Expresses opposition to the Environmental Protection Agency (EPA) proposal entitled "Prevention of Significant Deterioration New Source Review: Refinement of Increment Modeling Procedures" and urges that the rule be withdrawn. Finds that EPA has proposed multiple changes to the PSD program that would conflict with Congress's statutory scheme to preserve, protect, and enhance air quality in national parks, wilderness areas, monuments, and seashores, and in other areas of special natural, recreational, scenic, or historic value.

Amends the Internal Revenue Code to modify the tax credit for producing electricity from closed or open-loop biomass facilities equipped with a metering device to determine electricity consumption or sale to allow a tax credit after 2008 for electricity produced and consumed at such facilities and to extend the credit period for such production.

United States Nuclear Fuel Management Corporation Establishment Act of 2008 - Amends the Atomic Energy Act of 1954 to establish the United States Nuclear Fuel Management Corporation. Authorizes the Corporation to: (1) manage a spent nuclear fuel enterprise to eliminate the need for federal funding for the management of spent nuclear fuel; and (2) assume responsibility for the activities, obligations, and use of resources of the federal government with respect to spent nuclear fuel management. Establishes in the Treasury the United States Nuclear Fuel Management Corporation Fund. Directs the President to appoint a Transition Manager to transfer spent nuclear fuel management obligations, functions, personnel, and funds from the Secretary of Energy to the Corporation.

Motor Fuel Supply and Distribution Improvement Act - Amends the Clean Air Act to: (1) update provisions limiting the number of gasoline or diesel fuels allowed in a state implementation plan; and (2) allow a limited, temporary waiver of a control or prohibition of a fuel or fuel additive in circumstances that prevent the distribution of an adequate supply of such fuel or fuel additive to consumers.

Urges the President, the U.N. Secretary-General, the African Union, and members of the international community to pursue a comprehensive solution to the crisis in Darfur, Sudan. Condemns: (1) the government of Sudan for its continued obstruction of the deployment of United Nations-African Union peacekeepers; and (2) the ongoing acts of violence in, and obstruction of aid to, Darfur committed by all parties. Calls upon the government of Sudan and armed parties in the region to declare a cessation of hostilities, abide by the U.N. arms embargo, cease attacks upon humanitarian organizations, and participate in international efforts to negotiate a political settlement.

Amends the Food, Conservation, and Energy Act of 2008 with respect to producers, including peanut producers, with 10 or fewer base acres to: (1) suspend a prohibition on direct payments, counter-cyclical payments, or average crop revenue election payments; and (2) extend the 2008 signup deadline for direct payments and counter-cyclical payments until December 31, 2008. Directs the Secretary of Agriculture to ensure that no penalty is assessed against producers for failure to submit reports or comply with other program requirements as a result of compliance with the extended signup deadline.

General Services Administration Portfolio Enhancement Act of 2008 - Directs the Administrator of General Services (GSA) to convey to the National Women's History Museum, Inc. (the Museum) the northern part of specified property in the District of Columbia, which the Administrator and the Museum deem appropriate for a museum facility. Grants the Administrator the authority to convey the southern part of such property to the Museum. Requires the Administrator to enter into an agreement with the Museum for the conveyance. Permits separate conveyance of the northern and southern parts. Requires the northern part to be dedicated for use as a site for a national women's history museum for a 99-year period and allows the southern part to be used for any purposes permitted by applicable laws and regulations.

Giving Incentives to Volunteers Everywhere Act of 2008 or the GIVE Act of 2008 - Amends the Internal Revenue Code to: (1) increase the standard mileage rate for use of a passenger automobile for charitable purposes to a rate not less than the rate used for the tax deduction for medical transportation expenses; and (2) exclude from the gross income of charitable volunteers reimbursements paid to them for the use of a passenger automobile for the benefit of a charitable organization.

Prohibits the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac) and their affiliates from making: (1) lobbying expenditures; (2) political contributions; or (3) contributions to any nonprofit tax-exempt organization. Declares that violating this Act shall constitute violation of federal law limiting the use of appropriated funds to influence certain federal contracting and financial transactions (thus, imposing the same penalties).

Recognizes September 11, 2008, as a day of solemn commemoration of the events of September 11, 2001. Offers condolences to the families, friends, and loved ones of the innocent victims of the September 11, 2001, terrorist attacks. Honors the heroic service, actions, and sacrifices of first responders, law enforcement personnel, state and local officials, volunteers, and others who aided the victims and, in doing so, risked and often gave their own lives. Recognizes the service, actions, and sacrifices of U.S. personnel who have given so much to support our freedom and defend our security. Reaffirms that the people of the United States will never forget the challenges our country endured on and since September 11, 2001, and will work to defeat those who attacked us.

Amends the Federal Housing Enterprises Financial Safety and Soundness Act of 1992, as amended by the Federal Housing Finance Regulatory Reform Act of 2008, to require the Director of the Federal Housing Finance Agency to prohibit any golden parachute payment on or after enactment of this Act with respect to any executive officer or director of: (1) the Federal National Mortgage Association (Fannie Mae) and any affiliate; (2) Federal Home Loan Mortgage Corporation (Freddie Mac) and any affiliate; and (3) any Federal Home Loan Bank.

Commercial Motor Vehicle Advanced Safety Technology Tax Act of 2008 - Amends the Internal Revenue Code to allow a general business tax credit for 50% of the cost of placing in service any qualified commercial vehicle advanced safety system. Defines "qualified commercial vehicle advanced safety system" as a manufacturer-certified brake stroke monitoring system, lane departure warning system, collision warning system, or vehicle stability system identified by the Federal Motor Carrier Safety Administration or the National Highway Traffic Safety Administration as significantly enhancing the safety or security of commercial drivers, vehicles, or passengers. Terminates such credit after 2013.

ADA Amendments Act of 2008 - Amends the Americans with Disabilities Act of 1990 (ADA) to redefine the term "disability," including by defining "major life activities" and "being regarded as having such an impairment." Sets forth rules of construction regarding the definition of "disability," including that: (1) such term shall be construed in favor of broad coverage of individuals under the Act; (2) an impairment that substantially limits one major life activity need not limit other major life activities in order to be a disability; (3) an impairment that is episodic or in remission is a disability if it would substantially limit a major life activity when active; and (4) the determination of whether an impairment substantially limits a major life activity shall be made without regard to the ameliorative effects of specified mitigating measures. Prohibits employment discrimination against a qualified individual on the basis of disability. (Current law prohibits employment discrimination against a qualified individual with a disability because of the disability.) Prohibits the use of qualification standards, employment tests, or other selection criteria based on an individual's uncorrected vision unless the standard, test, or other selection criteria, as used by the covered entity, is shown to be related to the position and is consistent with business necessity. Declares that nothing in the Act: (1) alters the standards for determining eligibility for benefits under state worker's compensation laws or under state and federal disability benefit programs; (2) alters the requirement to make reasonable modifications in policies or procedures, unless such modifications would fundamentally alter the nature of the goods, services, facilities, or accommodations involved; or (3) provides the basis for a claim by an individual without a disability that the individual was subject to discrimination because of the individual's lack of disability. Declares that the authority of the Equal Employment Opportunity Commission (EEOC), the Attorney General, and the Secretary of Transportation to issue regulations includes the authority to issue regulations implementing the definitions of this Act. Makes conforming amendments to the Rehabilitation Act of 1973.

Timber Revitalization and Economic Enhancement Act II of 2008 - Amends the Internal Revenue Code to make permanent: (1) the reduction in the rate of tax on the net timber gain of corporations; and (2) rules for the treatment of timber real estate investment trust (REIT) gains, mineral royalty income, and prohibited transactions.

Commends and expresses gratitude to: (1) the men and women of the U.S. Armed Forces for the service, sacrifices, and heroism that made the success of the troop surge in Iraq possible; and (2) General David H. Petraeus, General Raymond Odierno, and Ambassador Ryan Crocker for the distinguished wartime leadership that made such success possible. Recognizes the success of the troop surge in Iraq and its strategic significance in advancing U.S. vital national interests in Iraq, the Middle East, and the world, in particular as a strategic victory in a central front of the war on terrorism. Recognizes that the gains achieved as a result of the troop surge are significant but not permanent, and that it is imperative that no action be taken that jeopardizes those gains or dishonors the service and sacrifice of the men and women of the U.S. Armed Forces who made those gains possible.

Increased Student Achievement Through Increased Student Support Act - Directs the Secretary of Education to award competitive, renewable, five-year grants to partnerships between low-income local educational agencies (LEAs) and schools offering graduate programs in school counseling, social work, or psychology to increase the number of program graduates employed by low-income LEAs. Defines "low-income LEAs" as those that: (1) serve students at least 20% of which are from low-income families; (2) have ratios of school counselors, social workers, and psychologists to students that fall at least 10% below specified target ratios; and (3) have been identified as needing improvement or corrective action or include at least one school identified as needing improvement, corrective action, or restructuring under the Elementary and Secondary Education Act of 1965. Allows the use of grant funds to: (1) provide program graduate students with field training at partnership LEA schools; (2) contribute to program graduates' salaries at such schools for up to three years after they graduate; (3) increase the number of school counselors, social workers, and psychologists per student in such schools; (4) enhance the capacity of partnership graduate schools to train such professionals; (5) develop course work designed to facilitate such graduates' service to low-income LEAs and at-risk students; and (6) provide tuition credits to such graduate students and student loan forgiveness to program graduates employed as school counselors, social workers, or psychologists by low-income LEAs for at least five years. Directs the Secretary to establish a program providing student loan forgiveness to non-participants in this Act's grant program who have been employed for at least five years as school counselors, social workers, or psychologists by low-income LEAs. Requires the Secretary to identify a formula for future use in designating regions as eligible for benefit programs because of having a shortage of such school personnel.

Recognizes July 30, 2008, as the 40th anniversary of the enactment of the resolution establishing the Senate Select Committee on Nutrition and Human Needs, the substantial contributions the Committee made in ensuring that effective and efficient federal food assistance programs were accessible to those most in need, and that hunger continues to be an issue plaguing the United States. Supports the continued efforts of federal, state, and local governments and private non-profit organizations to eradicate U.S. hunger.

National Infantry Museum and Soldier Center Commemorative Coin Act of 2008 - Directs the Secretary of the Treasury to mint and issue $1 coins emblematic of the courage, pride, sacrifice, sense of duty, and history of the U.S. Infantry, in commemoration of the legacy of the U.S. Army Infantry and the establishment of the National Infantry Museum and Soldier Center. Expresses the sense of Congress that the coins should be struck at the U.S. Mint at West Point, New York, to the greatest extent possible. Restricts coin issuance to calendar year 2012. Requires a $10 surcharge per coin, and payment of all surcharges received to the National Infantry Foundation to establish an endowment to support the maintenance of the National Infantry Museum and Soldier Center.

New Clean Energy Tax Extenders Act - Amends the Internal Revenue Code to extend various energy production and conservation provisions. Extends through 2012: (1) the tax credits for producing electricity from certain renewable resources (e.g., for wind, biomass, geothermal, and hydropower facilities), for residential energy efficient property, and for investment in clean renewable energy bonds; and (2) the tax deduction for energy efficient commercial buildings. Expands the tax credit for production of electricity from renewable resources to include marine and hydrokinetic renewable energy as a renewable resource. Extends through 2016 the energy tax credits for solar, fuel cell, and microturbine property and the tax credit for residential energy efficient property. Repeals the dollar per kilowatt limitation on the energy tax credit for fuel cell property. Extends through 2011 the tax credit for energy efficiency improvements to existing homes. Makes biomass fuel burning stoves eligible for such credit. Extends the tax credit for energy efficient household appliances produced after 2007. Denies major integrated oil companies a tax deduction for income attributable to the domestic production of oil, gas, or any primary product thereof. Revises the treatment of foreign oil and gas extraction income and foreign oil related income for purposes of the foreign tax credit.

Expresses the sense of the Senate that: (1) the eighth amendment to the Constitution allows the death penalty for the rape of a child where the crime did not result, and was not intended to result, in death of the victim; (2) the Louisiana statute making child rape punishable by death is constitutional; (3) because Kennedy v. Louisiana was decided under a mistaken view of federal law, the U.S. Supreme Court should grant any petition for rehearing of the case and the portions of the decision regarding the national consensus or evolving standards of decency with respect to the imposition of the death penalty for child rape should not be viewed as binding precedent; and (4) the Supreme Court should reverse its decision on rehearing or in a future case because it was supported by neither commonly held beliefs about cruel and unusual punishment nor by the text, structure, or history of the Constitution.

Expresses: (1) the condolences of the Senate to the wives, children, and other family members of Private First Class Chestnut and Detective Gibson on the 10-year anniversary of their passing; (2) gratitude and appreciation for the professional manner in which the U.S. Capitol Police carry out their diverse missions; and (3) appreciation for the dedication U.S. Capitol Police officers have for protecting the Capitol Complex. Prohibits the Administrator of the Environmental Protection Agency (EPA), or a state with an approved National Pollutant Discharge Elimination System (NPDES) permit program under the Federal Water Pollution Control Act, from requiring an NPDES permit for a covered vessel for the next two years for any discharge: (1) of effluent from properly functioning marine engines; (2) of laundry, shower, and galley sink wastes; or (3) that is incidental to the normal operation of a covered vessel. Defines "covered vessel" to mean a vessel that is less than 79 feet in length or a fishing vessel. Requires the Administrator to evaluate the impacts of such discharges, excluding discharges: (1) from a vessel of the Armed Forces; (2) of sewage from a vessel, other than the discharge of graywater from a vessel operating on the Great Lakes; and (3) of ballast water. Provides that such prohibition does not apply with respect to: (1) rubbish, trash, garbage, or other such materials discharged overboard; (2) other discharges when the vessel is operating in a capacity other than as a means of transportation; (3) ballast water discharges; or (4) any discharge that contributes to a violation of a water quality standard or poses an unacceptable risk to human health or the environment.

Disapproves the rule submitted by the Secretary of Health and Human Services relating to requirements set forth in the State Health Official Letter 07-001, dated August 17, 2007, issued by the Director of the Center for Medicaid and State Operations in the Centers for Medicare & Medicaid Services and the State Health Official Letter 08-003, dated May 7, 2008, from such Center, requiring states that expand the income eligibility level for children under the State Children's Health Insurance Program (SCHIP) above 250% of the federal poverty level to adopt the five crowd-out strategies described in the August 17, 2007, letter and to provide certain assurances described in such letter.

Expresses the sense of the Senate to: (1) condemn the Mugabe regime for its manipulation of the country's electoral process and reject the June 27, 2008, presidential runoff election as illegitimate; (2) encourage the President's efforts to expand sanctions on those individuals responsible for violations of human and political rights in Zimbabwe; (3) applaud the governments of Benin, Botswana, Liberia, Kenya, Nigeria, Senegal, Sierra Leone, and Zambia for condemning such election; (4) encourage the U.N. Security Council to authorize a United Nations Special Representative for Zimbabwe; (5) urge African leaders to engage in the political resolution effort; (6) urge the United States and the international community to assemble a comprehensive economic and political recovery package; and (7) support a democratic political solution that reflects the will and respects the rights of the people of Zimbabwe.

Title VII Fairness Act - Amends the Americans With Disabilities Act of 1990 and title VII (Equal Employment Opportunities) of the Civil Rights Act of 1964 to delay the start of the time period for filing charges of employment discrimination until the aggrieved person has, or should be expected to have, enough information to support a reasonable suspicion of the discrimination, provided the aggrieved person demonstrates that the person did not have, and should not have been expected to have, enough information to support a reasonable suspicion of such discrimination on the date on which the alleged discrimination occurred. Prohibits applying these amendments to alleged discrimination relating to pensions or pension benefits. Applies the above Civil Rights Act of 1964 amendment to discrimination claims brought under: (1) specified provisions of the Americans with Disabilities Act of 1990; and (2) provisions of the Civil Rights Act of 1964 relating to employment by the federal government.

Gas Price Reduction Act of 2008 - Amends the Outer Continental Shelf Lands Act (OCSLA) to prescribe procedures for petition, by the governor of a state with a new producing area within the offshore administrative boundaries beyond the state's submerged land, to make the new producing area available for oil and gas leasing. Directs the Secretary of the Treasury to deposit specified percentages of outer Continental Shelf revenues into: (1) the general fund of the Treasury; and (2) into a special account in the Treasury for disbursal to both new producing states and to the Land and Water Conservation Fund. Amends the Department of the Interior, Environment, and Related Agencies Appropriations Act, 2008, to repeal the prohibition against funding: (1) regulations regarding a commercial leasing program for oil shale resources on public lands; or (2) an oil shale lease sale. Instructs the Secretary of Energy to: (1) expand and accelerate research and development efforts for advanced batteries; and (2) implement a direct loan program for up to 30% of the costs of advanced battery production. Expresses the sense of the Senate that the federal government should implement policies to increase federal purchases of plug-in electric drive vehicles. Directs the Secretary of the Treasury, the Chairman of the Board of Governors of the Federal Reserve System, the Chairman of the Securities and Exchange Commission (SEC), and the Chairman of the Commodity Futures Trading Commission (CFTC) to study jointly and report to Congress on the international regime for regulating trading in energy commodity futures and derivatives. Amends the Commodity Exchange Act to prohibit the CFTC from permitting a foreign board of trade to provide to participants subject to CFTC jurisdiction direct access to electronic trading and order matching unless specified requirements are met. Directs the CFTC to: (1) promulgate rules for routine reporting requirements for index traders and swap dealers in energy and agricultural transactions; and (2) disaggregate and make public monthly information on the positions and value of index funds and other passive, long-only positions in the energy and agricultural futures markets. Instructs the CFTC to report to certain congressional committees on: (1) the scope of commodity index trading in the futures markets; (2) whether classification of index traders and swap dealers in the futures markets can be improved for regulatory and reporting purposes; and (3) whether index trading activity is adversely impacting the price discovery process in the futures markets and whether different practices and controls should be required. Instructs the CFTC to hire additional employees.

Attorney-Client Privilege Protection Act of 2008 - Amends the federal criminal code to prohibit any U.S. agent or attorney, in any federal investigation or criminal or civil enforcement matter, including any form of administrative proceeding or adjudication, from: (1) demanding or requesting that an organization, or a current or former employee or agent of such organization, waive the protections of the attorney-client privilege or attorney work product doctrine; (2) offering to reward or actually rewarding an organization, or current or former employee or agent, for waiving such protections; or (3) threatening adverse treatment or penalizing an organization, or current or former employee or agent, for declining to waive those protections. Prohibits a U.S. agent or attorney in any federal investigation or criminal or civil enforcement matter, including any form of administrative proceeding or adjudication, from considering specified conduct in: (1) making a civil or criminal charging or enforcement decision relating to an organization, or one of its current or former employees or agents; or (2) determining whether an organization, or a current or former employee or agent, is cooperating with the government. Numbers among the actions a U.S. agent or attorney may not use as a charging decision condition or a cooperation-determining factor: (1) any valid assertion of the protection of the attorney-client privilege or attorney work product doctrine; (2) the provision of counsel to, or contribution to the legal defense fees or expenses of, a current or former employee or agent of an organization; (3) entry into, or existence of, a valid joint-defense, information-sharing, or common-interest agreement between an organization and a current or former employee or agent, or among its current or former employees; (4) the sharing of relevant information in anticipation of or in response to an investigation or enforcement matter between an organization and a current or former employee or agent, or among its current or former employees, unless shuch sharing is itself an offense; or (5) the failure to terminate the employment or affiliation of or otherwise sanction any employee or agent of the organization because of the employee's or agent's decision to exercise personal constitutional rights or other legal protections in response to a government request. Prohibits a U.S. agent or attorney from demanding or requesting that an organization or an affiliated person not take any such action.

Constitutional Amendment - Marriage Protection Amendment - Declares that: (1) marriage in the United States shall consist only of the union of a man and a woman; and (2) neither the U.S. Constitution nor the constitution of any state shall be construed to require that marriage or the legal incidents of marriage be conferred upon any other union.

Enumerated Powers Act - Requires each Act of Congress to contain a concise and definite statement of the constitutional authority relied upon for the enactment of each portion of that Act. Declares that failure to comply with this requirement shall give rise to a point of order in either chamber of Congress.

Veterans 2nd Amendment Protection Act - Prohibits considering a veteran, surviving spouse, or child who is mentally incapacitated, deemed mentally incompetent, or experiencing an extended loss of consciousness from being considered adjudicated as a mental defective for purposes of the right to receive or transport firearms without the order or finding of a judge, magistrate, or other judicial authority of competent jurisdiction that such veteran, surviving spouse, or child is a danger to him- or herself or others.
