Green Taxis Act of 2009

Green Taxis Act of 2009 - Allows states or political subdivisions to prescribe requirements for fuel economy for taxicabs and other automobiles if such requirements are at least as stringent as federal requirements and if such vehicles: (1) are automobiles that are capable of transporting not more than 10 individuals, including the driver; (2) are commercially available or are designed and manufactured pursuant to a contract with such state or subdivision; (3) are operated for hire pursuant to a license, permit, or other authorization issued by such state or subdivision; (4) provide local transportation for a fare determined on the basis of the time or distance traveled; and (5) do not exclusively provide transportation to and from airports. Amends the Clean Air Act to allow states or political subdivisions to adopt and enforce standards for the control of emissions from new motor vehicles that are taxicabs and other vehicles if such standards will be at least as protective of public health and welfare as applicable federal standards and if such vehicles meet the other criteria specified above.

Roadless Area Conservation Act of 2009

Roadless Area Conservation Act of 2009 - Prohibits road construction and road reconstruction in inventoried roadless areas of the National Forest System. Specifies exceptions, including because: (1) there is threat of a catastrophic event; (2) a natural resource restoration action is necessary; or (3) a federal-aid highway project is in the public interest or is consistent with the purposes for which the land was reserved or acquired. Prohibits timber from being cut, sold, or removed in an inventoried roadless area. Permits various exceptions, including for specified environmental reasons, if the responsible official determines that the cutting, sale, or removal of timber is expected to be infrequent. Authorizes the Secretary of Agriculture, acting through the Chief of the Forest Service, to make modifications to roadless area maps to improve their accuracy or inclusiveness. Instructs the Secretary, in order to evaluate the effect of a modification to a roadless area map, to prepare an environmental impact statement or similar analysis required under the National Environmental Policy Act of 1969. Declares that this Act does not: (1) revoke, suspend, or modify legal instruments and decisions concerning the use of NFS land made before January 12, 2001; (2) compel the amendment or revision of any land and resource management plan; or (3) apply to specified activities in the Tongass National Forest. States that the prohibitions and restrictions of this Act cannot be reconsidered, modified, or terminated under the Forest and Rangeland Renewable Resources Planning Act of 1974.

September 11 Family Humanitarian Relief and Patriotism Act of 2009 - Provides permanent resident status adjustment for an applicant alien who: (1) was on September 10, 2001, the spouse, child, or unmarried son or daughter of an alien who died as a direct result of the September 11, 2001, terrorist activity against the United States; (2) was deemed to be a beneficiary of, and by, the September 11th Victim Compensation Fund of 2001; (3) has no federal tax liability; (4) made a proffer of information to the Secretary of Homeland Security (DHS) between April 24, 2008, and August 15, 2008, in connection with a request for immigration relief; and (5) applies not later than one year from the date of enactment of this Act. Makes the provisions of this Act inapplicable to an alien who is inadmissible or deportable under criminal or security grounds, including September 11, 2001, terrorist activity.

Graduation Promise Act of 2009 - Authorizes the Secretary of Education to make grants to states and, through them, subgrants to local educational agencies (LEAs) for differentiated high school improvement systems targeting support to schools with low student achievement and graduation rates after such schools fail for two consecutive years to make adequate yearly progress (AYP) pursuant to state academic performance standards. Allots grant funds to states pursuant to a formula that favors states with low graduation rates and a high percentage of students attending low-income LEAs. Requires state grantees to establish comprehensive school performance indicators and minimum annual improvement benchmarks for use, in addition to current AYP measures, in analyzing school performance and determining the improvement category into which a school is placed. Directs LEA subgrantees to: (1) categorize each of their schools that fail to make AYP for two consecutive years as needing targeted intervention, whole school reforms, or replacement; (2) convene a local school improvement team for each of such schools that will use performance indicators, AYP measures, and other relevant data to conduct a school needs assessment and develop a multiyear school improvement plan tailored to the school's need categorization; and (3) support the successful implementation of such plans and district-wide high school improvement strategies. Authorizes the Secretary to award competitive grants to LEAs, nonprofit organizations, and institutions of higher education to develop and implement, or replicate, effective secondary school models for struggling students and dropouts.

Russell National School Lunch Act to require the Secretary of Agriculture to: (1) develop guidelines for determining when it is appropriate to institute an administrative hold on suspect commodities and products being used in school meal programs; (2) work with states to increase their timeliness in notifying schools of food recalls; (3) improve the timeliness and completeness of direct communication with schools about holds and recalls; (4) establish a timeframe for improving commodity hold and recall procedures so that they address the role of processors and distributors, thereby facilitating the provision of more timely and complete information to schools; (5) revise procedures to provide states with more specific instructions for schools about how to dispose of recalled commodities and products and obtain timely reimbursement; and (6) institute a systematic quality check procedure to ensure that holds on commodities and products used by schools are carried out effectively. Directs the Secretary, within one year of this Act's enactment, to revise the procedures of the Food Safety and Inspection Service to ensure that schools are included in recall effectiveness checks.

Business Incubator Promotion Act - Amends the Public Works and Economic Development Act to include among the Act's goals encouraging distressed communities to support the formation of business incubators to promote innovation and entrepreneurship in economically distressed areas. Defines "business incubator" as an entity established to foster the startup of businesses or accelerate the growth of fledgling companies by providing entrepreneurs with resources and services to produce viable businesses that can help create jobs and restore vitality to distressed areas, excluding an entity organized primarily as for-profit venture. Modifies criteria for the eligibility of an area for grants under such Act for public works and economic development or economic adjustment projects to require an area to have had an unemployment rate of at least 1% greater than the national average for the most recent 12-month (currently, 24-month) period for which data are available. Authorizes the Secretary of Commerce to: (1) increase the federal share for public works and economic development project grants based upon an area's unemployment rate or per capita income compared to the national average; and (2) reduce or waive the non-federal or local share required for participation in such grant assistance for a special need area in cases of severe economic distress. Authorizes the Secretary to provide competitive grants for: (1) the development and implementation of feasibility studies and plans for the creation or expansion of business incubators; and (2) the temporary support of operations of business incubators that is essential to self-sustainability.

Full-Service Community Schools Act of 2009 - Amends the Elementary and Secondary Education Act of 1965 to authorize the Secretary of Education to award grants to: (1) consortia composed of a local educational agency and one or more community-based, nonprofit, or other public or private entities to assist public elementary or secondary schools to function as full-service community schools; and (2) state collaboratives to support the development of full-service community school programs. Requires such schools to: (1) participate in community-based efforts to coordinate educational, developmental, family, health, and other comprehensive services through community-based organizations and public and private partnerships; and (2) provide access to such services to students, families, and the community. Gives local grant priority to consortia that: (1) will serve at least two full-service community schools eligible for schoolwide programs under the Act, and more than one full-service community school as part of a community or districtwide strategy; (2) demonstrate a record of effectiveness in coordinating multiple qualified services; and (3) will be connected to a school and community partnership group that brings together key stakeholders across varied sectors to improve results for students and their families. Establishes a Full-Service Community Schools Advisory Committee.

Livable Communities Act of 2009 - Establishes in the Department of Housing and Urban Development (HUD) an Office of Sustainable Housing and Communities (OSHC). Establishes in the executive branch an independent Interagency Council on Sustainable Communities. Requires the OSHC Director to establish a program to make comprehensive planning grants and sustainability challenge grants to eligible entities (partnerships between a consortium of units of general local government and an eligible partner, which may be a metropolitan planning organization, a rural planning organization, a regional council, or a state). Requires the use of a comprehensive planning grant to carry out a project to: (1) coordinate land use, housing, transportation, and infrastructure planning processes across jurisdictions and agencies; (2) identify potential regional partnerships for developing and implementing a comprehensive regional plan; (3) conduct or update housing, infrastructure, transportation, energy, and environmental assessments to determine regional needs and promote sustainable development; (4) develop or update a comprehensive regional plan or goals and strategies to implement an existing comprehensive regional plan; and (5) implement local zoning and other code changes necessary to implement a comprehensive regional plan and promote sustainable development. Requires the use of a sustainability challenge grant to: (1) promote integrated transportation, housing, energy, and economic development activities carried out across policy and governmental jurisdictions; (2) promote sustainable and location-efficient development; and (3) implement projects identified in a comprehensive regional plan. Directs the OSHC Director to study and report to specified congressional committees on incentives for encouraging lenders to make, and homebuyers and homeowners to participate in, energy-efficient mortgages and location-efficient mortgages.

Reengaging Americans in Serious Education by Uniting Programs Act - Directs the Secretary of Labor to award competitive, renewable, five-year grants to eligible partnerships to assist them in providing disadvantaged youth with the support needed to: (1) graduate from secondary school; (2) attain a postsecondary credential, including those offered by institutions of higher education, industry groups, or registered apprenticeship programs; and (3) secure and succeed in a family-supporting career. Requires each eligible partnership to include: (1) the head of the local government assisted by the grant; (2) disadvantaged youth and their caregivers; (3) representatives from certain state and local service agencies; (4) representatives from certain educational entities; and (5) a representative from a community-based organization, a youth-serving nonprofit agency, a labor-management committee, and a business. Requires grantees to award subgrants and contracts to community-based organizations and other entities for the provision of a comprehensive array of coordinated services to disadvantaged youth that include workforce preparation, education support, and youth support services. Establishes an accountability system for measuring the performance of each grantee against specified interim, transitional, and long-term indicators of success. Directs the Secretary to: (1) award a grant or contract to an entity outside the Department of Labor for an evaluation of grant-assisted activities; (2) disseminate best practices that emerge from the partnership grant program; and (3) provide training, technical assistance, and professional development for organizations serving disadvantaged youth, including organizations that do not receive funding under this Act.

Child Protection Improvements Act of 2009 - Amends the National Child Protection Act of 1993 to direct the Attorney General to: (1) establish policies and procedures for a program for national criminal history background checks for child-serving organizations; (2) assist such organizations in obtaining access to nationwide background checks; (3) establish procedures for insuring the accuracy of criminal history records; (4) identify individuals convicted of serious misdemeanors or felonies involving children; and (5) collect demographic data relating to individuals and organizations covered by this Act and make reports to Congress on such data. Limits the liability of a child-serving organization for failure to conduct criminal background checks or to take adverse action against employees with a criminal history. Imposes limitations on the disclosure or use of criminal history records. Amends the PROTECT Act to provide for an extension of the Child Safety Pilot Program.

Authorizes the Secretary of Energy to provide grants to organizations to conduct business competitions that provide incentives, training, and mentorship to entrepreneurs and early stage startup companies throughout the United States to meet high priority economic, environmental, and energy security goals in areas including energy efficiency, renewable energy, air quality, water quality and conservation, transportation, smart grid, green buildings, and waste management. Grants priority to such competitions that: (1) are led by the private sector; (2) encourage regional and interregional cooperation; and (3) can demonstrate the creation of cost-effective green jobs through an annual publication of competition activities and directory of companies. Requires an organization, to be eligible for such a grant, to be a tax-exempt, charitable organization, or any sponsored entity of such organization that is operated as a nonprofit entity. Directs the Secretary to give priority to organizations that can demonstrate broad funding support from private and other non-federal funding sources to leverage federal investment.

Employment Non-Discrimination Act of 2009 - Prohibits employment discrimination on the basis of actual or perceived sexual orientation or gender identity by covered entities (employers, employment agencies, labor organizations, or joint labor-management committees). Prohibits preferential treatment or quotas. Allows only disparate treatment claims. Prohibits related retaliation. Makes this Act inapplicable to: (1) religious organizations; and (2) the relationship between the United States and members of the Armed Forces. Declares that this Act does not repeal or modify any federal, state, territorial, or local law creating a special right or preference concerning employment for a veteran. Provides for the construction of this Act regarding: (1) enforcement by employers of rules and policies; (2) sexual harassment; (3) certain shared facilities such as showers or dressing facilities; (4) construction of new or additional facilities; (5) dress and grooming standards; and (6) provision of employee benefits to married vs. unmarried couples. Declares that, in this Act, "married" refers to a legal union between one man and one woman. Prohibits the Equal Employment Opportunity Commission (EEOC) from collecting statistics from covered entities on actual or perceived sexual orientation or gender identity or compelling the collection by covered entities of such statistics. Provides for enforcement, including giving the EEOC, the Librarian of Congress, the Attorney General, and U.S. courts the same enforcement powers as they have under specified provisions of the Civil Rights Act of 1964, the Government Employee Rights Act of 1991, and other specified laws. Allows actions and proceedings, subject to exception, against the United States and the states.

Restore Our American Mustangs Act - Amends the Wild Free-Roaming Horses and Burros Act to revise provisions concerning the management of such animals. Requires the Secretary of the Interior (for Bureau of Land Management [BLM] administered lands) or the Secretary of Agriculture (for Forest Service administered lands) to: (1) ensure that acreage available for wild and free-roaming horses and burros is at least equal to the acreage where they were found in 1971; (2) update the inventory of such horses and burros annually and make it publicly available on the BLM website every two years; (3) take specified actions to manage such horses and burros and to achieve and maintain a thriving natural ecological balance on lands where such horses and burros are found; (4) identify new rangelands, arrange for supervised protection on private lands, and establish sanctuaries or exclusive use areas for such horses and burros; (5) report to specified congressional committees on the effects of new ranges, sanctuaries, and exclusive use areas on rangeland health, riparian zones, water quality, soil compaction, seed bed disturbance, native wildlife, and endangered or threatened species; (6) research, develop, and implement enhanced fertility control for mares, stallions, or both; (7) exhaust all practicable options of maintaining a thriving natural ecological balance on the range before removing horses and burros; (8) take specified actions to promote the adoption program; (9) temporarily remove horses or burros from the range if their immediate health or safety is threatened; (10) remove horses and burros determined to be a threat to the health and well-being of native plant or wildlife species; and (11) provide specified public information on animal removals, range changes, and treatment. Revokes provisions that allow the Secretaries to destroy: (1) old, sick, or lame animals; and (2) excess horses and burros for which an adoption demand does not exist. Requires adopters of such horses and burros to affirm that adopted animals and their remains will not be sold or transferred for consideration for processing into commercial products. Prohibits: (1) containing such horses and burros in corrals or short-term holding facilities for more than six months while awaiting disposition; or (2) destroying such horses or burros unless the Secretaries determine that the horses or burros are terminally ill or fatally injured. Removes the limitation on the number of titles to horse and burros that may be transferred to qualified individuals. Expands the membership of the advisory board on the management and protection of such horses and burros. Applies criminal penalties to any person who transports a live or deceased horse or burro for processing into commercial products. Lifts a restriction on the authority of the Secretary to relocate such horses and burros to public lands where they did not exist at the passage of such Act. Sets forth new reporting requirements on the management of such horses and burros.

Asthma Act

Asthma Act - Authorizes additional appropriations to the National Heart, Lung, and Blood Institute to expand the National Asthma Education and Prevention Program. Requires the Program's coordinating committee to report to Congress on: (1) the scope of the asthma problem in the United States; (2) federal programs that carry out asthma-related activities; and (3) recommendations for strengthening and better coordinating such activities. Includes the Secretary of Education or a designee in the committee's membership. Requires the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC) to: (1) collaborate with states to expand the scope of asthma-related activities to determine the incidence and prevalence of asthma and prevent related health consequences; (2) conduct local asthma surveillance activities to collect data on the prevalence and severity of asthma and the quality of asthma management; and (3) compile and annually publish data on the prevalence of asthma in children. Authorizes the Secretary to make grants for: (1) information and education on asthma; and (2) referrals to health programs that provide asthma-related services. Directs the Secretary to: (1) carry out a program to encourage the states to implement plans for activities to assist children with respect to asthma in accordance with the Institute's guidelines; and (2) make a grant to states under the Children's Health Insurance Program (CHIP, formerly known as SCHIP) for such activities. Authorizes grants to local educational agencies to carry out asthma-related activities at elementary and secondary schools in communities with a significant number of low-income or underserved individuals.

Protecting America's Workers Act

Protecting America's Workers Act - Amends the Occupational Safety and Health Act of 1970 (OSHA) to expand its coverage to federal, state, and local government employees. Authorizes the Secretary of Labor, under specified conditions, to cede OSHA jurisdiction to another federal agency with respect to certain occupational standards or regulations for such agency's employees. Declares OSHA inapplicable to working conditions covered by the Federal Mine Safety and Heath Act of 1977. Sets forth increased protections for whistle blowers under OSHA. Sets forth provisions relating to: (1) the posting of employee rights; (2) a prohibition against the adoption or implementation of policies or practices by employers that discourage the reporting of work-related injuries or illnesses or that discriminate or provide for adverse action against any employee for reporting such injury or illness; (3) a prohibition against the loss of wages or employee benefits as a result of an employee participating in or aiding workplace inspections; (4) investigations of incidents in a place of employment resulting in a death or the hospitalization of two or more employees; (5) a prohibition against designating a citation for an occupational health and safety standard violation as an unclassified citation; (6) the rights of an employee who has sustained a work-related injury or illness that is the subject of an investigation; (7) an employer's right to contest citations and penalties; (8) the Secretary's assertion of an employer's failure to correct a serious hazard during an employer's contest to a citation; and (9) employee objections to modifications of citations. Increases civil and criminal penalties for certain OSHA violators. Requires a state that has an approved plan for the development and enforcement of occupational safety and health standards to amend its plan to conform to the requirements of this Act within 12 months after enactment of this Act.

Forest Carbon Incentives Program Act of 2009 - Requires the Secretary of Agriculture to establish a carbon incentives program to achieve supplemental greenhouse gas emission reductions on private forest land of the United States. Directs the Secretary (subject to specified requirements) to provide to owners of eligible land financial incentive payments for: (1) eligible practices that measurably increase carbon sequestration and storage over a designated period, as specified through a climate mitigation contract; and (2) permanent avoided deforestation agreements (i.e., permanent conservation easements that cover eligible land that will not be converted for development). Directs the Secretary to: (1) specify requirements to address intentional or unintentional reversal of carbon sequestration during the contract period; (2) issue regulations that specify eligible practices and related compensation rates, standards, and guidelines; (3) establish and implement protocols that provide monitoring and verification of compliance with such contracts; (4) report on progress toward reaching specified levels of carbon sequestration and storage through such contracts; and (5) adjust (at least every two years) eligible practices and compensation rates for future contracts based on the results.

Veteran Voting Support Act of 2009

Veteran Voting Support Act of 2009 - Directs the Secretary of Veterans Affairs to provide mail voter registration application forms to each veteran who: (1) seeks to enroll in the Department of Veterans Affairs (VA) health care system at the time of such enrollment; and (2) is already enrolled in such system when there is a change in the veteran's enrollment status or when there is a change in the veteran's address. Requires the Secretary to accept completed application forms for transmittal to appropriate state election officials. Instructs that forms accepted at VA medical centers, community living centers, community-based outpatient centers, and domiciliaries be transmitted within ten days of acceptance, unless a completed form is accepted within five days before the last day for registration to vote in an election in which case the application shall be transmitted to the appropriate state election official within five days of acceptance. Prohibits any information relating to registering to vote or a declination to register to vote under this Act from being used for any purpose other than voter registration. Requires each Director of a VA community living center, domiciliary, or medical center to provide assistance in voting by absentee ballot to resident veterans. Requires such assistance to include: (1) providing information relating to the opportunity to request an absentee ballot; (2) making available absentee ballot applications upon request, as well as assisting in completing such applications and ballots; and (3) working with local election administration officials to ensure the proper transmission of the applications and ballots. Directs the Secretary to permit nonpartisan organizations to provide voter registration information and assistance at facilities of the VA health care system. Prohibits the Secretary from banning any election administration official, whether state or local, party-affiliated or non-party affiliated, or elected or appointed, from providing voting information to veterans at any VA facility. Directs the Secretary to provide reasonable access to facilities of the VA health care system to state and local election officials for the purpose of providing nonpartisan voter registration services to individuals.
