Protect and Serve Act of 2020 This bill establishes a new criminal offense for knowingly assaulting a law enforcement officer and causing serious bodily injury (or attempting to do so) in circumstances that affect interstate commerce. It imposes criminal penalties—a prison term, a fine, or both—on a violator.

Contact Lens Rule Modernization Act This bill (1) requires prescribers of contact lenses to conspicuously post notice that the prescriber is required to provide a copy of the contact lens prescription to the patient, (2) prohibits prescribers from requiring patients to acknowledge a contact lens prescription release in writing or electronically, and (3) prohibits automated telephone calls to verify a prescription.

This resolution expresses the sense of the Senate that the establishment of full diplomatic relations between Israel and the United Arab Emirates and between Israel and Bahrain are historic achievements. Further, it encourages other Arab nations to establish full relations with Israel, and it reaffirms the Senate's support for a negotiated, two-state solution to the Israeli-Palestinian conflict.

Stop Blocking Hospitals Act This bill establishes a new criminal offense for preventing ambulances and vehicles used by fire departments and law enforcement agencies from responding to a call or transporting an individual to a hospital. An individual who engages in this conduct is subject to criminal penalties—a fine, a prison term of up to five years, or both.

Rural Forest Markets Act of 2020 This bill directs the Department of Agriculture (USDA) to establish the Rural Forest Market Investment Program to guarantee investments to finance certain projects that will enable rural private forest landowners to participate in an innovative market for forest carbon or other products. Eligible projects are projects developed by a private entity or a publicly supported, charitable nonprofit organization engaged in the aggregation of sustainable forestry practices implemented by rural private forest landowners to facilitate the sale of credits in the voluntary carbon market or other environmental market using a methodology approved by a credible, third-party entity. USDA may guarantee up to $150 million with respect to each investment. Authority to carry out the program terminates on September 30, 2023.

COVID-19 Hospice Respite Care Relief Act of 2020 This bill authorizes the Centers for Medicare & Medicaid Services (CMS) to waive certain limitations with respect to Medicare coverage of hospice care during the public health emergency relating to COVID-19 (i.e., coronavirus disease 2019). Specifically, the CMS may allow respite care to be provided in other settings besides inpatient facilities and may allow such care to be provided for up to 15 (rather than up to 5) consecutive days.

K2 Veterans Toxic Exposure Accountability Act of 2020 This bill addresses the exposure of members of the Armed Forces to toxic substances at Karshi-Khanabad (K2) Air Base in Uzbekistan between October 1, 2001, and December 31, 2005. Specifically, the bill requires the Department of Defense (DOD) to study and report on the exposure of members of the Armed Forces to toxic substances at K2 Air Base during the specified period. The bill also expands the definition of an open burn pit, for purposes of the Department of Veterans Affairs (VA) open burn pit registry, to include burn pits located on land in Uzbekistan. A burn pit is an area used for burning solid waste in open air without equipment. DOD and the VA must ensure that individuals deployed to K2 Air Base during the specified time period are covered by the Depleted Uranium Follow-Up Programs of the departments. Such programs study the health effects of depleted uranium exposure and provide treatment. Upon request by the National Academies of Sciences, Engineering, and Medicine, DOD and the VA must provide information for the performance of a study on the exposure of humans to toxic substances at K2 Air Base during the specified period.

This bill provides statutory authority under the Clean Water Act for activities authorized in the reissued final rule titled Issuance and Reissuance of Nationwide Permits and specifies requirements and criteria for subsequent reissuances of such permits. Nationwide permits are issued for periods of up to five years by the U.S. Army Corps of Engineers to authorize activities that have minimal individual and cumulative adverse environmental effects.

Toxic Exposure in the American Military Act of 2020 or the TEAM Act of 2020 This bill requires the Department of Veterans Affairs (VA) to address health care and benefits for veterans with conditions related to exposure to toxic substances, including by requiring the VA to furnish consultation, testing, and treatment to certain veterans exposed to such substances.

K2 Veterans Advocacy Act of 2020 This bill requires the Department of Veterans Affairs (VA) to enter into an agreement with the Agency for Toxic Substances and Disease Registry to complete a study to identify and assess any causation or correlation between exposure to toxicants at the Karshi-Khanabad (K2) Air Base in Uzbekistan between October 7, 2001, and November 21, 2005, and incidents of cancer or other diseases in members of the Armed Forces. The bill also expands the definition of an open burn pit, for purposes of the VA's open burn pit registry, to include burn pits located on land in Uzbekistan. Repairing Existing Public Land by Adding Necessary Trees Act or the REPLANT Act This bill directs the Department of Agriculture (USDA) annually for each of the 10 years after enactment of this bill to transmit to Congress an estimate of the sums necessary to be appropriated, in addition to the funds available from other sources, to replant and otherwise treat an acreage equal to the acreage to be cut over that year, plus a sufficient portion of the backlog of lands found to be in need of treatment to eliminate the backlog within the 10-year period. After such 10-year period, USDA shall transmit annually to Congress an estimate of the sums necessary to replant and otherwise treat all lands being cut over and maintain planned timber production on all other forested lands in the National Forest System to prevent the development of a backlog of needed work larger than the needed work at the beginning of the fiscal year. Each reforestation activity included in a renewable resource assessment shall be carried out in accordance with applicable Forest Service management practices and definitions, including those contained in a specified amendment and regulations related to silvicultural practices. The Forest Service shall, based on recommendations from regional foresters, create a priority list of reforestation projects that primarily take place on priority land, promote effective reforestation following unplanned events, and may include activities to ensure adequate and appropriate seed availability. USDA shall give priority to projects on the priority list.

Dr. Lorna Breen Health Care Provider Protection Act This bill establishes several grant programs and otherwise requires the Department of Health and Human Services (HHS) to take actions to improve mental and behavioral health and prevent burnout among health care providers. Specifically, HHS must award grants to (1) health professions schools, state or local governments, or nonprofits to provide training for health care providers on suicide prevention, other behavioral health issues, and strategies to improve well-being; and (2) health care providers, prioritizing those in COVID-19 (i.e., coronavirus disease 2019) hot spots, to establish or expand programs to promote mental and behavioral health among health care providers involved with COVID-19 response efforts. HHS must also study issues related to, and develop policy recommendations on, preventing burnout and improving mental and behavioral health among health care providers, removing barriers to accessing care and treatment, and identifying strategies to promote resiliency. Additionally, the Centers for Disease Control and Prevention must conduct a campaign to encourage health care providers to seek support and treatment for mental and behavioral health concerns.

Time to Rescue United States Trusts Act of 2020 or the TRUST Act of 2020 This bill establishes congressional rescue committees to develop recommendations and legislation to improve critical social contract programs. A critical social contract program is a federal program for which a federal trust fund is established (e.g., Social Security, Medicare, and federal highway programs), with outlays of at least $20 billion during the year preceding the year in which this bill is enacted, and for which the amount of dedicated federal funds and federal trust fund balances will be inadequate to meet the total amount of outlays of the program that would otherwise be made. Each rescue committee may develop recommendations and legislation to improve the program for which it was established, including by (1) increasing the duration of positive balances of the federal trust fund established for the program, and (2) providing for the solvency of the federal trust fund established for the program during a 75-year period. Congress must use specified expedited legislative procedures to consider legislation that is approved and submitted by the rescue committees.

Restoring Critical Supply Chains and Intellectual Property Act This bill establishes tax credits, incentives, and other measures to support U.S. production of personal protective equipment (PPE), semiconductors, and critical minerals. Among other things, the bill (1) prohibits the use of federal funds for procurement of PPE items not produced in the United States, and (2) establishes a $7.5 billion tax credit for investment in certain medical PPE manufacturing projects. The bill also addresses the security of federally funded research and development grants and export-controlled goods, technologies, or sensitive information, including by establishing a Federal Research Security Council to develop research and development grant making policy and management guidance to protect the national and economic security interests of the United States. Further, it prohibits any federal grant application that fails to disclose the receipt of any outside compensation, including foreign compensation. The bill establishes investments and incentives to support U.S. semiconductor manufacturing, research and development, and supply chain security, such as requiring the National Institute of Standards and Technology to carry out a semiconductor manufacturing program to accelerate research and development for next generation semiconductors. Lastly, the bill addresses availability, development, and production of domestic critical minerals by (1) requiring the President to coordinate agencies to implement U.S. policy regarding critical minerals, including by establishing a capability for identifying critical mineral demand and supply; (2) establishing a grant program for critical mineral education, training, and workforce development programs at institutions of higher education; and (3) reauthorizing through FY2030 the National Geological and Geophysical Data Preservation Program.

Safeguarding America's Frontline Employees To Offer Work Opportunities Required to Kickstart the Economy Act or the SAFE TO WORK Act This bill limits liability for injuries related to COVID-19 (i.e., coronavirus disease 2019). Generally, an individual alleging harm from exposure to coronavirus or related medical treatment occurring before October 1, 2024, may sue only under the causes of action created by this bill, with limited exceptions. However, the bill does not preempt any law that imposes stricter limits on liability or otherwise provides greater protections to defendants. An individual or entity engaged in business or other activities may be liable for injuries resulting from coronavirus exposure only if the plaintiff proves by clear and convincing evidence that (1) the defendant did not make reasonable efforts to comply with government standards and guidance, (2) the defendant's actions constitute gross negligence or willful misconduct, and (3) actual exposure caused the plaintiff's injury. (The clear and convincing evidence standard is a higher standard of proof than is typically required in a civil action.) Similarly, a health care provider may be liable for injuries connected to coronavirus-related services only if the plaintiff proves by clear and convincing evidence that (1) the provider's actions constituted gross negligence or willful misconduct, and (2) such actions directly caused the injury. The bill also contains various coronavirus-related protections for defendants, including protections that (1) exempt an employer or operator of public accommodations that meets certain requirements from liability under certain federal laws, (2) impose limitations on coronavirus-related class action lawsuits, and (3) limit liability for certain injuries related to workplace coronavirus testing.

Drug-Free Communities Pandemic Relief Act This bill authorizes the Drug-Free Communities Support Program, subject to certain limitations, to waive matching funds requirements applicable to certain grants for reducing substance use among youth. Before waiving these requirements, the program must determine that a grantee is unable to raise funds because of the COVID-19 (i.e. coronavirus disease 2019) emergency. Currently, the Office of National Drug Control Policy administers this program, and community coalitions that receive the grants must match a specified percentage of the federal award amount with nonfederal funds, including in-kind contributions.

United States Manufacturing Availability of Domestic Equipment Act or the U.S. MADE Act of 2020 This bill prohibits the use of funds in the Strategic National Stockpile for the procurement of certain items unless they are grown, reprocessed, reused, or produced in the United States. Such items include personal protective equipment, including protective masks and gowns, sanitizing and disinfecting wipes, privacy curtains and coverings, or other textile medical supplies and equipment. The bill also allows a new 30% investment tax credit for qualifying medical personal protective equipment manufacturing projects. The term qualifying medical personal protective equipment manufacturing project is a project which reequips, expands, establishes or continues existing production of drugs, vaccines, and medical equipment for the emergency health security of the United States

COVID-19 Emergency Telehealth Impact Reporting Act of 2020 This bill requires the Department of Health and Human Services (HHS) to analyze the impact of expanded Medicare telehealth services that were authorized through emergency waivers related to the COVID-19 (i.e., coronavirus disease 2019) pandemic. In developing this analysis, HHS must seek input from the Medicare Payment Advisory Commission, the Medicaid and CHIP Payment and Access Commission, and other stakeholders. Additionally, the final report of the analysis must include conclusions about the impact of telehealth on health care delivery and estimates for Medicare spending on telehealth during the COVID-19 emergency.

Civil Justice for Victims of China-Originated Viral Infections Diseases Act or the Civil Justice for Victims of COVID Act This bill allows a foreign government to be sued in U.S. district court regarding that government's actions related to the COVID-19 (i.e., coronavirus disease 2019) outbreak. A foreign government shall not have sovereign immunity against a lawsuit in the United States seeking money damages for physical or economic injury occurring in the United States following any reckless action or omission of that foreign government (or any official or agent of that government) that caused or substantially contributed to the COVID-19 outbreak in the United States. If the United States is in discussions with a foreign state seeking to resolve claims related to COVID-19 against that foreign state, a court may stay a pending case brought under this bill against that foreign state.

This bill waives certain eligibility requirements for hospitals participating in the 340B drug discount program (i.e., a program that allows entities to receive covered outpatient drugs at reduced prices from manufacturers) during the COVID-19 (i.e., coronavirus disease 2019) public health emergency. Specifically, the bill waives the required minimum proportion of low-income patients served for hospitals that began participating in the program during or prior to the COVID-19 emergency.

Flexible Financing for Rural America Act of 2020 This bill allows rural utility service providers to submit to the Department of Agriculture (USDA) a request to adjust the interest rate or modify the terms of certain loans. The request shall include a report summarizing how the adjustment or modification will assist the borrower in providing critical utility services to a rural community. Specifically, on receipt of a request, USDA must adjust the interest rate on the loan to match certain interest rates in effect when the bill is enacted for obligations of comparable maturity to the term remaining on the loan (or a higher rate requested by the borrower), and make modifications to the loan terms as necessary to address changes in the financial position of the borrower due to the COVID-19 (i.e., coronavirus disease 2019) public health emergency and to promote the financial sustainability of the borrower. In carrying out the adjustments or modifications, USDA shall not impose or collect any fee from, or impose any penalty on, a borrower. The bill also provides funding to implement the adjustments and modifications.

Loan Interest Forgiveness for Taxpayers Under a Pandemic Act of 2020 or the LIFT UP Act This bill modifies specified debt relief made available to small businesses in response to COVID-19 (i.e., coronavirus disease 2019). Specifically, the Small Business Administration must pay the principal, interest, and any associated fees that are owed on certain disaster loans made to small businesses prior and unrelated to COVID-19 for a six-month period.

Paycheck Protection Small Business Forgiveness Act This bill modifies loan forgiveness under the Paycheck Protection Program established to support small businesses in response to COVID-19 (i.e., coronavirus disease 2019). Specifically, the bill provides for automatic forgiveness of a paycheck protection loan that is not more than $150,000 if the recipient submits a one-page form. Further, it prohibits any enforcement or other action against a lender relating to loan origination, forgiveness, or guarantee based on the lender's reliance on certifications or documentation submitted by a loan applicant or recipient.

Reinvigorating Lending for the Future Act or the RLF Act This bill reduces reporting requirements for recipients of Revolving Loan Fund grants, which provide funds to capitalize lending programs for businesses that cannot obtain traditional bank financing. Specifically, upon request by a qualifying grantee, the Economic Development Administration (EDA) must release any federal interest in a grant—thereby relieving the grantee of associated federal reporting requirements—if the request is made at least seven years after the final disbursement of the original grant. Currently, the EDA may release the federal interest in a grant beginning 20 years after the grant was awarded.

Tackling Residential Energy burdens Efficiently Act of 2020 or the TREE Act of 2020 This bill directs the Department of Energy to establish a grant program for states, local governments, Indian tribes, and other entities to plant a minimum of 300,000 trees annually in residential neighborhoods throughout the United States.

Save American Vital Energy Jobs Act or the SAVE Jobs Act This bill extends energy-related tax provisions and expands incentives for job creation in the energy sector during the COVID-19 (i.e., coronavirus disease 2019) emergency period. Specifically, the bill extends for one year the construction period for carbon oxide sequestration facilities for purposes of the tax credit, suspends capitalization rules in 2020 to permit immediate expensing of certain inventory costs, reduces the required deposit of certain motor fuel excise taxes from 95% to 25%, allows expensing of intangible drilling costs in 2020, permits extensions and suspensions of production and operations under onshore and offshore leases during the COVID-19 emergency period, requires a royalty rate reduction during the COVID-19 emergency period for a maximum 180-day period, and requires the Department of the Interior to delay until July 1, 2022, the effective date for compliance with the 2016 final rule titled Consolidated Federal Oil & Gas and Federal & Indian Coal Valuation Reform.

Accelerating Broadband Connectivity Act of 2020 This bill establishes the Accelerating Broadband Connectivity Fund from which the Federal Communications Commission (FCC) shall offer additional funding to certain terrestrial telecommunications carriers for specified broadband projects. Specifically, the FCC shall make one-time funding offers from the Accelerating Broadband Connectivity Fund to certain terrestrial telecommunications carriers that receive support from the Rural Digital Opportunity Fund. The Rural Digital Opportunity Fund is a mechanism through which the FCC finances high-speed broadband networks in unserved rural areas. Recipients of amounts from the Accelerating Broadband Connectivity Fund shall use such funds to (1) begin construction of a broadband network, (2) make broadband available from the network deployed using Rural Digital Opportunity Fund support, and (3) meet all build-out obligations pursuant to receiving amounts from the Rural Digital Opportunity Fund.

Foreign Civil Aviation Authority Assistance Act of 2020 This bill provides Federal Aviation Administration (FAA) support for foreign civil aviation authorities. In addition to the current requirement that the FAA promote and achieve global improvements in the safety, efficiency, and environmental effect of air travel, the bill requires the FAA to engage both bilaterally and multilaterally, including with the International Civil Aviation Organization, to bolster international collaboration, data sharing, and harmonization of international aviation safety requirements. The FAA must seek to expand technical assistance in support of enhancing international aviation safety, and it is authorized to provide technical assistance related to all aviation safety-related training and operational services in connection with bilateral and multilateral agreements. The bill also authorizes support for the implementation of certain recommendations to address pilots' dependency on automation.

Homeless Veterans Coronavirus Response Act of 2020 This bill addresses the administration of Department of Veterans Affairs (VA) programs and benefits for homeless veterans during the COVID-19 (i.e., coronavirus disease 2019) public health emergency. During the COVID-19 public health emergency, the bill authorizes the VA to reallocate specified grant funds to provide homeless veterans and veterans participating in the Department of Housing and Urban Development-VA Supportive Housing (HUD-VASH) program with transportation, assistance required for safety and survival, and communications equipment and services; collaborate with organizations to manage use of VA land for homeless veterans for living and sleeping; provide a maximum rate, in certain situations, for per diem payments that is three times the rate authorized for state homes for domiciliary care; provide amounts for additional transitional housing beds to facilitate access to housing and services provided to homeless veterans; and waive certain inspection and safety code requirements to allow grant recipients and therapeutic housing facilities to make adjustments (e.g., facilitating social distancing or isolation needs). Per diem payments may be used to provide assistance required for safety and survival (e.g., food) for homeless veterans and formerly homeless veterans residing in a facility operated by a grant recipient or entity that receives per diem payments for furnishing services to homeless veterans. Finally, the bill requires the VA to ensure that veterans participating in or receiving services under a program for homeless veterans have access to telehealth services. The VA must ensure telehealth capabilities are available to such veterans, VA case managers, and community-based service providers.
