Nurse Reinvestment Act

Nurse Reinvestment Act - Amends title XVIII (Medicare) of the Social Security Act to provide for nurse education training payments to qualified entities. Amends title XIX (Medicaid) of the Social Security Act to temporarily increase the matching rate for Medicaid nurse aide training and competency evaluation programs. Amends the Internal Revenue Code to provide for the exclusion from gross income of amounts received under the National Nursing Service Corps Scholarship Program. Amends the Public Health Service Act to direct the Secretary of Health and Human Services to: (1) develop and issue public service announcements that advertise and promote the nursing profession, highlight the advantages and rewards of nursing, and encourage individuals from diverse communities and backgrounds to enter the nursing profession; and (2) award grants to designated eligible educational entities in order to increase the number of nurses. Authorizes appropriations. Establishes a National Nurse Service Corps Scholarship program that provides scholarships to individuals seeking nursing education in exchange for service by such individuals in areas with nursing shortages. Authorizes appropriations.

Clean Money, Clean Elections Act

Clean Money, Clean Elections Act - Amends the Federal Election Campaign Act of 1971 (FECA) to: (1) prescribe eligibility and qualifying contribution requirements, seed money provisions, and benefits of clean money financing of Senate election campaigns; (2) set forth requirements applicable to clean money candidates; (3) direct the Federal Election Commission (FEC) to certify if a candidate is such a candidate and to assess a certain civil penalty against any such candidate making an expenditure from funds other than clean money funds; (4) establish in the Treasury a Senate Election Fund for clean money financing; (5) set forth requirements concerning reporting of certain expenditures of private money candidates and of independent expenditures, as redefined; (6) limit expenditures that may be made by political party committees in connection with the general election campaign of a Senate election in which one or more of the candidates is a clean money candidate; and (7) require a committee of a political party, before making coordinated expenditures in excess of $5,000 for a Federal election, to certify to the FEC that it has not and will not make any independent expenditures in connection with such campaign. Amends the Communications Act of 1934 to entitle clean money candidates to receive specified free broadcast time. Amends: (1) FECA to outline political advertising provisions for specified communications; and (2) Federal postal law to limit franked mass mailings by Members of Congress. Amends FECA with respect to soft money to prohibit: (1) a national committee of a political party from soliciting or receiving contributions or making expenditures not subject to FECA; (2) a national, State, district, or local committee from soliciting or donating funds to a tax-exempt organization; and (3) an incumbent or candidate for Federal office from soliciting or receiving funds not subject to FECA, or from soliciting or receiving funds for a non-Federal election in excess of certain limits or from prohibited sources (with exceptions). Requires a State, district, or local committee of a political party to make Federal election year expenditures (with exceptions) from funds subject to FECA. Amends FECA to: (1) establish aggregate and separate individual contribution limits to State Party Grassroots Funds and all committees established by a State committee of a political party, and increase annual individual contribution limits; and (2) eliminate the exception for building funds relating to the definition of "contribution." Revises requirements concerning: (1) reporting persons to whom certain expenditures are made to meet candidate or committee operating expenses; and (2) FEC Commissioners and FEC powers, including those involving investigations. Authorizes the FEC to seek injunctive relief to prevent FECA violations. Prescribes reporting requirements with regard to: (1) soft money disbursements of persons other than political parties; (2) disbursements made by authorized committees; and (3) Senate candidates. Prohibits contributions made by, or solicited, accepted or received in connection with a Federal election from, foreign nationals. Increases and expands the penalties for FECA violations.

Railroad Retirement and Survivors' Improvement Act of 2001 - Amends the Railroad Retirement Act of 1974 to increase benefits to railroad employees and their beneficiaries and to revise financing of the pension part (tier II) of the railroad retirement system. Establishes a Railroad Retirement Trust Fund and a Railroad Retirement Investment Trust to manage and invest Fund assets. Abolishes the Railroad Retirement Supplemental Annuity Account and provides for transfer of its funds to the Fund. Provides for transfer to the Fund of certain portions of the Railroad Retirement Account and of Social Security Equivalent Benefit account funds. Transfers to the disbursing agent from the Dual Benefits Payments Account the amount necessary to make dual benefit payments. Requires the Railroad Retirement Board (RRB) to calculate the ratio of assets to benefits to determine annual tier II tax rates for employers, employee representatives, and employees. Amends the Internal Revenue Code to exempt the Fund from taxation. Repeals a supplemental annuity tax that railroad employers pay to finance a benefit for long-time rail employees. Provides for adjustments to railroad employers, employee representatives, and employee tier II tax rates.

Higher Education Affordability and Fairness Act - Amends the Internal Revenue Code to allow a limited tax deduction for qualified higher education tuition and related expenses. Provides that the increase in the Lifetime Learning Credit to 20 percent of $10,000 of tuition from $5,000 of tuition shall be effective starting in 2002 rather than 2003. Directs the Comptroller General of the United States to conduct an annual study to examine whether the Federal income tax incentives to provide education assistance affect higher education tuition rates in order to identify if institutions of higher education are absorbing the intended savings by raising tuition rates. Expresses the sense of the Senate that the maximum Pell Grant should be increased to $4,700 to pay approximately: (1) 20 percent of the tuition, fees, room and board, and other expenses of the average college; or (2) the tuition and fees of the average public college.

Local Law Enforcement Enhancement Act of 2001 - Authorizes the Attorney General to provide technical, forensic, prosecutorial, or other assistance in the criminal investigation or prosecution of any crime that: (1) constitutes a crime of violence under Federal law or a felony under State or Indian tribal law; and (2) is motivated by prejudice based on the race, color, religion, national origin, gender, sexual orientation, or disability of the victim or is a violation of the hate crime laws of the State or tribe. Directs the Attorney General to give priority for assistance to crimes committed by offenders who have committed crimes in more than one State and to rural jurisdictions that have difficulty covering the extraordinary investigation or prosecution expenses. Authorizes the Attorney General to award grants to assist State, local, and Indian law enforcement officials with such extraordinary expenses. Directs the Office of Justice Programs to: (1) work closely with funded jurisdictions to ensure that the concerns and needs of all affected parties are addressed; and (2) award grants to State and local programs designed to combat hate crimes committed by juveniles. Prohibits specified offenses involving actual or perceived race, color, religion, national origin, gender, sexual orientation, or disability. Directs the U.S. Sentencing Commission to study and provide sentencing enhancements for adult recruitment of juveniles to commit hate crimes. Amends the Hate Crimes Statistics Act to require the crime data to be collected and published by the Attorney General to include data about crimes that manifest evidence of prejudice based on gender.

Sets forth provisions concerning such accounts, including: (1) the structure and administration of account programs; (2) procedures for opening and maintaining an account and qualifying for matching funds; (3) withdrawal procedures; and (4) disregarding account funds for purposes of certain means-tested Federal programs. Permits non-itemizers to deduct a portion of their charitable contributions. Prohibits, in general, including in gross income distributions from individual retirement accounts for charitable purposes. Sets forth a rule for determining the amount of the deduction allowable for a charitable contribution of food inventory.

Equal Protection of Voting Rights Act of 2001 - Establishes the Commission on Voting Rights and Procedures to study: (1) election technology and systems; (2) ballot design and uniformity; (3) ballot and polling place access; (4) voting systems capacity and election administration efficiency; (5) voter registration and maintenance of voter rolls; (6) alternative voting methods; (7) voter intimidation; (8) accuracy of voting, election procedures, and election technology; (9) voter education; (10) election personnel and volunteer training; (11) implementation of provisions of the Uniformed and Overseas Citizens Absentee Voting Act on registration and voting by absent uniformed services voters and overseas voters in elections for Federal office; (12) establishment of the date on which such elections are held as a Federal or a State holiday and on establishment of modified polling place hours; and (13) Federal assistance to State and local authorities to improve the administration of elections for Federal office. Directs the Commission to develop specific recommendations, consistent with certain uniform and nondiscriminatory election technology and administration requirements under this Act, regarding: (1) best practices in voting and election administration; (2) Federal assistance to State and local authorities to improve administration of Federal elections; (3) increased voter registration, accuracy of voter rolls, and participation and inclusion of legal voters, and (4) improved voter education and training of election personnel. Authorizes the Attorney General to make grants to approved State, territory, and locality applicants to pay the Federal share of the costs of activities to: (1) improve, acquire, or replace voting equipment or technology and improve the accessibility of polling places; (2) implement new election administration procedures to increase voter participation and reduce disenfranchisement, such as "same-day" voter registration procedures; (3) educate voters concerning voting procedures, voting rights or voting technology, and to train election personnel; and (4) implement Commission recommendations. Specifies certain uniform and nondiscriminatory requirements each voting system used in an election for Federal office must meet with regard to election technology and administration. Outlines requirements for provisional voting and sample ballot mailings to voters. Authorizes the Attorney General to bring a civil action in an appropriate district court to enforce the requirements of this Act for election technology and administration through the Office of Civil Rights of the Department of Justice.

Assure Access to Mammography Act of 2001 - Amends the Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act of 2000 to delay until 2003 the inclusion of payment for screening mammography in the Medicare physician fee schedule. Amends title XVIII (Medicare) of the Social Security Act to provide for a change in the payment amount for screening mammography performed in 2002 under Medicare. Provides that, for cost reporting periods between October 1, 2001, and October 1, 2006, in applying the limitations regarding the total number of full-time equivalent residents in the field of allopathic or osteopathic medicine under Medicare for a hospital, the Secretary of Health and Human Services shall not take into account a maximum of three residents in the field of radiology to the extent the hospital increases the number of radiology residents above the number of such residents for the hospital's most recent cost reporting period ending before October 1, 2001. Amends the Public Health Service Act to revise authorization of appropriations and allocation provisions with regard to interdisciplinary, community-based linkages, with changes establishing a specified authorization of appropriations for FY 2002 and a specified amount to be available for awards of grants and contracts under provisions on allied health and other disciplines. Directs the Comptroller General to study the relative value units established by the Secretary of Health and Human Services under the Medicare physician fee schedule for physicians' services that are gender-specific. Directs the Medicare Payment Advisory Commission to study the relative value units established by the Secretary under the such fee schedule for screening services that are reimbursed under it.

Makes it unlawful for any lodging facility to offer or provide such an unsafe crib. Presumes as unsafe a crib which does not conform to specified standards in the Code of Federal Regulations and the American Society for Testing Materials Voluntary Standards, unless labeled as dangerous for an infant and not intended to be used for one. Authorizes a fine and injunction against violators of this Act.

Justice for the Victims of Pan Am 103 Resolution of 2001 - Expresses the sense of Congress that: (1) the international community should condemn the Government of Libya and its leader, Muammar Qadhafi, for support of international terrorism, including the bombing of Pan Am 103; (2) such Government should make a complete accounting of its involvement in that bombing, accept responsibility, compensate the families of the victims, and renounce support for international terrorism; and (3) the President should instruct the U.S. Permanent Representative to the United Nations (UN) to use the voice and vote of the United States to maintain UN sanctions against Libya until all conditions in applicable Security Council resolutions are met, and to seek the reimposition of sanctions if Libya fails to comply. Declares that it should be U.S. policy to: (1) oppose the removal of UN sanctions until the Libyan Government has taken such actions; (2) maintain such sanctions until the Libyan Government has fulfilled the requirements of UN Security Council Resolutions 731, 748, 883, and 1192, the President certifies that Libya no longer provides support for international terrorism, and such Government is not pursuing weapons of mass destruction or the means to deliver them in contravention of U.S. law.

Amends the National Defense Authorization Act for Fiscal Year 1993 to make permanent (currently terminates on October 23, 2003) the prohibition on the transfer of anti-personnel landmines. Directs the President to establish an interagency working group to develop a comprehensive plan for expanded mine action programs, including victim rehabilitation, social support, and economic reintegration.

Innocence Protection Act of 2001 - Amends the Federal judicial code to authorize a person convicted of a Federal crime to apply to the appropriate Federal court for DNA testing to support a claim that the person did not commit: (1) the Federal crime of which the person was convicted; or (2) any other offense that a sentencing authority may have relied upon when it sentenced the person with respect to such crime. Sets forth: (1) guidelines for the court to use in ordering DNA testing; (2) post-testing procedures; (3) provisions regarding preservation of evidence; (4) criminal penalties for destroying or altering DNA evidence; and (5) provisions regarding post-conviction DNA testing in State criminal justice systems. Prohibits a State from denying an application for DNA testing made by a prisoner in State custody who is under sentence of death if specified conditions apply. Provides grants to prosecutors for DNA testing programs. Establishes the National Commission on Capital Representation. Withholds funds from States not complying with standards for capital representation. Provides for capital defense incentive grants and resource grants. Increases compensation in Federal cases, and sets forth provisions regarding compensation in State cases, where an individual is unjustly sentenced to death. Adds a certification requirement in Federal death penalty prosecutions. Expresses the sense of Congress regarding the execution of juvenile offenders and the mentally retarded.

National Teacher and Principal Recruitment Act - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to establish in the Office of Elementary and Secondary Education an Office of National Teacher and Principal Recruitment (Office). Directs the Secretary of Education, acting through the Office Director, to establish and carry out a National Teacher Corps program, to carry out recruitment and retention activities to relieve teacher shortages throughout the United States, particularly in high-need school districts and academic subjects. Includes in such program: (1) certain national activities; (2) grants to eligible partnerships of local educational agencies (LEAs) and institutions of higher education (IHEs), for local recruitment and retention activities, and for providing incentives through programs of scholarships, mid-career professional recruitment, paraprofessional-to-teacher, and volunteer training and support; (3) a competitive grant to one national coalition of teacher and media organizations, including the National Teacher Recruitment Clearinghouse, to jointly conduct a national public service campaign; and (4) studies relating to portability of teaching credentials and of teacher pensions. Directs the Secretary of Education, acting through the Office Director, to establish and carry out a national program of competitive grants to local educational agencies for recruiting and training principals and assistant principals. Gives priority to applications from LEAs that will carry out such activities in partnership with IHEs and nonprofit organizations.

Regional Skills Alliances Act of 2001 - Directs the Secretary of Labor to make matching grants to improve the job skills necessary for employment in specific industries. Makes eligible for such grants regional consortia that: (1) must have representatives from not fewer than five businesses or a lesser number that employ at least 30 percent of workers in that industry in the region (or a nonprofit organization that represents such businesses); (2) may have representatives from labor organizations, State and local governments, and educational institutions; and (3) are established to serve one or more particular industries in a particular region. Gives grant priority to eligible entities that consist of a majority of representatives from small businesses. Requires the Secretary to provide matching grants to States to assist businesses, organizations, and agencies in planning to form regional consortia under this Act.

Specifies that nothing in this Act shall be construed to create a cause of action against any firearms dealer or any other person for civil liability, or establish any standard of care. Makes evidence regarding compliance or noncompliance with this Act inadmissible in a proceeding of any court, agency, board, or other entity, except with respect to an action to enforce this Act. Sets forth civil penalties (in addition to any administrative penalties) for related violations, including suspension or loss of license. Amends the Consumer Product Safety Act to direct the Consumer Product Safety Commission to initiate a rulemaking proceeding to establish a consumer product safety standard for locking devices.

Makes such prohibition inapplicable to an exchange of one handgun for one handgun. Bars any unlicensed individual from purchasing two or more handguns during any 30-day period. Sets penalties for violations. Increases penalties for making knowingly false statements in connection with firearms. Extends the deadlines for the destruction of: (1) records related to handgun transfers subject to the waiting period; and (2) records of the national instant criminal background check system. Revises the definition of "engaged in the business" as applied to a firearms dealer to include any person who transfers more than one handgun in any 30-day period to a person who is not a licensed dealer.

Amends the National Energy Conservation Policy Act (NECPA) to: (1) mandate that each Federal agency undertake a comprehensive review of practicable measures for increasing energy and water conservation, and for using renewable energy sources; (2) allow as an approved benefit ancillary to an energy savings or performance contract those savings resulting from reduced operation and maintenance costs at replacement facilities; and (3) repeal the termination dates governing the authority to enter into energy savings performance contracts (thus extending such authority indefinitely).
