Trade Promotion Authority Act of 2001

Trade Promotion Authority Act of 2001 - Sets forth the overall trade negotiating objectives of the United States for trade agreements (generally similar to the objectives of the Omnibus Trade and Competitiveness Act of 1988 (OTCA)), including to: (1) further strengthen the system of international trading disciplines and procedures, including dispute settlement; and (2) foster economic growth, raise living standards, and promote full employment in the United States and to enhance the global economy. Sets forth the principal U.S. negotiating objectives (generally similar to the principal OTCA negotiating objectives) regarding trade barriers and other trade distortions, trade in services, foreign investment, intellectual property, transparency, improvement of the World Trade Organization (WTO) and other multilateral and bilateral trade agreements, foreign regulatory practices, electronic commerce, reciprocal trade in agriculture, and WTO extended negotiations. Requires the United States Trade Representative (USTR) to consult closely with Congress during trade negotiations. Sets forth the authority of the President (generally similar to the authority under OTCA) to enter into trade agreements with foreign countries regarding tariff and non-tariff barriers. States that a trade agreement may be entered into (before June 1, 2005; or June 1, 2007, if trade authorities procedures (or fast-track procedures) are extended under this Act) only if it makes progress in meeting the overall and principal trade negotiating objectives, and the President satisfies certain notification and consultation requirements set forth in this Act, including submission of the agreement for assessment by the International Trade Commission. Applies trade authorities procedures to bills implementing trade agreements if they consist of: (1) a provision approving a trade agreement entered into under this Act, and approving any statement of administrative action; and (2) if changes in existing laws or new statutory authority are required to implement such agreements, provisions necessary to implement them, either repealing or amending existing laws or providing new statutory law. Authorizes both Houses of Congress to adopt, within 60 days of each other, a procedural disapproval resolution denying trade authorities procedures to any trade agreement if the President has failed or refused to notify or consult with Congress about it. Exempts from the notice and consultation requirements of this Act any tariff or nontariff agreement which results from negotiations commenced before enactment of this Act, and which: (1) is entered into under the auspices of the WTO regarding the rules of origin work program; (2) is entered into with Chile or Singapore; or (3) establishes a Free Trade Area for the Americas. Requires the appointment of a Congressional Oversight Group to serve as advisor to the U.S. delegation after the President notifies Congress of his intention to enter into the negotiation of any tariff or nontariff trade agreement. Requires the President to submit an implementation and enforcement plan at the same time a final text of any tariff or nontariff trade agreement is submitted to Congress.

Uniformed Services Former Spouses Equity Act of 2001 - Requires payment from the monthly disposable retired pay of a member to his or her former spouse in compliance with court orders (division of property) to terminate upon the remarriage of that spouse, effective as of the last day of the month in which the remarriage occurs. Provides that, in the case of a member to whom a final decree of divorce, dissolution, annulment, or legal separation is issued before the member begins to receive retired pay, the disposable retired pay of such member, for purposes of such monthly payments, shall be computed based on the pay grade and length of service of the member while married. Increases such amount concurrently with retired pay increases. Requires a member's spouse or former spouse to obtain a court order for reapportionment of a member's monthly disposable retired pay by the later of the following dates: (1) two years of the date of the final decree of divorce, dissolution, annulment, or legal separation; or (2) six months after the enactment of this Act. Prohibits the court from treating as part of a member's disposable retired pay amounts which have been waived from such pay in order to receive veterans' disability compensation.

Amends the Public Health Service Act to require the NIH Director to: (1) appoint an official of the Department of Health and Human Services to serve as the NIH coordinator regarding breast implant research; (2) establish either a study section or special emphasis panel for NIH to review extramural breast implant research grant applications to ensure research design and quality, as well as quality intramural research; and (3) conduct or support research to expand the understanding of the health implications of both saline and silicone breast implants. Requires a report from the Commissioner of Food and Drugs concerning postmarket evaluations of saline implant manufacturers' data. Directs the Commissioner to take specified steps to assist women in receiving accurate and complete information about the risks of silicone breast implants.

Small Business Liability Protection Act - Amends the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to provide (with exceptions) that persons shall be liable for response costs at a National Priorities List (NPL) facility as non-owners or operators only if the total of material containing a hazardous substance that the business arranged for disposal, transport, or treatment of, or accepted for transport, was greater than 110 gallons of liquid material or 200 pounds of solid material. Applies this exemption only to activities taking place before April 1, 2001. Exempts a person from liability for response costs (with exceptions) at a NPL facility for municipal solid waste (MSW) as a non-owner or operator if the person is an owner, operator, or lessee of residential property from which all of the person's MSW was generated, or a certain small business or small charitable tax-exempt organization that generated all its MSW, with respect to the facility concerned. Makes nongovernmental entities that commence a contribution action liable to the defendant for all reasonable costs of defending the action if the defendant is not liable based on the above-described exemptions. Adds to the list of parties eligible for de minimis final settlements certain persons and businesses that demonstrate an inability or limited ability to pay response costs. Revises conditions of eligibility for such settlements for de minimis parties.

21st Century Teaching Scholarships Act - Establishes a 21st Century Teaching Scholarships program. Authorizes the Secretary of Education to make grants to the States for scholarships to outstanding secondary school graduates or exceptional certified teachers who demonstrate a commitment to and capacity for teaching at the preschool, elementary, or secondary level. Requires State agreements to require such scholarship recipients to teach full-time, in a public or public charter preschool, elementary, or secondary school in any State, for at least: (1) two years for every year of full-time assistance; or (2) one year for every year of part-time assistance. Requires that such teaching: (1) occur within the ten-year period after they complete the postsecondary education for which the scholarship was awarded; and (2) not exceed six years. Reduces such teaching requirements by one-half for individuals who teach in shortage areas designated by the Secretary. Professional Development Enhancement Act - Amends the Elementary and Secondary Education Act of 1965, with respect to authorized State-level uses of certain funds under the title II Dwight D. Eisenhower Professional Development Program, to include: (1) programs that include support during the initial teaching experience, such a s mentoring programs with specified required criteria; and (2) programs, with certain required components, that establish, expand, or improve alternative routes to State certification of teachers for highly qualified individuals with baccalaureate degrees who demonstrate the potential to become highly effective teachers. Quality Teacher Recruitment and Retention Act - Directs the Secretary to carry out a program of student loan forgiveness in exchange for the borrower's commitment, as a new teacher, to three consecutive years of full-time teaching in certain low-income schools or in special education teaching.

Electricity Supply Assurance Act of 2001 - Price-Anderson Amendments Act of 2001 - Amends the Atomic Energy Act of 1954 to extend the authority of the Nuclear Regulatory Commission (NRC) to indemnify licensees and Department of Energy contractors for public liability arising from nuclear incidents in excess of the required financial protection. Revises guidelines for licensee insurance premiums and liability and indemnification limits. Amends the Department of Energy Organization Act to add two Assistant Secretaries of Energy responsible, respectively, for: (1) the Office of Science; and (2) the Office of Nuclear Energy, Science, and Technology. Amends the USEC Privatization Act to prohibit the Secretary of Energy from selling surplus natural uranium and conversion services through 2005. Requires sale of uranium hexaflouride. Instructs the Secretary to begin construction of the Mixed Oxide Fuel Fabrication Facility by October 2003. Authorizes the Secretary to place the Portsmouth gaseous diffusion plant into cold standby condition for a five-year period. Mandates a program to: (1) demonstrate the NRC Early Site Permit process; (2) evaluate opportunities for completion of partially constructed nuclear plants; (3) assess opportunities for Generation IV reactors; and (4) research potential licensing issues associated with new reactor technologies and designs. Declares electricity generated by a nuclear plant to be an environmentally preferable product. Conditions Federal funding for a domestic or international organization that supports electricity production facilities upon reasonable efforts to include projects that use nuclear plants. Establishes the Office of Spent Nuclear Fuel Research. Directs the Secretary to: (1) conduct an advanced fuel recycling technology research and development program; and (2) establish the Advanced Accelerator Applications Program. Amends the Atomic Energy Act of 1954 to: (1) revise certain commercial license requirements; (2) repeal restrictions pertaining to foreign ownership of commercial licensees; and (3) grant firearms and arrest authority to employees of NRC licensees.

Federal Prison Industries Competition in Contracting Act of 2001 - Amends the Federal criminal code to replace provisions regarding the purchase of prison-made products by Federal departments with provisions establishing a Government-wide procurement policy relating to purchases from Federal Prison Industries (FPI) which shall generally require the use of competitive procedures. Requires FPI to comply with Federal occupational, health, and safety standards regarding its industrial operations. Requires that an analysis of the probable impact of a proposed expansion of inmate-work activities by FPI on private sector firms and their non-inmate workers be made whenever FPI proposes to authorize the sale of a new specific product or service or to expand production of a current product or service. Provides for inmate wages and deductions. Amends the Federal judicial code regarding the Department of Justice Assets Forfeiture Fund to authorize payments to the Bureau of Prisons exclusively for the purpose of providing additional vocational and remedial educational training for inmates. Amends the Federal criminal code to require that not less than 20 percent of the gross profits of the corporation at the end of each fiscal year be allocated to fund vocational training for inmates. Requires the Director of the Bureau to afford to inmates opportunities to participate in programs and activities designed to help prepare such inmates to obtain employment upon release. Authorizes FPI to: (1) locate more than one workshop at a Federal correctional facility; and (2) operate a workshop outside of a correctional facility if all of participating inmates are minimum security inmates.

Directs the Federal Labor Relations Authority (FLRA) to determine whether State law provides specified rights and responsibilities for public safety officers, including: (1) granting public safety employees the right to form and join a labor organization which excludes management and supervisory employees, and which is, or seeks to be, recognized as the exclusive bargaining agent for such employees; and (2) requiring public safety employers to recognize and agree to bargain with the employees' labor organization. Requires the FLRA to issue regulations establishing collective bargaining procedures for public safety employers and employees in States that do not substantially provide for such public safety employee rights and responsibilities. Directs the FLRA, in such cases, to: (1) determine the appropriateness of units for labor organization representation; (2) supervise or conduct elections to determine whether a labor organization has been selected as an exclusive representative by a majority of the employees in an appropriate unit; (3) resolve issues relating to the duty to bargain in good faith; (4) conduct hearings and resolve complaints of unfair labor practices; and (5) resolve exceptions to arbitrator's awards. Grants a public safety employer, employee, or labor organization the right to seek enforcement of such FLRA regulations and authority through appropriate State courts. Prohibits public safety employers, employees, and labor organizations from engaging in lockouts or strikes. Provides that existing collective bargaining units and agreements shall not be invalidated by this Act.

Amends the Uniformed and Overseas Citizens Absentee Voting Act to provide for: (1) extension of registration and balloting rights for absent uniformed services voters to State and local elections; (2) treatment of applications and absentee ballots submitted by absent uniformed services voters; and (3) coverage of recently separated uniformed services voters as absent uniformed services voters. Directs the Secretary of Defense to carry out a demonstration project under which absent uniformed services voters are permitted to cast ballots in the regularly scheduled general election for Federal office for November 2002 through an electronic voting system.

Fair Care for the Uninsured Act of 2001- Amends the Internal Revenue Code to allow an individual a tax credit in an amount equal to the amount paid for qualified health insurance, subject to stated limitations. Directs the Secretary of the Treasury to make payments to the provider of an individual's qualified health insurance equal to such individual's qualified health insurance credit advance amount (the Secretary's estimate of the amount of credit allowable) with respect to such provider. Requires each health insurer, health maintenance organization, and health service organization to participate in a health insurance safety net which shall assure the availability of health insurance to uninsurable individuals. Funds such safety nets through assessments against such insurers and organizations. Permits such insurers and organizations to add the costs of such assessments to the costs of its insurance or coverage. Amends the Public Health Service Act to allow health benefits coverage through individual membership associations (IMAs). Sets forth IMA requirements, including that the IMA be an organization operated under the direction of an association and that IMA health benefits coverage only be provided through contracts with health insurance issuers. Requires IMAs to include a minimum of two health insurance coverage options.

States that it is U.S. policy to ensure that any war claims settlement terms between Japan and any other country that are more beneficial than terms extended to the United States under the above Treaty are extended to the United States with respect to claims under this Act. Authorizes the Secretary of Veterans Affairs to secure information relating to chemical or biological tests conducted by Japan on members of the U.S. armed forces held as prisoners of war during World War II.

Stop Tuberculosis (TB) Now Act - Amends the Foreign Assistance Act of 1961 to declare that a major objective of the U.S. foreign assistance program is to control tuberculosis (TB) and that consequently Congress expects the agency primarily responsible for the administration of TB control health programs to: (1) coordinate with the World Health Organization and other designated health organizations toward the development and implementation of a comprehensive TB control program, including expanding the use of the strategy of directly observed treatment, short course (DOTS) and strategies to address multi-drug resistant TB (MDR-TB) where appropriate at the local level, particularly in countries with the highest TB rate; and (2) set as a goal the cure of at least 85 percent of TB cases detected by focusing efforts on the use of DOTS strategy or other internationally accepted primary TB control strategies in those countries in which the agency has established development programs, and the reduction of TB -related deaths by 50 percent, by December 31, 2010.

Amends the Internal Revenue Code to extend the energy tax credit to distributed energy resources property placed in service during the taxable year, including distributed power property and combined heat and power system property. Instructs the Secretary of Energy to implement an accelerated cooperative research and development program to ensure reliability, efficiency, and environmental responsibility of Distributed Energy Resources, including: (1) Advanced Energy Technologies and Systems Development; (2) Advanced Grid Reliability Technologies development; and (3) Technology Transfer and Education. Directs the Secretary to develop and submit to Congress a six-year research and development program plan.

Increases the earned income credit phaseout amount on a joint return by $2,000. Revises IRC provisions relating to limitation based on tax liability and the definition of such liability to provide that the aggregate amount of credits allowed as nonrefundable personal credits shall not exceed the sum of: (1) the taxpayer's regular tax liability for the taxable year reduced by the foreign tax credit; and (2) the tax imposed by the alternative minimum tax.

Death Tax Elimination Act - Repeals the estate tax, gift tax, and the tax on generation-skipping transfers, effective January 1, 2011. Provides for annual reductions of the tax until such date. Increases the unified estate and gift tax credit to $1.3 million. Repeals the estate and gift tax provisions applicable to family-owned businesses. Amends provisions concerning the special rules for allocation of the generation-skipping tax (GST) exemption to provide, as a general rule, that: (1) if any individual makes an indirect skip during such individual's lifetime, any unused portion of such individual's GST exemption shall be allocated to the property transferred to the extent necessary to make the inclusion ratio for such property zero; and (2) if the amount of the indirect skip exceeds such unused portion, the entire unused portion shall be allocated to the property transferred. Declares that, if a trust is severed in a qualified severance, the trusts resulting from such severance shall be treated as separate trusts thereafter. Revises valuation rules for gifts for which a gift tax return was filed or deemed allocation made. Provides that, if an allocation of the GST exemption to any transfers of property is deemed to have been made at the close of an estate tax inclusion period, the value of the property shall be its value at such time. Directs the Secretary of the Treasury to prescribe circumstances and procedures under which extensions of time will be granted to make an allocation of GST exemption or an election not to apply specified allocation requirements to certain lifetime direct skips, indirect skips, or transfers to a particular trust. Increases the permissible number of partners or shareholders in a closely held business for purposes of eligibility for an extension of estate tax payments.
