Incentivizing Offshore Wind Power Act This bill amends the Internal Revenue Code to: (1) allow a 30% tax credit for investment in a qualifying offshore wind facility (an offshore facility using wind to produce electricity), and (2) direct the Department of the Treasury to establish a qualifying credit for offshore wind facilities program to consider and award certifications for investments eligible for such a credit to qualifying offshore wind facility sponsors. The total amount of megawatt capacity for offshore facilities with respect to which credits may be allocated under the program may not exceed 3,000 megawatts. The bill requires Treasury to review credits allocated under this bill periodically and authorizes Treasury to make additional allocations and reallocations of such credits upon determining that: (1) the limit on the total amount of megawatt capacity for offshore facilities with respect to which credits may be allocated under the program has not been attained, or (2) scheduled placed-in-service dates of previously certified facilities have been significantly delayed and the applicant for certification will not meet the required timeline.

Community Solar Consumer Choice Act of 2017

Community Solar Consumer Choice Act of 2017 This bill requires the Department of Energy (DOE) to establish a program to expand community solar options to: (1) individuals, particularly individuals that do not have regular access to onsite solar, including low- and moderate-income individuals; (2) businesses; (3) nonprofit organizations; and (4) states and local and tribal governments. Community solar is a solar power plant, through which the benefits of the electricity produced is shared by electricity customers. In carrying out the program, DOE must: (1) provide technical assistance to states and local and tribal governments for projects to increase community solar; (2) assist such governments in the development of new and innovative financial and business models that leverage competition in the marketplace in order to serve community solar subscribers; and (3) use national laboratories to collect and disseminate data that assists private entities in the financing of, subscription to, and operation of community solar projects. The bill encourages the federal government to participate in community solar projects, including by subscribing to community solar facilities.

Harry W. Colmery Veterans Educational Assistance Act of 2017 This bill revises education and related benefits provided to veterans, service members, dependents, and survivors. The bill amends the Post-9/11 veterans' educational assistance program to: remove certain time restrictions on program use; increase assistance for reservists, guardsmen, dependents, and surviving spouses and dependents; provide full eligibility for Post-9/11 Purple Heart recipients and certain reservists and guardsmen; provide an extra academic years' worth of benefits for STEM (science, technology, engineering, or mathematics) degree candidates; establish a five-year pilot program for high technology courses; restore eligibility for service members whose school closes in the middle of a semester; authorize funding to improve claims processing; permit assistance to be used at certain institutions that are not institutions of higher education; and pro-rate the housing stipend for reservists called to active duty. The bill authorizes the Edith Nurse Rogers STEM Scholarship to help veterans complete STEM degrees. The Yellow Ribbon program is extended to Fry Scholarship recipients (surviving dependents of service members who died on active duty) and certain Purple Heart recipients. (The Yellow Ribbon program helps veterans pay for higher education tuition and fee costs not covered by the Post-9/11 program.) The bill: (1) extends the Advisory Committee on Education, (2) increases survivors' and dependents' educational assistance, and (3) extends funding for state educational program approving agencies. The bill provides statutory authority for the veterans success of campus program which provides veterans with on-campus educational and vocational counseling. The Department of Veterans Affairs shall: (1) make a new determination regarding each denied veteran's claim for disability compensation in connection with full-body exposure to mustard gas or Lewisite at specified locations during World War II, and (2) presume such exposure unless there is affirmative evidence otherwise.

Democracy Is Strengthened by Casting Light On Spending in Elections Act of 2017 or the DISCLOSE Act of 2017 This bill amends the Federal Election Campaign Act of 1971 (FECA) to ban campaign contributions and expenditures by corporations that are controlled, influenced, or owned by foreign nationals. The bill redefines the term "independent expenditure" to include an expenditure that is the functional equivalent of express advocacy because it can be interpreted by a reasonable person only as advocating the election or defeat of a candidate. The bill expands the period during which certain communications are treated as electioneering communications. The bill prescribes disclosure requirements for campaign-related disbursements by corporations, labor organizations, and other entities, including a political committee with an account established for the purpose of accepting donations or contributions that do not comply with the contribution limits or source prohibitions under FECA.

Authorized Rural Water Projects Completion Act

Authorized Rural Water Projects Completion Act This bill establishes the Reclamation Rural Water Construction and Settlement Implementation Fund, which shall consist of the Rural Water Project Account and the Reclamation Infrastructure and Settlement Implementation Account. The Department of the Treasury shall deposit into such accounts for each of FY2018-FY2038 specified revenues that would otherwise be deposited in the reclamation fund established by the Reclamation Act of 1902. The bill permits the Department of the Interior to use specified Rural Water Project Account funds to complete construction of rural water projects: (1) authorized before this bill's enactment, or (2) for which a feasibility study was submitted by February 27, 2015, pursuant to the Rural Water Supply Act of 2006 and for which Congress authorizes construction after enactment of this bill. Interior may not expend any amounts from the fund to carry this out until development of: (1) programmatic goals that would enable the completion of construction of the authorized rural water projects as expeditiously as practicable and that reflect the priorities identified in the laws authorizing the projects; and (2) funding prioritization criteria to serve as a methodology for distributing funds that take into account specified factors, including the need for potable water supplies in the affected rural and tribal communities. Interior shall use specified Reclamation Infrastructure and Settlement Implementation Account funds to: (1) provide authorized compensation to resolve all monetary claims of an Indian tribe against the United States relating to use of tribal land by the United States for the generation of hydropower; or (2) complete projects and implement provisions authorized by Congress that resolve litigation involving the United States and the water rights of Indian tribes or that implement approved agreements limiting such rights.

Refund Equality Act of 2017

Refund Equality Act of 2017 This bill amends the Internal Revenue Code to exempt certain same-sex couples who were legally married under state law from the three-year time limitation for filing: (1) a claim for a credit or refund of an overpayment of any tax, or (2) an election to file jointly after having filed separate returns. Certain legally married same-sex couples who were first treated as married for federal tax purposes by the application of the holdings of Revenue Ruling 2013-17 may file amended returns for previous years until the due date for the return for the year in which this bill is enacted. The bill applies only to amended returns and claims for a credit or refund that relate to a change in the marital status of the spouses. (In Revenue Ruling 2013-17, the Internal Revenue Service adopted a general rule recognizing, for federal tax purposes, the validity of a same-sex marriage that was valid in the state where it was entered into, regardless of the married couple's place of domicile.)

Every Kid Outdoors Act This bill directs the Departments of the Interior, Agriculture, Commerce, and the Army to establish the Every Kids Outdoors program to provide fourth graders free access to federal lands and waters to which the public has access. Such Departments shall issue such students annual passes, upon request, which shall allow free access to: a per-vehicle fee area for the student and any passengers accompanying the student in a private, noncommercial vehicle or for up to three adults accompanying the student on bicycles; or a per-person fee area for the student and up to three adults accompanying the student. In carrying out such program, such departments: may collaborate with state park systems that opt to implement a complementary Every Kid Outdoors State park pass, shall maintain a publicly available website that provides information about the program, may provide visitor services, and may support approved partners of the federal lands and waters by furnishing them with opportunities for participation in the program.

Sage-Grouse and Mule Deer Habitat Conservation and Restoration Act of 2017 This bill directs the Department of Interior to categorically exclude vegetative management activities that establish or improve habitat for greater sage-grouse and mule deer from environmental review requirements under the National Environmental Policy Act of 1969 (NEPA). Examples of vegetative management activities include restoring native vegetation following a natural disturbance or preventing the expansion of nonnative or invasive vegetation into such habitat. A categorical exclusion under NEPA is a category of actions which do not have a significant effect on the human environment and for which neither an Environmental Assessment nor an Environmental Impact Statement is required. The bill prohibits the categorical exclusion from including: (1) activity conducted in a wilderness area or wilderness study area, or (2) activity for the construction of a permanent road or trail. Before commencing a vegetative management activity that is covered by a categorical exclusion, Interior must develop a long-term monitoring and maintenance plan, covering at least 20 years, to ensure that management of the treated area does not degrade the habitat gains secured by the vegetative management activity. Vegetative material resulting from vegetative management activity may be: (1) used for fuel wood or other products; or (2) piled or burned, or both. Native vegetative cover must be reestablished on a temporary road constructed in connection with a categorically excluded vegetative management activity in order to minimize soil erosion from areas disturbed by the temporary road.

Voting Rights Advancement Act of 2017

Voting Rights Advancement Act of 2017 This bill amends the Voting Rights Act of 1965 to allow a representative official of an Indian tribe, with authorization from the governing body of the tribe, to request one or more polling places to be located on tribal lands. The state or political subdivision shall provide each requested polling place at no expense to the Indian tribe if certain criteria are met. A federal court shall retain jurisdiction to enforce constitutional voting guarantees, but also certain violations of the Act as well as of any federal prohibition against discrimination on the basis of race, color, or membership in a language minority group, for an appropriate period to prevent commencement of new devices to deny or abridge the right to vote. Any state (and all of its political subdivisions) shall be subject to certain requirements for a 10-year period if: 15 or more voting rights violations occurred there during the previous 25 years; or 10 or more violations occurred during the previous 25 years, at least one of which was committed by the state itself (as opposed to a political subdivision within it). A state or political subdivision that obtains a declaratory judgment that it has not used a device to deny or abridge the right to vote shall be exempt from such requirements unless as specified. This bill prescribes transparency requirements regarding any changes to specified matters. Department of Justice authority to assign observers receives new extensions. Courts shall grant preliminary injunctive relief if a complainant raises a serious question whether the challenged covered practice violates the Act or the Constitution and, on balance, the hardship imposed upon the defendant by the relief will be less than the hardship on the plaintiff if the relief were not granted.

21st Century Conservation Service Corps Act

21st Century Conservation Service Corps Act of 2017 This bill amends the Public Lands Corps Act of 1993 to replace provisions that established the Public Lands Corps with provisions establishing the 21st Century Conservation Service Corps (21CSC) to: engage youth and veterans in civilian national service positions to conserve, rebuild, and enhance the natural resources, infrastructure, and recreation assets of the United States; increase public access to, and use of, public and tribal land and water, infrastructure, and natural, cultural, and historical resources, while spurring economic development and outdoor recreation and addressing backlogged maintenance on public land; conserve, restore, and enhance such resources by carrying out high-quality, cost-effective projects; ensure that the activities and expertise of corpsmembers will be accessible to any public, nonprofit, or tribal entity responsible for the stewardship of land and water in coordination with the land or water owner; place youth and veterans in civilian national service positions to protect, restore, and enhance U.S. natural resources, infrastructure, and recreation assets in a cost-effective manner without undue duplication or overlap of federal agency activities or programs; and channel widespread interest among youth and veterans in serving in such positions to help conserve, restore, and enhance public and tribal land and water, infrastructure, and natural, cultural, and historical resources and to develop the next generation of outdoor stewards, entrepreneurs, recreationists, and sportsmen. The 21CSC shall be implemented jointly by the participating entities, which shall include the Corporation for National and Community Service, the Office of the Assistant Secretary of the Army for Civil Works, the Federal Emergency Management Agency, and the Departments of Interior, Agriculture, Transportation, Labor, Energy, Defense, Veterans Affairs, Commerce, Education, and Housing and Urban Development. Such entities shall: (1) establish a process for an organization to become a 21CSC organization, and (2) support 21CSC projects. A 21CSC organization shall provide to each youth or veteran corpsmember a wage, stipend, living allowance, and/or an educational credit, as well as skills development, credentials, and education, for participation in a 21CSC project that involves: specified conservation and restoration projects; the support, development, and enhancement of outdoor recreation or urban green space; service that is primarily indoors with a clear benefit for natural, cultural, or historic resources or treasures; or a project on private land or water having a direct or recognized public or environmental benefit or the funding of which originated from a governmental entity. The bill sets forth provisions governing 21CSC conservation centers and program support, the provision of resource assistants, and Corpsmember eligibility for a noncompetitive hiring status and national service educational awards. A participating entity may offer to enter into a cooperative agreement with a tribal agency or a 21CSC organization to establish and administer the Indian Youth 21st Century Conservation Service Corps, which shall carry out 21CSC projects on tribal land or water.

Safeguard Tribal Objects of Patrimony Act of 2017 This bill amends the federal criminal code to double the maximum prison term (from 5 years to 10 years) for persons convicted of selling, purchasing, using for profit, or transporting for sale or profit the human remains of Native Americans or cultural items obtained in violation of the Native American Graves Protection and Repatriation Act. The bill prohibits the export of Native American cultural items that were obtained in violation of the Act, Native American archaeological resources that were obtained in violation of the Archaeological Resources Protection Act of 1979, or Native American objects of antiquity that were obtained in violation of the criminal code. Violators may be subject to fines, imprisonment, or both. The Department of the Interior and the Department of State must each designate a liaison to facilitate and hold trainings and workshops on the voluntary return of human remains or cultural items. Interior must refer individuals and organizations to Indian tribes or Native Hawaiian organizations to facilitate the voluntary return of human remains or cultural items. In addition, Interior must convene a tribal working group consisting of representatives of tribes and Native Hawaiian organizations to provide advice on issues concerning the return of, and illegal trade in, human remains or cultural items.

Working Families Tax Relief Act of 201 7 This bill amends the Internal Revenue Code, with respect to the earned income tax credit, to: (1) increase the credit and reduce the phaseout percentage for taxpayers with no qualifying children, (2) reduce from 25 to 21 the qualifying age for individuals with no children, (3) revise eligibility rules relating to married individuals living apart and qualifying children claimed by another family member, and (4) repeal the denial of such credit for taxpayers with excess investment income. This bill modifies the child tax credit to: (1) increase the amount of the credit and the portion of the credit that is refundable for taxpayers with children under the age of six, and (2) require the dollar amounts of the credit to be adjusted for inflation after 2017.

Mental Health in Schools Act of 2017

Mental Health in Schools Act of 2017 This bill amends the Public Health Service Act to revise a community children and violence program to assist local communities and schools in applying a public health approach to mental health services, including by: (1) revising eligibility requirements for a grant, contract, or cooperative agreement; and (2) providing for comprehensive school mental health programs that are culturally and linguistically appropriate, trauma-informed, and age appropriate. A comprehensive school mental health program funded under this bill must assist children in dealing with trauma and violence. The bill makes only certain partnerships that include a state educational agency and one or more educational agencies, with a local agency serving as lead partner, eligible for funding. They include public or private entities that use evidence-based intervention. The Substance Abuse and Mental Health Services Administration shall develop a fiscally appropriate process for evaluating grant program activities, including the development of: (1) guidelines for the submission of program data by recipients; and (2) outcome measures to be applied by recipients in evaluating programs, including student and family measures and local educational measures.

The Department of Defense (DOD) shall ensure that any such changes are carried out consistently and uniformly across the military departments using specified criteria, including that: (1) the original discharge was based on the policy of Don't Ask Don't Tell (as in effect before it was repealed pursuant to the Don't Ask, Don't Tell Repeal Act of 2010) or a similar earlier policy; and (2) the discharge characterization will be changed if, with respect to the original discharge, there were no aggravating circumstances that would have independently led to any discharge characterization except honorable. The bill prohibits "aggravating circumstances" from including: (1) an offense of sodomy committed by the member against a consenting person of the same sex; or (2) statements, consensual sexual conduct, or consensual acts relating to sexual orientation or identity, or the disclosure of such statements, conduct, or acts, that were prohibited at the time of discharge but that became permitted after such discharge. Each military department shall ensure that oral historians of the department: (1) review discharges between World War II and September 2011 based on sexual orientation, and (2) receive oral testimony of individuals who personally experienced discrimination and discharge because of actual or perceived sexual orientation so that such testimony may serve as an official record of such discriminatory policies and their impact on American lives. Specified military personnel records and discharge forms must be reissued in a manner that shall not reflect the sexual orientation of the member.

Fair and Equal Housing Act of 2017 This bill amends the Fair Housing Act (FHA) under the Civil Rights Act of 1968 to add sexual orientation and gender identity as classes protected against discrimination in the sale, rental, or financing of housing. (Currently, the FHA prohibits housing discrimination on the basis of race, color, religion, sex, handicap, familial status, or national origin.) The bill defines: (1) "gender identity" as gender-related identity, appearance, or mannerisms or other gender-related characteristics of an individual, without regard to the individual's designated sex at birth; and (2) "sexual orientation" as homosexuality, heterosexuality, or bisexuality. The bill also extends prohibitions against housing discrimination on the basis of race, color, religion, sex, sexual orientation, gender identity, handicap, familial status, or national origin to include discrimination based on: (1) an individual's association with another person who is a member of such a protected class; and (2) a perception or belief, even if inaccurate, that an individual is a member of such a protected class.

Washington, D.C. Admission Act This bill provides for admission into the United States of the state of Washington, Douglass Commonwealth. The Commonwealth shall be admitted to the Union on an equal footing with the other states. The Mayor of the District of Columbia shall issue a proclamation for the first elections to Congress of two Senators and one Representative of the Commonwealth. The Commonwealth shall consist of all Washington, DC territory as of enactment of this bill, with specified exclusions for federal buildings and monuments. Bank on Students Emergency Loan Refinancing Act This bill amends title IV (Student Assistance) of the Higher Education Act of 1965 to establish a program that allows eligible students with loans under the Federal Direct Loan program (a Federal Direct Stafford Loan, a Federal Direct Unsubsidized Stafford Loan, a Federal Direct PLUS Loan, or a Federal Direct Consolidation Loan) to refinance their loans down to the lower rates offered to new federal borrowers in the 2016-2017 school year under certain circumstances. This bill amends the Internal Revenue Code to require an individual taxpayer whose adjusted gross income exceeds $1 million to pay a minimum tax rate of 30% of the excess of the taxpayer's adjusted gross income over the taxpayer's modified charitable contribution deduction for the taxable year (tentative fair share tax).

Miners Pension Protection Act This bill amends the Surface Mining Control and Reclamation Act of 1977 (SMCRA) to transfer certain funds to the 1974 United Mine Workers of America (UMWA) Pension Plan to provide pension benefits to retired coal miners and their families. The Department of the Treasury must transfer additional funds to the 1974 UMWA Pension Plan to pay pension benefits required under that plan if the amounts available for transfer under SMCRA's $490 million annual limit exceed the amounts required to be transferred for other purposes (including to the UMWA Health Plans). The bill also: (1) prohibits the pension plan from making certain changes to benefits during any year in which a transfer is received, and (2) establishes additional reporting requirements for the plan. As an offset, the bill amends the Consolidated Omnibus Budget Reconciliation Act of 1985 to extend the authority of Treasury to collect certain customs user fees.
