Restoring the 10th Amendment Act - Authorizes a designated state official to file with the head of a federal agency proposing a rule, during the period when the proposed rule is required to be open for public comment, a legal brief challenging the constitutionality of the rule under the Tenth Amendment. Directs the agency head: (1) to notify the designated official of each state within 15 days after such a brief is filed; (2) to post prominently on the agency's primary Web page a link to the brief; and (3) within 15 days after posting such link, to certify in writing that such rulemaking does not violate the Tenth Amendment and post the certification prominently on the front page of the agency's website, unless the agency determines it will not put the proposed rule into effect. Authorizes a state official who decides to challenge a federal rule on the grounds that it violates the Tenth Amendment to elect to file a legal action in U.S. district court for the district in which the official's place of business is located. Directs the relevant U.S. Court of Appeals, at the request of a designated state official, to grant expedited review of a decision by a district court in such a case.

Directs the Secretary of Agriculture (USDA) to approve and issue a special use permit to a covered owner of a houseboat on Laurel Lake in the Daniel Boone National Forest in Kentucky that provides authorization to use a houseboat of a covered owner as a landing pad for one or more approved helicopters that are owned by an approved medical evacuation company or the covered owner. Defines a "covered owner" as an owner of a houseboat located on such lake and on which is attached a helicopter landing pad that meets each applicable helicopter manufacturer requirement.

Electricity Reliability Protection Act of 2010 - Prohibits the use of funds made available to the Environmental Protection Agency (EPA), the Corps of Engineers, or the Office of Surface Mining Reclamation and Enforcement (OSMRE) of the Department of the Interior to implement, administer, or enforce any policy or procedure set forth in either the memorandum entitled "Enhanced Surface Coal Mining Pending Permit Coordination Procedures" or the EPA guidance entitled "Improving EPA Review of Appalachian Surface Coal Mining Operations under the Clean Water Act, National Environmental Policy Act, and the Environmental Justice Executive Order," until the EPA, the Corps of Engineers, or OSMRE promulgates regulations to implement it after providing notice and an opportunity for comment in accordance with the Administrative Procedure Act.

Reduce Unnecessary Spending Act of 2010 - Amends the Impoundment Control Act of 1974 to require the Office of Management and Budget (OMB) to transmit, within 45 calendar days after enactment of the funding in question, a message to Congress with specified information requesting any rescission the President proposes under the procedures in this Act. Prescribes requirements for timing and packaging of rescission requests. Authorizes OMB, subject to a specified time limit, to withhold funding from obligation temporarily if the President proposes a rescission. Prohibits the President from invoking such expedited procedures or such authority to withhold funding on more than one occasion for any Act providing funding. Sets forth procedures for expedited congressional consideration of proposed rescissions.

Expresses the sense of the Senate that: (1) the United Nations Convention on the Rights of the Child is incompatible with the U.S. Constitution, laws, and traditions; (2) the Convention would undermine presumptions of freedom and independence for U.S. families; (3) the Convention would interfere with the principles of U.S. sovereignty, independence, and self-government that preclude the propriety of adopting international law to govern domestic matters; and (4) the President should not transmit the Convention to the Senate for its advice and consent.

Requires the Administrator of the Environmental Protection Agency (EPA) to delay the implementation of the final rules entitled "Lead; Renovation, Repair, and Painting Program; Lead Hazard Information Pamphlet; Notice of Availability; Final Rule" (published on April 22, 2008) and "Lead; Amendment to the Opt-out and Recordkeeping Provisions in the Renovation, Repair, and Painting Program" (signed by the Administrator on April 22, 2010) in each state until accredited certified renovator classes to train contractors in practices necessary for compliance with such rules have been held in such state for at least a year. Requires the Administrator to: (1) monitor each state to determine when such classes are offered; and (2) notify each Member of Congress about the location and time of each such class held in their state and the date on which the classes have been held for one year.

Haiti Economic Lift Program Act of 2010 - Amends the Caribbean Basin Economic Recovery Act (CBERA) (as amended by the United States-Caribbean Basin Trade Partnership Act, the Haitian Hemispheric Opportunity through Partnership Encouragement Act of 2006 [HOPE Act], and the Haitian Hemispheric Opportunity through Partnership Encouragement Act of 2008 [HOPE II]) to extend, in each succeeding one-year period through FY2020 (transition period), the duty-free treatment of certain imported knit apparel articles made in one or more Caribbean Basin Trade Partnership Act (CBTPA) beneficiary countries from yarns wholly formed in the United States. Extends, in each applicable one-year period through FY2020, the duty-free treatment of imported apparel articles made in Haiti or the Dominican Republic. Prescribes duty-free treatment also, without regard to the source of the fabric, fabric components, components knit-to-shape, or yarns from which the article is made, for specified apparel articles or made-up textile articles: (1) wholly assembled, or knit-to-shape, in Haiti from any combination of fabrics, fabric components, components knit-to-shape, or yarns; and (2) imported directly from Haiti or the Dominican Republic. Sets forth a special rule for certain woven articles and certain knit articles entered during FY2010 and succeeding one-year periods. Requires the Commissioner responsible for U.S. Customs and Border Protection to verify that such apparel articles imported into the United States are not being unlawfully transshipped into the United States. Revises requirements for one particular credit under the earned import allowance certificate program to reduce from three to two the number of square meter equivalents of qualifying woven fabric or qualifying knit fabric that the producer or entity controlling production can demonstrate that it purchased for the manufacture in Haiti of articles like or similar to any article eligible for preferential treatment. Extends the value-added rule for apparel articles and the special rule for certain wire harness automotive components. Directs the Commissioner to seek to send a rapid response team, as well as a support team, to Haiti to: (1) assess the short-term and long-term technical, capacity-building, and training needs of the authorities of the government of Haiti responsible for customs services; and (2) provide immediate assistance, particularly with respect to reestablishing full capacity for commercial port operations at the seaport at Port-au-Prince, facilitating trade between the United States and Haiti under CBERA, preventing unlawful transshipment of goods through Haiti to the United States, and otherwise strengthening cooperation between U.S., Haitian, and Dominican customs authorities. Declares the sense of Congress regarding regional cooperation and transshipment.

Recognizes the ultimate sacrifice made by the 29 coal miners lost at the Upper Big Branch Mine-South in Raleigh County, West Virginia. Extends the deepest condolences of the Senate to the families of the fallen coal miners. Honors the survivors of the tragedy. Recognizes all coal miners for enduring the immeasurable loss of co-workers and maintaining courage in the aftermath of the explosion at the Upper Big Branch Mine-South. Commends the valiant efforts of the emergency response workers searching for the missing coal miners. Honors the many volunteers who provided support and comfort for the missing coal miners' families during the rescue and recovery operations.

Honest Expenditure Limitation Program Act of 2010 or HELP Act - Amends the Congressional Budget Act of 1974 to make it out of order in the House of Representatives or the Senate to consider any bill, joint resolution, amendment, or conference report that includes any provision that would exceed specified non-security discretionary spending limits for FY2011-FY2020. Limits non-security discretionary spending limits for FY2011-FY2015 to the level provided in FY2010, but reduced each year on a pro rata basis so that the level for FY2015 does not exceed the level for FY2008. Limits the spending levels for FY2016-FY2020 to the FY2015 spending level. Defines "non-security discretionary spending" as discretionary spending other than spending for the Department of Defense (DOD), homeland security activities, intelligence-related activities within the Department of State, the Department of Veterans Affairs (VA), and national security related activities in the Department of Energy (DOE). Requires the President to issue a sequestration order, effective on issuance, if the Office of Management and Budget (OMB) in its Final Discretionary Sequestration Report estimates that any sequestration is required. Subjects to permanent cancellation any budgetary resources sequestered from any account, except those in special fund accounts or offsetting collections sequestered in appropriation accounts. Applies the same percentage sequestration to all programs, projects, and activities within a budget account. Requires Discretionary Sequestration Preview Reports by: (1) OMB to the President and Congress; and (2) the Congressional Budget Office (CBO) to Congress. Requires the OMB report to explain the difference between OMB and CBO estimates for each item. Requires the Final Discretionary Sequestration Reports to set forth estimates for: (1) the current year and each subsequent year through 2014; (2) the current year, if applicable, and, the budget year, the new budget authority and the breach, if any; (3) the sequestration percentages necessary to eliminate the breach; and (4) the level of enacted sequesterable budget authority, and resulting estimated outlays to be sequestered for each account. Sets forth sequestration enforcement mechanisms.

Declares that no individual who elects to opt out of benefits under part A (Hospital Insurance) of title XVIII (Medicare) of the Social Security Act (SSA) shall be required to: (1) opt out of benefits under SSA title II (Old-Age, Survivors, and Disability Insurance) (OASDI) as a condition for making such election; or (2) repay any amount paid under Medicare part A for items and services furnished prior to making such election.

Erasing our National Debt Through Accountability and Responsibility Plan Act of 2010 - Terminates the authorities granted the Secretary of the Treasury under the Troubled Asset Relief Program (TARP) of the Emergency Economic Stabilization Act of 2008 (EESA) to purchase troubled assets from financial institutions. Lowers the public debt limit by the amount of all TARP assistance repaid by recipients on or after the enactment of this Act, along with dividends, profits, or other funds paid to the government based on such assistance.

Haiti Assistance Income Tax Incentive Act - Treats cash contributions made after January 11, 2010, and before March 1, 2010, for the relief of earthquake victims in Haiti as having been made on December 31, 2009, for purposes of the tax deduction for charitable contributions. Deems a contribution as meeting the recordkeeping requirements of the Internal Revenue Code if the taxpayer produces a telephone bill showing the name of the donee organization and the date and amount of the contribution.

Common Sense Budgeting Act - Amends the Congressional Budget Act of 1974 to make it out of order to consider in either chamber any legislation that would exceed specified discretionary spending limits. Sets discretionary spending limits for FY2010-FY2014. Permits waiver or suspension of such prohibition, or successful appeals from rulings of the Chair in the Senate only: (1) by an affirmative vote of two-thirds (67) of the Senate; or (2) in the case of the defense budget authority, a declaration of war by Congress. Makes it out of order in the Senate to consider any direct spending or revenue legislation that would increase the on-budget deficit or cause an on-budget deficit for: (1) the current fiscal year; (2) the budget year; or (3) 5 to 10 ensuing fiscal years after the current fiscal year.

Nullifies Internal Revenue Service Notice 2010-2 (guidance regarding the application of section 382 of the Internal Revenue Code to corporations whose instruments are acquired and disposed of by the Department of Treasury pursuant to the Emergency Economic Stabilization Act of 2008). Amends the Internal Revenue Code to prohibit the Secretary of the Treasury from prescribing any regulation after December 18, 2009, that provides an exemption or special rule under such section (provisions limiting net operating loss carryforwards and certain built-in losses following a change in corporate ownership) that is restricted to the disposition of corporate instruments acquired by the Secretary, unless Congress specifically authorizes the exemption or special rule.

Adoption Tax Relief Guarantee Act - Exempts provisions expanding the adoption tax credit and adoption assistance programs enacted by the Economic Growth and Tax Relief Reconciliation Act of 2001 from the general terminating (sunset) provisions of that Act. Amends the Internal Revenue Code to allow the tax credit for adoption expenses in the taxable year in which such expenses are paid or incurred.

Jerusalem Embassy Relocation Act of 2009 - Amends the Jerusalem Embassy Act of 1995 to eliminate the President's authority to waive certain funding limitations for Department of State acquisition and maintenance of buildings abroad until the U.S. Embassy in Jerusalem has officially opened. Limits appropriations that may be obligated in FY2012 for Department acquisition and maintenance of buildings abroad until the U.S. Embassy in Jerusalem has officially opened. States that, for each of FY2010-FY2011, of funds authorized to be appropriated for Department acquisition and maintenance of buildings abroad, necessary sums should be made available until expended only for construction and other costs associated with the establishment in Jerusalem of the U.S. Embassy in Israel.
