One Federal Decision Act of 2021

United States · United States Congress · 11 March 2021

One Federal Decision Act of 202 1 This bill provides statutory authority for the policy that requires federal agencies to coordinate environmental reviews and authorization decisions for major infrastructure projects. It also sets a goal for completing environmental reviews within two years. The Department of Transportation (DOT) must review existing practices, procedures, programmatic agreements, and applicable laws to identify potential changes that would facilitate an efficient environmental review process for projects. All authorization decisions for construction of a major project must be completed within 90 days of the issuance of a record of decision for the project, although the lead agency could extend the deadline in some cases. The lead agency must develop an environmental review schedule with the project sponsor that is consistent with an agency average of not more than two years for the completion of the environmental review process for major projects. DOT must also (1) establish a performance accountability system to track each major project, and (2) provide other relevant federal agencies with a list of categorical exclusions under the National Environmental Policy Act that are applicable to highway projects and that would accelerate project delivery. The bill also eliminates the two-year limitation on filing claims seeking judicial review of permits, licenses, or approvals issued by a federal agency for railroad projects.

No Taxpayer Funding for Abortion and Abortion Insurance Full Disclosure Act of 2021

United States · United States Congress · 5 February 2021

No Taxpayer Funding for Abortion and Abortion Insurance Full Disclosure Act of 2021 This bill modifies provisions relating to federal funding for, and health insurance coverage of, abortions. Specifically, the bill prohibits the use of federal funds for abortions or for health coverage that includes abortions. Such restrictions extend to the use of funds in the budget of the District of Columbia. Additionally, abortions may not be provided in a federal health care facility or by a federal employee. Historically, language has been included in annual appropriations bills for the Department of Health and Human Services (HHS) that prohibits the use of federal funds for abortions—such language is commonly referred to as the Hyde Amendment. Similar language is also frequently included in appropriations bills for other federal agencies and the District of Columbia. The bill makes these restrictions permanent and extends the restrictions to all federal funds (rather than specific agencies). The bill's restrictions regarding the use of federal funds do not apply in cases of rape, incest, or where a physical disorder, injury, or illness endangers a woman's life unless an abortion is performed. The Hyde Amendment provides the same exceptions. The bill also prohibits qualified health plans from including coverage for abortions. Currently, qualified health plans may cover abortion, but the portion of the premium attributable to abortion coverage is not eligible for subsidies.

United States · United States Congress · 28 January 2021

The program provides Medicare payments in advance to eligible providers experiencing claims or cash flow disruptions, such as during national emergencies; the program was specifically expanded in response to COVID-19 to encompass more types of providers, subject to certain recoupment and repayment provisions. The bill allows the Centers for Medicare & Medicaid Services to forgive repayment, extend the recoupment timeline, and lower applicable interest rates for hospitals experiencing significant financial hardship (e.g., impending bankruptcy).

American Family and Private Property Defense Act

United States · United States Congress · 21 July 2020

American Family and Private Property Defense Act This bill establishes various defenses a defendant charged with a crime of violence may assert and contains other related provisions. It shall be an affirmative defense if the defendant used force, including deadly force, against another person if the defendant reasonably believed such force was necessary to defend the defendant or a third party from what the defendant reasonably believed was the person's use (or imminent use) of unlawful force. (An affirmative defense allows a defendant to escape criminal liability, but the defendant has the burden to prove that the defendant is entitled to the defense.) A defendant who used deadly force may also assert this defense if the force was used against a person who unlawfully enters, attempts to unlawfully enter, or remains after unlawfully entering the private property lawfully occupied by a third party. If such a defendant was the initial aggressor, the defendant may still assert this affirmative defense in certain instances. A defendant has no duty to retreat from any location where the defendant has a right to be. The bill also establishes an affirmative defense for a defendant who used physical force on another to the extent the defendant reasonably believed such force was necessary to prevent what the defendant reasonably believed to be the commission or attempted commission of theft or damage of property. Evidence of a defendant suffering from battered spouse syndrome shall be admissible as to the issue of whether the defendant lawfully acted in self-defense or defense of another.
