Promotion and Expansion of Private Employee Ownership Act of 201 9 This bill expands tax incentives and federal assistance for employee stock ownership plans (ESOPs) that are sponsored by S corporations. The bill provides additional tax incentives for ESOPs by (1) extending to all domestic corporations, including S corporations, provisions allowing deferral of tax on gain from the sale of employer securities to an ESOP; and (2) allowing a tax deduction for 50% of the interest received by a bank on loans to S corporation-sponsored ESOPs for the purchase of employer securities. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The bill defines an "ESOP business concern" and allows such a concern to continue to qualify as a small business for the purposes of programs under the Small Business Act. An "ESOP business concern" is a business concern that was a small business concern eligible for a loan, preference, or other program under the Small Business Act before more than 49% of the business concern was acquired by an ESOP.

Revitalizing Underdeveloped Rural Areas and Lands Act of 2019 or the RURAL Act of 2019 This bill modifies the definition of income used to determine the tax-exempt status of a mutual or cooperative telephone or electric company to exclude certain government grants, contributions, and assistance. Specifically, the bill excludes from income (1) grants, contributions, and assistance provided under the Robert T. Stafford Disaster Relief and Emergency Assistance Act or by local, state, or regional governmental entities for disasters or emergencies; and (2) certain grants or contributions provided by a government entity for electric, communications, broadband, internet, or other utility facilities or services.

Veterans' Education, Transition, and Opportunity Prioritization Plan Act of 2019 or the VET OPP Act This bill establishes the Veterans Economic Opportunity and Transition Administration to administer economic opportunity assistance programs for veterans and their dependents and survivors. Specifically, the Veterans Economic Opportunity and Transition Administration must administer the following Department of Veterans Affairs programs: vocational rehabilitation and employment programs, educational assistance programs, veterans' housing loan and related programs, the Transition Assistance Program, and the database of small business concerns owned and controlled by veterans.

This resolution acknowledges over 85 years of effective state-based alcohol regulation since the passage of the Twenty-first Amendment to the Constitution (repealing Prohibition) and reaffirms the continued support of Congress for policies that allow states to effectively regulate alcohol.

Clean Energy Production Parity Act of 2019 This bill modifies the tax credit for investments in energy property to make qualified fuel cell property (certain fuel cell power plants) that uses an electromechanical process or includes a linear generator assembly eligible for the credit.

Second Chance at Life Act of 2019 This bill requires abortion providers administering chemical abortions to provide specified information about the possibility of reversing the effects of such procedure. Specifically, a patient must be informed at least 24 in advance that (1) reversing a chemical abortion may be possible after administering the first drug of a two-drug procedure and (2) additional information about chemical abortions is available through the Department of Health and Human Services. Further, after the first drug is administered, the physician must provide written discharge instructions to the patient that state it may be possible to reverse the abortion procedure before the second drug is taken, among other information. Such information also must be conspicuously posted inside the office or waiting area of clinics that provide chemical abortions. Abortion providers are not required to provide such information in the event that an abortion is necessary to save the life of a patient who is endangered due to a complication resulting from a pregnancy.

Taxpayer First Act of 2019 This bill modifies requirements for the Internal Revenue Service (IRS) regarding its organizational structure, customer service, enforcement procedures, management of information technology, and use of electronic systems. The bill includes provisions that establish the IRS Independent Office of Appeals to resolve federal tax controversies without litigation; require the IRS to develop a comprehensive customer service strategy; continue the IRS Free File Program; exempt certain low-income taxpayers from payments required to submit an offer-in-compromise; modify tax enforcement procedures that address issues such as the seizure of property, issuing a summons, joint liability, referral for private debt collection, and contacting third parties; establish requirements for responding to Taxpayer Advocate Directives; permanently authorize the Volunteer Income Tax Assistance Matching Grant Program; modify procedures for whistle-blowers; establish requirements for cybersecurity and identify protection; prohibit the rehiring of certain IRS employees who were removed for misconduct; allow the IRS to require additional taxpayers to file returns electronically; and increase the penalty for failing to file a return. The bill requires the IRS Commissioner to appoint a Chief Information Officer, modifies the requirements for managing information technology, and authorizes streamlined critical pay authority for certain IRS information technology positions. The bill also requires the IRS to implement an Internet platform for Form 1099 filings, a fully automated program for disclosing taxpayer information for third-party income verification using the Internet, and uniform standards and procedures for the acceptance of electronic signatures.

CT Colonography Screening for Colorectal Cancer Act of 2019 This bill (1) provides for Medicare coverage of screening computed tomography colonography (CTC) as a colorectal cancer screening test, and (2) excludes screening CTC from a special Medicare payment rule applicable to certain imaging services.

Lymphedema Treatment Act of 2019 This bill includes certain lymphedema compression treatment items as covered durable medical equipment under Medicare. (Lymphedema is a condition of localized fluid retention and tissue swelling that is caused when the lymphatic system is damaged or blocked.)

SFC Brian Woods Gold Star and Military Survivors Act This bill expands benefits for survivors of members of the Armed Forces. Specifically, it provides commissary and exchange privileges to a remarried former spouse; provides continued eligibility for payment of an annuity to a spouse who remarries, including a surviving spouse who remarried before the age of 55 and before enactment of this bill; allows payment of necessary expenses for the transportation of a decedent's remains to two locations (if the second is a national cemetery); allows payment of financial assistance to civilian providers of child care or youth program services furnished to survivors of members who die in the line of duty while on active duty, active duty for training, or inactive duty for training; and provides continued eligibility of a remarried surviving spouse for payment of veterans' dependency and indemnity compensation, including a surviving spouse who remarried before the age of 57 and before enactment of this bill.

Volunteer Income Tax Assistance Permanence Act of 2019 or the VITA Permanence Act of 2019 This bill directs the Department of the Treasury to establish a Community Volunteer Income Tax Assistance Matching Grant Program to provide matching funds for the development, expansion, or continuation of tax return preparation programs for low-income and underserved populations.

Restoring Investment in Improvements Act This bill confirms that the applicable recovery period for qualified improvement property (nonresidential real estate) for depreciation purposes is 15 years under the modified accelerated cost recovery system (MACRS) and 20 years under the alternative depreciation system (ADS).

Fair and Open Competition Act or FOCA Act This bill prohibits federal construction contracts or controlling documents for federally supported construction projects from requiring or prohibiting project labor agreements. Such documents also may not discriminate against or give preference to a bidder or contractor who signs or refuses to sign a project labor agreement. An agency may exempt a project from this prohibition to avert an imminent threat to public health or safety or to serve the national security.

Employee Rights Act This bill amends the National Labor Relations Act to (1) make it an unlawful labor practice for a labor organization to interfere (currently, also restrain or coerce) with the rights of employees to organize and collectively bargain; (2) require union recertification after a turnover in the workforce exceeding 50% of the bargaining unit; (3) require the National Labor Relations Board (NLRB) to give 14 days advance notice before a hearing investigating an election petition; and (4) require an employer to provide the NLRB with a list consisting only of employee names and addresses of all eligible voters within seven days after an NLRB determination of the appropriate bargaining unit or an agreement on eligible voters. The bill (1) grants union and nonunion employees the right to vote by secret ballot on whether to ratify a collective bargaining agreement or engage in a strike, (2) prohibits the use of union dues for any purpose not directly related to collective bargaining, (3) prohibits a strike without the consent of a majority of all represented employees determined by secret ballot, and (4) prohibits the use or threat of force or violence to obtain the right to represent employees. .

United States-Israel Cooperation Enhancement and Regional Security Act This bill authorizes various joint research and cooperation programs between the United States and Israel, reauthorizes security assistance to Israel, and establishes reporting requirements regarding various related issues. The bill authorizes the Department of State to work with Israel on research and development to establish directed energy capabilities. It authorizes through FY2024 cooperative projects involving the United States, Israel, and developing countries to identify and address sustainability challenges related to water resources, agriculture, and energy storage. The bill authorizes through FY2022 (1) activities of the U.S.-Israel Energy Center; (2) cooperation with and assistance to Israel related to security, explosives detection, and cybersecurity; (3) activities related to the U.S.-Israel Binational Agricultural Research and Development Fund; and (4) activities to establish a cooperative program with Israel to develop health technologies. The State Department shall establish a grant program to support cybersecurity research and development and commercialization of cybersecurity technology open to joint ventures involving U.S. and Israeli entities. The President shall establish contingency plans to provide Israel with necessary defense articles and services and assess plans to assist and supply Israel with munitions in the event of a sustained armed confrontation with Hezbollah. The bill authorizes the President to (1) waive export control requirements and immediately transfer defense articles to Israel in response to an existing or imminent military threat, and (2) transfer precision guided munitions to Israel as necessary for legitimate self-defense. The bill extends through FY2024 security assistance and loan guarantees for Israel.

This resolution opposes the Global Boycott, Divestment, and Sanctions Movement (BDS) and other efforts targeting Israel, and states that BDS undermines the possibility for a negotiated solution to the Israeli-Palestinian conflict. The resolution urges both sides to return to direct negotiations and expresses support for a solution resulting in the state of Israel existing alongside a democratic Palestinian state.

National Purple Heart Hall of Honor Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half-dollar clad coins emblematic of the National Purple Heart Hall of Honor. The bill limits the issuance of such coins to the one-year period beginning on January 1, 2021. The bill prescribes surcharges for coin sales, which shall be paid to the National Purple Heart Hall of Honor, Inc., to support the mission of such organization, including capital improvements to the National Purple Heart Hall of Honor facilities.

Tomb of the Unknown Soldier Centennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 100,000 $1 coins in commemoration of the centennial of the establishment of the Tomb of the Unknown Soldier. All sales of such coins shall include a surcharge of $10 for each coin. All surcharges received by Treasury from the sale of such coins must be paid to the National World War I Museum and Memorial to assist in the commemoration of the centennial.

College Transparency Act This bill requires the National Center for Education Statistics to establish a secure and privacy-protected data system that contains information about postsecondary students. Specifically, the data system must evaluate student enrollment patterns, progression, completion, and postcollegiate outcomes, and higher education costs and financial aid; provide complete and customizable information for students and families making decisions about postsecondary education; reduce the requirements for reporting by institutions of higher education; and periodically match with other federal systems of data. The bill also establishes a postsecondary student data system advisory committee.

Jobs and Opportunity with Benefits and Services for Success Act This bill renames the Temporary Assistance for Needy Families (TANF) program as the Jobs and Opportunity with Benefits and Services (JOBS) program, reauthorizes the program through FY2024, and makes changes relating to work requirements for beneficiaries. States providing aid under the program shall create an individual opportunity plan for each beneficiary. States shall impose work requirements on all work-eligible beneficiaries, and shall reduce benefits for noncompliance. (Currently, individual plans are optional under TANF, and states have discretion as to whether to reduce benefits for noncompliant individuals.) States providing aid shall meet annual performance targets related to the number of beneficiaries who exit the program and find unsubsidized employment. The Department of Health and Human Services (HHS) shall reduce grants to states that fail to meet such targets. States shall provide data related to beneficiary employment and wages to HHS, which shall be publicly available. The bill modifies various limitations on the use of funds for various purposes, and establishes that at least 25% of funds from various grants shall be spent on core activities. Certain existing laws relating to monitoring and recovering improper benefits payments shall apply to the JOBS program. The bill eliminates programs providing (1) supplemental grants for population increases, (2) bonuses for high performance states, (3) welfare-to-work grants, and (4) contingency funds for state welfare programs.

Violence Against Women Extension Act of 2019 This bill extends through March 31, 2020, 19 grant programs authorized by the Violence Against Women Act of 1994 and subsequent legislation and administered by the Office on Violence Against Women within the Department of Justice.

Charitable Equity for Veterans Act of 2019 This bill allows a tax deduction for charitable contributions to certain federally chartered organizations of past or present members of the Armed Forces. (Under current law, donations to such an organization are only deductible if at least 90% of the organization's membership consists of war veterans. The bill expands the deduction to include organizations that do not meet the wartime service requirement and are federally chartered.)

New Markets Tax Credit Extension Act of 201 9 This bill makes the new markets tax credit permanent. It also modifies the credit to (1) provide for an inflation adjustment to the limitation amount for the credit after 2018, and (2) allow an offset against the alternative minimum tax for the credit (determined with respect to qualified equity investments initially made after 2018).

Personal Health Investment Today Act of 2019 or the PHIT Act of 201 9 This bill allows a medical care tax deduction for up to $1,000 ($2,000 for a joint return or a head of household) of qualified sports and fitness expenses per year. The bill defines "qualified sports and fitness expenses" as amounts paid exclusively for the sole purpose of participating in a physical activity, including (1) fitness facility memberships, (2) physical exercise or activity programs, and (3) equipment for a physical exercise or activity program.

Education Savings Accounts for Military Families Act of 2019 This bill directs the Department of Education (ED) to establish a program to provide children with parents on active duty in the uniformed services with funds to pay educational expenses. Specifically, ED shall establish a tax-exempt Military Education Savings Account for dependent children of parents in the uniformed services for the payment of the children's educational expenses. Funds in the savings account may be used for, among other things, the cost of attendance at a private elementary or secondary school or institution of higher education, private tutoring, or costs associated with an apprenticeship or other vocational training program.

Removing Barriers to Colorectal Cancer Screening Act of 2019 This bill waives Medicare coinsurance requirements with respect to colorectal cancer screening tests, regardless of the code billed for a resulting diagnosis or procedure.

Resident Education Deferred Interest Act or the REDI Act This bill makes student loan borrowers eligible for interest-free deferment on loans under the William D. Ford Federal Direct Loan Program if the borrowers are serving in medical or dental internships or residency programs.

Treat and Reduce Obesity Act of 2019 This bill expands Medicare coverage of intensive behavioral therapy for obesity. Specifically, the bill allows coverage for therapy that is provided by (1) a physician who is not a primary care physician; or (2) other health care providers (e.g., physician assistants and nurse practitioners) and approved counseling programs, if provided upon a referral from, and in coordination with, a physician or primary care practitioner. Currently, such therapy is covered only if provided by a primary care practitioner. The bill also allows coverage under Medicare's prescription drug benefit of drugs used for the treatment of obesity or for weight loss management for individuals who are overweight.

Fallen Warrior Battlefield Cross Memorial Act This bill provides that the Department of Veterans Affairs authorizes the display of a Fallen Soldier Display in any national cemetery. A Fallen Soldier Display is a memorial monument in honor of deceased members of the Armed Forces.

Coordinating Assistance for TANF Recipients Act This bill directs the Department of Health and Human Services to make grants under the Temporary Assistance for Needy Families (TANF) program for state demonstration projects that provide coordinated case management to help TANF recipients increase their employment and self-sufficiency.

Import Tax Relief Act of 2019 This bill requires the President to establish a process by which certain articles imported from China may be excluded from duties. Specifically, the bill requires the creation of a process whereby U.S. entities may request that articles imported from China be excluded from duties imposed under the Trade Act of 1974. Such an exclusion must be based on a determination that the article can easily be excluded by U.S. Customs and Border Protection and that (1) the article is not commercially available outside of China or produced at a cost-competitive price, (2) a duty on the article would increase consumer prices for everyday items consumed by low- or middle-income families in the United States, or (3) the article does not directly benefit from nonmarket-based policies of China. Further, this exclusion applies retroactively to recently imported articles that would have been subject to a lower rate under this bill.

Health Insurance Tax Relief Act of 2019 This bill delays reimposition of the annual fee on health insurers until 2022. Under current law, the annual fee for a health insurer is calculated based on the insurer's share of total premiums from the preceding year. The fee is suspended for 2019 (i.e., there is no fee based on premiums from 2018); reimposition is scheduled for 2020.

Workforce Opportunity Realignment Kickstart Act or the WORK Act This bill modifies requirements for states with respect to the administration of Temporary Assistance for Needy Families (TANF) funds. Specifically, the bill (1) establishes new performance indicators related to employment and educational outcomes for states receiving TANF funds; (2) increases the percentage of TANF funds, from 30% to 50%, that may be used to support other state programs; and (3) allows states to use TANF funds to carry out certain workforce development programs. Under current law, states may use TANF funds to support other state programs only if they are related to Child Care and Development Block Grants or Social Services Block Grants. States must negotiate with the Department of Health and Human Services (HHS) to establish a level of performance for each indicator, taking into account certain economic, demographic, and other factors. HHS must periodically revise levels of performance for states to reflect economic and other conditions.

Burn Pit Registry Enhancement Act This bill authorizes specified individuals to update the burn pit registry with the cause of death of a registered individual. The Department of Veterans Affairs established the burn pit registry to allow certain veterans and servicemembers to document their exposures and report health concerns. The registry is for individuals who may have been exposed to toxic airborne chemicals and fumes caused by open burn pits (areas used for burning solid waste in open air without equipment) while deployed in Afghanistan or Iraq. Specifically, the bill authorizes a designee of a registered individual or an immediate family member to update the registry with the cause of death of the individual.

Never Forget the Heroes: Permanent Authorization of the September 11th Victim Compensation Fund Act This bill funds through FY2090 the September 11th Victim Compensation Fund of 2001. Additionally, the bill modifies the Victim Compensation Fund (VCF): to allow claims to be filed until October 2089, to require VCF policies and procedures to be reassessed at least once every five years (currently, at least once annually), to require claimants to be paid for the amount by which a claim was reduced on the basis of insufficient funding, to remove the cap on noneconomic damages in certain circumstances, and to adjust the annual limit on economic loss compensation for inflation.

The Mass Violence Prevention Act of 2019 or the MVP Act of 2019 This bill modifies criminal penalties for an offense involving the theft of a firearm from a federal firearms licensee. It also directs the Department of Justice (DOJ) to take specified actions to prevent gun violence. First, the bill modifies criminal penalties for an offense involving the theft of a firearm from a licensed importer, manufacturer, or dealer, or from their business premises. Specifically, the bill (1) increases from 10 to 20 years the maximum prison term, and (2) creates a 3- or 5-year mandatory minimum prison term for an offense that occurs during the commission of a burglary or robbery. Further, an attempt to commit an offense is subject to the same penalties as a substantive offense. Next, the bill establishes a Mass Violence Prevention Center in DOJ to, among other things, serve as the primary government organization for analyzing and integrating all government intelligence pertaining to threats of mass violence. Finally, the bill authorizes DOJ to appoint no fewer than 50 Assistant U.S. Attorneys to implement Project Safe Neighborhoods, which is a national initiative to reduce gun violence in the United States.

History and Tradition Protection Act of 2019 This bill limits the remedies available for certain civil actions involving the deprivation of rights under color of law. Specifically, remedies will be limited to injunctive and declaratory relief for claims where the deprivation of rights consists of violation of a prohibition in the Constitution against the establishment of religion. Additionally, no attorney's fees shall be awarded in proceedings in vindication of civil rights with respect to such a claim concerning the actions of states and localities. With regard to a claim brought against the United States or a federal official acting in his or her official capacity, the bill prohibits the award of reasonable fees and expenses of attorneys to the prevailing party.

Advancing Care for Exceptional Kids Act of 2019 or the ACE Kids Act of 2019 This bill establishes a state Medicaid option to provide for medical assistance with respect to coordinated care provided through a health home (i.e., a designated provider or team of health-care professionals) for children with medically complex conditions. States must determine payment methodologies in accordance with specified requirements; payments also temporarily qualify for an enhanced federal matching rate.

Craft Beverage Modernization and Tax Reform Act of 2019 This bill modifies the tax treatment of certain alcoholic beverages to exclude the aging period from the production period for beer, wine, or distilled spirits for purposes of determining whether a taxpayer can expense, rather than capitalize, interest costs paid or incurred during the production period; reduce excise tax rates on beer and distilled spirits; permit the transfer of beer between bonded facilities without payment of tax; increase the amount of the small wine producer tax credit and expand the categories of producers covered by such credit; allow an adjustment to the producer credit for hard cider; and modify the alcohol content limitations that apply to certain wines for tax purposes. The Department of the Treasury must amend applicable regulations with respect to the use of wholesome products suitable for human consumption in the production of fermented beverages. The bill also increases funding for the Alcohol and Tobacco Tax and Trade Bureau.

This resolution expresses support for the designation of DIPG Awareness Day. (DIPG is diffuse intrinsic pontine glioma, a terminal childhood brain cancer.) It also encourages public and private sources of research funding to elevate their consideration of the mortality rate of a type of cancer as well as the life years lost as factors considered during the grant application process.

Family Savings Act of 2019 This bill modifies requirements for tax-exempt multi-employer and pooled employer retirement plans and expands qualified tuition plans (commonly known as 529 plans) to cover additional programs and expenses. Among other things, the bill treats certain education fellowships and stipend payments as compensation for Individual Retirement Account (IRA) purposes, repeals the maximum age for contributions to a traditional IRA, increases the credit limitation for small employer pension plan startup costs, allows a new tax credit for small employer automatic enrollment plans, exempts certain individuals with pension plan assets not exceeding $50,000 from required minimum distribution rules, and modifies nondiscrimination rules to protect certain older pension plan participants, Additionally, the bill (1) expands 529 plans to allow distributions for registered apprenticeship programs, education loan repayments, and certain elementary and secondary school expenses in addition to tuition; (2) allows unborn children to be beneficiaries of 529 plans; and (3) permits penalty free withdrawals from retirement plans for expenses related to the birth or adoption of a child.
