Opioid Overdose Data Collection Enhancement Act

United States · United States Congress · 19 September 2024

Opioid Overdose Data Collection Enhancement Act This bill expands the allowable uses of grants under the Comprehensive Opioid Abuse Grant Program to include the adoption and implementation of an overdose data collection program to track fatal and nonfatal overdoses and the administration of opioid overdose reversal medication (e.g., the Overdose Detection Mapping Application Program). Specifically, the bill allows states, local governments, coalitions of law enforcement agencies, and Indian tribes to use these grants to develop and implement a data collection tool, including mobile data mapping applications. The tool must allow these entities to easily and quickly track the locations of (1) suspected fatal and nonfatal overdoses, and (2) the administration of opioid overdose reversal medication by first responders. An entity seeking to use a grant must first conduct an audit of available data and resources and submit the audit with the grant application. Grant recipients must (1) support the development of coordinated public safety, behavioral health, and public health responses to the data collected by the tool; (2) focus on areas in which fatal and nonfatal overdoses occur and trends of concern; (3) provide for interoperability with existing overdose data collection tools; and (4) make data collected through the program available to federal, state, tribal, and territorial governments and coalitions of law enforcement agencies. The Department of Justice must consult with agencies that maintain overdose data collection tools, including the Office of National Drug Control Policy.

Strengthening Child Exploitation Enforcement Act

United States · United States Congress · 11 July 2024

Strengthening Child Exploitation Enforcement Act This bill makes changes to federal criminal laws related to various offenses, particularly sexual abuse offenses against minors. The bill revises the federal kidnapping statute by specifying that obtaining a victim by defrauding or deceiving a third party constitutes the offense of kidnapping. Additionally, for a kidnapping offense that involves a victim who has not attained the age of 16, the bill specifies that it is not a defense that the victim consented to the conduct of the offender, unless the offender establishes by a preponderance of the evidence that the offender reasonably believed that the victim had attained the age of 16. The bill also revises statutes related to sexual abuse offenses against minors to specify the following: that crossing international lines with the intent to engage in a sexual act with a child who has not attained the age of 12 constitutes aggravated sexual abuse (currently, the statute only references crossing state lines), that the offense of sexual abuse of a minor also includes knowingly causing the intentional touching of any person by a person who has not attained the age of 16, and that attempting to commit abusive sexual contact is also a crime that is subject to the same penalty as the completed offense.
