Remedies for Refusal of Repatriation Act This bill requires the Department of Homeland Security (DHS) to establish procedures for determining whether a foreign government systematically and unreasonably refuses or delays the repatriation of its nationals who: (1) have been ordered deported by the United States; and (2) have been convicted of a felony or a crime of violence or are a threat to national security or public safety. Upon determining that a country does refuse or delay repatriation of its citizens, DHS shall notify the Department of State and the two departments shall meet with the country's representatives and notify them that the United States may deny visas to their nationals. If the country continues to refuse or delay the repatriation of its nationals, the State Department shall discontinue the issuance of visas, unless DHS determines that such discontinuance is not in U.S. interests. DHS and the State Department shall list such countries on their websites.

Air Traffic Controller Hiring Improvement Act of 2016 This bill directs the Federal Aviation Administration (FAA), in appointing air traffic controllers, to give preferential consideration to qualified individuals maintaining 52 consecutive weeks of experience involving the active separation of air traffic after receipt of an air traffic certification or facility rating within 5 years of application while serving at an FAA air traffic control facility, a civilian or military air traffic control facility of the Department of Defense, or a tower operating under contract with the FAA. The FAA shall consider additional applicants by referring an approximately equal number of employees for appointment among two applicant pools. The number referred from each group shall not differ by more than 10%. Pool one shall consist of applicants who: have successfully completed air traffic controller training and graduated from an institution participating in the Collegiate Training Initiative program and have received an appropriate recommendation or endorsement from such institution, are eligible for a veterans recruitment appointment and provide a Certificate of Release or Discharge from Active Duty within 120 days of the announcement closing, are veterans eligible for veterans' benefits who maintain aviation experience obtained in the course of the individual's military experience, or are preference eligible veterans. Pool two shall consist of applicants who apply under a vacancy announcement recruiting from all U.S. citizens. The FAA: (1) may not use a biographical assessment when hiring, (2) must provide an individual who applied in response to a specified 2014 vacancy announcement and was disqualified as the result of a biographical assessment an opportunity to reapply under the revised hiring practices, and (3) must waive any maximum age limit for such reapplying applicants who met such requirement when they applied under such announcement. Otherwise, the maximum age limit for an original appointment as an air traffic controller under this bill shall be 35 years of age. The FAA shall consider directly notifying secondary schools and institutes of higher learning of a vacancy announcement for pool one applicants.

Criminal Alien Deportation Enforcement Act of 2016 This bill amends the Foreign Assistance Act of 1961 to prohibit financial assistance to a foreign country that refuses or unreasonably delays the acceptance of an alien who: (1) is a citizen, subject, national, or resident of such country; and (2) has received a final order of removal from the United States. A country shall be deemed to have refused or unreasonably delayed acceptance of an alien if it does not accept such alien within 90 days of receiving an authorized repatriation request. The Department of Homeland Security shall submit a report to Congress every three months that: (1) lists the countries that refuse or unreasonably delay repatriation; and (2) includes the total number of aliens who were refused repatriation, organized by country, detention status, and criminal status. A listed country shall be subject to U.S. entry and financial assistance prohibitions unless it issues appropriate travel documents: (1) within 100 days after such report's submission for aliens convicted of a crime committed in the United States, and (2) within 200 days after such report's submission for all other aliens. A victim (or an immediate family member thereof) of a crime committed by any alien who has been issued a final order of removal shall have standing in federal district court to enforce entry and financial prohibitions. The Immigration and Nationality Act is amended to: (1) discontinue granting visas to a subject, national, or resident of a listed country unless the country has issued the appropriate travel documents pursuant to this bill; and (2) grant standing to enforce such provision in federal district court to a victim (or an immediate family member thereof) of a crime committed by any alien who has been issued a final order of removal.

North Korea State Sponsor of Terrorism Designation Act of 2016 This bill expresses the sense of Congress that North Korea meets the criteria for, and should be designated as, a state sponsor of terrorism. The President shall submit to Congress a report that finds, with respect to each of 22 acts specified by this bill, whether: (1) North Korea or any of its agents or instrumentalities committed, conspired to commit, attempted, or abetted such act; and (2) such act constitutes support for international terrorism. If the President finds that North Korea or its agents or instrumentalities committed any of such acts, the Department of State shall submit to Congress: (1) a determination that North Korea is a state sponsor of terrorism, or (2) a detailed justification as to why the conduct does not meet the legal criteria for such a determination.

(Guarantee fees are charged by enterprises, such as the Federal National Mortgage Association [Fannie Mae] and the Federal Home Loan Mortgage Corporation [Freddie Mac], to guarantee the payment of principal and interest on loans. This bill prevents the fees from being used to offset provisions that increase the deficit in determining whether a budget point of order applies to legislation.)

United States Naval Station Guantanamo Bay Preservation Act This bill prohibits any action to modify, abrogate, or replace the stipulations, agreements, and commitments contained in the Guantanamo Lease Agreements, or to impair or abandon the jurisdiction and control of the United States over Naval Station, Guantanamo Bay, Cuba, unless specifically authorized or otherwise provided by: a statute enacted on or after the enactment of this Act; a treaty ratified with the advice and consent of the Senate on or after enactment of this Act; or a modification of the Treaty Between the United States of America and Cuba signed at Washington, DC, on May 29, 1934, that is ratified with the advice and consent of the Senate on or after enactment of this Act. "Guantanamo Lease Agreements" means: the Agreement Between the United States of America and the Republic of Cuba for the Lease to the United States of Lands in Cuba for coaling and naval stations, signed by the President of the United States on February 23, 1903; and the Lease to the United States by the Government of Cuba of Certain Areas of Land and Water for Naval or Coaling Stations, signed by the President of the United States on October 2, 1903.

Transparency and Accountability of Failed Exchanges Act This bill amends the Patient Protection and Affordable Care Act (PPACA) to require the Department of Health and Human Services, for certain states awarded a grant to establish a health insurance exchange, to report on how awarded amounts were used and rescind unobligated amounts. This applies to any state that terminates operation of its exchange or transfers operation to another entity. Such a state must provide to the General Services Administration any property acquired through the grant and refer matters involving fraud, waste, and abuse of funds issued pursuant to PPACA to the Department of Justice. Funds rescinded must be retained for federal budget deficit reduction.

American Security Against Foreign Enemies Act of 2015 or the American SAFE Act of 2015 This bill requires that, in addition to the Department of Homeland Security (DHS) screening, the Federal Bureau of Investigation (FBI) shall take all actions necessary to ensure that each covered alien receives a background investigation before U.S. refugee admission. A "covered alien" is any alien applying for U.S. refugee admission who: is a national or resident of Iraq or Syria, has no nationality and whose last habitual residence was in Iraq or Syria, or has been present in Iraq or Syria at any time on or after March 1, 2011. A covered alien: may not be admitted as a refugee until the FBI certifies to DHS and the Director of National Intelligence (DNI) that he or she has received a background investigation sufficient to determine whether the alien is a U.S. security threat; and may only be admitted to the United States after DHS, with the unanimous concurrence of the FBI and the DNI, certifies to Congress that he or she is not such a threat. The Inspector General of DHS shall conduct annual risk-based reviews of all certifications. DHS shall report monthly to Congress on the total number of admission applications for which a certification was made and the number of covered aliens for whom such a certification was not made for the preceding month. The report shall include for each covered alien for whom a certification was not made the concurrence or nonconcurrence of each person whose concurrence was required by the certification.

Stopping EPA Overreach Act of 2015 This bill amends the Clean Air Act to exclude carbon dioxide, water vapor, methane, nitrous oxide, hydrofluorocarbons, perfluorocarbons, and sulfur hexafluoride pollution from the scope of that Act. The bill declares that current law does not authorize or require the regulation of climate change or global warming and nullifies certain proposed rules relating to greenhouse gas and carbon pollution emissions. Before proposing or finalizing regulations or policies, the Environmental Protection Agency must analyze the net and gross impact of those regulations and policies on employment. Regulations and policies may not take effect if they have a negative impact on employment, unless they are approved by Congress and signed by the President.

Reach Every Mother and Child Act of 2015 This bill directs the President to: establish a five-year strategy to achieve, with target countries and donors, the goal of ending preventable maternal, newborn, and child deaths globally and ensure healthy and productive lives within a generation; and provide assistance to implement the strategy. The President shall designate a current U.S. Agency for International Development (USAID) employee serving in the Senior Executive Service or at the level of a Deputy Assistant Administrator or higher to serve concurrently as the Maternal and Child Survival Coordinator, who shall be responsible for: overseeing such strategy, and all U.S. government funds appropriated or used for international maternal and child health and nutrition programs. The U.S. government, through USAID and other relevant executive branch agencies, should identify and remove financial barriers to strengthen access to delivery systems for vulnerable and marginalized populations by leveraging public and private capital to expand delivery of interventions for maternal, newborn, and child health.

Cuba Agricultural Exports Act This bill amends the Trade Sanctions Reform and Export Enhancement Act of 2000 to exempt from prohibitions against U.S. assistance to Cuba any exports under the market access program, the export credit guarantee program, and the foreign market development cooperator program, including any federal commodity promotion program obligations or expenditures of funds. This exemption shall not apply if the U.S. assistance recipient would be an entity controlled by the Cuban government, including the armed forces, the Ministry of the Interior, or any subdivision of either governmental entity. A person subject to U.S. jurisdiction may invest in the development of an agricultural business in Cuba if the Department of State and the Department of Agriculture jointly determine that the agricultural business: is not controlled by the government of Cuba, including the armed forces, the Ministry of the Interior, or any subdivision of either governmental entity; and does not traffic in property of persons subject to U.S. jurisdiction which was confiscated by Cuba on or after January 1, 1959. Certain language limiting financing of agricultural sales to Cuba is repealed.

Positive Train Control Enforcement and Implementation Act of 2015

Positive Train Control Enforcement and Implementation Act of 2015 This bill extends deadlines and modifies requirements for railroad carriers and providers of intercity or commuter rail passenger transportation to implement positive train control (PTC) systems. (A PTC system is a communications and signaling system designed to prevent train-to-train collisions, over-speed derailments, incursions into established work zone limits, and the movement of a train through a switch left in the wrong position. Railroads which carry passengers or have high-volume freight traffic with certain hazardous materials are required to implement a PTC system.) Within 60 days of enactment of this bill, each Class I railroad carrier (the largest operators by revenue) and provider of intercity or commuter rail passenger transportation must submit to the Department of Transportation (DOT) a plan for implementing PTC by December 31, 2018, instead of the December 31, 2015, deadline required under current law. DOT may extend the deadline if specified requirements are met. The revised plan must include a detailed schedule and sequence for fully implementing PTC in a manner that complies with specified regulations, and railroads must implement PTC in accordance with the plan. DOT may authorize a railroad carrier or other entity to begin the provisional operation of a PTC system without the required certification if it is necessary to enable the safe implementation of PTC in phases.

The Secretary must appear before the House Ways and Means Committee and the Senate Finance Committee to submit a report including: the historic, current, and projected levels of the debt; the drivers and composition of future debt; and how the U.S. will meet debt obligations if the debt limit is raised. The Secretary must also provide a detailed explanation of: proposals of the President to reduce the debt and a progress report on implementing them; the impact an increased debt limit will have on future government spending, debt service, and the position of the U.S. dollar as the international reserve currency; and projections of the fiscal health and sustainability of major entitlement programs (including Social Security, Medicare, and Medicaid). The Department of the Treasury must make the information required by this bill available to the public on the Treasury website.

Academic Partnerships Lead Us to Success or the A PLUS Act   This bill allows each state to receive federal elementary and secondary education funds on a consolidated basis and manage the funds to advance the educational policy of the state. States must submit to the Department of Education a declaration of intent no less than every five years. Each declaration must be formulated by a combination of specified state officials or by referendum and must list the programs for which consolidated funding is requested. States may use such funds for any educational purpose permitted by state law, but must make certain assurances that they will use fiscal control and fund accounting procedures, abide by federal civil rights laws, advance educational opportunities for the disadvantaged, and use federal funds to supplement rather than supplant state funding. Each declaration state shall: (1) inform the public about its student achievement assessment system; (2) report annually on student progress toward the state's proficiency standards by specified student groups; and (3) provide for the equitable participation of private school children and teachers in the same manner as provided for under current law.

Employee Rights Act

Employee Rights Act Amends the National Labor Relations Act (NLRA) to make it an unlawful labor practice for a labor organization or its agents to interfere with the rights of employees to organize and select representation to collectively bargain. Adds a requirement that representatives be selected by secret ballot in an election conducted by the National Labor Relations Board (NLRB) by a majority of the employees in a unit. Defines "majority" for purposes of determining the majority of employees in an election to mean the majority of all employees in the unit, and not the majority of employees voting in the election. Requires the NLRB, in cases where an existing certified or voluntarily recognized bargaining unit experiences turnover, expansion, or alteration by merger of more than 50% of the unit's employees, to conduct a secret paper ballot among the unit employees: (1) between the 120th day and 110th day before the collective bargaining agreement's expiration or before the end of three years, if there is an agreement between the labor organization and the employer; or (2) within 30 days, if there is no agreement between such parties. Requires the NLRB to decide, before the election of a labor organization as the exclusive collective bargaining representative of all employees of an appropriate unit, whether such unit shall be the employer unit, craft unit, plant unit, or subdivision unit. Requires the NLRB to give 14 days advance notice before a hearing when it is investigating an election petition if it has reasonable cause to believe that a question of representation affecting commerce exists. Revises the requirement that the NLRB direct an election by secret ballot, and certify its results, whenever it finds upon the record of such a hearing that a question of representation exists. Adds a requirement that the NLRB also review all post-hearing appeals before finding that such a question exists. Requires an employer to provide the NLRB a list consisting only of employee names and home addresses of all eligible voters within 7 days after an NLRB determination of the appropriate unit or following any agreement between the employer and the labor organization regarding eligible voters. Prohibits an election after the filing of a petition unless and until: (1) a hearing is conducted before a qualified hearing officer on any and all material, factual issues regarding jurisdiction, statutory coverage, appropriate unit, unit inclusion or exclusion, or eligibility of individuals; and (2) the issues are resolved by a regional Director, subject to appeal and review, or by the NLRB. Declares that election results shall not be final nor any labor organization be certified as a bargaining representative unless the NLRB has ruled on: (1) each pre-election issue not resolved before the election; and (2) the NLRB conducts a hearing and resolves each issue pertaining to the conduct or results of the election. Makes any labor organization found to have interfered with, restrained, or coerced employees in the exercise of their rights to form or join a labor organization or to refrain from forming or joining (including the filing of a decertification petition) liable for lost wages and unlawfully collected union dues and fees, if any, and an additional amount as liquated damages. Amends the Labor-Management Reporting and Disclosure Act of 1959 (Landrum-Griffin Act) to permit an election by secret ballot to be conducted through votes cast by electronic ballot cast in the privacy of a voting booth. Requires every employee in a bargaining unit represented by a labor organization, regardless of membership status, to have the same right as members to vote by secret ballot to ratify a collective bargaining agreement with, or to engage in, a strike or refusal to work of any kind against their employer. Prohibits the use of an employee's union dues for any purpose not directly related to the labor organization's collective bargaining, unless that employee authorizes such expenditure in writing. Prohibits a strike without the consent of a majority of all unit employees affected, determined by a secret ballot vote conducted by a neutral, private organization chosen by agreement between the employer and the labor organization. Requires each labor organization to make the independently verified annual audit report of its financial condition and operations available to all of its members and represented nonmembers. Makes it unlawful for a person to use force or violence, or threaten the use of force or violence, to restrain, coerce, or intimidate a person, or attempt to, in order to obtain from any person any right to represent employees, compensation, or other term or condition of employment. Subjects persons who willfully violate such prohibitions to both civil and criminal penalties.

Baseline Reform Act of 2015

Baseline Reform Act of 2015 This bill amends the Balanced Budget and Emergency Deficit Control Act of 1985 to change the assumptions used in calculating the baseline for discretionary spending, which is the spending that is provided and controlled by appropriations bills. The baseline is a projection of federal spending and receipts during the fiscal year under current law. It is used by the Congressional Budget Office (CBO) and the Office of Management and Budget (OMB) to estimate the cost of legislation and produce other budget projections. The bill requires the baseline to cover a ten-year period and changes the assumptions the CBO and the OMB must use to project discretionary spending. It eliminates adjustments required under current law for inflation, expiring housing contracts, social insurance administrative expenses, and changes in federal pay and other benefits. By removing these adjustments, the bill requires the baseline to assume that discretionary spending will continue without an increase or a decrease to account for these factors. The bill also requires the CBO to annually submit to the congressional budget committees by July 1 the Long-Term Budget Outlook for the fiscal year beginning on October 1 and at least the next 40 fiscal years.

The restriction will not apply in cases of rape or incest or where a physical condition endangers a woman's life unless an abortion is performed. The Department of Health and Human Services and the Department of Agriculture must seek repayment of federal assistance received by Planned Parenthood Federation of America, Inc., or any affiliate or clinic, if it violates the terms of the certification required by this Act.
