FERC and the President may waive these requirements under specified circumstances. The Energy Information Administration must collect and publish information on exports of natural gas and crude oil by vessels, including forecasts and data on those exports.

Specifically, the bill establishes a congressional approval process for a major rule. A major rule may only take effect if Congress approves of the rule. A major rule is a rule that results in (1) an annual effect on the economy of $100 million or more; (2) a major increase in costs or prices for consumers, individual industries, government agencies, or geographic regions; or (3) significant adverse effects on competition, employment, investment, productivity, innovation, or the ability of U.S.-based enterprises to compete with foreign-based enterprises. In addition, the bill establishes a congressional disapproval process for a nonmajor rule. A nonmajor rule may only take effect if Congress does not disapprove of the rule.

DRIVE-SAFE Act

Developing Responsible Individuals for a Vibrant Economy Act or the DRIVE-SAFE Act This bill directs the Department of Transportation to promulgate regulations to implement an apprenticeship program for licensed commercial motor vehicle drivers under the age of 21. Under the program, an apprentice must complete two probationary periods that total 400 hours of on-duty time, of which at least 240 hours must be driving time in a commercial motor vehicle. Additionally, the apprentice must be accompanied in the cab of the commercial motor vehicle by an experienced driver. Further, the bill requires all commercial motor vehicles used in the program for training to be equipped with safety technology such as active braking collision mitigation systems and video event capturing systems. An employer shall not knowingly allow, require, permit, or authorize a driver under the age of 21 to operate a commercial motor vehicle unless the driver is participating in, or has completed, an apprenticeship program that meets the requirements set forth in this bill.

This bill requires the Federal Communications Commission (FCC) to analyze and report on the demands associated with edge provider data transmitted over rural broadband networks during a specified six-year period. An edge provider is an entity that provides content, applications, or services over the internet (e.g., search engine providers, streaming video or music services, social media platforms, and retailers). Some edge providers generate revenue by selling products or subscriptions to their content, while others offer their content for free and generate revenue by selling advertising to users based on user-provided information. In its analysis, the FCC must retrospectively and prospectively estimate the quantity of edge provider data transmitted over rural broadband networks. It must also calculate costs to rural broadband providers that are not otherwise recovered for transmitting such data. These costs include (1) initial deployment of rural broadband networks, (2) operation and maintenance of those networks, and (3) the delivery of services to users over those networks.

Fellows will receive (1) a $120,000, two-year stipend for living and basic startup expenses; (2) health care; and (3) interest-free federal student loan deferral for two years. Further, fellows shall receive mentorship from the Service Corps of Retired Executives and be matched with a full range of lenders, investors, and insurers. The bill also establishes a fund in the Department of the Treasury from which the SBA may provide loans for qualified investors to support a small business owned and operated under the program by a fellow.

Cardiovascular Advances in Research and Opportunities Legacy Act This bill expands research on valvular heart disease and its treatment. This disease is caused by damage to or disease affecting any valve that controls blood flow in the heart. The National Institutes of Health must consult with the National Heart, Lung, and Blood Institute to conduct or support research on the disease, including on mitral valve prolapse. This occurs when the valve between the chambers of the left side of the heart seals improperly. The Centers for Disease Control and Prevention (CDC) must develop best practices to treat valvular heart disease. The CDC may also carry out other projects to increase awareness of and reduce deaths from the disease.

Following its award, the medal shall be given to the National Museum of American History of the Smithsonian Institution for display and research. The Department of the Treasury must strike duplicate medals in silver for presentation to a hostage (or the personal representative of a deceased hostage), and Treasury may also strike and sell duplicate medals in bronze.

Pain-Capable Unborn Child Protection Act This bill establishes a new criminal offense for performing or attempting to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. The bill provides exceptions for an abortion (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Puppies Assisting Wounded Servicemembers Act of 2021 or the PAWS Act of 2021 This bill requires the Department of Veterans Affairs (VA) to implement a grant program for the purpose of pairing service dogs with eligible veterans. Organizations that receive grants must provide veterinary health insurance coverage, hardware, and travel expenses for each service dog and veteran participating in the program. Eligible veterans are those who (1) are enrolled in the VA health care system, (2) have been evaluated and treated for post-traumatic stress disorder (PTSD) but remain diagnosed with PTSD, (3) may benefit from a service dog, and (4) agree to successfully complete training provided by an eligible organization. Veterans are required to see a VA health care provider at least once every six months to determine whether the veteran continues to benefit from a service dog. Eligible organizations are nonprofit organizations that provide service dogs to veterans with PTSD, meet publicly available standards set forth by the Association of Service Dog Providers for Military Veterans, have expertise in the needs of veterans with PTSD, agree to cover all costs in excess of the grant amount to guarantee the benefits of the program, agree to reaccept or replace a service dog provided to a veteran, and submit an application to the VA. Any improvement in PTSD symptoms as a result of the provision of a service dog shall not affect the veteran's eligibility for any other VA benefits. The Government Accountability Office must report on the grant program.

No Taxpayer Funding for Abortion and Abortion Insurance Full Disclosure Act of 2021 This bill modifies provisions relating to federal funding for, and health insurance coverage of, abortions. Specifically, the bill prohibits the use of federal funds for abortions or for health coverage that includes abortions. Such restrictions extend to the use of funds in the budget of the District of Columbia. Additionally, abortions may not be provided in a federal health care facility or by a federal employee. Historically, language has been included in annual appropriations bills for the Department of Health and Human Services (HHS) that prohibits the use of federal funds for abortions—such language is commonly referred to as the Hyde Amendment. Similar language is also frequently included in appropriations bills for other federal agencies and the District of Columbia. The bill makes these restrictions permanent and extends the restrictions to all federal funds (rather than specific agencies). The bill's restrictions regarding the use of federal funds do not apply in cases of rape, incest, or where a physical disorder, injury, or illness endangers a woman's life unless an abortion is performed. The Hyde Amendment provides the same exceptions. The bill also prohibits qualified health plans from including coverage for abortions. Currently, qualified health plans may cover abortion, but the portion of the premium attributable to abortion coverage is not eligible for subsidies.

The bill funds state and local grants, incentivizes state and local reporting on the use of certain policing practices, creates new federal offenses for certain misconduct, and establishes best practices and training requirements. The bill funds state and local grants, including to support the use of body-worn cameras, to implement information sharing systems for disciplinary records of law enforcement officers, and to prohibit officers from engaging in sexual acts under color of the law. Further, it requires state and local governments that receive grants under the Edward Byrne Memorial Justice Assistance Grant program to report information related to use-of-force incidents and the use of no-knock warrants. At the federal level, the bill establishes new criminal offenses related to falsifying police reports and engaging in sexual acts under color of law. The bill directs the Department of Justice to develop training on de-escalation tactics, behavioral health crises, alternatives to the use of force, and the duty to intervene when another officer uses excessive force. Finally, the bill establishes and funds the National Criminal Justice Commission. Among other tasks, the commission must develop best practices for policing tactics and procedures.

Teleabortion Prevention Act of 2021 This bill restricts the use of telehealth for chemical abortions (also known as medication abortions). Specifically, it requires a provider who dispenses or prescribes medication for a chemical abortion to physically examine the patient, be physically present at the location of the chemical abortion, and schedule a follow-up visit. The bill provides an exception for a chemical abortion that is necessary to save the life of a mother whose life is endangered by a physical disorder, illness, injury, or condition. The bill establishes criminal penalties—a fine, a prison term of up to two years, or both—for a provider who does not comply with the requirements. Born-Alive Abortion Survivors Protection Act

Born-Alive Abortion Survivors Protection Act This bill establishes requirements for the degree of care a health care practitioner must provide in the case of a child born alive following an abortion or attempted abortion. Specifically, a health care practitioner who is present must (1) exercise the same degree of care as would reasonably be provided to any other child born alive at the same gestational age, and (2) ensure the child is immediately admitted to a hospital. Additionally, a health care practitioner or other employee who has knowledge of a failure to comply with the degree-of-care requirements must immediately report such failure to law enforcement. A health care practitioner who fails to provide the required degree of care, or a health care practitioner or other employee who fails to report such failure, is subject to criminal penalties—a fine, up to five years in prison, or both. An individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive under this bill and allows her to bring a civil action against a health care practitioner or other employee for violations.

Shellfish Aquaculture Improvement Act of 2021 This bill limits the ability of an aquaculture worker to bring a civil action against an employer for employment-related injuries. Specifically, the bill limits recovery for injuries sustained by an aquaculture worker if (1) state workers' compensation is available to such individual; and (2) at the time of injury, the individual was engaged in aquaculture in a place where the individual had lawful access. An aquaculture worker is an individual employed by commercial enterprises involved in the controlled cultivation and harvest of aquatic plants and animals, including the cleaning, processing, or canning of fish and fish products, the cultivation and harvesting of shellfish, and the controlled growing and harvesting of other aquatic species.

Second Chance at Life Act of 2021

Second Chance at Life Act of 2021 This bill requires abortion providers to disclose information about the possibility of reversing a medication abortion. This is a procedure that uses a medication regimen to terminate a pregnancy, typically with a two-drug protocol.  Providers must inform patients that it may be possible to reverse the effects of a medication abortion after taking the first drug. They must also let patients know that more information and assistance is available on the Department of Health and Human Services (HHS) website. At least 24 hours before the procedure, the provider must share this information with the patient in person or by telephone. The provider must also include the information in written discharge instructions after the first drug is dispensed. The bill sets out an exception to these notification requirements when an abortion is necessary to resolve a physical injury or condition that threatens the life of the woman. The provider must document the circumstances giving rise to the exception in the patient's medical file. Furthermore, providers must post signs with this information in their offices or facilities, and HHS must maintain information about reversing medication abortions on its website.

Defund Planned Parenthood Act of 2021

Defund Planned Parenthood Act of 2021 This bill restricts federal funding for Planned Parenthood Federation of America Inc. or any of its affiliates or clinics for one year. Specifically, it prohibits funding those entities unless they certify that the affiliates and clinics will not perform, and will not provide funds to entities that perform, abortions during that year. If the certification requirement is not met, the Department of Health and Human Services and the Department of Agriculture must recoup any federal assistance received by those entities. However, the bill's funding restriction does not apply to abortions performed in cases of rape or incest or when necessary to resolve a physical condition that endangers a woman's life. The bill also provides additional funding for community health centers for the one-year period. These funds are subject to the same abortion-related restrictions and exceptions.
