This resolution designates September 2021 as National Voting Rights Month, encourages people to uphold the right to vote, encourages Congress to pass certain voting rights legislation, recommends the development of a curriculum in public schools and universities regarding voting, encourages the U.S. Postal Service to issue a special John R. Lewis stamp during the month of September, and invites Congress to allocate funds for public service announcements regarding elections.

Federal Employees Civil Relief Act This bill establishes a framework to temporarily suspend certain judicial and administrative proceedings against a federal employee or contractor during a shutdown (i.e., any period in which there is more than a 24-hour lapse in appropriations affecting any federal agency or department). A federal worker who is furloughed or required to work without pay during a shutdown may apply to a court for a temporary stay, postponement, or suspension of any payment of rent, mortgage, tax, fine, penalty, insurance premium, student loan repayment, or other civil obligation or liability that the worker or individual owes or would owe during the duration of the shutdown. The Department of Justice many commence a civil action against any person who engages in (1) a pattern or practice of violating the requirements of this bill, or (2) a violation that raises an issue of significant public importance. A person aggrieved by a violation of this bill's requirements may also bring a private right of action.

Indian Health Service Health Professions Tax Fairness Act of 2021 This bill excludes from gross income, for income tax purposes, payments under the Indian Health Service Loan Repayment Program and certain amounts received under the Indian Health Professions Scholarships Program.

Performing Artist Tax Parity Act of 2021 This bill modifies the tax deduction for the expenses of performing artists (including commissions paid to managers or agents) to provide for a phaseout of such deduction for taxpayers whose adjusted gross income exceeds $100,000 ($200,000 for joint return filers). The $100,000 phaseout threshold is adjusted for inflation annually for taxable years beginning after 2021.

Alternatives to Detention Act of 2021 This bill requires the Department of Homeland Security (DHS) to establish programs that are alternatives to detention for immigration enforcement and addresses related issues. Such programs must be available regardless of whether an alien is subject to a removal order or whether a charge of removability is pending, but shall not be available to certain aliens, such as those subject to mandatory detention. DHS or an immigration judge must determine, within 72 hours of an individual being taken into custody for immigration enforcement, the appropriate level of supervision for the individual and whether the individual may participate in such an alternative program. For a member of a vulnerable population (such as a victim of trafficking) or a caregiver (such as a parent of a minor), there must be a presumption that such an individual must be placed in a community-based supervision program. DHS must restore the Family Case Management Program as an alternative to detention. This program must provide community supervision and community support services through a contract with a nongovernmental organization. DHS must establish a Coordinator of Alternatives to Detention position. The Government Accountability Office must report on the use and effectiveness of the programs established under this bill.

Radiation Exposure Compensation Act Amendments of 2021 This bill expands two programs that compensate individuals who were exposed to radiation during certain nuclear testing or uranium mining and subsequently developed medical conditions, including cancers. First, the bill expands and extends a program that compensates individuals who were exposed to radiation from atmospheric nuclear testing or other sources and subsequently developed specified cancers. Under current law, this program compensates individuals who were present in a designated geographic area during a period of nuclear testing and certain individuals employed in uranium mining. The bill expands the designated areas to include Colorado, Idaho, Montana, New Mexico, and Guam and additional areas in Arizona, Nevada, and Utah; makes more individuals who worked in uranium mining eligible for the program; increases the amount of compensation awarded to and provides medical benefits for eligible claimants; and extends for 19 years following the bill's enactment the fund that supports this program and the statute of limitations for filing claims (currently, the program terminates on July 10, 2022). Second, the bill makes certain individuals employed in uranium mines or mills eligible for a program that compensates workers, including Department of Energy employees and contractors, for illnesses caused by occupational exposure to radiation and hazardous substances during development and testing of the nation's nuclear weapons stockpile. The bill also establishes a grant program in the National Institute of Environmental Health Sciences for institutions of higher education to study the epidemiological impacts of uranium mining and milling among individuals without occupational exposure.

Financial Compensation for CFPB Whistleblowers Act This bill requires the Consumer Financial Protection Bureau to provide rewards to whistleblowers who report information relating to a violation of consumer financial law resulting in certain monetary sanctions exceeding $1 million. Specifically, the bureau must award compensation to whistleblowers for 10%-30% of the collected penalties. In cases where the bureau collects less than $1 million in penalties, the bureau must award any single whistleblower 10% of the amount collected or $50,000, whichever is greater. The bill also sets forth requirements regarding the legal representation of a whistleblower and provides for confidentiality regarding the whistleblower's identity.

SNAP Tribal Food Sovereignty Act of 2021 This bill directs the Department of Agriculture to enter into self-determination contracts upon the request of Indian tribes and tribal organizations to carry out the Supplemental Nutrition Assistance Program.

This joint resolution proposes a constitutional amendment authorizing Congress and the states to set reasonable limits on the raising and spending of money by candidates and others to influence elections. The amendment grants Congress and the states the power to implement and enforce this amendment by legislation. They are allowed to distinguish between natural persons and corporations or other artificial entities created by law, including by prohibiting such entities from spending money to influence elections.

This bill provides funding that is available until September 30, 2030, for grants and other activities to support next generation 9-1-1 systems (i.e., interoperable, secure, Internet Protocol-based systems for receiving 9-1-1 requests for emergency assistance). The National Telecommunications and Information Administration (NTIA) must award grants to state, tribal, and territorial organizations (or entities established by one or more of those organizations) for implementing next generation 9-1-1 systems. The Inspector General of the Department of Commerce must conduct oversight related to the grants. The bill also establishes (1) a center to coordinate with state, local, and regional governments about cybersecurity threats to next generation 9-1-1 systems and strategies to detect and prevent such threats; and (2) an advisory board to provide the NTIA with recommendations about next generation 9-1-1 activities.

Do No Harm Act This bill prohibits the application of the Religious Freedom Restoration Act of 1993 (RFRA) to specified federal laws or the implementation of such laws. Currently, RFRA prohibits the government from substantially burdening a person's exercise of religion even if the burden results from a rule of general applicability, except in furtherance of a compelling governmental interest when using the least restrictive means. Under the bill, RFRA is inapplicable to laws or the implementation of laws that protect against discrimination or the promotion of equal opportunity (e.g., the Civil Rights Act of 1964); require employers to provide wages, other compensation, or benefits, including leave; protect collective activity in the workplace; protect against child labor, abuse, or exploitation; or provide for access to, information about, referrals for, provision of, or coverage for, any health care item or service. The bill prevents RFRA from being used to deny (1) goods or services the government has contracted, granted, or made an agreement to provide to a beneficiary of or participant in a program or activity funded by such government contract, grant, agreement, or other award; or (2) a person's full and equal enjoyment of a government-provided good, service, benefit, facility, privilege, advantage, or accommodation. In order for a person to assert a RFRA claim or defense in a judicial proceeding, the government must be a party to the proceeding.

Recognizing the Protection of Motorsports Act of 2021 or the RPM Act of 2021 This bill authorizes the modification of a vehicle's air emission controls for vehicles that are not legal for operation on a street or highway and are used solely for competition. In relation to the exemption of competition vehicles from anti-tampering provisions, the Environmental Protection Agency (EPA) is prohibited from creating or authorizing a database of vehicle registration information that is required to be consulted at the point of manufacture, sale, installation, or use of parts or components. Additionally, the EPA may not require the registration of a vehicle, or part or component of a vehicle, by the manufacturer, seller, purchaser, installer, or user of the vehicle. The regulation prescribed by the EPA regarding the exemption must include certain components, including a description of the reasonable conditions for the applicability of the exemption.

Freedom to Vote Act This bill addresses voter registration and voting access, election integrity and security, redistricting, and campaign finance. Specifically, the bill expands voter registration (e.g., automatic and same-day registration) and voting access (e.g., vote-by-mail and early voting). It also limits removing voters from voter rolls. Next, the bill establishes Election Day as a federal holiday. The bill declares that the right of a U.S. citizen to vote in any election for federal office shall not be denied or abridged because that individual has been convicted of a criminal offense unless, at the time of the election, such individual is serving a felony sentence. The bill establishes certain federal criminal offenses related to voting. In particular, the bill establishes a new criminal offense for conduct (or attempted conduct) to corruptly hinder, interfere with, or prevent another person from registering to vote or helping someone register to vote. Additionally, the bill sets forth provisions related to election security, including by requiring states to conduct post-election audits for federal elections. The bill outlines criteria for congressional redistricting and generally prohibits mid-decade redistricting. The bill addresses campaign finance, including by expanding the prohibition on campaign spending by foreign nationals, requiring additional disclosure of campaign-related fundraising and spending, requiring additional disclaimers regarding certain political advertising, and establishing an alternative campaign funding system for certain federal offices.

Filing Relief for Natural Disasters Act This bill authorizes the Internal Revenue Service to postpone federal tax filing deadlines upon the written request of a governor of a state in which an emergency or disaster has been declared. The bill also extends current mandatory extensions from 60 to 120 days. For purposes of this bill, a state includes the District of Columbia, the Commonwealth of Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.

Dustoff Crews of the Vietnam War Congressional Gold Medal Act This bill provides for the award of a single Congressional Gold Medal to Dustoff crews (helicopter air ambulance crews) of the Vietnam War in recognition of their heroic military service.

Public Transportation Expansion Act This bill authorizes the Department of Housing and Urban Development and the Department of Transportation to support access to affordable housing and enhanced mobility for residents in certain disadvantaged communities or low-income riders through grants for construction of new fixed guideway capital projects, construction of zero-emission bus rapid transit projects, or other public transportation projects.

Korean War Divided Families Reunification Act This bill directs the Department of State to periodically report to Congress on its consultations with South Korea on potential opportunities to reunite Korean Americans with family in North Korea. The State Department's Special Envoy on North Korean Human Rights Issues shall periodically report to Congress on its consultations with representatives of Korean Americans with family in North Korea on reunification efforts.

Frank Harrison, Elizabeth Peratrovich, and Miguel Trujillo Native American Voting Rights Act of 2021 This bill addresses the voting rights of Native American and Alaska Native voters and voting access on tribal lands. The bill includes provisions expanding the types of facilities that can be used as voter registration agencies; increasing polling site accessibility, including by expanding early in-person voting and providing ballot drop boxes; providing enforcement power to citizens and attorneys general; requiring approval for actions like moving a polling place; validating certain tribal identification for voting or registering to vote; permitting voters to designate another individual to return a ballot on their behalf; and expanding requirements for bilingual voting accessibility. In addition, the bill establishes a Native American voting task force grant program for the purpose of increasing voter outreach, education, registration, turnout, and accessibility for Native American communities. The bill also directs the Government Accountability Office to study and report on (1) the prevalence of nontraditional or nonexistent mailing addresses among Indians, members of tribes, and individuals residing on Indian lands; and (2) the alternatives for removing barriers to voter registration, receipt of voter information and materials, and receipt of ballots.

Diversifying Investigations Via Equitable Research Studies for Everyone Trials Act or the DIVERSE Trials Act This bill requires activities to increase diversity in clinical trials. It also expands reporting by laboratories that test for and diagnose COVID-19 and requires a study on data collection and data sharing during public health emergencies. Specifically, the Food and Drug Administration (FDA) must issue guidance on decentralized clinical trials to promote meaningful demographic and geographic diversity in patient engagement, enrollment, and participation. Decentralized clinical trials include those executed through telemedicine or other digital technologies to allow for the remote collection and assessment of clinical trial data. The FDA may also work with foreign regulators to harmonize international regulations governing decentralized clinical trials and the use of digital health technology. In addition, the Department of Health and Human Services (HHS) may support community education, outreach, and recruitment activities for clinical trials of treatments for conditions that disproportionately impact populations underrepresented in clinical trials. The bill also specifies that drug or device manufacturers may provide, subject to some limits, free digital health technologies and other remuneration to patients in approved clinical trials without violating laws that address fraud and abuse in federal programs. Furthermore, laboratories that test for and diagnose COVID-19 must report additional demographic data, including information about social determinants of health. HHS must also contract with the National Academy of Medicine to study and propose a design for an interoperable platform to facilitate data sharing during public health emergencies.

Continuing Emergency Support for Restaurants Act This bill provides an additional $48 billion in FY2021 for the Restaurant Revitalization Fund and designates specified amounts for fund administrative expenses and audits of grants made from the fund. The fund was established in response to COVID-19 to make grants to eligible food and beverage purveyors for covering specified costs such as payroll, operational expenses, and paid sick leave. The bill designates the funding as emergency spending, which is exempt from discretionary spending limits.

Livable Communities Act of 2021 This bill creates the Office of Sustainable Communities in the Department of Housing and Urban Development (HUD) to coordinate the provision of long-term affordable housing, transportation, and environmental projects and to administer grant programs established in the bill. The bill creates the Comprehensive Planning Grant Program and the Community Challenge Grant Program to be administered by the office. Grants under the Comprehensive Planning Grant Program must be used for specified activities related to the coordination, development, or updating of a comprehensive regional plan across jurisdictions and agencies. Grants offered under the Community Challenge Grant Program must be used to promote integrated planning and investments across policy and governmental jurisdictions and to implement projects identified in a regional plan. The bill also creates a program that requires HUD to provide loans and loan guarantees to projects that meet specified criteria. Eligible projects must be part of a community-wide development plan, promote sustainable development, and ensure that housing units associated with the project are affordable and initially occupied by lower-income renters or homeowners.

Iran Hostages Congressional Gold Medal Act This bill provides for the award of a Congressional Gold Medal to the 53 hostages of the Iran Hostage Crisis (November 4, 1979-January 21, 1981) in recognition of their bravery and endurance throughout their captivity.

Countering the Chinese Government and Communist Party's Political Influence Operations Act This bill directs the Department of State and the Department of Homeland Security to devise a long-term strategy to counter the Chinese government's political influence operations. The strategy must seek to counter the ruling Chinese Communist Party's campaigns to corrupt democratic countries and undermine democratic institutions, both in the United States and elsewhere. It must also seek to increase awareness of such campaigns and help other countries develop the capacity to counter them. The strategy must also ensure that Chinese nationals living in the United States, as well as Chinese Americans and members of the Uyghur, Mongolian, Korean, Taiwanese, and Tibetan diaspora, are protected against malign political influence operations, such as surveillance and intimidation. The State Department must annually report to Congress about Chinese government efforts to exert influence in the United States and in U.S. partner countries, and suggestions for countering such efforts. The report shall address issues including attempts to (1) influence government institutions and officials, (2) undermine democratic institutions and freedom of speech, and (3) suppress public information.

Protect Moms From Domestic Violence Act This bill establishes a grant program and requires studies to address adverse maternal health outcomes among victims of intimate partner violence, human trafficking, forced marriage, and similar harms. Specifically, the Health Resources and Services Administration must award grants to state, tribal, or local governments, maternal care providers, institutions of higher education, and community organizations for improving maternal and child health outcomes for victims of such harms. In addition, the Department of Health and Human Services (HHS) must study the relative risk of maternal mortality and severe maternal morbidity for victims of such harms. HHS must also contract with the National Academy of Medicine (or a similar entity) to conduct another study examining whether these harms increase the risk of suicide and substance use among pregnant and postpartum persons and other maternal health topics. The bill also requires HHS to disseminate guidance on developing protocols and creating partnerships to address intimate partner violence and similar harms.

Open Access Evapotranspiration Data Act This bill directs the U.S. Geological Survey (USGS) to establish an Open Access Evapotranspiration (OpenET) Data Program under which the USGS shall provide for delivering satellite-based evapotranspiration data to advance the quantification of evaporation and consumptive water use. The bill defines Evapotranspiration as the process by which water is transferred from the land to the atmosphere by evaporation from soil and other surfaces and transpiration from plants. As part of the program, the USGS shall provide data users with field-scale estimates of evapotranspiration data across large landscapes over certain periods of time, enter into cooperative agreements with program partners (e.g., institutions of higher education, states, private sector entities, or nongovernmental organizations) to provide for the efficient and cost-effective administration of the program, and provide nonreimbursable matching funding for programmatic and operational activities.

Expanding Access to Palliative Care Act This bill requires the Center for Medicare and Medicaid Innovation (CMMI) to test a model that provides community-based palliative care and care coordination for high-risk Medicare beneficiaries and that may replace the Medicare Care Choices Model (currently set to expire on December 31, 2021). Under the new model, multi-disciplinary teams must provide coordinated, palliative care that is available 24-7 for Medicare beneficiaries with serious illnesses or injuries, such as cancer. The CMMI must evaluate the model by comparing patients participating in the model with those outside of the model in relation to specified metrics, including the election and duration of hospice care.

Congressional Whistleblower Protection Act of 2021 This bill creates certain administrative and judicial remedies for federal employees whose right to provide information to Congress is interfered with or denied. Under current law, federal employees have the right to petition or furnish information to Congress or to individual Members of Congress, and this right may not be interfered with or denied. The bill explicitly allows employees who are aggrieved by a violation of this right to seek administrative remedies that are currently available to whistleblowers who are fired or experience other forms of retaliation. The bill also establishes a private right of action for aggrieved employees, including the option of a jury trial, if an administrative remedy is not issued within 210 days of a complaint being made. The bill applies to employees and contractors of the executive, legislative, and judicial branches of government, including members of the intelligence community.

Supreme Court Ethics Act This bill establishes a new statutory requirement for the Judicial Conference of the United States to issue a judicial code of conduct for judges and justices of U.S. courts, including Justices of the Supreme Court. Currently, the Judicial Conference issues a code of conduct for judges of U.S. courts (but not for Justices of the Supreme Court).

Brian Neuman Department of Veterans Affairs Clothing Allowance Improvement Act of 2021 This bill modifies the Department of Veterans Affairs (VA) clothing allowance policy for veterans who, due to a service-connected disability, wear a prosthetic, use an orthopedic appliance (e.g., a wheelchair), or use a prescription skin medication that the VA determines causes irreparable damage to clothing. The bill requires the VA to continue the clothing allowance for such a veteran on an annual basis until the veteran elects to no longer receive the allowance, or the VA determines the veteran is no longer eligible for the allowance, whichever occurs first. The bill sets forth a procedure by which the VA must conduct reviews of clothing allowance claims to determine the continued eligibility of veterans. Specifically, the VA must conduct a review (1) five years after the date on which a veteran initially receives a clothing allowance and periodically thereafter, and (2) whenever the VA receives notice that the veteran no longer meets eligibility requirements. If a veteran is eligible for a clothing allowance based on a circumstance that is not subject to change, the VA does not need to review whether the veteran has continued eligibility. If the VA determines, as the result of a review of a claim, that a veteran no longer meets the eligibility requirements for a clothing allowance, the VA must provide notice of the determination and discontinue the clothing allowance. The notice must include a description of applicable actions that may be taken following the determination (e.g., filing a notice of disagreement).

Local Journalism Sustainability Act This bill allows individual taxpayers a tax credit up to $250 in any taxable year for subscriptions to one or more local newspapers for the taxpayer's personal use. It also allows a local news journalist employer a payroll credit for wages paid to local news journalists. The bill allows certain small businesses a tax credit for amounts paid for advertising in a local newspaper or through a broadcast of a radio or television station serving a local community.

Women's Retirement Protection Act This bill modifies the requirements for employer-sponsored pension plans to (1) extend spousal consent requirements that currently apply to defined benefit pension plans to defined contribution pension plans; and (2) allow certain long-term, part-time workers to participate in pension plans that include either a qualified cash or deferred arrangement or a salary reduction agreement. Financial product or service providers who sell retirement financial products or services must provide purchasers of their products or services an easily accessible link to the website of the Consumer Financial Protection Bureau to obtain information relating to retirement planning or later life economic security. The Women's Bureau of the Department of Labor shall award grants to certain community-based organizations to (1) improve the financial literacy of women who are working age or in retirement, and (2) assist low-income women and survivors of domestic violence in obtaining qualified domestic relations orders and the benefits they are entitled to through the orders.

United States Call Center Worker and Consumer Protection Act of 2021 This bill establishes restrictions on businesses that relocate call centers or redirect customer service calls to locations outside the United States. Specifically, a business must notify the Department of Labor that it intends to move its customer service call center overseas and Labor must maintain a publicly available list of such businesses. Subject to narrow exceptions, a business appearing on such list is ineligible to receive federal grants or guaranteed loans for five years after the business is added to the list. Further, agencies must condition the awarding of government contracts on the requirement that any call center activity pursuant to the contract must be performed in the United States. Additionally, the bill requires call center employees to disclose their physical location at the beginning of each call initiated or received, unless all employees of the business participating in the communication are located in the United States, among other exceptions.

Safe Schools Improvement Act of 2021 This bill requires states to direct their local educational agencies (LEAs) to establish policies that prevent and prohibit bullying and harassment of elementary and secondary school students. In particular, these policies must prohibit bullying and harassment based on race, color, national origin, sex, sexual orientation, gender identity, disability, or religion. Further, LEAs must provide (1) students, parents, and educational professionals with annual notice of the conduct prohibited in their disciplinary policies; (2) students and parents with grievance procedures that target such conduct; and (3) the public with annual data on the incidence and frequency of that conduct at the school and LEA level. The Department of Education must conduct and report on an independent biennial evaluation of programs and policies to combat bullying and harassment in elementary and secondary schools. The National Center for Education Statistics must collect state data to determine the incidence and frequency of the conduct prohibited by LEA disciplinary policies.

Western Wildfire Support Act of 2021 This bill establishes activities to address wildfires. The bill requires the Department of Agriculture (USDA) and the Department of the Interior to establish spatial fire management plans before the end of FY2024. The bill establishes accounts in the Treasury for addressing wildfires, a program to train and certify citizens who wish to be able to volunteer to assist USDA or Interior during a wildland fire incident, a program to award grants to eligible states or units of local government to acquire slip-on tank and pump units for a surge capacity of resources for fire suppression, the Theodore Roosevelt Genius Prize for the management of wildfire-related invasive species, and the Management of Wildfire-Related Invasive Species Technology Advisory Board. The bill also requires the Department of Defense (DOD) to reimburse a state or federal agency for the costs of wildfire suppression as a result of a fire caused by DOD activity, requires the Joint Fire Science Program to work with unmanned aircraft test ranges to carry out research and development of unmanned aircraft system fire applications, requires federal and state disaster preparedness programs to include postdisaster assistance, and authorizes the Federal Emergency Management Agency to provide funding to a state agency to establish and operate a website to provide information relating to postfire recovery funding and resources to a community or an individual impacted by a wildland fire.

Veteran Peer Specialist Act of 2021 This bill requires the Department of Veterans Affairs (VA) to make permanent and expand the program that establishes at least two peer specialists in patient aligned care teams at VA medical centers to promote the use and integration of services for mental health, substance use disorder, and behavioral health in a primary care setting.
