Emergency Energy Assistance Act of 2008 - Amends the Internal Revenue Code of 1986 to increase the credit percentage for purposes of the earned income tax credit for taxable years beginning in 2008. Makes appropriations for FY2008 for payments under the Low-Income Home Energy Assistance Act of 1981 (LIHEAP Program). Makes appropriations for FY2008 to carry out the Weatherization Assistance Program for Low-Income Persons under the Energy Conservation and Production Act.

Dr. Joseph Medicine Crow Congressional Gold Medal Act - Directs the Speaker of the House of Representatives and the President Pro Tempore of the Senate to make appropriate arrangements for the presentation of a congressional gold medal in commemoration of Dr. Joseph Medicine Crow to recognize his especially meritorious role as a warrior of the Crow Tribe, Army Soldier in World War II, tribal historian, and author.

Disapproves the rule submitted by the Secretary of Health and Human Services relating to requirements set forth in the State Health Official Letter 07-001, dated August 17, 2007, issued by the Director of the Center for Medicaid and State Operations in the Centers for Medicare & Medicaid Services and the State Health Official Letter 08-003, dated May 7, 2008, from such Center, requiring states that expand the income eligibility level for children under the State Children's Health Insurance Program (SCHIP) above 250% of the federal poverty level to adopt the five crowd-out strategies described in the August 17, 2007, letter and to provide certain assurances described in such letter.

Small Business Energy Emergency Relief Act of 2008 - Amends the Small Business Act to authorize the Small Business Administration to make disaster loans to assist small businesses that have suffered or are likely to suffer substantial economic injury as the result of a significant increase in the price of heating fuel occurring on or after October 1, 2007. Prohibits such loan from being made if the total amount outstanding and committed to the borrower would exceed $1.5 million, unless the borrower is a major source of employment in its surrounding area. Amends the Consolidated Farm and Rural Development Act to authorize the Secretary of Agriculture to make loans to farm operations that qualify as a small business and that have or are likely to suffer substantial economic injury on or after October 1, 2007, as the result of a significant increase in energy costs in connection with an energy emergency declared by the President or the Secretary.

Medicare, Medicaid, and MCH Tobacco Cessation Promotion Act of 2008- Amends title XVIII (Medicare) of the Social Security Act to provide for Medicare coverage of: (1) counseling for cessation of tobacco use; and (2) tobacco cessation pharmacotherapy. Provides for similar benefits under SSA titles V (Maternal and Child Health Services) and XIX (Medicaid).

Establishes in the Executive Office of the President the position of White House Coordinator for Iraqi Refugees and Internally Displaced Persons who shall: (1) develop and implement U.S. policies, and coordinate federal functions, to address the protection, resettlement, and assistance needs of Iraqi refugees and displaced persons; (2) monitor the development and implementation of assistance strategies to countries in the Middle East hosting Iraqi refugees; (3) ensure that the President's budget requests to Congress are sufficient to meet the needs of such persons, including providing assistance for international efforts on behalf of such persons; (4) serve as principal liaison with the government of Iraq and the international community and organizations that are assisting such persons; and (5) ensure that the U.S. government will encourage refugee returns only when conditions permit safe and voluntary returns.

Preventing Student Loan Discrimination Act - Amends the Higher Education Act of 1965 to prohibit lenders under the Federal Family Education Loan (FFEL) program from receiving special allowance payments (made to such lenders to compensate them for the difference between FFEL interest rates and market rates) if they deny FFELs to eligible borrowers because of their race, sex, color, religion, national origin, age, disability status, income, attendance at a particular school participating in the FFEL program, education program length, or academic year in school.

Select Agent Program and Biosafety Improvement Act of 2008 - Amends the Public Health Service Act and the Agricultural Bioterrorism Protection Act of 2002 to reauthorize appropriations for the Select Agent Program, which lists and controls biological agents and toxins that have the potential to pose a severe threat to public health and safety. Requires appropriate training of individuals handling or using such agents and toxins. Includes the Department of Homeland Security (DHS) among the federal agencies limited in the disclosure of information related to listed agents or toxins. Requires the Secretary of Health and Human Services to contract with the National Academy of Sciences to review and make recommendations for improving the Select Agent Program. Sets forth additional factors that the Secretary must consider in determining whether to list an agent or toxin, including whether the agent or toxin is endemic to the United States. Requires the Secretary to issue guidance on inventorying and monitoring listed biological agents. Directs the Attorney General to issue guidance regarding the scope of the statutory definition of "variola virus." Requires the Secretary to: (1) develop guidelines for how laboratories and laboratory personnel that do not regularly test for listed agents and toxins may be rapidly accessed and utilized during emergencies; and (2) evaluate national needs of, and oversight of, high containment biological laboratories. Provides for the development of minimum standards for laboratory biosafety and biosecurity training for relevant personnel of high containment biological laboratories. Requires the Secretary to establish a Biological Laboratory Incident Reporting System.

Secure and Safe Detention and Asylum Act - Sets forth provisions regarding procedures and standards applicable to aliens detained in Department of Homeland Security (DHS) custody and the conditions of such custody, which shall address: (1) fair and humane treatment; (2) solitary confinement limitations; (3) investigation of grievances; (4) access to telephones and legal assistance; (5) detainee transfers; (6) translation capabilities; (7) medical care; (8) vulnerable populations; (9) standards for non-criminal detainees; (10) personnel training; and (11) reporting of detainee deaths. Establishes in DHS: (1) an Office of Detention Oversight; and (2) a detention alternatives program under which detainees may be released under enhanced supervision. Provides for: (1) legal orientation for immigration and asylum detainees; (2) construction or use of less restrictive detention facilities, including facilities for families with children; and (3) quality assurance procedures regarding expedited removal interviews.

Declares the sense of Congress that: (1) history should be regarded as a means for understanding the past and solving the challenges of the future; and (2) the celebration of the end of slavery is an important and enriching part of the history and heritage of the United States.

Consumer-First Energy Act of 2008 - Amends the Internal Revenue Code to: (1) deny major integrated oil companies (i.e., companies producing at least 500,000 barrels of crude oil daily) a tax deduction for income attributable to domestic production of oil, gas, or primary products thereof; (2) conform tax treatment of foreign oil and gas extraction income and foreign oil related income for purposes of the foreign tax credit; (3) impose a windfall profits tax on major integrated oil companies; and (4) establish an Energy Independence and Security Trust Fund funded by revenues raised by the tax provisions of this Act to reduce U.S. dependence on foreign and unsustainable energy sources and reduce the risks of global warming. Petroleum Consumer Price Gouging Protection Act - Declares it unlawful for a supplier to sell crude oil, gasoline, petroleum distillates, or biofuel at an unconscionably excessive price in an area for which the President declares that an energy emergency exists. Grants the Federal Trade Commission (FTC) authority to enforce this Act. Authorizes the President to declare a federal energy emergency if the well-being of U.S. citizens is at risk because of a shortage or imminent shortage of adequate supplies of crude oil, gasoline, petroleum distillates, or biofuel because of: (1) a disruption in the national distribution system; or (2) significant pricing anomalies in the national energy markets for such products. Authorizes state attorneys general to bring civil actions to enforce this Act. Sets forth civil and criminal penalties for violations. Directs the Secretaries of Energy and the Interior to suspend acquisition of petroleum for the Strategic Petroleum Reserve until December 31, 2008. No Oil Producing and Exporting Cartels Act of 2008 or NOPEC - Amends the Sherman Act to make it illegal for any foreign state to act with another foreign state to: (1) limit the production or distribution of oil, natural gas, or any other petroleum product; (2) set or maintain prices for such products; or (3) otherwise take any action in restraint of trade for such products. Denies sovereign immunity or act of state doctrine protections for foreign states who engage in such such illegal conduct. Amends the Commodity Exchange Act to require the Commodity Futures Trading Commission (CFTC) to: (1) determine that foreign boards of trade subject to CFTC jurisdiction regulate and provide information on off-shore oil trading; and (2) set a substantial increase in margin levels for all oil futures trades, contracts, or transactions.

AmeriCorps: Together Improving Our Nation Act or the ACTION Act - Amends the National and Community Service Act of 1990 to alter the formula for determining the amount of the national service educational award to base the award on the average cost of attending a four-year institution of higher education, rather than a portion of a veteran's basic educational assistance allowance. Excludes the national service educational award from an individual's gross income for tax purposes. Permits the Corporation for National and Community Service to support a national service program that is carried out by another federal agency and implements the priorities of such agency. Makes Chief Executive Officer of the Corporation a Cabinet position. Raises the Officer's compensation to Level I of the Executive Schedule.

Protecting Tenants at Foreclosure Act of 2008 - States that any immediate successor in interest to residential property in foreclosure assumes such interest subject to: (1) giving the existing bona fide tenant at least 90-day notice to vacate; and (2) specified rights of such tenant to occupy the premises until the end of the remaining term of the lease. Amends the United States Housing Act of 1937 to require a housing assistance payment contract to provide that in the case of an owner who is an immediate successor in interest pursuant to foreclosure: (1) during the initial term of the lease vacating the property prior to sale shall not constitute other good cause for termination of the lease; but (2) in subsequent lease terms, vacating the property prior to sale may constitute good cause if the property is unmarketable while occupied, or if such owner will occupy the unit as a primary residence. Authorizes a housing assistance payment contract entered into by the public housing agency and the owner of a dwelling unit to provide that the immediate successor in interest to property in foreclosure in which a housing assistance recipient resides, assumes such interest subject to the lease between the prior owner and the tenant, and subject to the housing assistance payments contract between the prior owner and the public housing agency for the occupied unit.

Detainee Basic Medical Care Act of 2008 - Directs: (1) the Secretary of Homeland Security to establish procedures for the delivery of medical and mental health care to all immigration detainees in Department of Homeland Security (DHS) custody; and (2) that such procedures address all detainee health needs, including primary care, emergency care, chronic care, prenatal care, dental care, eye care, mental health care, medical dietary needs, and other medically necessary specialized care.

Expresses the sense of the Senate: (1) expressing sympathy to and support for the people of Burma in the aftermath of Cyclone Nargis; (2) supporting President Bush's decision to provide emergency humanitarian assistance to Burma through nongovernmental organizations that are not affiliated with the Burmese regime; (3) in standing ready to appropriate additional funds to address dire humanitarian conditions in the aftermath of Cyclone Nargis; (4) calling upon the State Peace and Development Council to lift restrictions on humanitarian assistance and allow free access to the U.S. government's disaster assistance response team; and (5) stating that the United States Agency for International Development (USAID) should evaluate which organizations are capable of providing humanitarian assistance without Council interference.

National Guard and Reserve Mental Health Access Act of 2008 - Requires the Secretary of Defense to: (1) provide for the implementation of the Yellow Ribbon Reintegration Program for members of the National Guard and reserves and their families required by section 582 of the National Defense Authorization Act for Fiscal Year 2008 by not later than 180 days after the date of the enactment of this Act; and (2) report to the congressional defense committees on that Program's implementation. Directs the Secretary to carry out a joint psychological health program to: (1) increase access to and the provision of psychological health care and related services for members of the National Guard following their deployment, and their families; (2) improve coordination among DOD components in the provision of such care during members' transition from active duty to civilian life; and (3) coordinate and oversee DOD efforts to assist members of the National Guard with mental illness and members with traumatic brain injury post-deployment. Requires the Chief of the National Guard Bureau to establish the National Guard Psychological Health Council. Directs the Secretaries of Defense and Veterans Affairs to jointly carry out: (1) one or more pilot programs on the provision of mental health services to members of the National Guard and reserves, both before and after deployment, through telemental health technologies; and (2) an outreach program intended to reduce the stigma, among members of the National Guard and reserves returning from deployment, and their families, associated with seeking and obtaining mental health services.

Preserving Records of Terrorist & Criminal Transactions Act of 2008 or the PROTECT Act of 2008 - Amends the federal criminal code to require: (1) the retention for a minimum of 10 years of criminal background check records for known or suspected members of terrorist organizations who attempt to purchase firearms or apply for a state permit to possess, acquire, or carry firearms; and (2) the retention for at least 180 days of other criminal background check records relating to firearms purchases. Repeals certain provisions that require the destruction within 24 hours of identifying information for individuals who legally purchase or possess firearms.

Sportsmanship in Hunting Act of 2008 - Amends the federal criminal code to prohibit anyone, in or substantially affecting interstate or foreign commerce, from knowingly transferring, transporting, or possessing a confined exotic animal for purposes of allowing the killing or injuring of such animal for entertainment or for the collection of a trophy. Exempts the killing or injuring of an exotic animal in a state or federal natural area reserve undertaking habitat restoration from such prohibition. Defines "confined exotic animal" as a mammal of a species not historically indigenous to the United States that has been held in captivity for the majority of its life or for a period of one year. Allows persons authorized by the Secretary of the Interior to make arrests, execute warrants, and search for and seize animals to enforce the provisions of this Act.

PLUS Loan Borrower Protection Act of 2008 - Amends the Higher Education Act of 1965, with respect to eligibility for a PLUS Federal Family Education Loan, to specify an extenuating circumstance for purposes of determining if a borrower has an adverse credit history on the basis of a mortgage loan delinquency or foreclosure. Declares that an extenuating circumstance exists if, at any time from January 1, 2007, through December 31, 2112, the borrower is 90 or more days delinquent on mortgage loan payments, or foreclosure proceedings have been initiated, with respect to the borrower's primary residence.

Teaching and Research Assistant Collective Bargaining Rights Act - Amends the National Labor Relations Act to provide collective bargaining rights for students enrolled at a private institution of higher education who perform work for remuneration at the institution's direction, regardless of whether the work relates to their courses of study (teaching and research assistants).

Hubbard Act - Amends federal employment, armed forces, military pay, and veterans' benefits law to authorize the provision of the following benefits to a member of the Armed Forces who is discharged at the member's request pursuant to a Department of Defense (DOD) policy permitting the early discharge of a member who is the only surviving child in a family in which the father or mother, or one or more siblings, served in the Armed Forces and, incident to such service, was killed, died as a result of wounds, accident, or disease, is in a captured or missing in action status, or is permanently disabled: (1) continued payment, through the original agreed-upon service period, of any bonus, incentive, or similar benefit to which the member was entitled during service; (2) separation pay, even though the member has completed less than six years of active service before discharge; (3) transitional health care, on the same basis as an active-duty member, for 180 days after discharge; (4) transitional commissary and exchange benefits, on the same basis as an active-duty member, for two years after discharge; (5) veterans' housing loan, employment and training, and basic educational assistance; (6) federal unemployment compensation; and (7) veteran's preference for federal employment purposes. Makes this Act effective with respect to any such discharge granted after September 11, 2001.

Designates the third week of April 2008 as National Shaken Baby Syndrome Awareness Week. Commends organizations that are: (1) working to increase awareness of the danger of shaking young children; (2) educating caregivers on protecting children from injuries caused by abusive shaking; and (3) helping families cope with the challenges of child-rearing and other stresses. Encourages people to remember the victims of Shaken Baby Syndrome and to participate in educational programs to help prevent it.

Fisheries Capital Construction Fund Enhancement Act of 2008 - Adds withdrawals for the acquisition of gear or equipment required for safety of life at sea or to comply with conservation measures within a fishery to the list of qualified withdrawals from a vessel capital construction fund. Declares that specified capital acquisition, construction, or reconstruction minimum cost requirements do not apply to withdrawals for such purposes.

Military Personnel Citizenship Processing Act - Amends the Homeland Security Act of 2002 to establish an Office of the FBI Liaison in United States Citizenship and Immigration Services (USCIS), which shall monitor and assist with Federal Bureau of Investigation (FBI) functions related to expeditiously processing naturalization applications filed by members and former members of the Armed Forces. Amends the the Immigration and Nationality Act to require that USCIS, within six months of receipt of a naturalization application filed by a member of the Armed Forces: (1) process and adjudicate the application; or (2) provide the applicant with an explanation for the inability to meet such deadline and an estimate of the adjudication date. Repeals the provisions of this Act five years after the date of enactment of this Act.
