Instructional Materials Accessibility Act of 2002 - Directs Secretary of Education to: (1) develop and publish instructional materials accessibility standards for the national electronic file format to be used by publishers of instructional materials in the preparation of electronic files suitable for efficient conversion into specialized formats; (2) establish a National Instructional Materials Accessibility Advisory Committee to provide technical expertise and guidance in creating such national electronic file format; (3) periodically review and amend such standards to reflect technological advances or changes; and (4) establish a National Instructional Materials Access Center. Requires State educational agencies, as a condition for receiving Federal financial assistance under the Individuals with Disabilities Education Act, to develop and implement statewide plans and make contracts with publishers to ensure that instructional materials for classroom use in elementary and secondary schools are made available in specialized formats to individuals who are blind or have other print disabilities at the same time such materials are provided to individuals without such disabilities. Authorizes the Secretary to make grants to eligible entities to provide or improve their capacity to prepare or obtain instructional materials in specialized formats, including the national electronic format. Provides for enforcement of rights of children and parents under this Act.

Declares that the Senate: (1) stands in solidarity with Israel as it takes necessary steps to provide security to its people by dismantling the terrorist infrastructure in the Palestinian areas; (2) remains committed to Israel's right to self-defense; and (3) will continue to assist Israel in strengthening its homeland defenses. Condemns Palestinian suicide bombings. Demands that the Palestinian Authority fulfill its commitment to dismantle the terrorist infrastructure in the Palestinian areas. Urges: (1) all Arab states, particularly Egypt and Saudi Arabia, to declare their unqualified opposition to all forms of terrorism, particularly suicide bombing, and to act in concert with the United States to stop the violence; and (2) all parties in the region to pursue vigorous efforts to establish comprehensive peace in the Middle East.

Arafat Accountability Act - Expresses the support of Congress for the President's efforts to achieve comprehensive peace in the State of Israel. Expresses the sense of Congress that: (1) the United States should urge an immediate and unconditional cessation of all terrorist activities and the commencement of a cease-fire between Israel and the Palestinians; (2) the Palestine Liberation Organization (PLO) and the Palestinian Authority (PA) should immediately surrender to Israel for detention and prosecution those Palestinian extremists wanted by Israel for the assassination of Israeli Minister of Tourism Rehavam Zeevi; and (3) Yasser Arafat and the PLO must take immediate and concrete action to publicly condemn all acts of terrorism, confiscate and destroy the infrastructures of terrorism, and end (and urge all Arab nations to end) financial support for terrorism. Prohibits the Secretary of State (Secretary) and the Attorney General, respectively, from issuing a visa or admitting to the United States any member of the PLO or official of the PA. Permits the President to waive this prohibition in the national security interest of the United States. Directs the Secretary to prohibit the operation of a PLO or PA office in the United States from carrying out any function other than those carried out prior to the Oslo Accords. Requires the Secretary to impose travel restrictions on the senior official of the Permanent Observer Mission of Palestine. Requires the Secretary and the Attorney General to identify and freeze United States assets of the PLO, the PA, and Yasser Arafat. Requires the President to report to specified congressional committees on PLO terrorist activities.

Syria Accountability Act of 2002 - Prohibits the President from exporting any item on the United States Munitions List or Commerce Control List of dual-use items in the Export Administration Regulations, providing any U.S. assistance to U.S. businesses with respect to investment or other activities, or conducting Overseas Private Investment Corporation and Trade Development Agency programs in or with respect to Syria. Directs the President to impose two or more specified sanctions against Syria. Requires maintenance of such prohibition and sanctions until the President certifies that Syria meets specified requirements, including that it: (1) does not support international terrorist groups; (2) has withdrawn all of its military personnel from Lebanon: (3) has ceased the development and deployment of ballistic missiles and biological and chemical weapons; and (4) is no longer in violation of United Nations (UN) Security Council Resolution 661 and subsequent relevant resolutions.

Constitutional Amendment - Grants victims of violent crime the rights: (1) to reasonable and timely notice of any public proceeding involving the crime and of any release or escape of the accused; (2) to not be excluded from such public proceeding and reasonably to be heard at public release, plea, sentencing, reprieve, and pardon proceedings; and (3) to adjudicative decisions that consider the victim's safety, interest in avoiding unreasonable delay, and just and timely claims to restitution from the offender. Prohibits any restriction of such rights except as dictated by a substantial interest in public safety or the administration of criminal justice, or by compelling necessity.

Improved Vaccine Affordability and Availability Act - Amends the Public Health Service Act to authorize additional appropriations for grants to States to increase influenza immunization rates in high risk populations, including medically underserved adults and adolescents, and extend vaccine availability. Requires the Secretary of Health and Human Services to provide for a program of research, demonstration projects, and education to ensure that immunizations are routinely offered to adults and adolescents by public and private health care providers. Requires such program to collect data on adverse impacts associated with immunizations. Directs the Secretary to: (1) develop and disseminate information concerning certain diseases and their vaccines, including bacterial meningitis and hepatitis A and B; and (2) maintain a 6 months supply of prioritized vaccines. Revises provisions governing the National Vaccine Injury Compensation Program, including provisions regarding: (1) equitable relief; (2) third party petitions; (3) jurisdiction to dismiss improperly brought claims; (4) vaccine-unrelated injury; (5) an increase in the award for pain and suffering in the case of a vaccine-related death; (6) the basis for calculating projected lost earnings; (7) compensation for family counseling and establishing guardianship expenses; (8) payment of interim costs; (9) procedures for paying attorney's fees; (10) extending the statute of limitations; (11) the composition and meeting schedule of the Advisory Committee on Childhood Vaccines; and (12) standards of responsibility and the definitions of manufacturer, vaccine-related injury or death, and vaccine. Requires the Secretary to contract with the Institute of Medicine of the National Academy of Science to conduct an ongoing, comprehensive review of new scientific data on childhood vaccines.

Removes, for months beginning on or after October 1, 2002, the requirement that qualifying offsetting legislation be enacted before a member or former member of the armed forces may be paid military retired pay and veterans' disability compensation concurrently without deduction. Repeals, as of such date, a special compensation program for certain severely disabled military retirees.

Domestic Spirits Tax Equity Act of 2002 - Amends the Internal Revenue Code to allow a distilled spirits wholesaler a distilled spirits wholesalers credit equal to the product of: (1) the number of cases of bottled distilled spirits which were bottled in the United States and which are purchased by such wholesaler during the taxable year directly from the distiller or importer of such spirits; and (2) the average tax-financing cost per case for the most recent calendar year ending before the beginning of such taxable year.

Authorizes the Secretary of Health and Human Services to make grants to eligible nonprofit community based pregnancy help medical clinics to purchase ultrasound equipment to provide free examinations to pregnant women, under the direction and supervision of a licensed medical physician. Conditions eligibility on a clinic agreeing to provide each examined woman a visual image, the age, and a physical description of the fetus and information on abortion and alternatives.

Colon Cancer Screen for Life Act of 2002 - Expresses the sense of the Congress with respect to the use of and reimbursement for colorectal cancer screening tests covered under the Medicare program under title XVIII of the Social Security Act (SSA). Amends SSA title XVIII to: (1) increase reimbursement for colorectal cancer screening and diagnostic tests; (2) cover an outpatient office visit or consultation for the purpose of beneficiary education before a colorectal cancer screening test consisting of a screening colonoscopy or in conjunction with the beneficiary's decision to obtain such a screening, regardless of whether such screening is medically indicated with respect to the beneficiary; and (3) waive the deductible for colorectal cancer screening tests.

Excludes receipts and disbursements of the Abandoned Mine Reclamation Fund from the Federal budget as submitted by the President, the congressional budget, or the Balanced Budget and Emergency Deficit Control Act of 1985. Amends the Surface Mining Control and Reclamation Act of 1977 to provide that moneys in the Abandoned Mine Reclamation Fund at the end of any fiscal year shall be available without further appropriation at the commencement of the next fiscal year for reclamation and restoration of land and water resources adversely affected by past coal mining.

Human Cloning Prohibition Act of 2001 - Prohibits any person or entity, in or affecting interstate commerce, from knowingly: (1) performing or attempting to perform human cloning; (2) participating in such an attempt; (3) shipping or receiving an embryo produced by human cloning or any product derived from such embryo; or (4) importing such an embryo or product. Directs the General Accounting Office to assess the need for amendment of such prohibition, including through: (1) a discussion of new developments, the need for somatic cell transfer to produce medical advances, current public attitudes and prevailing ethical views, and potential legal implications; and (2) a review of technological developments.

Community Choice in Real Estate Act - Amends the Bank Holding Company Act of 1956 and the Revised Statutes of the United States to prohibit the Board of Governors of the Federal Reserve System and the Secretary of the Treasury, respectively, from making a determination that real estate brokerage activity or real estate management activity is an activity that is either financial in nature or incidental to any financial activity, or is complementary to a financial activity.

Federal Prosecutors Retirement Benefit Equity Act of 2001 - Amends Federal civil service law to include Federal prosecutors within the definition of "law enforcement officer" (LEO). Extends LEO benefits under the Civil Service Retirement System and the Federal Employees' Retirement System to Federal prosecutors, including Assistant United States Attorneys (AUSAs), and such other attorneys in the Department of Justice (DOJ) as may be designated by the Attorney General. Exempts Federal prosecutors from mandatory retirement provisions for LEOs under the civil service laws. Requires DOJ to provide notice to incumbent Federal prosecutors of their rights under this Act. Allows incumbents to opt out of the LEO retirement program. Sets forth provisions governing the crediting of prior service by incumbents. Provides for make-up contributions for prior service of incumbents to the Civil Service Retirement and Disability Fund. Gives incumbents the option of either contributing to their own share of any make-up contributions or receiving a proportionally lesser retirement benefit. Allows the Government to contribute its share of any make-up contribution ratably over a ten-year period.

Recognizes and honors the National Guard on the 365th anniversary of the founding of the Massachusetts Bay Colony militia and recognizes the critical importance of the National Guard to U.S. national security. Salutes members of the National Guard for their service on September 11, 2001, and their continued role in homeland defense and military operations against the al Qaeda terrorist network and the Taliban regime in Afghanistan. Expresses support for providing the National Guard with necessary resources to ensure its continued readiness.

White House Commission on National Military Appreciation Month Act - Expresses the sense of Congress that: (1) the President should establish the White House Commission on National Military Appreciation Month to make recommendations to the President on the proclamation of National Military Appreciation Month to be celebrated in May of each year; and (2) any such Commission should be composed of specified members. Expresses the sense of Congress that if such Commission is established, the President should also establish the Spirit of America Alliance to assist the Commission: (1) in the planning, organization, and conduct of an annual White House Conference on National Military Appreciation and other similar events; (2) in the promotion of the observance of such Month and other military commemorative events through appropriate means, subject to any guidelines developed by the Commission; (3) in the establishment of necessary incentives for Federal, State, and local governments and private sector entities to sponsor and participate in programs initiated by the Commission or the Alliance; (4) in the evaluation of the effectiveness of efforts by the Commission and the Alliance in carrying out this Act; and (5) by the performance of any other related duties that are assigned by the Commission.

Bioterrorism Preparedness Act of 2001 - Amends the Public Health Service Act to add provisions granting additional authorities to the Secretary of Health and Human Services concerning bioterrorism preparedness and responding to public health emergencies. Requires the Secretary to develop and implement a plan which includes the development of specific criteria enabling measurements to be made of the progress made at the national, State, and local levels toward achieving the national goal of bioterrorism preparedness. Requires the maintenance of an adequate national pharmaceutical stockpile of vaccines (including a smallpox vaccine), therapies, and medical supplies for use at the Secretary's discretion in the event of a biological threat or attack or other public health emergency. Expands the role of the Centers for Disease Control and Prevention. Directs the Secretary to provide for the establishment of a coordinated network of public health laboratories to assist with the detection of and response to a biological threat or attack. Provides for the appointment of an Assistant Secretary for Emergency Preparedness who shall head the Office for Emergency Preparedness. Provides for a National Disaster Medical System to provide appropriate health and social services to respond to a public health emergency, if the Secretary activates the System. Provides for enhanced regulatory control of biological agents and toxins. Establishes a State Bioterrorism Preparedness and Response Block Grant Program to improve State and local preparedness and response capabilities. Amends the Clayton Act to provide for a limited antitrust exemption with respect to the development of new countermeasures against bioterrorism. Requires, under the Public Health Service Act, the development of a crisis communications and education strategy with respect to bioterrorist threats to the food supply. Expands animal and plant health inspection service activities and authorities. Amends the Federal Food, Drug and Cosmetic Act to expand the authority of the Food and Drug Administration with respect to food presenting a serious threat to humans or animals. Requires the registration of food manufacturing, processing, and handling facilities. Directs the Secretary of Agriculture to utilize existing authorities to expand Agricultural Research Service and Cooperative State Research Education and Extension Service programs to protect the food supply of the United States.

Terrorism Risk Insurance Act of 2001 - Establishes in the Department of the Treasury the Terrorism Insured Loss Shared Compensation Program to the pay the Federal share of compensation for insured losses resulting from an act of terrorism occurring during specified periods through December 31, 2004. Sets forth an annual liability cap. States that this Act: (1) constitutes payment authority in advance of appropriation Acts; and (2) represents the obligation of the Federal Government to provide for the Federal share of compensation for insured losses under such Program. Confers general and administrative authority upon the Secretary of the Treasury to implement the Program, including assessments for civil penalties for violations of this Act. Grants the United States subrogation rights. Sunsets the Program at a specified date subject to a one year extension at the Secretary's discretion. Preserves the jurisdiction and regulatory authority of the State Insurance Commissioners. Expresses the sense of the Congress that the insurance industry should build capacity and aggregate risk to provide affordable property and casualty coverage for terrorism risk. Outlines procedures for civil actions.

Enhanced Border Security and Visa Entry Reform Act of 2001 - Directs the Attorney General to waive Immigration and Naturalization Service (INS) personnel limits. Authorizes appropriations for INS, Border Patrol, United States Customs Service, and consular personnel, training, facilities, and security-related technology. Provides for machine-readable visa fees. Directs U.S. law enforcement and intelligence entities to share alien admissibility- and deportation-related information with INS and the Department of State. Directs the President to develop and implement an interoperable law enforcement and intelligence data system (with name-matching and linguistic capacity) for visa, admissibility, or deportation determination purposes. Amends the Immigration and Nationality Act (Act) to require a consular officer issuing a visa to provide INS with an electronic version of the alien's visa file prior to the alien's U.S. entry. Sets forth technology standard and interoperability requirements respecting development and implementation of the integrated entry and exit data system and related tamper-resistant, machine-readable documents containing biometric identifiers. Directs the Secretary of State (Secretary) to: (1) establish a Terrorist Lookout Committee at each U.S. mission in which there is a consular post; and (2) provide consular staff with visa screening training. Prohibits the admission of an alien from a country designated to be a state sponsor of terrorism until a determination has been made that such individual does not pose a risk to the United States. Conditions participation in the visa waiver program upon a country's timely reporting to the United States of its stolen blank passports. Requires the Attorney General to enter stolen passport identification numbers into the interoperable data system.. Directs the Secretary, the Secretary of the Treasury, the Attorney General, and the Commissioner of INS to study the feasibility of establishing a North American Perimeter National Security Program (United States, Canada, Mexico), including consideration of alien preclearance and preinspection. Amends the Act to require commercial aircraft or vessels arriving at, or departing from, the United States to provide immigration officers with specified passenger and crew manifest information. Authorizes such provisions' extension to land carriers. Requires electronic manifest transmission by a specified date. Amends the Ports and Waterways Safety Act to revise and specify vessel prearrival message requirements. Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to direct the Attorney General to develop an electronic means of verifying and monitoring the foreign student information program, including aspects of documentation and visas issuance, and registration and enrollment. Increases student data requirements. Specifies information required for foreign student visa applications. Sets forth transitional monitoring requirements, including a requirement that an educational institution report student failure to enroll information to INS. Provides for INS and Department of State review of institutions authorized to enroll foreign students and exchange visitors. Amends Federal law to treat INS immigration inspectors as law enforcement officers for Federal retirement purposes. Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to extend the deadline for presentation of biometric border crossing identification cards. Directs: (1) the Comptroller General to determine the feasibility of requiring each nonimmigrant alien to report annually to INS respecting his or her address and employer's address; and (2) the Secretary and INS to study alternative approaches to international electronic data cooperation.

Medicare Physician Payment Fairness Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to set the conversion factor (update) for payments under the Medicare physician fee schedule for 2002 at 0.9 percent less than the conversion factor for 2001. Declares that this conversion factor and a specified update adjustment factor for a year after 2002 shall be applied as if this Act had not been in effect. Directs the Medicare Payment Advisory Commission (MEDPAC) to study and report to Congress on replacing the use of the sustainable growth rate as a factor in determining the update for such payments with a factor that more fully accounts for changes in the unit costs of providing physicians' services.

Military Homeowners Equity Act - Amends the Internal Revenue Code to state that members of the Uniformed or Foreign Services on qualified official extended duty shall be considered to be using already owned and used property as a principal residence for purposes of determining exclusion of gain upon such residence's sale.

Veterans' Memorial Preservation and Recognition Act of 2001 - Establishes a Veterans' Memorial Restoration Fund to repair, restore, and maintain veterans' memorials. Provides criminal and civil penalties for desecrating veterans' memorials. States that a veterans cemetery shall be treated as a site for which a supplemental guide sign may be placed on any Federal-aid highway.

American Small Business Emergency Relief and Recovery Act of 2001 - Amends the Small Business Act to authorize the Small Business Administration (SBA) to make disaster loans to a small business concern that has been directly affected and suffered or is likely to suffer substantial economic injury as the direct result of the terrorist attacks of September 11, 2001, including injury due to closure or suspension of its business for national security purposes by the Federal Government. Authorizes the SBA, during the year after enactment of this Act, to make loans to small business concerns that have suffered or are likely to suffer economic harm to or disruption of operations as a result such attacks. Waives guarantee fees and increases the guarantee percentage on such loans for one year after the enactment of this Act. Amends the Small Business Investment Act of 1958 to: (1) waive development company debenture guarantee loan fees for financings made after enactment of this Act for one year; and (2) authorize small business investment companies to issue leverage to assist small business concerns adversely impacted by the terrorist attacks. Amends the Small Business Act to authorize special, individualized assistance to small business concerns adversely impacted by the terrorist attacks through the following programs; (1) small business development centers; (2) Service Corps of Retired Executives (SCORE); (3) microloan program (women, low-income, veterans, minority); and (4) women's business center program. Directs the Office of Advocacy of the SBA to conduct annual studies on the impact of the events of September 11, 2001, on small business concerns, and the effects of assistance provided under this Act.

Honoring the Passengers and Crew of United Flight 93 Act - Authorizes the President to award posthumously the Congressional Gold Medal to the passengers and crew of United Airlines flight 93 in the aftermath of the terrorist attack on the United States on September 11, 2001.

Expresses the sense of Congress that: (1) because of the tragic events of September 11, 2001, the limit on the number of Public Safety Officer Medals of Valor should be waived and a medal should be awarded under the Public Safety Officer Medal of Valor Act of 2001 to any officer who was killed in the line of duty; and (2) the Medal of Valor Review Board should give strong consideration to the acts of bravery by other officers in responding to these events.

Amends Internal Revenue Code provisions concerning the death of a U.S. military or civilian employee resulting from a terrorist activity or military action to exempt such employee from income taxes if the activity or action occurred either inside or outside the United States. (Currently, the exemption from income taxes in such a situation is limited only to a death resulting from an activity or action which occurred outside the United States.) Makes the additional estate tax inapplicable in the case of a U.S. military or civilian employee who died as a result of wounds incurred in a terrorist activity or military action which occurred either inside or outside the United States.

Condemns the terrorists who attacked the United States on September 11, 2001, as well as their sponsors. Extends condolences to the victims and their families and commends the heroic actions of the rescue workers, volunteers, and State and local officials who responded. Declares that the United States is entitled under international law to respond to these attacks. Expresses: (1) thanks to those foreign leaders and individuals who have expressed solidarity with the United States in the aftermath of the attacks and asks them to continue to stand with the United States in the war against international terrorism; (2) a commitment to support increased resources in the war to eradicate terrorism; and (3) support for the determination of the President to bring to justice and punish the perpetrators of these attacks and their sponsors. Declares September 12, 2001, to be a National Day of Unity and Mourning.

Middle East Peace Compliance Act of 2001 - Imposes specified sanctions with respect to the Palestine Liberation Organization (PLO) or the Palestinian Authority if the President determines that such entities have not substantially complied with certain commitments made with Israel. Authorizes the President to waive such sanctions in the U.S. national security interest.

Common Sense Medical Malpractice Reform Act of 2001 - Declares that, in a health care liability action that is subject to this Act: (1) the action may not be initiated unless a complaint is filed within two years, with exceptions; (2) the amount of non-economic damages shall not exceed $250,000; and (3) an award for punitive damages may only be made if proven by clear and convincing evidence that the defendant intended to injure the claimant for a reason unrelated to the provision of health care services; understood the claimant was substantially certain to suffer unnecessary injury and deliberately failed to avoid such injury; or acted with a conscious disregard of a substantial and unjustifiable risk of unnecessary injury which the defendant failed to avoid in a manner which constitutes a gross deviation from the normal standard of conduct. Establishes additional limitations on punitive damages, including specified requirements for the pleading of punitive damages, and a requirement (at the request of any defendant in a health care liability action) that the trier of fact consider the issue of punitive damages in a separate proceeding. Sets forth provisions regarding periodic payments, the scope of liability (the liability of each defendant shall be several only and not joint), mandatory offsets for damages paid by a collateral source, and a cap on attorney's fees (limited to 25 percent of any judgement or settlement recovered). Encourages each State to establish or maintain ADR mechanisms. Directs the Attorney General to develop guidelines regarding such mechanisms.

Persian Gulf War POW/MIA Accountability Act of 2001 - Amends the Bring Them Home Alive Act of 2000 to direct the Attorney General to grant refugee status in the United States to any alien (and parent, spouse, or child thereof) who: (1) is a national of Iraq or a nation of the Greater Middle East Region; and (2) personally delivers into the custody of the United States Government a living American Persian Gulf War POW/MIA. Includes Iraq, Kuwait, and any other country of the Greater Middle East Region among the countries to which the International Broadcasting Bureau is required to broadcast information that promotes such refugee program.

Amends the Tennessee Valley Authority Act of 1933 to: (1) expand from 3 to 7 the membership of the Board of Directors; (2) grant permanent membership to the States of Alabama, Georgia, Kentucky, Mississippi; North Carolina, Tennessee, and Virginia; (3) confer chief executive officer status upon the chairperson selected from among board members; and (4) revise compensation guidelines.

Conservation Tax Incentives Act of 2001 - Amends the Internal Revenue Code of 1986 to exclude from gross income 50 percent of any gains from the sale to eligible entities for conservation purposes of specified land or an interest in land or water.

Small Business Paperwork Relief Act of 2001 - Amends the Paperwork Reduction Act to require the Director of the Office of Management and Budget, annually, to publish in the Federal Register and make available on the Internet a list of the collections of information required by Federal agencies which are applicable to small businesses. Requires each Federal agency, with respect to the collection of information and the control of paperwork, to establish one agency point of contact to act as a liaison with small businesses. Requires each agency to make efforts to further reduce the paperwork burden for small businesses with fewer than 25 employees. Establishes a task force to study the feasibility of streamlining requirements with respect to small businesses regarding the collection of information. Amends the Small Business Regulatory Enforcement Fairness Act of 1996 to require each agency to submit, biennially, to specified congressional committees information concerning regulatory enforcement actions taken and civil penalties assessed, including actions and assessments against small businesses.
