Amends the Internal Revenue Code to modify the qualification standard for exterior windows (including skylights) and exterior doors for purposes of the tax credit for nonbusiness energy property to require such standard to meet criteria established by the 2010 Energy Star Program.

Amends Rule XXVI (Committee Procedure) of the Standing Rules of the Senate to make it out of order in a subcommittee or committee to proceed to any legislative matter unless the legislative matter and a final budget scoring for it by the Congressional Budget Office (CBO) have been publicly available on the Internet, on the official committee and CBO websites, in searchable form 72 hours before proceeding (excluding Saturdays, Sundays, and holidays except when the Senate is in session on such a day). Permits waiver or suspension of this rule, or successful appeals from rulings of the Chair, only by an affirmative vote of two-thirds of the Members of the subcommittee or committee. Makes it out of order in the Senate to proceed to a legislative matter if it was proceeded to in a subcommittee or committee in violation of this Rule. Permits waiver or suspension of this rule, or successful appeals from rulings of the Chair, only by an affirmative vote of two-thirds of the entire Senate. Amends Rule XVII (Reference to Committees; Motions to Discharge; Report; Hearings Available) to apply the same rule in the Senate before it proceeds to any legislative matter. States that nothing in this resolution or any amendment made by it shall be interpreted to require or permit the declassification or posting on the Internet of classified information in the Senate's custody. Requires such classified information to be made available to Members in a timely manner as appropriate under existing laws and rules.

Amends the Emergency Economic Stabilization Act of 2008 (EESA) to prohibit any entity in receipt of financial assistance under the Trouble Asset Relief Program (TARP) (or any other program enacted by the Secretary under EESA authorities) from providing any direct or indirect assistance to, funding, promoting, or in any way contributing to the activities of the Association of Community Organizations for Reform Now (ACORN) or an ACORN-related affiliate. Exempts from this prohibition any entity that has repaid all outstanding amounts of TARP or related financial assistance.

Fairness in Representation Act - Directs the Secretary of Commerce, in conducting the 2010 decennial census and every decennial census thereafter, to include in any questionnaire used for the purpose of determining the total population by states, a checkbox or similar option for respondents to indicate citizenship status or lawful presence in the United States. Requires the Secretary to adjust census figures as necessary so that those who are not U.S. citizens or are not lawfully present in the United States are not counted in tabulating population for purposes of apportioning Representatives in Congress among the states.

Protect Taxpayers From ACORN Act - Prohibits any federal contract, grant, cooperative agreement, or other form of agreement from being awarded to, any federal funds in any other form from being provided to, or any federal employee or contractor from promoting, the Association of Community Organizations for Reform Now (ACORN) and any ACORN-related affiliate. Requires the Federal Acquisition Regulatory Council to amend the Federal Acquisition Regulation to carry out provisions of this Act relating to contracts.

Human-Animal Hybrid Prohibition Act of 2009 - Amends the federal criminal code to prohibit and to set penalties for: (1) creating or attempting to create a human-animal hybrid (a being with human and non-human tissue as specified in this Act); (2) transferring or attempting to transfer a human embryo into a non-human womb, or a non-human embryo into a human womb; or (3) transporting or receiving for any purpose a human-animal hybrid.

Academic Partnerships Lead Us to Success Act or the A PLUS Act - Allows each state to enter into a five-year performance agreement with the Secretary of Education permitting it to receive federal funds on a consolidated basis that would otherwise be directed toward specific programs furthering the stated purpose of title I (Improving the Academic Achievement of the Disadvantaged) of the Elementary and Secondary Education Act of 1965. Requires each agreement to be approved by a combination of specified state parties, and list the programs for which consolidated funding is requested. Allows states to use such funds for any educational purpose permitted by state law, but requires them to make certain assurances that they will use fiscal control and fund accounting procedures, abide by federal civil rights laws, and advance educational opportunities for the disadvantaged. Allows amendments to the scope of performance agreements. Requires each agreement state to: (1) maintain an accountability system measuring annual student progress toward state proficiency standards; (2) disseminate annually student performance data disaggregated by specified student groups; and (3) keep aggregate spending on elementary and secondary education at no less than 90% of such spending for the school year coinciding with enactment of this Act. Limits administrative expenses. Requires the inclusion of private schools and teachers in activities funded on a consolidated basis. Directs the Secretary to evaluate each performance agreement midway through its execution. Allows the Secretary to terminate an agreement whose terms are not met for three consecutive school years.

Recognizes the historic successes achieved by the President of Colombia, Alvaro Uribe, in rebuilding the Government of Colombia, strengthening Colombian institutions, and solidifying its rule of law. Expresses the sense of the Senate that: (1) it is in the national security interests of the United States to deepen its relationship with Colombia; and (2) the United States should implement the United States-Colombia Trade Promotion Agreement immediately.

Highway Investment Protection Act - Requires the Director of the Office of Management and Budget (OMB) to transfer remaining unobligated stimulus funds under the American Recovery and Reinvestment Act of 2009 to the Highway Trust Fund (HTF) to ensure its solvency through FY2010. Amends the Internal Revenue Code to extend the expenditure authority of the HTF through FY2010.

Want Not, Waste Not Act - Rescinds any amounts rejected by the governor of a state or a local government from amounts apportioned to that state under Public Law 111-5 (American Recovery and Reinvestment Act of 2009). Declares that the purpose of this Act is to ensure that such rejected stimulus funding is returned to the U.S. Treasury to reduce the national debt to be inherited by future generations.

Enumerated Powers Act - Requires each Act of Congress to contain a concise explanation of the specific constitutional authority relied upon for the enactment of each portion of that Act. Declares that failure to comply with this requirement shall give rise to a point of order in either chamber of Congress. Specifies procedures for disposition of such point of order in the Senate.

Good Samaritan Hunger Relief Tax Incentive Extension Act of 2009 - Amends the Internal Revenue Code to: (1) modify the tax deduction for charitable contributions of food inventory by limiting the reduction in such deduction to the amount by which the fair market valuation of the contributed food exceeds twice the basis of such food; and (2) make such deduction permanent.

Energy Employees Occupational Illness Compensation Program Improvement Act of 2009 - Amends the Energy Employees Occupational Compensation Program Act of 2000 to replace the current requirements for occupational illness compensation to the survivors of a Department of Energy (DOE) contractor employee. Requires payment to a survivor of the compensation the deceased contractor employee would otherwise have been paid, if the employee dies after applying for the compensation but before receiving it. Requires payment of the compensation, if no survivors exist, to a claimant's surviving family members. Requires a survivor eligible for contractor employee compensation under this Act as well as survivor compensation under the regular compensation schedule for survivors to elect one or the other. Prohibits any payment to a survivor of both kinds of compensation.

Condemns the ongoing violence against demonstrators by the government of Iran and pro-government militias as well as the ongoing government suppression of independent electronic communication through interference with the Internet and cellphones. Affirms the universality of individual rights and the importance of democratic and fair elections.

Supports: (1) the Iranian people as they take steps to peacefully express their voices, opinions, and aspirations; (2) journalists who take great risk to report on political events in Iran, including those surrounding the presidential election; and (3) efforts of the Broadcasting Board of Governors (BBG) to provide credible news within Iran through the Voice of America's (VOA) Persian News Network, and Radio Free Europe/Radio Liberty's (RFE/RL) Radio Farda. Condemns: (1) the detainment and intimidation of journalists in Iran and elsewhere throughout the world; and (2) restrictions on freedom of the press, freedom of speech, and freedom of expression in Iran and throughout the world.

Automobile Dealer Economic Rights Restoration Act of 2009 - Prohibits an automobile manufacturer (manufacturer) in which the federal government has an ownership interest, or which receives loans from the federal government, from depriving an automobile dealer (dealer) of its economic rights. Requires the manufacturer to honor those rights as they existed for Chrysler LLC and General Motors Corporation dealers prior to the commencement of the bankruptcy cases of each corporation, including dealer rights to recourse under state law. Requires the appropriate manufacturer to restore the franchise agreement between the dealers and Chrysler LLC or General Motors that was in effect prior to the commencement of their respective bankruptcy cases, and to take assignment of such agreements. States that nothing in this Act is intended to make null and void the transfer of substantially all the assets of such corporations.

Amends the Department of Commerce and Related Agencies Appropriations Act, 1999 to prohibit U.S. courts from recognizing, enforcing, or otherwise validating any assertion of rights by an individual (under current law, by a designated Cuban national) of a mark, trade name, or commercial name that was used in connection with a business or assets that were confiscated by the Cuban government unless the original owner of such mark or name, or such owner's bona fide successor, has expressly consented. Applies such prohibition only if the individual asserting the rights knew or had reason to know at the time of acquiring the rights asserted that the mark or name was the same or substantially similar to the mark or name used in connection with the business or assets that were confiscated.

Truth in Employment Act of 2009 - Amends the National Labor Relations Act to provide that nothing in specified prohibitions against unfair labor practices by employers shall be construed as requiring an employer to employ any person who seeks or has sought employment with the employer in furtherance of other employment or agency status.

Home Buyer Tax Credit Act of 2009 - Amends the Internal Revenue Code to replace the current tax credit for first-time homebuyers with a one-time credit for 10% of the purchase price of a principal residence, up to $15,000. Requires repayment of credit amounts if the taxpayer sells or fails to occupy the residence within 24 months after the date of purchase.

Amends the Burmese Freedom and Democracy Act of 2003 to renew, for three years, the President's authority to ban the import of Burmese products. Approves the renewal of certain import restrictions contained in the Act. Deems this resolution a renewal resolution which shall take effect upon its enactment or July 26, 2009, whichever occurs first.

Grow Research Opportunities With Taxcredits' Help Act or GROWTH Act - Amends the Internal Revenue Code to: (1) extend the tax credit for increasing research activities through 2010; (2) modify the rate of such credit and make such modified credit permanent after 2010; and (3) increase to 20% the rate of the alternative simplified research tax credit after 2010.

Commends the people who demonstrated at Tiananmen Square and elsewhere in the People's Republic of China (PRC) in 1989, many of whom sacrificed their lives and freedom to bring about democratic change and gain freedom of expression, assembly, association, and religion for the people of China. Expresses sympathy for the families of those who were killed, wounded, or imprisoned due to their involvement in the peaceful protests in Tiananmen Square. Condemns the ongoing human rights abuses by the PRC. Calls on the Government of the PRC to: (1) release all Tiananmen Square prisoners; (2) allow freedom of speech; and (3) cease intimidation and imprisonment of religious monitories and those who disagree with PRC policies. Supports efforts by free speech activists in China and elsewhere. Urges the President to support peaceful advocates of free speech around the world.
