A PLUS Act

Academic Partnerships Lead Us to Success Act or the A PLUS Act - Allows each state to submit to the Secretary of Education a declaration of intent, applicable for up to five years, permitting it to receive federal funds on a consolidated basis that would otherwise be directed toward specific programs furthering the stated purpose of title I (Improving the Academic Achievement of the Disadvantaged) of the Elementary and Secondary Education Act of 1965. Requires each declaration to be formulated by a combination of specified State Authorizing Officials or by referendum and to list the programs for which consolidated funding is requested. Allows states to use such funds for any educational purpose permitted by state law, but requires them to make certain assurances that they will use fiscal control and fund accounting procedures, abide by federal civil rights laws, and advance educational opportunities for the disadvantaged. Allows states to amend their declarations. Allows each declaration state to adopt new academic assessments and standards or apply those described under the Elementary and Secondary Education Act of 1965, but requires each state to have a single system of assessments and standards that includes student proficiency goals. Requires each declaration state to: (1) inform the public about its student achievement assessment system; (2) report annually on student progress toward the state's proficiency standards, disaggregating performance data by specified student groups; and (3) keep aggregate spending on elementary and secondary education at no less than 90% of such spending for the school year coinciding with this Act's enactment. Limits administrative expenses. Requires each declaration state to provide for the equitable participation of private school children and teachers in the activities assisted under its declaration of intent.

Requires all sales of coins minted under this Act to include a surcharge of $35 per gold coin, $10 per silver coin, and $5 per half-dollar clad coin. Requires all of the surcharges received from the sale of such coins to be paid to the National Park Foundation for projects and programs to help preserve and protect resources under the stewardship of the NPS and to promote public enjoyment and appreciation of those resources. Prohibits the surcharges paid to the Foundation from being used for land acquisition.

Iran Export Embargo Act - Amends the Iran Freedom and Counter-Proliferation Act of 2012 to direct the President to prohibit all transactions in property and property interests of a person (as defined in this Act) if such property and property interests are in the United States or within the possession or control of a U.S. individual. Directs the President to prohibit the opening, and prohibit or impose strict conditions on the maintaining, in the United States of a correspondent account or a payable-through account by a foreign financial institution that has knowingly conducted or facilitated a significant transaction with respect to the importation, sale, or transfer of goods or services from Iran on behalf of a described person. Directs the President to impose sanctions pursuant to the International Emergency Economic Powers Act with respect to an individual that knowingly: (1) imports, purchases, or transfers goods or services from a described person; and (2) provides underwriting services or insurance or reinsurance to a described person. Describes a "person" as: (1) the state and the government of Iran, or any political subdivision, agency, or instrumentality of such government, including the Central Bank of Iran; (2) any person owned or controlled by, or acting for or on behalf of, such government; or (3) any other person determined by the President to be described in clauses (1) or (2).

Iran Sanctions Loophole Elimination Act of 2013 - Amends the Iran Threat Reduction and Syria Human Rights Act of 2012 to direct the President to prohibit the opening, and prohibit or impose strict conditions on the maintaining, in the United States of a correspondent account or a payable-through account by a foreign financial institution that is a person described in this Act. Describes such person as a person that on or after May 9, 2013, knowingly: (1) conducted or facilitated a significant transaction involving the currency of a country other than the country in which the person is operating with, for, or on behalf of the Central Bank of Iran or another Iranian financial institution designated by the Secretary of the Treasury for the imposition of sanctions, or a person that is involved in the energy, shipping, and shipbuilding sectors of Iran; or (2) transferred funds for, or held funds on behalf of, a person described in the previous paragraph in relation to a transaction without regard to the currency of such funds. Authorizes the President to impose sanctions pursuant to the International Emergency Economic Powers Act with respect to any other person. Authorizes the President to waive the provisions of this Act with respect to a person for up to 180 days (and authorizes renewal of such waiver for additional periods of up to 180 days) for reasons of U.S. national security. Requires congressional notification at least seven days prior to a waiver or waiver renewal.

Declares that Congress has the responsibility to: (1) investigate, and conduct hearings on, abortions performed near, at, or after viability and public policies regarding such abortions; and (2) evaluate the extent to which such abortions involve violations of the natural right to life of infants who are born alive or are capable of being born alive and therefore are entitled to equal protection under the law. Expresses the sense of the Senate that: (1) there is a compelling government interest in protecting the lives of unborn children beginning at least from the stage at which substantial medical evidence indicates that they are capable of feeling pain, which is separate from the compelling governmental interest in protecting the lives of unborn children beginning at the stage of viability, and neither governmental interest is intended to replace the other; and (2) governmental review of public policies and outcomes relating to these issues is long overdue and is an urgent priority that must be addressed.

Defense of Environment and Property Act of 2013 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to redefine "navigable waters" to specify that included territorial seas are those that are: (1) navigable-in-fact; or (2) permanent, standing, or continuously flowing bodies of water that form geographical features commonly known as streams, oceans, rivers, and lakes that are connected to waters that are navigable-in-fact. Excludes from such term: (1) waters that do not physically abut navigable waters and lack a continuous surface water connection to navigable waters; (2) man-made or natural structures or channels through which water flows intermittently or ephemerally, or that periodically provide drainage for rainfall; or (3) wetlands without a continuous surface connection to bodies of water that are waters of the United States. Prohibits activities carried out by the Administrator of the Environmental Protection Agency (EPA) or the Army Corps of Engineers from impinging upon states' power over land and water use. Prohibits: (1) aggregation of such excluded wetlands or waters from being used to determine or assert federal jurisdiction, and (2) wetlands without a continuous surface connection to bodies of water that are waters of the United States from being considered to be under federal jurisdiction. Authorizes states or individual property owners to obtain judicial review of jurisdictional determinations by the Administrator or the Secretary of the Army that would affect their ability to plan the development and use of land and water resources within 30 days after such a determination. Considers groundwater to be state water. Prohibits groundwater from being considered in determining or asserting federal jurisdiction over isolated or other waters. Prohibits the Administrator from using a significant nexus test to determine federal jurisdiction over navigable waters and waters of the United States. Nullifies: (1) the Corps' rule entitled "Final Rule for Regulatory Programs of the Corps of Engineers," (2) EPA's proposed rule entitled "Advance Notice of Proposed Rulemaking on the Clean Water Act Regulatory Definition of 'Waters of the United States,'" (3) the guidance document entitled "Clean Water Act Jurisdiction Following the U.S. Supreme Court's Decision in Rapanos v. United States & Carabell v. United States (relating to the definition of waters under the jurisdiction of the Clean Water Act), and (4) any subsequent regulation or guidance issued by federal agencies that defines or interprets the term "navigable waters." Prohibits the Corps and EPA from promulgating rules or issuing guidance that expands or interprets the definition of navigable waters unless expressly authorized by Congress. Sets forth provisions requiring federal agencies to obtain consent of private property owners prior to entering their land to collect information about navigable waters. Requires federal agencies that issue regulations that relate to the definition of navigable waters or waters of the United States and diminish the fair market value or economic viability of a property to pay the affected property owner an amount equal to twice the value of the loss. Gives no force or effect to such regulation until landowners with such claims have been compensated.

District of Columbia Pain-Capable Unborn Child Protection Act - Amends the federal criminal code to prohibit any person from performing or attempting to perform an abortion within the District of Columbia except in conformity with this Act's requirements. Requires the physician to first make a determination of the probable post-fertilization age of the unborn child, or reasonably rely upon such a determination made by another physician, by making inquiries of the pregnant woman and performing such medical examinations and tests as a reasonably prudent physician would consider necessary. Prohibits the abortion from being performed if the probable post-fertilization age of the unborn child is 20 weeks or greater. Makes an exception where necessary to save the life of a pregnant woman whose life is endangered by a physical disorder, illness, or injury, excluding psychological or emotional conditions. Permits a physician to terminate a pregnancy under such exception only in the manner which provides the best opportunity for the unborn child to survive, unless termination of the pregnancy in that manner would pose a greater risk of the death or substantial and irreversible physical impairment of a major bodily function, not including psychological or emotional conditions, of the pregnant woman than would other available methods. Prescribes penalties for violations. Bars prosecution of a woman upon whom an abortion is performed in violation of this Act, but authorizes such a woman or the father or maternal grandparent of the unborn child to obtain appropriate relief through a civil action. Provides for injunctive relief to prevent violations. Sets forth specified privacy protections in court proceedings for the woman upon whom an abortion has been performed. Requires any physician who performs an abortion within the District to report it to the Department of Health of the District of Columbia, which shall issue annual public reports.

Firearm Straw Purchasing and Trafficking Prevention Act - Amends the federal criminal code to prohibit purchasing or otherwise obtaining a firearm that has been shipped, transported, or received in interstate or foreign commerce for or on behalf of any other person who the purchaser knows: (1) is prohibited from possessing or receiving a firearm; (2) intends to use, carry, possess, sell, or otherwise dispose of the firearm in furtherance of a crime of violence, a drug trafficking crime, or a federal crime of terrorism; (3) intends to engage in conduct that would constitute such a crime if the conduct occurred in the United States; or (4) is not a resident of any state and is not a citizen or lawful permanent resident of the United States. Prohibits willfully procuring another to engage in such conduct. Prohibits: (1) shipping, transporting, transferring, or otherwise disposing of two or more firearms to another person in or otherwise affecting interstate or foreign commerce knowing that the use, carrying, or possession of a firearm by the transferee is prohibited or would constitute a crime of violence, a drug trafficking crime, or a federal crime of terrorism; (2) receiving two or more firearms in or otherwise affecting interstate or foreign commerce if the recipient either knows such receipt is prohibited or intends to use the firearm in furtherance of such a crime; or (3) attempting or conspiring to commit such conduct. Sets penalties for violations, including enhanced penalties for acting in concert with another person as an organizer, leader, supervisor, or manager in such a transfer or receipt of firearms. Directs the U.S. Sentencing Commission to: (1) review and amend its guidelines and policy statements to ensure that persons convicted of such offenses and other offenses applicable to the straw purchases and trafficking of firearms are subject to increased penalties in comparison to those currently provided; (2) consider an appropriate amendment to reflect the intent of Congress that straw purchasers without significant criminal histories receive sentences that are sufficient to deter participation in such activities; and (3) review and amend its guidelines and policy statements to reflect the intent of Congress that a person convicted of such an offense who is affiliated with a gang, cartel, organized crime ring, or other such enterprise should be subject to higher penalties than an otherwise unaffiliated individual. Increases the maximum penalty for making false statements or representations with respect to firearms. Expands the scope of prohibitions against transferring a firearm knowing that it will be used to commit a crime of violence or drug trafficking crime to cover receiving or transferring a firearm or ammunition, attempting or conspiring to do so, and transferring a firearm or ammunition knowing that it will be used to commit a federal crime of terrorism or a crime under the Arms Export Control Act, the International Emergency Economic Powers Act, or the Foreign Narcotics Kingpin Designation Act. Increases the maximum term of imprisonment for such violations and for smuggling a firearm or ammunition into or out of the United States with intent to engage in or promote prohibited conduct.

Requires the Task Force to provide direction for and recommendations to the Attorney General regarding such investigation and prosecution, including with respect to: (1) the allocation of DOJ resources; (2) enhancing cooperation among federal agencies and entities and among federal, state, and local authorities; (3) changes in rules, regulations, or policy to improve effectiveness; and (4) improvements through changes in rules, regulations, or policy. Makes specified sums in the DOJ Assets Forfeiture Fund available for: (1) the investigation and prosecution of cases of convicted felons and fugitives who illegally attempt to purchase a firearm, and (2) the Task Force.

Sunshine for Regulatory Decrees and Settlements Act of 2013 - Defines a "covered civil action" as a civil action seeking to compel agency action and alleging that an agency is unlawfully withholding or unreasonably delaying an agency action relating to a regulatory action that would affect: (1) the rights of private persons other than the person bringing the action; or (2) a state, local, or tribal government. Defines a "covered consent decree" or a "covered settlement agreement" as: (1) a consent decree or settlement agreement entered into a covered civil action, and (2) any other consent decree or settlement agreement that requires agency action relating to such a regulatory action that affects the rights of such persons or governments. Requires an agency against which a covered civil action is brought to publish the notice of intent to sue and the complaint in a readily accessible manner, including by making such notice and complaint available online not later than 15 days after receiving service of such notice or complaint Requires an agency seeking to enter a covered consent decree or settlement agreement to publish such decree or agreement in the Federal Register and online not later than 60 days before it is filed with the court. Provides for public comment and public hearings on such decree or agreement. Requires the Attorney General or an agency head, if an agency is litigating a matter independently, to certify to the court that the Attorney General or the agency head approves of: (1) any proposed covered consent decree that includes terms that convert into a nondiscretionary duty a discretionary authority of an agency to propose, promulgate, revise, or amend regulations, commit an agency to expend funds that have not been appropriated and budgeted or to seek a particular appropriation or budget authorization, divest an agency of discretion committed to it by statute or the Constitution, or otherwise afford any relief that the court could not enter under its own authority; or (2) any proposed covered settlement agreement that includes terms that provide a remedy for a failure by the agency to comply with the terms of the agreement other than the revival of the civil action resolved by the agreement, interfere with the authority of an agency to revise, amend, or issue rules, or commit the agency to expend funds that have not been appropriated and budgeted or to exercise in a particular way discretion which was committed to the agency by statute or the Constitution. Requires a court to grant de novo review of a covered consent decree or settlement agreement if an agency files a motion to modify such decree or agreement on the basis that its terms are no longer fully in the public interest due to the agency's obligations to fulfill other duties or due to changed facts and circumstances.

Never Contract With the Enemy Act - States that it shall be the policy of the United States that executive agencies shall not contract with the enemy or with any person or entity that provides funds received under a contract, grant, or cooperative agreement to an enemy of the United States or that otherwise supports those actively opposing the United States or coalition forces in a contingency operation. Authorizes the termination or nullification of contracts, grants, and cooperative agreements valued in excess of $20,000 (currently, $100,000) with persons or entities identified as enemies of the United States. Requires the Secretary of Defense (DOD) and each senior procurement executive to use available intelligence to identify persons and entities who receive U.S. funds through contracts, grants, and cooperative agreements and who are: (1) providing such funds to an enemy or to a person or entity who is actively supporting an enemy of the United States, or (2) otherwise supporting those who are actively opposing U.S. or coalition forces in a contingency operation. Requires the Secretary and the Administrator for Federal Procurement Policy to jointly carry out a program for providing information to senior procurement executives and commanders of the geographic combatant commands relating to persons or entities who may be providing funding under contracts, grants, or cooperative agreements to enemies of the United States.

Provides for the continuous resubmission of, and required response to, requests not acted upon within the original or estimated period. Requires the Secretary to notify the appropriate claimant of each request made and explanation and estimate received. Directs the Secretary to: (1) keep records of the information requested and the time it takes to receive responses, and (2) submit semiannually to the congressional veterans committees a summary of such records.

Authorizes the Special Envoy, subject to direction by the President and the Secretary of State, to represent the United States in matters and cases relevant to religious freedom in: (1) contacts with foreign governments, intergovernmental organizations, and specialized agencies of the United Nations (U.N.), the Organization of Security and Cooperation in Europe, and other international organizations; and (2) multilateral conferences and meetings relevant to religious freedom.

Energy Production and Project Delivery Act of 2013 - Considers that the Secretary of the Interior (Secretary) has approved the Draft Proposed Outer Continental Shelf Oil and Gas Leasing Program 2010-2015 as a final oil and gas leasing program under the Outer Continental Shelf Lands Act. Deems the Secretary to have issued a final environmental impact statement for such Program under the National Environmental Policy Act of 1969 (NEPA). Directs the Secretary to: (1) conduct a lease sale in each outer Continental Shelf (OCS) planning area for which there is a commercial interest in purchasing federal oil and gas production leases, (2) approve or disapprove a drill permit application within 20 days after submission, and (3) hold Lease Sale 220 for an area offshore of Virginia. Revises requirements for the distribution of revenues from OCS planning areas and for their allocation among coastal states for FY2024 and ensuing fiscal years. Directs the Secretary, acting through the Director of the Bureau of Land Management (BLM), to implement a competitive leasing program for the exploration, development, and production of the oil and gas resources on the Coastal Plain of Alaska. Amends the Alaska National Interest Lands Conservation Act of 1980 to repeal the prohibition against leasing or other development leading to production of oil and gas from the Arctic National Wildlife Refuge (ANWR). Deems any oil and gas leasing programs and activities authorized by this Act to be in compliance with the purposes of ANWR, so that no further findings or decisions are required to implement this determination. Authorizes the Secretary to designate up to 45,000 acres of the Coastal Plain as a special area for special management and preservation of its unique and diverse character. Permits directional drilling in the Special Area. States that the Secretary's sole authority to close lands within the Coastal Plain to oil and gas leasing, exploration, development, and production is that set forth in this Act. Prescribes procedures governing Coastal Plain lease sales and lease sale bids, as well as lease terms and conditions. Requires the Secretary, when possible and practicable, to encourage the use of U.S. workers and U.S.-manufactured equipment in all construction related to mineral development on the Coastal Plain. Directs the Secretary to: (1) administer the leasing program with respect to Coastal Plain environmental protection according to the no significant adverse effect standard, (2) issue rights-of-way and easements across the Coastal Plain for the transportation of oil and gas, and (3) convey specified surface estates to the Kaktovik Inupiat Corporation and subsurface estates to the Arctic Slope Regional Corporation. Directs the Secretary to develop a plan facility consolidation plan for the Coastal Plain. Prescribes guidelines for expedited judicial review of complaints. Requires deposit in the Treasury of 90% of all bonus, rental, and royalty revenues from federal oil and gas leasing and operations authorized under this Act. Grants the U.S. District Court for the District of Columbia exclusive jurisdiction to hear all causes and claims arising from any covered project of federal land leasing for exploitation of oil, natural gas, or any other source or form of energy. Prohibits the award or federal payment of legal fees to an environmental nongovernmental organization in connection with any action: (1) preventing, terminating, or reducing access to production of energy, mineral resources, water by agricultural producers, a resource by commercial or recreational fishermen, or grazing or timber production on federal land; (2) diminishing a property owner's private property value; or (3) eliminating or preventing one or more jobs. Prohibits the Secretary, acting through the BLM, from establishing a master leasing plan as part of any guidance issued by the Secretary. Amends the Antiquities Act of 1906 to repeal the authority of the President to declare national monuments on federal lands in his or her own discretion. Subjects such authority to the approval of Congress. Prohibits the Administrator of the Environmental Protection Agency (EPA) or the head of any other federal agency from implementing or enforcing any regulations, proposals, or actions establishing any carbon dioxide or greenhouse gas emissions reductions until the Administrator, the Administrator of the Energy Information Administration, and the Secretary of Commerce certify in writing that the People's Republic of China, India, and the Russian Federation have proposed, implemented, and enforced measures requiring substantially similar reductions. Nullifies any regulation, proposal, or action in effect before such certification is made that requires any carbon dioxide or other greenhouse gas emissions reduction. Amends the Clean Air Act to require an economic analysis of any requirement of the Act that results in an adverse effect on employment. Requires the Secretary of Commerce to establish an economic review board to assess such an analysis. Amends the Endangered Species Act of 1973 (ESA) to require the Secretary of the Interior or the Secretary of Commerce, as appropriate, upon a state governor's declaration of an emergency, to exempt from the prohibition against taking, and against adverse modification of critical habitat, any action reasonably necessary to avoid or ameliorate the impact of the emergency, including fighting or preventing forest fires and building, rebuilding, or operating any water supply or flood control project by a federal agency. Prohibits consideration of the impact of greenhouse gas on any species of fish or wildlife or plant for any purpose in the implementation of the ESA. Prohibits the Bureau of Reclamation of the Department of the Interior and any California state agency operating a water project in connection with the Central Valley Project from restricting operations of an applicable project pursuant to any biological opinion issued under ESA if it would result in a level of allocation of water less than the historical maximum allocation under the project. Declares that no presidential permit shall be required for a specified pipeline application filed on May 4, 2012, by TransCanada Corporation to the Department of State for the northern portion of the Keystone XL pipeline from the Canadian border to the South Dakota/Nebraska border. Considers the final environmental impact statement regarding such pipeline issued by the Secretary of State on August 26, 2011, to satisfy all NEPA requirements. Considers approved the route of the Keystone XL pipeline through Nebraska. Declares that no area necessary to construct or maintain the pipeline shall be considered critical habitat under the Endangered Species Act of 1973. Directs the Secretary, acting through the Director of the National Park Service, to: (1) reinstate, for at least 10 years, the reservation of use and occupancy and special use permits to conduct commercial operations within Point Reyes National Seashore in California held by Drakes Bay Oyster Company; and (2) renew those reinstated permits for an additional 10-year period upon request by the company or a successor in interest. Prohibits the conversion of Drakes Estero to a designated wilderness.

Regulations From the Executive in Need of Scrutiny Act of 2013 or the REINS Act - States that the purpose of this Act is to increase accountability for and transparency in the federal regulatory process. Revises provisions relating to congressional review of agency rulemaking to require a federal agency promulgating a rule to include in its report to Congress and to the Comptroller General (GAO) a classification of the rule as a major or nonmajor rule. Requires a joint resolution of approval of major rules to be enacted before such rules may take effect. Provides that if a joint resolution of approval is not enacted by the end of 70 session days or legislative days, as applicable, after the agency proposing the rule submits its report on such rule to Congress, the major rule shall be deemed not to be approved and shall not take effect. Permits a major rule to take effect for one 90-calendar day period without such approval if the President determines it is necessary because of an imminent threat to health or safety or other emergency, for the enforcement of criminal laws, for national security, or to implement an international trade agreement. Sets forth the congressional approval procedure for major rules and the congressional disapproval procedure for nonmajor rules. Requires the introduction of a joint resolution addressing a report classifying a rule as a major rule within three legislative days in the House of Representative and three session days in the Senate. Prohibits any amendments to such a joint resolution at any stage of the legislative process. Provides for expedited consideration of a joint resolution of approval and requires a vote on such resolution in the Senate within 15 session days after it is reported by the committee to which it was referred, or after such committee has been discharged from further consideration of the resolution. Allows a court to review whether an agency has completed the necessary requirements under this Act for a rule to take effect. Limits the effect of a joint resolution of approval of a major rule. Prohibits an agency from allowing a major rule to take effect without the congressional review procedures set forth in this Act. Amends the Balanced Budget and Emergency Deficit Control Act of 1985 to provide that any congressional approval procedure set forth in this Act affecting budget authority, outlays, or receipts shall be assumed to be effective unless it is not approved in accordance with this Act.

Child Interstate Abortion Notification Act - Amends the federal criminal code to prohibit transporting a minor child across a state line to obtain an abortion (deems such transporting to be a de facto abridgment of the right of a parent under any law in the minor’s state of residence that requires parental involvement in the minor’s abortion decision). Makes an exception for an abortion necessary to save the life of the minor. Makes it an affirmative defense to a prosecution or civil action under this Act that a defendant: (1) reasonably believed that before the minor obtained the abortion, the required parental consent or notification or judicial authorization took place; or (2) was presented with documentation showing that a court waived parental notification requirements or authorized the minor's abortion. Defines "abortion" to mean the use or prescription of any instrument, medicine, drug, or any other substance or device: (1) to intentionally kill the unborn child of a woman known to be pregnant; or (2) to intentionally prematurely terminate the pregnancy of a woman known to be pregnant with an intention other than to increase the probability of a live birth or of preserving the life or health of the child after live birth, or to remove a dead unborn child. Imposes a fine and/or prison term of up to one year on a physician who performs or induces an abortion on an out-of-state minor in violation of parental notification requirements. Requires such physician to give 24-hour actual or constructive notice to a parent of the minor seeking an abortion, subject to certain exceptions.

Prohibits total outlays for any fiscal year from exceeding 18% of the gross domestic product (GDP) for the preceding calendar year unless Congress, by a two-thirds roll call vote of each chamber, authorizes a specific excess over such 18%. Directs the President to submit a balanced budget to Congress annually. Prohibits any bill from becoming law that imposes a new tax or increases the statutory rate of any tax or the aggregate amount of revenue, unless approved by a two-thirds roll call vote of each chamber. Requires a three-fifths roll call vote of each chamber to increase the federal debt limit. Authorizes waivers of these requirements: (1) when a declaration of war is in effect against a nation-state and Congress, by a majority roll call vote of each chamber, authorizes a specific excess; or (2) under other specified circumstances involving military conflict, if Congress, by a three-fifths roll call vote of each chamber, authorizes such waiver. Prohibits a federal or state court from ordering any increase in revenue to enforce this article.

Prescribes audit contents, including: (1) the guidance given by the Board to independent consultants retained by the supervised financial institutions regarding procedures to be followed in conducting the file reviews, (2) the factors considered by independent consultants when evaluating loan files and the results obtained pursuant to those reviews, and (3) the determinations made by such consultants regarding the nature and extent of financial injury sustained by each homeowner as well as the level and type of remediation offered.

Allows exemptions from the tax for property or services purchased for business, export, or investment purposes, and for state government functions. Sets forth rules relating to: (1) the collection and remittance of the sales tax, and (2) credits and refunds. Allows a monthly sales tax rebate for families meeting certain size and income requirements. Grants states the primary authority for the collection of sales tax revenues and the remittance of such revenues to the Treasury. Sets forth administrative provisions relating to: (1) the filing of monthly reports and payments of tax; (2) accounting methods; (3) registration of sellers of goods and services responsible for reporting sales; (4) penalties for noncompliance; and (5) collections, appeals, and taxpayer rights. Directs the Secretary of the Treasury to allocate sales tax revenues among: (1) the general revenue, (2) the old-age and survivors insurance trust fund, (3) the disability insurance trust fund, (4) the hospital insurance trust fund, and (5) the federal supplementary medical insurance trust fund. Prohibits the funding of the Internal Revenue Service (IRS) after FY2017. Establishes in the Department of the Treasury: (1) an Excise Tax Bureau to administer excise taxes not administered by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF); and (2) a Sales Tax Bureau to administer the national sales tax. Terminates the sales tax imposed by this Act if the Sixteenth Amendment to the U.S. Constitution (authorizing an income tax) is not repealed within seven years after the enactment of this Act.
