continuing levy for federal taxes owed by the provider or supplier.

Stop for School Buses Act of 2019 This bill addresses safety measures and programs to prevent the illegal passing of school buses. Specifically, the Department of Transportation must conduct a review of existing state laws and programs regarding the illegal passing of school buses; create a nationwide public safety campaign to highlight the importance of illegally passing school buses; review and evaluate the effectiveness of various technologies to enhance school bus safety; review driver education materials in states to determine how the illegal passing of school buses is addressed; and research the connections between the illegal passing of school buses and other safety issues, including distracted driving.

Promotion and Expansion of Private Employee Ownership Act of 201 9 This bill expands tax incentives and federal assistance for employee stock ownership plans (ESOPs) that are sponsored by S corporations. The bill provides additional tax incentives for ESOPs by (1) extending to all domestic corporations, including S corporations, provisions allowing deferral of tax on gain from the sale of employer securities to an ESOP; and (2) allowing a tax deduction for 50% of the interest received by a bank on loans to S corporation-sponsored ESOPs for the purchase of employer securities. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The bill defines an "ESOP business concern" and allows such a concern to continue to qualify as a small business for the purposes of programs under the Small Business Act. An "ESOP business concern" is a business concern that was a small business concern eligible for a loan, preference, or other program under the Small Business Act before more than 49% of the business concern was acquired by an ESOP.

Invest in America Act This bill repeals several tax provisions that were included in the Foreign Investment in Real Property Tax Act of 1980. The bill repeals provisions that imposed (1) capital gains taxes on dispositions of investments in U.S. real property by foreign citizens, and (2) related tax withholding and reporting requirements.

Keeping Girls in School Act This bill authorizes the U.S. Agency for International Development (USAID) to enter into acquisition, assistance, or financing agreements to address societal, cultural, health, and other barriers that adolescent girls face in accessing quality secondary education. The USAID shall seek to ensure that such activities meet various requirements related to monitoring and evaluating outcomes, collecting data, and adhering to gender-equality promotion policies. The Department of State shall periodically update and report to Congress a publicly available U.S. global strategy to empower adolescent girls. The U.S. Global Strategy to Empower Adolescent Girls, issued in March 2016, may serve as the initial version of the strategy. The USAID shall periodically report to Congress on the activities initiated under this bill and efforts to monitor and evaluate such activities.

Home Health Care Planning Improvement Act of 2019 This bill allows Medicare payment for home health services ordered by a nurse practitioner, a clinical nurse specialist, a certified nurse-midwife, or a physician assistant. Currently, coverage is provided only for services ordered by a physician.
