Digital Equity Foundation Act of 2022 This bill sets out a process for establishing the Foundation for Digital Equity to raise funding for, develop programs and partnerships to, and otherwise support efforts to expand access to broadband internet and promote digital literacy, inclusion, and equity. The bill authorizes the foundation to carry out a range of activities to advance its mission, such as (1) establishing for-profit subsidiaries to stimulate economic development and attract investment partners, and (2) awarding grants.

Loan Forgiveness for Educators Act of 2022 This bill expands the Teacher Loan Forgiveness program. Among other provisions, the bill (1) renames the program the Educator Loan Forgiveness program, (2) expands program eligibility to early childhood educators and program directors serving in early childhood education programs and school leaders serving in public high-need schools, and (3) establishes a program in which the Department of Education cancels monthly student loan payments during qualifying service and provides complete loan forgiveness after five years of service.

National Plan to End Parkinson's Act This bill requires the Department of Health and Human Services (HHS) to carry out a project to prevent and cure Parkinson's disease (a progressive brain disorder that causes unintended or uncontrollable movements) and related conditions. Among other components of the project, HHS must (1) implement and periodically update a national plan to coordinate and guide efforts to prevent and cure the disease; (2) improve diagnosis, treatment, and care of those with the disease; and (3) address health and other disparities related to the disease. HHS must also conduct annual assessments on the preparation for and response to the increased burden of Parkinson's disease. In addition, the bill establishes a council, comprised of federal and nonfederal stakeholders, to advise HHS on and make recommendations concerning the prevention and cure of Parkinson's disease. The bill's provisions terminate at the end of calendar year 2035.

This resolution remembers Her Majesty Queen Elizabeth II and her more than 70 years of service in support of the British people and the Commonwealth of Nations. The resolution also expresses gratitude to Queen Elizabeth II for her efforts to maintain strong bilateral relations between the United Kingdom and the United States. Finally, the resolution extends condolences to the family of Queen Elizabeth II, to the people of the United Kingdom of Great Britain and Northern Ireland, and to the peoples of the Commonwealth of Nations.

Democracy Is Strengthened by Casting Light On Spending in Elections Act of 2022 or the DISCLOSE Act of 2022 This bill addresses campaign finance, including by expanding the prohibition on campaign spending by foreign nationals, requiring additional disclosures of campaign expenditures, and requiring additional disclosures regarding certain political advertisements. Specifically, the bill expands existing foreign money prohibitions to include disbursements for paid web-based or digital communications and federal judicial nomination communications. It also prohibits foreign nationals from contributing to campaigns related to ballot initiatives and referenda. The Government Accountability Office must, for each four-year election cycle, study and report on the incidence of illicit foreign money in federal elections. Next, the bill makes it unlawful to establish or use a corporation, company, or other entity with the intent to conceal an election contribution or donation by a foreign national. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. Covered organizations (e.g., corporations, labor organizations, and political organizations) must, within 24 hours, file reports with the Federal Election Commission to disclose campaign expenditures of more than $10,000 during an election cycle. The bill also requires organizations to provide additional disclosures regarding political advertisements, including the donors who contributed the most money to that organization in the last year.

Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2023 This bill provides FY2023 appropriations for military construction, the Department of Veterans Affairs (VA), and related agencies. The bill provides appropriations to the Department of Defense (DOD) for military construction for the Army; the Navy and Marine Corps; the Air Force; Defense-wide agencies and activities; the Army and Air National Guard; and the Army, Navy, and Air Force Reserves. The bill also provides appropriations to DOD for the North Atlantic Treaty Organization (NATO) Security Investment Program; the Base Closure Account; Construction and Operation and Maintenance of Family Housing for the Army, the Navy and Marine Corps, the Air Force, and Defense-wide agencies and activities; the Family Housing Improvement Fund; and the Military Unaccompanied Housing Improvement Fund. Within the VA budget, the bill provides appropriations for the Veterans Benefits Administration, the Veterans Health Administration, the National Cemetery Administration, Departmental Administration, and the Cost Of War Toxic Exposures Fund. The bill provides appropriations for related agencies and programs, including the American Battle Monuments Commission, the U.S. Court of Appeals for Veterans Claims, Cemeterial Expenses of the Army, and the Armed Forces Retirement Home. The bill also sets forth requirements and restrictions for using funds provided by this and other appropriations acts.

Reproductive Health Care Accessibility Act This bill establishes various grants and related programs that address sexual and reproductive health care for individuals with disabilities. Specifically, the Health Resources and Services Administration must support training for health care providers who offer sexual and reproductive health care to individuals with disabilities, and educating individuals with disabilities about sexual and reproductive health care. The Administration for Community Living must establish a national center to provide recommendations, technical assistance, and other resources related to the provision of sexual and reproductive health care for individuals with disabilities. The bill also authorizes support for medical schools, nursing schools, and other educational institutions that offer obstetrics and gynecology training programs to expand the number of individuals with disabilities entering the reproductive health care workforce. Additionally, the Department of Health and Human Services must study the effectiveness and other aspects of reproductive health care services and programs for individuals with disabilities.

Hermit's Peak/Calf Canyon Fire Forest Restoration Program Relief Act This bill directs the Department of Agriculture to waive the cost share requirement with respect to a payment provided for restoration of land damaged by the Hermit's Peak/Calf Canyon Fire. That fire started as the result of a prescribed burn initiated by the Forest Service in the Santa Fe National Forest in New Mexico, on April 6, 2022.

Let Doctors Provide Reproductive Health Care Act This bill sets out protections for and establishes programs to support health care providers (and those who assist such providers) who offer reproductive health care services that are lawful in the state where the services are provided. Reproductive health care services refer to abortion services; contraceptive services; in vitro fertilization; or other reproductive care, education, and counseling that is provided (1) at a health care site or via telehealth, and (2) in a medically accurate manner. The bill prohibits individuals, entities, and states from preventing, restricting, or otherwise interfering with the provision of lawful reproductive health care services by health care providers. The Department of Justice, individuals, or providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations. Furthermore, states may not use federal funds to pursue legal cases or similar proceedings (e.g., adverse licensing proceedings) against health care providers, individuals, or entities that offer or assist with lawful reproductive health care services. Additionally, medical malpractice insurers may not deny coverage to or sue a health care provider because the provider offers or assists with lawful reproductive health care services. The bill also funds grants to assist health care providers who offer or refer for abortion services and face legal issues relating to their provision of reproductive health care services with legal matters and improving security.

Equal Access to Contraception for Veterans Act This bill prohibits the Department of Veterans Affairs from requiring payment from a veteran for any contraceptive item that is required to be covered by health insurance plans without a cost-sharing requirement.

Mental Health Workforce and Language Access Act of 2022 This bill establishes within the Department of Health and Human Services (HHS) two demonstration programs to increase access to mental health services provided in languages other than English at federally qualified health centers (FQHCs). In carrying out the programs, HHS must give preference to FQHCs at which at least 20% of the patients are best served in a language other than English. First, HHS must provide National Health Service Corps (NHSC) loan repayments to mental health care providers who agree to serve their period of obligated service in an FQHC. Additionally, HHS must provide enhanced payments to those who serve in an FQHC with non-English language needs. (The NHSC is a scholarship and student loan repayment program for eligible health care providers who agree to work in areas with a shortage of primary care, dental care, and mental health care providers.) Second, HHS must award grants to FQHCs for recruiting and retaining mental health care providers who are fluent in a language other than English.

Net Neutrality and Broadband Justice Act of 2022 This bill expressly classifies broadband internet as a telecommunications service rather than an information service for purposes of regulation by the Federal Communications Commission. (Current law treats providers of telecommunications services as common carriers and subjects them to more stringent requirements.)

Clean Energy Jobs Act of 2022 This bill directs the Department of Energy, in consultation with the Department of Labor and the Department of Education, to establish a comprehensive nationwide program to improve education and workforce development for jobs in energy-related industries, with emphasis on increasing the number of skilled individuals from underrepresented groups trained to work in those jobs.

Tribal Nutrition Improvement Act of 2022 This bill expands access to free and reduced school meals in tribal areas. Specifically, the bill makes a child who is an enrolled member (or who has one or more parents who are enrolled members) of an Indian tribe categorically eligible for free school breakfasts or lunches. Additionally, the bill allows the Department of Agriculture (USDA) to adjust reimbursement rates for breakfasts, lunches, suppers, and supplements served in Bureau-funded schools and elementary and secondary schools on or near an Indian reservation. The bill also directs USDA to establish a pilot program to award grants to 10 tribal entities for operating and implementing the National School Lunch Program, the School Breakfast Program, the Summer Food Service Program, and the Child and Adult Care Food Program in Bureau-funded schools and elementary and secondary schools on or near an Indian reservation.

Preserving Access to Home Health Act of 2022 This bill restricts the Centers for Medicare & Medicaid Services (CMS) from decreasing payments for Medicare home health services based on certain adjustments until 2026. Current law requires the CMS to make certain permanent and temporary payment adjustments under the Medicare prospective payment system for home health services based on behavioral assumptions for 2020 through 2026. The bill restricts the CMS from making adjustments that decrease payments until 2026; the CMS must also ensure that any such necessary decreases are made before 2032.

Quantum Computing Cybersecurity Preparedness Act This bill addresses the migration of executive agencies information technology systems to post-quantum cryptography. Post-quantum cryptography is encryption strong enough to resist attacks from quantum computers developed in the future. Not later than one year after the National Institutes of Standards and Technology has issued post-quantum cryptography standards, the Office of Management and Budget (OMB) shall begin to prioritize the migration of agency information technology systems to post-quantum cryptography. Not later than one year after the date of the enactment of this bill, the OMB shall submit to Congress a report on a strategy to address the risk posed by the vulnerabilities of agency information technology systems to the potential capability of a quantum computer; the funding necessary to secure such information technology systems from the threat posed by adversarial access to quantum computers; and a description of federal coordination efforts to develop standards for post-quantum cryptography, including any federal Information Processing Standards.

Right to Contraception Act This bill sets out statutory protections for an individual's right to access and a health care provider's right to provide contraception and related information. Contraception refers to an action taken to prevent pregnancy, including the use of contraceptives (i.e., a device or medication used to prevent pregnancy), fertility-awareness based methods, and sterilization procedures. Generally, the bill prohibits measures that single out and impede access to contraception and related information. However, a party may defend against a claim that a measure violates the bill's prohibitions by demonstrating, through clear and convincing evidence, that the measure significantly advances access to contraception and cannot be achieved through less restrictive means. The Department of Justice, individuals, or health care providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations.

Respect for Marriage Act This bill provides statutory authority for same-sex and interracial marriages. Specifically, the bill repeals and replaces provisions that define, for purposes of federal law, marriage as between a man and a woman and spouse as a person of the opposite sex with provisions that recognize any marriage that is valid under state law. (The Supreme Court held that the current provisions were unconstitutional in United States v. Windsor in 2013.) The bill also repeals and replaces provisions that do not require states to recognize same-sex marriages from other states with provisions that prohibit the denial of full faith and credit or any right or claim relating to out-of-state marriages on the basis of sex, gender, race, ethnicity, or national origin. (The Supreme Court held that state laws barring same-sex marriages were unconstitutional in Obergefell v. Hodges in 2015; the Court held that state laws barring interracial marriages were unconstitutional in Loving v. Virginia in 1967.) The bill allows the Department of Justice to bring a civil action and establishes a private right of action for violations.

Supporting Mental Assistance Responder Teams Community Policing Act or the SMART Community Policing Act This bill expands the Community Oriented Policing Services (COPS) program to specifically allow funds to be used for mobile crisis teams, behavioral health personnel, and case management or outreach teams to help deescalate situations between law enforcement and individuals experiencing a mental health crisis.

Freedom to Travel for Health Care Act of 2022 This bill prohibits anyone from interfering with a person's ability to access out-of-state reproductive health care. (Reproductive health care is defined as medical, surgical, counseling, or referral services related to pregnancy, the termination of a pregnancy, contraception services, and other reproductive care.) Specifically, the bill prohibits anyone from restricting, discriminating against, or otherwise disadvantaging anyone who receives, provides, or assists with out-of-state reproductive health care that is legal in the state in which it is provided. The bill allows the Department of Justice to bring a civil action and establishes a private right of action for violations. The bill specifically waives any applicable governmental immunity and preempts any contravening state laws.

Tribal Cultural Areas Protection Act This bill provides for the preservation of tribal cultural sites on public land, including by establishing the Tribal Cultural Areas System, setting forth requirements related to land management, and authorizing certain actions by tribes.

Advancing Tribal Parity on Public Land Act This bill addresses tribal interests in the disposal and management of public land. Specifically, the bill prohibits the federal government from disposing of public land or National Forest System land unless the Department of the Interior or the Department of Agriculture (USDA) determines, through consultation with any interested Indian tribe, that such disposal would not impact the rights and interests of any interested tribe and would not impair access to a reservation. Interested Indian tribe means an Indian tribe with (1) historic, precontact, cultural, or religious connection to a cultural site located on the tract of public land; (2) a former reservation located on the tract of public land; or (3) treaty rights or other reserved rights associated with the tract of public land. Interior and USDA must, prior to conducting a sale of a tract of public land, notify all tribes of the availability of land for sale. Further, Interior and USDA must sell the tract of land to an interested Indian tribe that submits a bid at fair market value. Land acquired by an interested tribe shall be taken into trust by Interior for the benefit of the tribe. Additionally, the bill revises various public land provisions, including to (1) add the interests of tribes to the list of considerations for land exchanges, and (2) authorize tribes to acquire land for recreational and other public purposes. The bill also requires each public land advisory board to include at least one representative of an interested Indian tribe.

Clean Competition Act This bill creates a carbon border adjustment mechanism to lower greenhouse gas emissions in high-polluting sectors. This mechanism imposes charges on imports from carbon-intensive (e.g., fossil fuels, refined petroleum products, petrochemicals) manufacturers, encourages decarbonization efforts, and funds future research, development, and deployment efforts to achieve a net-zero carbon future. The bill requires annual calculations of carbon intensity, imposes a carbon intensity charge on imports into the United States beginning after 2023, and allows for rebates for overpayments of charges. The bill also establishes a grant program in FY2025 and subsequent fiscal years for investments in new technology to reduce carbon intensity in existing facilities and ensure best-in-class carbon intensity for proposed facilities.

Fire Suppression Improvement Act This bill sets the federal cost share of fire management assistance at 75% of the eligible cost of such assistance and permits a state or local government to use such assistance for the predeployment of assets and resources. The Federal Emergency Management Agency (FEMA) must complete a rulemaking to provide criteria for the circumstances under which it may recommend that the President increase the federal cost share.

Post-Fire Flooding and Debris Flow Act of 2022 This bill makes changes to eligibility under the hazard mitigation grant program of the Federal Emergency Management Agency (FEMA) to include mitigating and preventing post-wildfire flooding and debris flow. Specifically, the bill requires the federal share of hazard mitigation assistance for mitigating and preventing post-wildfire flooding and debris flow to be not less than 75% of the cost (currently, the President may contribute up to 75% of the cost).

Affordability is Access Act This bill establishes several requirements relating to health insurance coverage of, and access to, over-the-counter contraceptives. Specifically, the bill requires the Department of Health and Human Services, the Department of Labor, and the Department of the Treasury to specify that private health insurance plans must cover over-the-counter contraceptives that are approved by the Food and Drug Administration (FDA), even without a prescription. Under current law, private health insurance plans (with some exceptions) must cover FDA-approved prescription contraceptives, without cost-sharing requirements. The bill also prohibits retailers from interfering with an individual's access to oral contraceptives that are meant for routine, daily use and are FDA-approved for use without a prescription.

Lifting Immigrant Families Through Benefits Access Restoration Act of 2022 or the LIFT the BAR Act of 2022 This bill repeals certain limits on the eligibility of noncitizens who lawfully reside in the United States for federal means-tested programs, including Medicaid, the Children's Health Insurance Program (CHIP), programs funded through Temporary Assistance for Needy Families (TANF) grants, Supplemental Security Income (SSI), and certain nutrition and housing programs.

Elimination of the VA Asset and Infrastructure Review (AIR) Commission Act of 2022 This bill repeals the VA Asset and Infrastructure Review Act of 2018, which established the independent Asset and Infrastructure Review Commission and prescribes directives related to the development and assessment of recommendations for modernizing or realigning Veterans Health Administration facilities.

National Wildland Fire Risk Reduction Program Act of 2022 This bill directs the President to establish a National Wildland Fire Risk Reduction Program to achieve major measurable reductions in the losses of life, property, and natural resources from wildland fires. This program shall coordinate federal efforts to improve the assessment of fire environments and the understanding and prediction of wildland fires, associated smoke, and their impacts; develop and encourage the adoption of science-based and cost-effective measures to enhance community resilience to wildland fires, to prevent and mitigate wildland fire and associated smoke impacts and to restore natural fire regimes in fire-dependent ecosystems; and improve the understanding and mitigation of the impacts of climate change, drought, and climate variability on wildland fire risk, frequency, and severity and inform the other goals described here. Not later than 90 days after enactment of this bill, the National Institute of Standards and Technology (NIST) shall establish an Interagency Coordinating Committee on Wildland Fire Risk Reduction to oversee the planning, management, and coordination of the program. The committee shall submit a strategic plan for the program to Congress. The Government Accountability Office shall submit a report to Congress on the progress and performance of the program. Further, the bill sets forth the responsibilities of NIST, the National Science Foundation, the National Oceanic and Atmospheric Administration, the Federal Emergency Management Agency, the National Aeronautics and Space Administration, the Environmental Protection Agency, and the Department of Energy with respect to the program.

Access to Baby Formula Act of 2022 This bill authorizes the Department of Agriculture (USDA) to take certain actions to address emergencies, disasters, and supply chain disruptions (particularly the shortage of infant formula in the United States) affecting participants of the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC). For example, the bill directs USDA to require each infant formula cost containment contract to include remedies in the event of an infant formula recall, including how an infant formula manufacturer would protect against disruption to WIC participants in the state.

Water Data Act This bill requires federal departments and agencies involved in water resources management to jointly develop and implement a National Water Data Framework and establish an interagency council, advisory committee, and grant program. This bill also requires the Department of the Interior to develop and implement an integrated water resources management plan (i.e., the Basin Plan) for the Rio Grande Basin and reauthorizes an irrigation infrastructure grant program for Rio Grande Pueblos tribes.

Medicare for All Act of 2022 This bill establishes a national health insurance program that is administered by the Department of Health and Human Services (HHS). Among other requirements, the program must (1) cover all U.S. residents; (2) provide for automatic enrollment of individuals upon birth or residency in the United States; and (3) cover items and services that are medically necessary or appropriate to maintain health or to diagnose, treat, or rehabilitate a health condition, including hospital services, prescription drugs, mental health and substance abuse treatment, dental and vision services, and home- and community-based long-term care. The bill prohibits cost-sharing (e.g., deductibles, coinsurance, and copayments) and other charges for covered services, with the exception of prescription drugs. Additionally, private health insurers and employers may only offer coverage that is supplemental to, and not duplicative of, benefits provided under the program. Health insurance exchanges and specified federal health programs terminate upon program implementation. However, the program does not affect coverage provided through the Department of Veterans Affairs, TRICARE, or the Indian Health Service. Additionally, state Medicaid programs must cover certain institutional long-term care services. The bill also establishes a series of implementing provisions relating to (1) health care provider participation; (2) HHS administration; and (3) payments and costs, including the requirement that HHS negotiate prices for prescription drugs and establish a formulary. Individuals who are age 18 or younger may enroll in the program starting one year after enactment of this bill; other individuals may buy into a transitional plan or an expanded Medicare program at this time, depending on age. The bill's program must be fully implemented four years after enactment.

Ysleta del Sur Pueblo and Alabama-Coushatta Tribes of Texas Equal and Fair Opportunity Act This bill allows the Ysleta del Sur Pueblo and Alabama-Coushatta tribes to conduct gaming activities on their land in Texas if certain conditions are met. Currently, the Ysleta del Sur Pueblo and Alabama-Coushatta Indian Tribes of Texas Restoration Act prohibits the tribes from conducting gaming activities on their land if those activities are prohibited by Texas law. The bill instead prohibits the act from precluding or limiting the applicability of the Indian Gaming Regulatory Act (IGRA). Therefore, the bill effectively makes IGRA the controlling federal statute governing gaming activities on the tribes' land.

Hermit's Peak Fire Assistance Act This bill provides for monetary compensation to the victims of the prescribed fire burn in the Santa Fe National Forest in New Mexico that became a wildfire known as the Hermit's Peak Fire or the Hermit's Peak Fire/Calf Canyon Fire. Each victim of the Hermit's Peak Fire shall be entitled to receive monetary compensation from the United States, including for personal injury, loss of property, business loss, or financial loss. An Office of Hermit's Peak Fire Claims is established within the Federal Emergency Management Agency (FEMA) to receive, process, and pay claims to victims of the fire. FEMA or the independent claims manager (which FEMA may appoint) shall, on behalf of the United States, investigate, consider, ascertain, adjust, determine, grant, deny, or settle any claim for money damages asserted by a victim of the Hermit's Peak Fire. Any claimant aggrieved by a final decision of FEMA concerning compensation may, not later than 60 days after the date on which the decision is issued, bring a civil action in the U.S. District Court for the District of New Mexico, to modify or set aside the decision.

Workplace Violence Prevention for Health Care and Social Service Workers Act This bill requires the Department of Labor to address workplace violence in health care, social service, and other sectors. Specifically, Labor must issue an interim occupational safety and health standard that requires certain employers to take actions to protect workers and other personnel from workplace violence. The standard applies to employers in the health care sector, in the social service sector, and in sectors that conduct activities similar to those in the health care and social service sectors. In addition, Labor must promulgate a final standard within a specified time line.

CDFI Crisis Fund Act This bill establishes the CDFI National Crisis Fund. The fund is authorized to make grants to community development financial institutions (CDFIs) providing financial products as emergency assistance to small businesses and low-income populations in certain circumstances. Furthermore, the fund is triggered by certain emergency declarations, including the COVID-19 emergency period; certain disaster declarations; a specified increase in a statewide unemployment rate; or a specified increase in the nationwide unemployment rate. Specified amounts in the fund are set aside for grants to Native and minority CDFIs. The Government Accountability Office must report on the impact of the fund and provide recommendations.

This resolution expresses that the Senate has heard of the death of the Honorable Orrin G. Hatch, former U.S. Senator for the state of Utah. The resolution also expresses that the Senate honors the life and legacy of the late Senator Hatch for his unwavering dedication to Utah as a Senator and a public servant and accomplishments in legislating with principle and dedication for the good of the people of the United States. The resolution states when the Senate adjourns today, it stands adjourned as a further mark of respect to the memory of Senator Hatch.
