Advancing Tribal Parity on Public Land Act

Advancing Tribal Parity on Public Land Act This bill addresses tribal interests in the disposal and management of public land. Specifically, the bill prohibits the federal government from disposing of public land or National Forest System land unless the Department of the Interior or the Department of Agriculture (USDA) determines, through consultation with any interested Indian tribe, that such disposal would not impact the rights and interests of any interested tribe and would not impair access to a reservation. Interested Indian tribe means an Indian tribe with (1) historic, precontact, cultural, or religious connection to a cultural site located on the tract of public land; (2) a former reservation located on the tract of public land; or (3) treaty rights or other reserved rights associated with the tract of public land. Interior and USDA must, prior to conducting a sale of a tract of public land, notify all tribes of the availability of land for sale. Further, Interior and USDA must sell the tract of land to an interested Indian tribe that submits a bid at fair market value. Land acquired by an interested tribe shall be taken into trust by Interior for the benefit of the tribe. Additionally, the bill revises various public land provisions, including to add the interests of tribes to the list of considerations for land exchanges. The bill also requires each public land advisory board to include at least one representative of an interested Indian tribe.

Tribal Cultural Areas Protection Act

Tribal Cultural Areas Protection Act This bill provides for the preservation of tribal cultural sites on public land by establishing the Tribal Cultural Areas System. Within three years of this bill's enactment, the Department of the Interior or the Department of Agriculture (USDA), as applicable, must establish criteria for recommending tribal cultural sites for designation as tribal cultural areas for inclusion in the system, using specified factors; solicit recommendations from tribes, state historic preservation officers, and tribal historic preservation officers; review designations in local land management plans to identify tribal cultural sites that meet established criteria; consider any other relevant information; consider and evaluate tribal cultural sites for designation as a tribal cultural area for inclusion in the system; and  make recommendations to Congress. The bill gives Congress the sole authority to (1) designate a tribal cultural site located on public land as a tribal cultural area for inclusion in the system, and (2) remove a tribal cultural area from the system. Congress must consider the recommendations of Interior and USDA when determining whether to make such a designation. For each congressionally designated tribal cultural area, Interior or USDA must (1) establish a tribal commission to provide guidance and recommendations on the development of a management plan for the tribal cultural area, and (2) develop a comprehensive management plan. The bill allows for self-determination contracts with tribes or tribal organizations to perform administrative or management functions within a tribal cultural area.

HCBS Relief Act of 2023 This bill temporarily increases the applicable Federal Medical Assistance Percentage (i.e., federal matching rate) under Medicaid for certain approved home- and community-based services that are provided during FY2024-FY2025. As a condition for receiving the increased rate, a state must agree to undertake activities to improve the delivery of such services, such as by providing additional benefits to home health workers and by helping individuals who were relocated to nursing facilities move back to their homes.

Safe Schools Improvement Act

Safe Schools Improvement Act This bill requires states to direct their local educational agencies (LEAs) to establish policies that prevent and prohibit bullying and harassment of elementary and secondary school students. In particular, these policies must prohibit bullying and harassment based on race, color, national origin, sex (including sexual orientation, gender identity, and sex characteristics), disability, or religion. Further, LEAs must provide (1) students, parents, and educational professionals with annual notice of the conduct prohibited in their disciplinary policies; (2) students and parents with grievance procedures that target such conduct; and (3) the public with annual data on the incidence and frequency of that conduct at the school and LEA level. The Department of Education must conduct and report on an independent biennial evaluation of programs and policies to combat bullying and harassment in elementary and secondary schools. The National Center for Education Statistics must collect state data to determine the incidence and frequency of the conduct prohibited by LEA disciplinary policies.

Artificial Intelligence Advancement Act of 2023 This bill requires the development of a bug bounty program within the Department of Defense (DOD) and requires various studies and reports related to artificial intelligence. The bill requires certain financial entities (e.g., the Federal Reserve System) to report on the knowledge gap on artificial intelligence. The bill also requires the Chief Digital and Artificial Intelligence Office (CDAO) within DOD to develop a bug bounty program for foundational artificial intelligence models being integrated into DOD missions and operations. Generally, a bug bounty program provides incentives to individuals to discover and report on vulnerabilities in an organization's software or systems. Not later than one year after the enactment of this bill, CDAO must brief Congress on the development of bug bounty programs and long-term plans with respect to such programs. The bill also requires CDAO to study the vulnerabilities to the privacy, security, accuracy of, and capacity to assess, artificial intelligence-enabled military applications. Finally, DOD must report on ways to improve data sharing, interoperability, and quality across DOD.

Indian Buffalo Management Act This bill establishes a permanent program within the Department of the Interior to develop and promote tribal ownership and management of buffalo and buffalo habitat on Indian lands. Specifically, the bill requires Interior to (1) enter into contracts, award grants, and provide technical assistance to Indian tribes and tribal organizations for activities related to buffalo restoration or management; (2) consult with tribes and tribal organizations on initiatives that affect buffalo or buffalo habitat, including efforts to contain or eradicate diseased buffalo; and (3) develop a policy relating to buffalo and buffalo habitat management activities on Indian land. Additionally, Interior may enter into agreements with tribes or tribal organizations to transport surplus buffalo from federal land onto Indian land.

Secure And Fair Enforcement Regulation Banking Act or the SAFER Banking Act This bill provides protections for federally regulated financial institutions that serve state-sanctioned marijuana businesses. Currently, many financial institutions do not provide services to state-sanctioned marijuana businesses due to the federal classification of marijuana as a Schedule I controlled substance. Under the bill, a federal banking regulator may not penalize a depository institution for providing banking services to a state-sanctioned marijuana business. For example, regulators may not terminate or limit the deposit or share insurance of a depository institution solely because the institution provides financial services to a state-sanctioned marijuana business. The bill also prohibits a federal banking regulator from requesting or requiring a depository institution to terminate a deposit account unless (1) there is a valid reason, such as the regulator has cause to believe that the depository institution is engaging in an unsafe or unsound practice; and (2) reputational risk is not the dispositive factor. Additionally, proceeds from a transaction involving activities of a state-sanctioned marijuana business are no longer considered proceeds from unlawful activity. (Financial institutions that handle proceeds from unlawful activity are subject to anti-money laundering laws. Violators of these laws are subject to fines and imprisonment.) Furthermore, a financial institution, insurer, or federal agency may not be held liable or subject to asset forfeiture under federal law for providing a loan, mortgage, or other financial service to a state-sanctioned marijuana business.

Current law prohibits the use of these funds to provide any person with a dangerous weapon or training in the use of a dangerous weapon. The bill specifies that this prohibition shall not apply to the use of these funds for permissible program activities that provide students with educational instruction or educational enrichment activities, such as archery, hunting, other shooting sports, or culinary arts.
