Restoring the 10th Amendment Act - Authorizes a designated state official to file with the head of a federal agency proposing a rule, during the period when the proposed rule is required to be open for public comment, a legal brief challenging the constitutionality of the rule under the Tenth Amendment. Directs the agency head: (1) to notify the designated official of each state within 15 days after such a brief is filed; (2) to post prominently on the agency's primary Web page a link to the brief; and (3) within 15 days after posting such link, to certify in writing that such rulemaking does not violate the Tenth Amendment and post the certification prominently on the front page of the agency's website, unless the agency determines it will not put the proposed rule into effect. Authorizes a state official who decides to challenge a federal rule on the grounds that it violates the Tenth Amendment to elect to file a legal action in U.S. district court for the district in which the official's place of business is located. Directs the relevant U.S. Court of Appeals, at the request of a designated state official, to grant expedited review of a decision by a district court in such a case.

Condemns the November 2010 attack by the government of North Korea against the Republic of Korea in violation of the 1953 Korean War Armistice Agreement. Expresses deep condolences to the government and people of the Republic of Korea, especially the families on Yeonpyeong Island who suffered from this attack and lost their loved ones. Recognizes that maintaining peace on the Korean peninsula requires constant vigilance and stands with the people and the government of the Republic of Korea in this time of crisis. Calls on the international community, especially China, to condemn this attack and enjoin the government of North Korea to halt all nuclear activities in accord with U.N. Security Council Resolutions 1718 and 1874, and refrain from further actions that may destabilize the Korean Peninsula. Calls on the President to work with the government of the Republic of Korea to take all necessary steps to deter further North Korean aggression. Urges the Administration to continue a bilateral economic relationship with the Republic of Korea. Reaffirms the commitment of the United States to its alliance with the Republic of Korea.

Social Security Number Protection Act of 2010 - Prohibits federal, state, or local agencies from: (1) displaying the Social Security account number of any individual, or any derivative of such number, on any check issued for any payment by the agency; or (2) employing, or entering into a contract for the use or employment of, prisoners in any capacity that would allow them access to the Social Security account numbers of other individuals.

American Family Farm and Ranchland Protection Act of 2010 - Amends the Internal Revenue Code to increase to $5 million the limitation on the estate tax exclusion for land subject to a qualified conservation easement and to increase the percentage of the value of such land that is excludable.

Reduce Unnecessary Spending Act of 2010 - Amends the Impoundment Control Act of 1974 to require the Office of Management and Budget (OMB) to transmit, within 45 calendar days after enactment of the funding in question, a message to Congress with specified information requesting any rescission the President proposes under the procedures in this Act. Prescribes requirements for timing and packaging of rescission requests. Authorizes OMB, subject to a specified time limit, to withhold funding from obligation temporarily if the President proposes a rescission. Prohibits the President from invoking such expedited procedures or such authority to withhold funding on more than one occasion for any Act providing funding. Sets forth procedures for expedited congressional consideration of proposed rescissions.

All Students Achieving through Reform Act of 2010 or All-STAR Act of 2010 - Amends the Elementary and Secondary Education Act of 1965 to direct the Secretary of Education to award competitive grants to certain eligible entities and, through them, subgrants to successful public charter schools to allow such schools to expand or replicate to serve additional students. Lists, as eligible grantees, state and local educational agencies, authorized public chartering agencies, and tax-exempt organizations that have successfully supported the replication and expansion of such schools. Sets forth the attributes that are to give such entities grant priority, including their serving or planning to serve a large percentage of low-income students from public schools with low-graduation rates or schools identified as needing improvement, corrective action, or restructuring under the Elementary and Secondary Education Act of 1965. Authorizes grantees to use up to 25% of a grant to establish a reserve account to assist them in acquiring and developing new facilities for successful public charter schools through: (1) credit enhancement initiatives; (2) the establishment of revolving loan funds; (3) direct spending or financing; or (4) partnerships with community development or other mission-based financial institutions. Directs the Secretary to conduct an independent, comprehensive, and scientifically sound evaluation of the effect this Act's initiatives have on student achievement and other areas, as determined by the Secretary.

Requires the Administrator of the Environmental Protection Agency (EPA) to delay the implementation of the final rules entitled "Lead; Renovation, Repair, and Painting Program; Lead Hazard Information Pamphlet; Notice of Availability; Final Rule" (published on April 22, 2008) and "Lead; Amendment to the Opt-out and Recordkeeping Provisions in the Renovation, Repair, and Painting Program" (signed by the Administrator on April 22, 2010) in each state until accredited certified renovator classes to train contractors in practices necessary for compliance with such rules have been held in such state for at least a year. Requires the Administrator to: (1) monitor each state to determine when such classes are offered; and (2) notify each Member of Congress about the location and time of each such class held in their state and the date on which the classes have been held for one year.

Recognizes the ultimate sacrifice made by the 29 coal miners lost at the Upper Big Branch Mine-South in Raleigh County, West Virginia. Extends the deepest condolences of the Senate to the families of the fallen coal miners. Honors the survivors of the tragedy. Recognizes all coal miners for enduring the immeasurable loss of co-workers and maintaining courage in the aftermath of the explosion at the Upper Big Branch Mine-South. Commends the valiant efforts of the emergency response workers searching for the missing coal miners. Honors the many volunteers who provided support and comfort for the missing coal miners' families during the rescue and recovery operations.

Condemns the detention of, and calls for the immediate release of, Burmese democracy leader Daw Aung San Suu Kyi and all prisoners of conscience in Burma. Calls on the military regime in Burma to engage in political dialogue with the National League for Democracy and other opposition groups and ethnic minorities. Calls upon the Secretary of State to: (1) assess the effectiveness of the policy of engagement with the military regime in Burma; (2) engage regional governments and multilateral organizations, including the People's Republic of China (PRC), the Association of Southeast Asian Nations (ASEAN), and the U.N. Security Council, to push for democratic transition to civilian rule in Burma; and (3) support the National League for Democracy and the people of Burma in calling for constitutional and election reforms by the military regime.

National Alzheimer's Project Act - Establishes in the Office of the Secretary of Health and Human Services (HHS) the Office of the National Alzheimer's Project to: (1) accelerate the development of treatments that would prevent, halt, or reverse the course of Alzheimer's; (2) create and maintain an integrated national plan to overcome Alzheimer's; (3) help to coordinate the health care and treatment of citizens with Alzheimer's; (4) ensure the inclusion of ethnic and racial populations that are at higher risk for Alzheimer's or that are least likely to receive care in clinical, research, and service efforts with the purpose of decreasing health disparities; (5) coordinate with international bodies to integrate and inform the fight against Alzheimer's globally; and (6) provide information and coordination of Alzheimer's research and services across all federal agencies. Sets forth the duties of the Director of the Office, including to use discretionary authority to evaluate all federal programs concerning Alzheimer's. Establishes in the Office an Advisory Council on Alzheimer's Research and Treatment.

National September 11 Memorial & Museum Commemorative Medal Act of 2010 - Directs the Secretary of the Treasury to strike and make available for sale not more than 2 million silver national medals, containing one ounce of silver each, in commemoration of the 10th anniversary of the September 11, 2001, terrorist attacks on the United States and the establishment of the National September 11 Memorial & Museum at the World Trade Center. Declares that all sales of medals under this Act shall include a surcharge of $10 per medal, which shall be paid to the National September 11 Memorial & Museum at the World Trade Center to support its operations and maintenance.

Bipartisan Tax Fairness and Simplification Act of 2010 - Declares as the purposes of this Act to: (1) make the federal individual income tax system simpler, fairer, and more transparent; (2) reduce the income tax rate on corporations, repeal the individual and corporate alternative minimum tax (AMT), and eliminate special tax preferences; and (3) reduce the federal budget deficit. Amends the Internal Revenue Code to: (1) reduce the number of tax brackets for individual taxpayers from six to three (i.e., 15, 25, and 35%); (2) increase the standard tax deduction; (3) eliminate miscellaneous itemized tax deductions after 2010; (4) exclude from gross income 35% of certain dividend income and gain on capital assets; (5) repeal the AMT for individuals; (6) allow a new tax credit for interest on state and local bonds; (7) revise rules for tax-exempt retirement plans and education tax credits and create tax-exempt Lifetime Savings Accounts; and (8) deny a tax deduction for punitive damages. Makes permanent specified provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 that: (1) increased the earned income, dependent care, and child tax credits; and (2) repealed limits on personal exemptions and itemized tax deductions. Requires the Internal Revenue Service (IRS), beginning on January 1, 2011, to provide taxpayers a simplified Easyfile pre-prepared income tax return and a one-page summary of federal spending on Social Security, Medicare, Medicaid, defense, and interest on the federal debt. Revises corporate and business-related taxation by: (1) imposing a flat 24% rate on the taxable income of corporations; (2) increasing the expensing allowance for depreciable assets; (3) repealing deferral of taxes on foreign income; and (4) requiring 30% withholding of certain payments to beneficiaries of foreign accounts. Directs the Congressional Budget Office (CBO) to identify and report to Congress on federal direct and indirect spending on businesses. Increases penalties for noncompliance with information reporting requirements. Sets forth rules and definitions for applying the economic substance doctrine to tax transactions. Imposes penalties for underpayments of tax due to transactions lacking in economic substance. Imposes a tax on Internet gambling.

Clean Air Act Amendments of 2010 - Amends the Clean Air Act (CAA) to require the Administrator of the Environment Protection Agency (EPA) to establish a sulfur dioxide allowance trading program to reduce sulfur dioxide emissions for fossil fuel-fired combustion devices in the contiguous states and the District of Columbia. Directs the Administrator to issue allowances authorizing specified annual tonnage amounts of emissions of sulfur dioxide from such devices for 2012-2014, 2015-2017, 2018-2020, and 2021 and thereafter. Provides for the distribution of such allowances. Requires the Administrator to establish two nitrogen oxide allowance trading programs (for specified Zone One and Zone Two states) to reduce nitrogen oxide emissions for fossil fuel-fired electric generating facilities that served as generators with nameplate capacities greater than 25 megawatts on or after January 1, 1985, and that produce electricity for sale in the contiguous states and the District of Columbia. Directs the Administrator to issue allowances authorizing specified annual tonnage amounts of nitrogen oxide emissions from such facilities in Zone One and Zone Two states for 2012-2014, 2015-2019, and 2020 and thereafter. Provides for the distribution of such allowances. Requires the Clean Air Interstate Rule and related federal implementation plans promulgated and modified by the Administrator to remain in force and effect with respect to all provisions relating to nitrogen oxides and sulfur dioxide emitted through 2011. Sets forth exceptions to the rule. Requires the Administrator to: (1) regulate coal- and oil-fired electric utility steam generating units under the CAA's regulations for sources of hazardous air pollutants; and (2) ensure that emission standards for the coal-fired electric utility steam generating units achieve at least a 90% reduction in mercury emissions when applied to the listed category as a whole. Requires electric utility steam generating units to meet maximum achievable control technology emission limitations by January 1, 2015, if the Administrator fails to promulgate nationally applicable emission limitations for such units by January 1, 2012. Requires the Administrator to promulgate regulations requiring certification of continuous emission monitoring systems to measure the quantity of mercury emitted by electric coal utility steam generating units.

Prohibits any funds appropriated or made available to the Department of Justice (DOJ) from being used to commence or continue a prosecution in an Article III court of any individual suspected of involvement in the attacks on the United States and its citizens on September 11, 2001, who is not a citizen of the United States and is subject to the jurisdiction of a military commission.

Child Care Protection Act of 2009 - Amends the Child Care and Development Block Grant Act of 1990 to require states that receive funds under such Act to: (1) require and conduct criminal background checks for staff members of child care providers; (2) prohibit the employment of a child care staff member who refuses to consent to a criminal background check, makes a false statement in connection with such background check, is registered as a sex offender, or is a convicted felon involving certain crimes; and (3) provide criminal background checks to child care providers upon request. Imposes a financial penalty on states that fail to comply substantially with the requirements of this Act.

Bipartisan Task Force for Responsible Fiscal Action Act of 2009 - Amends the Congressional Budget Act of 1974 to establish in the legislative branch the Bipartisan Task Force for Responsible Fiscal Action to address, and report to the President, the Vice President, the Speaker of the House of Representatives, and the Majority and Minority Leaders of both chambers on, the nation's long-term fiscal imbalances, including federal expenditures and revenues and the current and long-term actuarial financial condition of the federal government. Provides for expedited legislative consideration of Task Force recommendations.

Military Voter Compliant States Act of 2009 - Amends the Uniformed and Overseas Citizens Absentee Voting Act to exempt certain states from the requirement that a state transmit a validly requested absentee ballot to an absent uniformed services voter or overseas voter not later than 45 days before a federal election if the voter's request is received at least 45 days before the election. Requires a waiver of such requirement for any state where, in the regularly scheduled general election for federal office held in November 2008, less than 3% of all absentee ballots received by the state from absent uniformed services voters and overseas voters were not counted as a result of not being received in time to be so counted.

Amends the Higher Education Act of 1965 to extend by one year, from July 2010 to July 2011, the Secretary of Education's authority to purchase or enter into forward commitments to purchase: (1) Federal Family Education Loans (FFELs) from lenders, upon the determination that there is an inadequate availability of loan capital to meet the demand for such loans; and (2) rehabilitated loans that eligible lenders purchased under the FFEL default reduction program. Extends by one year, from June 30, 2010 to June 30, 2011, the authority of institutions of higher education (IHEs), with the Secretary's approval, to participate in the FFEL lender-of-last-resort program for borrowers otherwise unable to obtain such loans (thereby requiring guaranty agencies serving as lenders-of-last-resort to make FFELs to student and parent borrowers of such IHEs, until such date, regardless of their ability to otherwise obtain such loans).

USA PATRIOT Reauthorization Act of 2009 - Amends the USA PATRIOT Improvement and Reauthorization Act of 2005 to extend until December 31, 2013, provisions: (1) granting roving electronic surveillance authority; and (2) authorizing the production of tangible things (including books, records, papers, and documents) for foreign intelligence and international terrorism investigations. Amends the Intelligence Reform and Terrorism Prevention Act of 2004 to extend until December 31, 2013, provisions revising the definition of an "agent of a foreign power" to include any non-U.S. person who engages in international terrorism or preparatory activities ("lone wolf" provision). Amends the federal criminal code to revise procedures for obtaining judicial review of national security letter nondisclosure orders. Allows the recipient of a nondisclosure order to request judicial review of the order and requires the government to respond by setting forth specific facts in a certification that justify the need for nondisclosure based upon national security and other concerns. Requires courts, in considering whether to grant a nondisclosure order, to give substantial weight to the facts alleged by the government in its certification. Repeals provisions granting government certifications a conclusive presumption of veracity.

Amends Rule XXVI (Committee Procedure) of the Standing Rules of the Senate to make it out of order in a subcommittee or committee to proceed to any legislative matter unless the legislative matter and a final budget scoring for it by the Congressional Budget Office (CBO) have been publicly available on the Internet, on the official committee and CBO websites, in searchable form 72 hours before proceeding (excluding Saturdays, Sundays, and holidays except when the Senate is in session on such a day). Permits waiver or suspension of this rule, or successful appeals from rulings of the Chair, only by an affirmative vote of two-thirds of the Members of the subcommittee or committee. Makes it out of order in the Senate to proceed to a legislative matter if it was proceeded to in a subcommittee or committee in violation of this Rule. Permits waiver or suspension of this rule, or successful appeals from rulings of the Chair, only by an affirmative vote of two-thirds of the entire Senate. Amends Rule XVII (Reference to Committees; Motions to Discharge; Report; Hearings Available) to apply the same rule in the Senate before it proceeds to any legislative matter. States that nothing in this resolution or any amendment made by it shall be interpreted to require or permit the declassification or posting on the Internet of classified information in the Senate's custody. Requires such classified information to be made available to Members in a timely manner as appropriate under existing laws and rules.

Amends Rule XXVI (Committee Procedure) of the Standing Rules of the Senate to make it out of order in a subcommittee or committee to proceed to any legislative matter (except perfecting amendments) unless the legislative matter and a final budget scoring for it by the Congressional Budget Office (CBO) have been publicly available on the Internet, on the official committee and CBO websites, in searchable form 72 hours before proceeding (excluding Saturdays, Sundays, and holidays except when the Senate is in session on such a day). Permits waiver or suspension of this rule, or successful appeals from rulings of the Chair, only by an affirmative vote of two-thirds of the Members of the subcommittee or committee. Makes it out of order in the Senate to proceed to a legislative matter if it was proceeded to in a subcommittee or committee in violation of this rule. Permits waiver or suspension of this rule, or successful appeals from rulings of the Chair, only by an affirmative vote of two-thirds of the entire Senate. Amends Rule XVII (Reference to Committees; Motions to Discharge; Report; Hearings Available) to apply the same rule in the Senate before it proceeds to any legislative matter (other than perfecting amendments). States that nothing in this resolution or any amendment made by it shall be interpreted to require or permit the declassification or posting on the Internet of classified information in the Senate's custody. Requires such classified information to be made available to Members in a timely manner as appropriate under existing laws and rules.

Declares that the Senate has heard with profound sorrow and deep regret the announcement of the death of the Honorable Henry Bellmon, a former member of the U.S. Senate. Declares that when the Senate adjourns on September 29, 2009, it stand adjourned as a further mark of respect to the memory of Senator Bellmon.
