This concurrent resolution calls for honoring the 237th anniversary of the enactment of the Virginia Statute for Religious Freedom on Religious Freedom Day, January 16, 2023. The resolution affirms that religious freedom includes the right of individuals of any faith and individuals of no faith to live, work, associate, and worship in accordance with their beliefs; all people of the United States can be unified in supporting religious freedom because it is a fundamental human right; and the American people will remain forever unshackled in matters of faith.

Born-Alive Abortion Survivors Protection Act This bill establishes requirements for the degree of care a health care practitioner must provide in the case of a child born alive following an abortion or attempted abortion. Specifically, a health care practitioner who is present must (1) exercise the same degree of care as would reasonably be provided to any other child born alive at the same gestational age, and (2) ensure the child is immediately admitted to a hospital. Additionally, a health care practitioner or other employee who has knowledge of a failure to comply with the degree-of-care requirements must immediately report such failure to law enforcement. A health care practitioner who fails to provide the required degree of care, or a health care practitioner or other employee who fails to report such failure, is subject to criminal penalties—a fine, up to five years in prison, or both. An individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive under this bill and allows her to bring a civil action against a health care practitioner or other employee for violations.

Promoting Agriculture Safeguards and Security Act of 2023 or the PASS Act of 2023 This bill establishes requirements to address the national security risk to the agricultural sector of the United States. Specifically, the bill prohibits persons who are acting on behalf of China, Russia, Iran, or North Korea from purchasing or investing in U.S. agricultural land and companies. The President may waive this prohibition, on a case-by-case basis, if the President determines that the waiver is vital to U.S. national security interests. The bill also places the Secretary of Agriculture on the Committee on Foreign Investment in the United States (CFIUS) and requires CFIUS to review certain transactions involving investments by foreign persons in the U.S. agricultural sector. Additionally, the Department of Agriculture must report on the risks that foreign purchases of U.S. businesses engaged in agriculture pose to the agricultural sector of the United States.

Regulations from the Executive in Need of Scrutiny Act of 20 23 This bill revises provisions relating to congressional review of agency rulemaking. Specifically, the bill establishes a congressional approval process for a major rule. A major rule may only take effect if Congress approves the rule. A major rule is a rule that has resulted in or is likely to result in (1) an annual effect on the economy of $100 million or more; (2) a major increase in costs or prices for consumers, individual industries, government agencies, or geographic regions; or (3) significant adverse effects on competition, employment, investment, productivity, innovation, or the ability of U.S.-based enterprises to compete with foreign-based enterprises. The bill generally preserves the current congressional review process for a nonmajor rule.

This joint resolution nullifies the Local Resident Voting Rights Amendment Act of 2022, enacted by the council of the District of Columbia. The act allows noncitizens who meet residency and other requirements to vote in local elections in the district.

Sarah's Law This bill requires U.S. Immigration and Customs Enforcement (ICE) to detain a non-U.S. national ( alien under federal law) who is unlawfully present in the United States and has been charged with a crime that resulted in the death or serious bodily injury of another person. ICE must make reasonable efforts to obtain information about the identity of any victims of the crimes for which the detained individual was charged or convicted. ICE shall provide the victim, or a relative or guardian of a deceased victim, with information about the detained individual, including name, date of birth, nationality, immigration status, criminal history, and a description of any related removal efforts.

Jumpstart Our Businesses by Supporting Students Act of 2023 or the JOBS Act of 2023 This bill expands student eligibility for Pell Grants by establishing the Job Training Federal Pell Grant program. Specifically, the bill requires the Department of Education to award a job training Pell Grant to a student who does not have a degree; attends an institution of higher education (IHE); is enrolled in a career and technical education program at an IHE that provides 150 to 600 clock hours of instructional time over a period of 8 to 15 weeks and provides training aligned with high-skill, high-wage, or in-demand industry sectors (i.e., job training programs); and meets all other eligibility requirements for a Pell Grant. Additionally, the bill specifies that any period during which a student receives a job training Pell Grant counts toward that student's Pell Grant eligibility period.

No Tax Breaks for Radical Corporate Activism Act This bill disallows a business expense tax deduction for any reimbursement paid by an employer to an employee for travel expenses to obtain an abortion, or for the costs of any gender transition procedure for the employee's minor child.

Stop Harassing Owners of Rifles Today Act or the SHORT Act This bill removes certain short-barreled rifles, short-barreled shotguns, and other weapons from the definition of a firearm for purposes of regulation under the National Firearms Act (NFA). The bill also eliminates certain restrictions that apply to the sale or transportation of such rifles and shotguns in interstate commerce. If a state or local registration or licensing requirement is determined by reference to the NFA, the bill treats persons who acquire or possess a short-barreled rifle, short-barreled shotgun, or other weapon in accordance with the Gun Control Act of 1968 as meeting the registration and licensing requirements. The bill preempts certain state or local laws that tax or regulate these rifles, shotguns, and weapons. The Bureau of Alcohol, Tobacco, Firearms and Explosives must destroy records relating to the registration, transfer, or manufacture of applicable weapons described by this bill within one year after the enactment of this bill.

Protecting Our Democracy by Preventing Foreign Citizens from Voting Act of 2023 This bill prohibits federal funds from being made available to state or local governments that allow noncitizens to vote in federal, state, or local elections.

Wildfire Emergency Act of 2023 This bill provides for programs and activities in support of forest restoration, wildfire mitigation, and energy resilience. The Department of Agriculture (USDA) shall establish a pilot program under which it may enter into conservation finance agreements with public or private persons to increase the pace and scale of forest restoration and land management projects across the National Forest System. The bill provides for an increased federal cost share for conservation finance projects that would primarily benefit one or more low-income communities and for which the nonfederal entities involved cannot meet a specified cost share requirement. The Department of Energy shall establish a program to support critical facilities (e.g., hospitals), including by improving the energy resilience and power needs of critical facilities through the development and use of microgrids, renewable energy, energy efficiency, reduced electricity demand, and on-site storage. The bill expands the weatherization assistance program to support the use of fire-resistant materials. The bill directs USDA and the Department of the Interior to take actions to improve the detection and monitoring of wildfires. USDA and Interior shall establish one or more centers in western states to train individuals in methods relevant to the mitigation of wildfire risk. USDA shall establish a competitive grant program to support workforce development in forestry and fire management. USDA may issue grants to increase community capacity for land stewardship activities.

Prohibiting Federal Emergencies for Abortion Act This bill prohibits the President and the Department of Health and Human Services (HHS) from declaring a federal emergency relating to abortion. Specifically, neither the President nor HHS may declare a national emergency for purposes of (1) promoting, supporting, or expanding access to abortion; or (2) taking adverse action against or litigating against states that prohibit or otherwise restrict abortion.

Alzheimer's Accountability and Investment Act This bill requires the National Institutes of Health to annually submit, beginning in FY2024, an estimate of its budget and personnel needs for carrying out initiatives pursuant to the National Alzheimer's Project directly to the President for review and transmittal to Congress. The Department of Health and Human Services and the Advisory Council on Alzheimer's Research, Care, and Services may comment on the budget estimate but may not change it. The National Alzheimer's Project supports coordination of federal planning, research, and other efforts to address Alzheimer's disease and related dementias.

NAPA Reauthorization Act This bill extends through 2035 and makes other changes to the National Alzheimer's Project. This project supports coordination of federal planning, programs, and other efforts to address Alzheimer's disease and related dementias. In particular, the bill incorporates a focus on promoting healthy aging and reducing risk factors associated with cognitive decline. The bill also expands the Advisory Council on Alzheimer's Research, Care, and Services to include additional members, such as (1) a researcher with experience recruiting and retaining diverse clinical trial participants, (2) an individual diagnosed with Alzheimer's disease, and (3) representatives from additional federal agencies (e.g., the Department of Justice and the Office of Management and Budget).

Prevent Government Shutdowns Act of 2023 This bill provides continuing appropriations to prevent a government shutdown if any of the appropriations bills for a fiscal year have not been enacted before the fiscal year begins and continuing appropriations are not in effect. The bill also limits official travel, congressional recesses or adjournments, and the consideration of legislation that is unrelated to appropriations after the beginning of a fiscal year if the appropriations process has not been completed.

Combating Organized Retail Crime Act of 2023 This bill expands federal enforcement of criminal offenses related to organized retail crime. Organized retail crime typically refers to large-scale retail theft and fraud by organized groups of professional shoplifters, or boosters, who make money by stealing merchandise and reselling it for a fraction of the retail cost. First, with respect to criminal offenses involving the transportation of stolen property across state lines and the sale or receipt of stolen goods, the bill broadens the scope of conduct that qualifies as offenses. Additionally, the bill makes the offenses predicate offenses (i.e., underlying offenses) for prosecutions under the federal money laundering statute and authorizes the criminal forfeiture of any property representing or traceable to the gross proceeds obtained as a result of an offense or a conspiracy to commit an offense. Second, with respect to criminal offenses involving theft from an interstate or foreign shipment, the bill makes an offense an underlying offense for prosecution under the federal money laundering statute and authorizes the criminal forfeiture of any property representing or traceable to the gross proceeds obtained as a result of an offense or a conspiracy to commit an offense. Finally, the bill establishes a center—the Organized Retail Crime Coordination Center—within the Department of Homeland Security to coordinate the federal law enforcement activities related to organized retail crime.

This concurrent resolution commends the bravery, courage, and resolve of the women and men of Iran who are (1) participating in the current protests to defend their fundamental human rights, and (2) risking their safety to speak out against the human rights abuses committed by the Iranian regime. The resolution condemns (1) the brutal beating and death of Mahsa Amini; and (2) the violent suppression by the Iranian regime of women and men participating in the current demonstrations, including children, and calls for transparent accountability for all killings of protesters by Iranian security forces. Finally, the resolution encourages continued efforts by the Biden Administration to respond to the protests, including the recent sanctioning of the Iranian morality police.

Educational Choice for Children Act This bill allows individuals and corporations a new tax credit after 2022 for charitable contributions to tax-exempt organizations that provide scholarships to elementary and secondary school students. Such students must be members of a household with incomes not greater 300% of the area median gross income and be eligible to enroll in a public elementary or secondary school. The bill excludes from the gross income of taxpayer dependents any scholarship amount for the elementary or secondary education expenses of eligible students. It also prohibits governmental control over scholarship granting organizations.

Academic Partnerships Lead Us to Success Act or the A PLUS Act This bill creates a framework under which states may receive federal elementary and secondary education funds on a consolidated basis and use such funds for any educational purpose permitted by state law.

Support And Value Expectant Moms and Babies Act of 2023 or the SAVE Moms and Babies Act of 2023 This bill prohibits the Food and Drug Administration (FDA) from approving any new drug (either as a brand-name drug or a generic) intended to terminate a pregnancy and imposes additional restrictions on such drugs that are already approved. Under the bill, an already-approved drug intended to terminate a pregnancy may be dispensed to a patient only with a prescription. Furthermore, the FDA may not approve any labeling change that would authorize (1) using the drug after 70 days of gestation, or (2) dispensing the drug by any means other than in-person administration by the prescribing health care practitioner. The FDA must also impose additional restrictions on such already-approved drugs, including by (1) requiring the prescribing health care practitioner to receive a special certification, (2) prohibiting the practitioner from also acting as the dispensing pharmacist, and (3) requiring the practitioner to have the ability to provide surgical intervention to the patient. The bill also rescinds any investigational use exemption already granted to such a drug if the bill would have prohibited the FDA from granting the exemption. (Currently, the FDA may grant an exemption to certain market approval requirements if a drug is intended solely for use in safety and effectiveness investigations.)

No Taxpayer Funding for Abortion and Abortion Insurance Full Disclosure Act of 2023 This bill modifies provisions relating to federal funding for, and health insurance coverage of, abortions. Specifically, the bill prohibits the use of federal funds for abortions or for health coverage that includes abortions. Such restrictions extend to the use of funds in the budget of the District of Columbia. Additionally, abortions may not be provided in a federal health care facility or by a federal employee. Historically, language has been included in annual appropriations bills for the Department of Health and Human Services (HHS) that prohibits the use of federal funds for abortions—such language is commonly referred to as the Hyde Amendment. Similar language is also frequently included in appropriations bills for other federal agencies and the District of Columbia. The bill makes these restrictions permanent and extends the restrictions to all federal funds (rather than specific agencies). The bill's restrictions regarding the use of federal funds do not apply in cases of rape, incest, or where a physical disorder, injury, or illness endangers a woman's life unless an abortion is performed. The Hyde Amendment provides the same exceptions. The bill also prohibits qualified health plans from including coverage for abortions. Currently, qualified health plans may cover abortion, but the portion of the premium attributable to abortion coverage is not eligible for subsidies.

Foreign Adversary Risk Management Act or the FARM Act This bill places the Secretary of Agriculture on the Committee on Foreign Investment in the United States. It also requires the committee to review any investment that could result in foreign control of any U.S. agricultural business. Further, the bill includes agricultural systems and supply chains in the definitions of critical infrastructure and critical technologies for the purposes of reviewing such investments. The Department of Agriculture and the Government Accountability Office must each analyze and report on foreign influence in the U.S. agricultural industry.

Child Interstate Abortion Notification Act of 2023 This bill creates new federal crimes related to transporting a minor across state lines for an abortion. Specifically, the bill makes it a crime to knowingly transport a minor across a state line to obtain an abortion without satisfying the requirements of a parental involvement law in the minor's resident state. A parental involvement law requires parental consent or notification, or judicial authorization, for a minor to obtain an abortion. The bill prohibits an individual who has committed incest with a minor from knowingly transporting the minor across a state line to receive an abortion. Finally, the bill makes it a crime for a physician to knowingly perform or induce an abortion on an out-of-state minor without first notifying the minor's parent.

Focus on the Mission Act of 2023 This bill prohibits the Department of Defense from requiring the recipient of a federal contract to provide a greenhouse gas inventory or to provide any other report on greenhouse gas emissions.

Allowing Military Exemptions, Recognizing Individual Concerns About New Shots Act of 2023 or the AMERICANS Act This bill prohibits the Department of Defense (DOD) from issuing any COVID-19 vaccine mandate as a replacement for the rescinded vaccine mandate of August 24, 2021, unless the mandate is expressly authorized by Congress. The bill also provides that DOD must establish an application process for remedies for members of the Armed Forces who were discharged or subject to adverse action under the rescinded mandate. Any administrative discharge of a member on the sole basis of a failure to receive a COVID-19 vaccine must be categorized as an honorable discharge, and DOD is prohibited from taking any adverse action against such a member for that reason. Under the bill, DOD must try to retain unvaccinated members and provide such members with professional development, promotion and leadership opportunities, and consideration equal to that of their peers. Additionally, DOD may only consider the COVID-19 vaccination status of members in making certain decisions (e.g., deployments in countries where it is the law) and must establish a process to provide exemptions to certain members for such decisions. This bill applies to all members of the Armed Forces, regardless of whether they sought an accommodation to any DOD COVID-19 vaccination policy.

Strategic Production Response Act or the SPR Act This bill limits the drawdown of petroleum in the Strategic Petroleum Reserve (SPR) until the Department of Interior issues a plan or updates a previously issued plan to increase the production of oil and gas on federal land. However, Interior may drawdown petroleum in the SPR if there is a severe energy supply interruption. The bill defines federal land to (1) include Outer Continental Shelf land; and (2) exclude land otherwise not available for oil and gas development within the National Park System, the National Wildlife Refuge System, the National Wilderness Preservation System, a National Marine Sanctuary, or Indian land.

Balanced Budget Accountability Act This bill requires the Office of Management and Budget (OMB), upon adoption by a chamber of Congress of a concurrent budget resolution for a fiscal year, to certify to the Speaker of the House of Representatives or the President pro tempore of the Senate whether that chamber has adopted a balanced budget. Balanced budget means a concurrent budget resolution providing that for FY2033 and each succeeding fiscal year to which the resolution applies total outlays do not exceed total receipts and are not more than 18% of the projected domestic product for such fiscal year. The bill requires the salary of Members of Congress to be held in escrow if OMB determines a chamber has not adopted a balanced budget for FY2024 before April 16, 2023, and for FY2025 before April 16, 2024. The bill also provides for the release of these funds to the Members. Beginning in FY2026, if OMB does not certify that a chamber has adopted a balanced budget before April 16 of the prior fiscal year, each Member of that chamber shall be paid at the rate of $1 annually for pay periods after that date in the same calendar year. The bill also requires that legislation in either chamber to increase revenue be agreed upon by an affirmative vote of three-fifths of the Members of that chamber.

Community Wildfire Protection Act of 2023 This bill modifies the definition of at-risk community with respect to the hazardous fuel reduction program to eliminate the requirement that such a community be included on a specified list of interface communities or be within or adjacent to federal land.

This bill prohibits the use of federal funds to allow an individual who is not a U.S. citizen to vote in any election in the District of Columbia (DC). Further, DC must certify that it does not allow noncitizens to vote in elections as a condition of receiving any federal funds. Federal law bars noncitizens from voting in federal elections; however, the DC Council passed a bill on October 18, 2022, that allows noncitizens who meet residency and other requirements to vote in local elections.

Ensuring Accurate and Complete Abortion Data Reporting Act of 2023 This bill requires states, as a condition of federal payment under Medicaid for family planning services, to report certain abortion data to the Centers for Disease Control and Prevention (CDC). (Currently, reporting is voluntary.) The CDC must develop standardized questions for states with respect to specified variables (e.g., maternal demographics and methods of abortion).

Protecting Life on College Campus Act of 2023 This bill prohibits the award of federal funds to an institution of higher education (IHE) that hosts or is affiliated with a school-based service site that provides abortion drugs or abortions to its students or to employees of the IHE or the site. An IHE that hosts or is affiliated with a site must, in order to remain eligible for federal funds, annually certify that the site does not provide abortion drugs or abortions to students or employees.

Protecting Individuals with Down Syndrome Act This bill creates new federal crimes related to the performance of an abortion on an unborn child who has Down syndrome. It subjects a violator to criminal penalties—a fine, a prison term of up to five years, or both. It also authorizes civil remedies, including damages and injunctive relief. A woman who undergoes such an abortion may not be prosecuted or held civilly liable.

The rule authorizes the VA to provide certain abortion-related care to veterans. IRS Funding Accountability Act This bill delays for a 60-day period funding for the Internal Revenue Service (IRS) enforcement activities enacted by the Inflation Reduction Act (except for eliminating return processing backlogs and reducing call wait times) until an annual spending plan for such activities is submitted to the congressional tax and appropriation committees. Congress may enact a joint resolution of disapproval of the spending plan before the end of the 60-day period requiring the IRS to submit a new spending plan. The IRS and the Department of the Treasury must make quarterly reports to the committees on expenditures for enforcement activities. The bill requires reductions in appropriations to the IRS for any failure to submit required reports.

Arrest Murderers not Ministers Act This bill specifies that in order for the federal government to prosecute individuals for violations of the Freedom of Access to Clinic Entrances Act (which prohibits forceful or threats of forceful interference with an individual's access to reproductive health services or exercise of religious freedom), the violation must involve intentional physical injuries or damage. Any funds that would have been used for prosecutions that are prohibited under the bill must be used to prosecute individuals who commit violent crimes or other specified offenses.

Mandatory Materiality Requirement Act of 2022 This bill limits additional disclosure requirements applicable to issuers of securities. Specifically, the Securities and Exchange Commission may only require an additional disclosure if the commission determines that there is a substantial likelihood that a reasonable investor of the issuer would consider the information important with respect to an investment decision.
