Guarantees that individuals subjected to polygraph tests be furnished a copy of the results, and specifies that no action may be taken based solely on the results of such testing.

An amendment in the nature of a substitute numbered 18 printed in House Report 108-566 to 1) require sequestration of mandatory spending in the event that OMB baseline estimates of mandatory spending exceed previous estimates due to enacted legislation; 2) require baseline estimates to exclude emergency spending; 3) provide an exception for outlay components of certain expiring receipts legislation when making estimates of mandatory spending legislation; 4) change the start date of the fiscal year to November 1; 5) require sunsetting of all Federal programs (except earned entitlements) effective October 1, 2006, unless reauthorized prior to that date; 6) requires an adjustment to Appropriations Committee 302(a) allocations to ensure that the transportation guarantees contemplated in TEALU and Vision 100 are fully met; and 7) make technical and conforming changes to the Balanced Budget and Emergency Deficit Control Act of 1985.

An amendment to insert the provisions of H.R. 1536 as a substitute for the existing text. The amendment would allow the use of polygraph testing under certain conditions. Notice must be provided stating that such tests are voluntary. It would prohibit any questions dealing with religious, racial, political, labor rights views, and sexual preference except in certain instances (eg. day care jobs). It permits the subject to terminate the test at any time, quarantees the subject a copy of the results of the exam, and specifies that no action may be taken solely in the results of a polygraph test. Minimum standards on test examiners would be imposed. In addition, the amendment would permit states to adopt more stringent standards, and provide relief for violations of the bill and make other changes.

Amendment· HAMDTHAMDT 284 (98th)passed

An amendment to add to the prohibition against military or paramilitary aid in Nicaragua by the CIA or other U.S. entity, that the prohibition shall take effect only if the Nicaraguan government enters into an agreement with other countries of the region not to support military or paramilitary operations by antigovernment forces in any other Central American country. The agreement must be verifiable. Also a Sense of Congress is added to the bill that the President should convene a national bipartisan commission to address the long term problems of security, poverty and democratic development in Central America. The commission is to help build a national consensus in support of the policy, consult with Central American leaders and submit a report to Congress in 180 days.
