National Infantry Museum and Soldier Center Commemorative Coin Act of 2008 - Directs the Secretary of the Treasury to mint and issue $1 coins emblematic of the courage, pride, sacrifice, sense of duty, and history of the U.S. Infantry, in commemoration of the legacy of the U.S. Army Infantry and the establishment of the National Infantry Museum and Soldier Center. Expresses the sense of Congress that the coins should be struck at the U.S. Mint at West Point, New York, to the greatest extent possible. Restricts coin issuance to calendar year 2012. Requires a $10 surcharge per coin, and payment of all surcharges received to the National Infantry Foundation to establish an endowment to support the maintenance of the National Infantry Museum and Soldier Center.

Protecting Children from Pornography and Internet Exploitation Act of 2008 - Providing Resources, Officers, and Technology to Eradicate Cyber Threats to Our Children Act of 2008 or the PROTECT Our Children Act of 2008 - Directs the Attorney General to create and implement a National Strategy for Child Exploitation Prevention and Interdiction and to submit such Strategy to Congress by February 1 of each year. Establishes within the Department of Justice (DOJ) a National Internet Crimes Against Children (ICAC) Task Force Program consisting of state and local law enforcement task forces (including at least one ICAC Task Force for each state) to address online enticement of children, child exploitation, and child obscenity and pornography. Directs the Attorney General to conduct periodic reviews of the effectiveness of ICAC task forces and provide training programs to support such task forces. Directs the Attorney General to establish: (1) a National Internet Crimes Against Children Data System (System) to assist the National ICAC Task Force Program and federal, state, local, and tribal agencies in investigating and prosecuting child exploitation; (2) a steering committee to provide guidance to the System on training and technology and the development of strategic plans; and (3) additional computer forensic capacity to address the current backlog for computer forensics, including for child exploitation investigations. Authorizes the Attorney General to award grants to state and local ICAC task forces. Requires the National Institute of Justice to prepare a report on investigative factors that indicate whether a subject of an online child exploitation investigation poses a higher risk of harm to children. Enhancing the Effective Prosecution of Child Pornography Act of 2007 [ sic ] - Amends the federal criminal code to enhance prohibitions against child sexual exploitation and child pornography. Imposes additional requirements on electronic communication or remote computing service providers for reporting suspected violations of child pornography laws.

Expresses the sense of the Senate that: (1) the eighth amendment to the Constitution allows the death penalty for the rape of a child where the crime did not result, and was not intended to result, in death of the victim; (2) the Louisiana statute making child rape punishable by death is constitutional; (3) because Kennedy v. Louisiana was decided under a mistaken view of federal law, the U.S. Supreme Court should grant any petition for rehearing of the case and the portions of the decision regarding the national consensus or evolving standards of decency with respect to the imposition of the death penalty for child rape should not be viewed as binding precedent; and (4) the Supreme Court should reverse its decision on rehearing or in a future case because it was supported by neither commonly held beliefs about cruel and unusual punishment nor by the text, structure, or history of the Constitution.

Honors and commemorates the selfless acts of heroism displayed by the late Private First Class Jacob Joseph Chestnut and Detective John Michael Gibson of the U.S. Capitol Police on July 24, 1998. Expresses: (1) the condolences of the Senate to the wives, children, and other family members of Private First Class Chestnut and Detective Gibson on the 10-year anniversary of their passing; (2) gratitude and appreciation for the professional manner in which the U.S. Capitol Police carry out their diverse missions; and (3) appreciation for the dedication U.S. Capitol Police officers have for protecting the Capitol Complex. Commends the U.S. Capitol Police for their continued courage and professionalism in protecting the Capitol Complex and its employees and visitors.

Better Energy Strategy for Tomorrow Act of 2008, or the BEST Act of 2008 - Directs the Secretary of Energy each year to: (1) analyze all federal policies that encourage, or have the potential to encourage, energy production in the United States; and (2) report to specified congressional committees recommendations for the adjustment of such policies to reduce the dependence of the United States on foreign sources of energy, air pollutants in the environment, greenhouse gas emissions, and the cost of energy. Requires the President to develop every four years and report to Congress on an energy security strategy that proposes comprehensive and long-range energy policies to reduce such dependence, air pollutants, emissions, and cost.

Title VII Fairness Act - Amends the Americans With Disabilities Act of 1990 and title VII (Equal Employment Opportunities) of the Civil Rights Act of 1964 to delay the start of the time period for filing charges of employment discrimination until the aggrieved person has, or should be expected to have, enough information to support a reasonable suspicion of the discrimination, provided the aggrieved person demonstrates that the person did not have, and should not have been expected to have, enough information to support a reasonable suspicion of such discrimination on the date on which the alleged discrimination occurred. Prohibits applying these amendments to alleged discrimination relating to pensions or pension benefits. Applies the above Civil Rights Act of 1964 amendment to discrimination claims brought under: (1) specified provisions of the Americans with Disabilities Act of 1990; and (2) provisions of the Civil Rights Act of 1964 relating to employment by the federal government.

Gas Price Reduction Act of 2008 - Amends the Outer Continental Shelf Lands Act (OCSLA) to prescribe procedures for petition, by the governor of a state with a new producing area within the offshore administrative boundaries beyond the state's submerged land, to make the new producing area available for oil and gas leasing. Directs the Secretary of the Treasury to deposit specified percentages of outer Continental Shelf revenues into: (1) the general fund of the Treasury; and (2) into a special account in the Treasury for disbursal to both new producing states and to the Land and Water Conservation Fund. Amends the Department of the Interior, Environment, and Related Agencies Appropriations Act, 2008, to repeal the prohibition against funding: (1) regulations regarding a commercial leasing program for oil shale resources on public lands; or (2) an oil shale lease sale. Instructs the Secretary of Energy to: (1) expand and accelerate research and development efforts for advanced batteries; and (2) implement a direct loan program for up to 30% of the costs of advanced battery production. Expresses the sense of the Senate that the federal government should implement policies to increase federal purchases of plug-in electric drive vehicles. Directs the Secretary of the Treasury, the Chairman of the Board of Governors of the Federal Reserve System, the Chairman of the Securities and Exchange Commission (SEC), and the Chairman of the Commodity Futures Trading Commission (CFTC) to study jointly and report to Congress on the international regime for regulating trading in energy commodity futures and derivatives. Amends the Commodity Exchange Act to prohibit the CFTC from permitting a foreign board of trade to provide to participants subject to CFTC jurisdiction direct access to electronic trading and order matching unless specified requirements are met. Directs the CFTC to: (1) promulgate rules for routine reporting requirements for index traders and swap dealers in energy and agricultural transactions; and (2) disaggregate and make public monthly information on the positions and value of index funds and other passive, long-only positions in the energy and agricultural futures markets. Instructs the CFTC to report to certain congressional committees on: (1) the scope of commodity index trading in the futures markets; (2) whether classification of index traders and swap dealers in the futures markets can be improved for regulatory and reporting purposes; and (3) whether index trading activity is adversely impacting the price discovery process in the futures markets and whether different practices and controls should be required. Instructs the CFTC to hire additional employees.

Respecting States Rights and Concealed Carry Reciprocity Act of 2008 - Amends the federal criminal code to provide for reciprocity for the carrying of certain concealed firearms in different states by persons who are not prohibited by federal law from possessing, transporting, shipping, or receiving a firearm and who are: (1) carrying a valid state license or permit for carrying a concealed firearm; or (2) otherwise entitled to carry a concealed firearm in their state of residence.

Constitutional Amendment - Marriage Protection Amendment - Declares that: (1) marriage in the United States shall consist only of the union of a man and a woman; and (2) neither the U.S. Constitution nor the constitution of any state shall be construed to require that marriage or the legal incidents of marriage be conferred upon any other union.

Directs the Secretary of Veterans Affairs to provide a dental insurance plan for any veteran enrolled in the Department of Veterans Affairs (VA) annual patient enrollment system, as well as their survivors and dependents. Provides for: (1) the payment of premiums for plan enrollment; and (2) voluntary plan disenrollment.

Enumerated Powers Act - Requires each Act of Congress to contain a concise and definite statement of the constitutional authority relied upon for the enactment of each portion of that Act. Declares that failure to comply with this requirement shall give rise to a point of order in either chamber of Congress.

Veterans 2nd Amendment Protection Act - Prohibits considering a veteran, surviving spouse, or child who is mentally incapacitated, deemed mentally incompetent, or experiencing an extended loss of consciousness from being considered adjudicated as a mental defective for purposes of the right to receive or transport firearms without the order or finding of a judge, magistrate, or other judicial authority of competent jurisdiction that such veteran, surviving spouse, or child is a danger to him- or herself or others.

Medicare DMEPOS Competitive Acquisition Reform Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act to delay generally until after 2011 full implementation of the Medicare competitive acquisition program for the purchase of durable medical equipment (DME), prosthetics, orthotics, and supplies (DMEPOS). Revises such program, dividing its implementation into two rounds, and specifying covered item updates for 2009-2014. Prescribes requirements for application of accreditation in implementing quality standards. Requires suppliers to disclose subcontractors. Directs the Secretary of Health and Human Services to provide for a competitive acquisition ombudsman within the Centers for Medicare & Medicaid Services to respond to complaints and inquiries by suppliers and individuals. Specifies topics for the Comptroller General's required study and report to Congress on the impact of competitive acquisition of DME on suppliers, manufacturers, and patients. Sets forth a special rule for the competitive acquisition program for diabetic testing strips.

Select Agent Program and Biosafety Improvement Act of 2008 - Amends the Public Health Service Act and the Agricultural Bioterrorism Protection Act of 2002 to reauthorize appropriations for the Select Agent Program, which lists and controls biological agents and toxins that have the potential to pose a severe threat to public health and safety. Requires appropriate training of individuals handling or using such agents and toxins. Includes the Department of Homeland Security (DHS) among the federal agencies limited in the disclosure of information related to listed agents or toxins. Requires the Secretary of Health and Human Services to contract with the National Academy of Sciences to review and make recommendations for improving the Select Agent Program. Sets forth additional factors that the Secretary must consider in determining whether to list an agent or toxin, including whether the agent or toxin is endemic to the United States. Requires the Secretary to issue guidance on inventorying and monitoring listed biological agents. Directs the Attorney General to issue guidance regarding the scope of the statutory definition of "variola virus." Requires the Secretary to: (1) develop guidelines for how laboratories and laboratory personnel that do not regularly test for listed agents and toxins may be rapidly accessed and utilized during emergencies; and (2) evaluate national needs of, and oversight of, high containment biological laboratories. Provides for the development of minimum standards for laboratory biosafety and biosecurity training for relevant personnel of high containment biological laboratories. Requires the Secretary to establish a Biological Laboratory Incident Reporting System.

Recognizes, on the 12th anniversary of that attack, the service and sacrifice of the 19 members of the U.S. Air Force who died in the terrorist bombing of the Khobar Towers U.S. military housing compound in Dhahran, Saudi Arabia. Calls upon the people of the United States to pause and pay tribute to those brave members of the Air Force. Extends the continued sympathies of Congress to the families of those who died. Assures the members of the Armed Forces serving anywhere in the world that their well-being and interests will at all times be given the highest priority.

Preserving Access to Medicare Act of 2008 - Craig Thomas Rural Hospital and Provider Equity Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to: (1) revise the payment adjustment for low-volume hospitals; (2) extend increased Medicare payments for ground ambulance services; (3) extend the authorization for Medicare rural hospital flexibility program grants; (4) provide for rebasing for sole community hospitals; and (5) extend the rural home health add-on policy through 2009. Revises the formula for payments for physician services to provide an update to the single conversion factor of: (1) 0.5% for the remainder of 2008; and (2) 1.1% for 2009. Extends the Physician Assistance and Quality Initiative (PAQI) Fund. Directs the Secretary of Health and Human Services to establish a Physician Feedback Program. Revises requirements or provides for: (1) incentive payments for electronic prescribing and primary care services in physician scarcity areas; (2) the Medicare anesthesia teaching program; (3) advanced diagnostic imaging services; (4) Medicare coverage of items and services under cardiac rehabilitation and pulmonary rehabilitation programs; (5) phase-out of the indirect costs of medical education (IME) from capitation rates; (6) quality improvement programs; and (7) certain prohibitions with respect to marketing of Medicare Advantage and prescription drug plans. Amends the Public Health Service Act to authorize the Secretary to establish specified pilot projects regarding chronic kidney disease. Amends the Tax Relief and Health Care Act of 2006 to extend the transitional medical assistance (TMA) and abstinence education programs. Amends SSA title XIX to extend: (1) the qualifying individual program; and (2) the Medicaid disproportionate share hospital (DSH) allotment for Tennessee and Hawaii. Provides for: (1) asset verification under Medicaid; and (2) reduction in payments for Medicaid administrative costs to prevent certain payment duplications. Amends the Deficit Reduction Act of 2005 to extend authority for supplemental grants under SSA title IV part A (Temporary Assistance for Needy Families) (TANF). Amends the Medicare, Medicaid and SCHIP Extension Act of 2007 to provide for additional funding for state health insurance assistance programs, area agencies on aging, and aging and disability resource centers. Amends the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 to make appropriations for federal reimbursement of eligible providers for emergency health services furnished to undocumented aliens.

Requires that the Cape Hatteras National Seashore, North Carolina, be managed in accordance with the Interim Protected Species Management Strategy/Environmental Assessment issued by the National Park Service (NPS) during the period beginning on the date of enactment of this Act and ending on the date on which the Secretary of the Interior, acting through the Director of the NPS, issues a special regulation and long-term off-road vehicle management plan for the use of that seashore. Invalidates the consent decree filed in the United States District Court for the Eastern District of North Carolina regarding off-road vehicle use at that seashore.

Military Voting Protection Act of 2008 - Amends the Uniformed and Overseas Citizens Absentee Voting Act to direct the Secretary of Defense (the presidential designee) to establish procedures for: (1) collecting absentee ballots of military overseas voters in elections for federal office; and (2) delivering such ballots to the appropriate state election officials. Requires the designee to: (1) ensure that such ballots are delivered prior to the time established for the closing of the polls on the date of the election; (2) carry out delivery requirements through a contract with a private provider of express mail services, which shall include a mechanism for ballot tracking; and (3) take steps to ensure that such voters are able to cast their votes in a private and independent manner, and that vote contents remain private while in the designee's possession or control. Expresses the sense of Congress that the Department of Defense (DOD) should: (1) utilize existing and emerging technologies to enhance the ability of members of the Armed Forces to meaningfully participate in elections and have their votes counted; and (2) continue to closely examine the option of electronic voting, with the objective of protecting voter privacy and guarding against voter fraud.

Boy Scouts of America Centennial Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue up to 350,000 $1 coins in commemoration of the centennial of the founding of the Boy Scouts of America. Requires the coin design to be emblematic of the 100 years of the organization. Restricts issuance of such coins to February 8 through December 31, 2010. Subjects coin sales to a surcharge of $10 per coin. Requires payment of such surcharges to the National Boy Scouts of America Foundation, to be made available to local councils in the form of grants for the extension of Scouting in hard-to-serve areas.

Designates August 2008 as Digital Television Transition Awareness Month to increase public awareness and encourage consumers to learn about the government coupon program for obtaining converter boxes. Encourages consumers to make the transition well before the conversion date (February 17, 2009). Encourages local nonprofit organizations to assist households in applying for the coupons and installing converter boxes and to educate consumers about websites and other sources of transition information.

Enhancement of Recruitment, Retention, and Readjustment Through Education Act of 2008 - Directs the Secretary of Defense to develop a plan on the coordination of current Department of Defense (DOD) educational assistance programs and the development of additional programs to enable members of the Armed Forces (members) to attain a bachelor's degree while pursuing a military career. Increases rates of educational assistance: (1) under the Montgomery GI Bill; (2) for members of the Selected Reserve; and (3) for Selected Reserve members with extended (more than 12 years) service who provide support for contingency operations and other operations. Provides an annual stipend for individuals receiving basic educational assistance and pursuing a program of education at an approved institution of higher education. Allows a member who has completed six years of service (current law allows only members who have completed six years of service and have a military skill designated as critical) to transfer to one or more dependents any unused portion of the member's educational assistance entitlement. Provides similar authority for members of the Selected Reserve. Authorizes a member on active duty and entitled to basic educational assistance to use all or a portion thereof to repay any outstanding federal student loan. Makes eligible for educational assistance an individual who, after September 30, 2009, receives a commission upon graduation of a service academy or completion of Senior Reserve Officers' Training, and completes at least five years of continuous active duty. Makes eligible for enrollment under the Montgomery GI Bill certain retired personnel originally enrolled in the veterans' educational assistance program. Requires the Secretary of Veterans Affairs to carry out a supplemental educational grant program under which a participating institution of higher education provides certain veterans with the non-federal share of a percentage of such veteran's unmet educational financial need.

Poison Center Support, Enhancement, and Awareness Act of 2008 - Amends the Public Health Service Act to require the Secretary of Health and Human Services to provide coordination and assistance for the maintenance of the nationwide toll-free phone number to access poison control centers. Requires the Secretary to carry out and expand upon a national media campaign to educate the public and health care providers about poison prevention and the availability of poison control center resources in local communities. Authorizes the Secretary to enter into contracts with nationally recognized organizations in the field of poison control and national media firms for the development and implementation of a nationwide poison prevention and poison control center awareness campaign. Expands the poison control center grant program to allow the Secretary to award grants for poison control centers to comply with the operational requirements needed to sustain certification of the center. Adds as the purposes for which such grants may be used: (1) to establish and evaluate best practices in the United States for poison prevention, poison control center outreach, and emergency and preparedness programs; (2) to develop and implement standard patient management guidelines for commonly encountered toxic exposures; (3) to improve national toxic exposure surveillance; (4) to develop, support, and enhance technology and capabilities of professional organizations in the field of poison control to collect national poisoning, toxic occurrence, and related public health data; and (5) to develop initiatives to foster the enhanced public health utilization of national poison data. Eliminates matching requirements for such grants.

Government Oil Acquisition Financial Accountability and Consumer Relief Act of 2008 - Instructs the Secretary of Energy to suspend petroleum acquisition for the Strategic Petroleum Reserve (SPR). Authorizes the Secretary to resume petroleum acquisition for the SPR not earlier than 30 days after the date on which the Secretary notifies Congress that for the most recent consecutive four-week period: (1) the weighted average price of retail, regular, all formulations gasoline in the United States is $2.50 or less per gallon; or (2) the weighted average price of retail, No. 2 diesel in the United States is $2.75 or less per gallon. Amends the Energy Policy and Conservation Act to require that acquisitions made for the SPR reflect a steady monthly dollar value of oil. Instructs the Secretary to include at least 10% heavy crude oil in making any crude oil acquisitions for the SPR.

SBA Reauthorization and Improvement Act of 2008 - Amends the Small Business Act (the Act) to reauthorize for FY2008-FY2010 certain small business assistance programs of the Small Business Administration (SBA), including: (1) the microloan program (loans made to very small businesses for start-up, expansion, or equipment); (2) section 7(a) loans (SBA-guaranteed general business loans); (3) certified development company (CDC) financings; (4) assistance to small businesses affected by a Department of Defense base closure or realignment or the termination of a defense contract or subcontract; (5) the Program for Investment in Microentrepreneurs (PRIME); and (6) small business disaster loans. Revises or adds provisions concerning the microloan program, including: (1) increased loan amounts; and (2) making eligible under such program persons with disabilities. Transfers the PRIME Program from the Riegle Community Development and Regulatory Improvement Act of 1994 to the Act. Establishes the Small Business Intermediary Lending Pilot Program under which the SBA Administrator provides loans to loan intermediaries, who then make loans to startup, newly established, and growing small businesses. Revises or adds provisions concerning the 7(a) loan program, including: (1) establishing a Preferred Lenders Program under which the Administrator may authorize qualified lenders to make and service small business loans; (2) increasing maximum loan amounts and expanding loan eligibility; (3) authority for an alternative loan size standard and a variable loan interest rate; (4) establishing an Office of Minority Small Business Development; (5) increasing small business international trade loans; and (6) requiring a rural lending outreach program. Amends the Small Business Investment Act of 1958 to revise or add provisions concerning CDCs, including: (1) replacing the term "504 loan program" with "local development business loan program"; (2) loan foreclosure and liquidation; (3) adding as an eligible purpose the expansion of businesses in low-income communities; (4) allowing CDC financings to include a limited amount of debt refinancing; (5) repealing the sunset on reserve requirements for premier certified lenders; (6) allowing development companies to issue debentures for the financing of loans; (7) allowing CDCs to provide loans to small, nonprofit child care businesses; and (8) requiring (in some cases) or authorizing CDCs to utilize real estate appraisals in connection with loans. Revises or adds provisions concerning the Small Business Investment Company program, including: (1) reauthorization through FY2010; (2) increased outstanding leverage amounts; and (3) increased maximum investment in a single company. Revises or adds provisions concerning the New Markets Venture Capital Program, including: (1) a goal of selecting at least one participating company from each SBA region; (2) establishing the Office of New Markets Venture Capital; and (3) the use of operational assistance grants. Reauthorizes through FY2010 the: (1) Service Corps of Retired Executives (SCORE) program; (2) small business development center program; and (3) Paul D. Coverdell drug-free workplace program. Revises or adds provisions concerning women's small business ownership. Establishes an Associate Administrator for International Trade. Native American Small Business Development Act of 2008 - Establishes: (1) the Office of Native American Affairs; (2) a Native American small business development program; (3) a Native American development grant pilot program; and (4) an American Indian tribal assistance center grant pilot program. National Small Business Regulatory Assistance Act of 2008 - Establishes a: (1) small business regulatory assistance pilot program; (2) minority entrepreneurship and innovation pilot program; (3) small business health insurance information pilot program; and (4) Native American economic development pilot program. Directs the President to convene a National Small Business Summit. Revises or adds provisions concerning small business lender oversight.

Amends the Internal Revenue Code to suspend excise taxes on gasoline and diesel fuels between May 26, 2008, and September 1, 2008. Provides for reimbursement from the Treasury to the Highway Trust Fund for any reduction in Trust Fund receipts resulting from such suspension. Expresses the policy of Congress that: (1) consumers immediately receive the benefit of the reduction in taxes resulting from this Act; and (2) transportation motor fuels producers and other dealers take necessary actions to reduce fuel prices to reflect such reduction in taxes.

Small Business Health Plans Act of 2008 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide for the establishment and governance of small business health plans, which are group health plans sponsored by trade, industry, professional, chamber of commerce, or similar business associations that meet ERISA certification requirements. Requires the Secretary of Labor to: (1) apply the rules and standards of this Act to Alternative Market Pooling Organizations, such as unions, churches, and other groups; and (2) consult with the domicile state regarding the Secretary's exercise of authority over such plans. Allows other existing plans to be treated as small business health plans under certain circumstances. Amends the Public Health Service Act to require the Secretary of Health and Human Services (the Secretary) to promulgate Minimum Standards for premium variations and Model Small Group Rating Rules for plans under this Act. Requires the Secretary to issue the List of Required Benefits of covered benefits, services, or categories of providers that are required to be provided by health insurance issuers in at least 26 states as a result of state mandate laws. Applies covered benefit, service, or category of provider mandates from the List to states with laws requiring such mandates, but does not apply such mandates from the List to states with no such laws. Supersedes any and all state laws relating to such mandates in the health insurance market. Requires the Secretary to establish the Health Insurance Consensus Standards Board to develop recommendations that harmonize inconsistent state health insurance laws. Provides that any harmonized standards adopted by the Secretary will supersede state laws related to the areas covered by the harmonized standards.

Clean Energy Tax Stimulus Act of 2008 - Amends the Internal Revenue Code to extend certain tax incentives for energy production and conservation. Extends through 2009 the tax credit for the production of electricity from renewable resources (e.g., biomass, geothermal energy, landfill gas, and trash combustion). Includes marine and hydrokinetic renewable energy as a renewable resource eligible for such credit. Allows sales of electricity produced from renewable resources to regulated public utilities. Extends the energy investment tax credits for solar energy (through 2016) and for fuel cell and microturbine property (through 2017). Repeals the dollar per kilowatt limitation for fuel cell property under the energy investment tax credit. Allows public electric utilities to qualify for such credit. Extends through 2009 the tax credit for residential energy efficient property expenditures. Repeals the $2,000 limitation on the tax credit for solar electric property. Allows an offset against the alternative minimum tax (AMT) of tax credit amounts. Extends through 2009 the tax credit for investment in clean renewable energy bonds. Increases the national limitation amount for such bonds. Extends through 2009 deferral provisions relating to the recognition of gain by certain electric utilities. Extends through 2009 the tax credit for nonbusiness energy property. Includes residential biomass fuel stoves (pellet stoves) as eligible energy property for purposes of such credit. Extends through 2010 the tax credit for energy efficient new homes. Extends through 2009 the tax deduction for energy efficient commercial buildings and increases the allowable amount of such deduction. Extends the tax credit for energy efficient appliances to include appliances produced in 2008, 2009, and 2010. Revises and updates energy efficiency standards for such appliances in accordance with the Energy Independence and Security Act of 2007.

Clean Boating Act of 2008 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to provide that no permit shall be required by the Administrator of the Environmental Protection Agency (EPA) under the national pollutant discharge elimination system for the discharge from a recreational vessel of graywater, bilge water, cooling water, weather deck runoff, oil water separator effluent, or effluent from properly functioning marine engines or for any other discharge that is incidental to the normal operation of such vessel. Defines a "recreational vessel" as any vessel that is leased, rented, or chartered to a person for that person's pleasure or that is manufactured or used primarily for pleasure, excluding vessels that are subject to Coast Guard inspection and that are engaged in commercial use or that carry paying passengers. Requires the Administrator to: (1) develop management practices for recreational vessels to mitigate the adverse impacts on U.S. waters of discharges incidental to normal vessel operation (excluding sewage) in any case in which the Administrator determines that the use of those practices is reasonable and practicable; and (2) promulgate federal standards of performance (which may distinguish among vessel types) for each discharge for which such a management practice is developed. Requires the Secretary of the department in which the Coast Guard is operating to promulgate regulations governing the design, construction, installation, and use of management practices for recreational vessels as necessary to meet such standards. Prohibits the owner or operator of a recreational vessel from operating in U.S. waters if such owner or operator is not using applicable management practices in compliance with such regulations.
