Clean Air, Healthy Kids Act This bill reinstates a variety of rules regarding climate change that were repealed, suspended, delayed, withdrawn, or replaced and prohibits the implementation of certain policies and proposed rules. Specifically, the bill nullifies Executive Order 13783 titled Promoting Energy Independence and Economic Growth . In addition, the bill nullifies the following rules: the Repeal of the Clean Power Plan; Emission Guidelines for Greenhouse Gas Emissions From Existing Electric Utility Generating Units; Revisions to Emission Guidelines Implementing Regulations rule issued by the Environmental Protection Agency (EPA); the Waste Prevention, Production Subject to Royalties, and Resource Conservation; Delay and Suspension of Certain Requirements rule issued by the Bureau of Land Management; the Energy Conservation Program: Definition for General Service Lamps rule issued by the Department of Energy (DOE); and the Adopting Requirements in Emission Guidelines for Municipal Solid Waste Landfills rule issued by the EPA. The bill prohibits agencies from finalizing the following proposed rules: the Oil and Natural Gas Sector: Emission Standards for New, Reconstructed, and Modified Sources Review proposed rule issued by the EPA; the Safer Affordable Fuel-Efficient (SAFE) Vehicle Rules for Model Years 2021-2026 Passenger Cars and Light Trucks proposed rule issued by the EPA and the National Highway Traffic Safety Administration; and the Energy Conservation Program: Energy Conservation Standards for General Service Incandescent Lamps proposed determination issued by DOE. Finally, the bill nullifies a rescission of a waiver granted to California to enforce standards, which are more stringent than federal standards, for air pollution emissions from vehicles.

(An alien who is a public charge may be denied certain immigration benefits, such as lawful permanent residence. Currently, a public charge is generally interpreted as an individual who is primarily dependent on the government for subsistence. The DHS rule would define a public charge to mean an individual who receives more than 12 months' worth of designated public benefits in a 36-month period.)

Degrees Not Debt Act of 2019 This bill sets forth provisions to increase the availability of need-based federal student aid and require an institution of higher education (IHE) to disclose performance indicators. The bill repeals the alternative minimum tax exemption and the increased estate and gift tax exemption and uses the tax revenue to increase need-based federal student aid. Specifically, the bill increases (1) the maximum amount of the federal Pell Grant, and (2) the income threshold that triggers an automatic zero for an expected family contribution. In addition, the bill eliminates Pell Grant funding for an institution of higher education in a state that does not maintain its funding levels for IHEs. Finally, an IHE must disclose performance indicators (e.g., graduation rates and employment outcomes).

E-Cigarette Tax Parity Act This bill amends the Internal Revenue Code to provide for the taxation of electronic cigarettes and alternative nicotine products at rates applicable to other tobacco products. An "alternative nicotine product" is defined as any product containing nicotine which is suitable for and likely to be offered to, or purchased by, a consumer for the inhalation, ingestion, absorption, or consumption of nicotine, but does not include tobacco, processed tobacco, cigars, cigarettes, smokeless tobacco, pipe tobacco, or roll-your-own tobacco, or any product approved by the Food and Drug Administration for sale as a tobacco cessation product.

American Energy Opportunity Act of 2019 This bill establishes a process for expediting and standardizing the permitting process for certain distributed energy systems. The bill defines such systems as equipment or materials installed in, on, or near a building to support onsite or local energy use, such as solar energy, batteries, and charging systems for electrical vehicles. Specifically, the Department of Energy (DOE) must establish or designate a Distributed Energy Opportunity Board to carry out a voluntary program to (1) expedite the process for local permitting and inspection of qualifying distributed energy systems, and (2) facilitate the certification of distributed energy system installers. In addition, DOE must recognize and certify communities as Distributed Energy Opportunity Communities if they adopt and implement a permit-to-build protocol that is established by the board. DOE may award grants to encourage communities to adopt the protocol and standardized inspection processes established by the board.

(A micro-grid system means a stand-alone electrical system that uses grid-scale energy storage.) DOE must also establish a grant program to carry out projects related to the modernization of the electric grid, including the application of technologies to improve observability, advanced controls, and prediction of system performance on the distribution system.

Energy Cybersecurity Act of 2019 This bill directs the Department of Energy (DOE) to develop advanced cybersecurity applications and technologies for the energy sector. DOE shall: advance the security of field devices and third-party control systems; leverage electric grid architecture as a means to assess risks to the energy sector, including by implementing an all-hazards approach to communications infrastructure, control systems architecture, and power systems architecture; perform pilot demonstration projects with the energy sector to gain experience with new technologies; and develop workforce development curricula for energy sector-related cybersecurity. DOE may also implement within the energy sector cybertesting and cyberresilience programs that target: DOE emergency response capabilities, cooperation with the intelligence communities for energy sector-related threat collection and analysis, enhancing the tools of DOE and the Electricity Sector Information Sharing and Analysis Center (ES-ISAC) for monitoring the status of the energy sector, expanding industry participation in ES-ISAC, and technical assistance to small electric utilities to assess cybermaturity posture. DOE must develop an advanced energy security program that secures diverse energy networks in order to increase the functional preservation of the electric grid operations or natural gas and oil operations in the face of natural and human-made threats and hazards, including electric magnetic pulse and geomagnetic disturbances. DOE shall study alternative management structures and funding mechanisms to expand industry membership and participation in ES-ISAC.

Butch Lewis Act of 2019 This bill establishes the Pension Rehabilitation Administration within the Department of the Treasury and a related trust fund to make loans to certain multiemployer defined benefit pension plans. To receive a loan, a plan must be either in critical and declining status (including any plan with respect to which a suspension of benefits has been approved) or insolvent, if the plan became insolvent after December 16, 2014, and has not been terminated. Treasury must issue bonds to fund the loan program and transfer amounts equal to the proceeds to the trust fund established by this bill. The Pension Rehabilitation Administration may use the funds, without a further appropriation, to make loans, pay principal and interest on the bonds, or for administrative and operating expenses. The bill amends the Employee Retirement Income Security Act of 1974 (ERISA) to allow the sponsor of a multiemployer pension plan that is applying for a loan under this bill to also apply to the Pension Benefit Guaranty Corporation (PBGC) for financial assistance if, after receiving the loan, the plan will still become (or remain) insolvent within the 30-year period beginning on the date of the loan. The bill also appropriates to the PBGC the funds that are necessary to provide the financial assistance required by this bill.

Specifically, it removes marijuana from the list of scheduled substances under the Controlled Substances Act and eliminates criminal penalties for an individual who manufactures, distributes, or possesses marijuana. The bill also makes other changes, including the following: replaces statutory references to marijuana and marihuana with cannabis , requires the Bureau of Labor Statistics to regularly publish demographic data on cannabis business owners and employees, establishes a trust fund to support various programs and services for individuals and businesses in communities impacted by the war on drugs, imposes a 5% tax on cannabis products and requires revenues to be deposited into the trust fund, makes Small Business Administration loans and services available to entities that are cannabis-related legitimate businesses or service providers, prohibits the denial of federal public benefits to a person on the basis of certain cannabis-related conduct or convictions, prohibits the denial of benefits and protections under immigration laws on the basis of a cannabis-related event (e.g., conduct or a conviction), and establishes a process to expunge convictions and conduct sentencing review hearings related to federal cannabis offenses.

The bill requires the Department of the Interior and the Department of State to each designate a liaison to facilitate and hold trainings and workshops on the voluntary return of human remains or cultural items. Additionally, Interior must refer individuals and organizations to Indian tribes or Native Hawaiian organizations to facilitate the voluntary return of human remains or cultural items; convene an interagency working group; and convene a tribal working group consisting of representatives of Indian tribes and Native Hawaiian organizations to provide advice on issues concerning the return of, and illegal trade in, human remains or cultural items. The bill also increases from 5 years to 10 years the maximum prison term for an individual convicted of selling, purchasing, using for profit, or transporting for sale or profit human remains or cultural items that were illegally obtained.

Humanitarian Standards for Individuals in Customs and Border Protection Custody Act This bill imposes requirements and standards related to the care of aliens in U.S. Customs and Border Protection (CBP) custody. CBP shall conduct an initial health screening of each alien in custody to identify those with acute conditions and high-risk vulnerabilities and to provide appropriate health care. CBP shall conduct the screening within 12 hours of each alien's arrival at a CBP facility, and within 6 hours for certain priority individuals such as children, pregnant women, and those with disabilities. The bill imposes various requirements related to the services, personnel, and infrastructure for providing such screenings, such as providing interpreters, chaperones, and mental health treatment when necessary. CBP shall ensure detainees have access to drinking water, toilets, sanitation facilities, hygiene products, food, and shelter. The bill imposes certain standards relating to such requirements, such as the minimum amount of drinking water for each detainee and the acceptable temperature range of the shelters. The Department of Homeland Security (DHS) shall enter into memoranda of understanding with various emergency government relief agencies to address instances when surge capacity is necessary. The Inspector General of DHS shall conduct unannounced inspections of ports of entry, border patrol stations, and detention facilities and report the results to Congress. The Government Accountability Office shall assess CBP management of such facilities and whether CBP and DHS processes are in compliance with this bill's requirements.

Modernizing the Pittman-Robertson Fund for Tomorrow's Needs Act This bill revises provisions of the Pittman-Robertson Wildlife Restoration Act relating to the funding of wildlife conservation. Specifically, the bill adds new definitions, including a definition of hunter recruitment and recreational shooter recruitment ; apportions to states revenues from taxes on pistols, revolvers, bows, and arrows at a rate not greater than 3% and not less than 1% of such revenues; removes the existing prohibition on public relations to allow spending by states for management of wildlife areas and promotion of hunting and recreational shooting; allows the use of grant funds for the enhancement of hunter recruitment and recreational shooter recruitment; and expands the Multistate Conservation Grant program by providing $5 million exclusively for making hunter and recreational shooter recruitment project grants that promote a national hunting and shooting sport recruitment program, including related communication and outreach activities. The Fish and Wildlife Service shall review and evaluate the effects of funds used for hunter and recreational shooter recruitment on funds available for wildlife conservation.

The fund may accept donations and in-kind contributions. Palliative Care and Hospice Education and Training Act This bill requires the Department of Health and Human Services (HHS) to take a series of actions relating to palliative-care training. Specifically, HHS must provide support for Palliative Care and Hospice Education Centers. The centers must improve the training of health professionals in palliative care and establish traineeships for individuals preparing for advanced-education nursing degrees, social-work degrees, or advanced degrees in physician-assistant studies in palliative care. HHS may provide support to medical schools, teaching hospitals, and graduate medical-education programs for training physicians who plan to teach palliative medicine. HHS must (1) provide Palliative Medicine and Hospice Academic Career Awards to individuals to promote their career development, (2) support entities that operate a Palliative Care and Hospice Education Center, (3) support individuals in specified fields who are pursuing an advanced degree in palliative care or related fields, and (4) award grants to nursing programs to train individuals in providing palliative care. The Agency for Healthcare Research and Quality must provide for a national education and awareness campaign to inform patients, families, and health professionals about the benefits of palliative care. The National Institutes of Health must expand national research programs in palliative care.

Joint Long-Term Storage Act of 2019 This bill requires the Advanced Research Projects Agency-Energy (ARPA-E) in the Department of Energy to establish a demonstration initiative composed of demonstration projects focused on the development of long-duration energy storage technologies. The goals of the initiative include demonstrating the potential benefits of long-duration energy storage to efficient use of the electricity grid and increasing the commercial viability of long-duration energy storage technologies. As part of the initiative, ARPA-E must establish a joint program with the Department of Defense's Environmental Security Technology Certification Program office to (1) demonstrate promising long-duration energy storage technologies at different scales; and (2) help new, innovative long-duration energy storage technologies become commercially viable. The bill authorizes through FY2024 the Duration Addition to electricitY Storage program to develop energy storage systems that provide power to the electric grid for durations of 10 to approximately 100 hours.

Green Spaces, Green Vehicles Act of 2019 This bill directs the Department of Energy (DOE) and appropriate agencies to collaborate on the Green Spaces, Green Vehicles Initiative to facilitate the installation and use of zero-emissions vehicle infrastructure on National Forest System lands, National Park System lands, and specified lands owned by units of local government or Indian tribes. DOE and such agencies shall facilitate such installation and use, including by acquiring zero-emissions vehicles for the fleets of the Forest Service and the National Park Service. For purposes of determining whether the acquisition of alternative-fueled vehicles is practicable for the fleet of the Forest Service or the National Park Service, DOE shall take into account the availability on National Forest System land or National Park System land, as applicable, of zero-emissions vehicle infrastructure.

Building Indigenous STEM Professionals Act This bill expands the grant program for science, technology, engineering, and mathematics (STEM) programs that benefit Native American students. Under current law, this program only applies to programs that benefit Alaska Natives and Native Hawaiians. The bill expands grant eligibility to include programs that benefit American Indians. Additionally, the bill authorizes grants under the program for the creation of new programs for the development of Native American STEM professionals. The bill also revises how programs are prioritized for awarding grants. The bill gives priority to programs in which 70% or more of the participants are Native Americans.

Farm to School Act of 2019

Farm to School Act of 2019 This bill modifies and expands the Department of Agriculture's (USDA's) Farm to School Program. The program currently provides grants and technical assistance to schools, state and local agencies, Indian tribal organizations, agricultural producers, and nonprofit entities to improve access to local foods in schools. Among other things, the bill reauthorizes the program through FY2025; permits USDA to provide land-grant colleges and universities with grants, research, evaluation, and technical assistance under the program; expands the purposes for grants awarded under the program to include implementing educational activities relating to agriculture, nutrition, or food; requires USDA to provide technical assistance, research, and information to increase awareness of and participation in farm to school programs among agricultural producers, including beginning, veteran, and socially disadvantaged farmers; directs USDA to seek to improve local food procurement and distribution options for agricultural producers and eligible institutions; authorizes USDA to fund projects that include innovative approaches to aggregation, processing, transportation, and distribution; establishes new limitations on the amount and duration of grants; and limits funds that may be used for administrative costs.

CCM–CARE Act

Cerebral Cavernous Malformations Clinical Awareness, Research, and Education Act of 2019 or the CCM-CARE Act This bill requires the National Institutes of Health (NIH) and other agencies to expand and coordinate their efforts to research cerebral cavernous malformation. (Cerebral cavernous malformation is a condition in which blood vessels in the brain and spinal cord become enlarged, which can lead to seizures, paralysis, hearing or vision loss, and bleeding in the brain.) The NIH must (1) award grants for medical, clinical, and pharmacological research; (2) award grants to support a network of clinical research centers intended to develop a cure for the condition; and (3) convene a Cerebral Cavernous Malformations Research Consortium to develop programs for clinicians, scientists, and patients. The Centers for Disease Control and Prevention must award grants to research entities for collecting and reporting data about cerebral cavernous malformation. The Food and Drug Administration must accelerate the clinical trial process for cerebral cavernous malformation by supporting (1) appropriate laboratory indicators of the condition, (2) the qualification of clinical outcome measures related to quality of life, (3) investigational drug applications, and (4) expedited peer-review pathways.

This prohibition does not apply to treatment that assists an individual undergoing a gender transition or facilitates identity exploration and development.

Renewable Electricity Standard Act

Renewable Electricity Standard Act This bill requires retail electric suppliers to generate a significant amount of electricity from renewable energy resources. The Department of Energy must establish a program to (1) verify and issue federal renewable energy credits to generators of renewable energy; (2) track the sale, exchange, and retirement of the credits; and (3) enforce the federal renewable energy credits program. The bill prescribes rules for federal renewable energy credit trading and for borrowing and repayment of federal renewable energy credits. The bill establishes a state renewable energy account to provide grants for promoting renewable energy production and providing energy assistance and weatherization services to low-income consumers.

Public Service Freedom to Negotiate Act of 2019 This bill prohibits strikes by certain individuals and requires the issuance of rules that provide for federal minimum standard collective bargaining rights and procedures. The Federal Labor Relations Authority (FLRA) shall determine for each state whether the laws of such state substantially provide for each of the minimum standard collective bargaining rights and procedures specified by this bill, including the right of public employees and supervisory employees to self-organize, form or join a labor organization, or collectively bargain. The FLRA must issue rules and take actions to establish and administer bargaining rights and procedures for those states that do not substantially provide for them. No employers, emergency services employees, or law enforcement officers may engage in a lockout, strike, or any other organized job action that would probably result in a measurable disruption of the delivery of emergency or public safety services. Furthermore, no labor organization may be the cause of a violation of such prohibition.

Family Coverage Act

Family Coverage Act This bill amends the Internal Revenue Code to modify the requirements for determining the affordability of employer-sponsored minimum essential health coverage that is required under the Patient Protection and Affordable Care Act (PPACA). (Under current law, the coverage is unaffordable, and an employee may be eligible for premium assistance tax credits, if the employee's required contribution for an individual plan exceeds 9.5% of household income, adjusted for inflation after 2014.) The bill specifies that, with respect to an employee's family members who are eligible to enroll in the plan, affordability must be determined using the cost of family coverage rather than individual coverage to expand the eligibility of families for premium assistance tax credits. This bill also expresses the sense of Congress that the Departments of Health and Human Service and the Treasury have the administrative authority, within their respective jurisdictions, to apply the affordability provision of PPACA so as to expand access to affordable health insurance coverage for working families without further legislation.
