CO2 Regulatory Certainty Act This bill amends the Internal Revenue Code to revise requirements for the secure geological storage of carbon dioxide for the purpose of the tax credit for carbon dioxide sequestration. The bill establishes a December 31, 2017, deadline and requirements for regulations that the Internal Revenue Service (IRS) is required, under current law, to establish for determining adequate security measures for the geological storage of the carbon dioxide such that carbon dioxide does not escape into the atmosphere. The IRS regulations must consider the carbon dioxide to be disposed of in secure geological storage if it is stored in compliance with specified rules promulgated by the Environmental Protection Agency under the Clean Air Act and the Safe Drinking Water Act for the geologic sequestration of carbon dioxide, the injection of carbon dioxide, and the criteria and standards for underground injection control programs that are applicable to Class II wells. The bill also revises the definition of "qualified enhanced oil or natural gas recovery project" to exclude a requirement for the first injection of liquids, gases, or other matter to commence after December 31, 1990.

ECPA Modernization Act of 2017 This bill revises provisions that limit an electronic communication service provider or remote communication service provider from disclosing to law enforcement the contents of a wire or electronic communication that is in electronic storage.

Email Privacy Act This bill amends the federal criminal code to revise provisions that limit an electronic communication service (ECS) or remote communication service (RCS) provider from disclosing the contents of a wire or electronic communication that is in electronic storage. Additionally, it revises the standards for the government to compel an ECS or RCS provider to disclose contents of a wire or electronic communication or noncontent records or information pertaining to a subscriber or customer. An ECS or RCS provider may notify a subscriber or customer of the receipt of a warrant, court order, subpoena, or request, unless the government obtains an order for delayed notification. The bill revises the process for obtaining a delayed notification order and lengthens the maximum duration of a delayed notification order.

Protecting Consumers' Access to Credit Act of 2017 This bill amends the Revised Statutes, the Home Owners' Loan Act, the Federal Credit Union Act, and the Federal Deposit Insurance Act to state that bank loans that are valid when made as to their maximum rate of interest in accordance with federal law shall remain valid with respect to that rate regardless of whether a bank has subsequently sold or assigned the loan to a third party.

Bob Dole Congressional Gold Medal Act This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the award of a Congressional Gold Medal to Bob Dole in recognition for his service to the nation as a soldier, legislator, and statesman.

Harry W. Colmery Veterans Educational Assistance Act of 2017 This bill revises education and related benefits provided to veterans, service members, dependents, and survivors. The bill amends the Post-9/11 veterans' educational assistance program to: remove certain time restrictions on program use; increase assistance for reservists, guardsmen, dependents, and surviving spouses and dependents; provide full eligibility for Post-9/11 Purple Heart recipients and certain reservists and guardsmen; provide an extra academic years' worth of benefits for STEM (science, technology, engineering, or mathematics) degree candidates; establish a five-year pilot program for high technology courses; restore eligibility for service members whose school closes in the middle of a semester; authorize funding to improve claims processing; permit assistance to be used at certain institutions that are not institutions of higher education; and pro-rate the housing stipend for reservists called to active duty. The bill authorizes the Edith Nurse Rogers STEM Scholarship to help veterans complete STEM degrees. The Yellow Ribbon program is extended to Fry Scholarship recipients (surviving dependents of service members who died on active duty) and certain Purple Heart recipients. (The Yellow Ribbon program helps veterans pay for higher education tuition and fee costs not covered by the Post-9/11 program.) The bill: (1) extends the Advisory Committee on Education, (2) increases survivors' and dependents' educational assistance, and (3) extends funding for state educational program approving agencies. The bill provides statutory authority for the veterans success of campus program which provides veterans with on-campus educational and vocational counseling. The Department of Veterans Affairs shall: (1) make a new determination regarding each denied veteran's claim for disability compensation in connection with full-body exposure to mustard gas or Lewisite at specified locations during World War II, and (2) presume such exposure unless there is affirmative evidence otherwise.

Promotion and Expansion of Private Employee Ownership Act of 201 7 This bill amends the Internal Revenue Code to extend to all domestic corporations, including S corporations, provisions allowing deferral of tax on gain from the sale of employer securities to an S corporation-sponsored employee stock ownership plan (ESOP). The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The bill also amends the Small Business Act to define "ESOP business concern" and allow such a concern to continue to qualify for loans, preferences, and other programs under such Act.

Industrial Hemp Water Rights Act This bill specifies that the owner of an absolute or conditional water right, or an entity that receives or distributes water contracted from the federal government, may use or sell the water for the cultivation of industrial hemp if the growth or cultivation of industrial hemp is otherwise authorized under the laws of the state in which the use occurs. The bill applies regardless of whether the water has passed through a federal water project.

Authorized Rural Water Projects Completion Act This bill establishes the Reclamation Rural Water Construction and Settlement Implementation Fund, which shall consist of the Rural Water Project Account and the Reclamation Infrastructure and Settlement Implementation Account. The Department of the Treasury shall deposit into such accounts for each of FY2018-FY2038 specified revenues that would otherwise be deposited in the reclamation fund established by the Reclamation Act of 1902. The bill permits the Department of the Interior to use specified Rural Water Project Account funds to complete construction of rural water projects: (1) authorized before this bill's enactment, or (2) for which a feasibility study was submitted by February 27, 2015, pursuant to the Rural Water Supply Act of 2006 and for which Congress authorizes construction after enactment of this bill. Interior may not expend any amounts from the fund to carry this out until development of: (1) programmatic goals that would enable the completion of construction of the authorized rural water projects as expeditiously as practicable and that reflect the priorities identified in the laws authorizing the projects; and (2) funding prioritization criteria to serve as a methodology for distributing funds that take into account specified factors, including the need for potable water supplies in the affected rural and tribal communities. Interior shall use specified Reclamation Infrastructure and Settlement Implementation Account funds to: (1) provide authorized compensation to resolve all monetary claims of an Indian tribe against the United States relating to use of tribal land by the United States for the generation of hydropower; or (2) complete projects and implement provisions authorized by Congress that resolve litigation involving the United States and the water rights of Indian tribes or that implement approved agreements limiting such rights.

Fairness For Breastfeeding Mothers Act of 2017 This bill requires that certain public buildings that are open to the public and contain a public restroom provide a lactation room, other than a bathroom, that is hygienic and is available for use by members of the public to express milk. The lactation room must be shielded from view, be free from intrusion, and contain a chair, a working surface, and (if the building is supplied with electricity) an electrical outlet.

Designates June 2017 as National Post-Traumatic Stress Awareness Month and June 27, 2017, as National Post-Traumatic Stress Awareness Day. Supports efforts of the Department of Veterans Affairs (VA) and the Department of Defense, as well as the medical community, to educate members of the Armed Forces, veterans, their families, and the public about the causes, symptoms, and treatment of post-traumatic stress. Welcomes the efforts of the VA's National Center for PTSD (post-traumatic stress disorder) and local Vet Centers to assist veterans suffering from the effects of post-traumatic stress. Encourages Armed Forces commanders to support appropriate treatment of Armed Forces personnel who suffer from post-traumatic stress.

21st Century Conservation Service Corps Act of 2017 This bill amends the Public Lands Corps Act of 1993 to replace provisions that established the Public Lands Corps with provisions establishing the 21st Century Conservation Service Corps (21CSC) to: engage youth and veterans in civilian national service positions to conserve, rebuild, and enhance the natural resources, infrastructure, and recreation assets of the United States; increase public access to, and use of, public and tribal land and water, infrastructure, and natural, cultural, and historical resources, while spurring economic development and outdoor recreation and addressing backlogged maintenance on public land; conserve, restore, and enhance such resources by carrying out high-quality, cost-effective projects; ensure that the activities and expertise of corpsmembers will be accessible to any public, nonprofit, or tribal entity responsible for the stewardship of land and water in coordination with the land or water owner; place youth and veterans in civilian national service positions to protect, restore, and enhance U.S. natural resources, infrastructure, and recreation assets in a cost-effective manner without undue duplication or overlap of federal agency activities or programs; and channel widespread interest among youth and veterans in serving in such positions to help conserve, restore, and enhance public and tribal land and water, infrastructure, and natural, cultural, and historical resources and to develop the next generation of outdoor stewards, entrepreneurs, recreationists, and sportsmen. The 21CSC shall be implemented jointly by the participating entities, which shall include the Corporation for National and Community Service, the Office of the Assistant Secretary of the Army for Civil Works, the Federal Emergency Management Agency, and the Departments of Interior, Agriculture, Transportation, Labor, Energy, Defense, Veterans Affairs, Commerce, Education, and Housing and Urban Development. Such entities shall: (1) establish a process for an organization to become a 21CSC organization, and (2) support 21CSC projects. A 21CSC organization shall provide to each youth or veteran corpsmember a wage, stipend, living allowance, and/or an educational credit, as well as skills development, credentials, and education, for participation in a 21CSC project that involves: specified conservation and restoration projects; the support, development, and enhancement of outdoor recreation or urban green space; service that is primarily indoors with a clear benefit for natural, cultural, or historic resources or treasures; or a project on private land or water having a direct or recognized public or environmental benefit or the funding of which originated from a governmental entity. The bill sets forth provisions governing 21CSC conservation centers and program support, the provision of resource assistants, and Corpsmember eligibility for a noncompetitive hiring status and national service educational awards. A participating entity may offer to enter into a cooperative agreement with a tribal agency or a 21CSC organization to establish and administer the Indian Youth 21st Century Conservation Service Corps, which shall carry out 21CSC projects on tribal land or water.

Safeguard Tribal Objects of Patrimony Act of 2017 This bill amends the federal criminal code to double the maximum prison term (from 5 years to 10 years) for persons convicted of selling, purchasing, using for profit, or transporting for sale or profit the human remains of Native Americans or cultural items obtained in violation of the Native American Graves Protection and Repatriation Act. The bill prohibits the export of Native American cultural items that were obtained in violation of the Act, Native American archaeological resources that were obtained in violation of the Archaeological Resources Protection Act of 1979, or Native American objects of antiquity that were obtained in violation of the criminal code. Violators may be subject to fines, imprisonment, or both. The Department of the Interior and the Department of State must each designate a liaison to facilitate and hold trainings and workshops on the voluntary return of human remains or cultural items. Interior must refer individuals and organizations to Indian tribes or Native Hawaiian organizations to facilitate the voluntary return of human remains or cultural items. In addition, Interior must convene a tribal working group consisting of representatives of tribes and Native Hawaiian organizations to provide advice on issues concerning the return of, and illegal trade in, human remains or cultural items.

Improving Access to Cardiac and Pulmonary Rehabilitation Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to allow physician assistants, nurse practitioners, and clinical nurse specialists to supervise cardiac, intensive cardiac, and pulmonary rehabilitation programs.

Tribal HUD-VASH Act of 2017 This bill amends the United States Housing Act of 1937 to direct the Department of Housing and Urban Development (HUD) to use at least 5% of the amounts made available for rental assistance under the low-income housing assistance program to carry out a rental assistance and supported housing program, in conjunction with the Department of Veterans Affairs, for the benefit of Indian veterans who are homeless or at risk of homelessness and residing in or near an Indian area. Rental assistance shall be: (1) made available to recipients eligible for housing assistance block grants under the Native American Housing Assistance and Self-Determination Act of 1996; and (2) awarded based on need, administrative capacity, and any other funding criteria established by HUD.

Home Mortgage Disclosure Adjustment Act This bill amends the Home Mortgage Disclosure Act of 1975 to exempt a depository institution from certain records and disclosure requirements related to the itemization of loan data: (1) with respect to closed-end mortgage loans, if the depository institution originated fewer than 500 such loans in each of the two preceding years; and (2) with respect to open-end lines of credit, if the depository institution originated fewer than 500 such lines of credit in each of the two preceding years.

Restoring Accountability in the Indian Health Service Act of 2017 This bill amends the Indian Health Care Improvement Act to require the Department of Health and Human Services (HHS) to establish a pay system for health care professionals employed by Indian Health Service (IHS) that is competitive with the salary of health care professionals employed by the Veterans Health Administration. HHS may establish incentives related to IHS employee recruitment and retention by providing relocation costs and rental assistance to employees under certain circumstances. In addition, IHS must: centralize its credentialing system for licensed health professionals seeking to provide health care services at its facilities, establish standards to measure the timeliness of health care services in its facilities, implement an annual mandatory program that provides cultural training for certain IHS employees and contractors, and establish a demonstration project to provide additional staffing resources to understaffed IHS facilities. Liability protections are given to certain health care professionals who volunteer at IHS facilities. The bill expands the IHS student loan repayment program to include loan repayments for degrees related to health administration. HHS may: (1) directly hire candidates to positions within IHS; and (2) remove, transfer, or demote certain IHS employees based on performance or misconduct. HHS must establish a tribal consultation policy for IHS. The bill establishes: (1) whistle blower protections for IHS employees, and (2) requirements concerning IHS fiscal accountability and transparency.

Freedom for Americans to Travel to Cuba Act of 2017 This bill states that: (1) the President may not prohibit or otherwise restrict travel to or from Cuba by U.S. citizens or legal residents, or any of the transactions incident to such travel, including banking transactions; and (2) any law, regulation, or policy in effect on the date of enactment of this bill that prohibits or otherwise restricts such travel or transactions incident to such travel shall cease to have any force or effect. Nothing in this bill may be construed to limit the President's authority to restrict such travel or any transaction incident to such travel if the President determines that such restriction is necessary to protect: (1) U.S. national security, or (2) the health or safety of U.S. citizens or legal residents resulting from traveling to or from Cuba. Prior to restricting travel to Cuba, the President shall submit a written justification to Congress.

Child Protection and Family Support Act of 2017 This bill amends Part E (Foster Care and Adoption Assistance) of title IV of the Social Security Act to require the removal and foster care placement of a child to meet the requirements for foster care maintenance payments if the child has been placed with a parent residing in a licensed residential family-based treatment facility for substance abuse. The bill revises requirements for grants to regional partnerships delivering services and producing activities designed to implement IV-E prevention services, improve the well-being of, and improve permanency outcomes for, children and families affected by heroin, opioids and other substance abuse. This grant program is reauthorized for FY2018-FY2022.

Recognizes the 50th anniversary of Jerusalem's reunification and extends the Senate's friendship and hopes for peace to Jerusalem's residents and Israel's people. Reaffirms support for Israel's commitment to religious freedom and administration of holy sites in Jerusalem. Supports strengthening the mutually beneficial American-Israeli relationship. Commends Egypt and Jordan, former combatant states of the Six Day War, for embracing a vision of peace and coexistence with Israel and continuing to uphold their respective peace agreements. Reaffirms: (1) that it is long-standing U.S. bipartisan policy that the permanent status of Jerusalem remains a matter to be decided between the parties through final status negotiations towards a two-state solution; and (2) the Jerusalem Embassy Act of 1995 as U.S. law, and calls upon the President and all U.S. officials to abide by its provisions.

American Legion 100th Anniversary Commemorative Coin Act This bill requires the Department of the Treasury to mint and issue commemorative coins in recognition and celebration of the 100th anniversary of the American Legion. Surcharges received from the sale of these coins shall be paid to the American Legion for costs related to promoting the importance of: (1) caring for those who have served, and those who are still serving, in the Armed Forces; and (2) maintaining patriotic values, strong families, and assistance for at-risk children.

Honors and remembers law enforcement officers who have made the ultimate sacrifice. Expresses condolences to the loved ones of each law enforcement officer who has made the ultimate sacrifice in the line of duty.

Stop Online Booking Scams Act of 2017 This bill prohibits third-party online hotel reservation sellers from charging a consumer's credit card or financial accounts in an Internet transaction for a hotel unless they disclose: (1) a description of the offered good or service, the cost, and other material terms before the conclusion of the transaction; (2) that the third-party seller is not affiliated with the hotel owner or an entity that provides the hotel services or accommodations; (3) that the third-party seller is not an exhibition organizer, a meeting planner, or the official housing bureau for an event at the hotel; and (4) the brand identity of the third party online or over the phone. The bill provides authority to the Federal Trade Commission (FTC) and states to enforce against violations. The bill also expresses the sense of Congress that the FTC should revise its website to make it easier for consumers and businesses to report complaints of deceptive practices with respect to online booking of hotel reservations.

Back the Blue Act of 2017 This bill amends the federal criminal code: to establish new criminal offenses for killing, assaulting, and fleeing to avoid prosecution for killing a judge, law enforcement officer, or public safety officer; to expand the list of statutory aggravating factors in death penalty determinations to also include the killing or attempted killing of a law enforcement officer, judge, prosecutor, or firefighter or other first responder; and to broaden the authority of federal law enforcement officers to carry firearms. The bill amends the federal judicial code to limit federal court review of challenges to state court convictions for killing a public safety officer or judge. It amends the Revised Statutes of the United States to limit the recovery of compensatory damages and prohibit the recovery of attorney's fees by an individual for a violation of rights that occurs as a result of (or in the course of) conduct that constitutes a felony or crime of violence. Finally, it directs the Department of Justice to make grants to law enforcement agencies and nongovernmental organizations to promote trust and improve relations between law enforcement agencies and the communities they serve.

Department of Veterans Affairs Accountability and Whistleblower Protection Act of 2017 This bill establishes in the Department of Veterans Affairs (VA) the Office of Accountability and Whistleblower Protection, to be headed by the Assistant Secretary for Accountability and Whistleblower Protection. The VA shall develop criteria to promote supervisory protection of whistle-blowers and provide supervisors with related training. The bill revises VA authority to remove certain employees or senior executives for reasons of misconduct or performance, including by permitting such individuals to be demoted or suspended. The VA: (1) shall reduce the federal annuity of a removed individual who is convicted of a felony that influenced his or her performance while employed in such position, and (2) may reduce the federal annuity of a retired individual who was convicted of such a felony but who left the VA before final action was taken. The VA may recoup an award, a bonus, or relocation expenses paid to an employee under specified circumstances. The VA may directly appoint medical center directors and Veterans Integrated Service Network directors. The bill revises time periods for adverse action reviews with respect to physicians, dentists, podiatrists, chiropractors, optometrists, registered nurses, physician assistants, and expanded-function dental auxiliaries. The VA shall: (1) assess the effect of the enactment of this bill on the hiring, promotion, retention, and productivity of individuals in senior executive positions; and (2) collect information on the outcomes and effectiveness of disciplinary actions carried out during the three-year period ending on the date of enactment of this bill.

Armed Forces Reserve and National Guard Dual-Status Review and Modernization Act This bill postpones the deadline for conversion of at least 20% of all military technician (dual status) positions to positions of civilian employment in the federal government until 180 days after the Department of Defense transmits to Congress the report of the Working Group on Full Time Support of the Reserve Components, established by this bill. The working group shall undertake a comprehensive review of full-time support of the reserve components of the Armed Forces, including: an identification of the missions, purposes, and objectives of military technicians (dual status) in support of an operational reserve force; a review of the posture of such positions and their role in meeting such objectives; an analysis of potential workforce restructuring to fully align such positions with objectives for full-time support of the reserve components; an identification of such positions the conversion of which to federal civilian positions would best ensure the achievement of such objectives; an assessment of the impact of such conversion on the readiness of the National Guard for domestic operations; and an assessment of costs and potential savings associated with such conversion.

Interstate Transport Act of 2017 This bill permits an individual to transport a knife for any lawful purpose between two places (e.g., states) where it is legal to possess and carry such knife. The individual must comply with specified requirements. The bill prohibits the arrest or detention of an individual for a knife violation unless there is probable cause to believe the individual failed to comply with specified requirements. An individual may assert compliance with this bill's requirements as a claim or defense in any civil or criminal action or proceeding.

Veterans Appeals Improvement and Modernization Act of 2017 This bill revises the Department of Veterans Affairs (VA) disability claims appeals system. The bill permits a veteran to appeal within one year by: (1) requesting a review of the agency of original jurisdiction's (AOJ) decision by a higher-level adjudicator within AOJ using the same evidentiary record; (2) filing a supplemental claim with a regional office that includes the opportunity to submit additional evidence and have a hearing; or (3) appealing directly to the Board of Veterans' Appeals, with the opportunity to select an expedited review to submit new evidence but without a hearing, or to select a review with the option to submit new evidence and request a hearing. A veteran may: (1) maintain the original effective date of a claim if he or she submits new and relevant evidence within one year of the most recent decision, and (2) retain the services of attorneys and accredited agents who charge a fee when the AOJ provides notice of the original decision. The VA's statutory duty to assist a veteran terminates after the original decision. The bill: (1) requires the VA to issue decision notification letters, (2) permits certain veterans who initiated an appeal prior to the bill's effective date to opt-in to the new appeals system, (3) authorizes the VA to conduct a pilot program to test such system, and (4) requires the VA, prior to full implementation, to certify to Congress that it has sufficient resources and personnel to carry out the legacy and new appeals systems.

Crowdfunding Enhancement Act This bill amends the Securities Act of 1933 to allow a crowdfunding issuer to sell shares through a crowdfunding vehicle. (Crowdfunding is a method of capital formation in which groups of people pool money either to invest in a company or to support an effort by others to accomplish a specific goal.) A "crowdfunding vehicle" is a company that: has purposes limited to acquiring, holding, and disposing securities issued by a single company; issues only one class of securities; receives no compensation for such acquisition, holding, or disposition of securities; and meets other specified requirements, including those related to disclosure obligations and the use of investment advisers. The bill amends the Securities Exchange Act of 1934 to revise the conditions upon which the Securities and Exchange Commission (SEC) shall exempt securities issued in crowdfunding transactions from SEC registration requirements. Under current law, holders of crowdfunded shares do not count toward the shareholder threshold beyond which an issuer is required to register its securities with the SEC, provided that the issuer: (1) is current in its annual reporting obligations, (2) retains the services of a registered transfer agent, and (3) has less than $25 million in assets. The bill maintains this exemption but removes and replaces the conditions upon which it applies. Specifically, holders of crowdfunded shares shall not count toward the shareholder threshold if the issuer has: (1) a public float of less than $75 million, and (2) annual revenues of less than $50 million.

This bill extends the Secure Rural Schools and Community Self-Determination Act of 2000 through FY2017, including provisions concerning secure payments to eligible states, territories, and counties containing federal land. The bill: (1) sets forth special rules for state and county payments for FY2016, and (2) requires all FY2016 payments to be made within 45 days of enactment of this bill. No funds made available to eligible counties under such Act may be used in lieu of, or to otherwise offset, a state funding source for a local school, facility, or educational purpose. The merchantable timber contracting pilot program is repealed. The bill extends through FY2019 the authority under such Act to initiate special projects on such federal lands and certain county activities.

Creating Opportunities Now for Necessary and Effective Care Technologies (CONNECT) for Health Act of 2017 or the CONNECT for Health Act of 2017 This bill makes a series of changes to expand coverage of telehealth services under Medicare, including by exempting certain telehealth services (e.g., specified renal dialysis and stroke evaluation services) from originating site requirements.

Community Lending Enhancement and Regulatory Relief Act of 2017 or the CLEAR Relief Act of 2017 This bill amends the Sarbanes-Oxley Act of 2002 to exempt from specified reporting and attestation requirements a community bank with assets of $1 billion or less. The bill amends the Truth in Lending Act to exempt from certain escrow requirements and residential mortgage loan standards a residential mortgage loan held by a depository institution with assets of $10 billion or less. The bill further amends that Act, as well as the Consumer Protection Act of 2010, to exempt certain creditors from specified disclosure requirements. In addition, the bill amends the Bank Holding Company Act of 1956 to exempt from the Volcker Rule a depository institution with assets of $10 billion or less. (The Volcker Rule prohibits banking agencies from engaging in proprietary trading or entering into certain relationships with hedge funds and private-equity funds.)

Bureau of Land Management Headquarters Relocation Act This bill directs the Department of the Interior to submit a strategy, including a proposed time line, for relocating the headquarters of the Bureau of Land Management (BLM) from Washington, DC, to Alaska, Arizona, California, Colorado, Idaho, Montana, Nevada, New Mexico, Oregon, Utah, Washington, or Wyoming in a manner that will save the maximum amount of taxpayer money practicable. The bill authorizes such relocation.

Moving Americans Privacy Protection Act This bill amends the Tariff Act of 1930 to revise requirements regarding the public disclosure of personally identifiable information contained in the manifest of vessels or aircraft entering any U.S. port or place to direct the U.S. Customs and Border Protection (CBP) to ensure that any such information, including social security numbers, passport numbers, and residential addresses, are removed from any manifest signed and transmitted to the CBP before it is disclosed to the public.

Modernizing Government Technology Act of 2017 or the MGT Act This bill authorizes each of specified agencies for which there are Chief Financial Officers to establish an information technology system modernization and working capital fund to: improve, retire, or replace existing information technology systems to enhance cybersecurity and to improve efficiency and effectiveness; transition legacy information technology to cloud computing and other innovative platforms and technologies; assist and support efforts to provide adequate, risk-based, and cost-effective information technology capabilities that address evolving threats to information security; and reimburse amounts transferred to the agency from the Information Technology Modernization Fund (ITMF) (established under this bill), with the approval of such agency's Chief Information Officer. Each agency shall prioritize amounts within such fund to be used initially for approved cost savings activities. The bill establishes a Technology Modernization Fund for technology related activities, to improve information technology, and to enhance cybersecurity across the federal government. The fund shall be administered by the Commissioner of the Technology Transformation Service of the General Services Administration (GSA) in accordance with guidance issued by the Office of Management and Budget. The Commissioner shall: transfer amounts from the fund to an agency to improve, retire, or replace existing federal information technology systems to enhance cybersecurity and improve efficiency and effectiveness; use amounts in the fund for the development, operation, and procurement of information technology products, services, and acquisition vehicles to improve efficiency and cybersecurity; and use amounts in the fund to provide services or work performed in support of such activities. The bill establishes a Technology Modernization Board to: (1) evaluate proposals submitted by agencies for funding authorized under the fund; (2) make recommendations to the Commissioner to assist agencies in the further development and refinement of select modernization proposals; (3) monitor progress and performance in executing approved projects and, if necessary, recommend the suspension or termination of funding; and (4) monitor fund operating costs. The Commissioner shall support board activities and provide technical support to, and oversight of, agencies that receive transfers from the fund.

Creating and Restoring Equal Access To Equivalent Samples Act of 2017 or the CREATES Act of 2017 This bill permits the developer of a drug or biological product to bring a civil action against the license holder of an approved drug or biological product if the holder has declined to make available sufficient quantities of the approved drug or product for the developer's testing.

Empowering State Forestry to Improve Forest Health Act of 2017 This bill amends the Cooperative Forestry Assistance Act of 1978 to direct the Forest Service to establish a landscape-scale restoration program to provide financial and technical assistance for landscape-scale restoration projects on state and private forest lands that maintain or improve benefits from trees and forests on such lands. The program shall: address the national private forest conservation priorities specified under the Act; and enhance public benefits from trees and forests, as identified in a state-wide assessment and a long-term state-wide forest resource strategy under the Act. The program shall also have one or more objectives, including to: protect or improve water quality or quantity; reduce wildfire risk, including through hazardous fuels treatment; protect or enhance wildlife habitat; improve forest health and forest ecosystems, including addressing native, nonnative, and invasive pests; or enhance opportunities for new and existing markets in which the production and use of wood products strengthens local and regional economies. The Forest Service shall allocate from the amounts made available under this bill: 50% for the competitive process for distributing funds for landscape-scale restoration projects; and 50% proportionally to states to maximize the achievement of the restoration program's objectives and to address the highest national priorities, as identified in state-wide assessments and long-term state-wide forest resource strategies. The bill amends the Healthy Forests Restoration Act of 2003 to allocate funds and use specified authorities of the Department of Agriculture or of the Department of the Interior, as appropriate, to assist cross-boundary hazardous fuel reduction and wildfire mitigation programs.

Preserving Data in Government Act of 2017 This bill requires that any open government data that is made available to the public for at least 90 consecutive days must: (1) remain machine-readable, available in an open format, and part of the worldwide public domain or, if necessary, be published with an open license; and (2) not be altered in such a way as to decrease its machine-readable nature. It shall not be a violation of such requirement to alter: (1) the digital location or format of open government data for routine asset maintenance or long-term archiving if such alteration does not decrease the open public accessibility or the machine-readable nature of the data, or (2) the contents of such data to update it or correct an error. Any substantial alteration of the data's contents shall be recorded in a log that is made available to the public in an open format along with the data. An agency may remove such data from public availability if: the agency determines that the data is too costly to maintain or does not provide sufficient value to the public, the agency publishes specified notice at least six months in advance of such removal, and the data is available for download on the worldwide public domain for at least six months before such removal. This bill shall not apply to such data that is required to be removed from public availability or altered under another provision of law.

Johnson-O'Malley Supplemental Indian Education Program Modernization Act This bill requires the Department of the Interior to provide an updated and ongoing count of eligible Indian students for the Johnson-O'Malley Program (JOM Program) to ensure full participation of all qualified students. (The JOM Program awards contracts to support the cultural and academic needs of Native American students.) Interior shall consult with Native American tribes and state and local education agencies that have not participated in the JOM Program to expand the number of eligible Native American students served. Interior shall determine whether the JOM Program funding formula and eligibility requirements should be updated to ensure the maximum number of eligible Native American students.

Veterans Treatment Court Improvement Act of 2017 This bill requires the Department of Veterans Affairs (VA) to hire at least 50 Veterans Justice Outreach Specialists, place each one at an eligible VA medical center, and ensure that each one serves as part of a justice team in a veterans treatment court or other veteran-focused court. An eligible VA medical center is one that: complies with all VA guidelines and regulations for placement of a specialist; works with a veteran with active, ongoing, or recent contact with some component of a local criminal justice system; maintains an affiliation with one or more veterans treatment courts or other veteran-focused courts; and either routinely provides specialists, or establishes a VA-approved plan to provide specialists, to serve as part of a justice team in such a court. The VA shall prioritize the placement of specialists at eligible VA medical centers that have an affiliation with such a court that: (1) was established after the date of this bill's enactment, or (2) was established before such date and is not fully staffed with specialists.
