Therapeutic Fraud Prevention Act of 20 21 This bill prohibits commercial conversion therapy, which is a practice or treatment designed to change a person's sexual orientation or gender identity or otherwise change behaviors, thoughts, or expressions related to gender or sexual attraction. This prohibition does not apply to treatment that assists an individual undergoing a gender transition or facilitates identity exploration and development.

Championing Apprenticeships for New Careers and Employees in Technology Act or the CHANCE in TECH Act This bill requires the Department of Labor to enter into contracts with industry intermediaries to promote the development of and access to apprenticeships in the technology sector. The Department of Education (ED) may issue CHANCE in TECH Awards for 21st Century Schools to secondary schools or junior or community colleges that demonstrate high achievement in providing students necessary skills to compete in the 21st century workforce. In making an award, ED must consider the availability of science, technology, engineering, and mathematics (STEM), career and technical education, and computer technology courses at the schools.

Charitable Conservation Easement Program Integrity Act of 2021 This bill imposes a limitation on the tax deduction for qualified conservation contributions made by certain partnerships if the amount of the contribution exceeds 2.5% times the sum of each partner's relevant basis in the partnership. This limitation also applies to other pass-thru entities, such as S corporations.

Better Care Better Jobs Act This bill establishes programs and provides funds for state Medicaid programs to improve home- and community-based services (HCBS), such as home health care, personal care, case management, and rehabilitative services. Specifically, the bill provides funds for the Centers for Medicare & Medicaid Services to award planning grants, develop quality measures, and provide technical assistance to states regarding specified HCBS improvements, particularly with respect to access, utilization, and the associated workforce. The bill also increases the Federal Medical Assistance Percentage (i.e., federal matching rate) for HCBS in states that develop plans and meet specified benchmarks for improvements. The bill also makes permanent (1) the Money Follows the Person Rebalancing Demonstration Program (a grant program to help states increase the use of HCBS for long-term care and decrease the use of institutional care), and (2) certain provisions regarding Medicaid eligibility that protect against spousal impoverishment for recipients of HCBS.

Advancing the Clean Hydrogen Future Act of 2021 This bill requires the Department of Energy (DOE) to establish a research, development, demonstration, and deployment program to improve the efficiency, increase the durability, and reduce the cost of producing hydrogen using electrolyzers. Electrolyzers are systems that produce hydrogen using electrolysis, a process that uses electricity to split water into hydrogen and oxygen. The goal of the program is to reduce the cost of hydrogen produced using electrolyzers to less than $2 per kilogram of hydrogen by 2026. In carrying out the program, DOE must award grants for projects that DOE determines would provide the greatest progress toward achieving the goal. In addition, DOE must fund demonstration projects under the program to (1) demonstrate technologies that produce hydrogen using electrolysis; and (2) validate information on the cost, efficiency, durability, and feasibility of commercial deployment of those technologies.

Oil and Gas Bonding Reform and Orphaned Well Remediation Act This bill establishes incentives and requirements to clean up orphaned oil and gas wells, including by (1) establishing a program to remediate, reclaim, and permanently plug such wells located on federal land, state land, or land under the jurisdiction of Indian tribes; and (2) revising bonding requirements for oil and gas development on public land leased from the federal government. Such bonds are required to ensure developers have adequate financial resources to remediate and reclaim public land, water, or other resources after wells are abandoned or oil and gas development ceases.

Reinvesting In Shoreline Economies and Ecosystems Act of 2021 or the RISEE Act of 2021 This bill increases the percentage of revenue generated from offshore energy projects that is shared with adjacent coastal states. For example, the bill dedicates a percentage of the revenue generated from offshore wind leases for coastal states. Currently, this revenue is deposited in the U.S. Treasury. In addition, the bill increases the amount of revenue generated from offshore oil and gas leases that is shared with states under the Gulf of Mexico Energy Security Act. Coastal states must use the funding from the revenue for specified purposes, such as coastal restoration, conservation, or infrastructure.

Native American Rural Homeownership Improvement Act of 2021 This bill provides statutory authority for a Department of Agriculture pilot program that provides direct loans to Native community development financial institutions to increase homeownership opportunities for tribal communities in rural areas.

Pell Grant Preservation and Expansion Act of 2021 This bill makes various changes to the Federal Pell Grant program, including by expanding student eligibility for Pell Grants. The bill also revises student eligibility for federal student-aid programs. Specifically, the bill provides funding to increase the maximum Pell Grant award for each eligible student. Further, the bill requires the award amount to be adjusted for inflation. Next, the bill allows students who receive means-tested federal benefits (e.g., Medicaid) to automatically qualify for the maximum Pell Grant award plus an additional award amount. In addition, the bill moves the Iraq and Afghanistan Service Grant program into the Pell Grant program. Next, the bill raises from 12 to 18 the total number of semesters during which a student may receive a Pell Grant. The bill makes Dreamer students (i.e., students who have been granted Deferred Action for Childhood Arrivals status) who entered the United States before the age of 18 and who meet certain educational criteria eligible for federal financial aid. The bill also revises satisfactory academic progress requirements for federal student-aid programs, including by allowing a student who has not been enrolled in an institution of higher education for two years to regain eligibility for federal student aid.

Restaurant Revitalization Fund Replenishment Act of 2021 This bill provides an additional $60 billion in FY2021 for the Restaurant Revitalization Fund, which was established to support restaurants and other food and beverage purveyors in response to COVID-19.

Save Our Future Act This bill imposes a fee on certain fossil fuels, including coal, petroleum products, and natural gas. It also imposes fees on fluorinated greenhouse gases imported into the United States and on facilities that emit greenhouse gases from processes other than fossil fuel combustion. The bill provides rebates to middle- and low-income taxpayers equal to $800 ($1,600 for joint returns), plus $300 times the number of taxpayer dependents. The bill directs the Department of the Treasury to provide cost mitigation grants to states and Indian tribes to assist with the transition to a low-carbon economy, assist rural households in reducing energy expenses, and for assistance to displaced coal industry workers. The bill creates an Office of Energy Veterans Assistance. It also provides funds through FY2032 for community assistance programs, including the Appalachian Regional Commission Revitalization Initiative and the Coal Communities Assistance Initiative. The bill provides funds for each fiscal year after FY2022 for assistance to environmental justice communities (i.e., communities most impacted by environmental harms and risks).

Telemental Health Care Access Act of 2021 This bill eliminates certain restrictions relating to Medicare coverage of mental health services that are provided through telehealth. Current law allows for coverage of such services regardless of the geographic location of the originating site (i.e., the location of the beneficiary) after the end of the COVID-19 public health emergency, as long as the beneficiary previously received in-person services and continues to receive in-person services at specified intervals. The bill eliminates these in-person requirements.

Meat Packing Special Investigator Act This bill establishes within the Department of Agriculture's Packers and Stockyards Division the Office of the Special Investigator for Competition Matters. Specifically, the office must use all available tools (e.g., subpoenas) to investigate and prosecute violations of the Packers and Stockyards Act of 1921 by packers. Further, the bill grants the office the authority to bring any civil or administrative action authorized by that act against a packer. Additionally, the office must serve as a liaison to the Department of Justice and the Federal Trade Commission with respect to competition and trade practices in the food and agricultural sector, consult with the Department of Homeland Security on national security and critical infrastructure security in the food and agricultural sector, and maintain a staff of attorneys and other professionals with appropriate expertise.

Ski Hill Resources for Economic Development Act of 2021 This bill establishes the Ski Area Fee Retention Account. A specified portion of rental charges for ski area permits on a Forest Service unit shall be deposited in such account. Amounts in the fund shall be available to the unit for expenditure without further appropriation for ski area administration, improvements, visitor services, and wildfire preparedness. Funds may be reallocated only if the amounts collected exceed the reasonable needs of the unit.

Women's Health Protection Act of 2021 This bill prohibits governmental restrictions on the provision of, and access to, abortion services. Specifically, governments may not limit a provider's ability to prescribe certain drugs, offer abortion services via telemedicine, or immediately provide abortion services when the provider determines a delay risks the patient's health. Furthermore, governments may not require a provider to perform unnecessary medical procedures, provide medically inaccurate information, comply with credentialing or other conditions that do not apply to providers whose services are medically comparable to abortions, or carry out all services connected to an abortion. In addition, governments may not (1) require patients to make medically unnecessary in-person visits before receiving abortion services or disclose their reasons for obtaining such services, or (2) prohibit abortion services before fetal viability or after fetal viability when a provider determines the pregnancy risks the patient's life or health. The bill also prohibits other governmental measures that are similar to the bill's specified restrictions or that otherwise single out and impede access to abortion services, unless a government demonstrates that the measure significantly advances the safety of abortion services or health of patients and cannot be achieved through less restrictive means. The Department of Justice, individuals, or providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations. The bill applies to restrictions imposed both prior and subsequent to the bill's enactment.

National Heritage Area Act This bill requires a standard for the designation of National Heritage Areas. The bill establishes a National Heritage Area System through which the Department of the Interior may furnish technical and financial assistance to local coordinating entities to support the establishment, development, and continuity of the National Heritage Areas. Such system shall be composed of each existing National Heritage Area, National Heritage Corridor, National Heritage Canalway, Cultural Heritage Corridor, and National Heritage Partnership designated by Congress; and each National Heritage Area designated by Congress after enactment of this bill, unless the law designating the area exempts that area from the system by specific reference to this bill. Under the system, Interior shall review and approve management plans for heritage areas, and submit to Congress reports on the activities conducted with respect to such areas. Interior may carry out or review a study that assesses the suitability and feasibility of each proposed heritage area. Interior must review and certify whether a study conducted by others determines an area meets specified requirements, including that it has natural, historic, and cultural resources that represent distinctive aspects of the heritage of the United States. The bill declares that a heritage area shall be designated only by an act of Congress. Management plans must be developed for heritage areas designated under this bill.

Increasing Access to Osteoporosis Testing for Medicare Beneficiaries Act of 2021 This bill specifies that certain Medicare payment rules applicable to imaging services shall apply to dual-energy x-ray absorptiometry services used in bone mass scans beginning in 2022. The bill also establishes national minimum payment amounts for such services.

Medicare Multi-Cancer Early Detection Screening Coverage Act of 2021 This bill provides for Medicare coverage and payment for multi-cancer early detection screening tests that are approved by the Food and Drug Administration and that are used to screen for cancer across many cancer types. The Government Accountability Office must report on the resulting utilization and effectiveness of such tests.

This bill authorizes the Department of the Interior to take land into trust for all federally recognized Indian tribes. Specifically, the bill applies the Indian Reorganization Act to all federally recognized Indian tribes, regardless of when a tribe became recognized. The amendments made by this bill are retroactively effective as if included in the Indian Reorganization Act. This effectively overrules the Supreme Court's decision in Carcieri v. Salazar, which held that Interior could not take land into trust for a specified tribe because that tribe had not been under federal jurisdiction when the Indian Reorganization Act was enacted in 1934.

John Lewis Every Child Deserves a Family Act This bill prohibits discrimination on the basis of sexual orientation, gender identity, marital status, or religion in the provision of child welfare programs and services by entities receiving federal funding. The Department of Health and Human Services (HHS) must provide technical assistance to help states follow this requirement, including (1) guidance for bringing state laws into compliance, (2) developing training to increase cultural competency related to social identity, and (3) training for judges and attorneys involved in child welfare cases, among other supports. Additionally, HHS must establish the National Resource Center on Safety, Well-Being, Placement Stability, and Permanency for LGBTQ Children and Youth Involved with Child Welfare Services to provide training, technical assistance, and guidance to applicable state and local agencies and service providers. Further, the Religious Freedom Restoration Act may not be the basis for challenging the application or enforcement of this bill. The Government Accountability Office must study and report on states' compliance with the requirements of the bill no later than three years after enactment.

Rights for the Transportation Security Administration Workforce Act of 2021 or the Rights for the TSA Workforce Act of 2021 This bill modifies the workplace rights, protections, and benefits applicable to Transportation Security Administration (TSA) personnel. Specifically, the bill within 180 days, eliminates personnel authorities of the Department of Homeland Security (DHS) and the Department of Transportation governing the conditions of employment for TSA employees, thus making TSA employees subject to the personnel management system applicable to other federal employees; sets forth transition rules that protect the pay rates, leave rights, and other rights of TSA and Federal Air Marshal Service employees; and requires DHS to consult with the labor organization certified by the Federal Labor Relations Authority to carry out the conversion of such positions. The bill also directs the TSA to implement in-person or remote mental health programs at each field office of the Federal Air Marshal Service and consult with labor associations to address concerns regarding federal air marshals, including mental health and suicide rates; requires DHS to prioritize the hiring of veterans, including disabled veterans; and directs the TSA to ensure its employees are provided proper guidance regarding prevention and protections against the coronavirus.

Helping American Victims Afflicted by Neurological Attacks Act of 2021 or the HAVANA Act of 2021 This bill specifically authorizes the Central Intelligence Agency, the Department of State, and other agencies to provide payments to agency personnel who incur brain injuries from hostilities while on assignment. Specifically, the bill allows agency personnel and their families to receive payments for brain injuries that are incurred (1) during a period of assignment to a foreign or domestic duty station; (2) in connection with war, insurgency, hostile acts, terrorist activity, or other agency-designated incidents; and (3) not as the result of willful misconduct. The bill's authority applies to injuries incurred before, on, or after the date of the bill's enactment. Agencies must submit classified reports on the bill's implementation, including the number of payments made and the amount of each payment. Since 2016, some intelligence, diplomatic, and other governmental personnel have reported experiencing unusual cognitive and neurological impairments while on assignment (particularly abroad), the source of which is currently under investigation. Symptoms were first reported by personnel stationed in Cuba and have since been collectively referred to as Havana Syndrome .

Accelerating Access to Critical Therapies for ALS Act This bill establishes grant programs to address neurodegenerative diseases, such as amyotrophic lateral sclerosis (also known as ALS or Lou Gehrig's disease), and contains other related provisions. The Department of Health and Human Services (HHS) shall award grants to eligible entities to facilitate patients' access to investigational drugs that diagnose or treat ALS. The Food and Drug Administration (FDA) shall award grants to public and private entities to cover the costs of research and development of drugs that diagnose or treat ALS and other severely debilitating neurodegenerative diseases. HHS shall also establish the Public-Private Partnership for Neurodegenerative Diseases between the National Institutes of Health, the FDA, and at least one eligible entity (generally, an institution of higher education or a nonprofit organization). The partnership shall support the development and regulatory review of drugs that address ALS and other rare neurodegenerative diseases. The FDA shall publish on its website a five-year action plan for fostering the development of drugs that improve or extend the lives of people living with rare neurodegenerative diseases.

Pursuing Equity in Mental Health Act This bill establishes and expands programs to address racial and ethnic disparities in mental health. Specifically, the Department of Health and Human Services (HHS) must award grants to establish interprofessional behavioral health care teams in areas with a high proportion of racial and ethnic minority groups. In addition, HHS may award grants to incorporate best practices and competencies to address mental health disparities in curricula for training social workers, psychologists, and other behavioral health professionals. HHS must also promote behavioral and mental health and reduce stigma associated with mental health conditions and substance use disorder through outreach to racial and ethnic minority groups. HHS must consult with appropriate advocacy groups and behavioral health organizations to develop a strategy for this outreach. The bill also (1) reauthorizes the minority fellowship program to support the education of mental health professionals who provide services to racial and ethnic minorities, and (2) requires studies on mental health disparities and the effects of social media use on adolescents.

Artificial Intelligence for the Military Act of 2021 This bill requires the implementation of training and education related to emerging technologies and artificial intelligence for certain military personnel. The bill requires expansion of the curriculum for military junior leader education to incorporate training material related to focuses that include problem definition and curation and a conceptual understanding of the artificial intelligence life cycle. Such training and education should include the use of existing artificial intelligence-enabled systems and tools. The Department of Defense (DOD) must ensure that the curriculum for professional military education is revised in each of the military services to incorporate periodic courses on militarily significant emerging technologies. DOD must establish a short course on emerging technologies for general and flag officers and senior executive-level civilian leaders. The course must be taught on an iterative, two-year cycle and address the most recent and relevant technologies and the application of these technologies to military and business outcomes in DOD. DOD must ensure that the military services code appropriate billets to be filled by emerging technology-qualified officers and develop a process for qualification of officers in emerging technologies. The process for qualifying officers for emerging technology-coded billets must be modeled on a streamlined version of the joint qualification process and may include credit for serving in emerging technology-focused (1) fellowships, (2) talent exchanges, (3) government positions, and (4) education courses.

Schools and State Budgets Certainty Act of 2021 This bill modifies how states, counties, and Indian tribes are paid for mineral extraction on their land. The Department of the Interior shall pay to eligible states, counties, and Indian tribes an energy transition payment as calculated in accordance with this bill. An energy transition payment received by a state or county pursuant to the Gulf of Mexico Energy Security Act of 2006 must be used for certain authorized uses, such as coastal protection and mitigation of damage to wildlife.

Midwives for Maximizing Optimal Maternity Services Act of 2021 or the Midwives for MOMS Act of 2021 This bill establishes grants within the Health Resources and Services Administration (HRSA) for establishing or expanding midwifery programs at institutions of higher education and nursing schools. HRSA may prioritize funding for institutions that focus on increasing the number of midwife professionals from underrepresented groups and that promote practicing in areas with limited access to professional health care.

Artificial Intelligence Capabilities and Transparency Act of 2021 or the AICT Act of 2021 This bill addresses artificial intelligence capabilities related to national defense and security. The bill requires the Department of Defense (DOD) to designate a chief digital recruiting officer within the Office of the Under Secretary of Defense for Personnel and Readiness to oversee a digital recruiting office. The office must be responsible for (1) identifying DOD needs for specific types of digital talent, (2) recruiting technologists, (3) integrating federal scholarship for service programs into DOD civilian recruiting, and (4) partnering with human resource teams in the military services and DOD components to use direct-hire authorities to accelerate hiring. The Office of the Director of National Intelligence and the Department of Energy must also designate chief digital recruiting officers to be responsible for the same objectives in those departments. DOD must carry out a pilot program to assess the feasibility and advisability of establishing the Artificial Intelligence Development and Prototyping Fund. DOD must plan for the development of a modern digital ecosystem to enable development, testing, fielding, and continuous update of artificial intelligence-powered applications at speed and scale from headquarters to the tactical edge. The National Institute of Standards and Technology within the Department of Commerce must establish a program to provide accreditation to organizations that are determined to be competent at evaluating the specified effects of artificial intelligence systems used by persons in DOD, an element of the intelligence community, or the Federal Bureau of Investigation.

Delivering Envelopes Judiciously On-time Year-round Act or the DEJOY Act This bill requires the U.S. Postal Service (USPS) to maintain the service standards for first-class mail that were in effect on January 1, 2021. The Postmaster General proposed in March 2021 a 10-year restructuring plan for the USPS that would lengthen the permissible mail-delivery window.

Health Equity and Access under the Law for Immigrant Women and Families Act of 2021 or the HEAL Immigrant Women and Families Act of 20 21 This bill extends Medicaid and Children's Health Insurance Program coverage to individuals lawfully present in the United States who otherwise meet eligibility requirements. Individuals granted federally authorized presence also are required to maintain minimum essential health insurance coverage and are eligible for health insurance exchanges, reduced cost sharing, premium subsidies, and premium tax credits.

Dynamic Glass Act This bill includes electrochromic glass as energy property for purposes of the 30% energy tax credit. The bill defines electrochromic glass as glass that uses electricity to change its light transmittance properties to heat or cool a structure, but only with respect to property whose construction begins before January 1, 2024.

Greatest Generation Memorial Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in commemoration of the National World War II Memorial in the District of Columbia. The design of the coins shall be emblematic of the memorial and the service and sacrifice of American soldiers and civilians during World War II. All surcharges received from the sale of such coins shall be paid to the Friends of the National World War II Memorial to support the National Park Service in maintaining and repairing the memorial, and for educational and commemorative programs.

Universal School Meals Program Act of 2021 This bill revises requirements under the food and nutrition programs of the Department of Agriculture, such as the school lunch and breakfast programs. For example, the bill permanently provides free meals to all school children regardless of income. The bill increases the reimbursement rate for school food authorities participating in the food and nutrition programs. The bill also prohibits school food authorities from (1) physically segregating or otherwise discriminating against any child participating in the free breakfast program, or (2) overtly identifying a child participating in the program with a special token or announcement. Additionally, the bill expands the summer food service program by making all children eligible for participation in the program. Further, the bill revises eligibility determinations for measuring poverty to include runaway or homeless youth, foster children, migratory children, and children participating in specified programs (e.g., Head Start).

America's Red Rock Wilderness Act This bill designates specified lands in the following areas of Utah as components of the National Wilderness Preservation System: (1) Great Basin, (2) Grand Staircase-Escalante, (3) Moab-La Sal Canyons, (4) Henry Mountains, (5) Glen Canyon, (6) San Juan-Anasazi, (7) Canyonlands Basin, (8) San Rafael Swell, and (9) Book Cliffs and Uinta Basin. The bill sets forth administrative requirements for (1) the exchange of state-owned lands within such areas, (2) federal reservation of water rights, (3) measurement of setbacks for roads with adjacent wilderness, (4) authorized livestock grazing, and (5) withdrawal of such lands from disposition under certain public land laws.

Military Justice Improvement and Increasing Prevention Act of 2021 This bill modifies the process and policy related to the disposition of charges and convening of courts-martial for certain sexual assault cases and other specified offenses under the Uniform Code of Military Justice (UCMJ). Among other elements, the bill provides that the determinations on the preferral, disposition, and referral of charges for specified offenses under the UCMJ must be made by a commissioned officer of the Armed Forces who is designated as a court-martial convening authority (in grade O-6 or higher) and who is available for detail as trial counsel, has significant trial experience, and is outside the chain of command of the member subject to the charges.
