American Small Business Emergency Relief and Recovery Act of 2001 - Amends the Small Business Act to authorize the Small Business Administration (SBA) to make disaster loans to a small business concern that has been directly affected and suffered or is likely to suffer substantial economic injury as the direct result of the terrorist attacks of September 11, 2001, including injury due to closure or suspension of its business for national security purposes by the Federal Government. Authorizes the SBA, during the year after enactment of this Act, to make loans to small business concerns that have suffered or are likely to suffer economic harm to or disruption of operations as a result such attacks. Waives guarantee fees and increases the guarantee percentage on such loans for one year after the enactment of this Act. Amends the Small Business Investment Act of 1958 to: (1) waive development company debenture guarantee loan fees for financings made after enactment of this Act for one year; and (2) authorize small business investment companies to issue leverage to assist small business concerns adversely impacted by the terrorist attacks. Amends the Small Business Act to authorize special, individualized assistance to small business concerns adversely impacted by the terrorist attacks through the following programs; (1) small business development centers; (2) Service Corps of Retired Executives (SCORE); (3) microloan program (women, low-income, veterans, minority); and (4) women's business center program. Directs the Office of Advocacy of the SBA to conduct annual studies on the impact of the events of September 11, 2001, on small business concerns, and the effects of assistance provided under this Act.

Pesticide Maintenance Fees Authorization Act - Amends the Federal Insecticide, Fungicide, and Rodenticide Act, with respect to the pesticide registration maintenance fee system, to: (1) make uniform the amount of the annual fee for each registration; (2) set maximum amounts payable by a registrant and an increased aggregate amount of collected fees for FY 2002 through 2006; (3) expand the definition of a small business; and (4) extend the authority to collect such fees and the prohibition on levy of fees other than those specified in the Act's fee provisions. Extends the requirement that the Administrator of the Environmental Protection Agency use maintenance fees to ensure expedited processing of similar applications and adds a requirement that the fees be used to review inert ingredients. Amends the Federal Food, Drug, and Cosmetic Act to prohibit the Administrator, through FY 2006, from promulgating regulations addressing pesticide tolerance processing fees (except those changing current fee amounts by the same percentage as the annual adjustment to the Federal General Schedule pay scale).

Critical Infrastructure Information Security Act of 2001 - Prohibits critical infrastructure information that is voluntarily submitted to specified Federal agencies for analysis, warning, interdependency study, recovery, reconstitution, or other informational purpose, when accompanied by the express statement specified under this Act, from: (1) being made available under the Freedom of Information Act; (2) being used directly by the agency, any other Federal, State, or local authority, or third party in a civil action, without the written consent of the person or entity submitting such information, unless such information is submitted in bad faith; and (3) being used for a purpose other than this Act's purpose or disclosed by a officer or U.S. employee, without such written consent, except pursuant to official duties under this Act. Requires the establishment of uniform procedures for the receipt, care, and storage of such information by Federal agencies. Sets forth provisions for the notification about and dissemination and analysis of significant and credible information about the security of protected systems or critical infrastructure received by specified Federal agencies from private persons and entities. Directs the President to designate an element in the executive branch to conduct and report to information sharing and analysis organizations on strategic analyses of potential threats to critical infrastructure. Exempts from the antitrust laws, with an exception, conduct of such organizations, including making agreements solely for: (1) gathering and analyzing critical infrastructure information to better understand security problems related to critical infrastructure and protected systems; (2) communicating or disclosing such information to prevent, detect, mitigate, or recover from problems related to such infrastructure or systems; or (3) voluntarily disseminating such information to entity members, other such organizations, the Government, or any entities that may be of assistance in carrying out the purposes specified above.

Internet Equity and Education Act of 2001 - Amends the Higher Education Act of 1965 (HEA) to exempt courses offered through telecommunications from certain limitations on student financial assistance with respect to correspondence courses. Allows such exemption if the institution offering such course through telecommunications: (1) is participating in the guaranteed or the direct student loan program; and (2) has a cohort default rate of less than ten percent for each of the most recent fiscal years for which data are available. Defines a week of instruction as one in which at least one day of instruction, examination preparation, or examination occurs, for purposes of determining an academic year for HEA student aid programs. Prohibits higher education institutions participating in HEA student assistance programs from making any incentive, non-salary payment, based directly on success in securing enrollments or financial aid, to any person or entity directly engaged in student recruiting or admission activities, or making decisions regarding the award of student financial assistance. Exempts from such prohibition recruitment of foreign students not eligible to receive Federal student assistance.

Expresses sorrow for the deaths and injuries suffered by first responders who participated in evacuating and rescuing the innocent people after the terrorist attacks on the World Trade Center and the Pentagon on September 11, 2001, and sympathy to their families and loved ones. Honors and commends such first responders. Encourages: (1) the President to issue a proclamation calling upon the people of the United States to pay respect to the first responder community for their service in the aftermath of the terrorist attacks and their continuing efforts to save lives; and (2) all levels of government to continue to work together to effectively coordinate emergency preparedness by providing the infrastructure, funding, and interagency communication and cooperation necessary to ensure that if an attack occurs, first responders will be as prepared as possible to respond effectively.

Victims of Terrorism Relief Act of 2001 - Amends the Internal Revenue Code to exempt from income taxes and the estate and gift taxes any individual who died as a result of the September 11, 2001, terrorist attacks, unless the individual was a perpetrator of the attacks.

Condemns the terrorists who attacked the United States on September 11, 2001, as well as their sponsors. Extends condolences to the victims and their families and commends the heroic actions of the rescue workers, volunteers, and State and local officials who responded. Declares that the United States is entitled under international law to respond to these attacks. Expresses: (1) thanks to those foreign leaders and individuals who have expressed solidarity with the United States in the aftermath of the attacks and asks them to continue to stand with the United States in the war against international terrorism; (2) a commitment to support increased resources in the war to eradicate terrorism; and (3) support for the determination of the President to bring to justice and punish the perpetrators of these attacks and their sponsors. Declares September 12, 2001, to be a National Day of Unity and Mourning.

Middle East Peace Compliance Act of 2001 - Imposes specified sanctions with respect to the Palestine Liberation Organization (PLO) or the Palestinian Authority if the President determines that such entities have not substantially complied with certain commitments made with Israel. Authorizes the President to waive such sanctions in the U.S. national security interest.

Amends the Internal Revenue Code to allow a first-time homebuyer who purchases a principal residence a tax credit of ten percent of the purchase price of such residence. Limits the credit to $6,500. Requires married individuals filing jointly to both be first-time homebuyers. Makes this credit applicable to a principal residence only if the taxpayer enters into, on or after September 1, 2001, and before September 1, 2002, a binding contract to purchase the residence, and purchases and occupies the residence before April 1, 2003.

Advancement of Geriatric Education Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) with respect to payment to hospitals for inpatient hospital services to: (1) provide that, with respect to specified cost reporting periods, in applying the limitations regarding the total number of full-time equivalent residents in the field of allopathic or osteopathic medicine under provisions on payments for direct and indirect graduate medical education (GME) costs for a hospital, the Secretary of Health and Human Services shall disregard up to a specified maximum number of residents enrolled in an approved geriatric residency or fellowship program under certain circumstances; and (2) provide that in the case of an individual enrolled in an approved geriatric residency or fellowship program, the period of board eligibility and the initial residency period shall be the period of board eligibility for the subspeciality involved, plus one year under provisions on payments for direct GME costs. Amends the Public Health Service Act to increase, provide for, and make other specified funding-related changes with respect to certain geriatric matters.

Medicare Ambulance Payment Reform Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to revise requirements for payment for ambulance services concerning: (1) the establishment of a fee schedule; and (2) the coding system specifying the medical condition of the individual transported by an ambulance and the appropriate level of transportation service. Amends SSA titles XVIII (Medicare) (including part C (Medicare+Choice) of the Medicare program) and XIX (Medicaid) to establish a prudent layperson standard for justification of emergency ambulance services under Medicare and Medicaid.

Linking Educators and Developing Entrepreneurs for Reaching Success Act of 2001 - Authorizes the Secretary of Education to support business incubation at institutions of higher education that award associate or baccalaureate degrees. Directs the Secretary to make competitive, matching awards to: (1) a non-profit entity that manages or provides technical assistance to a degree-granting institution's affiliated incubator (or to the institution that manages in the absence of such an entity), for helping acquire or renovate space for incubators, and for developing curricula, providing services, or providing programming for entrepreneurs housed in an incubator; and (2) a degree-granting institution or a nonprofit local government or community development organization, for feasibility studies to determine the need for or siting of incubators. Requires the Secretary to reserve certain amounts for research regarding best practices for incubator programs, including the development of a benchmarking system based on uniform measures, and for dissemination of information regarding such practices. Authorizes contracts for such purposes with organizations with expertise in business incubation practices.

Minor Use and Minor Species Animal Health Act of 2001 - Amends the Federal Food, Drug, and Cosmetic Act to define: "minor species" as animals other than cattle, horses, swine, chickens, turkeys, dogs, and cats; and (2) "minor use" as use on minor species or on other species for a disease or condition that occurs infrequently or in limited geographic areas. Provides for: (1) designation of new animal drugs for minor use; and (2) three-year approval exclusivity. Provides for establishment of an index of unapproved new animal drugs for minor species, and allows marketing of such drugs that evidence no human food safety concern. Authorizes: (1) designation of new animal drugs for minor use or minor species; and (2) grants or contracts for development (and exclusivity) of designated new animal drugs. Modifies new animal drug approval requirements. Amends the Internal Revenue Code to allow a business research tax credit (not applicable to grant or contract funds) for minor use qualified safety and effectiveness testing expenses. Directs the Secretary of Health and Human Services to establish within the Food and Drug Administration an Office of Minor Use and Minor Species Animal Drug Development.

Stroke Treatment and Ongoing Prevention Act of 2001 - Amends the Public Health Service Act to create a new title (this title) covering stroke prevention, treatment, and rehabilitation. Directs the Secretary of Health and Human Services to: (1) carry out a national education and information campaign to promote stroke prevention and increase the number of stroke patients who seek immediate treatment; and (2) make available, support, and evaluate a grant program to enable a State to develop statewide stroke care systems, foster the development of modern systems of stroke care, and provide technical assistance to State and local agencies. Requires the Secretary to: (1) maintain the Paul Coverdell National Acute Stroke Registry and Clearinghouse; and (2) ensure the availability of published research on stroke or conduct research concerning best practices, barriers to access, the effectiveness of existing public awareness campaigns, and disparities in the prevention, diagnosis, treatment, and rehabilitation, regarding stroke. Directs the Secretary to award grants to States for the purpose of establishing statewide stroke prevention, treatment, and rehabilitation systems. Requires the Secretary to develop standards of care for stroke patients in all phases of stroke that may be adopted for guidance by the State and a model plan for the establishment of statewide stroke care systems. Authorizes the Secretary to make grants to public and non-profit private entities for the development and implementation of education programs for appropriate medical personnel in the use of newly developed diagnostic approaches, technologies, and therapies for the prevention and treatment of stroke.

Community Access to Emergency Defibrillation Act of 2001 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to award grants to States, political subdivisions of States, Indian tribes, and tribal organizations to develop and implement public access defibrillation programs by: (1) training and equipping local emergency medical services personnel to administer immediate care, including cardiopulmonary resuscitation (CPR) and automated external defibrillation (AED), to cardiac arrest victims; (2) purchasing AEDs, placing the defibrillators in public places where cardiac arrests are likely to occur, and training personnel in such places to administer CPR and AED to such victims; (3) setting procedures for proper maintenance and testing of such devices; (4) providing training to members of the public in CPR and AED; (5) integrating the emergency medical services system with the public access defibrillation programs; and (6) encouraging private companies to purchase AEDs and provide training for their employees to administer CPR and AED to cardiac arrest victims in their community. Directs the Secretary to award grants to States, Indian tribes, and tribal organizations to develop and implement innovative, comprehensive, community-based public access defibrillation demonstration projects that: (1) provide CPR and AED to cardiac arrest victims in unique settings; (2) provide training to community members in CPR and AED; and (3) maximize community access to AEDs. Directs the Secretary to award a grant to a health care organization to establish a national information clearinghouse that provides information to increase public access to defibrillation in schools.

Conservation Extension and Enhancement Act of 2001 - Amends the Food Security Act of 1985 to: (1) extend the environmental conservation acreage reserve program; (2) extend the conservation reserve program, including marginal pasture lands devoted to trees, and the pilot program for Iowa, Minnesota, Montana, Nebraska, North Dakota, and South Dakota; (3) increase the scope of conservation reserve eligible lands; (4) increase maximum conservation reserve acreage; (5) extend and provide maximum annual acreage levels for the wetlands reserve program; (6) establish a grassland reserve program; (7) extend and expand the scope of the environmental quality incentives program, including increased payment limits, and establishment of Colorado River Basin salinity control measures; and (8) provide for the privacy of personal information relating to natural resources conservation programs. Amends the Agriculture and Food Act of 1981 to revise the resource conservation and development program, including: (1) provision of program assistance through councils which shall carry out area plans and projects in designated areas; and (2) establishment in the Department of Agriculture of a Resource Conservation and Development Policy Advisory Board. Amends the Federal Agriculture Improvement and Reform Act of 1996 to: (1) extend funding for the conservation of private grazing land program; (2) extend funding for the wildlife habitat incentive program; (3) establish related pilot programs to avoid listing of endangered species and preserve critical habitats; and (4) extend funding for the farmland protection program. Provides for disaster program and conservation accounting system studies.

Breast Cancer Research Stamp Act of 2001 - Amends Federal postal law to provide that any limitation in the Semipostal Authorization Act relating to whether more than one semipostal (a postage stamp issued by the U.S. Postal Service, at a premium, in order to help provide funding for a national public interest) may be offered for sale at the same time, shall not apply to the breast cancer research special stamps issued by the U.S. Postal Service. Extends the Service's authority to issue such stamps through July 29, 2008. Revises the differential amount of the special rate of postage for the breast cancer research stamp to not less than 15 percent of the regular first-class rate (currently, not to exceed 25 percent of first-class). Requires the special rate to be evenly divisible by five.

POW/MIA Memorial Flag Act of 2001 - Includes the World War II Memorial among the locations where the National League of Families POW/MIA flag is required to be displayed. Requires such flag to be displayed at such Memorial, as well as the Korean War Veterans Memorial and the Vietnam Veterans Memorial, on any day on which the United States flag is displayed.

Subchapter S Modernization Act of 2001 - Amends the Internal Revenue Code to revise provisions concerning S corporations to, among other things: (1) allow certain members of a family to be treated as one shareholder of an S corporation; (2) prohibit treating qualified preferred stock as a second class of stock and treating a person as a shareholder by reason of holding such stock; (3) permit financial institutions to hold convertible (safe harbor) debt; (4) repeal the characterization of excessive passive investment income as a termination event; (5) permit certain losses on liquidation not exceeding ordinary income basis to be treated as ordinary losses; (6) permit the deductibility of interest expense incurred by an electing small business trust to acquire S corporation stock; (7) provide that shareholder basis is not increased by income derived from cancellation of S corporation's debt; (8) provide for the exclusion of investment securities income from the passive income test for bank S corporations; (9) provide relief from inadvertently invalid qualified subchapter S subsidiary elections and terminations on the same basis as is provided to invalid or terminated S corporation elections; and (10) provide for the elimination of all earnings and profits attributable to pre-1983 years.

Amends the Internal Revenue Code to allow a tax credit for marginal domestic oil and natural gas well production during any taxable year in the amount of $3 per barrel of qualified crude oil production and 50 cents per 1,000 cubic feet of qualified natural gas production, reduced, but not below zero, as oil and gas prices increase. States that the limitation to the general business credit, based on the amount of tax, shall not be reduced by the amount of the marginal oil and gas well credit. Allows both geological and geophysical expenditures on domestic oil and gas exploration and development and delay rental payments, at the taxpayer's election, to be deducted from gross income at the time incurred.

Expresses the sense of the Senate that: (1) all Americans should keep abused and neglected children in their thoughts and prayers; (2) all Americans should seek to break the cycle of abuse and neglect and to give these children hope for the future; (3) the faith community, nonprofit organizations, and volunteers across America should recommit themselves and mobilize their resources to assist these children; and (4) the Senate supports the goals and ideas of the Day of Hope, (April 3, 2002) and commends Childhelp USA for its efforts on behalf of abused and neglected children everywhere.

Agricultural Job Opportunity Benefits and Security Act of 2001 - Directs the Attorney General, upon completion of specified agricultural work and residency requirements, to adjust the status of a qualifying alien agricultural worker to that of a: (1) lawfully admitted temporary nonimmigrant; and (2) permanent resident nonimmigrant. Sets forth provisions with respect to: (1) adjustment of status applications, including penalties for false statements; (2) waiver of numerical limitations and certain grounds for inadmissibility; (3) temporary stay of removal and work authorization; (4) administrative and judicial review; and (5) dissemination of program information. Amends the Immigration and Nationality Act to set forth registry application requirements for H-2A employers and employer associations, including assurances: (1) that the job opportunity is temporary or seasonal, and is not the result of a labor dispute, (2) that attempts have been made to hire U.S. workers; and (3) respecting required wages and benefits, and compliance with labor laws. Sets forth employment requirements with respect to: (1) wages; (2) housing; (3) transportation reimbursement; and (4) obligation to employ U.S. workers. Revises provisions respecting the admission and extension of stay of temporary H-2A workers. Provides special rules for alien sheepherders. States that nothing in this Act shall preclude the Secretary and the Attorney General from continuing to apply special procedures to the employment, admissions, and extension of aliens in the range production of livestock. Directs the Secretary to establish registry user and alien employment user fee schedules and related collection processes.

Expresses the sense of Congress that: (1) there should be established a National Community Health Center Week to raise awareness of health services provided by community, migrant, public housing, and homeless health centers; and (2) the President should issue a proclamation calling on the people of the United States and interested organizations to observe such a week with appropriate programs and activities.

Motor Vehicle Franchise Contract Arbitration Fairness Act of 2001 - Provides that whenever a motor vehicle franchise contract provides for the use of arbitration to resolve a controversy arising out of or relating to the contract, arbitration may be used to settle the controversy only if both parties consent in writing after such controversy arises. Requires the arbitrator to provide the parties with a written explanation of the factual and legal basis for the award.

Amends the Federal Food, Drug, and Cosmetic Act to change the meaning of "authorized distributor" of a prescription drug from a distributor with whom a manufacturer has established an ongoing relationship to distribute such manufacturer's products to any distributor to which a manufacturer sells a prescription drug. Requires the wholesale distributor of certain drugs who is not the manufacturer or an authorized distributor to provide to a drug recipient a statement that the drug was first purchased from or through an authorized distributor.

Broadband Deployment and Competition Enhancement Act of 2001 - Amends the Communications Act of 1934 to prohibit subjecting an incumbent local exchange carrier (carrier) to common carrier regulation with respect to any optical fiber facility, or any technology of a similar facility, in the carrier's network that is used to provide service to residential customers and that is or was deployed where no outside telephone distribution plant previously existed, or from any structure or premise to a customer premise, if the facility is capable of providing advance service. Prohibits subjecting such a carrier to such regulation with respect to packet switching or successor technology or the resale of advanced service or high-speed Internet access service. Requires such carrier to provide: (1) collocation in its central offices with respect to equipment used in the provision of advanced service; and (2) advanced service to all of its customers in a State within five years after the enactment of this Act, making carriers that do not so comply subject to common carrier regulation thereafter. Prohibits requiring such a carrier to convert to a network element or combination of network elements any special access circuit being provided on June 1, 2001. Requires the Federal Communications Commission to identify in its regulations any requirements or obligations that result in different or disparate treatment among various types of providers of advanced service and high-speed Internet access service, or among different technologies used to provide such service.

Biodiesel Renewable Fuels Act - Amends the Internal Revenue Code to: (1) allow a tax credit of between 3 and 20 cents per gallon for soy or specified vegetable based biodiesel fuel mixtures; and (2) make corresponding reductions to motor fuel excise taxes.

Rural Health Care Improvement Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to provide for: (1) payment adjustment for low-volume hospitals; (2) revision in the Medicare disproportionate share hospital (DSH) payment adjustment for rural hospitals equalizing DSH payment amounts; (3) a single, standardized amount under the Medicare inpatient hospital prospective payment system (PPS); (4) treatment of certain physician pathology services; and (5) one-time opportunity of critical access hospitals to return to the Medicare inpatient hospital PPS. Amends the Public Health Service Act (PHSA) to establish: (1) a capital infrastructure revolving loan program under which the Secretary of Health and Human Services may make described loans to any rural entity for projects for capital improvements from the loan and loan guarantee fund under PHSA; (2) a high technology acquisition grant and loan program under which the Secretary may award grants and make loans to any eligible entity for any costs incurred by the entity in acquiring eligible equipment and services for improving the quality of health care in rural areas; and (3) a program of grants to eligible entities under which the Secretary shall award such grants to public or nonprofit private entities to establish telehealth resource centers for the health care needs of individuals in rural areas. Amends SSA title XVIII concerning: (1) rural health clinics and Medicare reimbursement; and (2) exclusion of certain rural health clinic services and federally qualified health center services from the Medicare PPS for skilled nursing facilities.

Amends the Internal Revenue Code to permit: (1) Federal civilian and military retirees to pay Federal Employees Health Benefits Program and TRICARE supplemental premiums on a pretax basis; and (2) a deduction (available to itemizers and nonitemizers) for TRICARE supplemental premiums and enrollment fees.

Reforestation Tax Act of 2001 - Amends the Internal Revenue Code to allow a deduction to a taxpayer who has a qualified timber gain in an amount equal to the qualified percentage of such gain. Decreases the amortization period for reforestation expenditures.

Wage Index Fairness Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to establish a wage adjustment factor of .925 as a floor on area wage adjustment factors used under the Medicare prospective payment system for inpatient and outpatient hospital services.
