Rare Earths Supply-Chain Technology and Resources Transformation Act of 2010 or RESTART Act - Sets forth U.S. policy with respect to the reestablishment of a rare earth materials supply chain in the United States and its allies. Establishes within the Department of the Interior the Rare Earth Policy Task Force to monitor and assist federal agencies in expediting the review and approval of permits to accelerate the completion of projects that will increase investment in, exploration for, and development of domestic rare earth elements. Directs the Secretaries of Commerce, of Defense, of Energy, of the Interior, and the Secretary of State to establish jointly an interagency working group for the purposes of reestablishing the production of, and a competitive supply chain for, rare earth materials in the United States. Requires the Secretary of the Interior and the Secretary of Energy to report jointly to Congress on: (1) the vulnerability of the supply chain for rare earth materials in the United States; (2) rare earth elements critical to clean energy technologies and the domestic and economic security; and (3) the establishment of a rare earth stockpile. Amends the Energy Policy Act of 2005 to authorize the Secretary of Energy (DOE) to implement a temporary loan guarantee program for the commercial application of rare earth materials revitalization. Establishes in DOE a program to ensure the long-term, secure, and sustainable supply of rare earth materials in quantities sufficient to satisfy the U.S. national security, economic well-being, and industrial production needs. Expresses the sense of Congress that: (1) the capability to produce rare earth materials is the backbone of both the defense and energy supply chains; (2) the United States lacks sufficient capability to produce rare earth materials; (3) there is an urgent need to reestablish a supply chain in the United States for processing rare earth oxides into metals and rare earth magnets; and (4) that urgency warrants the exercise of the President's authority to support reestablishment of the capability to produce rare earth materials and the supply chain to meet a deficiency in the defense industrial base and renewable energy sectors of the United States. Directs the Secretary of the Interior and the Secretary of Energy to study the feasibility and effectiveness of using a cooperative structure involving multiple producers of rare earth materials to reestablish the production of, and a supply chain for, rare earth materials in the United States. Specifies restrictions upon the use of appropriated funds for the rare earth materials program. Makes conforming amendments to the National Materials and Minerals Policy, Research and Development Act of 1980. Repeals the National Critical Materials Act of 1984.

Restoring the 10th Amendment Act - Authorizes a designated state official to file with the head of a federal agency proposing a rule, during the period when the proposed rule is required to be open for public comment, a legal brief challenging the constitutionality of the rule under the Tenth Amendment. Directs the agency head: (1) to notify the designated official of each state within 15 days after such a brief is filed; (2) to post prominently on the agency's primary Web page a link to the brief; and (3) within 15 days after posting such link, to certify in writing that such rulemaking does not violate the Tenth Amendment and post the certification prominently on the front page of the agency's website, unless the agency determines it will not put the proposed rule into effect. Authorizes a state official who decides to challenge a federal rule on the grounds that it violates the Tenth Amendment to elect to file a legal action in U.S. district court for the district in which the official's place of business is located. Directs the relevant U.S. Court of Appeals, at the request of a designated state official, to grant expedited review of a decision by a district court in such a case.

Condemns the November 2010 attack by the government of North Korea against the Republic of Korea in violation of the 1953 Korean War Armistice Agreement. Expresses deep condolences to the government and people of the Republic of Korea, especially the families on Yeonpyeong Island who suffered from this attack and lost their loved ones. Recognizes that maintaining peace on the Korean peninsula requires constant vigilance and stands with the people and the government of the Republic of Korea in this time of crisis. Calls on the international community, especially China, to condemn this attack and enjoin the government of North Korea to halt all nuclear activities in accord with U.N. Security Council Resolutions 1718 and 1874, and refrain from further actions that may destabilize the Korean Peninsula. Calls on the President to work with the government of the Republic of Korea to take all necessary steps to deter further North Korean aggression. Urges the Administration to continue a bilateral economic relationship with the Republic of Korea. Reaffirms the commitment of the United States to its alliance with the Republic of Korea.

Emergency Unemployment Benefits Extension Act of 2010 - Amends the Supplemental Appropriations Act, 2008 with respect to the state-established individual emergency unemployment compensation account (EUCA). Extends the final date for entering a federal-state agreement under the Emergency Unemployment Compensation (EUC) program through January 3, 2012. Postpones the termination of the program until June 9, 2012. Amends the Assistance for Unemployed Workers and Struggling Families Act to extend until January 4, 2012, requirements that federal payments to states cover 100% of EUC. Amends the Unemployment Compensation Extension Act of 2008 to exempt weeks of unemployment between enactment of this Act and June 10, 2012, from the prohibition in the Federal-State Extended Unemployment Compensation Act of 1970 against federal matching payments to a state for the first week in an individual's eligibility period for which extended compensation or sharable regular compensation is paid if the state law provides for payment of regular compensation to an individual for his or her first week of otherwise compensable unemployment. (Thus allows temporary federal matching for the first week of extended benefits for states with no waiting period.) Amends the Federal-State Extended Unemployment Compensation Act of 1970 to authorize a state by law to apply certain requirements of the Act, with specified substitutions, for determining an extended unemployment compensation period. Requires the state's "on" and "off" indicators to be based on its rate of insured unemployment and rate of total unemployment for the period between enactment of this Act (or, if later, the date established pursuant to state law), and ending on or before December 31, 2011. Rescinds permanently, out of all available unobligated federal funds, $95 billion in appropriated discretionary funds. Requires the Director of the Office of Management and Budget (OMB) to identify and report to the Secretary of the Treasury and Congress on which appropriation accounts the rescission shall apply from, including amounts. Exempts from rescission any unobligated funds of the Department of Defense (DOD) or the Department of Veterans Affairs (VA).

Prematurity Research Expansion and Education for Mothers who deliver Infants Early Act or the PREEMIE Act - Amends the Public Health Service Act to: (1) require the Secretary of Health and Human Services (HHS), acting through the Director of the National Institutes of Health (NIH), to expand, intensify, and coordinate the activities of NIH with respect to research on the causes and prevention of preterm labor and delivery and the care and treatment of preterm infants; (2) establish within NIH a multicenter clinical program and trans-disciplinary centers for prematurity research; (3) require the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to conduct research, activities, and studies on preterm birth; and (4) require the CDC to award grants for telemedicine demonstration projects for services for high risk pregnancies. Directs the Secretary to: (1) establish and implement a national science-based consumer education campaign on the prevention of preterm birth; and (2) conduct and report on research studies and demonstration projects for reducing the rate of preterm birth. Requires the Advisory Committee on Infant Mortality of HHS to report annually to the Secretary on a strategic plan for the conduct of preterm birth-related research.

Tax Hike Prevention Act of 2010 - Repeals the general terminating date (i.e., December 31, 2010) applicable to tax relief provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA), thus making such provisions permanent. Repeals the provision of the Jobs and Growth Tax Relief Reconciliation Act of 2003 terminating the reductions in tax rates for capital gains and dividends, thus making such reductions permanent. Repeals provisions of EGTRRA repealing the estate and generation-skipping transfer taxes after 2009, thus restoring such taxes, subject to the amendments made by this Act. Restores the step-up in basis tax treatment of inherited estate assets. Amends the Internal Revenue Code to: (1) provide for annual increases in the alternative minimum tax (AMT) exemption amount during the period of 2010 through 2020; (2) expand offsets against the AMT for certain nonrefundable tax credits; (3) retain marriage penalty relief provisions and the increased child tax credit; (4) revise the estate tax by imposing a permanent maximum estate tax rate of 35% and allowing a permanent estate tax exclusion amount of $5 million (adjusted annually for inflation) after 2009; and (5) allow a surviving spouse to increase the estate tax exclusion amount by the unused exclusion amount of his or her deceased spouse. Allows the executor of any estate of a decedent dying in 2010 to elect to apply existing provisions of the Internal Revenue Code of 1986 without regard to specified provisions of this Act.

Excluding Abortion Coverage from Health Reform Act - Amends the Patient Protection and Affordable Care Act to prohibit federal funds from being to used to cover any part of the costs of any health plan that includes coverage of abortion services. (Currently, federal funds cannot be used for abortion services and plans receiving federal funds must keep federal funds segregated from any funds for abortion services.) Requires any qualified health benefit plan offered through an Exchange that includes coverage for abortions to also offer a qualified health benefit plan through the Exchange that is identical in every respect except that it does not cover abortions.

Patients' Freedom to Choose Act - Repeals provisions of the Patient Protection and Affordable Care Act and the Health Care and Education Reconciliation Act of 2010 that: (1) restrict payments from health savings accounts, medical savings accounts, and health flexible spending arrangements for medications to prescription drugs and insulin only; and (2) impose a $2,500 limitation on salary reduction contributions to a health flexible spending arrangement under a cafeteria plan.

Medical-Legal Partnership for Health Act - Directs the Secretary of Health and Human Services (HHS) to establish a nationwide demonstration project to: (1) award matching grants or enter into contracts with medical-legal partnerships to assist patients and their families in navigating health-related programs and activities; and (2) evaluate the effectiveness of such partnerships. Authorizes the Secretary to provide technical assistance to grantees to support the establishment and sustainability of medical-legal partnerships. Requires amounts received under this Act to be used to achieve one or more of the following goals: (1) enhancing access to health care services; (2) improving health outcomes for low-income individuals; (3) reducing health disparities among health disparities populations; (4) enhancing wellness and prevention of chronic conditions and other health problems; (5) reducing cost of care to the health care system; (6) addressing the social determinants of health; and (7) addressing situational contributing factors. Prohibits funds under this Act from being used: (1) for any medical malpractice action or proceeding; (2) to provide any support to an alien who is not a qualified alien or a nonimmigrant under the Immigration and Nationality Act or an alien who is paroled into the United States under such Act for less than one year; (3) to provide legal assistance with respect to any proceeding or litigation which seeks to procure an abortion or to compel any individual or institution to perform or assist in the performance of an abortion; or (4) to initiate or participate in a class action lawsuit. Requires the Secretary to study and report to Congress on the results of such project.

Thermal Renewable Energy and Efficiency Act of 2010 - Amends the Internal Revenue Code to extend the tax credit for the production of electricity from renewable resources to the production of thermal energy and to include a naturally occurring cold water source as a qualified energy resource and a natural air conditioning system facility as a qualified facility for purposes of such credit. Modifies the definition of "local heating and cooling facilities" for purposes of tax-exempt facility bonds to include equipment for producing thermal energy in the form of hot water, chilled water, or steam, distributing that thermal energy in pipelines, and transferring the thermal energy. Defines "thermal energy" as heat (in the form of hot water or steam) or cooling (in the form of chilled water or ice). Amends the Energy Policy and Conservation Act, with respect to the energy sustainability and efficiency grant and loan program for institutions, to: (1) include a not-for-profit district energy system as an institutional entity for purposes of such grant program; (2) increase the amounts of technical assistance grants and grants for efficiency improvement and energy sustainability; and (3) extend the authorization of appropriations for such grant program through FY2015.

Small Business Paperwork Mandate Elimination Act - Amends the Internal Revenue Code to repeal a provision (added by the Patient Protection and Affordable Care Act) that extends to corporations that are not tax-exempt the requirement to report payments of $600 or more.

Rebuilding Local Business Act of 2010 - Amends the Small Business Act to designate as a HUBZone (historically underutilized business zone), for purposes of assistance under such Act: (1) an initial period rebuilding county; and (2) an extension period rebuilding county. Defines an initial period rebuilding county as a county, parish, or similar political subdivision: (1) for which the Administrator of the Small Business Administration (SBA) determines that the one-year unemployment rate is at least 120% of the one-year average unadjusted unemployment rate for the United States; (2) that is not a HUBZone or will cease to qualify as a HUBZone two years after such unemployment determination; and (3) during the three-year period beginning on the date of such unemployment determination. Defines an extension rebuilding county as a county, parish, or political subdivision: (1) in which the Administrator has made the above unemployment determination; (2) for which the above three-year period has ended; (3) for which the Administrator determines that the unemployment rate as of a specified date is at least 140% of the average unadjusted unemployment rate; and (4) for which such designation extends for an additional specified period after the three-year period.

National Cyber Infrastructure Protection Act of 2010 - Establishes within the Department of Defense (DOD) a National Cyber Center, headed by a Director who shall report directly to the President. Includes among the Director's duties: (1) coordinating federal government defensive operations, intelligence collection and analysis, and activities to protect and defend government information networks; (2) acting as the principal adviser to the President, the National Security Council, and the heads of federal agencies on matters relating to the protection and defense of such networks; and (3) keeping appropriate congressional committees fully informed of the Center's activities. Grants the Director access to all intelligence relating to cyber security collected by any federal agency, with specified exceptions. Provides for annual submissions to the Director of cyber budget requests by the head of each federal agency with responsibilities for matters relating to the protection and defense of federal information networks. Establishes within the National Cyber Security Program Budget a National Cyber Defense Contingency Fund. Directs the Secretary of Energy (DOE) to determine the appropriate location for, and to establish within a National Laboratory, a public and private partnership for sharing cyber threat information and exchanging technical assistance, advice, and support, to be known as the Cyber Defense Alliance. Sets forth guidelines regarding the uses of shared information. Requires the Director of National Intelligence (DNI) to: (1) facilitate certain information sharing and declassification activities; and (2) establish uniform procedures for the receipt, care, and storage by agencies of information that is voluntarily submitted to the government through the Alliance. Establishes penalties for federal officers or employees who knowingly disclose cyber threat information protected from disclosure by this Act. Authorizes the federal government to provide warnings regarding potential threats to information networks. Terminates the Alliance on December 31, 2020.

Water Assistance from International Vessels for Emergency Response Act - Waives requirements for coastwise endorsements to a certificate of documentation in order to engage in coastwise trade for foreign vessels engaged in containment, remediation, or associated activities in connection with the mobile offshore drilling unit Deepwater Horizon oil spill in the Gulf of Mexico.

Honors the noble service and sacrifice of the U.S. Armed Forces and the armed forces of allied countries that served in Korea since 1950 to the present. Expresses the sense of the Senate: (1) that Israel has a right to defend itself against any threat to its citizens' safety; (2) reaffirming that the United States stands with Israel in pursuit of shared security goals, including Israel's security; (3) condemning the violent attack and provocation by extremists aboard the Mavi Marmara; (4) condemning any future such attempts to break the Israeli blockade of Gaza for the purpose of provoking violent confrontation or otherwise undermining Israel's security; (5) condemning Hamas for its failure to recognize Israel's right to exist, its human rights abuses against the residents of Gaza, and its continued rejection of a constructive path to Israeli-Palestinian peace; (6) condemning the government of Iran for supporting Hamas and undermining Israel's security; (7) encouraging the government of Turkey to recognize the importance of continued strong relations with Israel and the necessity of scrutinizing organizations with potential terrorist ties; and (8) expressing profound disappointment with the counterproductive actions of the United Nations (U.N.) regarding the May 2010 flotilla incident.

Recognizes the importance of ensuring that: (1) applicable procurement goals for small businesses are reached by all federal agencies; (2) guaranteed loans and microloans are made available to all qualified small businesses; (3) necessary federal resources are provided to management assistance programs delivered by SBA resource partners; (4) SBA small business disaster assistance is provided in a timely and efficient manner; (5) federal tax policy spurs small business growth, creates jobs, and increases competitiveness; (6) the federal government reduces the regulatory compliance burden on small businesses; (7) advanced technology policy facilitates access to affordable broadband Internet service to foster rural small business growth; and (8) systems of intellectual property protection continue to foster small business innovation.

Fair Defense Competition Act - Directs the Secretary of Defense (DOD), in awarding a contract for any major defense acquisition program and conducting the cost or price evaluation of any proposal for that contract, to take into account any final panel report that concludes that an illegal subsidy (inconsistent with the Agreement on Subsidies and Countervailing Measures) has been provided with respect to: (1) any merchandise or major component of such program; or (2) the development of any merchandise or major component thereof. Requires the Secretary, if the illegal subsidy has not been withdrawn, to increase the cost or price of the proposal by the amount of the subsidy.

Expresses the sense of the Senate that: (1) the United Nations Convention on the Rights of the Child is incompatible with the U.S. Constitution, laws, and traditions; (2) the Convention would undermine presumptions of freedom and independence for U.S. families; (3) the Convention would interfere with the principles of U.S. sovereignty, independence, and self-government that preclude the propriety of adopting international law to govern domestic matters; and (4) the President should not transmit the Convention to the Senate for its advice and consent.

Requires the Administrator of the Environmental Protection Agency (EPA) to delay the implementation of the final rules entitled "Lead; Renovation, Repair, and Painting Program; Lead Hazard Information Pamphlet; Notice of Availability; Final Rule" (published on April 22, 2008) and "Lead; Amendment to the Opt-out and Recordkeeping Provisions in the Renovation, Repair, and Painting Program" (signed by the Administrator on April 22, 2010) in each state until accredited certified renovator classes to train contractors in practices necessary for compliance with such rules have been held in such state for at least a year. Requires the Administrator to: (1) monitor each state to determine when such classes are offered; and (2) notify each Member of Congress about the location and time of each such class held in their state and the date on which the classes have been held for one year.

Fair Access to Credit Scores Act of 2010 - Amends the Fair Credit Reporting Act to require nationwide consumer reporting agencies, including nationwide specialty consumer reporting agencies (that compile and report on medical records or payments, residential or tenant histories, check writing histories, employment histories, and incusrance claims), to provide a free annual credit score disclosure upon consumer request.

Grow Renewable Energy from Ethanol Naturally Jobs Act of 2010 or the GREEN Jobs Act of 2010 - Amends the Internal Revenue Code to extend through 2015 the income and excise tax credits for alcohol used as fuel, the cellulosic biofuel producer tax credit, and the reduced credit for ethanol blenders. Amends the Harmonized Tariff Schedule of the United States to extend until 2016 the additional tariff on ethyl alcohol blends (ethanol) used as fuel.

Extends the deepest condolences of the Senate to the families of the fallen coal miners. Honors the survivors of the tragedy. Recognizes all coal miners for enduring the immeasurable loss of co-workers and maintaining courage in the aftermath of the explosion at the Upper Big Branch Mine-South. Commends the valiant efforts of the emergency response workers searching for the missing coal miners. Honors the many volunteers who provided support and comfort for the missing coal miners' families during the rescue and recovery operations.

Child Protection Compact Act of 2010 - Authorizes the Secretary of State, through the Ambassador-at-Large of the Department of State's Office to Monitor and Combat Trafficking in Persons, to provide assistance (grants, cooperative agreements, or contracts) for an eligible country with a significant prevalence of trafficking in children that enters into a Child Protection Compact with the United States to support policies and programs to eradicate the trafficking of children.

Ponzi Scheme Victim's Bill of Rights Act of 2010 - Amends the Internal Revenue Code to allow: (1) a special tax deduction for qualified fraudulent investment losses held in an individual retirement account (IRA); (2) a six-year carryback of net operating losses which are qualified fraudulent investment losses; (3) withdrawals from tax-exempt retirement plans for a 10-year period without penalty to replace qualified fraudulent investment losses; (4) catch-up contributions to retirement plans to compensate for fraudulent investment losses; and (5) an extension of the limitation period for filing refund claims for overpayments of tax in connection with gifts and bequests of an interest in an investment for which there is a qualified fraudulent investment loss. Defines "qualified fraudulent investment loss" as a loss discovered in 2008 or 2009 resulting from a fraudulent arrangement in which a person receives cash or property from investors, purports to earn income for investors, reports partially or wholly fictitious income to such investors, makes payments to some investors from payments made by other investors, and appropriates some or all of the investors' cash or property.

Save Our Industries Act of 2010 or the SAVE Act - Grants duty-free treatment, subject to specified conditions, to certain apparel wholly assembled in the United States or the Philippines, or both, and components of such apparel consisting entirely of: (1) fabric cut in the United States or the Philippines, or both, from fabric wholly formed in the United States from yarns wholly formed in the United States; (2) components knit-to-shape in the United States from yarns wholly formed in the United States; or (3) any combination of such fabric or components. Grants: (1) a reduction of duty for such apparel, provided the same criteria are met; and (2) duty-free treatment to apparel that meet both the requirements for duty-free treatment and reduction of duty. Prescribes single transformation duty-free rules for specified apparel articles, regardless of the source of the fabric, fabric components, components knit-to-shape, or yarns from which the articles are made, if they: (1) are wholly assembled, or knit-to-shape, in the Philippines from any combination of such components; and (2) are imported directly into the United States from the Philippines. Prescribes requirements for review and enforcement of the program. Prescribes penalties for exporters and importers who engage in the transshipment of apparel that has been afforded preferential treatment under this Act.
