Federal Acceleration of State Technologies Deployment Act of 2009 or the FAST Deployment Act of 2010 - Directs the Assistant Secretary of Commerce for Economic Development to establish a Federal Acceleration of State Technologies (FAST) Deployment Program to distribute matching federal funds to qualifying states. Requires each qualified state to use FAST grant funds exclusively for making assistance grants to small manufacturing enterprises for approved technology development projects. Establishes a national manufacturing technology database to disseminate to U.S. manufacturers information related to new U.S. manufacturing technologies. Requires an annual assessment of small manufacturing technology needs and information from such assessment to be incorporated into the database.

Unborn Child Pain Awareness Act of 2010 - Amends the Public Health Service Act to require an abortion provider who knowingly performs an abortion of a pain-capable unborn child (defined as an unborn child who has reached a probable stage of development of 20 weeks or more after fertilization), to first: (1) inform the woman of the probable age of the child; (2) provide to the woman an Unborn Child Pain Awareness Brochure (unless she waives receipt); (3) provide information that pain medicine administered to the mother may not prevent pain in the child, but in some cases anesthesia or pain-reducing drugs can be administered directly to the child; (4) give the woman the provider's best medical judgment of the risks and costs of such anesthesia or analgesic; and (5) obtain the woman's signature on the Unborn Child Pain Awareness Decision Form and her explicit request for or refusal of the administration of drugs to the child. Requires the Secretary of Health and Human Services (HHS) to develop the Unborn Child Pain Awareness Brochure that includes a statement that there is substantial evidence that the process of being killed in an abortion will cause the unborn child pain and that the mother has the option of having pain-reducing drugs administered directly to the child. Creates an exception to save the life of the mother. Establishes civil penalties for willfully failing to comply with this Act. Authorizes: (1) the U.S. Attorney General to bring a civil action under this Act; and (2) private rights of action for violations of this Act.

Tax Hike Prevention Act of 2010 - Repeals the general terminating date (i.e., December 31, 2010) applicable to tax relief provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA), thus making such provisions permanent. Repeals the provision of the Jobs and Growth Tax Relief Reconciliation Act of 2003 terminating the reductions in tax rates for capital gains and dividends, thus making such reductions permanent. Repeals provisions of EGTRRA repealing the estate and generation-skipping transfer taxes after 2009, thus restoring such taxes, subject to the amendments made by this Act. Restores the step-up in basis tax treatment of inherited estate assets. Amends the Internal Revenue Code to: (1) provide for annual increases in the alternative minimum tax (AMT) exemption amount during the period of 2010 through 2020; (2) expand offsets against the AMT for certain nonrefundable tax credits; (3) retain marriage penalty relief provisions and the increased child tax credit; (4) revise the estate tax by imposing a permanent maximum estate tax rate of 35% and allowing a permanent estate tax exclusion amount of $5 million (adjusted annually for inflation) after 2009; and (5) allow a surviving spouse to increase the estate tax exclusion amount by the unused exclusion amount of his or her deceased spouse. Allows the executor of any estate of a decedent dying in 2010 to elect to apply existing provisions of the Internal Revenue Code of 1986 without regard to specified provisions of this Act.

Excluding Abortion Coverage from Health Reform Act - Amends the Patient Protection and Affordable Care Act to prohibit federal funds from being to used to cover any part of the costs of any health plan that includes coverage of abortion services. (Currently, federal funds cannot be used for abortion services and plans receiving federal funds must keep federal funds segregated from any funds for abortion services.) Requires any qualified health benefit plan offered through an Exchange that includes coverage for abortions to also offer a qualified health benefit plan through the Exchange that is identical in every respect except that it does not cover abortions.

Pulmonary Fibrosis Research Enhancement Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC), to: (1) establish the National Pulmonary Fibrosis Advisory Board; (2) develop a system to collect data on pulmonary fibrosis and other interstitial lung diseases; and (3) establish the National PF Registry. Requires the Secretary, in developing the Registry, to: (1) expand and coordinate existing data and surveillance systems, surveys, registries, and other federal public health and environmental infrastructure; and (2) provide for research access to pulmonary fibrosis data. Directs the Secretary to ensure that epidemiological and other types of information are made available to the National Institutes of Health (NIH) and the Department of Veterans Affairs (VA). Requires the Director of CDC to prepare the National Pulmonary Fibrosis Education and Awareness Plan, which shall: (1) focus on strategies to increase public education and awareness of pulmonary fibrosis; (2) address the need for new physician education strategies to improve diagnosis and treatment standards; and (3) assess and monitor the costs of pulmonary fibrosis and its burden on patients and families. Encourages the Director of the National Heart, Lung, and Blood Institute to expand, intensify, and coordinate Institute pulmonary fibrosis research activities.

Oil Spill Response Improvement Act of 2010 - Amends the Outer Continental Shelf Lands Act (OCSLA) to direct the Secretary of the Interior to establish: (1) no more than two bureaus, to which the functions of the Minerals Management Service shall be transferred, which shall implement leasing, permitting, and safety and environmental regulatory functions relating to the outer Continental Shelf (OCS); (2) an office to implement royalty and revenue management functions; and (3) an OCS Safety and Environmental Advisory Board. Authorizes the National Transportation Safety Board (NTSB), upon the Secretary's request, to conduct an independent investigation of any accident occurring in the OCS and involving activities under this Act. Establishes the Ocean Energy Enforcement Fund as a depository for inspection fees imposed by the Secretary to offset the annual expenses of inspections of OCS facilities. Requires the Secretary of Energy, acting through the Energy Information Administration, to report to certain congressional committees monthly evaluations of the effect upon employment and small businesses of the moratoria following the April 20, 2010, blowout and explosion of the mobile offshore drilling unit Deepwater Horizon . Amends the Energy Policy Act of 2005 to direct the Secretary of Energy to implement a deepwater (in lieu of ultra-deepwater) technologies research and development program addressing technology challenges for well control and accident prevention. Revises the petroleum resources research and development program to replace ultra-deepwater activities with deepwater architecture, well control and accident prevention, and deepwater technology, including drilling to deep formations in waters deeper than 500 feet (currently, deeper than 15,000 feet). Directs the Secretary of Energy to ensure the safe and environmentally responsible production of domestic natural gas and other petroleum resources. Replaces the Ultra-Deepwater Advisory Committee and the Unconventional Resources Technology Advisory Committee with a Program Advisory Committee. Establishes the National Commission on Outer Continental Shelf Oil Spill Prevention. Instructs the Secretary and the Secretary of the Department in which the Coast Guard is operating to issue joint regulations requiring systems used in OCS offshore exploration, development, and production of oil and gas to be constructed and operated to meet specified standards necessary to protect the health and safety of affiliated workers and prevent environmental degradation. Amends the Oil Pollution Act of 1990 to direct the President to establish limits on strict liability for incidents occurring from offshore facilities (other than deepwater ports) covered by OCS leases issued after enactment of this Act. States that economic damages that exceed certain amounts shall be paid: (1) up to $20 billion by all other entities operating OCS offshore facilities; and (2) then from the Oil Spill Liability Trust Fund (FUND). Amends the Oil Pollution Act of 1990 to direct the President to issue regulations allowing advance payments from the Fund for state and local actions taken to prepare for and mitigate substantial threats from an oil discharge. Amends the Internal Revenue Code to suspend the Oil Spill Liability Trust Fund financing rate in any calendar quarter in which the unobligated balance in the Fund is greater than $10 billion. Amends the Oil Pollution Act of 1990 to direct the Interagency Coordinating Committee on Oil Pollution Research (Interagency Committee) to establish a regional subcommittee for each of the Gulf of Mexico and Arctic regions of the United States. Requires the Interagency Committee to: (1) coordinate a comprehensive federal oil spill research and development program; (2) establish an oil pollution research, technology development, and demonstration grant program; and (3) submit to Congress an assessment of the status of oil spill prevention and response capabilities, as well as annual federal interagency oil spill research and development plans. Directs the Coast Guard to conduct environmental studies of oil discharge prevention or mitigation technologies. Authorizes the Incident Commander of the Coast Guard to use dispersants in response to a spill of oil from: (1) any facility or vessel located in, on, or under any navigable waters of the United States; and (2) any facility subject to the jurisdiction of the United States and that is located in, on, or under any other waters. Instructs the Commandant of the Coast Guard to: (1) establish a Maritime Center of Expertise for Maritime Oil Spill and Hazardous Substance Release Response, and within it a program for release response; (2) maintain a National Strike Force to respond to maritime oil spill and hazardous substance release incidents; and (3) maintain district preparedness response teams. Amends the Federal Water Pollution Control Act to: (1) authorize the President to deploy cleanup and mitigation assets immediately to the location of discharge; and (2) add certain requirements to the National Contingency Plan. Amends the OCSLA to prescribe allocation requirements for OCS post leasing revenue sharing for specified coastal states and the Alaska Adjacent Zone. Amends the Gulf of Mexico Energy Security Act of 2006 regarding allocation of revenue sharing among certain Gulf producing states. Amends the OCSLA to direct the Secretary to require that oil produced from federal leases in specified Arctic waters be transported by pipeline to the Trans-Alaska Pipeline System. Rescinds certain stimulus funds under the American Recovery and Reinvestment Act of 2009 to offset any net increase in spending or foregone revenues resulting from this Act. States that the moratorium on certain OCS offshore permitting and drilling activities, including any suspension of operations issued in connection with the moratorium, shall not apply to a drilling permit applicant if the Secretary makes certain determinations. Directs the Secretary to develop and implement a plan to ensure that onshore oil and natural gas development on federal land would provide full energy resource compensation for offshore oil and natural gas resources not being developed, and federal revenues not being generated for the benefit of the Treasury, during the time that any offshore moratorium is in place in response to the Deepwater Horizon incident .

Data Security Act of 2010 - Prescribes security procedures which an entity that maintains or communicates sensitive account or personal information must implement and enforce in order to protect the information from an unauthorized use likely to result in substantial harm or inconvenience to the consumer. Grants exclusive enforcement powers to specified federal regulatory agencies with oversight of financial institutions. Denies a private right of action, including a class action, regarding any act or practice regulated under this Act. Prohibits any civil or criminal action in state court or under state law relating to any act or practice governed under this Act. Prescribes data security standards to be implemented by federal agencies. Preempts state law with respect to the responsibilities of any person to protect against and investigate such data security breaches and mitigate any losses or harm resulting from them.

Amends the Credit Card Accountability Responsibility and Disclosure Act of 2009 to state that, in the case of a gift certificate, store gift card, or general-use prepaid card produced before April 1, 2010, the effective date of the certain disclosure requirements under the Electronic Funds Transfer Act pertaining to fees shall be delayed until January 31, 2011. Requires the issuer of such a certificate or card, as a condition of such delayed effective date, to: (1) comply with a specified prohibition against and certain requirements for the imposition of any dormancy, inactivity, or service fees; (2) consider any such certificate or card for which funds expire to have no expiration date with respect to the underlying funds; (3) replace, at consumer request, any such certificate or card that has funds remaining at no cost to the consumer; and (4) comply with certain consumer rights disclosure requirements.

Securing Aircraft From Explosives Responsibly: Advanced Imaging Recognition Act of 2010 or SAFER AIR Act of 2010 - Expresses the sense of Congress that the Department of Homeland Security (DHS) should: (1) increase efforts to address privacy concerns regarding the screening of passengers using advanced imaging technology at airports; and (2) conduct additional testing of advanced imaging technology; and (3) deploy technology to standardize images, remove personally identifying characteristics, while providing transportation security officers with necessary information, and upgrade equipment to detect new threats without major capital expenditures. Declares it to be U.S. policy to aggressively seek, develop, and timely deploy primary screening technologies capable of detecting and protecting against threats to domestic and international aviation travel that cannot be effectively and efficiently detected by other technologies currently more commonly used, such as metal detectors. Directs the Secretary to ensure that advanced imaging technology and other advanced technology with capability to detect weapons, on-body plastic explosives, and other nonmetallic explosives are timely deployed for the primary screening of aircraft passengers. Requires the Secretary to provide passengers with an option for primary screening other than the use of such technologies. Requires all advanced imaging technology equipment used at airport checkpoints to be configured so that passenger: (1) images are not retained; and (2) facial features are blurred, while allowing detection of individual on-body threats. Prohibits DHS employees from having cameras or cell phones present while viewing such images. Requires such employees to communicate with other DHS employees using a wireless headset or another comparable method of communication that does not allow for the transmission of the image.

Central Rockies Land Exchange and National Park System Enhancement Act of 2010 - Requires the Secretary of the Interior (Secretary), if the Bear Ranch, LLC, offers to convey all interest in specified non-federal parcels of land within the Curecanti National Recreation Area in Gunnison County, Colorado, and Dinosaur National Monument in Uintah County, Utah, for inclusion in the National Park System, to accept the offer and the Secretary and the Secretary of Agriculture (USDA) to convey to the Ranch all interest of the United States in specified federal land under the jurisdiction of the Bureau of Land Management (BLM) or the United States Forest Service. Requires the USDA Secretary, if the Darien Ranch offers to convey all interest in certain non-federal land in Gunnison County, to accept the offer, and upon receipt of such land, to convey to the Ranch a permanent right-of-way of no more than 200 feet in width for a water intake on Rapid Creek and water pipeline (and access to such intake and pipeline) running along an existing irrigation ditch from the Creek to private land. Requires the values of the federal and non-federal lands in each separate land exchange to be equal and to be determined by appraisals performed in accordance with this Act. Requires lands acquired by the Secretary and the USDA Secretary, respectively, to become part of: (1) the Curecanti National Recreation Area or Dinosaur National Monument; and (2) the unit of the National Forest System in which the land is located. Requires implementation of a travel management plan for the design, construction, improvement, replacement, or other siting of roads, trails, and trailheads in the Anthracite-Spring Creek Travel Planning Area.

Secure Federal File Sharing Act - Requires the Director of the Office of Management and Budget (OMB) to issue guidance to: (1) prohibit the download, installation, or use by government employees and contractors of open-network peer-to-peer file sharing software on all federal computers, computer systems, and networks, unless approved in accordance with procedures under this Act; and (2) address the download, installation, or use by government employees and contractors of such software on home or personal computers as it relates to telework and remotely accessing federal computers, computer systems, and networks. Requires the Director to develop a procedure for receiving requests from heads or chief information officers of agencies for approval for use by government employees and contractors of specific open-network peer-to-peer file sharing software programs that are: (1) necessary for day-to-day business operations, for use in the course of a law enforcement investigation, or to perform official agency business; or (2) instrumental in completing a particular task or project that directly supports the agency's overall mission. Requires the Director to direct agencies to: (1) establish or update personal use policies to be consistent with the guidance issued under this Act; (2) require contracts to require contractor compliance with that guidance; (3) update their information technology security or ethics training policies to ensure that all employees are aware of the requirements of that guidance and the consequences of engaging in prohibited conduct; and (4) ensure that proper security controls are in place to prevent, detect, and remove file sharing software that is prohibited. Provides that nothing in this Act shall be construed to require the disclosure of any information relating to any confidential government operation or investigation.

American Energy and Western Jobs Act - Rescinds Bureau of Land Management (BLM) Instruction Memoranda numbered 2010-117 (Oil and Gas Leasing Reform – Land Use Planning and Lease Parcel Reviews) and 2010-118 (Energy Policy Act Section 390 Categorical Exclusion Policy Revision), issued on May 17, 2010, and declares that they shall have no force or effect. Amends the Mineral Leasing Act to direct the Secretary of the Interior, before modifying and implementing any onshore oil or natural gas preleasing or leasing and development policy, to complete an economic impact assessment and determine that the proposed modification will not: (1) result in a detrimental impact on employment opportunities relating to oil- and natural gas-related development; (2) contribute to an increase in the domestic use of imported petroleum resources; or (3) contribute to an aggregate loss of oil and natural gas receipts.

Expresses the sense of the Senate that: (1) the United Nations Convention on the Rights of the Child is incompatible with the U.S. Constitution, laws, and traditions; (2) the Convention would undermine presumptions of freedom and independence for U.S. families; (3) the Convention would interfere with the principles of U.S. sovereignty, independence, and self-government that preclude the propriety of adopting international law to govern domestic matters; and (4) the President should not transmit the Convention to the Senate for its advice and consent.

Requires the Administrator of the Environmental Protection Agency (EPA) to delay the implementation of the final rules entitled "Lead; Renovation, Repair, and Painting Program; Lead Hazard Information Pamphlet; Notice of Availability; Final Rule" (published on April 22, 2008) and "Lead; Amendment to the Opt-out and Recordkeeping Provisions in the Renovation, Repair, and Painting Program" (signed by the Administrator on April 22, 2010) in each state until accredited certified renovator classes to train contractors in practices necessary for compliance with such rules have been held in such state for at least a year. Requires the Administrator to: (1) monitor each state to determine when such classes are offered; and (2) notify each Member of Congress about the location and time of each such class held in their state and the date on which the classes have been held for one year.

Expresses support for the designation of June 2010 as National Hereditary Hemorrhagic Telangiecstasia (HHT) month. Recognizes: (1) the need to pursue research to find better treatments and a cure for HHT; (2) the HHT Foundation International as the only U.S. advocacy organization working to find a cure for HHT while saving the lives and improving the well-being of individuals and families affected; (3) the importance of comprehensive care centers in providing complete care and treatment for HHT patients; (4) that stroke, lung, and brain hemorrhages can be prevented through early diagnosis, screening, and treatment of HHT; (5) that severe hemorrhages in the nose and gastrointestinal tract can be controlled through intervention and that heart failure can be managed through proper diagnosis and treatments of HHT; and (6) that a leading medical and academic institution estimated that $6.6 billion of one-time health care costs can be saved through aggressive management of HHT in the at-risk population. Acknowledges the need to identify the approximately 90% of the HHT population that has not yet been diagnosed and that is at risk for death or disability due to sudden rupture of the blood vessels in major organs in the body.

Second Amendment Enforcement Act - Amends specified law prohibiting the killing of wild birds and wild animals in the District of Columbia to declare that nothing in it or any other provision of law shall authorize or be construed to permit the Council, the Mayor, or any governmental or regulatory authority of the District to prohibit, constructively prohibit, or unduly burden the ability of persons otherwise not prohibited from possessing firearms under federal law from acquiring, possessing in their homes or businesses, transporting for legitimate purposes, or using for sporting, self-protection or other lawful purposes, any firearm neither prohibited by federal law nor subject to the National Firearms Act. Denies the District any authority to enact laws or regulations that discourage or eliminate the private ownership or use of firearms. Declares that nothing in such prohibitions shall be construed to prohibit the District from regulating the carrying of firearms by a person, either concealed or openly, other than at the person's dwelling place, place of business, or on other land possessed by the person. Amends the Firearms Control Regulations Act of 1975 (FCRA) to repeal the definition of a machine gun as any firearm which shoots, is designed to shoot, or can be readily converted or restored to shoot semiautomatically, more than 12 shots without manual reloading. (Thus repeals the ban on semiautomatic weapons.) Redefines "machine gun" as any firearm which shoots, is designed to shoot, or can be readily restored to shoot automatically, more than one shot without manual reloading by a single function of the trigger. Includes also the frame or receiver of any such firearm, any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a firearm into a machine gun, and any combination of parts from which a machine gun can be assembled if such parts are in the possession or under the control of a person. Repeals the District's: (1) registration requirement for possession of firearms; and (2) requirement that licensed firearms dealers keep records of ammunition received into inventory and ammunition sold or transferred. Maintains the current ban on the possession and control of a sawed-off shotgun, machine gun, or short-barreled rifle. Permits a licensed firearms dealer to sell or transfer ammunition, excluding restricted pistol bullets, to persons not otherwise prohibited from possessing or receiving ammunition. Declares that, in the case of a sale or transfer of a handgun to a District resident, a federally licensed importer, manufacturer, or dealer of firearms in Maryland or Virginia shall be treated as a dealer licensed under this Act if: (1) the transferee meets in person with the transferor to accomplish the transfer; and (2) the sale, delivery, and receipt fully comply with the legal conditions of sale in both the District and the jurisdiction in which the transfer occurs. Amends FCRA to allow an individual to possess ammunition in the District if the individual owns (currently, holds the valid registration certificate for) a firearm of the same gauge or caliber as such ammunition. (In effect, repeals the handgun ammunition ban.) Repeals the requirement that firearms in the possession of individuals (other than law enforcement personnel) must be kept unloaded, disassembled, or with the trigger locked, unless the firearm is kept at an individual's place of business, or while being used for lawful recreational purposes within the District . Continues current criminal penalties for allowing access of a minor (under age 16) to loaded firearms, except in specified circumstances. Repeals increased penalties for violations of the prohibition against allowing access of a minor to loaded firearms if injury or death results to the minor or another person. Requires the U.S. attorney, however, to consider both the extent of the minor's injuries and the effect of the minor's injury or death on both of the minor's parents when deciding whether to file charges. Prohibits any prosecution in such circumstances unless the person who committed the violation behaved in a grossly negligent manner, or unless similarly egregious circumstances exist. Eliminates criminal penalties for possessing an unregistered firearm. Amends the District of Columbia Code to: (1) allow private persons or entities owning property in the District to prohibit or restrict the possession of firearms on their property (other than authorized law enforcement personnel or lessees occupying residential or business premises); (2) prohibit unauthorized carrying of rifles or shotguns in the District; (3) authorize certain individuals to carry firearms in certain places and for certain purposes; (4) prescribe requirements for lawful transportation of firearms; and (5) prohibit the use of toy and antique pistols to commit a violent or dangerous crime. Authorizes the District of Columbia to prohibit or restrict the possession of firearms (except to lessees occupying residential or business premises) within any building or structure under its control, or in any area of it, which has implemented security measures to identify and exclude unauthorized or hazardous persons or articles. Amends the Office of Administrative Hearings Establishment Act of 2001 to grant jurisdiction to the Office of Administrative Hearings to hear cases pertaining to denial or revocation of firearm dealer licenses. Repeals the Firearms Registration Amendment Act of 2008 and the Inoperable Pistol Amendment Act of 2008. Restores and revives any provision of law amended or repealed by such Acts as if such Acts had not been enacted into law.

NEPA Certainty Act - Declares that the National Environmental Policy Act of 1969 (NEPA) should not be used to document, predict, or mitigate the climate effects of specific federal actions. Provides that compliance with NEPA does not include consideration of: (1) the greenhouse gas emissions, or any climate change effects of those emissions, of a proposed action and alternative actions; or (2) the relationship of climate change effects to a proposed action or alternatives, including the relationship to proposal design, environmental impacts, mitigation, and adaptation measures. Declares that this Act does not preempt or interfere with: (1) any authority to consider the climate change effects of proposed legislation or regulations specifically addressing greenhouse gas emissions; or (2) requirements to consider the potential effects of climate change on proposals for agency action during planning or design processes under provisions of law other than NEPA.

Prosthetics and Custom Orthotics Parity Act of 2010 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Public Health Service Act to require a group health plan that provides medical and surgical benefits and also provides benefits for prosthetics and custom orthotics to offer such prosthetics and custom orthotics in the same manner as applicable to medical and surgical benefits. Prohibits separate financial requirements or more restrictive treatment limitations. Requires a health plan that does not provide coverage for benefits outside of a network to ensure that such provider network is adequate to ensure enrollee access to prosthetic and custom orthotic devices and related services provided by appropriately credentialed practitioners and accredited suppliers. Limits coverage for required benefits for prosthetics and custom orthotics to the most appropriate device or component that adequately meets the medical requirements of the patient. Requires benefits to include repair and replacement due to normal wear and tear, irreparable damage, a change in the condition of the patient, or as otherwise determined appropriate by the treating physician. Prohibits any annual or lifetime dollar limitation on benefits for prosthetics and custom orthotics unless such limitation applies in the aggregate to all benefits. Directs the Comptroller General to study the effects of the implementation of this Act.

Preserving the American Historical Record Act - Requires the Archivist of the United States to make grants to states to: (1) protect historical records; (2) use such records in new and creative ways; (3) provide education and training to those who care for historical records; and (4) create a wide variety of access tools, including finding aids, documentary editions, indexes, and images of key records maintained on state and local organization websites. Sets forth a formula for the allocation of grant funds to states. Requires the Archivist to consult with state archivists, state secretaries of state, or other appropriate state and local officials who have administrative responsibilities for archival functions.

Recognizes the ultimate sacrifice made by the 29 coal miners lost at the Upper Big Branch Mine-South in Raleigh County, West Virginia. Extends the deepest condolences of the Senate to the families of the fallen coal miners. Honors the survivors of the tragedy. Recognizes all coal miners for enduring the immeasurable loss of co-workers and maintaining courage in the aftermath of the explosion at the Upper Big Branch Mine-South. Commends the valiant efforts of the emergency response workers searching for the missing coal miners. Honors the many volunteers who provided support and comfort for the missing coal miners' families during the rescue and recovery operations.

Early Hearing Detection and Intervention Act of 2010 - Amends the Public Health Service Act to: (1) expand the newborns and infants hearing loss program to include diagnostic services among the services provided; and (2) require the Secretary of Health and Human Services (HHS), acting through the Administrator of the Health Resources and Services Administration, to assist in the recruitment, retention, education, and training of qualified personnel and health care providers to implement the program. Revises program purposes to include: (1) developing and monitoring the efficacy of statewide programs and systems for hearing screening of newborns and infants, prompt evaluation and diagnosis of children referred from screening programs, and appropriate education, audiological, and medical interventions for children identified with hearing loss; (2) developing efficient models to ensure that newborns and infants who are identified with a hearing loss through screening receive follow-up by a qualified health care provider; and (3) ensuring an adequate supply of qualified personnel to meet the screening, evaluation, and early intervention needs of children. Amends the definition of "early intervention" to require that families be given the opportunity to obtain the full range of appropriate early intervention services, educational and program placements, and other options for their child from highly qualified providers. Requires the Secretary to establish a postdoctoral fellowship program to foster research and development in the area of early hearing detection and intervention.

Expresses: (1) solidarity with the people of Poland and Polish-American communities in the United States; and (2) support for the Polish government as it addresses the loss of many key officials.

Condemns the detention of, and calls for the immediate release of, Burmese democracy leader Daw Aung San Suu Kyi and all prisoners of conscience in Burma. Calls on the military regime in Burma to engage in political dialogue with the National League for Democracy and other opposition groups and ethnic minorities. Calls upon the Secretary of State to: (1) assess the effectiveness of the policy of engagement with the military regime in Burma; (2) engage regional governments and multilateral organizations, including the People's Republic of China (PRC), the Association of Southeast Asian Nations (ASEAN), and the U.N. Security Council, to push for democratic transition to civilian rule in Burma; and (3) support the National League for Democracy and the people of Burma in calling for constitutional and election reforms by the military regime.

Requires the National Aeronautics and Space Administration (NASA) to comply with the provision under the heading Exploration in the Science Appropriations Act, 2010 (title III of division B of the Consolidated Appropriations Act, 2010) relating to a prohibition on the use of funds for termination or elimination of any programs, projects, or activities of the architecture of NASA's Constellation Program. Bars use of the provisions of the Anti-Deficiency Act as a basis for terminating or eliminating any contracts, programs, projects, or activities of the Program. Requires the Comptroller General to submit a report on the Program to Congress. Requires such report to set forth a description and assessment of the contracts, programs, projects, and activities of the Program, if any, that are contrary to law or are experiencing waste, fraud, or abuse. Instructs the Administrator of NASA to ensure shuttle launch capability, including by not terminating any contractor support that will limit or impair the launching of, at a minimum, the payloads manifested for the shuttle.
